<title><![CDATA[Niger&#39;s 6th Republic stumbles on, looking for the door]]></title>

<p>No end is yet in sight for the Nigerien political crisis, begun when President <a class="zem_slink freebase/guid/9202a8c04000641f80000000002e1175" title="Tandja Mamadou" rel="wikipedia" href="http://en.wikipedia.org/wiki/Tandja_Mamadou">Tandja Mamadou</a>, facing the end of his term-limited mandate on 22 December, decided to scrap the constitution of the 5th Republic, and grant himself three years grace period in which to create a 6th Republic. The alienation of most of the political class was expected, but the severity of ECOWAS rhetoric was likely not.  Niger&#8217;s rulers would have expected this to be wrapped up by now, with the previous legal deadline for a new president to pass with a shrug.  But the personal interest of current ECOWAS chair Nigeria &#8212; Niger&#8217;s massive neighbor and largest African trade partner &#8212; has meant that President Tandja has been excluded from the body, branded as a coup leader, and placed alongside Capt. <a class="zem_slink freebase/guid/9202a8c04000641f800000000a4b80b5" title="Moussa Dadis Camara" rel="wikipedia" href="http://en.wikipedia.org/wiki/Moussa_Dadis_Camara">Moussa Dadis Camara</a> as a poster child for what&#8217;s wrong with West African governance.</p>
<p>And while Blaise Compaore, assigned mediation duties in Guinea, seems intent on finding a way for Dadis to stay in power despite his wholesale slaughter of his own people, Yar&#8217;Adua&#8217;s government has kept an unusual concentration of pressure on Niamey. [see <a title="http://tomathon.com/mphp/?p=462" href="http://tomathon.com/mphp/?p=462" target="_blank">Niger:Piling on the Pressure</a> for details] Sadly, this has far exceeded any pressure the remarkably unified internal opposition has been able to bring to bear internally.</p>
<p>Should effective ECOWAS pressure escalate as they promise, <a title="http://www1.voanews.com/english/news/africa/ECOWAS-Backs-EU-Ultimatum-to-Nigers-Leaders--78346052.html" href="http://www1.voanews.com/english/news/africa/ECOWAS-Backs-EU-Ultimatum-to-Nigers-Leaders--78346052.html" target="_blank">seconded by sanctions by crucial donors</a> like France, the EU, and the US, Niger&#8217;s new 6th Republic can&#8217;t carry on indefinitely. Current Chinese projects don&#8217;t fill the gap with direct payments.  While uranium and oil revenue continue to flood in, too much of that has gone to support a small group of businessmen around Tandja to enable the government to balance the budget with it. Wages will not be paid, loans will not be forthcoming, the military will miss their trips to Fréjus, and there will be trouble.</p>
<p>But if Tandja is toppled or forced to give way in this manner, it will be an inside job by the political and military leadership who aided his new constitutional order.</p>
<p>&#8211;</p>
<p>Niger has had a lot of constitutions, and they tend to be none too creative rehashes of previous documents. <a title="http://fr.wikisource.org/wiki/Avant_Project_de_Constitution_de_la_6eme_R%C3%A9publique_du_Niger_%282009%29#TITRE_IV_:_DU_POUVOIR_LEGISLATIF" href="http://fr.wikisource.org/wiki/Avant_Project_de_Constitution_de_la_6eme_R%C3%A9publique_du_Niger_%282009%29#TITRE_IV_:_DU_POUVOIR_LEGISLATIF" target="_blank"> The 6th</a> was generated in less than a week, and declared &#8220;in effect&#8221; within days of the August referendum. It recycles much of the 5th Republic (semi-presidential 1999), with elements of the failed 4th Republic (General Baré Maïnassara&#8217;s strong presidency and ceremonial legislature). To give you a feel for the slapdash nature of current Nigerien jurisprudence, the constitution calls for a strong presidency which appoints all ministers &#8212; including the PM &#8212; and most of the judiciary and &#8220;independent&#8221; governing bodies. In most every public power carried over from the last constitution, there is simply a clause added which gives either the President or a body he appoints the power to suspend or override its function &#8220;when needed&#8221;. For new bodies, their description is invariably followed by something like &#8220;..whose functions and composition will be determined by law.&#8221; Later.</p>
<p>The &#8220;new&#8221; Legislature includes a National Assembly, whose law-making functions can be largely replaced by the President and his Council of Ministers.  Their primary task, the annual budget legislation, must also be passed by a new second house, the Senate, which has not yet been created.  The constitution says that the President will appoint a third of this Senate&#8217;s members, while bodies such a the council of Chieftancies and other government commissions will &#8220;indirectly elect&#8221; the remainder.  I have yet to find any serious discussion of this body in the government&#8217;s daily mouthpiece, Le Sahel, let alone a schedule for it&#8217;s appearance.</p>
<p>The <a class="zem_slink freebase/guid/9202a8c04000641f80000000009a1196" title="National Assembly of Niger" rel="wikipedia" href="http://en.wikipedia.org/wiki/National_Assembly_of_Niger">Nigerien National Assembly</a> has historically sat in two short sessions each year.  The first Hemicycle of the new Assembly has just wrapped up, but its hard to see what they accomplished.  Committee rules were written up by a group led by former Communications Minister and close Tandja loyalist Mohammad Ben Omar, former PM and current MNSD party chief <a class="zem_slink freebase/guid/9202a8c04000641f8000000005788d50" title="Seyni Oumarou" rel="wikipedia" href="http://en.wikipedia.org/wiki/Seyni_Oumarou">Seyni Oumarou</a> was named President of the Assembly, and heads of each of the minor parties was given an important sounding office. because of the opposition boycott, there is no opposition in the Assembly. A budget for 2010 was announced in the President&#8217;s Council of Ministers and adopted by the National Assembly, calling for an increase in direct budget supports from foreign donors, which the government relies upon to pay the bills.  That these will soon be cut by many donors seems to have eluded normally erudite Finance Minister Zeine. The leadership then wrapped up by<a title="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2738:-lmissionr-parlementaire-que-sest-il-passe-a-luanda&#38;catid=44:politique&#38;Itemid=61" href="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2738:-lmissionr-parlementaire-que-sest-il-passe-a-luanda&#38;catid=44:politique&#38;Itemid=61" target="_blank"> chartering a junket to Angola</a> for the 18th Joint Parliamentary Assembly of Africa, Caribbean and Pacific plus European Union (ACP/EU).  All interested members were offered a large stipend to fly down and look like a real parliament.  At least one member <a title="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2749:-scandale-a-lassemblee-&#38;catid=44:politique&#38;Itemid=61" href="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2749:-scandale-a-lassemblee-&#38;catid=44:politique&#38;Itemid=61" target="_blank">reportedly took the stipend but chose to stay in Niamey</a>.  And then the gavel fell of the first Assembly session of Niger&#8217;s 6th Republic.</p>
<p>And while the domestic and foreign press is rife with speculation, there seems little movement to resolve the crisis. The opposition, including two former Prime Ministers, one former President, and a large split from Tandja&#8217;s ruling MNSD, vows to eject the current President from power, and mark the 22nd with a final repudiation of his holding any legal office. Expect demonstrations and some violence in major cities.</p>

<p>Niger is an overwhelmingly rural society, in which the vast majority of the population do not participate in politics, intent as they are with meager rain-fed substance agriculture in the strip of Sahel along the south and west of the nation. The time leading up to harvest, taking place now or in the last month, is &#8220;the hungry season&#8221; in which rural people work much and eat little. Even many urban Nigeriens return to farms to help with the crop and pad their food supply. Rains in some areas of the west stopped for a crucial period in June this year, causing farmers there to replant, and millet crops to be less than expected.  As if that were not preoccupation enough, the time after Tabaski and harvest begins the &#8220;exodé&#8221; when as many as a third of rural men (and a few women) travel as far afield as Ghana, coastal Nigeria, Benin or Côte d&#8217;Ivoire to work odd jobs, coming home in several months with clothes, supplies, and a little cash.  Short of ECOWAS closing the borders, Nigeriens are unlikely to be roused to large scale political action in the next few months.</p>
<p>ECOWAS negotiator Abdulsalami Abubakar, the former Nigerian general and interim president who led his nation out of military rule, <a title="http://www.reuters.com/article/marketsNews/idUSGEE5B022Q20091201" href="http://www.reuters.com/article/marketsNews/idUSGEE5B022Q20091201" target="_blank">has continued his negotiations with opposition and government</a>, demanding a directly negotiated solution between the parties. Nigerien PM Ali Badjo Gamatié, <a title="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2741:fin-de-la-mission-du-premier-ministre-sem-ali-badjo-gamatie-a-libreville-au-gabon-sous-le-signe-du-renforcement-des-liens-de-cooperation-entre-nos-deux-pays&#38;catid=44:politique&#38;Itemid=61" href="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2741:fin-de-la-mission-du-premier-ministre-sem-ali-badjo-gamatie-a-libreville-au-gabon-sous-le-signe-du-renforcement-des-liens-de-cooperation-entre-nos-deux-pays&#38;catid=44:politique&#38;Itemid=61" target="_blank">jetting from one West African capital to another</a> has recently  acceded &#8212; in theory &#8212; to such negotiations. Several recent <a title="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2740:-dialogue-politique--gamatie-un-cheveu-dans-la-soupe-tazarchiste-&#38;catid=44:politique&#38;Itemid=61" href="http://www.tamtaminfo.com/index.php?option=com_content&#38;view=article&#38;id=2740:-dialogue-politique--gamatie-un-cheveu-dans-la-soupe-tazarchiste-&#38;catid=44:politique&#38;Itemid=61" target="_blank">opposition press stories</a> have postulated that Gamatié</p>

<p>is eager to split off the hard core Tazarché (pro-Tandja) forces who have become a political force parallel to the ruling MNSD.  The Assembly elections of October were already read as such a movement, with the return of MNSD apparatchiks at the expense of an influx of &#8220;independent&#8221; business men close to the president and his sons.  Yet Gamatié is technically himself an Independent, not a MNSD minister, and brought in for that reason.</p>
<p>The rumored &#8220;solution&#8221; to this crisis, the creation of a 7th Republic with Tandja as a figure head and his <em>bête noire</em> former ally <a class="zem_slink freebase/guid/9202a8c04000641f8000000000219761" title="Hama Amadou" rel="wikipedia" href="http://en.wikipedia.org/wiki/Hama_Amadou">Hama Amadou</a> as head of a transitional authority, remains just rumor.  The re-assertion of the old line MNSD over the pure Tazarchistes may make the political bloodletting easier to take, but many powerful men have publicly hitched their stars to the 6th Republic and the President himself.</p>
<p>Creeping personalization of rule is after all par for the course in such regimes, but a sudden and unexpected transition from one government to another is not a new phenomena in Niger.  The genius of the Nigerien political class is, arguably, their ability to not only change political sides, but to successfully hit the &#8220;reset button&#8221; after dramatic change. Very few of the high ranking members of Ibrahim Baré Maïnassara&#8217;s 4th Republic saw their political careers &#8212; or access to the state &#8212; end following his death at the hands of his own former coup leaders in April 1999.</p>
<p>Tandja, whose government has been supported from the outset by the group of officers surrounding Chief of Staff General Moumouni Boureima, has since 2004 relied on the unwavering support of the RDP-Jama&#8217;a, Baré Maïnassara&#8217;s old party.  Their only identifiable founding principle is the rollback of the 1999 immunity against those who carried out the April coup, including Moumouni Boureima.  It&#8217;s current leader, Hamid Algabid flew to Abudja in November to plead with ECOWAS to support Tandja&#8217;s new regime. Still, the constitution of the 6th Republic maintains a blanket immunity for officers like Boureima.</p>
<p>Algabid is a good illustration of how reinvention is easy for the Nigerien elite.  A Tuareg from Tanout, Algabid rose to the office of Secretary General of Finance in</p>

<p>Hamani Diori&#8217;s First Republic.  When Seyni Kountché led a coup in 1974 and imposed almost a decade of extra-constitutional government, Algabid flourished, being appointed to several international posts and becoming Minister of Finance.  When a token civilian government was named in 1983, Algabid became its second Prime Minister. When the gray formless General Ali Saïbou succeeded to power on Kountché&#8217;s death, Algabid served him for a year, before being kicked up to head the Organisation of the Islamic Conference throughout both the authoritarian Second Republic and the post-revolutionary Third Republic.  When Baré Maïnassara took power, Algabid failed in a bid to become Secretary General of the UN (!), and agreed instead to head the General-President&#8217;s new party, made up almost entirely of defectors from the boycotting civilian parties. After 1999, Algabid led RDP-Jama&#8217;a into a coalition with the social democratic PNDS (a leader in the opposition to Baré Maïnassara, and now Tandja) before changing their minds in 2004 and supporting the president.</p>
<p>So while a few diehards newly lifted to great heights will fall should Tandja go, most of the political class will just change seats. Look for that jockeying with an eye to a post-Tandja future at every meeting of Nigerien officials with ECOWAS. The final key is where it always was, with Moumouni Boureima and a group of several officers who are all veterans of the 1999 CRN coup government. <p>Even if nothing comes of that, the moment a 7th Republic looks more likely to those currently in government than the stumbling on of the 6th, Tandja will be carried out on his throne.  Pressure is important, then, but unless either ECOWAS or the opposition exhibit to heretofore unseen ability to generate outside force or popular unrest, Tandja will exit thanks to an inside job.</p>

<title><![CDATA[The Government Explains Land and House Taxes and the Road Taxes' Increase - Tuesday, 1.12.2009]]></title>

<p>&#8220;Phnom Penh: Government officials and parliamentarians from the Cambodian People&#8217;s Party explained in detail the regulations for setting of taxes on land and houses, and the increase of road taxes in 2010. This decision is part of the decisions for the national budget for 2010 which the National Assembly discussed and approved on Monday 30 November 2009.</p>
<p>&#8220;Defending the national budget draft for 2010, officially known as a financial management law for 2010, during the parliament session on Monday morning, the Minister of Economy and Finance, Deputy Prime Minister Keat Chhon, said that the increase of road taxes and the collection of taxes for real estate including land, houses, buildings, and constructions are a measure to seek additional income while Cambodia is encountering an economic and financial crisis. </p>
<p>&#8220;Deputy Prime Minister Keat Chhon added that measures of the government to create taxes on land and houses is not expected to bring in much here in Phnom Penh, because there are 180,000 houses from which only US$3 million to US$9 million can be made. This tax collection will surely be made from high ranking officials and rich people, but it does not have an impact like the tax rates of land and houses in foreign countries, where up to 1% of the total value is charged. In our country, it is only 0.1%. The government will use it to reduce the state support of resources to under national levels and to expand taxation culture which is a movement for direct tax income in the future.</p>
<p>&#8220;Deputy Prime Minister Keat Chhon stressed that this new tax was created after proper studies, by an assessment committee, but it is not to frighten the people.</p>
<p>&#8220;This statement of the Minister of Economy and Finance is a defense and a response to the criticism of Sam Rainsy Party parliamentarians when the parliament begun discussing to approve a draft of the national budget for 2010. </p>
<p>&#8220;The total national budget for 2010, about US$2 billion, was criticized by the Sam Rainsy Party because of the increased expense allocated for national defense and security, which amounts to about US$274 million, while expenses allocated for agriculture and contributing to the development of the national economy were increased by only 5%. </p>
<p>&#8220;Sam Rainsy Party parliamentarians also opposed the policy to collect land and house taxes, and to augment road taxes from automobiles, which is proposed as a measure to increase income for state expense in 2010. </p>
<p>&#8220;Parliamentarian and spokesperson of the Sam Rainsy Party, Mr. Yim Sovann, said during the parliament session that to augment road taxes and the collection of land and house taxes are strange moves and cannot be supported. Both the rich and the poor cannot cry during the economic crisis at present, because their houses and their land cannot be sold, and some even are indebted to banks.</p>
<p>&#8220;The parliamentarian Yim Sovann suggested that the government should try to be brave to collect other taxes, like from visits to the Angkor Wat Temples [contracted to a private company], from forest exploitation, from land contracted out as economic concession land, and to monitor the selling of state property, so that it becomes transparent. Doing so, the state will have increased income and does not need to collect taxes from houses and to increase the road tax. </p>
<p>&#8220;The National budget law for 2010 says that taxes will be collected from real estate such as land, houses, buildings, constructions, and others, with a value over Riel 100,000,000 [approx. US$25,000]. The tax will be collected annually at a rate of 0.1% of the total value of the real estate. But the tax excludes agricultural land, and land and buildings of the government, of communities, or individuals who serve religious or humanitarian activities. But houses for normal citizens must pay taxes. </p>
<p>&#8220;The budget law for 2010 foresees also an increase of taxes on means transportation including automobiles (road taxes):</p>
<ol type="1">
<li>Vehicles with a power over 12 HP to 17 HP, within 5 years from their production date, have to pay Riel 500,000 [approx. US$125] each year, and after the 5th years, it is Riel 360,000 [approx. US$90].</li>
<li>Cars with a power over 17 HP to 24 HP, within 5 years from their production date, have to pay Riel 1,600,000 [approx. US$400], and after the 5th year, it is Riel 1,200,000 [approx. US$300]. </li>
<li>Cars with a power over 24 HP, like Lexus&#8217; and Land Cruisers, had to pay only Riel 1,000,000 [approx. US$250] for road tax in the previous year, but next year, they will be charged Riel 2,000,000 [approx. US$500]. </li>
<li>As for passengers&#8217;, general transportation, and tourists&#8217; cars with a power of 12 HP, and small motorbikes, their taxes are kept at the same level.</li>
</ol>
<p>&#8220;However, 106 parliamentarians among 109, who were present during the session on Monday morning, raised their hand in favor of the overall content to accept the draft of the national budget for 2010 to be discussed and approved. The Parliament session continued until Monday afternoon, and the parliament plans to continue to discuss the national budget law, which consists of 6 chapters and 20 articles, on Tuesday morning.&#8221; <em>Rasmei Kampuchea, Vol.17, #5061, 1.12.2009</em>	</p>

  &#8220;Phnom Penh: Personnel of the National Assembly (not to be confused with the 123 parliamentarians) is required to receive their salaries through a bank account and to pay taxes for their salaries; according to the plan, this will start from January 2010.
</p>
<p>
  &#8220;On 25 November 2009, 73 persons employed at the National Assembly, in positions of directors and deputy directors of departments, are preparing documents and have their photos taken to fill in application forms to open accounts at the <A href="http://www.anzroyal.com">ANZ Royal Bank</A>. This is the first step. Next comes the filling of forms by normal staff of the National Assembly &#8211; their total number is not given. But it is known that those staff are under the administration of the secretariat of the National Assembly, where at present, there are 1,200 staff members and some other contracted persons.
</p>
<p>&#8220;Officials of the National Assembly in charge of this work said that the National Assembly organizes to release the salaries through a bank, following public financial reforms of the Royal Government. Also, this eases the release of the salaries for civil servants at other cities and in the provinces, as they need not come to collect their salaries in Phnom Penh, and it improves the efficiency of the management of resources. The release of salaries to staff of the National Assembly through a bank will begin in January 2010. </p>
<p>&#8220;The private ANZ Royal Bank received the exclusive right from the Cambodian government to handle the release of the salaries of civil servants and officials of all ministries and institutions. This agreement was made in mid 2007.</p>
<p>&#8220;The head of the commercial communication section of the ANZ Royal Bank, Mr. Nou Netra, who is organizing the documents to open bank accounts for the staff of the National Assembly, said that so far, the ANZ Royal Bank has already prepared to release the salaries for 35 of the 36 state institutions, and it has been operating at 27 ministries.</p>
<p>&#8220;Meanwhile, personnel of the National Assembly will also have to pay taxes on their salaries, which had been decided to begin in October 2009, but the National Assembly had asked to delay it until early 2010.</p>
<p>&#8220;During a meeting between the secretariat of the National Assembly and tax officials of the Ministry of Economy and Finance last week, tax officials mentioned the order of Prime Minister Samdech Hun Sen regarding the collection of taxes on salaries of civil servants at all ministries and state and private institutions.</p>
<p>&#8220;Monthly salary taxes will be collected in accordance with the amendment of the taxation law that was published to be used on 31 March 2003.</p>
<p>&#8220;The ranges for the collection of taxes on staff salaries are set as follows:</p>
<ul>
<li>from Riel 500,001 [approx. US$125] to Riel 1,250,000 [approx. US$312]: 5%</li>
<li>from Riel 1,250,001 to Riel 8,500,000 [approx. US$2,125]: 10%</li>
<li>from Riel 8,500,001 to Riel 12,500,000 [approx. US$3,125]: 15%</li>
<li>more than Riel 12,500,000: 20%.</li>
</ul>
<p>&#8220;It should be noted that the total number of staff of the National Assembly and the total amount of their salaries are not given. But the amount of their salaries depends on their experience and certified level of education. Normal staff who are high school graduates earn more than Riel 600,000 [approx. <p>“Phnom Penh: The Appeals Court of Cambodia issued a  surprising decision, sentencing Ms. Chea Ratha [a former military police brigadier general, who had a lesbian relationship with actress In Soklida] for 18 years to jail for an acid attack against the aunt of the actress In Soklida, and also other accomplices are to be imprisoned. The decision made by the Appeals Court at this time is totally in contrast to the former decisions made by the Phnom Penh Municipal Court to dismiss the accusations against the accused persons.</p>
<p>“The acid attack against Ms. In Soklida’s aunt had been brought for a hearing and judgment by the Appeals Court on 27 November 2009, with Mr. Seng Sivutha as the head of the council of judges, with Mr. Nhoung Thul and Mr. Thou Monei as members, and with Mr. Hean Rith as representative of the prosecutors. </p>
<p>“The judgment decided to uphold Decision 82, dated 31 August 2009, of the Phnom Penh Municipal Court, but rejected Point 1, which is related to punishments for all who had been charged. The new decision of the Appeals Court exempts Meas Mao, male, 40; and Meas Chandy from the charge of illegal gun use, but sentenced them to serve 18 years in prison for violating the right of an individual, and for planned and attempted murder. Chea Ratha, female, 43, was removed from the charge of illegal use of a weapon, but she is convicted to serve 18 years in prison for planned and attempted murder. Ie Puthea, male, 33, and San Savuth, called San Sanut or Nut, 29, were freed from the charge of using a weapon illegally, but are to be imprisoned for 15 years for violating the right of an individual, and for collusion in a planed and attempted murder. Siek Sophal, male, was removed from the charge of using a weapon illegally, but is to be jailed for 15 years. Chan Dara, male, was removed from the charge of using a weapon illegally, of violating the right of an individual, and of collusion in an attempted murder, that means he is free from all accusations. All the six accused persons were ordered to pay to cover the cost of the medical treatment and to compensate the plaintiff with US$100,000, and an arrest warrant was issued to arrest those who escaped.</p>
<p>“It should be noted that the acid attack against Ms. In Soklida’s aunt occurred on 8 May 2008 in front of the RHAC Hospital on street 433, Tuol Tumpung 1, Chamkar Mon, Phnom Penh. </p>
<p>“The Phnom Penh Municipal Court had sentenced to dismiss the accusations against all accused persons, but the plaintiff’s lawyer later appealed against this judgment, and there was also a complaint from the prosecutor of the Appeals Court dated 23 September 2009. </p>
<p>“The reason leading to this new judgment is that there was an acid attack against the victim Ya Sok Nim, Ms. In Soklida’s aunt, by two unidentified persons, who rode a 2008 Viva motorbike, and then stopped behind her to attack her with acid, and escaped. </p>
<p>“After the event, the victim’s husband lodged a complaint to the authorities to solve the case according to the law, but he could not identify the perpetrators’ faces. </p>
<p>“According to a note of the victim read by a clerk, a day ahead of the attack, bodyguards and Chea Ratha came to her house to ask for information about her niece (In Soklida), but she said that she did not know where she was. They asked to check in the house, but they still could not find her. Then they left. </p>
<p>“A few days later, Chea Ratha phoned to warn her, ‘If you do not deliver In Soklida, there will be bloodshed.’ This i was recorded, and her voice was played in the municipal court. Later on, the acid attack happened on 8 May 2008.</p>
<p>“Sok Chey, a person who witnessed the event, said he saw two men, whose faces he could not identify as they wore masks, but remembers their appearance, as they appeared behind the victim, attacked her with acid, and escaped. </p>
<p>“After that, police arrested two perpetrators, after showing their photos to the victim. The victim was sure that they were the perpetrators, bodyguards of Chea Ratha, as the victim had gone to the accused&#8217;s house [Mr. Chea Ratha’s house]. </p>
<p>“After hearing the information and conclusions from the prosecutors, the Appeals Court took the decision as mentioned above.&#8221; <em>Rasmei Kampuchea, Vol.17, #5059, 28.11.2009</em></p>

<p>The Camboia Daily reported on Saturday/Sunday 28/29, November 2009:</p>
<p>&#8220;Mr. Ratha&#8217;s defense attorneys Keo Ya and Nach Try, who had lobbied Cabinet Minister Sok An ahead of the municipal court trial of Mr. Ratha seeking his intervention to have the case dropped, said they were unaware of their client&#8217;s whereabouts. Council of Ministers spokesman Phay Siphan said on Thursday that the lawyer&#8217;s letter was not considered in any way by Mr. Sok An, as it was the work of the courts.&#8221;</p>
<p>&#8220;There was no report that the office of the Deputy Prime Minster rejected this attempt, requesting an illegal act of influencing the court.&#8221;</p>

<p>&#8220;Phnom Penh: Pointing to the importance to create a law about non-government organizations (NGOs) being drafted by the government, the Cambodian Prime Minister said on 24 November 2009 that previous problems caused by some NGOs encourage the government to create a law on organizations of different kinds, in order to ensure their proper operation, but this law will not affect the freedom of the NGOs.</p>
<p>&#8220;Examples raised by Samdech Akkak Moha Senapadei Dekchor Hun Sen during the 30th anniversary celebration of the partnership between NGOs and Cambodia, were of an organization which had been prosecuted in the United State regarding the adoption of children from Cambodia, which finally became human trafficking, and of another organization that sheltered under an NGO some years ago and had taken the British Embassy as its target for a terrorist attack, but this plan was suppressed in time by the government. [The terrorist] Hambali left Cambodia and was later arrested in Thailand, after the attack on the island of Bali in Indonesia.</p>
<p>&#8220;Prime Minister Samdech Hun Sen said, &#8216;These examples do not imply that the Royal Government is suspecting other organizations that are implementing good activities of participating in terrorism, but please do not forget that some organizations are doing bad things.&#8217; Therefore, we need a law to control NGOs. He stressed, &#8216;I guarantee that it is not an action to restrict the freedom of NGOs, please believe me.&#8217;</p>
<p>&#8220;During the 1980s there were just less than 30 NGOs in Cambodia. But by 2009, there are 3,207 NGOs and associations, where 1,933 are NGOs and 1,274 are associations, that is why Samdech Dekchor Hun Sen observed that Cambodia is a heaven for NGOs that carry out different activities.</p>
<p>&#8220;The claim about the practicality of an NGO law was made, while an NGO law is being drafted carefully by the Royal Government; some NGOs expressed the fear that the Royal Government will exercise prohibitive controls over NGOs through that law. Prime Minister Samdech Hun Sen said, &#8216;I am aware that some NGOs that have acted correctly, and they do not care too much about this law, but some organizations protested loudly, and I wonder why they claim to promote the rule of law, but they want to act without a law.&#8217;</p>
<p>&#8220;Samdech Dekchor Hun Sen added, &#8216;Anyway, we will neither restrict the freedom to creat NGOs, nor take away the funding of NGOs.&#8217; He added that some NGOs demand that the government has to be transparent, providing information, but they themselves do not have such transparency. The Royal Government wants to know where NGOs get the money from and how they use it for what. &#8216;Just this they do not want to tell, but they oppose the government. The Royal Government also wants to know how much capital is from government, from development partners, and from NGOs, so that we can know the total amount of capital to allocate each year in each sector, where at present, we do not control it and we are not aware of how many activities are contributed by NGOs. This point creates difficulties for macro management or other relevant tasks.&#8217; Samdech went on to say that sometimes, there are some overlapping activities of NGOs, and what is more problematic is that some NGOs had expressed their voice absolutely in the same way as opposition parties. Such organizations protest more than others, because they feel afraid, just because the laws in Cambodia do not allow political parties to receive funds from foreign donors.</p>

<title><![CDATA[Wear a White Ribbon]]></title>

<description><![CDATA[Today is “International Day for the Elimination of Violence against Women”, a day that has been mark]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Today is “International Day for the Elimination of Violence against Women”, a day that has been marked as a day against violence since 1981. </p>
<p>On a European basis, one in 5 women has been subjected to domestic violence. Large studies show that at least 30-50% of women between 16 and 67 have at one time been victims of physical or sexual violence, and if psychological violence is included the figures raise to between 45-50%.</p>
<p>None of the EU Member States are succeeding in successfully addressing this problem on their own. The forthcoming Spanish Presidency has announced that they will put violence against women on top of the agenda and propose to set up an Observatory on Violence against Women in the EU Gender Institute. </p>
<p>Last year I called upon the Welsh Assembly Government to fund an awareness raising campaign to challenge attitudes towards violence against women, and I’m glad to say that the government took my comments seriously.</p>
<p>The Assembly government has been consulting on a new action plan, and I welcome that eliminating violence against women is at the heart of this plan.</p>
<p>As a society we need to work towards respecting each other, and I urge everyone to wear a white ribbon as a small step towards this.</p>

<title><![CDATA[An Opposition Party: The Government Should Control the Cambodia Air Traffic Service Itself - Monday, 23.11.2009]]></title>

<p>&#8220;There had been several reports that information about confidential flight plans by the Cambodia Air Traffic Service (CATS) controlled by Thai people were leaked. The opposition party has demanded that the government should take control of the air traffic control itself, but there is no response. And now everything seems somewhat too late.</p>
<p>&#8220;The spokesperson of the Sam Rainsy Party, Mr. Yim Sovann, spoke to the media late last week, saying that the government should take the CATS company under its control to ensure that there is no economic loss, and it would be easier for the government to control national secrets. Mr. Yim Sovann said, &#8216;The Sam Rainsy Party had mentioned this case many times before, suggesting that all these important tasks should not be given to foreigners, and the government should control it by itself. But the state does not care.&#8217;</p>
<p>&#8220;In January 2001, the <A href="http://www.civilaviation.gov.kh/">State Secretariat of Civil Aviation</A> of the Cambodian government signed an agreement with the [Thai] <A href="http://www.samartcorp.com/08/indexen.php">Samart Corporation</A>, providing an exclusive license for 22 years to this company, to organize, operate, and maintain a system for air traffic routing for civil aviation companies in Cambodia, and this company is also required to conform to the technical standards of <A href="http://www.bctair.com/">BCT</A> [an aviation maintenace company]. After receiving the license from the Cambodian government, Samart very quickly prepared the bidding procedure for the radar system and set up the necessary tools needed for its effective air traffic control operations.</p>
<p>&#8220;A parliamentarian from the Cambodian People&#8217;s Party, Mr. Cheam Yeap, agreed that it would be very good if the government would reconsider the air traffic control agreement with the Thai side. He added that Cambodia should have the ability to control this company, rather than allow foreigners to continue to control it. He said, &#8216;We should recheck that investment agreement, and we should check whether our human resources can take the place of the foreigners.&#8217; He explained that Cambodia jointly created the company CATS with Thailand, because, at that time, Cambodia did not have sufficient experts, and air traffic was not so busy [like it is at present]. Mr. Cheam Yeap went on to say that to continue to let foreigners do the air traffic control affects the security of our nation through the secret release of confidential information to their government, adding that foreigners are not honest to us. He said, &#8216;Do not trust foreigners but only those having the same blood as Khmers. If we let them be at that place, they might release confidential information about national security, as one Thai person did already. They are not 100% honest  towards us.&#8217;</p>
<p>&#8220;Mr. Cheam Yeap continued to say that according to new Article 90 of the Constitution of Cambodia, the Royal Government can make a request to the National Assembly ["The National Assembly shall approve the national budget, State planning, loans, financial contracts, and the creation, modification and annulment of tax."]. Then the National Assembly will exercise its right to cancel any contract that can affect the national interest. The Thai spy can be considered as proof to cancel that contract. Another Sam Rainsy Party parliamentarian, Mr. Son Chhay, said that the opposition party had expressed concerns since the beginning about problems of national security. Now, it happened as the Sam Rainsy Party had been concerned. He said he will write a letter to the government, because it is related to national security. </p>
<p>&#8220;He said, &#8216;I also saw information about the arrest of the Thai spy. I think it is an opportunity to respond to the Ministry of Defense and the Council of Ministers which had claimed that there would be no problems, but the problem exists now, and I want to know what measures they take.&#8217; He emphasized that he will write a letter this week to the government to request it to check the control over the CATS company.</p>
<p>&#8220;Because of the secret copy of the flight plan of Mr. Thaksin Shinawatra, the Cambodia government ordered all Thai [CATS] personnel to stop working, after Mr. Siwarak Chutiphong, 31, had been arrested for spying, while the eternal friend of Prime Minister Hun Sen, Thaksin Shinawatra, visited Cambodia, to give a lecture about the Cambodian economy, as he is now an economic advisor of Cambodia.&#8221; <em>Sereypheap Thmey, Vol.17, #1817, 23.11.2009</em></p>

<title><![CDATA[Considering Public Financial Resources - Sunday, 22.11.2009]]></title>

<p>This <a href="http://cambodiamirror.wordpress.com/2009/10/26/credits-extradition-agreements-and-reasons-for-exemptions-sunday-25-10-2009/">Saturday, we reported</a>: &#8220;According to a recent notification from the Council of Ministers, the Royal Government decided to suspend all promotions for government positions in 2010. If a promotion in any position is planned, it has to wait until 2011.&#8221; That was even more surprising than <a href="http://cambodiamirror.wordpress.com/2009/11/11/the-government-cuts-salaries-of-advisers-tuesday-10-11-2009/">another report</a> which the Mirror carried on 10.11.2009: &#8220;The Government Cuts Salaries of Advisers&#8221; &#8211; which, in a way, was only the correction of a violation of common sense (and economic justice): Why should only some public servants, employed full time, get a second salary for an additional function as adviser, a task to be adhered to during working hours which are already covered by another salary? But such double, or even multiple payments for some persons, seem to have gone on for years. In many other countries, the Auditor General – being an independent position without special loyalties – might have intervened many years ago.</p>
<p>When working to select and to present texts for the Mirror, related to some new millions of dollars &#8220;to help Cambodia,&#8221; it is surprising that quite often the text does not specify whether this refers to a credit to be paid back, or to a grant. Even some statements of preference, from where it is more agreeable to receive funds – whether there are conditions of transparency or of human rights adherence part of the agreement, or whether funds come without such expectations – do not distinguish between grants and loans. Though the latter have a minor condition: they have to be paid back.</p>
<p>The <a href="http://cambodiamirror.wordpress.com/2009/10/26/credits-extradition-agreements-and-reasons-for-exemptions-sunday-25-10-2009/"> Mirror referred last month to the loans</a> of about US$ 1 billion Cambodia had contracted with China in 2008 and 2009,  continuing: “We are not aware that details about the timing and the terms of the re-payment obligations were published. Neither did we see any evaluation of the situation in terms of what is called a &#8220;sustainable external debt&#8221; – which is defined by some scholars of economics as &#8220;a situation where a country is expected to be able to meet its current and future debt obligations in full, without recourse to debt relief, rescheduling of debts, or the accumulation of arrears, and without unduly compromising growth.&#8221;</p>
<p>Some old debts did received special attention in recent reporting. On 11 November 2009, one paper had reported, supposedly based on information from high ranking Cambodian officials, that the Russian Government is considering to cancel the US$1.5 billion debt that Cambodia owes to Russia. But this had to be corrected on the basis what high ranking Russian officials said: when the president of the National Assembly and his delegation returned without success from Russia: “Russia Refuses to Cancel Debt” &#8211; it was clear that in spite of similar efforts in 2006 and 2008, the Russian government had not agreed to wipe out these old debts from the 1980ies. While we did not see details about the related negotiations, it is interesting to remember what had been <a href="http://cambodiamirror.wordpress.com/2007/01/29/vol-11-no-493-sunday-and-monday-282912007/">reported formerly in 2007</a>: that the Russian government is prepared to consider arrangements for the old debts under three conditions:</p>
<ol type="1">
<li>Russia asks for the resumption of Moscow-Phnom Penh flights, for the promotion partly of tourism, and partly of investment. </li>
<li>Russia asks Cambodia to strengthen military relations between the two countries by asking the ministries of defense of the two countries to have good relations again, because so many members of the Cambodian armed forces studied in Russia; therefore, the Cambodian Government should accept the request and organize those who studied military affairs in Russia again, and Russia, in turn, promises to accept Cambodian students to study in Russia. </li>
<li>Russia sees the possibility to exploit natural gas in Cambodia, and asks the Cambodian National Assembly to facilitate relations, so that Russia can come to invest in oil drilling, because Russia has long years of experience in [oil and] gas drilling and hopes that Cambodia will allow Russian investors to come to invest in natural gas exploitation in Cambodia.</li>
</ol>
<p>We do not remember that these points – especially as they relate also to untapped oil resources – have ever been mentioned in the more recent reports about maritime oil resource negotiations with a number of other countries. It should therefore be no surprise that the latest delegation to Russia to discuss the old debts did not bring the expected solution: that Russia would simply write off US$1.5 billion.</p>
<p>Another old, much much smaller debt, also shows up from time to time. We quote old headlines as a reminder:</p>

<p>To look forward to comprehensive information about all debt obligations, in light of what economic theories say about an appropriate “sustainable external debt” ratio is not unreasonable.</p>
<p>The recent dramatic decisions, to cut the salaries of the large number of advisers, and to freeze all promotions in the civilian and uniformed services, “aiming to save state resources in 2010,” is a signal of a new approach to handle public funds.</p>

<p>&#8220;According to a broadcast of a radio station based in Washington D.C. in the United States yesterday, about strong illegal logging of luxury wood in protected forested areas in a national park in Ratanakiri, bordering on Yuon [Vietnam], carried out by merchants colluding with some persons in the local authorities, an official, who asked not to be named, claimed there is collusion to open a Khmer-Yuon [Cambodian-Vietnamese] border crossing illegally to export luxury wood from Cambodia to be sold to Yuon merchants. </p>
<p>&#8220;According to this source, a Ratanakiri official, anonymly spoke about collusion to open an international crossing between the Ou Ya Dav district in Cambodia and a province&#8217;s district on the Yuon [Vietnamese] side of the border, during the first six months of 2009, leading to estimation that over 400 trucks transported trees, cut the Khmer natural forest, were transported by merchants and illegal business networks, to be sold to Yuon merchants who wait at the border.</p>
<p>&#8220;As an example of continuing loggings of luxury wood, a case was mentioned where merchants hired villagers to cut trees in Taveng district in Ratanakiri.</p>
<p>&#8220;The Phav village chief in Taveng Krom commune, Taveng district, Mr. Pel Hin, was quoted as saying that he noticed that merchants came to villages and hired poor villagers to cut valuable trees in the forest, and they then bought them from villagers. The village chief expressed concern about forest destruction, forests being resources of the state, and that the destruction might spread to the Vireakchey National Park, established by Royal Decree at the Kantuy Neak [dragon tail] region, bordering on Laos and on Yuon. </p>
<p>&#8220;The village chief said, &#8216;I am really concerned. When I attended some meetings, I told the meetings that there are companies buying and selling wood in my village.&#8217;</p>
<p>&#8220;The secretary of thhe Taveng Krom commune, Mr. Boeung, recognized that there are illegal loggings and then the transport of luxury wood, but he claimed that this had happened only during the last few months. He said, &#8216;I saw much luxury wood at Taveng Krom commune brought from Taveng Leu commune. Merchants brought it here to sell it.&#8217; </p>
<p>&#8220;The Taveng district&#8217;s military police chief, Mr. Keo Vichet, expressed regrets, as he has very few forces, and therefore he does not know such cases.</p>
<p>&#8220;However, according to direct monitoring by <em>Radio Free Asia</em> late last week in Phav village about illegal wood transactions, workers were seen transporting luxury wood; some had 10 cm by 15 cm width bars, 1 meter long, being transported from the village to the river, to be loaded in motor boats of merchants for exports.</p>
<p>&#8220;A worker said that he was hired by a local Chinese merchant in Vern Sai district, Nhok Thong, an illegal luxury wood merchant who hires poor villagers to enter to cut trees in the forest.</p>
<p>&#8220;The Taveng district governor, Mr. Kim Toeu, recognized that there are illegal wood businesses.</p>
<p>&#8220;Regarding this issue, Taveng Forestry Administration official in Ratanakiri recognized that there are such activities, involving merchants and some evil officials. He said about the loss of trees, &#8216;As for the activities and crimes in any specific district, those districts have to be responsible respectively.&#8217;</p>
<p>&#8220;Poor villagers from different villages, like Sieng Soy, Taveng Leu, Dambouk villages&#8230; have been contacted by merchants who have relations with some evil officials, using money to hire them to cut valuable trees in the forest and sell them to those merchants who go to buy trees in villages, such illegal activities happened repeatedly during recent months, as they are not afraid of the law.</p>
<p>&#8220;Those sources said also that many cubic meters of luxury wood were found, piled up at many places in areas near the Yuon border, in order to facilitate the transport in order to sell the wood to Yuon merchants who wait near the border crossing. </p>
<p>&#8220;The official of the province, who asked not to be named, was quoted as saying that the illegal transport of wood is most actively done during the night. According to his estimation since June 2009, the luxury wood cut by hired poor villagers was loaded onto more than 400 trucks, to be transported for sale to Yuon merchants. </p>
<p>&#8220;They cannot understand why forest crimes destroying state resources still exist, even though Prime Minister Hun Sen had promised in 2001, with words like swearing an oath, that he would give up leading the government, if his government was not able to crack down on illegal logging and illegal transport starting from 1 January 2002.</p>

<p>&#8220;Phnom Penh: A high ranking official of the Japanese Embassy to Cambodia told the Minister of the Ministry of Agriculture, Forestry, and Fisheries that some Japanese big companies plan to invest in Cambodia to plant trees, and one company has already conducted a study for such an investment.</p>
<p>&#8220;This information was shared by the Japanese Ambassador to Cambodia, Mr. Kuroki Masafumi, when he met with the Minister of Agriculture, Forestry, and Fisheries, Mr. Chan Sarun, in the evening of 12 November 2009. The chief of cabinet of the Ministry of Agriculture, Mr. Hong Narith, told <em>Rasmei Kampuchea</em> on 13 November 2009, during the cordial meeting, that Mr. Masafumi told the minister that following the results from the first Mekong-Japan meeting in Japan recently, where the Action 63 projects, includes the Green Mekong project, had been mentioned, some big investment companies of Japan are interested in investing in tree plantations, and one company had already studied this in three provinces &#8211; Kompong Chhnang, Kampot, and Ratanakiri. The study was finished, and implementation will follow soon. The ambassador asked for support from the Minister of Agriculture, Forestry, and Fisheries in this field.</p>
<p>&#8220;The chief of cabinet said that the Minister of Agriculture, Forestry, and Fisheries had expressed full support for this crucial project. Also, he said that there is no problem with land in Kompong Chhnang, as it is state land. In the meantime, the minister asked the ambassador to help attract investors to invest in manufacturing agricultural products for export, as there are not many investments in that sector.</p>
<p>&#8220;During the meeting, the Minister of Agriculture, Forestry, and Fisheries expressed his gratitude towards Japan for assisting Cambodia so far, also a lot in the field of agriculture. Practically, at present, Japan is creating an aquaculture development center in Sihanoukville, amounting US$10 million.</p>

<p>Several mails I had received during the week requested what this week&#8217;s editorial should be about. Agreed. The visit of Mr. Thaksin Shinawatra to Cambodia has more than any other recent event received wide international attention – at the same time it resulted in bringing a range of different and opposing issues to the surface, beyond the straightforward political tensions.</p>
<p>The disparities start with the wording, how the visitor is called in national and international media: the possibilities extend from the fond description of Mr. Thaksin Shinawatra as an “eternal friend” by Prime Minister Hun Sen, to the more neutral description when referring to the “former Thai prime minister ousted by a military coup,” to the references – and this not only in part of the Thai  press – to the “convicted fugitive, because of corruption, and who finally violated the bail requirements and fled the country to avoid going to prison.”</p>
<p>This is the first controversy.</p>
<p>The Cambodian government did not only refuse to live up to the Cambodian-Thai extradition agreement, &#8220;considering the prosecution and legal process against Thaksin Shinawatra as a politically motivated proceeding,&#8221; and therefore even handed back the Thai documents submitted to seek Mr. Thaksin Shinawatra&#8217;s extradition. On the other hand, the Thai government and part of the Thai media felt that already that extending an invitation and offering the function to be an adviser to the Cambodian government were an insult to the legal system of Thailand. </p>
<p>As a public reaction in Thailand, the popularity of the Thai Prime Minister, Mr. Abhisit Vejjajiva, almost tripled, with appruval rates of 24% in September to 69% recently, according to a poll.</p>
<p>The interpretation of Prime Minister Hun Sen, that the present Cambodian-Thai dispute is basically a personal dispute between the two prime ministers, was not shared in the international press. More fundamental problems were touched upon: What does it mean for the international standing of a country when a search warrant by Interpol can be dismissed, after the fugitive, who is being sought under a “red alert” warrant, after a bail violation, and after a criminal conviction for corruption in dealing with the sale of valuable public property to a family member, up to the grotesque $60,000 event of the mysteriously <A href="http://cambodiamirror.wordpress.com/2009/10/26/credits-extradition-agreements-and-reasons-for-exemptions-sunday-25-10-2009/">mistaken box of chocolate</A>.</p>
<p>How would such events be dealt with under a Cambodian anti-corruption law, due to be adopted by the National Assembly since a decade ago? If actions of corruption are committed in combination with political ones, are they then no longer subject to criminal prosecution?</p>
<p>There were several rumors and denials – that Mr. Thaksin Shinawatra would fly together with the Cambodian Prime Minister to the APEC meetings in Singapore.</p>
<p>Surprising also, that the Cambodian Prime Minister compared him to Aung San Suu Kyi in Myanmar. In an <A href="http://www.timesonline.co.uk/tol/news/world/asia/article6909258.ece?token=null&#38;offset=0&#38;page=1">interview with Times Online</A>, Mr. Thaksin Shinawatra said: “There are some similarities there, but not really everything. The similarity is we won elections, we rule the countries. We&#8217;ve been ousted by the coup d&#8217;etat and we come from the people. We are democratically elected leaders and we come from the majority of the people – a big majority, not just a small majority. She&#8217;s under house arrest, I&#8217;ve been kicked out of the country.”</p>
<p>The Cambodian government has never found such strong critical words against the ruling military in Myanmar. Will the Cambodian government also accept such advice and change its position? The statement “I&#8217;ve been kicked out of the country” contrasts with the fact that the self imposed exile abroad started with breaking bail arrangements with the Thai law enforcement authorities, traveling abroad without the promised return.</p>
<p>But the invitation to Mr. Thaksin Shinawatra as economic adviser  may lead to a second kind of controversies.</p>
<p>Press reports in Cambodia were not enthusiastic about his speech in front of 300 selected economists. The Cambodian Daily said that his address “primarily dealt in generalities and contained little that Cambodian economists will not already know.” Not only that: Some of his advice runs contrary to some of the traditional approaches of Cambodian economic practice. </p>
<p>Thakshin Sinawatra became the favorite politician among a majority of the rural population in Thailand because of his new policy of favoring them directly, with debt relief and village loan funds administered by the local communities themselves. The revenue of the public and the private sector should, first of all, be directed towards the poorest sector of society, is his advice. Large scale land leasings to big companies in favorable relation with the government, leading to considerable groups of the rural population losing their land, coming to demonstrate in Phnom Penh, asking for justice, as happens so frequently in Cambodia, are not compatible which the vision of Thaksin Shinawatra&#8217;s economic policies.</p>
<p>Surprising is also his emphasis on the need of reconciliation and good neighborliness between Cambodia and Thailand, in order to foster Cambodia&#8217;s economic development, including the promotion of Thailand and Cambodia together for international tourism, presenting themselves as a &#8220;joint destination.&#8221; This runs against many recent antagonistic trends: the Thai government had proposed to submit Preah Vihear together with the Cambodian government to the World Heritage Committee, which was flatly rejected by the Cambodian side. During the last year there were even plans discussed in Cambodia to create an international airport 500 meters below the mountain range where Preah Vihear is situated, which is conveniently accessible from the north, from Thailand. This plan, to exclude the natural access to Preah Vihear – and therefore tourism via Thailand, was soon given up again as economically completely unreal. The public outcry some years ago, when Bangkok Airways had named one of its airplanes Angkor Wat – while other planes are named according to other international destinations, promoting tourism to these places – has no place in this context. The Cambodian Daily reported his emphasis on the need for cooperation between Thailand and Cambodia,  as the two countries&#8217; economic fortunes are inextricably linked &#8211; adding: “Of course, not all my compatriots see it that way right now.” Those who see it differently in Thailand are assumed to suffer from being shortsighted, driven by false patriotism.</p>
<p>One may ask whether the anti-Thai actions of 2003, when the Thai embassy in Phnom Penh was ransacked because of a baseless rumor, resulting in further arson so that the hardware damage alone of that night was estimated at US$56 million, and the tensions before and after the designation of Preah Vihear as a World Heritage Site, would also fall under a similar verdict by Mr. Thaksin Shinawatra, that a false patriotism is in the way also in some of the Cambodian attitudes and actions.</p>
<p>It is surprising to consider how future suggestions of the new economic adviser of the Cambodian government will be handled, while land conflicts in rural areas continue, further large scale leasings of land are under consideration inviting countries from the Middle East to start agro-business ventures, and Japanese companies are considering to create new large tree planting schemes in Cambodia. </p>
<p>Mr. Thaksin Shinawatra&#8217;s suggestions may not only be unwelcome in his own country. They run counter to major trends of present day Cambodian big business.</p>

It&#8217;s a time that many PR professionals look forward to because of the pre-conference seminars, keynote speakers, networking and general sessions. By the way, the weather, food and entertainment only add to the excitement.</p>
<p style="text-align:left;">Of the nearly 25,000 <a title="PRSA Organization Web site" href="http://www.prsa.org/index.html" target="_blank">PRSA</a> members, a select group of us (about 325) have the opportunity to represent our local chapters as Assembly Delegates in the <a title="National Assembly Page" href="http://www.prsa.org/AboutPRSA/Governance/Bylaws#Article_III." target="_blank">National Assembly</a> &#8211; a day-long event akin to a session of congress. This marathon day typically entails review of PRSA bylaws, including amendments and resolutions to enhance the structure of our society.</p>

<p style="text-align:left;">But this year was different. We were tasked with reviewing and finalizing a complete rewrite of the <a title="Society Bylaws" href="http://www.prsa.org/AboutPRSA/Governance/Bylaws" target="_blank">society bylaws</a>, which would constitute the most significant change in the PRSA since its inception in 1947.</p>
<p style="text-align:left;">Many thought it would be impossible to achieve such a feat. But after about 10 hours of laboring, conversing, amending, compromising and sometimes arguing, we made it happen.</p>
<p style="text-align:left;">At about 6 p.m. on Saturday, Nov. 7, a majority vote of two-thirds was reached.</p>
<p style="text-align:left;"><strong>What changes were made to the bylaws?</strong><br />
The Assembly made vast changes, but  a few major ones should be mentioned. I will touch on them without going into too much detail since they are still in legal review.</p>
<p style="text-align:left;"><span style="text-decoration:underline;">APR Accreditation</span><br />
The first major change that was debated for quite some time was the <a title="APR Accreditation Page" href="http://www.prsa.org/Learning/Accreditation/index.html" target="_blank">APR accreditation</a> among membership and the National Board of Directors. According to a 2009 Membership Satisfaction Survey, 63 percent of the respondents stated that the APR was one of the most important programs offered by PRSA. With that said, the Assembly moved to require that any candidate for National Board have an APR to be eligible.</p>
<p style="text-align:left;"><span style="text-decoration:underline;"><a rel="attachment wp-att-375" href="http://tonofbricks.wordpress.com/2009/11/16/the-state-of-the-pr-industry-has-changed/apr_logo_sm/"><img class="alignleft size-full wp-image-375" title="APR Logo" src="http://tonofbricks.wordpress.com/files/2009/11/apr_logo_sm.jpg" alt="APR_Logo_sm" width="162" height="115" /></a></span>This amendment makes a critical statement to the profession. It says that we, as PR pros, must work to achieve a higher standard of excellence by attaining an APR status.  The APR sends a strong message that PR is a true profession, and that we hold a stake in all levels of communication and at the management table.</p>
<p style="text-align:left;">I&#8217;d like to add that it&#8217;s not all about using your APR accreditation as a sales tool or getting a job. It&#8217;s about grounding yourself in the theory and practice of public relations, as well as the confidence you gain.</p>
<p style="text-align:left;"><span style="text-decoration:underline;">Membership Criteria</span><br />
The other main issue discussed at length was how we, as a society, can increase PRSA&#8217;s value among the profession. There are approximately <a title="PR Statistics" href="http://www.bls.gov/oco/ocos086.htm" target="_blank">250,000 people practicing PR in the United States</a>, and only about 10 percent, or 25,000 of them, are PRSA members. Additional terminology was added within the language of the criteria that would have allowed other related professions to become members. After much debate, we as an Assembly voted to keep the language focused on public relations professionals as the membership target.</p>
<p style="text-align:left;"><a rel="attachment wp-att-385" href="http://tonofbricks.wordpress.com/2009/11/16/the-state-of-the-pr-industry-has-changed/prsaaltweb/"><img class="alignleft size-full wp-image-385" style="margin:4px;" title="PRSA Logo" src="http://tonofbricks.wordpress.com/files/2009/11/prsaaltweb.gif" alt="PRSA Logo" width="169" height="65" /></a>We have worked, since the start of the PRSA, to make our society the pre-eminent organization for PR pros. And to make sure that PR is taken seriously among others, we agreed that targeting our efforts on the other 90 percent of practicing PR practitioners would be best, and only strengthen our society and profession.</p>
<p style="text-align:left;">So, many members and PR pros asked why bylaw changes were made and how it would benefit them. Dave Rickey, APR, chair of the <a title="Task Force Update: Dave Rickey, APR" href="http://www.prsa.org/AboutPRSA/Governance/BylawsDocuments/Rickeyinterviewupdate9-09.pdf" target="_blank">Bylaws Rewrite Task Force</a> said:</p>

<p style="text-align:left;">The primary objective of the bylaws rewrite is to enable a flexible, nimble governance structure to support the best possible PRSA for members, leaders and the profession.</p>
</blockquote>
<p style="text-align:left;"><strong>Final Thoughts</strong><br />
I believe that the rewrite will allow all of us to have a greater voice in decision-making and the direction we take PR and the society. It&#8217;s about inclusion, and we are in an age of both traditional and non-traditional communication, which makes this change both critical and timely.</p>
<p style="text-align:left;">We all have a voice in our society and profession, and need to come together to enhance PR&#8217;s reputation and understanding among the masses. Only then will we be appreciated and valued like we should be.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>I was really excited to learn that the plans for the former Burberry in Treorci are going ahead. This is real welcome news for the Rhondda, and a major boost for the area.</p>
<p>I met with the developers when the plans were in their early stages and gave this project my total support. Following our meeting I raised the issue of European funding with Ieuan Wyn Jones, the Deputy First Minister, and I’m really pleased that he was able to secure that funding, and help progress this much-needed project in these very difficult times.</p>
<p>I hope this will be a springboard for the community to develop the local economy further, and move towards a more sustainable future. I wish the project every success.</p>

<p>&#8220;Stung Treng: The Prime Minister of the Kingdom of Cambodia, Samdech Akkak Moha Senapadei Dekchor Hun Sen, said that China becomes the country that has constructed the most roads in Cambodia, sections of road of more than 1,500 km, which had been constructed, are being constructed, or are planned to be constructed. Moreover, China has provided loans to construct bridges with a total length of 3,014 meters, for which in total more than US$800 million have been offered for road construction and more than US$100 million for building bridges. Besides, there are hydro-electric projects in some provinces with 700 megawatt power, costing approx. US$1.7 billion.</p>
<p>&#8220;Samdech Dekchor said so during the launching of a construction site on National Road 78 in the morning of 12 November 2009: &#8216;The site to construct and to restore National Road 78, starting at 121 km from Ou Pong Moan in Stung Treng, to Ban Lung in Ratanakiri, is to be covered by red gravel, 6 meter wide; it was started with a loan from the People&#8217;s Republic of China, also with 5% contributed by the Royal Government.</p>
<p>&#8220;The Minister of Public Works and Transport, Mr. Tram Iv Tek, stated that the construction of this road will take 40 months, the width will be broadened to 11 meters, it will be paved according to the Double Bituminous Surface Treatment, following the 3rd standard of China, with 13 bridges of together 903 meters, and 126 culverts. It will cost US$73.3 million, to be paid by a loan provided by the People&#8217;s Republic of China, together with a 5% share from the Royal Government of Cambodia. But this amount does not cover expense for taxes, the state&#8217;s burden importing materials and other means for the construction, and for clearing mines and unexploded ordnance along the road.</p>
<p>&#8220;The National Road 78 branches off from the National Road 7 in Ou Pong Moan in Stung Treng, leading to Ou Ya Dav at the Cambodian-Vietnamese border. But a another portion of National Road 78 from Ban Lung to Ou Ya Dav is being constructed with a loan from  Vietnam, and has already been finished 90%.</p>
<p>&#8220;Samdech Dekchor Hun Sen said that National Road 78 has the characteristic of serving for both internal and regional integration. This road contributes to provide advantages for integration in the country as well as connecting to economic centers in Stung Treng and Ratanakiri, in order to encourage economic and social development in Cambodia, to reduce the gap between the urban and the rural areas. It also helps to promote the livelihood of citizens in the Northeast through facilitating transport, commerce, the exchange of agricultural products, and industry, and to encourage cooperation and development in the triangle zone of Cambodia, Laos, and Vietnam, through the Ou Ya Dav boarder crossing in Ratanakiri and through the connection of National Road 7, which is the Asian Road 11, from Vientiane in Laos to the Sihanoukville International Port. In addition, National Road 78 serves nature tourism, because the Northeast is a green area, rich in beautiful big lakes, waterfalls, mountains, and forest. It is also rich in many types of mineral resources and fertile soil that is favorable for agro-industrial crops, where rubber trees are prioritized. </p>
<p>&#8220;On behalf of the Royal Government and the Cambodia people, Prime Minister Samdech Dekchor expressed great gratitude towards the Chinese people and the Chinese government for assisting and supporting Cambodia. Prime Minister Samdech Hun Sen added that among the 11 road construction projects of more than 1,200 km that will be subsequently opened in 2010, including the roads that the government builds by its own resources, as many as 7 projects are implemented with Chinese loans.</p>
<p>&#8220;Prime Minister Samdech Hun Sen encouraged the Shanghai Construction Company and the Kwang Ju Vanan [? - phonetic] technical monitoring consultancy to take good care of the implementation to construct the crucial National Road 78, so that is has the quality compatible with the technical standards, and so that it is finished as planned or before the deadline.&#8221; <em>Rasmei Kampuchea, Vol.17, #5046, 13.11.2009</em></p>

<p>&#8220;Phnom Penh: The first Cambodian-Indian commercial and investment exhibition in Phnom Penh is being organized with the participation of 20 Indian companies.</p>
<p>&#8220;The Minister of Commerce, Senior Minister Cham Prasidh, stated during the launching of the exhibition on 11 November 2009 that it is the first time that both countries organize an exhibition to help investors and businesspeople from both countries to understand each other better.</p>
<p>&#8220;He said, &#8216;This is the greatest opportunity for Indian investors and businesspeople to seek investment opportunities and markets in Cambodia.&#8217;</p>
<p>&#8220;According to Mr. Cham Prasidh, the trade between Cambodia and India amounts to about US$56.32 million, where Indian imports of products from Cambodia is only US$2.87 million, while the exports of India to Cambodia are US$56.32 million.</p>
<p>&#8220;Based on these figures, Mr. Cham Prasidh said that the amount of this commercial relation is still low, and he encouraged both countries to try to study further market exchange possibilities, in order to strengthen and improve the commercial ties. </p>
<p>&#8220;The Indian Ambassador to Cambodia said that Indian investors from 21 companies attend this exhibition. Most companies are companies from the fields of information technology, medicine, industry and mines, machinery, agriculture, engineering, and infrastructure.</p>
<p>&#8220;He added that this exhibition will be held for two days from 11 to 12 November 2009. </p>

<p>&#8220;Phnom Penh: A Source from the <em>Thai News Agency (TNA)</em> said on Tuesday that the Thai parliament decided to cancel a Cambodian-Thai memorandum of understanding, but senior officials of the Royal Government of Cambodia consider this as only a dream of people who do not know the law.</p>
<p>&#8220;According to a report from <em>TNA</em> published on Tuesday, 10 November 2009, the [Thai] parliament decided to terminate a Memorandum of Understanding between the Kingdom of Cambodia and the Kingdom of Thailand, signed in 2001. This decision was made after the Kingdom of Cambodia recently decided [by Prime Minister Hun Sen and a Royal decree] to appoint the former Thai prime minister, Mr. Thaksin Shinawatra, as an economic adviser of the Royal Government and of Prime Minister Samdech Hun Sen. </p>
<p>&#8220;<em>TNA</em> said that the Thai parliament decided to officially cancel the Memorandum of Understanding signed by Thai former Minister of Foreign Affairs, Mr. Surakiart Sathirathai, and the Minister of the Council of Ministers, Deputy Prime Minister Sok An, on 14 June 2001, though there has be no improvement at all within the eight years since it became valid.</p>
<p>&#8220;The head of the National Border Committee, Senior Minister Va Kimhong, spoke during a press conference held in the morning of 10 November 2009 at the Council of Ministers, where he said that the Memorandum of Understanding was agreed upon between the Royal Governments of the Kingdom of Thailand and the Kingdom of Cambodia about the overlapping zones at the seabed of the two countries in 2001. He added that the aims of this 2001 Memorandum of Understanding are:</p>
<ol>
<li> To seek an agreement for a treaty about overlapping zones; and</li>
<li> To explicitly demarcate the sea border between Cambodia and Thailand.</li>
</ol>
<p>&#8220;The Senior Minister explained the cause how these overlapping emerged, saying that because Cambodia drew a line in 1972, while Thailand also designated its seabed in 1973, so this overlapping zones emerged. The government had sought to negotiate since 1970 and 1971 to find a solution at the region of the later overlapping zones. He went on to say, &#8216;In fact, we again started negotiations since 1995 with a Deputy Prime Minister as the head of the negotiations at that time, during the first term of the Royal Government, but the talks failed, and only in 1999, 2000, and 2001, there came a situation to sign that Memorandum of Understanding. Its major goal was to agree to develop those overlapping zones, as well as to clearly demarcate the sea border.&#8217;</p>
<p>&#8220;A Source from [the Thai well known newspaper] <em>The Nation</em> said that recently, yellow shirt demonstrators [supporters of the current Thai government] of the Thai People&#8217;s Alliance for Democracy had submitted 11 documents, detailing the agreement between the Kingdoms of Cambodia and of Thailand, asking their Royal Government to check, and to cancel the Memorandum of Understanding. On Tuesday, the parliament of the Kingdom of Thailand decided to send this request to cancel this Memorandum of Understanding into the parliament for discussion and approval.</p>
<p>&#8220;Responding to questions of journalists about the intention to cancel the Memorandum of Understanding between the Kingdoms of Cambodia and of Thailand, Senior Minister Va Kimhong said that this canceling is only a dream of a group of people who do not know the law, and if Thailand had people with knowledge about the law, it would have been impossible to decide as they did.&#8221; <em>Kampuchea Thmey, Vol.8, #2095, 11.11.2009</em></p>

<p>&#8220;Phnom Penh: According to a circular of the Royal Government, the government decided to cut the salaries of all newly and continually appointed advisers who earn high salaries, advisers to high ranking officials, to receive only the normal amount in order to save state resources. </p>
<p>&#8220;The circular signed by the Prime Minister, Samdech Dekchor Hun Sen, on 27 October 2009, said that the Royal Government instructed all ministries and institutions to reorganize salaries for all advisers who have been offered equivalent positions, starting from under secretary of state upwards, to earn only the normal salaries of their current main positions. </p>
<p>&#8220;In the circular, the government noticed that previously, the Royal Government has nominated some officials as personal advisors of Prime Minister Samdech Dekchor Hun Sen, of deputy prime ministers, or of the Royal Government of Cambodia&#8230; by providing them with equivalent positions besides their current positions, and those officials situations are administered so that they earn salaries through their new, additional positions an additional higher amount than they continue to get already in their current positions. The circular added that the current economy, which is encountering difficulties due to the impact from the global economic crisis, requires the government to take measure to save state resources, and therefore, it is necessary to cut the salaries of those advisers, so that all receive normal salaries. </p>
<p>&#8220;According to an informed source, there are at least 30 to 40 officials continually appointed as advisers of high ranking officials at each ministry. Some have only a position as head of an office, or deputy head of a department, or as head of a department, but they have also been nominated as advisors with positions equivalent to an under-secretary of state, or as secretary of state. Some ministers even hold also positions as senior ministers. Through such appointments, those officials receive also salaries from those new, additional positions, for example: an under-secretary of state receives a salary of about Riel 1.04 million [approx. <title><![CDATA[Opposition Party Parliamentarians and Civil Society Officials Stated that the Government Does Not Implement the Constitution - Friday, 30.10.2009]]></title>

<p>&#8220;On the occasion of the 5th Coronation Day of Preah Karuna Samdech Preah Boromneath Norodom Sihamoni, high ranking officials from the opposition parties, who are parliamentarians, and national and international observers, pointed to the Cambodian government&#8217;s obligation and need to implement the supreme law of the country by creating and reforming at least two institutions of Cambodia.</p>
<p>&#8220;A parliamentarian from the Sam Rainsy Party, Mr. Son Chhay, agrees with the idea of an international observer, Mr. Lao Mong Hay, and of a civil society official of Cambodia as well of a parliamentarian [from the Human Rights Party], Mr. Kem Sokha over the duty that the King at present fulfills, especially the idea that the government must create and progress two supreme institutions led by the King.</p>
<blockquote><p><strong>From the Constitution of the Kingdom of Cambodia</strong></p>
<p><strong>Article 23:</strong><br />
The King is the Supreme Commander of the Royal Khmer Armed Forces. A Commander-in-Chief of the Royal Khmer Armed Forces shall be appointed to command the Armed Forces.</p>
<p><strong>Article 24:</strong><br />
The King shall serve as Chairman of the Supreme Council of National Defense to be established by law.</p></blockquote>
<p>&#8220;Mr. Son Chhay, a leader of the Sam Rainsy parliamentarians, said, &#8216;I hope that Cambodia will in the future create a Supreme Council of National Defense which, according to the Constitution, must be under the presidency of the King with the role as Chairman of that Supreme Council of National Defense.&#8217;</p>
<p>&#8220;Mr. Son Chhay agreed with a statement of a senior researcher of the Asian Human Rights Commission based in Hong Kong, Mr. Lao Mong Hay, in this point.</p>
<p>&#8220;Dr. Lao Mong Hay sees an obligation of the government, as stipulated in the Constitution of Cambodia, to create a Supreme Council of National Defense with the King as Chairman. So far, according to a statement of Mr. Lao Mong Hay, the government formed by the Cambodian People&#8217;s Party, with Mr. Hun Sen as the Prime Minister, has not discussed the creation of a Supreme Council of National Defense under the oversight by the King.</p>
<p>&#8220;Everything in the defense sector is seen being organized and decided directly by Prime Minister Hun Sen. This leads to criticism that the defense system of Cambodia is not conform with the Constitution of the country, which states the need to establish a Supreme Council of National Defense led by the King.</p>
<p>&#8220;The founder of the Cambodian League for the Promotion and Defense of Human Rights (LICADHO) &#8211; a large human rights organization in Cambodia, Ms. Pong Chhiv Kek [also known as Dr. Kek Galabru], said that in the five years since the coronation of Preah Karuna Preah Bath Norodom Sihamoni, it is seen by the public that in general, he cares for humanitarian affairs for his citizens. She expressed her concern related to a point of the Constitution which says that the King takes the thrown, but does not take the power.</p>
<blockquote><p><strong>From the Constitution of the Kingdom of Cambodia</strong></p>
<p><strong>Article 7:</strong><br />
The King of Cambodia shall reign but shall not govern.<br />
The King shall be the Head of State for life. The King shall be inviolable.</p>
<p><strong>Article 8:</strong><br />
The King of Cambodia shall be a symbol of unity and eternity of the nation.<br />
The King shall be guarantor of the national independence, sovereignty, and territorial integrity of the Kingdom of Cambodia, the protector of rights and freedom for all citizens and the guarantor of international treaties.</p></blockquote>
<p>&#8220;Ms. Pong Chhiv Kek said, &#8216;I regret that the Constitution states that the King reigns, but is not involved in political affairs, so that he could fulfill many other duties according to the constitution.&#8217;</p>
<p>&#8220;The Constitution of Cambodia stipulates that the King of Cambodia shall reign but shall not govern, though, according to another article, it makes the King responsible for the territorial integrity of Cambodia, for the protection of the rights and the freedom for all citizens, and for an independent court system, though he does not have the power to decide anything, and can only be burdened by the mistakes decided upon by the government.</p>
<p>&#8220;A parliamentarian and president of the Human Rights Party, Mr. Kem Sokha, noted also the point in the Constitution which states that the King must not be involved in politics, and that the King does not have power, as at present, the power is controlled by the government. According to his opinion, the King should be given the possibility to ensure the respect for human rights and the independence of the court system, as well as the right to pardon journalists and human rights activists who are jailed by government authorities. He stressed that at present, unless there is request from the government, the King does not decide to an amnesty, but Mr. Kem Sokha thinks that the government should not prevent the King from granting an amnesty.</p>
<blockquote><p><strong>From the Constitution of the Kingdom of Cambodia</strong></p>
<p><strong>Article 27:</strong><br />
The King shall have the right to grant partial or complete amnesty.</p></blockquote>
<p>&#8220;Senior politicians from the opposition parties and from civil society organization official expressed their ideas under the impression that the King seems to be restricted in fulfilling his duties which are stated as his rights, as stated in the Constitution, to help his people.</p>
<p>&#8220;Besides expressing good wishes to the King at the 5th Coronation Day after he succeeded his father, some scholars want to see the country&#8217;s Constitution implemented properly by the government, like by organizing the National Congress, which, as stated by the supreme law of Cambodia, is to be held annually under the chairmanship of the King. It is an event to remember the National Congress held by the current King&#8217;s father, Samdech Preah Norodom Sihanouk, to provide an opportunity for the citizens to express their concerns, hopes, and wishes, as well as to question the prime minister about how the country is ruled, while now, the Cambodian People&#8217;s Party government, especially Prime Minister Hun Sen, said that it is not possible to hold such a congress.</p>
<blockquote><p><strong>From the Constitution of the Kingdom of Cambodia</strong></p>
<p><strong>Article :</strong><br />
<strong>Article 147:</strong><br />
The National Congress shall enable the people to be directly informed on various matters of national interests and to raise issues and requests for the State authority to solve.<br />
Khmer citizens of both sexes shall have the right to participate in the National Congress.<br />
<strong>Article 148:</strong><br />
The National Congress shall meet once a year in early December at the convocation of the Prime Minister.<br />
It shall proceed under the chairmanship of the King.<br />
<strong>Article 149:</strong><br />
The National Congress adopts recommendations to the Senate and the National Assembly, and to the Executive branch for reflection.<br />
The organization and operation of the National Congress should be determined by law.</p></blockquote>

<title><![CDATA[CARWYN SAYS: "TIME TO GET REAL - ON THE NATION'S HEALTH"]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>An end to health service re-organisation, continuing action to reduce waiting times, a new focus on primary care, enabling patients to see their GPs in the evenings and at weekends, and public investment in the air ambulance service are just some of a progressive and innovative set of health policies that will be unveiled later today by Welsh Labour Leadership candidate, Carwyn Jones.</p>
<p>Carwyn will make public his forward-looking policy statement to improve the NHS in Wales by saying:</p>
<p>&#8220;The NHS has looked after my family well, and continues to do so. I love the NHS and will defend it against any attack. It is a service for the people, and I am proud that in government in Wales we have delivered real and lasting improvements for patients in Wales. </p>
<p>&#8220;My agenda for Welsh Labour will focus firmly on the issues that matter to ordinary people &#8211; continually improving healthcare, with better access to GP services, and working with staff and their unions to improve areas like the Ambulance service.</p>
<p>&#8220;I want to deliver more convenient services for patients &#8211; making access easier, enabling patients to see their GPs in the evenings and at weekends, and make it possible to book an appointment online. I want to see GPs surgeries to be electronically linked to hospitals &#8211; for Wales to learn from the e-referral system currently operating in Scotland.&#8221;</p>
<p>Promising to deliver what he calls, &#8220;common-sense solutions&#8221; for the NHS under his Leadership, Carwyn will pledge to remove red tape when it gets in the way of patient care and improvements to services, by saying:</p>
<p>&#8220;Health professionals tell me that our systems for scrutiny of capital investment are slowing down investment decisions. I will lead a programme to cut through the bureaucracy.&#8221;</p>
<p>Underlining his ambition to be a &#8216;Leader for the whole of Wales&#8217;, Carwyn will make it clear to people in North Wales that borders will not be a barrier  when it comes to offering patients access the best healthcare the NHS can provide. He will say:</p>
<p>&#8220;Under my leadership we will continue to work in partnership with the rest of the UK &#8211; for example, while we want the strongest health services in Wales, we must also acknowledge how for example cross-border health provision is critical to excellent services provided to Welsh patients, particularly in North Wales.&#8221;</p>
<p>    Carwyn, who was born in Morriston Hospital in Swansea, will also make clear to people in West and Mid Wales his commitment to rapid accident and emergency care   &#8220;To ensure those in isolated rural areas in West and North Wales in particular can be confident that they can receive an emergency response fast in cases where an immediate response is needed, such as brain or spinal damage, my government will look at proper investment in the Air Ambulance service.&#8221;</p>
<p>Committing himself to drawing a line under further re-organisation of the NHS in Wales, Carwyn will say:</p>
<p>&#8220;The health service in Wales has been through substantial re-organisation. Too frequent re-organisation damages staff morale and reduces operational effectiveness. Decisions in health must be carefully thought through. I will not introduce wholesale re-organisation on my watch, but work with staff and unions in the interest of patients.&#8221;</p>
<p>Other pledges contained within Carwyn&#8217;s policy statement are a pledge to:</p>
<p>* reward NHS staff for implementing new ideas and developing an all-Wales innovation team to spread good practice;</p>
<p>* re-focus ways of tackling diagnostic waits to speed up treatment, and ensure hospital operating theatres are used at weekends in more places to make the best use of our investments;</p>
<p>* deliver solutions to the Ambulance Service problems through working with staff and their unions;</p>
<p>* have more focus on tackling delayed discharges of care. Elderly people in particular are frustrated at being kept in hospital because the care services are not in place at home. Equally, people should not be kept unnecessarily in hospital for tests if they are fit enough to leave – they should not lose their place on the waiting list as a result;</p>
<p>* to initiate a review of residential care for older people to try and reduce the real concerns that families have in paying for care costs;</p>
<p>* take action to implement our commitment to develop not-for-profit nursing homes;</p>
<p>* have a higher priority for mental health services, which are particularly important during an economic crisis as the pressures of stress at work and unemployment come into focus; and</p>
<p>* deliver faster response times to emergencies. <title><![CDATA[Cancer Care Cymru]]></title>

<p> After picking up last week’s Private Eye (my father would be proud), I was pleased to see a mention of the National Assembly. It was good to see after 10 years of scraping around for credibility, it had finally made an impact on the political press.</p>
<p>Unfortunately, the point of the story was the closure of Cancer Care Cymru. The charity, which provided 14 specialist nurses to hospitals across south Wales and supported patients emotionally as well as clinically, was forced to close in the summer as they couldn’t raise enough funds privately to carry on operating. The non-publicly funded charity, due to the recession, were unable to raise the funding necessary and as a result 10 of those specialists who worked at Velindre NHS trust’s Cancer Centre in Cardiff have finished work as the trust is unable to cover the cost of keeping them in employment.</p>
<p>The Private Eye article however, was not just a piece on the failure to supply the charity with funding in order to keep supplying these specialised nurses to work alongside NHS doctors.</p>
<p>The National Assembly were warned two years ago about the dangers of relying on the voluntary sector to supplement care. The need of specialist care, they were told, in something as traumatic as cancer needed to be included in a strategic framework to ensure there was money available for them to continue their work. This didn’t happen.</p>
<p>Why after they were told by the Velindre trust in 2007, of the need to implement voluntary services into a strategic framework to ensure the continuation of this specialist provision, had nothing happened? There was still no strategy in place even after the warnings from the trust.</p>
<p>While there is no accusation that patient care has suffered because of the closure of the charity (the charity worked closely with Tenovus to ensure cover for patients affected), surely it is a damning indictment of those in Cardiff Bay who couldn’t organise a strategic plan to incorporate the voluntary sector into the overall scheme of things and support them financially.</p>
<p>It could even be debated that such an important role such that these nurses were doing shouldn’t have to be provided by the voluntary sector, but should come from the NHS itself. If it has to come from charities work, then the least the Assembly could have done is work out its planning to maintain the work of the nurses. It is not as if they weren’t warned.</p>

<p><span style="color:#993366;">George; former chairman of the Nigerian Ports Authority (NPA) and five others to two and half years imprisonment each without an option of fine.</span></p>
<p><span style="color:#993366;">They were sentenced for two years each on a seven-count charge of abuse of office and six months each for a 27-count charge of disobedience to constituted authority.</span></p>
<p><span style="color:#993366;"> Others convicted include; former CEO of NPA Aminu Dabo, O. Abidoye, Abdullahi Tafida, Zanna Maideribe and Sule Aliyu.</span></p>
<p><span style="color:#993366;">The Economic and Financial Crimes Commission (EFCC) had arraigned them on charges of wilful disobedience to constituted authority, contract splitting and conspiracy in August, last year.</span></p>
<p><span style="color:#993366;">The sentence which was seen by many as a crushing defeat of three Senior Advocates Of Nigeria; Joe Gadzama, Tunji Ayanlaja and Dele Adesina, by fiery human rights lawyer, Mr. Festus Keyamo had suffered many encumbrances which necessitated several adjournments based on technicalities.</span></p>
<p><span style="color:#993366;">Strangely, Chief Bode George and other co travelers were not found guilty on the other charges as the prosecution led by activist lawyer Mr. Festus Keyamo, could not prove the commission of the offences alleged against them beyond reasonable doubt.</span></p>
<p><span style="color:#993366;">Defense had argued that the convicts were not charged in their personal capacities but as board members of NPA and asked the court to acquit their clients except the court can prove otherwise.</span></p>
<p><span style="color:#993366;">However, Justice Oyewole averred that; &#8220;The facts indisputably before the court are that the defendants are natural persons who were appointed to serve as directors on the board of the NPA, a public corporation owned solely by the Federal Government of Nigeria and established under an Act of the National Assembly. The judge noted that &#8220;It is an evident fact upon which the court can take judicial notice that only natural persons are appointed to hold public offices and not corporate or incorporate bodies.</span></p>
<p><span style="color:#993366;">He insisted that the board of a corporation is an organ of that organization and does not possess a corporate legal existence separate from that of the corporate body it belongs to and therefore cannot possess legal identity as to sue or be sued independently.</span></p>
<p><span style="color:#993366;">&#8220;Persons acknowledged out of millions of Nigerians by the President of the Federal Republic of Nigeria to be of proven integrity and of cognitive experience in relation to the activities of the NPA cannot claim ignorance or simply play Pontius Pilate when obviously irregular contracts placed before them were approved by them without question. It amounts to wilful blindness and must have its consequences” the court said.</span></p>
<p><span style="color:#993366;">&#8220;The prosecutor had argued that while there may be good reasons to seek a presidential waiver in respect of the application of the said circular, flagrant disobedience was not the proper course of action.</span></p>
<p><span style="color:#993366;">When the tide of the case became obvious, lead counsel, Mr Tunji Ayanlaja (SAN), pleaded for mitigated sentence, noting that the conviction of his client on a technical charge could scare others who are interested in serving the nation.</span></p>
<p><span style="color:#993366;">But the Justice Oyewole in his Sentence noted that: &#8220;When public office is abused, the entire system is assaulted. This must not be treated with kid gloves, if the quality of service in our public life is to be attained to an appreciable standard of the civilised world.</span></p>

<p>&#8220;Phnom Penh: All banks and micro-credit institutions in Cambodia employ 14,698 Cambodian persons, according to a report from the National Bank of Cambodia.</p>
<p>&#8220;The report of the National Bank issued recently said that banks and micro-credit institutions provide jobs for 14,698 people.</p>
<p>&#8220;The report shows that all commercial and other special banks create jobs for 9,550 citizens in total, while micro-finance institutions employ 5,148 people.</p>
<p>&#8220;According to this report, all banks in Cambodia recognized by the National Bank provide a variety of numbers of jobs. The banks employ between 13 to 6,128 persons, while the micro-finance institutions employ freom 6 to 1,024 persons.</p>
<p>&#8220;Based on the report, the job market in the banking and micro-finance sectors has achieved a moderate growth rate. In 2007, all commercial and other special banks provided 6,869 jobs, while in 2006, they could employ only 4,624 persons. Micro-finance institutions employed just 3,511 persons in 2007, and only 2,503 persons in 2006.</p>

<p>&#8220;Phnom Penh: The South Korean president promised to the head of the Royal Government of Cambodia to provide US$200 million in concession loans for 2009 to 2012 to develop the Cambodian economy and society. </p>
<p>&#8220;The promise of such loan provisions was made during the two-day official visit of the South Korean President, Mr. Lee Myung-Bak, and his delegation in Cambodia on 22 and 23 October 2009. Together with the above concession loan, the governments of both countries also signed 9 agreements and memorandums of understanding to strengthen cooperation between Cambodia and Korea. </p>
<p>&#8220;After the meeting at the Ministry of Foreign Affairs of Cambodia, on Thursday evening, the Minister of Foreign Affairs, Deputy Prime Minister Hor Namhong, told journalists that the Korean government is ready to provide donations in response to the destruction in Cambodia, recently caused by the typhoon Ketsana, and Mr. Lee Myung-Bak will send his Minister of Foreign Affairs to check the situation, and Cambodia will raise the requirements to repair roads, schools, and hospitals that were damaged by this typhoon. </p>
<p>&#8220;Deputy Prime Minister Hor Namhong added, &#8216;In response to Prime Minister Samdech Hun Sen&#8217;s request, the South Korean President, Mr. Lee Myung-Bak, agreed with the comprehensive and strategic partnership between Cambodia and Korea.&#8217;</p>
<p>&#8220;Regarding tourism, within the past five years, the Korean tourists&#8217; arrival figures were still at the first position [in 2009 it will probably be Vietnamese tourists which provide the top number] with many Korean tourists visiting Cambodia. In this sense, Deputy Prime Minister Hor Namhong went on to say, &#8216;Prime Minister Samdech Hun Sen will offer 1 year visas for Korean tourists to encourage them to visit Cambodia.&#8217; </p>
<p>&#8220;During a dinner party, a Cambodian-Korea business meeting, on Thursday evening, Prime Minister Samdech Hun Sen said, &#8216;This visit shows more clearly that the Korean government always really cares about the close ties and and the cooperation between both countries, and the presence of His Excellency [Mr. Lee Myung-Bak] and Her Excellency [Kim Yun-Ok] as well as the Korean delegation and the business community will surely bring new success and achievements, with the efforts to help develop the Cambodian economy and society, continuing to strengthen and to expand the cooperation in all fields, including politics, security, economy, social affairs, and culture.&#8217; </p>
<p>&#8220;Prime Minister Samdech Hun Sen said that Cambodia and Korea have been cooperating with the aim to ensure new opportunities, with the intention to mutually contribute and share benefits in order to achieve economic growth and poverty alleviation. </p>
<p>&#8220;Prime Minister Samdech Hun Sen added that the Cambodian-Korean ties and cooperation appear to be more noticeable, through the cooperation to implement different projects together, like the cooperation to organize the Angkor-Kyongju World Exhibition, joint investments, and the cooperation to create a Cambodia stock exchange market.&#8217; </p>
<p>&#8220;During the party, the South Korean President, Mr. Lee Myung-Bak, said also that he sees some positive points for future cooperation between both countries; <em>first</em>, in agriculture and bio-energy. In this sense, Mr. Lee Myung-Bak stressed, &#8216;Cambodia has high agricultural potential while Korea is experienced in modernizing rural areas of poor people via the <A href="http://info.worldbank.org/etools/BSPAN/PresentationView.asp?PID=2101&#38;EID=955">New Village Movement countrywide</A>.&#8217;</p>
<p>&#8220;<em>Second</em>, the president focused on cooperation in forestry, and Korea promised to implement a project to plant trees on 200,000 hectares, which is a win-win policy to restore forestry, to produce bio-energy, as well as to create job opportunities. His project will become a fine project of cooperation creasing  &#8216;green&#8217; cooperation bilaterally, which can create proper carbon dioxide emission credits and help to control global climate change. </p>
<p>&#8220;The South Korean president added that the <em>third</em> field is cooperation in industry, to provide training and education services, where at present, there are more than 500 enterprises in Cambodia contributing to develop the Cambodian economy. </p>
<p>&#8220;The <em>fourth</em> field focuses on cooperation in building infrastructure, where since the 1970ies, Korea has a lot of techniques, capital, and experience, and has constructed infrastructure in Korea and in other countries in electricity, roads, and railroads. </p>
<p>&#8220;Deputy Prime Minister Hor Namhong continued to say that the Cambodian-Korean cooperation has reached a comprehensive and strategic partnership, and both countries will boost this cooperation further. </p>
<p>&#8220;During this meeting, the heads of the two governments signed nine agreements: </p>
<ol type="1">
<li>Extradition treaty;</li>
<li>Conditional agreement between the Cambodian and Korean governments about economic development cooperation for 2009-2012; </li>
<li>Agreement on cooperation between the chambers of commerce of Cambodia and Korea ; </li>
<li>Cooperation agreement to produce publications between the Ministry of Information of Cambodia and the Korean Telecommunications Committee;  </li>
<li>Memorandum of Understanding between the two countries on mineral resources; </li>
<li>Memorandum of Understanding on investments to plant trees and to control climate change; </li>
<li>Memorandum of Understand on education, training, and research, between the Royal University of Agriculture and the University of Agriculture of Korea; </li>
<li>Memorandum of Understanding on rice product investments for export; and </li>
<li>Memorandum of Understanding on cooperation in the oil sector between the National Oil Authority of Cambodia and the Korean Oil Corporation. The South Korean president also promised to accept 3,500 Cambodian workers more to work in South Korea, adding to the total number of Cambodian workers to South Korea to increase to 9,000.</li>
</ol>
<p>&#8220;The South Korean president welcomes workers to South Korea, and he promised to help Cambodian women who are legally married to Korean men. </p>

<title><![CDATA[Sam Rainsy and Kem Sokha Consider the New Demonstration Law as a Constraint on the Power of the People of Cambodia - Thursday, 22.10.2009]]></title>

<p>&#8220;The National Assembly has adopted a demonstration law limiting demonstrations to not more than 200 people. This law is considered by the opposition parties as a restriction of the power of the people in Cambodia. However, government representative claimed that this new law helps maintain social stability. </p>
<p>&#8220;During the session of the National Assembly yesterday, 21 October 2009, 76 parliamentarians out of 101 raised their hands to adopt this demonstration law, while the parliamentarians from the Sam Rainsy Party and from the Human Rights Party did not.</p>
<p>&#8220;Mr. Sam Rainsy told reporters in the morning of 21 October 2009, &#8216;At present the government cares only about cracking down on  demonstrations and wants to eliminate the right of citizens who have reasons to protest.&#8217; The people will get angry and feel pain when they want to present what they demand, but cannot do it though their demands are right. The government does not solve the citizens needs, but wants to intercept their presention.</p>
<p>&#8220;Mr. Sam Rainsy stressed that the Sam Rainsy Party wants to organize the country rightly, to eliminate the root causes of demonstrations, but the government just eliminates the demonstrations. Regarding the law limiting the number of people to only 200 to participate in a demonstration, Mr. Sam Rainsy said that it is a ban anticipating the expression of the power of the people in Cambodia.</p>
<p>&#8220;Mr. Sam Rainsy said, &#8216;They do not want that large scale demonstrations can be held. If large scale demonstrations are held, the state fears the power of the people. People take power to control the country to serve the real benefit of the people, but not to serve the benefit of any dictatorial party or any dictators or their groups.&#8217; </p>
<p>
  &#8220;Mr. Sam Rainsy said that the Sam Rainsy Party does not support this law, as it has gaps which the state could use as a pretext to prevent people from demonstrating peacefully. It abolishes citizens&#8217; right to express their opinions through peaceful demonstrations.
</p>
<p>&#8220;The president of the Human Rights Party, Mr. Kem Sokha, spoke to journalists expressing the same view as Mr. Sam Rainsy: that this demonstration law banishes people&#8217;s power in Cambodia, especially when citizens want to demonstrate to demand that leaders resign from their positions. He said, &#8216;For example, citizens may want to demonstrate over politics&#8230; to demand that some leaders resign.&#8217; </p>
<p>&#8220;Mr. Kem Sokha added that in countries that practice democracy, people can hold demonstrations to demand that some leaders leave their positions &#8211; which is called people&#8217;s power. While in Cambodia, it is now to be assumed that the Ministry of Interior will not allow this kind of manifestation, using the reasoning that it might be against national security, or against safety and public order. These are pretexts that governments use to prevent the people from demonstrating. Mr. Kem Sokha said that also the Sam Rainsy Party parliamentarians do not support this law.</p>
<p>&#8220;When asked whether this law interdicts people&#8217;s power or not, Mr. Kem Sokha said, &#8216;Of course. We see the direction. After we heard the words of the parliamentarians of the ruling party, it seems that they are afraid of the power of the people.</p>
<p>&#8220;A democratic regime is a regime where power can be changed peacefully, and leaders are established through general elections. But if the elected leaders act against what they had promised, citizens can demonstrate for a change of power. </p>
<p>&#8220;An investigating official of the Cambodian League for the Promotion and Defense of Human Rights (LICADHO), Mr. Oum Sam Ath, said that limiting the number of people who can participate in a demonstration is not right for a country that practices democracy. </p>
<p>&#8220;This demonstration law also requires demonstration leaders to inform the authorities in advance, and Mr. Oum Sam Ath explained that the need to request for a permission, and this 5-days in advance, requires then to wait to see whether the demonstration is permitted or not &#8211; which is a new restriction, including the limitation of the number of demonstrators. This law is not according to the concept of democracy. </p>
<p>&#8220;However, a representative from the Ministry of Interior claimed during the session of the National Assembly since a few days ago that this law ensures social stability.</p>
<p>&#8220;A secretary of state of the Ministry of Interior, Mr. Nuth Sa An, said that the Ministry will ask the government to develop a policy how to publicize this law among the citizens.</p>
<p>&#8220;Though this law limits the number of people to 200 who can join a demonstration, Mr. Sam Rainsy said that this is not acceptable, and the Sam Rainsy Party plans to hold big demonstrations in the future. Mr. Sam Rainsy said that a planned big demonstration &#8211; though a specific date has not yet been set &#8211; is a demonstration to assemble tens of thousands of citizens victimized by land disputes from the provinces and cities countrywide.</p>
