Anyway, the latest case verdict is that Prita Mulyasari has to pay punitive damage with a mind-blowing sum of Rp 204 million or $20,400. We, the people, together form a group called “Koin Keadilan untuk Prita” or “Coin For Justice”, by collecting changes to help Prita pay her dues.

Until today, donation has flow to Prita’s pocket and the sum of donation reach near Rp 1 billion or $100,000, almost 5 times the punitive damage that she has to pay.

The people have spoken and they are screaming for the freedom of speech in this nation. The riddiculous UU ITE or Information & Electronic Exchange law needs to be revised since it is a threat to the nation’s democracy practice in freedom of speech. I say a job well done for the people who participated and value the freedom of speech in the nation as the utmost priority.

Of course, after the support from every element of society regarding Prita’s case, Omni International Hospital, still wanting to save their name, caved in and held a press conference stating that they will withdraw from prosecuting Prita Mulyasari further. However, the thing is that this so-called organization didn’t apologize for their action in prosecuting Prita Mulyasari for her complaint over the internet. It’s as if they forgot that they were the group who put Prita into a traumatic situation where she was in jail for several weeks and can’t get the opportunity to see her family.

I say, if Omni International Hospital is really sorry, they have to apologize to the public for their excessive action for this kind mother. Today is Mother’s Day right? What more action it will fitting to regain the people’s trust by admitting that you have screwed up one person life and take advantage by gaining money out of it?

Anywhere, Anytime, semua obrol ucap banyak membicarakan Prita. Ada apa? Siapa Prita?

Prita Mulyasari, namanya. Seorang Ibu rumah tangga yang secara beruntun booming, mencuat namanya di berbagai media di tanah air.  Mungkin berawal dari “konsumen Adalah Raja”, Prita kemudian curhat E-mailnya mengenai keluhnya atas pelayanan RS Omni International, tempatnya berobat.  Pihak Omni lantas memandang hal yang bisa di katakan sepele ini sebagai pencemaran nama baik. yang kemudian sangat perlu di selesaikan di jalur Hukum.

Berjalanlah gugatan ini. Yang pada akhirnya mengharuskan Prita membayar sejumlah uang kepada Pihak RS Omni. Manusiawi kah??

Hmm..disinilah masyarakat menaruh penilaian masing-masing. Layakkah hanya curhat dikit tentang keluhan lantas ujung2nya pidana??Wahh..mungkin bnyak yang melihat ini lewat ambang batas, terlalu. Kalau mau disederhanakan, hal ini tidak akan menjadi masalah besar. Sekiranya kedua pihak mau dengan legowo membicarakan atas nama kekeluargaan, enjoy dan kalo perlu di warung2 kopi, informal. Tapi nyatanya??Hakim telah mengetuk Palu..Tok..tok..

Disinilah masyarakat yang tergugah, prihatin, respek menaruh sumbangsih.  Koin. Yahh, lewat koin masyarakat bersatu peduli keadilan dan kemanusiaan demi seorang Prita. Di seluruh tanah air dapat disaksikan betapa banyaknya mereka yang dengan sadar ikut melepas koin mereka. Total 850 juta !!!

Dari pelajaran ini mungkin saya melihat, masyarakat bersatu semua menjadi ringan enteng. Disinilah kekuatan kemanusiaan yang sesungguhnya. Bahwa kita semua masih terikat dalam satu kekeluargaan dan tak terkalahkan. Hmm..kata SID, jika kami bersama terus menantang di garis Depan !!!

Denger denger bu Prita mau balik nuntut ke Omni ya? adudududh Ibu!!!, Awalnya sih saya Sangat simpatik, namun celotehan seseorang kawan sebut saja String agak menyentak pemikiran. Sebelumnya sih saya agak sedih kalo tau Bu Pritanya mau majuin lagi naek jadi 1 Trilyun, Jangan lah bu! itu rumah sakit kalo perlu dibenahi ya baiknya dibenahi rame rame, Kasian orang orang yang kerja disana, bayangin yang jadi cleaning servicenya sih! yang gak tau menahu masalah malpraktiknya.

JAKARTA - Pengumpulan koin untuk Prita Mulyasari, yang diputus bersalah oleh Pengadilan Negeri (PN) Tangerang dan Pengadilan Tinggi (PT) Banten dalam kasus perdata pencemaran nama baik RS Omni Internasional, secara resmi ditutup pukul 21.00 tadi malam (14/12).

Penghitungan koin kemarin dimulai pukul 09.00. Hingga pukul 21.27, para relawan menghitung jumlah koin mencapai Rp 416.001.500. Tetapi, aktivitas penghitungan belum selesai.

Kalau dijumlah dengan sumbangan sebelumnya, dana sumbangan untuk Prita mencapai lebih dari setengah miliar rupiah (Rp 500 juta).

Sebelumnya, mantan Men­teri Perindustrian (Menperind) Fah­mi Idris menyumbang separo dari kerugian material dan immaterial yang ditetapkan PT Banten, yakni Rp 102 juta. Lantas, Dewan Perwakilan Daerah (DPD) RI menyumbang Rp 50 juta. Jadi, total dana sumbangan untuk Prita sudah mencapai Rp 568 juta.

Jumlah sumbangan akan terus bertambah. Sebab, penghitungan beberapa karung koin belum selesai. Begitu pula sumbangan koin dari daerah-daerah. ”Belum semua sampai kepada kami,” kata Yusro Muhammad Santoso, salah seorang relawan Koin untuk Prita, di markas penghitungan di Jalan Langsat 1/3a, Kramat Pela, Jakarta Selatan.

Kamis lusa (17/12) Yusro berharap agar penghitungan seluruh karung rampung. Lalu, uang itu akan diserahkan secara simbolis pada 20 Desember bertepatan dengan Hari Kesetiakawanan Sosial. Rencananya, akan ada konser akbar yang diselenggarakan sebuah majalah musik. ”Saat itu, secara simbolis uang koin akan diserahkan kepada Ibu Prita,” tutur Yusro.

Namun, para relawan malah menghadapi kesulitan baru. Me­reka sulit mencari bank yang mau menerima uang receh itu. Fa­­silitator relawan Didi Nugrahadi me­ngatakan, uang itu akan di­se­rahkan kepada Prita dalam bentuk rekening. Sebab, RS Om­ni men­cabut gugatannya.

Namun, hingga tadi malam, belum ada bank yang mau menerima. Didi sudah mendekati tiga bank besar nasional. Tetapi, me­reka kompak menolak. ”Tidak perlu saya sebut nama banknya. Mereka beralasan tidak mau dianggap berpihak pada gerakan sosial tertentu,” jelasnya.

Pengacara RS Omni Internasional kemarin (14/12) secara resmi mengajukan pencabutan gugatan perdata atas Prita Mulyasari. Itu berarti Prita dipastikan tidak perlu lagi membayar denda Rp 204 juta sesuai dengan putusan Pengadilan Tinggi (PT) Banten. Syaratnya, Prita mau menyepakati akta perdamaian. ”Pencabutan gugatan perdata ini realisasi keinginan rumah sakit untuk berdamai,” kata Risna Situmorang, pengacara RS Omni. 

Apakah saya mengenal Prita? Tidak. Lalu kenapa bersusah payah ikut menggalang pengumpulan koin untuk Prita. Apakah saya tahu penggagas gerakan koin untuk keadilan? Saya tidak tahu. Gerakan koin pertama kali saya ketahui melalui twitter dan seperti menjadi sebuah jalan buat saya dan mungkin buat yang lain juga untuk menyuarakan kekecewaan yang luar biasa atas ketidakadilan hukum di negeri tercinta.

Saya sama dengan Prita, seorang perempuan biasa yang seringkali mengalami kekecewaan dan bahkan kerugian akibat pelayanan yang buruk tidak hanya rumah sakit atau dokter, tetapi dari berbagai hal. Sebagai konsumen seringkali kebingungan bagaimana caranya mengeluh bahkan memprotes atas hal-hal yang tidak sebagaimana mestinya. Mengisi form keberatan atau melapor ke management perusahaan/ lembaga menjadi cara yang basi karena seringkali kita hanya jadi bola pingpong yang dilempar kesana kemari tanpa penyelesaian. Atau lain waktu kita bak patung yang didiamkan dan dianggap tidak penting kecuali uang kita. Apa yang dialami Prita sangat efektif untuk membungkam kita dalam diam dan menyimpan kekecewaan sendirian, karena hukum begitu menakutkan.

Belum kelar soal Prita, datang Mbok Minah. Aaaaaagggh…..saya tidak tega melihat tatapan bingung dan ketakutan simbah tua atas apa yang menimpanya. Kemudian secara bertubi-tubi muncul ke media kasus pencurian semangka, kasus satu keluarga yang dipenjara karena mencuri sisa olahan kayu untuk mempertahankan hidup, dan kasus-kasus yang lain yang membuat kita ternganga karena disatu sisi Anggodo yang bocoran sadapan teleponnya begitu menggemaskan untuk ditindaklanjuti bebas berlalu lalang tidak diapa-apakan. Atas nama hukum hati nurani pun menjadi tidak ada karena nurani tidak punya bukti.

Saya begitu bersemangat ikut menggalang koin melalui FB dan twitter karena menurut saya pribadi ini adalah cara untuk menyuarakan kekecewaan atas ketidakadilan, daripada saya marah-marah membuang sumpah serapah. Kemudian gerakan ini bergulir tanpa bisa terbendung dan membuat publik tercengang sendiri betapa luar biasa sambutan masyarakat untuk ikut serta dalam pengumpulan koin bukan hanya orang yang mampu, pengemis dan pemulung pun ikut berpartisipasi.

Ketika pada akhirnya RS Omni mencabut gugatan, bukan berarti pengumpulan koin menjadi sia-sia. Saya percaya gemerincing pengumpulan koin terdengar sampai ke ujung negeri membuat gerah dan malu hati. Dan koin itu hanyalah perlambang ketika keadilan semakin membumbung tinggi diawan, maka perlu dibumikan,direcehkan sehingga kembali terjangkau oleh semua masyarakat. Semua orang bisa berpartisipasi untuk mengumpulkan koin : pengusaha, politisi karyawan bahkan pengemis. Karena keadilan pada dasarnya untuk semua untuk pemulung juga.

Pelajaran penting bagi negeri ini, ketika hukum tidak (lagi) dapat menaungi rakyatnya bersiap-siaplah karena berkarung-karung koin akan jatuh menimpanya. Berat dan merepotkan!!

Pasca JK lengser, seperti ada yang hilang. Selain beliau sendiri memang memilih ‘menghilang’ untuk berlibur sehingga wartawan sulit mencarinya, namun suasana kenegaraan menjadi ‘tidak biasa’. Tidak ada lagi “pasukan gerak cepat” dengan slogan “lebih cepat, lebih baik”-nya. Semua seakan membeli waktu saja. Beberapa hal penting yang mendesak harus segera diselesaikan malah diperlambat.

Peran Wapres yang dipegang Boediono kembali ke zaman Orde Baru-nya Soeharto. Nyaris seperti pelengkap saja dari fungsi presiden, sehingga “nyaris tak terdengar”. Padahal, kepresidenan adalah lembaga, bukan perseorangan.

Salah satu efek melambatnya laju respon tersebut tercermin dalam kasus Prita. Dimana kita tahu ia kembali divonis bersalah oleh Pengadilan Tinggi Banten dalam perkara pencemaran nama baik RS Omni International Tangerang dan dua dokternya. Semasa JK menjabat Wapres, apalagi menjelang Pilpres, kasus ini mendapat perhatian para pejabat. Namun, kini seolah tenggelam dalam perseteruan “Cicak vs Buaya” dan kisruh Bank Century.

Walau minim perhatian pemerintah, namun masyarakat rupanya tetap memantaunya. Salah satunya justru nampak dari ramainya kunjungan ke blog ini. Justru setelah ada yang menaruh referensi link tulisan tentang Prita di kaskus.us, banyak traffic berdatangan. Hampir 300 hits per-hari sejak hari Senin lalu. Komentar-komentar pun disampaikan, hanya saja saya pasti tidak meloloskan yang berkata kasar atau menggunakan bahasa tidak sopan dalam menulis. Ini blog pribadi, bukan website portal berita, sehingga saya pun harus menjaganya karena semua isinya adalah tanggung jawab saya seorang.

Soal Prita, sama seperti persoalan Bank Century, yang  terjadi adalah adanya keterlibatan kekuatan yang dekat dengan kekuasaan. Bedanya, kalau dalam soal Prita kekuatan itu adalah swasta, sementara di Bank Century adalah individu-individu berjabatan tinggi dalam kekuasaan. Andaikata Prita menang, yang kalah hanya R.S. Omni International Tangerang dan dua dokternya. Sementara kalau kasus Bank Century dibongkar, banyak sekali pejabat yang akan terkena. Bahkan, kasus ini sudah merambat ke Menteri Keuangan Sri Mulyani Indrawati dan Wakil Presiden Boediono.

Andaikata SBY berniat memberantas korupsi, tentu ia akan membiarkan pihak mana pun mengungkapkan kebenaran. Karena bagi nalar publik, seperti pernah juga diutarakan JK, aneh bank kecil seperti Bank Century diberikan dana talangan begitu besar oleh pemerintah. Padahal, andaikata Bank Century tutup pun, tidak akan berpengaruh bagi perekonomian nasional. Saya tentu saja tahu dan sudah mencermati argumen pemerintah seperti diutarakan oleh Sri Mulyani, tapi tetap saja tidak masuk akal bagi publik awam seperti saya. Lagipula, kasus Bank Century bermula justru karena dana yang ada digelapkan oleh pemiliknya sendiri, Robert Tantular. Kerugian yang dialami Bank Century hingga terancam bangkrut bukan karena masalah pasar atau guncangan sistem perekonomian, tapi karena tindak pidana. Maka, agak aneh pemerintah musti ‘cancut tali wondo’ untuk menalangi dana bank ini yang dibawa lari si empunya sendiri.

Ini berandai-andai. Andaikata Boediono terpaksa lengser lebih cepat karena kasus Bank Century ini, akankah SBY mengajak JK kembali? Mungkin tidak, karena aturannya sulit. Mungkin akan dibiarkan tanpa Wapres seperti di masa pemerintahan Habibie. Padahal, stabilitas ekonomi dan kinerja pemerintah yang cepat dalam 5 tahun pertama masa pemerintahan SBY tidak bisa lepas dari JK. Seperti guyonan yang dilontarkan saat Pemilu, slogan SBY “Lanjutkan!” hanya akan jadi “Lanutan” tanpa JK. Artinya, kinerja pemerintah sebenarnya sulit dilanjutkan karena tidak ada lagi pejabat tinggi yang secepat JK, bahkan berani menerabas aturan birokrasi yang birokratis sekali pun.

RS Omni Internasional bersiap untuk mencabut gugatan perdata terhadap Prita Mulyasari. Prita pun tidak perlu membayar denda kalah di gugatan perdata di tingkat banding senilai Rp 204 juta.

“Prinsipnya kita sudah mempelajari draft perdamaian dari Depkes, dan kita setuju. Isi draft perdamaian itu hakekatnya saling menghargai dan memaafkan,” jelas juru bicara RS Omni Internasional Ronald melalui telepon, Rabu (9/12/2009).

Bila Prita juga setuju, draft perdamaian akan dibawa ke Pengadilan Tinggi. “Kita siap untuk mencabut gugatan dan membebaskan dari ganti rugi,” imbuhnya.

Kemudian dari klausul perdata ini akan dibawa ke Pengadilan Negeri yang menangani pidana untuk sebagai bahan pertimbangan, mengingat Prita saat ini tengah menjalani proses hukum.

“Prita belum ada reaksi, tapi pengacaranya malah datang dan menambahkan klausul agar dicabut pidana,” terangnya.

Bagaimana dengan kondisi Prita yang pernah menjalani masa penahanan di LP Tangerang karena aduan RS Omni?

“Tidak ada ganti rugi, karena pada prinsipnya sejak awal sebelum lapor polisi sudah menawarkan perdamaian dan saat itu sudah negosiasi dengan pengacara Prita, tapi karena tidak ada titik temu ya karena ini negara hukum kita lanjutkan kepada proses hukum,” terangnya.

Dukungan bagi Prita Mulyasari belum surut. Seperti diketahui, proses perdata antara Prita Mulyasari dengan RS Omni Internasional sudah diputus. Di tingkat Pengadilan Negeri Tangerang, Prita divonis membayar denda Rp 312 juta.

Vonis itu diterimanya sebelum ia mendekam di Lembaga Pemasyarakatan Wanita Tangerang pada Mei 2009. Atas putusan tingkat pertama itu, Prita lalu mengajukan banding ke Pengadilan Tinggi Banten.

Hasilnya, Prita kembali diposisikan sebagai pihak yang kalah dengan diwajibkan membayar denda Rp 204 juta. Meski nilai denda turun sekitar Rp 100 juta, Prita tetap pada posisi kalah.

Terkait vonis itu, masyarakat melakukan gerakan mengumpulkan koin untuk membantu Prita. Tercatat, beberapa tokoh juga memberikan bantuan kepada Prita.

Aksi Koin Peduli Prita merupakan bentuk protes masyarakat terhadap vonis pengadilan terhadap Prita Mulyasari. Protes itu menunjukkan buruknya pengadilan di Indonesia.

Demikian disampaikan oleh Ketua Komisi Nasional Hak Asasi Manusia (Komnas HAM), Ifdhal Kasim di Jakarta, Selasa 8 Desember 2009. “Bentuk protes ini mempermalukan pengadilan kita,” kata dia. .(dari berbagai sumber)

A very sad day today as I’ve heard how a part of democracy in my country has been shut down by the domination of big corporation with big money. I’m talking about the trial case of Prita Mulyasari vs Omni International Hospital which verdict Prita Mulyasari to be guilty of name blemishing of the Omni International Hospital.

This trial case was initially triggered by an email from Prita Mulyasari to one of her colleague complaining about the low quality that Omni International Hospital has given her. Instead of her being treated and getting better, she complained that her condition gotten worse as she also witness a false diagnose by an incompetent doctor.

That complain then goes worldwide in the internet and commented critical by the viewers. The Omni International Hospital then pressed charges to Prita Mulyasari as they claimed that their customers decreased as a direct result of Prita’s email content. Prita then was confined in a prison without any further investigation from the law enforcement while the claim from Omni International Hospital remained bias.

I have to tell you guys that Prita has to pay punitive damage in the sum of Rp 205 million or if you convert it in dollars is around $20,500. With the ITE (Information & Electronic Transaction) act which define a person can be fined or sent to jail for name blemishing, Prita was put into the guilty stance.

This is just one of those ludicrous regulations which threaten the very essence of democracy and the freedom of speech. This verdict sends the message of fear to express your opinion to the public. If the opinion is bad or disadvantageous for the person being targeted, then he can shut down the person by using this law. I say this is a law abuse which just want to get a chance to shut down information from the public knowing.

If this goes on, I’m afraid that our mass media will also be pressured and we will go back to the Monarchy of the New Order that was once led by Soeharto. Big corporate can just shut down any threatening comment against them using this law. Next, the government will select the information that we can obtained by censoring private mass media corporation.

I say, enough is enough! I’m sick of getting stomp by them and give our freedom of speech back. Your helping to Prita is essentially a voice of support in the freedom of speech. Let’s make this moment worth and may justice be served in this country! For the well-being of a democracy country which we once dream of……

I know I say this all the time for a lot of the shoots I work on but Erica’s range is nothing far from amazing, the concept behind each piece is clear in plain sight and well executed, with each piece really speaking for itself, and Anna our model despite coming straight from a viewing and been dead tired pulled of every shot and let both herself and the garments equally as powerful frame after frame, and let’s just say wasn’t afraid to get her hands dirty…

Big thanks to Erica for letting my concept to come through in the shots and having it been a little bit more collaborative than usual and letting me try some new techniques, regardless of how the shots looked these were shot in full daylight in the middle of the day and mid afternoon using a kind of light masking technique I’m trying much like they use in the twilight movies only a little different and my own creation…

If there’s one thing I do love it’s food and, as much as I love cooking I also enjoy dining out.

On Monday night I met a friend for dinner and at first we couldn’t decide where to eat.  I felt like some Chinese food so my friend suggested China, China at the Omni Centre.  Although, strangely it’s still listed as Chinois on the Omni Centre website.

The usual doorman was on the phone but another member of staff was with us immediately and seated us at a comfy table for four.  The restaurant was moderately busy and I can imagine that at the weekend it’s exceptionally busy.  My friend tells me it’s popular with hen and stag nights at the weekend.

Our waiter took our drinks order and then explained about the buffet style set-up of the restaurant.  “Help yourself,” the waiter said and went off to get our drinks.

So help ourselves we did.  My friend informed me that they now use smaller plates than before and I wondered why that was.  The idea is you can eat as much as you like so why make the plates smaller? Perhaps I should have asked a member of staff.

There is a super selection of food which would cover most peoples appetites.  Being a curry fiend I heaped that onto my first plateful and added noodles, rice and chips.  I wouldn’t normally heap all that on but it was there so I went for it, as did my friend.

The food was lovely, hot and tasty but one downfall was the rice, which was too dry.  The food does sit under heat-lamps which seems to dry the rice out too quickly.  However, mixed in with some curry sauce, it was edible.

Second trip to the buffet, a few onion rings, more chicken curry, more rice, chicken and mushrooms, vegetable spring rolls…the choice really is endless.  One other small problem is that the naming tags above the food are not always correct.  Or they don’t seem to be.  However, if you’re willing to try anything, that’s not a problem and if you’re vegetarian it’s fairly obvious what has meat content and what doesn’t.

I didn’t manage a pudding but my friend managed some ice cream.

Over all a nice meal out but at £10.99 each it is quite pricey, all you can eat yes but if you can’t eat a lot you will feel slightly done if you eat after 7pm.  Before 7pm it’s £9.99 which is still pricey and there is an earlier lunch time deal too which is probably cheaper.

However, good food, friendly and helpful staff.  The atmosphere was good and the restaurant was neither too hot or too cold which is always a concern for me.
