On Monday, the Irish Penal Reform Trust will launch a new report; Detention of Children in Ireland: International Standards and Best Practice. Details of the launch are here. In the year in which the UNCRC turns 20, the IPRT reminds us that:

Article 37 of the UN Convention on the Rights of the Child, ratified by Ireland in 1992, requires that the arrest, detention or imprisonment of a child should be a measure of last resort and for the shortest appropriate period of time. Detention as a last resort requires parsimony in the use of custody for children and that it be limited to exceptional cases, including for example where a child has been found guilty of a violent offence.As long as detention exists as an option, places of detention for children should aim to maximise their chances of rehabilitation and integration into society by providing a humane, safe and secure environment whereby the offending behaviour of children can be addressed, and where children will be assisted to make better choices about their lives during custody and on their return to society.

The report will:

• discuss the context of the detention of children in Ireland, outlining the international standards applicable to detention of children, and provide a comparative analysis of a number of youth detention systems in Europe.
• examine specific standards relating to a number of practice areas (such as physical environment and accommodation; personal and social development; health care provision; staffing requirements, etc.) and highlight examples of good practice both in Ireland and in other European countries in those areas, which may serve as guidance for the development of policy and practice in the new National Children Detention Facility at Oberstown.
• make 63 detailed recommendations across a range of practice areas.

The IPRT said yesterday that it is calling on the government to:

1. Bring an immediate end to the detention of children in St Patrick’s Institution
2. Extend the remit of the Ombudsman for Children to receive individual complaints from children held in St. Patrick’s Institution. The Ombudsman for Children Act, 2002 forecloses this option. In the foreword to the report, the Ombudsman, Emily Logan, has expressly welcomed this recommendation.
3. Improve child protection procedures and practices in all places where children are detained

We look forward to blogging about the contents of this important report in more detail in due course. We also recommend the IPRT’s recent briefings on mental health in Irish prisons and overcrowding in Irish prisons.

Úgy tűnik, egy nem is annyira távoli országban 1775 óta iskolások generációit fosztottak ki. Nem is értem, hogy nem jutott eddig senkinek az eszébe, hogy ezt a szörnyű rendszert eltöröljék. Hogy ne töröljék el azt, hogy a diákok szüleinek PÉNZT kell adniuk arra, hogy a szemük fénye elmehessen kirándulni az osztállyal, vagy esetleg ruházkodhasson. Az ombudsman szerint törvényellenes az osztálypénz, az iskolai egyenruha megvásároltatása stb. Mi lesz még itt?

Törvényellenes az osztálypénz, mert a szülőknek be kell fizetniük olyan pénzeket, amikből a fiacskájuk osztálya megvásárolja a dolgokat, esetleg elmennek valahova kirándulni. Sőt, iskolai egyenruhát se kötelezhetik, hogy megvegyék, de még arra sem, hogy egyáltalán hordják. Tehát a kirándulást kifizetheti az iskola, és akkor mindenki happy, kivéve a tanárok, meg az igazgató. A tanárok azért, mert az igazgató levont a fizetésükből, mert az állambácsi azt mondta, adjanak a diákoknak pénzt. Az állambácsi viszont nem ad az iskoláknak. Az igazgató meg azért nem lesz hepi, mert a tanárok megerőszakolják, kiherélik, meglincselik, kitépik a kezét és feldugják a seggébe. Mindezt azért, mert az így is alacsony fizetésüket mégjobban lecsökkentette nekik az igazgató. Na szóval a kirándulást kifizethetik, sőt, még az egyenruhákat is, de a diákoknak nem kell hordani, mert kötelezővé nem tehetik.

Fura… na de menjünk tovább. Lassan az lesz, hogy a diákok nem vehetik meg maguknak a könyveket, majd az iskola megveszi nekik… aztán füzetek, vonalzók, körző, színes tollak, ceruzák, ugye? Szalagavatóra meg majd mindenki kap egy 20 000 forintos Parker tollat, nem? Így is szarban van az állam, meg az iskolaügy, mit akar még tőlük az ombudsman?

Ha nincs pénz Magyarország legrangosabb iskolájába járatni a 2 gyereket, nem muszáj. Senki nem kényszerít senkit. Majd nem Svájcba fog síelni menni két hétre az osztálykiránduláson, hanem csak Sopronba 3 napra, de jó lesz az is. Nem fog iskolai egyenruhát hordani, csak hétköznapi öltözetet. Nincs semmi baj az ilyen iskolákkal, én is túléltem. Ha meg valakinek nincs pénze a 14 gyerekét iskolába járatni, akkor MENJEN EL DOLGOZNI! (igen, célzás volt).

Jornalismo e ciência têm tempos diferentes entre si, o que sempre foi problema para especialistas na área

O AQUECIMENTO global é uma das mais sérias questões da agenda mundial. Um dos capítulos do livro recomendado ao final resume bem as razões; algumas das consequências já observáveis estão no filme indicado.
O jornalismo tem obrigação de cobrir com rigor, isenção, destaque e prioridade o debate em torno do assunto. A Folha a vem cumprindo com louvor, às vésperas da cúpula de Copenhague no início de dezembro.
Esta semana, no entanto, parece ter dado pequena derrapada ao tentar extrair conclusões definitivas rapidamente demais de comunicado conjunto dos países banhados pelo Pacífico (EUA e China entre eles), ao final do encontro da APEC no domingo, no qual declaravam sua intenção de não definir no mês que vem metas fixas e obrigatórias de corte de emissões de gases causadores do efeito estufa.
A obsessão em apontar “fiascos” alheios se manifestou novamente na segunda-feira quando a palavra foi usada na primeira página para definir desde já o resultado de Copenhague. Pode ser que a reunião acabe mesmo em fiasco. Mas é cedo para decretar o resultado.
Tanto que, na quarta, sem o mesmo alarde e nenhum radicalismo (nem chamada de capa), o jornal noticiou que os presidentes Barack Obama e Hu Jintao anunciaram aceitar estipular metas em Copenhague.
A aparente contradição pode muito bem ser apenas resultado do exercício rotineiro de táticas de diplomacia, que podem incluir declarações públicas com conteúdo diverso (às vezes oposto) ao das posições de fato dos governos, a fim de sentir a reação das demais partes e da opinião pública.
Jornalismo e ciência têm tempos diferentes entre si e este sempre foi o principal problema para quem exerce essa especialização da atividade. O jornalismo anseia por conclusões finais rápidas; a ciência requer prazos longos para testar e validar hipóteses.
Esses tempos raramente sincrônicos têm que se ajustar agora também aos da diplomacia, da política e da economia, que tampouco costumam ser simultâneos entre si. Conectar os cinco relógios é tarefa dificílima.
Como se já não o fosse explicar no espaço reduzido do jornal a enorme complexidade e muitas controvérsias em torno do aquecimento global. Por exemplo, o fato de que o aumento gradativo das temperaturas no planeta não deve ser medido pela sua evolução anual, mas sim de pelo menos décadas, e talvez de meio século ou séculos.
A Folha vem usando pouco os recursos da internet, que podem levar leitores a recursos didáticos muito mais adequados à compreensão desses problemas do que a página impressa, onde deveriam constar remissões para sites confiáveis com elementos audiovisuais e de multimídia eficazes.
Se isso não for feito bem e depressa, corre-se o risco de a opinião pública se desinteressar do assunto e deixar de colocar pressão sobre os governantes, como já vem ocorrendo nos EUA. O resultado pode ser trágico.

AN OPEN LETTER TO RICHARD KING, on the occasion of a story about council credit cards in the New Zealand Herald’s Herald on Sunday.

Dear Mr King

Thank you for taking the time to read this letter. We appreciate you’re a busy man, and that stuff like having to find someone to drive you to and from engagements only makes you busier.

We write having read a story about you published in the New Zealand Herald’s Herald on Sunday today. The Herald is, apparently, a reputable newspaper, but its latest work shows it doesn’t know just how important you are.

The Herald reported it’d asked the chief executives of all New Zealand councils to say how much they spent on council credit cards, and what they’d spent the money on.  It said only seven charged more than $10,000 to the cards.

And it said the top charger was you.

It said you spent $25,000 in the 2008-2009 financial year. That was more than $7000 more than the next highest charger, a chap from a big outfit called Waitakere City. We’re pretty sure your boss Mayor Tim used to work there when it was called something else. But that’s by-the-by.

Anyway, the newspaper says you refused to say what you spent the money on. Instead, your off-sider said it was all authorised and that it included expenses related to the mayor and councillors; food, drink, and petrol (though we guess most of that bill will drop this year), and even some furniture for the council building.

All that looks fair enough, we suppose. But we wonder why you refused to tell the Herald yourself. And we wonder why you cited privacy when you refused, and why you did that when a man of your infinite experience should’ve known the newspaper would only go and ask the Ombudsman to make you.

We know your council has a habit of making people go to the Ombudsman. And, fair play, sometimes there may be perfectly legitimate reasons for doing so. Not all publicly-funded information is public, we suppose, and someone of your standing should be allowed to make such decisions about what we ought to know.

But, equally, what we don’t understand is how you can say expenses you charged to a council-owned credit card are personal and private. After all, it’s a council card funded by council money. Ergo, the expenses were charged to ratepayers.

Maybe you’re acting on advice from your council’s communications boss. Maybe you don’t think the media has any role in asking questions for ratepayers. Maybe you can’t see how the enabling provisions of the Local Government Official Information and Meetings Act apply. Perhaps this is, genuinely, a case where the Ombudsman should give councils a steer.

We don’t know what the Ombudsman will say, though he has got a pretty good track record in telling people who spend public money to be up front and honest. But we’d say he’ll have to consider whether the public has a right to know what it paid for when you used the council card.

And like us, he’ll have to wonder whether you lost all claim to keep your receipts private when you used ratepayer cash to generate them.

So, in conclusion, chin up in these trying times and thank you for keeping Invercargill in the national media. We’ve had a tremendous time of it, what with your drink driving conviction and the latest mayor vs council dustup. We’re just so pleased that our public money is being so well spent putting Invercargill on the map.

But boy, isn’t it a hard road once you start on it.

A manipulação de informações que o site do STF tem promovido contra Cesare Battisti (ver aqui e aqui) é revoltante. Além de combater a desinformação promovida nesse caso, devemos estar atentos contra a privatização de um espaço público de comunicação pela autoridade estatal, que o toma como quintal privado.

Como mudar isso? Uma possibilidade é criar cargo de ombudsman da comunicação institucional do STF, com papel de zelar para que não ocorram manipulações. Ele poderia ser indicado, por exemplo, pelo Congresso Nacional. Não lhe caberia examinar mérito dos julgados do STF, mas sim a comunicação da corte (site, informativos, etc.).

É hora de a comunicação de órgãos públicos ser pública, e não meramente estatal. Para isso, devemos cumprir nosso dever cívico de manter postura ativa e vigilante das instituições, levando à esfera pública informal todo caso de abuso e manipulação; mas também pode ser útil criar um espaço de voz crítica no âmbito da própria institucionalidade. O ombudsman ficaria atento a desvios, receberia e sistematizaria críticas feitas pelas pessoas, e levaria isso a público, no próprio canal criticado. Se até alguns órgãos privados de comunicação fazem isso (E tem dever de fazê-lo mesmo! Deveria ser obrigado por lei!), como os órgãos públicos podem não fazer?

O que acham de projeto de lei que institua ombudsman como regra para comunicação institucional de todo e qualquer órgão público? E talvez até todo e qualquer veículo de comunicação, inclusive os privados.

O Congresso Internacional que comemorou os 200 anos da instituição do primeiro ombudsman na Suécia transcorreu com intensos trabalhos nos dias 04, 05 e 06 de novembro no Maksoud Plaza em São Paulo. As experiências internacionais foram o ponto de partida dos debates, no entanto, o último painel no formato de talk show não deixou dúvidas em relação a qualidade do conteúdo apresentado pelos brasileiros. Os convidados foram unânimes em admitir que saiam com a disposição de refletir sobre as variáveis que incidem nas ouvidorias, porque a diversidade de temas demonstrados nas oficinas temáticas deixou-os perplexos. Após o evento foram realizadas as eleições da Diretoria da ABO Nacional e da seção São Paulo para o biênio 2010/2011 com o compromisso de uma atuação marcada pelo diálogo. A chapa Experiência e Inovação pela Nacional e a chapa União por São Paulo foram eleitas por aclamação.

Então tá… só eu estou considerando a escolha do Zé Carioca uma solução rápida típica de preguiça? Só eu estou achando estranho a utilização de um personagem com mais de 60 anos enquanto todos os paises sede criaram mascotes exclusivos? Ok. Lanço aqui um convite. Ilustradores, desenhistas e artistas, profissionais e, principalmente, amadores, vamos mostrar que não temos preguiça!

Vou divulgar os desenhos e ideias de quem estiver a fim de provar que o brasileiro é criativo e não precisa de um personagem criado há 60 anos. É só mandar no meu e-mail, que está ali no botão de Contato.

Segundo várias agências de notícias, o presidente da Companhia Estadual de Água e Esgoto (Cedae), Wagner Victer, sugeriu ao amigo/prefeito do Rio de Janeiro, Eduardo Paes, escolher Zé Carioca como mascote das olimpíadas 2016. A infeliz declaração já gerou manifestações. Algumas vozes se levantaram para apoiar a idéia, que me parece tão absurda que nem me dei ao trabalho de analisar os argumentos… Dos que são contra, há os que levantam a bandeira do politicamente correto, dizendo que Zé Carioca é um personagem de caráter questionável e que essa é uma imagem que não se quer atribuir ao Rio de Janeiro. Outros, aparentemente pragmáticos, dizem que seria muito caro pagar royalties à Disney para utilizar o personagem. O problema que vejo é um pouco diferente: Se até para escolher o mascote, os caras já estão apelando para personagens já criados (atalho espertinho que nenhuma outra nação tomou quando sediou as olimpíadas), que dirá de tantas outras decisões que eles terão pela frente? Que meia dúzia de limítrofes defendam a escolha de Zé Carioca como mascote das olimpíadas 2016 é até compreensível… que autoridades como o prefeito do Rio de Janeiro apoiem esse tipo de ideia já é outra conversa…

Here is an extract from one of the case notes of complaints against NT police documented in the 2008-2009 annual report to the local Parliament by the NT Ombudsman.

The Ombudsman’s case note detailed the treatment by NT Police at an unnamed station to “a complainant who was taken into custody for breaking and entering, and who had subsequently fallen asleep outside the premises, due to being highly intoxicated, and who was arrested at the scene.”

Even before he made it to the cells he was getting the full benefit of the cop’s limited vocabulary:

“The complainant could be heard mumbling something whilst he was seated on the bench, although it was not discernable as to what was said. One of the attending officers responded with “shut your face”. Further comments made to or about the complainant within the next 30 minutes included “dumb fuck”, “fucking loser”, “dickhead over there”, “fucking retard”.

“In addition to the inappropriate comments identified above the duty officer was heard and observed making the following statements to or about the complainant:

“stupid fucking idiot”

“make things quite clear, … if you wanna fuckin’ play up I’ll make things hard for you”

“God, he fucking stinks”

Two officers were joking about the complainant hitting his head against the cell door because he wasn’t given a blanket. One officer stating that the complainant had said he would jump in the air and land on his head killing himself. The officer then stating “go ahead, do it”. The other officer stating “make sure you do it in front of the cameras”.

After the officer established that the complainant was dialling his wife, against whom he had a domestic violence order, the officer said “get back in your fucking cell you spastic” “you’ve got a domestic violence order that says you are not allowed to contact her, you fucking wanker.

I have always enjoyed familiar talk with the local constabulary. Easy, unrestrained, unceremonious conversation is the hallmark of good communication, and shooting the breeze about sports, neighborhood scuttlebutt, off-color jokes exposed me to their finer use of the English language.

My stay in jail lasting but a short, fleeting time, but my vocabulary increased measurably, certainly much more than 12 years of schooling.

The white majority have no reason to feel like they will be dispossessed when the revolution starts.

Se avete avuto problemi con la Vostra Banca, o con lo sportello della Posta, ora avete una strada aggiuntiva per rivendicare i Vostri diritti. E’ stato infatti introdotto  l’Arbitrato Bancario Finanziario, una nuova procedura di risoluzione delle controversie che si svolgerà sotto il controllo della Banca d’Italia.

Sono soggetti alle decisioni dell’Arbitro le banche, gli intermediari iscritti negli elenchi previsti dal Testo unico bancario, gli istituti di moneta elettronica che operano in Italia, Poste italiane per le attività di Bancoposta e le banche e gli intermediari esteri che operano in Italia

E’ un sistema stragiudiziale che offre un’alternativa più semplice, rapida ed economica rispetto al ricorso al giudice. L’Arbitro è un organismo indipendente ed imparziale composto da cinque membri, di cui due nominati dalle associazioni dei consumatori e di categoria e tre dalla Banca d’Italia, che decide, in pochi mesi, chi ha ragione e chi ha torto. C’è, però, una procedura che i clienti devono rispettare: il reclamo alla banca é il primo passo; in caso di silenzio da parte della stessa o di risposta insufficiente, si può attivare il ricorso che puo’ avvenire via web, con posta elettronica certificata oppure per posta tradizionale, via fax o addirittura a mano.

Le decisioni non sono vincolanti come quelle del giudice, ma se l’intermediario non le rispetta, il suo inadempimento è reso pubblico e se il cliente non rimane soddisfatto della decisione dell’Arbitro può comunque rivolgersi al giudice.

L’Arbitro può decidere tutte le controversie che riguardano operazioni e servizi bancari e finanziari, come ad esempio i conti correnti, le carte di credito (anche revolving), i mutui, i prestiti personali fino a 100.000 euro, se il cliente chiede una somma di denaro; senza limiti di importo quando si chiede soltanto  di accertare diritti, obblighi e facoltà (ad esempio quando si lamenta la mancata consegna della documentazione di trasparenza o la mancata cancellazione di un’ipoteca dopo aver estinto un mutuo).

Non possono essere decise controversie che riguardano servizi ed attività di investimento quali la compravendita di azioni ed obbligazioni, od operazioni in strumenti derivati che sono di competenza del sistema di conciliazione ed arbitrato della Consob attraverso l’Ombudsman giurì bancario; e  nemmeno controversie di beni e servizi  quali il bene concesso in leasing o venduto mediante operazioni di credito al consumo, oppure le forniture connesse a operazioni di factoring.

Non possono essere ricomprese controversie relative ad operazioni o comportamenti anteriori al 1 gennaio 2007. Per presentare il ricorso basta versare un contributo spese di 20 euro, che viene rimborsato dall’intermediario se il ricorso è accolto.

Non si può ricorrere se è pendente una causa o un altro tipo di conciliazione. Se sarà proposta una class action, l’arbitrato è escluso se il consumatore o utente aderisce all’azione collettiva.

Dato che per il ricorso all’Arbitro non è necessaria l’assistenza di un avvocato, il cliente può essere adeguatamente assistito da un consulente indipendente, con notevole risparmio di costi ed un’assistenza tecnica più completa e puntuale.

Alla base del nuovo organismo vi è un intento semplificativo del rapporto banca-cliente soprattutto in relazione al restringimento di tempi e costi per la soluzioni delle varie questioni. Tra la domanda del risparmiatore e la decisione non dovranno passare più di sei mesi. Una vera rivoluzione se si pensa ai tempi della giustizia civile.

RWWA is in my opinion a dictatorship and aparently above the law. Its governence is disturbing to say the least. I quote from the governence.
To manage these changes, four separate Acts have been passed by parliament:

•Racing and Wagering Western Australia Act 2003
•Racing and Gambling Legislation Amendment and Repeal Act 2003
•Racing Restriction Act 2003
•Racing and Wagering Western Australia Tax Act 2003
In terms of its structure, RWWA is not:a Crown agency;

•subject to ministerial direction or the jurisdiction of the Ombudsman ; nor
•a public sector body under the Public Sector Management Act 1994

As you can read 4 acts of parliament have been passed yet a minister of the crown can give no direction. The OMBUDSMAN cannot inquire into the method of delivering penalties to ensure that the protocol of a persons rights has been adhered to. Duncan Miller has been disqualified for 12 months for carrying the whip but has his Human Rights been compromised. Who can say,the kangaroo court is obove scrutiny and seemingly answerable to nobody.
Duncan Miller a 17 year old found himself on the front and back pages of the West Australian newspaper much to the happiness of moron from the RSPCA who is delighted that this young man has lost his right to work. Richard Barry is a disgrace and so is the reporter that starts the article by telling us all that the RSPCA has welcomed a potentially career ending penalty. The RSPCA is a toothless tiger and this situation in the horse racing industry is just what it needed to grandstand and create a smokescreen for its pathetic past record. RWWA fueled the RSPCA fire and has let down to all racing industry members that can now see that RWWA is the enemy of the racing industry and will do very little to show any compassion in their zealous persuit to punish.
On page 12 of the West Australian newspaper they run a story about naming juveniles yet here is Duncan giving the full treatment and only days ago and aspiring year 12 footballer was named in this so called newspaper because he drank alcohol. Hypocracy to say the least.
So Mr Barry is going to step up his campaign to stop whipping horses and stop putting money ahead of animal welfare, very noble of you sir and while youre at it why dont you take your kids to the circus and see what they use to make an elephant stand on its front legs. But thats normal eh. I repeat you are a disgrace and a hypocrite. As for RWWA, its Kangaroo Court will continue in its Im above the law undemocratic way.

Este humilde veículo virtual (mas bem limpinho, diga-se de passagem) não se dedica apenas a olhar para dentro da maravilhosa programação aberta da TV brasileira, como também olhar para aqueles que olham a nossa TV. Nossos “colegas” nem sempre conseguem digerir as informações que chegam até eles, regurgitando ao público qualquer coisa. E convenhamos, nada que seja regurgitado é algo bom de se consumir.

Fabíola Reipert e Patrícia Kogut são jornalistas oriúndas da redação (respectivamente Folha de São Paulo e O Globo). Suas respectivas colunas, assim como o conteúdo dos jornais, migraram para a internet. Hoje, cada uma mantém o seu blog onde comentam o que acontece na telinha (e fora dela). Certamente Alex Primo definiria estes blogs como profissionais informativos e reflexivos. Ambos falam sobre sua área de atuação, trazem notícias, opiniões e críticas. Porém, como estão situados sob a tutela de grandes portais, não são blogs que visam lucro.

E as comparações acabam por aí.

Kogut é a típica chapa-branca. Profissional da Globo, com blog hospedado na Globo. Qual é o assunto predominante nos posts? Lógico que são os profissionais da emissora do finado Roberto Marinho! Na falta de pautas, entrevistas e notas com o casting do terceiro escalão da casa são publicados – ou interessa pra alguém saber a quantidade de fibras que a apresentadora da TV Globinho ingere pela manhã?  Como a TV não é só “plim-plim”, a concorrência é citada. E na maioria das vezes, de modo depreciativo.

O ponto positivo do blog é a interação com o leitor. Semanalmente, Kogut publica a opinião dos leitores sobre assuntos postados, de acordo com a nota dadas para eles. Até mesmo quando os leitores “xoxam” algo ligado à Globo, a opinião é postada. A escassez de assuntos interessantes acaba deixando o blog monótono. É praticamente um Video Show virtual – só falta o Mocotó aparecer para falar uma gracinha e a musica do Michael Jackson rolando no fundo.

Já Fabíola Reipert é a típica fofoqueira de varanda. Seus posts são, na maioria, especulativos. “Rola nos bastidores da emissora X que Fulano tem caso com outro homem”. Isso agrega em quê? Como a especulação anda ao lado da mentira, imaginem o quão constrangedor é quando a jornalista publica um post que é desmentido pela pessoa citada em seguida. Fabíola está tão acostumada que não tem o hábito de publicar erratas.  E ela erra. Muito. A colunista padece do mesmo mal que Ricardo Noblat, que prefere dar o furo a checar as informações. Porém, a fofoca também é o seu trunfo – quem não gosta de dar uma fuxicada na vida de alguém, descobrir os podres de outrém? Principalmente se o visado é aquele artista “perfeito”, que todo mundo inveja, cujas falhas lhe fariam aproximar dos pobres telespectadores mortais.

A internet mostra-se como um palco livre e novo para a produção de conteúdo. Mas cabe aos jornalistas migrantes para a nova mídia trazerem hábitos da velha mídia, como apuração jornalística e relevância. Nem sempre a história da cauda longa é aceitável. E nem sempre o povo é burro.

O I Fórum Internacional de Ouvidorias/Ombudsman/Defensores del Pueblo/Provedores de Justiça/Médiateaur de la République, que ocorrerá nos dias 10, 11 e 12 de novembro, em Brasília, foi tema da entrevista da ouvidora-geral da União, Eliana Pinto, no programa NBR Entrevista. O programa foi gravado na quarta-feira, dia 14, e tem sido veiculado desde sexta-feira, dia16, pela TV NBR, televisão a cabo – podendo ser captada também por antenas parabólicas – que noticia os atos e políticas do Governo Federal e transmite ao vivo os principais eventos governamentais. A programação é transmitida por mais de mil emissoras em todo país, públicas e privadas.

There are interludes that arise, while peering through the glass darkly, when I find myself looking back, with a faint smile and a touch of fondness, at the dark ages of real estate. You know – twenty years ago. Way back in the last millennium. It doesn’t seem that long ago. Even if it feels like it was a completely different world.

I remember a running argument I had with my Broker in those days. I wanted a fax machine for the office. I was young(er) and raring to go. I wanted to stoke the art of the deal, tilt at windmills in search of excellence, banish the snail from the mail and address for success sans the 25 cent stamp. I was ready to get down to bid-ness and negotiate the quickest path there.

A wise Old Tortoise, my Broker’s logic was impeccable. “Tom” he said, “the only way one of these fax machines is going to do us any good is if everyone gets a fax machine.”

He was right and wrong of course. A shiny new fax machine sending signals through the fiber optic lines, was worthless if there wasn’t a compatible fax on the other end to receive the overture and consummate the communication. People “stuff” in a people business was/is and should be a two-way street. In 1989, SPAM was just another 4 letter word for bad canned meat.

He did underestimate the nano-time it would take for everyone to lock down their own inner-Luddite, become enamored with all things E (Email, E-commerce, E Properties, even E Fax!) and get on the turbo-charged bandwagon to take the plunge.

And so began the not so long, not so slow, demise of some of those grand old traditions of higher real estate…. the weekly caravan bus, the cadres of couriers running around town and those clunky tumbler-style, lockboxes that rusted up whenever Agents placed them to close to an errant lawn sprinkler. (We used to carry a can of WD 40 with us to un-stick those things just so we could get into the houses.)

Remember the Realtor’s Bible? The compendium of MLS Listings that came out every two weeks and contained all the new listings? It was printed, bound and delivered like Gideon’s telephone book to the front door of all the local Brokerages. Eager Agents waited in anticipation for its arrival, like kids on Christmas Eve. Yes Virginia, there was a time when you couldn’t just strap yourselves onto a search engine and check out the new listings five times a day.

In its purest form, on its best behavior, with its clearest and most powerful voice, being a Real Estate Agent was always more about being a life transition facilitator, part mid-wife, part spirit-guide for those souls journeying on the walkabout of buying or selling a home. More this, than it ever was about selling hyped-up, widgets off the assembly line of life to people wandering onto the used-house lot to kick a few T-111 tires.

In the average residential real estate transaction, the following people or entities participate in the process: buyer, seller, buyer’s agent, seller’s agent, agents’ brokers, escrow coordinator, title researcher, escrow officer, escrow assistant, loan broker, loan assistant, loan source, underwriter, document preparer, appraiser, home inspector, termite inspector, a ton of other inspectors, the county recorder’s office.

Whose job is it to make sure that all of these people and all these things are talking and communicating to and with one another? Who connects all the little islands of information in the archipelago to make sure that the end result magically materializes at a specific moment in time and space? You know…the Close of Escrow – when the Deed is Done and the Check is Cut.

Unofficially, it has always been the Real Estate Agent’s job, whether they realized it, copped to it or stepped up to the task or not. Real Estate Agents are the only one’s in a position to see the whole of the sum of the parts. They are the only one’s who speak at least a smattering of each of the different languages that are being used. While some folks still think the Agent’s primary job is simply to find that one perfect house or that one perfect buyer, they are missing the essential role of the one right and real person, who should be acting as their trusty ombudsperson while they walk the walk.

When we all took the plunge, twenty years ago, we went from the slow dance to the slam dance. We went from nuanced choreography to the chaos of the mosh pit. And everything got more confusing in the process. More complex. Faster. Out of control. The brilliance of Moore’s Law notwithstanding, more is in many ways less. Not more better. While integrating the circuit we’ve dis-integrated the connections between heart and head and home.

And so, there are some days, some small dizzy interludes, when I find myself reaching for a can of virtual WD 40 to help me unlock the tumblers of an invisible system that is clogged in the fiber optic lines and floating out of control on the ether. Right now, I’d settle for just the fax, M’am.
