Have you ever come across a tender that looks interesting but you just don’t have a clue what it’s talking about?

Buyers, often with the best intentions, sometimes include terminology that is quite frankly harder to understand than ‘The Theory of Everything’ by Stephen Hawkings. If you’re new to public sector tendering, here’s a simple jargon buster of some of the most commonly used terms that may just save your PC from being thrown out the window…!

Approved List
An eligible list of potential suppliers.

Consortia
A group of organisations.

Contract Award Notice
Notification of the award of a contract, including successful supplier details and duration of contract.

Contract Notice
Invitation to tender for Works, Supplies or Services.

CPV Codes
Common Procurement Vocabulary – industry classification system. For a comprehensive list please go to: http://simap.europa.eu/codes-and-nomenclatures/codes-cpv/codes-cpv_en.htm

EOI
Expression of Interest – responses of interest from suppliers.

Framework Agreement
An agreement with suppliers which set out terms and conditions under which specific call-offs (purchases) can be made throughout the term of the agreement (can also be referred to as a Call off Contract)

ITT
Invitation to Tender – an invitation to suppliers to bid for the provision of works, goods or services.

MEAT
Most Economically Advantageous Tender – the basis for the award of any contract not being awarded on lowest price. If the purchaser is awarding a contract based on MEAT, they must also specify the criteria and weightings that they will apply to this judgement.

OJEU
Official Journal of the European Union – formerly known as OJEC (Official Journal of the European Community).

OGC
The Office of Government Commerce – an independent office of HM Treasury, established to help Government deliver best value from its spending.

PFI
Private Finance Initiative – a partnership between the public and private sector which is used for high risk / high value contracts.

PIN
Prior Information Notice – advance notice of contracts which will be placed mainly for items of major expenditure.

PPP
Public Private Partnership – very similar to a PFI arrangement, but the aim is centered more on service delivery rather than finance.

PQQ
Pre-Qualification Questionnaire – this document is used in a restricted procedure tendering process where the responses are used to shortlist suppliers.

RFQ
Request for Quotation

Shortlist
A list of suppliers that have been successful in meeting the requirements of a pre-qualification questionnaire.

SLA
Service Level Agreement – enforcing the KPIs (Key Performance Indicators) of the Contract.

Specification
The document used to establish the requirements for the goods or services being purchased.

Standstill Period
Sometimes referred to as the ‘Alcatel Period’ – the contracting authority must allow a period of 10 days between the date suppliers are notified about the outcome of the tender process and the date that they sign the contract or framework agreement. This allows unsuccessful bidders to request a review of an award decision from the relevant contracting authority.

Supplementary Vocabulary
Designed to describe the subject matter of CPV Codes – a more refined classification.

Tender Notice Procedure Types:

Competitive Dialogue
Used only for particularly complex contracts – i.e. where you are unable to define the technical means or the legal/financial make-up (preferred option for PFI/PPP contracts).

Negotiated Procedure
Use reserved for exceptional circumstances only, i.e. failure of a previous procedure, where no pricing structure can be set, for some services which cannot be adequately specified and some research & development contracts.

Open Procedure
Tenders invited from all interested parties.

Restricted Procedure
Tenders invited from providers meeting the requirements of the pre-qualification questionnaire.

Thresholds
The EU sets financial thresholds over which all public sector contracts must be advertised. For more guidance on thresholds please go to: http://www.tendersdirect.co.uk/Help/Threshholds.aspx

TUPE
The Transfer of Undertakings (Protection of Employment) Regulations. The purpose of TUPE is to preserve continuity of employment and to safeguard employment rights of all employees whose employment transfers to a new employer as a result of a relevant transfer.

Francis Maude - Shadow Minister for the Cabinet Office Speaking at the Conservative party conference

Francis Maude - Shadow Minister for the Cabinet Office

Speaking at the Conservative party conference in Manchester yesterday, Francis Maude, Shadow Minister for the Cabinet Office, said the party would publish online, every item of government expenditure over £25,000 and all government tender documents for contracts worth over £10,000.

The Shadow Minister said that he thought that this would allow ‘an army of armchair auditors’ to crawl all over the governments accounts and not only help them to spend money better, but it would also help to rebuild trust.

This isn’t the first time that politicians have promised to make government procurement more transparent:

In 2003 the Better Regulation Task Force published ‘Government Supporter and Customer?’ Recomendation No. 1 was that the government should advertise ’lower value contracts from across central government and include information on future contract opportunities.’ This set the scene for the Supply2.gov website, which due to a woeful lack of support from the Department of Business failed to reach its true potential and is due to be replaced by a new website implementing the Glover recommendations (see below).

In 2005 the Office of Government Commerce and the Small Business Service published ‘Smaller supplier…..better value?‘ which pointed out the challenges facing SME’s and how the government could help by publishing their future contracts online.

Also in 2005 the Office of the Deputy Prime Minister (when John Prescott was still a force to be reckoned with) published the ‘Small Business Friendly Concordat: Good Practice Guidance’ which yet again urged public sector organisations to use their websites to publish ‘details of forthcoming bidding opportunities.’

In 2006 the then Scottish Executive published a ‘Review of Public Procurement in Scotland’ authored by John McClelland, which recommended that ‘a single public sector “electronic portal” should be established. Suppliers must be able to access all essential information on opportunities to offer services and bid for contracts for the supply of commodities and services to the whole Public Sector in Scotland.’ This report resulted in the establishment of the rather effective Public Contracts Scotland website in 2008, which is run by the (some say, brilliant) team behind Tenders Direct.

Most recently in November 2008, the Glover report or ‘Accelerating the SME economic engine: through transparent, simple and strategic procurement,’ as it was more formally known, yet again, you guessed it, recommended that:

‘By 2010, contract opportunities above £20,000 across the whole public sector should be advertised electronically with standard indicative contract value ranges, and accessible through a single, free, easy to search online portal.’

So at numerous times over the last six years, various politicians, government departments, quango’s and notable report authors have called for more transparency in the publication of government contracts.

The main barrier to progress has definitely been the lack of a clear lead by central government, either to publish its own contracts, or to establish an infrastructure and clear guidelines or regulations to ensure that other public bodies publish their contracts. The secondary barrier has been an unwillingness by staff in local authorities, NHS trusts, etc., to publish their contracts. This unwilling attitude stems from a variety of reasons such as a fear that they will be inundated with suppliers, that they want to keep contracts for local suppliers, that they ‘know’ who the best suppliers are anyway. Provided the procurement activity is approached professionally these fears are either groundless, well intentioned, but illegal and ineffective, or simply wrong. All of them get in the way of efficient procurement, or as the Right Honorable Member for Horsham put it yesterday we need to ’spend money better.’

The Department for Business and the Office of Government Commerce have been making some progress towards implementing the recommendations contained in the Glover Report. Unfortunately progress appears to have slowed as the General Election looms closer. At least it seems that the Tories have a similar, if not even greater, enthusiasm to open up public procurement, so that regardless of who wins power next year we should have a new era of open access to government contracts.

Or is it a dagger? Either way a gin and tonic would be more palatable perhaps ! I note some rather sniffy press coverage of the recent OGC review of the review of the role of the Senior Responsible Owner (SRO). Mainly along the lines of the report being a statement of the blooming obvious. You can judge for yourself here.

Having now read the full report it strikes me the press coverage is rather unfair as the OGC report contains much valuable learning especially as understanding and defining the role of the SRO in an area where so many organisations struggle.

For those of you who have not been reading their MSP manuals lately the Senior Responsible Owner (SRO) role is important and pivotal in ensuring that projects deliver their expected outcomes and benefits. The role was first proposed for IT-enabled projects in the McCartney Report in 2000; prior to this, it was often difficult to identify the individual with responsibility for the successful outcome of a major project. In recognition of its importance, the role is now mandated across all UK Government projects. The SRO role is widely regarded as an essential innovation that increases the chances of project success by helping to establish clear objectives and better decision making both internally and in the management of any third party suppliers involved in delivery.

The SRO role is especially important in programmes of change. It is the SRO who should take personal ownership for ensuring that a project or programme meets its objectives and delivers the expected and planned benefits. Crucially the SRO should be the owner of the overall business change that is being supported by the project. This allows the SRO to ensure that the change maintains its business focus and does not get bogged down in minutiae and the techy detail stuff so loved by many of us who earn a crust from ICT. It goes without saying that this person must be very senior, have the necessary authority and be recognised as THE ultimate authority in relation to the programme throughout the organisation.

Sounds simple? No near impossible to be candid and this OGC report is useful in highlighting why it’s such a difficult – some might say impossible – role. It contains some good stuff in terms of lessons learned and some valuable practical advice.

From my perspective it seems to me that within local government the SRO concept is still relatively immature and underdeveloped. Two things strike me as being particularly important.

Firstly, understanding what the SRO is and what it isn’t and ensuring that the person doing the role ‘gets it’. If the SRO does not properly understand their role then things are sticky from the outset. Perhaps a way of thinking about this is to consider it as an extension of the Project Executive role (in PRINCE terms) but with a specific emphasis on being FULLY engaged with the work of the planned business change. The SRO should be prepared to take active decisions and should be proactive in providing leadership and direction throughout the life of the Project or Programme. Crucially the SRO should be responsible for ensuring the organisation can fully exploit the outcome of the change such that the benefits are delivered as a result of that outcome. There are three important things here : Ownership, ownership and ownership !

The second big thing for me is giving the SRO the time to do the job properly. That means space within their ‘day job’ – so ask yourself the question “what am I NOT going to do?” and crucially “who is going to do those parts of the day job that I won’t be doing instead of me?”. If you don’t think about these questions and re-allocate day job roles and duties from the outset (and for the duration of the project/programme) then it almost won’t work and it will turn out to be that poisoned chalice !

Not everybody might find this funny, but it made me laugh!

Oh, and when you look back in the list they have for sale – there is also an itil version 5 and 6 if remember correctly.

But seriously – The current version of the ITIL framework is ITIL V3 which consists of 5 core volumes:

- Service Strategy

- Service Design

- Service Transition

- Service Operations

- Continual Service Improvement

OGC (the owner of the framework) has just announced that a refresh of this version will take place to rectify some mistakes, but the current version is still version 3.

OGC recently released the project requirements for an update to the ITIL Core publications.

The aim for this update project would be :

To update the publications in line with a number of issues raised in the Change Control Log. Not everything will be addressed – some technical changes are seen as too much for this evolutionary change

To remedy the inconsistencies that exist between the content and layout of the publications

To answer some of the criticisms that have been leveled at the core publications by the training community

To simplify the Service Strategy publication to ensure that the concepts are readily understood and that the content is accessible to a greater number of users.

Some of the key updates which are in scope for this edition (not version) would be :

Look at remedying inconsistencies within the content of the five books:

Roles need to be made consistent across the books, ensuring that the activities apply only to one role

Clarify that the organizational structures given as examples are indicative rather than prescriptive

Restructure the guidance to ensure that all five publications are organized in the same way:

Ensure that each process has goals, purpose and objectives

Look at how the processes are dealt with, and ensure a common treatment for all

Ensure that the books are aligned, w • here relevant, with guidance in MSP™, M_o_R®, PRINCE2® and P3O®.

Give clear explanations and descriptions of roles and responsibilities

Standardize the use of glossary definitions within the five titles. Ensure that the explanations in the text align with those in the glossary

Update to the glossary to take account of the comments made in the Change Control Log

Examine the definition and usage of the roles of Product Manager and Service Owner

Ensure that service catalogue manager appears within Service Operation

Redesign the content according to OGC’s updated style guidelines.

Please see the official document here.

Information Source : OGC Best Management Practice Website.

I personally think this is a good idea to make these updates. Having gone through the Service Strategy and Design books myself, I found them very difficult to understand and vague. This should help those two books and the entire audience who refers back to the core publications.

Quais as principais ferramentas e softwares usados no PRINCE2?

O PMI regula a Certificação PMP.
