Sài Gòn mấy tuần gần đây mưa bão liên tục, cứ chiều là mưa, chiều là mưa, thỉnh thoảng “mưa ké” vào buổi sáng hôm sau nếu chiều hôm trước “ổng” mưa..chưa đã ! Hôm kia hay hôm kìa gì đó, hôm qua mưa còn ác hơn, trời mưa rất to, gió thổi rất mạnh, cúp điện ! Lúc này tôi có cảm giác như mình sống chỉ để làm một việc duy nhất vào lúc này là : ngồi nhìn mưa. Thật vậy, cúp điện là hết : không blog, không internet, không lập trình, không nghe nhạc, xém chút nữa là không điện thoại di động luôn. Hic, 4 tập của cuốn sách “Học làm giàu từ những doanh nhân khổng lồ” tôi đã đọc tới đọc lui từ những lần cúp điện trước rồi, giờ biết kiếm gì đọc đây ?

Thôi được rồi, cũng phải kiếm việc đó để làm chứ : trải chiếu ra, mở cửa sổ, vừa nằm nhìn mưa vừa thưởng thức giai điệu của “From sarah with love” trên cái iPod kết hợp với các loa mini sạc điện, chợt nhớ….

Đang xuống nhà đi ăn cơm, tôi hơi ngạc nhiên thấy mấy con chó ở nhà xe đang nằm ở cầu thang lầu 1, “Vì sao thế ?” – Xuống tới nơi mới thấy, nước tới đầu gối luôn ! Chưa từng thấy !
Lúc tôi viết những dòng này thì hơn chục người hàng xóm ở khu tôi ở đang hỳ hục tác nước, chuyển Ông địa lên tầng trên, cũng may tôi ở trên tầng 3 nên thoát nạn, dù sông Sài Gòn có tràn bờ cũng không sợ !

Đi ngang qua nhà họ, một chủ đề đang được là Cư xá nơi tôi ở mới làm lại đường (vì cứ mưa là ngập) với kinh phí hơn 100 triệu (chúng tôi ở trên tầng 3 nên chỉ đóng 1 triệu), những nhà đang tát nước thì đóng 3 triệu, thế nên giờ họ mới tức vì hiện tại có vẻ ngập nặng hơn trước (nước lên tới đầu gối). Hic, nếu nhà họ không cao hơn mặt đường đáng kể thì coi như xong, nội việc “bưng” cái tủ lạnh hay cái tủ TV lên lầu thôi cũng đã mệt rồi ! Chỉ tội những nhà đang khóa cửa, lúc họ về sẽ có nhạc nhiên đây , sorry.

Donates 120 TONS of dog food to shelters across the U.S. during economic crisis

Les professions médicales sont exposées, dans le cadre des dispositions du code de la sécurité sociale, au contrôle médical de leur activité par le service médical de la caisse d’assurance maladie.

Cette procédure de contrôle est souvent négligée par les praticiens alors qu’elle est susceptible d’aboutir à différentes procédures judiciaires ou conventionnelles :

- remboursement d’indus à la CPAM au cas de contestation des actes pratiqués,

- sanctions disciplinaires devant la section des assurances sociales du conseil de de l’Ordre,

- sanctions conventionnelles,

- sanctions pénales,

- sanctions financières instituées par la loi du 13 août 2004.

La phase de contrôle d’activité, qui est essentiellement administrative, n’est donc pas à négliger et le législateur a entendu, compte tenu de son importance et des conséquences potentiellement graves pour le praticien, améliorer les garanties du praticien.

Le décret n° 2007-146 du 1er février 2007 réglemente la procédure et son caractère contradictoire en vue d’assurer la garantie des droits du praticien contrôlé.

Phase 1 : Ouverture du contrôle et information du praticien contrôlé.

Lors de l’ouverture du contrôle d’activité, le praticien-conseil doit obligatoirement informer le praticien contrôlé de la mise en place de la procédure de contrôle. La procédure de contrôle ne peut porter que sur les actes effectués dans les trois dernières années à la date de l’ouverture de la procédure de contrôle.

Phase 2 : Contrôle d’activité par le service médical de la Caisse.

Le praticien-conseil a la possibilité de se faire communiquer, dans le cadre de sa mission, l’ensemble des documents, actes, prescriptions et éléments relatifs à la période d’activité contrôlée. Il est habilité à consulter les dossiers médicaux des patients et, en cas de besoin, entendre et examiner ces patients après en avoir informé le praticien contrôlé.

Le praticien-conseil est habilité par la loi à vérifier la compatibilité de l’activité du praticien contrôlé au regard de la nomenclature générale des actes professionnels. Il peut constater les abus en matière de soins, de prescription d’arrêts de travail ainsi que l’intérêt thérapeutique des soins et de leur pertinence au regard des données acquises de la science, ce dernier point étant généralement très mal vécu par les praticiens qui y voient une atteinte à leur liberté dans le choix des méthodes thérapeutiques et de prescription des soins.

Phase 3 : Information du praticien et de la caisse du résultat du contrôle.

A l’issue de l’analyse d’activité, le praticien-conseil est tenu d’informer le praticien contrôlé du résultat de ses analyses.

S’il est constaté le non-respect des règles législatives, réglementaires ou conventionnelles régissant la couverture des prestations à la charge des organismes de sécurité sociale, le praticien-conseil est tenu d’en aviser parallèlement la caisse d’assurance maladie.

Phase 4 : Notification des griefs par la Caisse au praticien contrôlé et entretien contradictoire ouvert à la demande du praticien contrôlé.

En cas d’anomalie dénoncée à la caisse d’assurance maladie, celle-ci notifie au praticien les griefs susceptibles d’être retenus contre lui en l’informant qu’il dispose d’un délai d’un mois pour présenter ses observations et être entendu par le service médical. Au cours de cet entretien, le praticien peut être assisté d’un confrère. La caisse est tenue, en vue de permettre au praticien de préparer cet entretien éventuel, de lui remettre les éléments nécessaires, en particulier la liste des anomalies relevées et l’identité des patients concernés.

Cet entretien fait l’objet d’un compte-rendu qui est adressé, par lettre recommandée avec demande d’avis de réception, au professionnel de santé dans un délai de quinze jours. A compter de sa réception, le professionnel de santé dispose d’un délai de quinze jours pour renvoyer ce compte-rendu signé, accompagné d’éventuelles réserves. A défaut, il est réputé approuvé.

Phase 5 : Notification de la décision finale de la Caisse.

La caisse dispose d’un délai de trois mois pour informer le professionnel de santé des suites qu’elle envisage de donner aux griefs initialement notifiés. A défaut, la caisse est réputée avoir renoncé à poursuivre le professionnel de santé contrôlé.
