Waqt il-kumpilazzjoni tal-provi kontra Niżar Mustafa El-Gadi, l-eks raġel tal-avukata Margaret Mifsud, intqal kif l-akkużat ma kienx qed iwieġeb it-telefonati minn surġent tal-pulizija eżatt wara li nstab il-katavru tal-mara.

Man found murdered at Bahar ic-Caghaq | maltastar

A Maltese man was found murdered at Bahar ic-Caghaq, very near where the body of murdered lawyer Margaret Mifsud was discovered some months ago.

The police know the identity of the man who might be linked to another murder that happened some time ago at Ta’ Qali.

At 3.30am on Wednesday morning a hunter went to the Naxxar Police Station to tell them that he saw a man in a pool of blood near the Coast Road at Bahar ic-Caghaq.

The police went on the spot and found a semi-undressed man facing downwards with his head full of blood. A few metres away from the body they found a shoe, probably belonging to the murdered man.

In a lengthy deposition before Magistrate Saviour Demicoli this morning, the court heard Tessie Mifsud – the victim’s mother – reveal that she got to know from hearing her two grandchildren arguing about their mother’s death.

“Mummy died because of you, when you told daddy where she was going…” Tessie Mifsud heard her eldest grand-daughter tell her younger sister.

Mifsud said that when she sat them both down, the children told her that their father had threatened the youngest that he would “kill her” unless she told him where their mother was going on the night of April 18.

Margaret Mifsud was found dead inside her car in Bahar ic-Caghaq the day after, and police charged her estranged husband, Nizar El-Gadi with her murder.

Tessi Mifsud gave a detailed account of the last time she saw her daughter on April 18, before she set out for a farewell dinner to a colleague in Xemxija.

“She kissed her children good-bye, promising them that she wasn’t going to be long, switched off her mobile phone so that she won’t be bothered by Nizar, and asked for a piece of paper to write the number of a girl-friend of hers on which to call in case of an emergency,” Mifsud said.

“I never saw her again,” the witness said, adding that “Nizar seems to have got what he wanted, my daughter killed.”

Mifsud gave a detailed account of her daughter’s relationship with the accused, revealing that she had married him at 22 because she got pregnant out of wedlock, and then had another child while she was still studying law.

“I took them both in, because I didn’t want my daughter to lose out on her legal career. And I knew from the very beginning, either out of maternal instinct or because it was clear, that Nizar only wanted to be married to Margaret, and gave her children, so that he could stay in Malta, while he despised her becoming a lawyer,” she said.

Mifsud said that three weeks after their first daughter was born, Nizar left Malta for three whole years, and only returned after Margaret had graduated.

“I knew it from the very start that he would return after she graduated, because he had a clear scope in his mind,” she said, adding that Nizar was unemployed, penniless but full of pretences.

“He was argumentative, arrogant and when I had accepted him back home, he continued to play the ‘king’ and make everything his.”

Violent

The witness said that her daughter only sought the wellbeing of her two children and although she was separating, and later had her marriage annulled, always wanted the children’s father to be present in their lives.

“But things started to degenerate, and while Margaret remained secretive about her strained relation with Nizar, I started to understand that Nizar was becoming violent with her. One day I noticed a large dark blue bruise on her left inner arm, and also a punch mark on my bedroom’s wooden door. When I noticed the dent, he came up to me to say that he was sorry to have caused the dent, which was made while he was playing with the children and accidentally hit the door,” Tessie Mifsud said.

She added that she had confronted her daughter to tell her if Nizar was hitting her, but she said nothing, except lower her eyes and ignore the matter.

Some days before the murder, Tessie Mifsud said that her daughter had lodged a police report in Birkirkara, after he tried to strangle her with a string.

Margaret had told her mother that Nizar had ordered her to close the windows and doors, get onto her knees and rest on her elbows, then came from behind her only to wrap the string around her neck asking her to choose between herself or the children.

After that incident, Margaret and her family had packed all of Nizar’s belongings and took them to the Birkirkara Police Station.

Crafty

Tessie Mifsud described her former son-in-law as a “crafty man” who despite his inability to do anything, and never keep a job, he used to say that he was a trained professional guard with the deposed Libyan dictator Muammar Gaddafi, and had told her, and even Margaret that he knew how to kill without leaving a trace.

“I thought he was joking,” the witness said, adding that besides the threats to Margaret, he was also quite violent with the children.

“He manipulated them, he was nasty and he made them fear him at all times,” she said.

“I had discovered him one day sitting on his youngest daughter’s head as she crouched on her side by the bed. He told me he was playing, when it was obvious he wasn’t. He laughed and said…’she knows’”

Stalker

During her evidence, Tessie Mifsud spoke about the times Nizar El-Gadi would stalk her and Margaret.

Besides the hours he spent waiting outside his daughter’s school in Sliema, Nizar once barged his way into St. Joseph’s Convent school in Sliema where he confronted the headmistress, who had to alert the teachers and the police about him.

Another time he stalked the witness as she went to pick up the children from school, and walked with them until she got to her car.

And another time when he frightened her daughter by hiding inside her car, as she was coming out of court.

“He apparently hid inside the hatch-back of her Daihatsu car and frightened her as he emerged to tell her that he knew everything about her, and that she would find him everywhere.”

Another time, Margaret found Nizar El-Gadi stalking her as she attended a wedding with another girl-friend.

Dr Patrick Mifsud u Dr Stephen Farrugia Sacco rritornaw oġġetti li ntużaw fl-inkjesta, fosthom erba’ mowbajls, riċevuta, żewġ sim cards u żewġ starter packes tal-kumpanija GO, u ppreżentaw rapport li fih l-informazzjoni kollha miġbura mill-oġġetti rritornati.

Xehed l-iSpettur Josrc Mifsud, stazzjonat l-Għassa tan-Naxxar li qal li fid-19 ta’ April, kien informat li nsabet persuna mejta u li kienet l-Avukatessa Margaret Mifsud. Huwa kien infurmat li fil-lejl ta’ qabel, kienet ħarġet bil-karozza tagħha ma’ xi ħbieb, kellha ikla u ma rritornatx lejn id-dar.

Mifsud mar fuq il-post, fejn kien hemm diġà pulizija oħrajn u uffiċjali tax-xena tar-reat. Il-pulizija skoprew fejn kellha tmur għall-ikla u ddentifikaw persuni li kienu qegħdin magħha u kellmuhom. Jidher li din l-ikla damet sal-23.30.

Mifsud kienet ġabret ħabiba tagħha minn ħdejn l-Empire Cinema u wasslitha lura hi.

Il-Pulizija kellmet ukoll lil individwu li jieħu ħsieb il-lukanda fejn kien jgħix l-akkużat. Dan qal li s-soltu l-akkużat kien jidħol għall-ħabta tal-23.00. L-akkużat kien interċettat u ttieħed il-kwartieri tal-pulizija.

L-akkużat kien spjega kif kien qatta’ l-ġurnata, qal li kien iltaqa’ ma’ l-eks mara tiegħu ħdejn id-dar tagħha, kellu x’jaqsam magħha, kien mar San Ġiljan fejn iltaqa’ ma’ tfajla ta’ nazzjonalità barranija, kien tela’ ma’ din it-tfajla San Pawl biex ifittex ħanut u iktar tard mar jiekol Paceville.

L-akkużat kien inżamm arrestat u prova jitgħallaq waqt li kien il-lock-up. Fis-26 ta’ April l-akkużat kien irrilaxxa stqarrija fejn spjega li xi ġurnata qabel kien mar ma’ Margaret biex jieklu u kienu kuntenti ħafna u wera ritratti tagħhom fuq il-mowbajl. Imma l-akkużat kien għażel li ma jiffirmax din l-istqarrija.

L-ispettur Mifsud qal li l-akkużat qatt ma kien konsistenti kemm-il darba kellimuh, dejjem ta stejjer kompletament differenti, kemm x’ġara dakinhar kif ukoll dwar ir-relazzjoni li kellu ma’ Mifsud.

Tixhed ħabiba ta’ Margaret

Xehdet ukoll Geraldine Watson, Kanadiża, li tgħix Birkirkara u li ilha taf lil Margaret għal għaxar snin. Qalet li kienu jżommu kuntatt flimkien għax it-tnejn kienu qegħdin jiffaċjaw diffikultajiet fiż-żwieġ.

“She was so unhappy, she was trapped in her marriage,” qalet Watson fix-xhieda tagħha.

Qaltilha li mhux l-ewwel darba kien jheddidha li jekk titilqu joħdilha t-tfal. Kienet tgħidilha li kien kattiv magħha u ma’ uliedha iżda kienet tipprova tagħmel mill-aħjar li tista’ minħabba fihom biex ikollhom ħajja normali.

Nizar al Gadi, 34, the former partner of lawyer Margaret Mifsud, was jailed for four months today after being convicted of threatening police officers following his arraignment to face murder charges.

The incident happened in the afternoon of July 28 after al Gadi was accused of murdering Dr Mifsud in Bahar ic-Caghaq.

Police Inspector Keith Arnoud said the accused was in a police car being escorted to prison when he started insulting him and making obscene gestures. He then threatened him, saying he had family in Libya who would track him down and harm him.

Magistrate Antonio Micallef Trigona jailed the accused for four months.

Barra dan kien hemm ħafna affarijiet fil-karozza, fosthom ġugarelli tat-tfal iżda l-iżjed importanti kienet ‘tissue’ fuq is-‘seat’ ta’ wara.

Fetaħ il-bieba tas-sewwieq, fejn kien hemm ras il-kadavru sserraħ mal-bieba. Is-‘seat’ tas-sewwieq kien miġbud kollu ’l quddiem, tant li l-irkoppa tas-sieq ix-xellugija kienet qiegħda tħabbat man-naħa ta’ quddiem. Il-kadavru nstab liebes żarbuna waħda u l-oħra kienet fl-art, fuq it-tapit. Iż-żraben kellhom tkaken twal.

“As the Magistrate’s Court continues hearing more evidence from investigators who probed the murder of lawyer Margaret Mifsud last May, Police Inspector Keith Arnaud revealed that DNA from accused Nizar El-Gadi was elevated from scrapings taken from under the victim’s fingernails.

According to Inspector Arnaud, the evidence indicates that Mifsud struggled with her aggressor.

Margaret Mifsud was found dead in her car in Bahar ic-Caghaq on April 19, after failing to return home from a farewell dinner for a colleague in Xemxija.

Previous evidence put the accused just metres away from where Mifsud – a mother of two young children – was dining in Xemxija, and later in Bugibba where she dropped of a friend.

Further DNA belonging to the accused was found on tissue paper found on the car’s back seat, which also had the victim’s lipstic and blood.

Magistrate Saviour Demicoli is presidening the case, while lawyers Emanuel Mallia and Arthur Azzopardi are appearing ‘parte civile’ for the Mifsud family. Martin Testaferrata Moroni Viani is appearing for the accused.

“Nizar Mustafa Al-Gadi, 33, a Libyan resident of Birkirkara was today charged with having threatened to kill his former partner Margaret Mifsud, the mother of his children.

Dr Mifsud, a lawyer, was found dead in her car in Bahar ic-Cagħaq in April. The circumstances of her death are still under investigation.

Mr Al-Gadi was also accused of slightly injuring and harassing Dr Mifsud, holding her against her will and threatening to kill their two young daughters.

He was also accused of committing a crime during the operative period of a suspended sentence.

The alleged incidents allegedly took place on March 24 in the morning.

Police Sergeant Kevin Grima told the court that on the day of the incidents, Dr Mifsud called at the police station in Birkirkara with her two children. She looked scared and asked to speak to the inspector. She filed a police report saying that at about 9.30 a.m. while she was at home, the accused told her he wanted to speak to her. He then pushed her onto a sofa and tried to strangle her. Her neck was red, apparently as a result of the alleged attempted strangulation.

Defence counsel Simon Galea Testaferrata said that his client had already been subjected to trial by the media and wanted this case to be concluded as soon as possible.

Magistrate Clare Stafrace Zammit put off the case to September.”

Police have spent long hours questioning a Libyan man over the death of 31 year old lawyer Margaret Mifsud found dead at Bahar ic-Caghaq last week. He was taken to Police Headquarters from Mount Carmel Hospital where he had been taken for treatment after he went hysterical in the cell where he was kept, started screaming and shouting and banging his head against the wall.

The Libyan man, a former partner of the young lawyer, is making very contradictory and confused statements to the police who are trying to find from him where he spent the last two days of the lawyer’s life. He told the police he has an alibi who knows where he was on Wednesday and Thursday of last week when the young lawyer went missing, eventually to be found dead in her car at Bahar ic-Caghaq. His alibi does not seem to be all that solid.

While believing that they have made progress in trying to find out whether Margaret Mifsud was murdered, the police still feel they have a lot of complicated work to do to solve the case. Things have been made more difficult for them as Dr Mifsud switched off her mobile at 7.30pm on Wednesday – a full 18 hours before she was discovered dead.

Police have had no problems putting together the calls that she made and received on her mobile in the last two years as service providers are legally bound to provide such data on magistrate’s orders – but they have no calls on her missing mobile phone that will help them piece together the last movements of her life.

Her hand bag is also missing. In June her former partner will be charged with illegally holding her against her will, slightly injuring her and threatening her on 24 March 2012. She used to be afraid of him and insisted of being escorted when she took their two children to see him at San Anton Gardens. Police sources say that she only lodged a report about the 24 March incident.

Friday – Next week samples taken from young lawyer’s body Margaret Mifsud will be sent overseas for toxicological tests that police hope will help them establish the cause of her death, Forensic expert Dr Mario Scerri will fly to London with these samples. A post-mortem on her has so far been inconclusive.

But investigators think that she died of a heart failure and not a heart attack which means that she could have been killed in a very sophisticated manner by putting pressure on several parts of her body to deny her oxygen without leaving any external signs of violence.

Thursday – Police investigating the death of 31 year old lawyer Margaret Mifsud, discovered dead in her car at Baħar iċ-Ċagħaq a week ago, strongly suspect that she was murdered. But it is not going to be easy for them to catch the murderer.

The person who murdered Margaret was very careful not to leave any clues that might lead to his/her capture. There are no tyre marks in the area. So the person carrying out the crime did not leave the scene using a car. The car for the getaway must have been parked some distance away and the police have found no footsteps leading to it.

The investigators are finding it difficult to reconstruct the last hours of Margaret’s life as she switched off her mobile at 7.30pm on Wednesday evening – 18 hours before she was discovered dead.

There are no external signs of violence on her body but the investigators are hoping that the toxicological tests carried out on her will show if violence was used on her. The samples taken from her during the post-mortem have still not been sent overseas to be tested in forensic laboratories.

Her former partner with whom she had a very difficult relationship is still being kept at Mount Carmel Hospital. He was sent there after he started behaving hysterically while in police custody, shouting and screaming and banging his head against the walls of the cell where he was being kept for questioning.

Her handbag is still missing.

Wednesday – When 31 year old lawyer Margaret Mifsud was found dead in her car at Baħar iċ-Ċagħaq last week on Thursday afternoon her handbag was not in the car with her. A police search has not been successful. The missing handbag is quite a blow to investigators as it might have contained clues that throw light on the last movements of the young lawyer. Her mobile phone has also not been traced. At first her car key was not found as it was not in the ignition but it was then found later in the car.

No external signs of violence were found on her body although it seems she had a slight nose bleed before she died and she tried to wipe the blood with her hand and then smudged her brow with it.

Friends and colleagues who were last to see her alive a week ago on Wednesday night saw that she had her handbag during the social function she was attending at Fortress bar and restaurant in Xemxija Bay.

She left there at around 11.30pm to give her secretary a lift.

Police officers investigating her death are trying to find out what she did after dropping her secretary at home as she never went back to her mother’s house where she lives with her two children. Her family reported her missing. She was found dead in her car on Thursday early afternoon.

So far police attention is focusing on her former Libyan former partner with whom she had a very turbulent relationship. But he is insisting that he has an alibi to show that he was not involved in any way with the young lawyer on Wednesday and Thursday. He is being held at Mount Carmel Hospital.

Last weekend the police took him into custody. Next month they will be charging him with holding Margaret against her will on 24 March 2012, slightly injuring her and threatening her.

She was so afraid of him that when she took her two children to see him at San Anton Gardens she always had someone escorting her.

She left there at around 11.30pm to give her secretary a lift.

Police officers investigating her death are trying to find out what she did after dropping her secretary at home as she never went back to her mother’s house where she lives with her two children. Her family reported her missing. She was found dead in her car on Thursday early afternoon.

So far police attention is focussing on her former Libyan former partner with whom she had a very turbulent relationship.

The police have taken him into custody. Next month they will be charging him with holding Margaret against her will on 24 March 2012, slightly injuring her and threatening her.

She was so afraid of him that when she took her two children to see him at San Anton gardens she always had someone escorting her.

Saturday – The former partner of 31 year old lawyer Margaret Mifsud found dead in her car at Bahar ic-Caghaq on Thursday afternoon is in police custody as he is being investigated in connection with her death. He is in hospital after feeling unwell during police questioning. Intense police investigations into Mifsud’s death are continuing. Yesterday’s autopsy on her body is inconclusive and further toxicological tests will be carried out but there are strong indications that her death is not due to natural causes.

Her friends say that for many years she has been molested by her former Libyan partner.

They find it unacceptable that the police arrested her former partner a month after an incident of 24 March 2012 where he held her against her will, harassed her and threatened her. But court sources have told maltastar.com that her former partner has been charged with this incident before her death. He will appear before Magistrate Claire Stafrace to answer for these charges in June.

These friends know how her partner bullied her constantly while she suffered in silence. One of her friends has told maltastar.com: “I call this murder through bullying.”

She used to take her two kids to a public place in San Anton Gardens for them to see their father and her former partner and she was so scared of him that she would ask to be escorted.

Yesterday the police arrested her former partner – a Libyan man – about an incident that happened between them a month ago. The police are expected to charge him with illegally arresting her, slightly injuring her, harassing her and threatening her.

The police investigators are giving a lot of importance to the fact that her handbag was not found in the car where she was found dead on Thursday afternoon.

On Wednesday evening at 11.30pm she was still at a social function at Fortress bar and restaurant at Xemxija Bay. She took her secretary home but she never went back to her mother’s home and went missing till she was discovered dead at Baħar iċ-Ċagħaq.

Update: Results of Dr Margaret Mifsud’s autopsy revealed that she suffered a heart attack, however the autopsy is inconclusive, the police confirmed with ONE News. Other tests, including toxicological ones, will be carried out. There are strong indications her’s was not a natural death.

The autopsy on the body of Margaret Mifsud, the 31-year-old lawyer from Birkirkara who was found dead in her car yesterday afternoon, was inconclusive.

Dr Mifsud, a mother of two, was found slumped in her car that was parked just off the Coast Road at around 2 p.m. Her handbag was missing.

Although there were no signs of foul play or self-harm, the police have arrested her former partner, Libyan Nizar el Gadi, on suspicioun of holding her against her will last month.

Sources said this afternoon that as the autopsy results were inconclusive, the cause of death remained a mystery. However, the authorities were still waiting for toxicology results which had to come from abroad.
