He definitely knows a lot about searches for missing children. Many of you will remember him from the search for little Caylee Anthony last year.</p>

<p><em>In an exclusive interview with WESH 2 News, Tim Miller, of Texas EquuSearch, said, &#8220;It just shows again what people can do when everybody is working together for the right cause.&#8221;</em></p>
<p><em>Miller contrasted the search for Somer, a 7-year-old Orange Park girl whose body was found in a Georgia landfill, with the Haleigh Cummings case in Putnam County. Miller, whose group assisted in the search, said Haleigh&#8217;s family was not working well together.</em></p>
<p><em>Haleigh disappeared from her home earlier this year and has not been found. Miller and his group help search for missing persons and became familiar to many in Central Florida during the search for Caylee Anthony, whose body was found in Orange County woods in December months after she was last seen.</em></p>
<p><em>&#8220;I&#8217;ve worked a lot of these things&#8230;Haleigh is not going to be one of those miracles,&#8221; Miller said. &#8220;I truly believe it&#8217;s going to be a miracle if we find Haleigh&#8217;s body some day &#8230; and I just hate to be that blunt.&#8221;</em></p>

<p>Hi Everyone,</p>
<p>You may have noticed that my posts have not been as in-depth or as recently. It&#8217;s not because I don&#8217;t love you all and reading the great dialogue that you are always having <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </p>
<p>I&#8217;ve been suffering from a bout of headaches for the past 3 1/2 weeks that have been constant 24/7 (mild, not severe) and a state of being tired all the time. I finally went into the doctor last week and they ordered an MRI. When the results came back, they found an anomaly in the Sella region of the brain, specifically the pituitary gland.</p>
<p>I went in this morning for a 2nd MRI to determine the issue. I&#8217;m currently awaiting the results. As you can imagine, the thought of an &#8220;anomaly&#8221; is pretty scary so I&#8217;m just waiting to find out what the MRI shows and will move forward from there. It could be as simple as a hormone imbalance or some swelling, but of course could be worse. They mentioned the possibility of a tumor/cancer but they don&#8217;t seem too concerned that this is what it is. I&#8217;m leaning toward the good side since I&#8217;m always optimistic and, frankly, I don&#8217;t think it&#8217;s anything too serious.</p>
<p>With this being the case, I just haven&#8217;t felt much like reading and writing as much as I usually do, but I&#8217;ll keep trying to post some stories that I find interesting, when I can <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' />  Thanks again for everyone who stops by every day to participate in the ongoing discussion on all the articles that I post. I know I enjoy reading what you all have to say and I hope you feel the same way!</p>

<p><i>Two exculpatory statements &#8211; are admissible as evidence of guilt</i> </p>
<p>Recently, because of the role of my software developmental enterprise, <a href="http://writeandshow.com">writeandshow.com</a>, which provides the online tools for a book on the Natalee Holloway case entitled (ironically, considering the subject and content of this essay), <a href="http://noevidenceofacrime.com">No Evidence of a Crime</a>, by Jan Brennan,  I have had occasion to ponder again the circumstances regarding the guilt or innocence of Joran Van der Sloot and Deepak and Satish Kalpoe in the case involving the mysterious disappearance of Natalee Holloway.  What follows is an updated essay, a portion of which I wrote back in the fall of of 2005.  It was published on an inner page of a website (called Scrux.com), but it largely went unnoticed, perhaps because that site never gained a huge following or really probably because it lacked a sufficient introductory explanation or a proper conclusion, both of which I have made an effort to remedy in this rendition.</p>
<p>There is legal precedence which states that juries (in the United States) can consider as evidence or proof of guilt in crime when a defendant prior to trial has made a statement which was intended to cause suspicion to be directed away from any wrong doing and that statement is later proven to be false by his own second statement also proclaiming his innocence.  Any such statement in which anyone describes their own lack of involvement or circumstances which would be for the purpose of absolving them of criminal involvement is known as an &#8220;exculpatory statement.&#8221;  Of course, innocent people usually give such an exculpatory statement when they are first queried about their involvement in a crime (because such is true). Typical exculpatory statements are &#8220;I wasn&#8217;t there at the crime scene&#8221; or &#8220;When I last saw her she was fine.&#8221;  Joran and the Kalpoes both provided the police with such exculpatory statements when they explained that they &#8220;Dropped her off at the Holiday Inn and she stumbled toward the entrance.&#8221;  Then approximately ten days later they retracted that story.  Some said the retraction was made after being confronted with the Holiday Inn surveillance video footage, but other reports say that the front cameras were inoperable and that it was because Joran had confided to a friend that the Holiday Inn dropoff was a lie,  who then told Joran&#8217;s parents, who convinced Joran (and perhaps the Kalpoes) to tell &#8220;the truth.&#8221;   Whatever the circumstances, after about ten days had passed, the Kalpoes were arrested and brought in for questioning and they now told police that they left Joran and Natalee at an entrance to the beach and Joran revised his statement saying that after walking with her on the beach, he left her there in a drunken state.   The problem with the two stories is realized with a simple bit of legal deductive reasoning. The following discussion is an exercise in legalistic logic and it can serve to gain a very interesting perspective on why so many people remain convinced (in spite of no other evidence of a crime) that the three suspects are guilty. </p>
<p><strong>US case law which speaks to this situation: </strong></p>
<blockquote><p>&#8220;When a defendant voluntarily and intentionally offers an explanation, or makes some statement before trial tending to show his innocence, and this explanation or statement is later shown to be false, you may consider whether this evidence points to a consciousness of guilt. The significance to be attached to any such evidence is a matter for you to determine.   The instruction is aimed at pretrial fabrications, and is not generally appropriate for casting doubt on a defendant&#8217;s trial testimony.&#8221;<br />
United States v. Clark, 45 F.3d 1247, 1251 (8th Cir. 1995). </p></blockquote>
<p><strong>Both stories are exculpatory </strong></p>
<p>Saying the two versions are both exculpatory means that both of them taken at face value (by themselves) are stories which describe no criminal involvement. They serve to clear the suspect of any wrong doing.  </p>
<p>In a criminal proceeding, if a witness tells one accounting and then recants, and then tells what he now says is the truth (usually in the face of some evidence from another source, which would be incriminatory), you look for the reason he told the first lie. Invariably, the sequence makes sense, because while the first accounting was exculpatory (describing innocence), the second story (the truth) will be in some way incriminating (non exculpatory), therefore explaining or demonstrating the reason or need for the original lie.  </p>
<p>So the logic to be applied is that when you have two stories, and the first one is recanted for the second, but both are exculpatory, then you also suspect the second, because a recanted exculpatory alibi should logically be replaced with a story which confesses to, at least, some criminal activity (for example, accidental death and hiding a body or something worse).  </p>
<p>Where does this logic take us? It takes us to the understanding that, according to the experiential record of practiced interrogators, Joran&#8217;s second story is also a lie or, perhaps, a partial truth. Maybe he did leave her on the beach. So, that part would be the truth (making the new story easier to tell and swear to). The various theories could then apply: Maybe she died accidentally. Maybe he went back and buried her (maybe with Deepak&#8217;s help). Maybe, later he made arrangements (with perhaps a drug acquaintance) to have the body removed and disposed of at sea. Pure speculation, of course.  </p>
<p>It is important to consider that in the practice of studying testimony and applying logic to the way witnesses testify, especially concerning their own alibis, suspects who provide an exculpatory alibi and then recant that story, have traditionally done so because the truth (which they were trying to hide with the first story) describes their involvement in a crime.  </p>
<p>Joran&#8217;s wanting to avoid embarrassment reason for telling his first (now admitted lie) simply doesn&#8217;t rise to an appropriate level to assume any kind of logical justification for providing such a complicated cover-up story. </p>
<p><strong>Further US case law references on this subject:</strong> </p>
<blockquote><p>&#8220;False exculpatory statements are properly admissible as substantive evidence tending to show consciousness of guilt.&#8221;  </p>
<p>United States v. Hudson, 717 F.2d 1211, 1215 (8th Cir. 1983) and cases cited therein.  </p>
<p>This Circuit has repeatedly held that an instruction of this nature:<br />
&#8220;is properly given when a defendant . . . offers an exculpatory explanation which is later proven to be false.&#8221;<br />
Wells, 702 F.2d at 144; Hudson, 717 F.2d 1211;  </p>
<p>See also Rizzo v. United States, 304 F.2d 810, 830 (8th Cir.), cert. denied, 371 U.S. 890 (1962), and cases cited therein.  </p>
<p>See further, Wilson v. United States, 162 U.S. 613, 620-21 (1896) indicating that such conduct formerly gave rise to a &#8220;presumption&#8221; of guilt.</p></blockquote>
<p>It is easy to see why so many people (including the television show talking heads) remain convinced that at the least the three suspects have not told the whole story and worse they are covering up for a serious crime which some speculate was disposing of the victims body after an accidental death and some think even murder.  Hopefully, investigators are not at a dead end. The best approach in some people&#8217;s opinion would be attractive awards for people giving information, which would lead to the arrest and conviction of anyone who participated in a crime.  </p>
<p>Courts in many circuits have approved giving  juries instruction of this nature: </p>
<blockquote><p>
      &#8220;False exculpatory statements are properly admissible as substantive evidence tending to show consciousness of guilt.&#8221; </p>
<p>See, in addition to the Eighth Circuit cases cited above,<br />
United States v. Zang, 703 F.2d 1186, 1191 (10th Cir. 1982), cert. denied, 464 U.S. 828 (1983);<br />
United States v. McDougald, 650 F.2d at 533 [noting that such instructions "have long been approved by the courts" (citing Wilson)];<br />
United States v. Boekelmon, 594 F.2d 1238, 1240-41 (9th Cir. 1979);<br />
United States v. Pringle, 576 F.2d 1114, 1120 (5th Cir. 1978).  </p></blockquote>
<p>So, it is apparent that the exculpatory lies told by both Joran and the Kalpoes, proven to be false by their second, also exculpatory, tale would be sufficient evidence for conviction of a crime if they had been charged, indicted and tried in a United States court of law.  The gravity and significance of this first exculpatory lie is made even more applicable as evidence of guilt when it is known that that first lie was not corrected until ten days into the search for the missing girl with the obvious intent (because the defendants were aware of the investigation, concern of her family and friends that she had still not been found) of misleading the police to assume that no harm had come to her and to be less diligent in their investigative and search efforts.  And while the title of the book is<em> &#8220;No Evidence of a Crime&#8221;</em> such a premise is indeed proven false by the application of the substantial legal precedence regarding the admissibility of exculpatory statements subsequently established to be untrue by the defendant&#8217;s own later additional exculpatory accounts of their involvement.</p>

<p style="text-align:left;">This is probably going to sound extremely coldhearted, but the moment news of the blonder than blonde, blue eyed, all American good teen&#8217;s disappearance hit airwaves (and it hit EVERY airwave for MONTHS) all I could think was, &#8220;This is going to make one hell of a MFTV movie.&#8221; Boy was I wrong.</p>
<p><em>Natalee Holloway</em> premiered on the Lifetime Movie Network a couple months ago, but being that my cable package does not feature this channel (which I consider both a blessing and a curse) I had to wait until they sent it over to their sister network for its own Saturday night basic cable package premiere.<img class="aligncenter size-full wp-image-815" title="natalee_holloway_VLP_stil" src="http://veryspecialepisode.wordpress.com/files/2009/07/natalee_holloway_vlp_stil1.jpg" alt="natalee_holloway_VLP_stil" width="500" height="276" /></p>
<p>[Sidenote: I  texted my mother so she would remind my grandmother (who didn't miss a single second of Holloway coverage and who is convinced that Natalee was sold instantly into white slavery for a hefty sum) that the movie version would be on at 8 pm on channel 31, which my mother almost forgot to do until she saw my grandmother in the car behind her in the Kentucky Fried Chicken Drive Thru. <p><img class="alignright size-full wp-image-816" title="s-NATALEE-HOLLOWAY-MOVIE-large" src="http://veryspecialepisode.wordpress.com/files/2009/07/s-natalee-holloway-movie-large.jpg" alt="s-NATALEE-HOLLOWAY-MOVIE-large" width="260" height="190" />At any rate, I was less than pleased at this movie whose release I had been anticipating for four long years. Let&#8217;s start with casting. We all know what Natalee looks like. We saw that damn yearbook and graduation photo everyday for so long that years from now if I see it, I&#8217;ll probably assume she was a classmate. And in all those pictures of her, her most defining characteristic (to me) was her really long, super straight, extremely blonde hair. Since acting skills are unnecessary in a Lifetime movie, any girl could have played the part of Natalee, so long as she had the long, straight, blonde hair. Oh wait no? You want to go with a this girl with wavy, sandy, blonde hair? Okay, that&#8217;ll do. I&#8217;m going to forgive that they cast the innocent-esque, religious, Southern mother with a rough, wifebeater clad tough gal, who looked like she worked out with Madonna or Sarah Connor and smoked all day, because at least they didn&#8217;t cast that Callie Duquesne character from CSI, which I would have expected.</p>
<p>All I wanted from this movie was to SEE what happened. I know we don&#8217;t ACTUALLY KNOW the true story, because the Van der Sloot guy was obviously a shady, unscrupulous murderer/rapist, but come on, I didn&#8217;t want 15 minutes of Natalee&#8217;s graduation and ten minutes of partying in Aruba, followed by an hour and a half of Beth Twitty on CNN, I ALREADY SAW THAT SHIT! The movie did flashbacks, for each statement the suspects gave, which boiled down to watching Van der Sloot make out with Natalee on the beach a dozen times and then leave her there to sleep. When that reporter in Holland got Van der Sloot to admit that she &#8220;died&#8221; on the beach so he found someone to take her a couple miles out into the ocean on a boat to hide the evidence, I sadly had to laugh when they showed them taking her out to sea, as her twitching hand hung over the side of the boat, suggesting that she was still alive when they &#8220;dumped the body.&#8221;</p>
<p>Maybe the best part of the movie though, was the Natalee&#8217;s kid brother, who they just left at home alone in Alabama while they searched for their favorite child? Every scene that featured him was him sitting alone on the couch watching news coverage of his sister&#8217;s disappearance. At one point, he made himself some Hot Pockets, and deciding he was too sad to eat them, just threw them in the trash. Come on, it&#8217;s funny.</p>
<p>All in all, this absurd re-enactment of a &#8220;national tragedy&#8221; was par for course, but if you&#8217;re looking for real &#8220;based on a true story&#8221; entertainment, I suggest something featuring Amy Fisher.</p>

<p>Today, Cummings amended that message, stating that he wants help from everyone except for Cindy and <span class="taxInlineTagLink">George Anthony</span>.</p>
<p>Cummings disappeared from her bed in Satsuma, Florida, back in February.</p>

<p><strong>Natalee Holloway: </strong>A television movie based on her <a href="http://themediasizzles.com/2008/11/18/november-18-2008-pt-2/" target="_blank">disappearance</a> gave the Lifetime Movie Network its <a href="http://www.variety.com/article/VR1118002635.html?categoryid=14&#38;cs=1" target="_blank">best ratings</a> ever.  If only that would bring her back.  Sigh.</p>

The result &#8212; a &#8220;perfect storm&#8221; on the Internet as renewed interest in the case immediately catapulted the term &#8220;Natalie Holloway&#8221; to the top of the search engine charts. Our two stories about the case received thousands of hits overnight and the visits will no doubt continue to increase as the day progresses.</p>
<p>As a result of this new interest we&#8217;ve learned something ourselves: the suspect in Natalie&#8217;s disappearance was recently filmed again with a hidden video camera &#8212; this time involved in human trafficking of Thai prostitutes to work in Europe. Joran Van der Sloot was caught out in Bangkok Thailand last November, 2008 by undercover reporters posing as Dutch sex industry bosses. Van der Sloot was videotaped accepting cash to arrange immigration and travel documents for the girls &#8212; who believed they were being hired as dancers in the Netherlands at $400 per month.</p>

<p>What a nasty piece of work this Joran Van der Sloot is. As related in our February 4, 2008 story (link below), Van der Sloot was befriended by an undercover reporter and confessed on hidden video that he had disposed of Natalie&#8217;s body possibly while she was still alive.</p>
<p>The name Natalie Holloway will be synonymous with the word &#8220;Aruba&#8221; for the foreseeable future &#8212; perhaps even decades into the future if her disappearance remains unsolved.</p>
<p>As a side note, we at Barbados Free Press are reminded every once in a while of the power of the Internet to give worthy stories &#8220;legs&#8221; &#8212; staying power in the public consciousness. Although public interest in a story might fade in the news cycle, when something makes the story current, all the background is instantly available to ordinary people on the Internet. As we have seen ourselves on numerous occasions, these legacy stories can result in tens of thousands of new visitors over a day or two.</p>
<p>In Barbados, the political and media elites still think they can effectively control information and the public consciousness. How quickly Prime Minister David Thompson and his DLP party have forgotten the lessons of the 2007 campaign &#8212; when a handful of blogs run by ordinary citizens were probably the tipping point in the fall of the Owen Arthur government and the election of the DLP.</p>
