<content:encoded><![CDATA[<div class='snap_preview'><p>BEIJING – China has executed two men for abducting and selling 15 children, many of whom were taken as babies or toddlers and have not yet been reunited with their parents, state media said Friday.</p>
<p>The official Xinhua News Agency said Hu Minghua, 55, and Su Binde, 27, were executed Thursday morning, according to a statement from the Supreme People&#8217;s Court.</p>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"><img class="alignnone size-medium wp-image-320" title="ChineseChildren" src="http://abpworld.wordpress.com/files/2009/11/chinesechildren.jpg?w=300" alt="" width="351" height="235" /></a></p>
<p>Hu was convicted of kidnapping and selling nine children from April 1999 to Oct. 2005. He was detained in January 2006. Five of the children, all boys now aged from 3 to 6, have been returned to their families, while the parents of the remaining ones have not been found.</p>
<p>Su was convicted of abducting six children between Sept. 2005 to July 2006. Five of the children were rescued by police while a sixth remains missing.</p>
<p>Child trafficking is big problem in China, where traditional preference for male heirs and a restrictive one-child policy has driven a thriving market in baby boys, who fetch a considerably higher price than girls. Girls and women also are abducted and often used as laborers or as brides for unwed sons.</p>
<p>Thousands of children go missing every year though the exact numbers of victims are difficult to obtain. Earlier this year, Chinese police announced they had rescued about 2,000 abducted children as part of a nationwide crackdown on widespread trafficking of women and children.</p>
<p>In October, China&#8217;s Ministry of Public Security set up a Web site — &#8220;Babies Looking for Home&#8221; — to reunite rescued children with their families.</p>
<p>State media have reported hundreds of rescues and arrests since the campaign began in April, and the new site had photos of dozens of children rescued from kidnappers but who had not yet found their families. The ministry set up a national DNA database earlier this year.</p>

<title><![CDATA[How to Win a Hague Convention Child Abduction Case]]></title>

<h5>Here are some tips for attorneys and clients faced with instituting or defending child abduction proceedings under the Hague Convention on the Civil Aspects of International Child Abduction, whether in the United States or internationally.</h5>
<h5>In a nutshell, a Hague Convention application may be made when a child is taken or retained across an international border, away from his or her habitual residence, without the consent of a parent who has rights of custody, if the two countries are parties to the Convention. The child must be promptly returned to the habitual residence unless the return will create a grave risk of harm to the child.</h5>
<p><strong>1. ACT FAST</strong></p>
<h5>An attorney must be ready to file a Hague Convention application and institute or defend a Hague Convention lawsuit on extremely short notice.</h5>
<h5>Prompt action may be critical. The Convention specifically requires that hearings be conducted expeditiously. A Hague case can theoretically be instituted more than a year after the abduction but a defense will then arise that the child has become settled in the new environment and, in practice, the longer a child is in a new place the more likely it is that a court will be reluctant to send the child away.</h5>
<h5>Fast action by the left-behind parent is also necessary to help prevent a claim that the parent has acquiesced in the child’s relocation.</h5>
<h5>Clients must move quickly to obtain the documents needed to file the initial application and then to collect the documents needed for the hearing. They should normally be asked to prepare a detailed family history and to assist the attorney to develop evidence as rapidly as possible.</h5>
<h5>In addition to the Hague application and lawsuit itself, counsel for the left-behind parent should take many other steps.</h5>
<h5>First, counsel should enlist the support of the U.S. State Department’s Office of Children’s Issues. Second, the left-behind parent should institute civil proceedings. If there is no custody order in place from a court in the jurisdiction of the habitual residence, an application should immediately be made for such an order.</h5>
<h5>Third, counsel should consider putting the abducting parent on immediate written and formal notice of the dire consequences, civil, criminal and financial, that the abduction will cause to that parent personally, and, possibly to others conspiring with the parent. It may be appropriate to provide an extremely short time for the abducting parent to cure the problem by returning the child.</h5>
<h5>Fourth, the parent should consider requesting the federal and state prosecutors to institute both federal and state criminal proceedings. The federal crime of international parental kidnapping is a felony with a penalty of up to three years in prison. In addition, many states including New York have provisions that also provide criminal penalties for parental child abduction. It will occasionally be possible to seek extradition based on a federal warrant.</h5>
<p><strong>2. PREPARE THE FACTUAL PRESENTATION INTENSELY</strong></p>
<h5>Hague Convention cases are often extremely fact-intensive. They frequently hinge on the ability of one party to convince the court of matters such as the habitual residence of a child, the extent to which a parent actually exercised custody rights and whether or not a parent consented to or acquiesced in a new residency. For a court to resolve these matters it must analyze the relevant facts.</h5>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"><img class="alignnone size-medium wp-image-313" title="cover2" src="http://abpworld.wordpress.com/files/2009/11/cover21.jpg?w=300" alt="" width="407" height="269" /></a></p>
<h5>A successful Hague proceeding requires the attorney, working closely with the client, to marshal as much evidence as possible, in as many forms as possible, to support the client’s position.</h5>
<h5>Clients are frequently shocked that matters that to them are obvious and indisputable turn out to be disputed and to require them to produce clear and convincing proof. They may well be insulted that their word alone is insufficient to convince the court that they are truthful and that the other parent is lying.</h5>
<h5>In one case, the parents had moved permanently with their young child from the mother’s native country to the U.S. Two years later, the mother took the child back to her country for a vacation and then refused to return to the States. In supporting her claim that the child was never habitually resident in the States she claimed that the original move to America had been only temporary and that she and the father had agreed that they would return to the mother’s native country after a year or two. The mother had planned the move well in advance and had amassed — and even created — evidence that tended to support her claims. Additionally, she had removed evidence from the parties’ home that would have disproved her claims.</h5>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"></a></p>
<h5>To win the case, we interviewed neighbors, friends, family members, schoolteachers, real estate salespeople, fellow office workers and an array of other people who had had some connection with the family. We checked into any and all areas of the mother’s life for anything that might indicate her intention to stay in the States. We obtained emails, notes, invoices, and other documents. We searched old household bills for evidence of the purchase of items that inferred a degree of permanency. At the hearing, the mother was shocked that her husband had collected so much written evidence to disprove her claims and undercut her credibility. The courts ultimately — and with great reluctance, since they were going against a local national — found in favor of our client.</h5>
<h5>Since Hague cases are tried quickly, there is usually only one chance to present the case and it needs to be done well at the very outset. An attorney must embark on a quick campaign of collecting mounds of relevant evidence to support the client’s positions, and must expect the other parent to lie, cheat, and distort the facts in a desperate attempt to avoid losing the case.</h5>
<h5>Just as a current military strategy is to employ overwhelming force to create shock and awe, so too in a Hague Convention case it is often advisable to use overwhelming amounts of evidence to win the case. Such a campaign in a Hague proceeding may yield a capitulation by the other parent even before the hearing actually commences.</h5>
<h5>Hague Convention hearings sometimes take the form of “he said, she said” disputes in which each side makes verbal accusations against the other. Documentary evidence is usually far better than the mere word of one parent. Thus, if you want to claim that a parent applied for an immigration visa, you must be prepared to do more than simply have the parent tell the court that this was done. You should do whatever you can to get hold of the actual application papers that the parent signed in applying for the visa, which may mean contacting the lawyer who handled the immigration matter originally.</h5>
<h5>While it is helpful if documents are supported by sworn statements, it is not essential. Both the Convention and the International Child Abduction Remedies Act (“ICARA”) provide that authentication of documents is not required in a Convention proceeding.</h5>
<p><strong>3. PREPARE THE LEGAL ARGUMENT INTENSELY</strong></p>
<h5>Hague Convention cases raise unusual international law, foreign law and treaty law questions. They involve the courts in matters of a kind that they are usually not used to handling. In many jurisdictions the court may be entirely unfamiliar with Hague cases. Accordingly it is usually essential for the lawyers to help the court to an unusual extent. Certainly a well-reasoned memorandum of law is essential.</h5>
<h5>The matters in dispute in most Hague cases raise difficult legal issues that must be thoroughly briefed. Thus, the Convention requires the left-behind parent to establish that the child was taken from the “habitual residence” and that the parent had “rights of custody” under the law of that jurisdiction. However, neither of those fundamental terms is defined in the Convention and substantial jurisprudence has grown domestically and internationally setting forth often-contradictory determinations concerning their scope and meaning. Moreover, courts have held that, while they must determine under international law whether the left-behind parent possesses Hague Convention “custody rights,” they must first examine the law of the child’s habitual residence in order to ascertain the extent of the rights that such parent possesses under that law. In this regard, it is often essential to use foreign law experts to establish the existence and scope of such rights.</h5>
<h5>A Hague Convention attorney may ” and should ” cite cases not only from the domestic jurisdiction but also from other jurisdictions if they support the client’s position. It has become more usual to cite cases from other jurisdictions in this area of the law than perhaps in any other. Courts around the world recognize that it is best to coordinate their decisions with those of other courts internationally and, for that very reason, the Hague Conference on Private International Law has established a database of significant Hague cases from courts around the world.</h5>
<p><strong>4. AVOID BEST INTERESTS ANALYSIS </strong></p>
<h5>In representing the left-behind parent in a Hague proceeding, it is necessary to keep the court focused on the narrow issues that the Convention requires an applicant to establish and the narrow defenses that a respondent can assert. Whenever the hearing strays into any areas that might be considered as constituting an analysis of the child’s best interests, the applicant should vehemently object.</h5>
<h5>However, a party opposing a return should do his or her utmost to assert any and all relevant issues under the rubric of one of the defenses specified in the Convention and should be armed with case law to establish that similar claims were permitted in other cases.</h5>
<p><strong>5. BE FLEXIBLE CONCERNING EVIDENCE </strong></p>
<h5>In Hague cases evidence rules are usually relaxed, so evidence should be submitted in any possible format. Live testimony is invariably the best and normally everything should be done to get the left-behind parent into the courtroom. (An exception is if that parent would be a poor witness and his or her presence would create an opportunity for embarrassing cross-examination). If a witness cannot be brought to the courthouse, consider testimony by video conferencing or otherwise by telephone conference. As a last resort, submit affidavits.</h5>
<p><strong>6. USE AN EXPERIENCED ATTORNEY: IF THAT’S NOT YOU, FIND SOMEONE WHO IS</strong></p>
<h5>Hague Convention cases happen too fast, and too much is at stake for the client, for an attorney to learn about this area of law at the last minute. It is extremely important to locate counsel with knowledge and experience in Hague proceedings.</h5>

Some authorities say that if your child is abducted, you should follow procedures outlined by the Hague, but we don’t agree.</p>
<p>Until 1980, there was no international system in place to help parents recover abducted children who had been taken to other nations. The Hague Convention attempted to create one, but it doesn’t work. If you take the time to read the well-intentioned text of the Hague, you’ll see its many flaws.</p>

<p>In our opinion, it’s not worth the large amounts of money, time and trouble to hire an attorney to try using the Hague Convention to get your child back. You aren’t likely to get him or her back — and even worse, the abducting parent could be “legitimized” by the courts in another nation.</p>

<p>Under the Hague Convention, a case must be filed in the country where the abductor has taken the child. The courts of that country tend to render their decisions in favor of their countrymen, as the Hague Convention focuses on residency, not citizenship. There is little concern for the fact that the child is a citizen of the country from which he or she was abducted, or for the possible detrimental effect on the child.</p>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"></a></p>
<p>Even if the child was born in your country, if that child is found to be a “habitual resident” by the courts in another country, the child may be ordered to be returned to that country.</p>
<p>This underscores the need to act quickly.</p>
<p>Few, if any, of the Hague signatory countries are going to send anyone out to physically recover your child for you. Embassy officials will check on the child’s welfare, if it is known where the child is and if the abducting parent lets them.</p>
<p>As soon as abducting parents are aware that that they’ve been located, they’ll usually disappear with the children again.</p>
<p><strong>And about hiring lawyers</strong></p>
<p>You need to be aware that a great amount of money has been spent on lawyers in foreign abduction cases. The unfortunate fact is that they, most often, can’t practice in the foreign courts and are required to hire associate lawyers in the foreign country.</p>
<p>Note: they often have no qualifications or experience working with child abduction cases.</p>

<p><strong>Educate yourself</strong></p>
<p>Many resources are available to help you learn about parental child abduction. If you’re dealing with an abduction, the better informed you are, the better equipped you’ll be to cope.</p>
<p><strong>Recover your child</strong></p>
<p>Time is of the essence. Parentally abducted children are helpless on their own and confused by the irrational and sometimes abusive acts of non-custodial parents who are supposed to have their best interests in mind. <title><![CDATA[Parental Alienation Syndrome: How to Detect It and What to Do About It]]></title>

<p><span style="font-size:large;"><span style="font-size:small;">Although parental alienation syndrome (PAS) is a familiar term, there is still a great deal of confusion and unclarity about its nature, dimensions, and, therefore, its detection.(<a href="http://www.fact.on.ca/Info/pas/walsh99.htm#1">1</a>) Its presence, however, is unmistakable. In a longitudinal study of 700 &#8220;high conflict&#8221; divorce cases followed over 12 years, it was concluded that elements of PAS are present in the vast majority of the samples.(<a href="http://www.fact.on.ca/Info/pas/walsh99.htm#2">2</a>) Diagnosis of PAS is reserved for mental health professionals who come to the court in the form of expert witnesses. Diagnostic hallmarks usually are couched in clinical terms that remain vague and open to interpretation and, therefore. susceptible to argument pro and con by opposing experts. The phenomenon of one parent turning the child against the other parent is not a complicated concept, but historically it has been difficult to identify clearly. Consequently, cases involving PAS are heavily litigated, filled with accusations and counter accusations, and thus leave the court with an endless search for details that eventually evaporate into nothing other than rank hearsay. It is our experience that the PAS phenomenon leaves a trail that can be identified more effectively by removing the accusation hysteria, and looking ahead in another positive direction.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">For the purpose of this article the authors are assuming a fair degree of familiarity with parental alienation syndrome on the part of the reader.(<a href="http://www.fact.on.ca/Info/pas/walsh99.htm#3">3</a>) There are many good writings on PAS which the reader may wish to consult now or in the future for general information. Our focus here is much more narrow. Specifically, the goal is twofold. First we will describe four very specific criteria that can be used to identify potential PAS. In most instances, these criteria can be identified through the facts of the case, but also can be revealed by deposition or court testimony. Secondly, we wish to introduce the concept of &#8220;attempted&#8221; PAS; that is when the criteria of PAS are present, but the child is not successfully alienated from the absent parent. This phenomenon is still quite harmful and the fact of children not being alienated should not be viewed as neutral by the court.</span></span></p>

<p><span style="font-size:large;"><span style="font-size:small;">The criteria described below are fairly easy to identify separate and apart from the court file. When there is uncertainty about any of them, these criteria can be used to guide the attorney in the deposing of witnesses as well as in their examination in court.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;"><strong>Criteria I: Access and Contact Blocking</strong></span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">Criteria I involves the active blocking of access or contact between the child and the absent parent. The rationale used to justify it may well take many different forms. One of the most common is that of protection. It may be argued that the absent parent&#8217;s parental judgment is inferior and, therefore, the child is much worse off from the visit. In extreme cases, this will take the form of allegations of child abuse, quite often sexual abuse. This will be addressed in more detail in Criteria II, but suffice it to say that often this is heard as a reason for visitation to be suspended or even terminated. On a more subtle and common level, an argument heard for the blocking of visitation is that seeing the absent parent is &#8220;unsettling&#8221; to the child, and that they need time &#8220;to adjust.&#8221; The message here is that the absent parent is treated less like a key family member and more like an annoying acquaintance that the child must see at times. Over time, this pattern can have a seriously erosive effect on the child&#8217;s relationship with the absent parent. An even more subtle expression of this is that the visitation is &#8220;inconvenient,&#8221; thereby relegating it to the status of an errand or chore. Again the result is the erosion of the relationship between the child and the absent or &#8220;target&#8221; parent. One phenomenon often seen in this context is that any deviation from the schedule is used as a reason to cancel visitation entirely.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">The common thread to all of these tactics is that one parent is superior and the other is not and, therefore, should be peripheral to the child&#8217;s life. The alienating parent in these circumstances is acting inappropriately as a gatekeeper for the child to see the absent parent. When this occurs for periods of substantial time, the child is given the unspoken but clear message that one parent is senior to the other. Younger children are more vulnerable to this message and tend to take it uncritically; however, one can always detect elements of it echoed even into the teenage years. The important concept here is that each parent is given the responsibility to promote a positive relationship with the other parent. When this principle is violated in the context of blocking access on a consistent basis, one can assume that Criteria I has been, unmistakably identified.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;"><strong>Criteria II: Unfounded Abuse Allegations</strong></span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">The second criteria is related to false or unfounded accusations of abuse against the absent parent. The most strident expression of this is the false accusation of sexual abuse.(<a href="http://www.fact.on.ca/Info/pas/walsh99.htm#4">4</a>) It has been well studied that the incident of false allegations of sexual abuse account for over half of those reported, when the parents are divorcing or are in conflict over some post dissolution issue.(<a href="http://www.fact.on.ca/Info/pas/walsh99.htm#5">5</a>) This is especially the situation with small children who are more vulnerable to the manipulations implied by such false allegations. When the record shows that even one report of such abuse is ruled as unfounded, the interviewer is well advised to look for other expressions of false accusations.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">Other examples of this might be found in allegations of physical abuse that investigators later rule as being unfounded. Interestingly our experience has been that there are fewer false allegations of physical abuse than of other forms of abuse, presumably because physical abuse leaves visible evidence. It is, of course, much easier to falsely accuse someone of something that leaves no physical sign and has no third party witnesses.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">A much more common expression of this pattern would be that of what would be termed emotional abuse. When false allegations of emotional abuse are leveled, one often finds that what is present is actually differing parental judgment that is being framed as &#8220;abusive&#8221; by the absent parent. For example, one parent may let a child stay up later at night than the other parent would, and this scheduling might be termed as being &#8220;abusive&#8221; or &#8220;detrimental&#8221; to the child. Or one parent might introduce a new &#8220;significant other&#8221; to the child before the other parent believes that they should and this might also be called &#8220;abusive&#8221; to the child. Alternatively one parent might enroll a child in an activity with which the other parent disagrees and this activity is, in actuality, a difference of parental opinion that is now described as being abusive in nature. These examples, as trivial as they seem individually, may be suggestive of a theme of treating parental difference in inappropriately subjective judgmental terms. If this theme is present, all manner of things can be described in ways that convey the message of abuse, either directly or indirectly. When this phenomenon occurs in literally thousands of different ways and times, each of which seems insignificant on its own, the emotional atmosphere that it creates carries a clearly alienating effect on the child.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">Obviously, this type of acrimony is very common in dissolution actions but such conflict should not necessarily be mistaken or be taken as illustrative of the PAS syndrome; however, the criteria is clearly present and identifiable when the parent is eager to hurl abuse allegations, rather than being cautious, careful. and even reluctant to do so. This latter stance is more in keeping with the parent&#8217;s responsibility to encourage and affirmatively support a relationship with the other parent. The responsible parent will only allege abuse after he or she has tried and failed to rationalize why the issue at hand is not abusive. Simply put, the responsible parent will give the other parent the benefit of the doubt when such allegations arise. He or she will, if anything, err on the side of denial, whereas the alienating parent will not miss an opportunity to accuse the other parent. When this theme is present in a clear and consistent way, this criteria for PAS is met.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;"><strong>Criteria III: Deterioration in Relationship Since Separation</strong></span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">The third of the criteria necessary for the detection of PAS is probably the least described or identified, but critically is one of the most important. It has to do with the existence of a positive relationship between the minor children and the now absent or nonresidential parent, prior to the marital separation; and a substantial deterioration, of it since then. Such a recognized decline does not occur on its own. It is, therefore, one of the most important indicators of the presence of alienation as well. as a full measure of its relative &#8220;success.&#8221; By way of example, if a father had a good and involved relationship with the children prior to the separation, and a very distant one since, then one can only assume without explicit proof to the contrary that something caused it to change. If this father is clearly trying to maintain a positive relationship with the children through observance of visitation and other activities and the children do not want to see him or have him involved in their lives, then one can only speculate that an alienation process may have been in operation. Children do not naturally lose interest in and become distant from their nonresidential parent simply by virtue of the absence of that parent. Also, healthy and established parental relationships do not erode naturally of their own accord. They must be attacked. Therefore, any dramatic change in this area is virtually always an indicator of an alienation process that has had some success in the past. </span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">Most notably, if a careful evaluation of the pre-separation parental relationship is not made, its omission creates an impression that the troubled or even alienated status that exists since is more or lees an accurate summary of what existed previously. Note that nothing could be further from the truth! An alienated or even partially or intermittently alienated relationship with the nonresidential parent and the children after the separation is more accurately a distortion of the real parental relationship in question. Its follow-through is often overlooked in the hysterical atmosphere that is often present in these cases. A careful practitioner well knows that a close examination is warranted and that it must be conducted with the utmost detail and scrutiny.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">If this piece of the puzzle is left out, the consequences can be quite devastating for the survival of this relationship. Also, without this component, the court can be easily swayed into premature closure or fooled into thinking that the turmoil of the separation environment is representative of the true parent-child relationship. Once this ruling is made by the court, it is an exacting challenge to correct its perception.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">In a separate but related issue, a word should be said about the use of experts. First, it must be understood that all mental health professionals are not aware of nor know how to treat the PAS phenomenon. In fact, when a mental health professional unfamiliar with PAS is called upon to make a recommendation about custody, access, or related issues, he or she potentially can do more harm than good. For example, if the psychologist fails to investigate the pre-separation relationship of the nonresidential parent and the children, he or she may very easily mistake the current acrimony in that relationship to be representative of it, and recommend that the children should have less visitation with that parent, obviously supporting the undiagnosed PAS that is still in progress. If that expert also fails to evaluate critically the abuse claims or the agenda of the claimant, they may be taken at face value and again potentially support the undiagnosed PAS. If that professional is not also sensitive to the subtleties of access and contact blocking as its motivator, he or she may potentially support it, thereby contributing to the PAS process. When these things occur, the mental health professional expert has actually become part of the PAS, albeit unwittingly. Alarmingly, this happens often. Suffice it to say, if PAS is suspected, the attorney should closely and carefully evaluate the mental health professional&#8217;s investigation and conclusion. Failure to do so can cause irreparable harm to the case, and, ultimately to the children.</span></span></p>

<p><span style="font-size:large;"><span style="font-size:small;"><strong>Criteria IV: Intense Fear Reaction by Children</strong></span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">The fourth criteria necessary for the detection of PAS is admittedly more psychological than the first three. It refers to an obvious fear reaction on the part of the children, of displeasing or disagreeing with the potentially alienating parent in regard to the absent or potential target parent. Simply put, an alienating parent operates by the adage, &#8220;My way or the highway.&#8221; If the children disobey this directive, especially in expressing positive approval of the absent parent, the consequences can be very serious. It is not uncommon for an alienating parent to reject the child(ren), often telling him or her that they should go live with the target parent. When this does occur one often sees that this threat is not carried out, yet it operates more as a message of constant warning. The child, in effect, is put into a position of being the alienating parent&#8217;s &#8220;agent&#8221; and is continually being put through various loyalty tests. The important issue here is that the alienating patent thus forces the child to choose parents. This, of course, is in direct opposition to a child&#8217;s emotional well being.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">In order to fully appreciate this scenario, one must realize that the PAS process operates in a &#8220;fear based&#8221; environment. It is the installation of fear by the alienating parent to the minor children that is the fuel by which this pattern is driven; this fear taps into what psychoanalysis tell us is the most basic emotion inherent in human nature&#8211;the fear of abandonment. Children under these conditions live in a state of chronic upset and threat of reprisal. When the child does dare to defy the alienating parent, they quickly learn that there is a serious price to pay. Consequently, children who live such lives develop an acute sense of vigilance over displeasing the alienating parent. The sensitized observer can see this in visitation plans that suddenly change for no apparent reason. For example, when the appointed time approaches, the child suddenly changes his or her tune and begins to loudly protest a visit that was not previously complained about. It is in these instances that a court, once suspecting PAS must enforce in strict terms the visitation schedule which otherwise would not have occurred or would have been ignored.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">The alienating parent can most often be found posturing bewilderment regarding the sudden change in their child&#8217;s feelings about the visit. In fact, the alienating parent often will appear to be the one supporting visitation. This scenario is a very common one in PAS families. It is standard because it encapsulates and exposes, if only for an instant, the fear-based core of the alienation process. Another way to express this concept would be that whenever the child is given any significant choice in the visitation, he or she is put in the position to act out a loyalty to the alienating parent&#8217;s wishes by refusing to have the visitation at all with the absent parent. Failure to do so opens the door for that child&#8217;s being abandoned by the parent with whom the child lives the vast majority of the time. Children, under these circumstances, will simply not opt on their own far a free choice. The court must thus act expeditiously to protect them and employ a host of specific and available remedies.(<a href="http://www.fact.on.ca/Info/pas/walsh99.htm#6">6</a>)</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">As a consequence of the foregoing, these children learn to manipulate. Children often play one parent against the other in an effort to gain some advantage. In the case of PAS, the same dynamic operates at more desperate level. No longer manipulating to gain advantage, these children learn to manipulate just to survive. They become expert beyond their years at reading the emotional environment, telling partial truths, and then telling out-and-out lies. One must, however, remember that these are survival strategies that they were forced to learn in order to keep peace at home and avoid emotional attack by the residential parent. Given this understanding, it is perhaps easier to see why children, in an effort to cope with this situation, often find it easier if they begin to internalize the alienating parent&#8217;s perceptions of the absent parent and begin to echo these feelings. This is one of the most compelling and dramatic effects of PAS, that is, hearing a child vilifying the absent parent and joining the alienating parent in such attacks. If one is not sensitive to the &#8220;fear-based&#8221; core at the heart of this, it is difficult not to take the child&#8217;s protests at face value. This, of course, is compounded when the expert is also not sensitive to this powerful fear component, and believes that the child is voicing his or her own inner feelings in endorsing the &#8220;no visitation&#8221; plan.</span></span></p>

<p><span style="font-size:large;"><span style="font-size:small;"><strong>Conclusion</strong></span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">All the criteria listed above can be found independent of each other in highly contested dissolutions, but remember that the appearance of some of them does not always constitute PAS. When all four are clearly present, however, add the possibility of real abuse has been reasonably ruled out, the parental alienation process is operative. This does not necessarily mean, however, that it is succeeding in that the children are being successfully alienated from the target parent. The best predictor of successful alienation is directly related to the success of the alienating parent at keeping the children from the target parent. When there are substantial periods in which they do not see the other parent, the children are more likely to be poisoned by the process. Another variable that predicts success is the child&#8217;s age. Younger children generally are more vulnerable than older ones. Also, another variable is the depth and degree of involvement of the pre-separation parent-child relationship. The longer and more involved that relationship, the less vulnerable will be the children to successful alienation. The final predictor is the parental tenacity of the target parent. A targeted parent often gives up and walks away, thus greatly increasing the chances of successful alienation.</span></span></p>
<p><span style="font-size:large;"><span style="font-size:small;">The question remains: What if all four criteria are present, but the children are not successfully alienated? Should this failure at alienation be seen as nullifying the attempt at alienation? The answer to that should be a resounding &#8220;No!&#8221; It should be, but often it is not. It is very common to read a psychological evaluation or a GAL&#8217;s report that identified PAS but then notes that since it was not successful, it should not be taken very seriously. Nothing could be further from the truth. Any attempt at alienating the children from the other parent should be seen as a direct and willful violation of one of the prime duties of parenthood, which is to promote and encourage a positive and loving relationship with the other parent, and the concept of shared parental responsibility.</span></span></p>

<p><strong>International Parental Child Abduction Is Illegal</strong></p>
<p>Under the laws of the United States and many foreign countries, international parental child abduction is crime.  Removing a child from the United States against another parent&#8217;s wishes can be considered a crime in every U.S. state.  In some cases an abducting parent may be charged with a Federal crime under the <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00001204----000-.html">International Parental Kidnapping Crime Act</a> (IPKCA).  This can be the case even when neither parent holds a custody decree prior to the abduction. Nevertheless, a custody decree can be helpful to prevent an international parental child abduction, or to recover your child if he/she is abducted.</p>
<p><strong>The Importance of a Custody Decree</strong></p>
<p>A well-written custody decree is an important line of defense against international parental child abduction. In your custody decree, it may be advisable to include a statement that prohibits your child from traveling abroad without your permission or that of the court. Ask your attorney if you should obtain a decree of sole custody or a decree that prohibits the travel of your child without your permission or that of the court.  If you have or would prefer to have a joint custody decree, you may want to make certain that it prohibits your child from traveling abroad without your permission or that of the court.</p>
<p>If your child is at risk of being taken to a country that partners with the United States under the <a href="http://www.hcch.net/index_en.php?act=conventions.text&#38;cid=24">Hague Convention on the Civil Aspects of International Child Abduction</a> (Hague Abduction Convention), your custody decree should include the terms of the Hague Abduction Convention that apply if                            there is an abduction or wrongful retention (<a href="http://travel.state.gov/family/abduction/hague_issues/hague_issues_1487.html">see country list</a>).</p>
<p>The American Bar Association also suggests requesting the court, if the other parent is not a U.S. citizen or has significant ties to a foreign country, to require that parent to post a bond. This may be useful both as a deterrent to abduction and, if forfeited because of an abduction, as a source of revenue for you in your efforts to locate and recover your child.</p>
<p>REMINDER: Obtain several certified copies of your custody decree from the court that issued it. Give a copy to your child&#8217;s school                            and advise school personnel to whom your child may be released.</p>
<p><strong>Two Parent Signature Law for a Passport</strong></p>
<p>The United States does not have exit controls on its borders for holders of a valid passport.  This makes preventing a passport from being issued to your child without your consent very important.  Generally, if your child has a passport, it can be difficult to prevent the other parent from removing the child to another country without your permission.</p>
<p>U.S. law requires the signature of both parents, or the child&#8217;s legal guardians, prior to issuance of a U.S. passport to children under the age of 16.  To obtain a U.S. passport for a child under the age of 16, both parents (or the child’s legal guardians) must execute the child’s passport application and provide documentary evidence demonstrating that they are the parents or guardians.  If this cannot be done, the person executing the passport application must provide documentary evidence that he or she has sole custody of the child, has the consent of the other parent to the issuance of the passport, or is acting in place of the parents and has the consent of both parents (or of a parent/legal guardian with sole custody over the child to the issuance of the passport).</p>
<p>EXCEPTIONS: The law does provide two exceptions to this requirement: (1) for exigent circumstances, such as those involving the health or welfare of he child, or (2) when the Secretary of State determines that issuance of a passport is warranted by special family circumstances.</p>

<p><strong>Children&#8217;s Passport Issuance Alert Program</strong></p>
<p>You may also ask that your child&#8217;s name be entered into the State Department&#8217;s <a href="http://travel.state.gov/family/abduction/resources/resources_554.html">Children’s Passport Issuance Alert Program</a> (CPIAP).  Entering your child into the Children&#8217;s Passport Issuance Alert Program will enable the Department to notify you or your attorney if an application for a U.S. passport for the child is received anywhere in the United States or at any U.S. embassy or consulate abroad. If you have a court order that either grants you sole custody, joint legal custody, or prohibits your child from traveling without your permission or the permission of the court, the Department may refuse to issue a new or renewal U.S. passport for your child. The Department may not, however, revoke a passport that has already been issued to the child. There is also no way to track the use of a passport once it has been issued, since there are no exit controls for people leaving the U.S. If your child already has a passport, you should take steps to ensure that it is kept from a potential abductor by asking the court or attorneys to hold it.</p>
<p>IMPORTANT TO KEEP IN MIND:</p>
<ol>
<li>The United States does not have exit controls.</li>
<li>The Department of State may not revoke a passport that has been issued to a child, but you can ask a court to hold onto it.</li>
<li>There is no way to track the use of a passport once it has been issued.</li>
<li>Your child might also be a citizen of another country (dual nationality).  Even if he/she does not have a U.S. passport, your                               child may be able to travel on the other country&#8217;s passport.</li>
</ol>
<p><strong>The Privacy Act and Passports</strong></p>
<p>Passport information is protected by the provisions of the Privacy Act (PL 93-579) passed by Congress in 1974. Information regarding a minor’s passport is available to either parent. Information regarding adults may be available to law enforcement officials or pursuant to a court order issued by the court of competent jurisdiction in accordance with (22 CFR 51.27). <p>FORMER MEP Mary Banotti has called on the Government to monitor the number of reported child abduction cases involving sharia law countries which have not signed international conventions on the issue.</p>
<p>Figures published by the Department of Justice last week showed that a record 141 transnational child abduction cases were dealt with by the authorities last year.</p>
<p>The department said 141 cases involving 183 children were received by the Central Authority for Child Abduction in 2008, an increase of 42 cases on 2007 and the highest annual total since the unit was established in 1991.</p>
<p>However, Ms Banotti, who is president of Irish Centre for Parentally Abducted Children, said it was very difficult to retrieve children who were abducted by one parent to a state that had not signed the Hague conventions on child abduction. Cases involving countries governed by sharia law were particularly difficult to resolve.</p>
<p>“I think there should be a record kept of all children removed to sharia law countries,” she said.</p>

<p>Ms Banotti pointed to a case in which an Irish woman, originally from a north African state, was reunited in January with her four children six years after her husband took them back to their country of origin without her consent. Because the African state had not signed the Hague conventions, the woman had no legal avenue to pursue in order to retrieve her children, who were aged between two and seven when they were taken in 2002.</p>
<p>She was eventually reunited with them in January after her husband was arrested by gardaí on his return to Ireland.</p>
<p>Ms Banotti said the latest child abduction figures corroborated her organisation’s view that the problem remained significant. The centre received reports of seven abductions in the past week.</p>
<p>A major shift in trends in recent years was that, whereas women until recently made up the vast majority of those reporting abduction, today at least half of reports came from men.</p>
<p>While the overwhelming majority of transnational abduction cases investigated here once involved the United States and the UK, recent immigration patterns are reflected in the variety of central and eastern European countries that have appeared on the department’s list in recent years.</p>
<p>In 2008, a total of 33 cases related to states that joined the EU since 2004, including Poland, Latvia, Lithuania, Hungary, the Czech Republic and Romania.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>The year is ending.  It is time to renew and/or change work benefit plans for next year, which then add more to-do&#8217;s in my list.  Speaking of changing plans, we have to do this at least every 2-3 years.  If the company does that, why can&#8217;t we do so as an individual when it comes to internet/cable/TV/phone services, car and home insurances?  So it is time to shop around.<br />
First thing first, health insurance, as we are changing from Humana to Aetna, I will miss my PPO 1000, or maybe not.  Deadline for completing the enrollment is Friday of this week.  Time is crunching.<br />
Healthcare insurance is the most confusing thing in this world.  After all  these years of having plans company-sponsored and self-paid, I still can&#8217;t figure what to go with. POS and HMO?  And then there is Open Access HMO vs Traditional HMO.<br />
If I am healthy, do not see that I will get really sick or hospitalized, what is best for me? POS/PPO?  Or HMO?  As they say, what works for one maynot work for others.  I don&#8217;t know what&#8217;s ahead of me within one year.  But I &#8216;d better plan now.  Should I give HMO a try for one year?  Hah hah&#8230; the docs / hospitals would not like this as I will pay less or nothing out of pocket, and Aetna will cover more for me but pay less to them for sure.  The cons: my HMO-plan monthly premium will be as double as what I paid under PPO plan.  That is the up-front cost, and helps the company with half of the cost.  Unless I was in mental care, ER, or hospitalized, I would not have to pay a dime.  I will be restricted to access one PCP only, and get referred for every single specialist I want to go to.  Some say it sucks; some could handle it OK.  And usually it is the long wait before visiting a specialist.  On the other hand, POS1500 looks reasonable, my annual cost is cut back, although the deductible is high.  Of course company always looks for cutting back on the costs for both company and employees.  Moving to this plan could save me good dollar amount (approx $300 from current year plan), which can be put into flex spending account for co-pays and deductible.<br />
Deductible is the scary word to any consumer (but it is a favorite word to insurance agents).  And then they have these terms &#8220;after deductible&#8221; and &#8220;deductible waived&#8221;.  The deductible kicks in when there are necessary or rendered services which are not covered by the chosen plan, especially dental services, if I am understanding correctly.<br />
Dental care is always expensive and necessary.  I had to pay 1/3 of the cost for my crown.   But it was not that easy to pay up-front an amount of 500 bucks.  I can tell, most dental office hate the process of billing and keeping billing patients.  They want quick payment and get it done with, and therefore CareCredit is in the house.  It is all my money anyway.<br />
I can&#8217;t take my health for granted.  What if I became disabled and could not work?  Another decision to make: STD or LTD?  I have been thinking of switching from LTD to STD?  or should I have both?  I have been thinking &#8220;long term&#8221;.  Now I should think &#8220;short-term&#8221;.  What if I become a working mom, or adopt a child?<br />
STD (Short term disability) ensures salary pay for 6 months after all sick days are accrued and (maybe) vacation days are exhausted, and the sickness has to be certified by the doctor.  Most of the times the doctors won&#8217;t sign off unless there are real complications, for their liabilities.  What are the policies on company side, insurance side, and healthcare (doctor) &#8217;s side?  It can be a trick to your expectations.  But it is always good to have it handy.  It&#8217;s time to consider this.  Actually I have been thinking about this plan for two years now.  I am ready for child birth or adoption.  I don&#8217;t know how others do it.  But to me, getting ready for being a mom takes plan.<br />
The Short-term disability insurance costs more than the Long-term. LTD kicks in after 6 months of being on STD sick leave, and lasts up to 2-5 years.  Do I really need LTD?  Most likely I&#8217;d get back to work after 6 months.  What if I discontinue/decline LTD next year?  Does it mean I will lose the benefits I could have earned from LTD otherwise?<br />
The Group Basic AD&#38;D with the employer should take care of this, according to <a href="http://www.insure.com/articles/disabilityinsurance/long-term-disability.html">Insure.com</a>.  So adding LTD would make me un-neccessarily over-covered?      </p>

<p>The Hague Convention on the Civil Aspects of International Child Abduction created an international treaty and legal mechanism in order to find children that have been abducted. This is just one treaty or law that has been enacted in order to recover children that have been taken away from their loved ones. However, it is really important to make sure that every state has a means to deal with and track down children that have gone missing. Children get abducted for a number of reasons: •Intent to raise the child as their own<br />
•A parent takes the child from the other parent’s care<br />
•For ransom</p>

<p>Despite the seriousness of child abductions it is not publicized enough. This may in part be because the statistics are not very clear. Data collection by different organizations can differ drastically from the definition of “abducted child” to a motivation explanation. Consequently, comparing the numbers is not very helpful or simple. The need for a transnational database is evident in that it will help ascertain the significance of the missing children problem.<br />
Fortunately, in 2007 the European Commission declared the telephone number “116000” to be the single telephone number in the EU to make pressing calls about 3missing children. By securing a single hotline number, hopefully the “116000” number will help this lack of communication that can occur between the EU countries.<br />
Despite this effort to create a line of communication across European borders there is still not a child alert system that would create a network to look for children who may have been taken into a different country.<br />
The United States has a number of different laws that focus on this topic exclusively by engaging in actively preventing crimes against children as well as, similar methods to handle situations in which children go missing. With the ease of crossing borders in Europe it becomes apparent that it can be difficult to work with countries that follow different procedures to help children and this creates a complicated setting to recover and protect children efficiently and safely.<br />
Missing Children Europe is one organization that is tirelessly working to improve and enact legislation that will improve the mechanisms to help children across the European Union while simultaneously working to improve the quality and communication of existing means of handling missing children cases.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>These cigars are getting harder to find, so I thought I should get a review up in case anyone wanted to search one out. The Oliveros LTD line was produced in the Dominican Republic as a limited edition cigar. It was a one-time production run of only 2000 boxes each of two sizes, and each box contains 50 cigars. Either size will run about $10 in your local B&#38;M. The Gran Robusto is 5.5 inches long with a 52 ring gauge. The wrapper is Brazilian and surrounds a Corojo binder and fillers from Nicaragua, Peru, and the Dominican Republic.</p>

<p>The cigar has spent over two years in my humidor. I noticed a few medium-sized veins on the wrapper but otherwise its color and appearance were very good. The cap was perfect and was easily cut using a Xikar cutter. I lit the cigar with my butane torch lighter. The aroma included nuts, hickory wood, and leather. No issues with the draw. When I began puffing, these same components came through in the flavors even more intensely with the addition of red pepper and coffee. I also detected a nice black pepper on the dry finish.  The cigar is full-bodied and full-strength from the start- definitely not one I would pick for a breakfast-time cigar, but it is still one I can enjoy after a light lunch. The ash was a light-grey and was pretty firm. The burn was impressively straight thoughout the smoke. My main concern with the cigar is balance. The red pepper can be a little strong at first. As I smoked the coffee seemed to become more dominant as the leatherflavor started to diminish. Neither of these two issues is enough for me to to actually dislike the cigar, but it is worth noting. I think this may be related to the dryness of the smoke. I started sipping water near the end to cleanse my palette and the flavors began to take shape again. The strength seemed to also diminish slightly near the end.</p>

<p>+Excellent burn</p>
<p>- Very dry finish</p>
<p>- Some flavors would dominate at times</p>
<p>I took off four points for the wrapper veins against the overall presentation, and eight for the balance issues. Overall I found the cigar to be very enjoyable and gave it a score of 88.</p>

<h5>Statistics from international child abduction charity suggest that international child abductions within the family have increased by 87% since 1995. The reasons for this may be many, but it is believed that a variety of factors have made international travel and residence much easier for most people. Reasons for this increase likely include:</h5>

<li> A rise in the number of parents who break up with each other, including through divorce.</li>
<li>A rise in the number of people marrying foreign nationals (meaning that these partners will become parents with origins and possibly residences in other countries).</li>

<li> Greater familiarity with immigration laws, which means that more people are aware of where and how they can work in other countries, particularly those in the European Union.</li>

<h4>How Can Parents Guard their Children Against an International Abduction?</h4>
<p>There are many things that a guardian parent can do to prevent their ex-partner from taking their children across international boundaries. Guardian parents can:</p>
<ul>
<li> Obtain a court order as to the custody or residence of their children. If the child ordinarily resides in a specific country or was abducted from that country, a court order is necessary for it to be considered an abduction.</li>
<li> Prevent passports from being issued for their children. You will likely need an order of the court as well as this request in writing.</li>
<li> Tell the police of your suspicions.</li>
<li> Request a Port Warning or Port Alert in urgent/imminent circumstances. Only the police are able to issue such an alert, and only when there is good reason to believe that the child may be taken out of the country.</li>
<li> Contact a solicitor  to discuss their personal situation and transmit this information to the partner they believe may be thinking of abducting their children.</li>
</ul>
<p>Child abduction within the family is a crime much like any other type of child abduction. If you fear that your child may be abducted by another family member, take necessary precautions to keep him/her safe, and if the worst does happen report the abduction immediately. Don’t hesitate, or you may regret the wait later.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Many left-behind parents are told that the <a href="http://www.hcch.net/index_en.php?act=text.display&#38;tid=10#family">Hague Convention</a> will bring about the return of their abducted children. Some authorities say that if your child is abducted, you should follow procedures outlined by the Hague, but we don&#8217;t agree.</p>
<p>Until 1980, there was no international system in place to help parents recover abducted children who had been taken to other nations. The Hague Convention attempted to create one, but it doesn&#8217;t work. If you take the time to read the well-intentioned text of the Hague, you&#8217;ll see its many flaws.</p>
<p>In our opinion, it&#8217;s not worth the large amounts of money, time and trouble to hire an attorney to try using the Hague Convention to get your child back. You aren&#8217;t likely to get him or her back — and even worse, the abducting parent could be &#8220;legitimized&#8221; by the courts in another nation.</p>
<p>Under the Hague Convention, a case must be filed in the country where the abductor has taken the child. The courts of that country tend to render their decisions in favor of their countrymen, as the Hague Convention focuses on residency, not citizenship. There is little concern for the fact that the child is a citizen of the country from which he or she was abducted, or for the possible detrimental effect on the child.</p>

<p>Even if the child was born in your country, if that child is found to be a “habitual resident” by the courts in another country, the child may be ordered to be returned to that country.</p>
<p>This underscores the need to act quickly.</p>
<p>Few, if any, of the Hague signatory countries are going to send anyone out to physically recover your child for you. Embassy officials will check on the child&#8217;s welfare, if it is known where the child is and if the abducting parent lets them.</p>
<p>As soon as  abducting parents are aware that that they&#8217;ve been located, they&#8217;ll usually disappear with the children again.</p>
<h3>And about hiring lawyers</h3>
<p>You need to be aware that a great amount of money has been spent on lawyers in foreign abduction cases. The unfortunate fact is that they, most often, can’t practice in the foreign courts and are required to hire associate lawyers in the foreign country.</p>

<p>On recense environ 1000 enfants enlevés chaque année par l&#8217;un des deux parents. Près de la moitié n&#8217;est jamais retrouvé.<br />
Cette situation est d&#8217;autant plus difficile à vivre quand l&#8217;un des parents est originaire d&#8217;un autre pays, et décide d&#8217;emmener son enfant avec lui.</p>

<p>Cette semaine, le cas de la petite Elise illustre parfaitement le drame que subisse ces enfants pris en otage par leurs parents qui se déchirent. Elise aurait été (d&#8217;après son père) enlevée par sa mère, une russe, afin d&#8217;être emmenée en Russie. Arrachée à son père par des &#8220;gros bras&#8221; en plein milieu de la rue, cette petite fille subit cette situation depuis 2 ans. Une première fois enlevée par sa mère et conduite en Russie, elle a été récupérée par son père et donc arrachée à sa mère. c&#8217;est ainsi la troisième fois qu&#8217;Elise subit un rapt. Quel traumatisme !<br />
La question n&#8217;est pas de savoir qui du père ou de la mère a raison. L&#8217;enfant a besoin de ses deux parents. Beaucoup de couples se disputent la garde des enfants après le divorce, ce n&#8217;est pas rare. Cependant, quand l&#8217;un des parents a la possibilité d&#8217;emmener son enfant dans un autre pays, cela devient plus délicat.<br />
On se souvient du film &#8220;Jamais sans ma fille&#8221; qui avait fait pleurer le monde entier, stigmatisant au passage les pays musulmans ! Combien d&#8217;affaires semblables chaque année ? Comment résoudre ces conflits ?<br />
Une instance de médiation est mise en place par l&#8217;Etat pour tenter de trouver des solutions pour ces familles déchirées, mais elle n&#8217;intervient qu&#8217;auprès des pays qui ont signé des conventions avec la France (ce qui n&#8217;est pas le cas de la Russie par exemple).</p>
<p>Bref, ce sont des situations dramatiques, traumatisantes pour tous les protagonistes, et notamment pour les enfants, victimes des querelles parentales. Comment prévenir ce problème ? Peut-être en favorisant la communication dans le couple. Même en cas de divorce difficile, une médiation devrait être instaurée afin de prévenir un tel drame. En cas de doute sur les intentions de l&#8217;autre parent, on peut toujours noter les numéros de passeport, les coordonnées des familles et proches dans le pays du conjoint, toutes les informations qui permettraient de retrouver la trace de l&#8217;enfant en cas d&#8217;enlèvement, et garder une photo récente.</p>

<p><strong>Et norsk selskap som henter hjem bortførte norske barn skal ifølge daglig leder flere ganger ha blitt møtt av våpen.</strong></p>
<p>Ved 8–9 anledninger har våre folk grepet aktivt inn og hentet barnet ut for å få det hjem, sier daglig leder Martin Waage i <a href="http://www.abpworld.com">ABP World Group</a>. Men han vil ikke svare på om de har vært bevæpnet i slike situasjoner. <a href="http://www.abpworld.com">ABP World Group</a> tilbyr blant annet livvakt- og overvåkingstjenester – og oppsporing og hjemhenting av bortførte barn. – De siste seks årene har vi vært involvert i om lag 15 slike saker, blant annet i Sør-Amerika, Midtøsten og på Balkan, sier Waage til <a href="http://www.bt.no/nyheter/Henter-barn-hjem-til-Norge-908059.html#" target="_blank">Bergens Tidende</a>.For de mest krevende og risikofylte oppdragene kommer prisen ifølge Waage fort opp i 200.000–500.000 kroner.</p>
<h2>Tilkjent daglig omsorg</h2>
<p>En kvinne på Vestlandet kontaktet selskapet etter at sønnen angivelig ble bortført til Balkan av sin far. – Han reiste på ferie i juni i fjor, og kom tilbake uten barnet. Gutten bor hos farens familie. Han fyller to år denne måneden. Jeg har ikke sett ham siden i fjor sommer, sier kvinnen som ikke er gift med mannen lenger. Hun ønsker å være anonym av hensyn til sønnen.</p>

<h2>– Ikke registrert</h2>
<p>Martin Waage i <a href="http://www.abpworld.com">ABP World Group</a> mener foreldre av bortførte barn blir motarbeidet av politiet når de skal anmelde sakene. – Ofte er ikke barna engang registrert som savnet. Da begynner vi med å kontakte Kripos og Interpol, sier han. Om lag 20 foreldre som har fått bortført barna sine, har gått sammen i et nettverk som blant annet driver nettsiden <a href="http://www.bortført.no">bortført.no</a>. Kjell Schevig, som administrerer siden, sier han flere ganger har anbefalt <a href="http://www.abpworld.com">ABP World Group</a> til desperate foreldre. – Norske myndigheter gjør svært lite i slike saker, og en del foreldre har sagt at de i ren desperasjon vil dra og hente barna, selv i svært farlige området. Det har også skjedd at vi har sagt nei til å gripe inn fordi risikoen ved å hente barnet ville vært for stor. Så langt har ingen blitt skadet i operasjonene, sier Waage. Han kaller virksomheten «nødhjelp» til desperate foreldre. – Etter Haag-konvensjonen skal bortførte barn tilbake der de bodde. Jeg er selvsagt klar over at vi begår et overtramp i de landene vi opererer i, men moralsk og etisk er det likevel riktig, mener han. Kripos bekrefter overfor BT at de er kjent med at <a href="http://www.abpworld.com">ABP World Group</a> har vært involvert i en bortføringssak.</p>
