As agent for the Geoffrey Jenkins estate I have been requested to put Relativity Media and its associates on notice. The title “HUNTER KILLER,’ “GEOFFREY JENKINS’ HUNTER KILLER” AND “COMMANDER GEOFFREY PEACE” are Registered Trademarks of Geoffrey Jenkins Publications. (2.) Geoffrey Jenkins wrote and published “HUNTER KILLER” in (1966) and the novel has sold in excess of 30,000,000 copies worldwide. The story that is being used by Relativity Media is based upon a lesser known novel entitled, “Firing Point.” The Geoffrey Jenkins estate and Thornfield Productions, Inc., are currently in pre-production for “HUNTER KILLER” based upon the Geoffrey Jenkins classic. And, by the way, the plot of the Relativity Media picture is so similar to the original Jenkins story that we believe that the producers are crossing the line one more time. Our atomic submarine Commander Geoffrey Peace averts World War 3 with the Russians and his precious cargo is the Vice President of the United States. In their story, World War 3 is averted with the Russians and their precious cargo is the President of Russia. The Geoffrey Jenkins estate is in the process of investigating this situation and are bringing in their literary forensic experts to determine what is happening. The Los Angeles entertainment attorneys for the estate are on stand-by and suggesting that there are more than seven determined places where their script needs to be changed. NOTICE TO NEAL MORITZ’S ORIGINAL FILMS AND RELATIVITY MEDIA FROM THE GEOFFREY JENKINS ESTATE, DURBAN, SOUTH AFRICA: I am the agent for the GEOFFREY JENKINS ESTATE. This entity owns all rights in the world famous character COMMANDER GEOFFREY PEACE and the TRADEMARKED TITLES “HUNTER KILLER” and “GEOFFREY JENKINS’S HUNTER KILLER.” These rights are extremely valuable to the Geoffrey Jenkins estate, and are zealously guarded against any unauthorized use. (2.) We have recently become aware that Neal Moritz’s Original Films and Relativity Media are infringing on these valuable intellectual property rights, both through their publicity for a film entitled, “HUNTER KILLER,” based upon a novel entitled “FIRING POINT” by DON KEITH and GEORGE WALLACE, which your companies are co-producing and distributing. Specifically, you have posted pictures of director Philip Noyce and created articles indicating that your picture entitled “HUNTER KILLER” will be released late in 2012. (3.) The aforementioned conduct constitutes copyright infringment, Trademark infringement, false endorsement, and false designation of origin in violation of Section 43(a) of the Lanham Act, and unfair competition in violation of state and federal law. (4.) Accordingly, the GEOFFREY JENKINS ESTATE demands that you immediately refrain from marketing materials with this name “HUNTER KILLER,” or any other name using or mimicing the plot or characters from the famous novel HUNTER KILLER (1966) by GEOFFREY JENKINS, character of Commander Geoffrey Peace (submarine Captain) or any other motion picture or character using Commander Peace (See “A Twist of Sand,” (1968) starring Richard Johnson and Honor Blackman for reference.) In order to comply with this demand, you must cease the print and electronic distribution of any current or future materials promoting a film entitled “HUNTER KILLER,” which infringes the Geoffrey Jenkins Copyrights and Trademarks throughout the world–and which are deemed “protected materials.” In addition, the Geoffrey Jenkins Estate demands that you provide an accounting of any and all revenues collected since you began using the Trademarked title “HUNTER KILLER” or marketing the aforementioned merchandize, and confirm in writing the steps you have taken in complying with the terms of this correspondence (notice) in a public forum. PLEASE BE ADVISED that failure to comply with these demands will cause the GEOFFREYJENKINS ESTATE to take appropriate legal action to protect their rights and interests in “HUNTER KILLER,” (a film now in development by the Geoffrey Jenkins Estate in partnership with Thornfield Productions, Inc.) and to seek all injunctions, damages, fees and costs to which they are entitled under law.
