The Operational Divisions of Enterprise provide essential installation, maintenance and management services throughout the public sector and the private sector. Jacques Monsieur, a Belgian national and resident of France suspected of international arms dealing for decades, pleaded guilty today in U.S. District Court for the Southern District of Alabama to conspiracy to illegally export F-5 fighter jet engines and parts from the Untied States to Iran.

Monsieur along with Dara Fotouhi, aka Dara Fatouhi, an Iranian national currently living in France, was charged in a six-count indictment returned on Aug. 27, 2009, with conspiracy, money laundering, smuggling, as well as violations of the Arms Export Control Act (AECA) and the International Emergency Economic Powers Act (IEEPA). Monsieur was arrested by federal agents in August 2009 upon his arrival in New York. Fotouhi remains at large.

According to Monsieur’s factual proffer and the documents filed in court, Monsieur, along with his co-conspirator Fotouhi, are experienced arms dealers who have been actively working with the Iranian government to procure military items for the Iranian government. In February 2009, Monsieur contacted an undercover agent seeking engines for the F-5 (EIF) fighter jet and the C-130 military transport aircraft for export to Iran. Thereafter, Monsieur began having regular e-mail contact with the undercover agent regarding the requested F-5 engines and parts.

In June 2009, Monsieur sent an e-mail to the undercover agent and provided a purchase order for F-5 fighter jet parts from a front company for an organization known as Trast Aero Space, located in Kyrgyzstan. The order requested that the parts be located by the undercover agent and illegally exported to the United Arab Emirates for the transshipment to Iran. The following month, Monsieur contacted the undercover agent indicating that approximately $110,000 had been wired from Dubai to a bank account in Alabama as payment for the parts. He also indicated that a deposit of $300,000 would be forthcoming as a down payment for two F-5 fighter jet engines. In August 2009, Monsieur requested information from the undercover agent about his contact in Colombia for forwarding the aircraft parts from Colombia to the United Arab Emirates.

“Today’s plea underscores the threat posed by Iranian procurement networks and the international arms traffickers who help supply them,” said David Kris, Assistant Attorney General for National Security.

Monsieur faces a maximum penalty of five years in prison and a $250,000.00 fine.

Yesterday the Danish Parliament in Copenhagen passed a hotly disputed “anti-riot law”, less than two weeks before what is shaping up to be the largest single convergence around climate change ever. The law, passed to stymie public protest around the UN climate negotiations in Copenhagen, strips people of civil liberties, freedoms, and sanctions (if not encourages) preemptive arrests for any of the 10,000’s of people expected to arrive in Copenhagen to voice concern, march, take direct action, and participate in the UN climate talks.

The new laws layout is fairly straightforward, and inevitably draws a comparison to unlawful US and UK preemptive arrest actions from the last year.

• Preventive arresting: Under the new law, police can detail people for up to 12 hours without any charges, just because they decide you look like a troublemaker.

• Hindrance of authorities performing their duties: Normally the penalty is a fine. Now, they can hold you for 40 days.

• Breach of the peace, or disorderly behavior while staying around after the police have broken up a demo: They have more than quadrupled fines for staying in a demo that the police have broken up is 403 euro and up to 671 euro if you are showing disorderly behavior.

Additionally (yes there’s more), Danish police said “open-air meetings may be prohibited when it is feared that they may constitute a danger to the public order”.

Another essential information if you are attending the COP15 meetings, KlimaForum09, joining a bike bloc, or just hitting the streets, is that masks in any form are illegal at any demo or protest. This means you can be arrested on your way to a protest or meeting for having a scarf in your pocket. This doesn’t mean that the police will be working with this mandate, but it does mean the law grants them the freedom to do so. All of these developments come on the heels of UK police coming under heavy scrutiny and now official investigation for aggressive tactics during this years G20 protests.

Still craving money to buy stuff on ebay – a crumpler, a D300S, a new MacBook Pro, a new iMac, a 24-70mm Nikkor f/2.8 AF-S lens… Even a new HD camcorder with a large image sensor. But I literally have no cash money, and hence must work with kids till christmas.

Speaking of work, training day from yesterday was longer than expected. We will be working with a Nikon D70 with a 18-75mm lens, an umbrella flash bounce system, an iMac and some other gear. I’ll be in charge of the store on Wednesdays (also known as 2IC Wednesday as all supervisors tend to take their days off on Wednesday). The next issue is the actual Santa set, we’ll be working with the theme of “Aussie Santa” and as a result we’ll not only be working with Santa’s throne…but also Santa’s UTE! We don’t even know how we can really integrate the ute into these photos…Should be interesting how this all goes when my first shift starts on Saturday.

Everything you type and/or view is stored somewhere.  This changes the rules of the game somewhat.  Before this electronic age, people did things and had a probability of getting caught.  In other words, it was a question of if you would get caught.  But today, it’s not a question of if.  It’s a question of when.

Everything online is monitored.  Everything is saved, cached, and archived.  There is no anonymity unless one takes great pains to purposefully create another identity.  Then again, if you had the skills to do so, you wouldn’t be worried about Big Brother anyhow.

En términos generales, todo lo que son marcas, enseñas, lemas o eslogan, sonidos, etc., lo que buscan es una sola cosa: distinguir productos o servicios de un empresario con los de otros empresarios que hagan iguales o similares productos o servicios.

El registro obligatorio: Primero en el tiempo, primero en el derecho!

Todo lo que son marcas, eslogan, etc., pertenecen al empresario, o sea son bienes del Establecimiento de Comercio, pero para ello, es necesario el debido registro. O sea, que se haya registrado dicha marca, símbolo, enseña, soneto, etc. para que legalmente le pertenezca.

Dicho registro se debe hacer ante la Superintendencia de Industria y Comercio, quien verificará si dicha marca, lema, símbolo, etc., ya no esté registrado para otro producto o servicio igual o similar. Es importante anotar, que el valor del registro de estos, en muchos casos no excede de 2 s.m.m.l.v.

El derecho sobre una marca, lema, etc., no lo da su uso continuo, sino su registro, de tal manera que si dos empresarios están usando un mismo lema para igual producto, el derecho lo tendrá el que primero lo registre ante la Superintendencia de Industria y Comercio.

Estos derechos sobre una marca, lema, enseña, sonidos, etc., debidamente registrados, son de uso exclusivo por 10 años, pero se puede renovar por dicho término todas las veces que se quiera, tiempo en el cual otros no lo pueden utilizar, ni pretender registrar.

Definamos varios términos que son susceptibles de registro por parte del empresario.

Marca: Son bienes o servicios que produce un comerciante, pero que le agrega su propia marca para poderlo distinguir de otros que hacen igual o similares productos o servicios. Dicha marca sólo es en el nombre del producto o servicio, sino también en la forma o colores particulares del producto “un buñuelo cuadrado” o puede ser la forma del envase, empaque o envolturas (botella de una bebida, una caja triangular de chocolates, etc.), diferenciando la forma común o tradicional del producto o su empaquetamiento.

Las marcas también pueden ser sonoras, por eso es que escuchamos algún sonido en radio o televisión y siempre lo asociaremos con un mismo producto o servicio, pues el empresario lo registró para que otros no lo utilicen.

Ejemplo:

Almacenes Éxito tiene varias marcas propias, obviamente que dichos productos también los hacen otros empresarios (Ej. Finlandek, hogar con sentido. Notes Collectión, productos para estudio y oficina, entre otras marcas)

Los bancos tienen muchos productos y servicios, como variedad en créditos, tarjetas, chequeras, pero cada uno de estos servicios tienen un nombre en particular que le han dado, de tal manera que dichos nombres de esos productos o servicios los han registrado como marcas.

La letra o incluso el simple sonido de la canción de la Margarina La Fina no puede ser usada por otra empresa.

Enseña comercial: Es un signo que siendo perceptible por el sentido de la vista sirve para identificar a un establecimiento mercantil. Este signo puede ser una palabra, letras, números dibujos, imágenes, formas, colores, logotipos, figuras, símbolos, gráficos, monogramas, retratos, etiquetas, emblemas, escudos, o combinación de estos elementos.

Ejemplo:

Lema comercial o Eslogan: Es un signo distintivo consistente en una palabra, frase o leyenda que se utiliza como complemento de una marca.  Este lema complementa o fortalece la función de distinguir la marca con la que se está asociado.

Ejemplos:

Harina haz de trigo haz de oro, rinde, rinde, rinde que da gusto.

Estrenando, no vel rosita

Para la mayoría de la gente, el amparo es algo así como un misterio.  Es algo que todo mundo sabe que existe pero relativamente poca gente entiende qué es y para qué sirve.  En esta serie de artículos iré tocando los diversos aspectos del juicio de amparo mexicano.

Aquí encontrarás la primera parte aquí la segunda parte de esta serie de artículos.

Como lo he mencionado antes, el juicio de amparo es un medio de control constitucional y su objetivo es integrar a los límites establecidos por la constitución aquellas situaciones provocadas por autoridades gubernamentales que violan los derechos fundamentales de la población y que, por tanto, son inconstitucionales.

El beneficio es solo para el que lo pide.

En esta ocasión abordaremos el muy famoso “principio de la relatividad de las sentencias de amparo”.  Que significa esto?  Pues muy sencillo… una sentencia de amparo únicamente beneficia a aquella persona que promovió el juicio y no así todos los demás, aunque se encuentren dentro de la misma situación de inconstitucionalidad.

Lo anterior se encuentra regulado, constitucionalmente, en el artículo 107, fracción II que establece:

“Artículo 107. Todas las controversias de que habla el Artículo 103 se sujetarán a los procedimientos y formas del orden jurídico que determine la ley, de acuerdo a las bases siguientes:

II. La sentencia será siempre tal, que sólo se ocupe de individuos particulares, limitándose a ampararlos y protegerlos en el caso especial sobre el que verse la queja, sin hacer una declaración general respecto de la ley o acto que la motivare.”

El Poder Judicial de la Federación, en diversos criterios a sostenido que el principio de relatividad de las sentencias de amparo debe interpretarse en el sentido de que ésta, cuando otorgue el amparo, tiene un alcance relativo ya que sólo protegerá al quejoso que haya promovido el juicio.

Ahora bien, es importante tomar en cuenta que los actos de autoridad inconstitucionales pudieran ser de diversos tipos, entre ellos, una ley, reglamento, etc., un acto aislado fuera de juicio o actos dentro de juicios (o procedimientos análogos).

Cuando se trata de leyes, reglamentos, etc., los efectos de la sentencia que otorgue el amparo al quejoso serán los de protegerlo no sólo contra los actos específicos de aplicación que haya impugnado, ya que la declaración de amparo tendrá consecuencias jurídicas en relación con los actos de aplicación futuros, lo que significa que la ley ya no podrá válidamente ser aplicada al demandante que obtuvo la protección constitucional.

Prohibición de declaraciones generales de inconstitucionalidad.

El principio de instancia de parte agraviada (del que platicamos en la segunda parte de esta serie) y el de relatividad de las sentencias de amparo, prohíben hacer una declaración general de la constitucionalidad o inconstitucionalidad de la ley o del acto reclamado y los efectos que debe tener la sentencia dictada en un juicio que conceda el amparo.

Por todo lo anterior, para que proceda un juicio de amparo es necesario que los promoventes acrediten su “interés jurídico” para que, en su caso, la protección del amparo se dé respecto de personas determinadas y en forma particularizada.

Cabe mencionar que, desde hace años, existen iniciativas de ley para reformar tanto la constitución como la ley de amparo buscando eliminar el principio de relatividad de las sentencias para que, cuando una ley u otro cuerpo normativo general se declare inconstitucional, dicha declaración beneficie a todos los gobernados.  La verdad es que resulta ilógico que, aun en nuestros tiempos, subsista el principio de relatividad dentro del juicio de amparo mexicano.

Recordemos que el juicio de amparo tiene como fin proteger a los gobernados de los actos de autoridad que sean violatorios de la constitución.  Siendo así, esperemos que pronto sean aprobadas las reformas para eliminar el principio de relatividad de las sentencias.

…instead of learning lessons from 26/11 and committing itself to non-repetition of such incident, Pakistani rulers are busy in finding the possible ‘hand’ of India behind the disturbance & terror attacks in Pakistan, even if a Pak based terror group takes the responsibility of the attacks.

Here again, I want to talk about the testimony of the defence minister of Pakistan, Ahmed Mukhtar after 26/11 in which he publicly accepted that had the Jamaat-ud-Dawa, the parent organization of the LeT, not been banned, Pakistan would have been declared a terrorist state. As a result of such wrong decisions of nurturing terrorism, today the current and former Pakistani rulers are being seen saying that Pakistan needs sympathy, not accusations and criticism. No doubt, India has full sympathy with Pakistan but first Pakistan will have to liberate itself from such fracas jihadis so that peace can prevail in Pakistan and India too can be saved from the repetition of 26/11.
