A Colombian indigenous leader has been shot dead outside his family home in the Colombian city of Riohacha, in the northern province of la Guajira.

Luis Alfredo Socarrás Pimienta of the Wayúu tribe was allegedly shot by a paramilitary hitman who then fled the scene. Following the murder, leaflets were distributed listing the killers’ next targets, which include the names of up to twelve Wayúu people. Socarrás Pimienta had led several demonstrations over the past year in protest against abuses of the Wayúu’s rights. His death follows the murders of ten indigenous people in la Guajira this year alone.

The Inter-American Commission on Human Rights has released a statement urging the Colombian state to investigate the killing and bring the perpetrators to justice. It also urges the state to ‘attend to the protection and security’ of indigenous rights defenders ‘to ensure that crimes such as this one do not happen again.’

More than 1,400 indigenous people have been killed in Colombia’s internal armed conflict since 2002 and an estimated 74,000 have been forcibly evicted from their homes. According to Colombia’s national indigenous organization, ONIC, at least 64 out of 102 indigenous Colombian tribes now face extinction.

Survival is supporting ONIC’s recently launched ‘extinction’ campaign to raise awareness of the critical situation faced by Colombia’s indigenous peoples.

La advertencia lanzada en noviembre del 2008 por la Coordinadora Andina de Organizaciones Indígenas, CAOI, sobre la desintegración de la Comunidad Andina (CAN) se está cumpliendo: la Unión Europea (UE) está negociando con tres de los cuatro países de la región un mal llamado “Acuerdo de Asociación” (ADA), que en realidad es un Tratado de Libre Comercio (TLC). Esto es en la práctica un golpe mortal para la CAN.

Cuando este ADA fue lanzado, la UE insistió en que la negociación se haría bloque a bloque. Sin embargo, la posición digna del gobierno boliviano (Evo Morales), que no acepta vulneraciones a la soberanía de su país ni a los derechos de sus pueblos, frente a la actitud vergonzosamente entreguista de los gobiernos de Perú (Alan García) y Colombia (Álvaro Uribe) y la inicialmente dubitativa del gobierno ecuatoriano (Rafael Correa), fueron minando este compromiso.

Finalmente, luego de marchas y contramarchas, el gobierno de Rafael Correa cedió a la tentación neoliberal y se unión a sus pares Alan García y Álvaro Uribe, en una inaceptable contradicción con un discurso aparentemente soberano.

Frente a ello, los pueblos indígenas andinos y sus organizaciones, articuladas en la CAOI:

1. Rechazamos la negociación y la firma de un TLC con la UE, sea por acuerdos regionales o por negociaciones bilaterales, porque los TLC vulneran la soberanía de nuestros países, representan el saqueo de los bienes naturales y generan una nueva forma de colonización a través de las empresas multinacionales y el capital financiero.

2. En ese contexto, rechazamos en particular la Ronda de Negociaciones del ADA UE-CAN que se realiza en Bogotá, Colombia, del 9 al 13 de este mes, de manera bilateral, dividiendo a la CAN y petardeando el proceso de integración latinoamericana, así como la ronda que se ha acordado realizar en Lima del 23 de febrero al 5 de marzo.

3. Proponemos, en cambio, una integración desde y para nuestros pueblos, que supere la visión exclusivamente comercial y garantice el Buen Vivir para todos, basado en los principios y prácticas ancestrales de complementariedad, reciprocidad y equidad entre los pueblos y con la Madre Naturaleza. Es decir:

- Integración social, cultural y política desde los pueblos.
- Armonía con la Pachamama.
- Fortalecimiento de las economías comunitarias locales.
- Consulta y consentimiento previo, informado y de buena fe, de cualquier política o inversión que afecte a las comunidades.
- Comercio internacional complementario a los esfuerzos locales, con justicia social y ambiental, respetando la diversidad de visiones de desarrollo.

4. Exigimos al presidente del Ecuador, Rafael Correa, tomar una firme decisión respecto a las negociaciones del TLC con la UE. De no hacerlo, será cómplice de Álvaro Uribe y Alan García en estos graves atentados contra la integración.

5. Demandamos a la Secretaría General de la CAN exponer y explicar el estado de este espacio de integración subregional.

6. Convocamos a los Consejos Consultivos laboral y de los pueblos indígenas de la CAN a pronunciarse sobre este grave atentado contra este organismo.

7. Emplazamos al Parlamento Europeo, Ombusdman Europeo, la izquierda y los partidos verdes de ese continente, así como a los movimientos sindicales, al Foro Social Europeo y las redes que integran Enlazando Alternativas, a definir su postura en relación a este modelo de integración neoliberal.

8. Demandamos a los gobiernos andinos que llamen a referendos o consultas nacionales para que los pueblos se pronuncien respecto a cualquier forma de acuerdo comercial. Llamamos a las organizaciones sociales del área andina a movilizarse para convocar a los referendos.

9. Exigimos a la UE que reconozca la deuda histórica social y ambiental que tiene con nuestros pueblos por los cinco siglos de colonización del Abya Yala.

Kankuamos could be an odd name even for Colombians. But it is one of the names of those indigenous communities that have stand along years as a minority, fighting to preserve its ancient American language and traditions. The end of 2008 was not properly the best for its indigenous reservation. During the traditional celebrations to receive the new year, a man who has not been identified, exploded an IM-26 bomb in the place where there was the perform of a traditional dance.

67 persons were injured and four more died in the spot. The National Organization of the Colombian Indigenous (ONIC) condemned the act and called for solidarity with the Kankuamos, an indigenous community of the northern State of César, one hour from Valledupar.

It was about 23:20 of 31rst December in Atánquez, the provincial capital of the Kankuamo reservation in Cesar. As it is traditional every year, hundred of persons from different regions of the community gathered in the spot to welcome the new year. Dances, traditional performances and other cultural activities are contemplated to preserve the identity of one of the ancient cultures of the Colombian territory.

The patio fresco, an open space for dance, was full of people when an unidentified man threw a fragmentation grenade against a mango tree. According to the witnesses, the impact in the tree minimized the mortal effect of the bomb.

Three women and a man lost their lives in the incident: Gloria Lucía Arias, 26 y.o., mother of three children; Marelvis Mindiola Díaz, 45 y.o., mother of 4 children; María Teresa Arias Caceres, 24 y.o., mother of three children and Azael Arias Pinto, 25 y.o., father of two children.

The injured persons, 67, were brought to the city of Valledupar and two of them were amputee of their feet. The indigenous community underlined that Atánquez, the capital of the indigenous reservation, has two medical centers, but there were not doctors in the place at the moment of the incident. However, the ambulance was available and several persons with car offered to bring injured people to Valledupar that is located at only one hour from Atánquez.

Several organizations and sectors of the Colombian society joined the condemnation stated by ONIC and the Kankuamos for the attack. The call for solidarity with the community has been answered also and ONIC opened an account to attend the victims. The author of the crime still under investigation.

The husband of Aida Quilcué, the Colombian indigenous leader, was killed last 16th December in Totoró, State of Cauca, south-west of Colombia, when the army shot several times to the car he himself was driving, according to reports of national media and  official and human rights organizations sources.  Edwin Legarda, 28 y.o., was the husband of the top leader of the Indigenous Regional Council of Cauca (CRIC). Few days ago, Aida Quilcué had done a report to the United Nations Human Rights Council of Geneva, denouncing the killing of several indigenous leaders in Colombia due theft of their lands. The news has caused concern to different human rights watch organizations about the safety and protection of indigenous peoples, while the government promised investigation to this incident that have different versions.

Organizations condemned the act and said that it has links to the denounces of Quilcué in the National Palace of Geneva, said Julie Gromellon of the International Federation of Human Rights.

For Eric Sottas, General Secretary of the World Organization Against Torture, it is a common event in Colombia when there are denounces of violation of human rights and he said that it shows the indifference of the Colombian government on what the international community is asking to this country related to human rights protection.

The leaders of international organizations, linked the death of indigenous leader Edwin Legarda to the exam that Colombia faced in human rights in Geneva days ago. For most of them, it was a kind of retaliation to the statements of Aida Quilcué.

“The Colombian government says that it is impacted for these things, but everything continues the same“, said Sottas to AFP and adds that the same happened when the Colombian lawyer Eduardo Umaña Mendoza spoke a decade ago in a session of the Human Rights Commission of the United Nations: he was killed in Colombia short after that. Sottas said that it is the evidence that in Colombia killings are selective and that the country seems unable to stop the violation of human rights.

Other human rights NGOs asked that the Colombian government should follow a full investigation on the matter and reminded that Colombia promised protection and prevention of selective killings of indigenous and Afro-Colombian community leaders.

Aida Quilcué, the top leader of the Indigenous Regional Council of the State of Cauca, south-west of Colombia, said that it was a premeditate plan to kill her and she made the government responsable for the death of her husband. Quilcué dennounced recently in Geneva the killing of several indigenous activists and the impunity, because illegal armed groups want the lands of the indigenous communities. She said that even if the car did not obbey a possible order to stop made by the army, it was not also a reason to open fired, because officially there is not a death penalty in Colombia. She said that it is the duty of the goverment to protect the life of the Colombians.

Soldiers of the Colombian army opened fire against a Toyota SUV at about 4:00, no far from the indigenous reserve of Legarda, according to the reports of Vicente Otero, spokesman of the Cauca Regional Indigenous Council. The official report said that Legarda did not obey the order of the authorities to stop the car and that the army had an information that the car was load with guns, then the soldiers did shot.

President Álvaro Uribe said in his statement, following military reports, that the car did not stop in two of the military roadblocks and it made the soldiers suspicious. He said that the Commander of the 3rd Division of the Colombian Army got an information that the car was bringing guns. However, President Uribe admitted that there were irregularities in the technical requirements of the military roadblocks and that he ordered strict investigations on the matter. He asked the Department of Prosecution of Colombia, the National Attorney and the High Commission for Human Rights of the United Nations, to investigate and that the government will act accordingly with their results. He asked also objectivity and said that it is necessary not to proceed against the possible innocence of the soldiers. President Uribe manifested his condolences to leader Aida Quilcué for the dead of her husband and to the indigenous communities.

By its part, the National Indigenous Organization of Colombia (ONIC), made a strong statement accusing that the incident was premeditated. ONIC declared that the soldiers shot 17 times against the car when it was going to the city of Popayán. The car was bringing medical personnel that work in a help team in Inzá municipality. Edwin Legarda, who was driving the car, got three shots and one of them in his chest. He was brought to San José Hospital in the city of Popayán, but he died there.

ONIC said that it is not true that the car did not obey orders to stop twice, as official sources stated. The cars has not impacts of shots at its back, but it has impacts in the front and in both sides, said the indigenous organization. ONIC cited also that some witnesses claimed that there were not two military roadblocks. “Anyway, even if he did not obey the order to stop, the reaction of open fire is exaggerate and it does not belong to protocols and norms and even worst when it is about a car that is protected by the Ministry of Domestic Affairs and Justice“, said ONIC in its Website. It said also that Legarda was doing humanitarian activities and it makes its death a more serious case.

ONIC made the Colombian government responsible of the death of Legarda and said that in several times President Uribe has referred to the pacific mobilizations of the indigenous communities as terrorists.

The indigenous population in Colombia is the most vulnerable to the violation of the human rights, stated ONIC, because there is ambition toward their lands. The Organization said that the death of the indigenous leader can be also a consequence of racism against the communities and the systematic elimination of their leaders.

ONIC required an immediate investigation by the national authorities to make the event clear and make justice. They asked the withdrawal of the army from the indigenous territories, because the army is not protecting the people but being a cause of fear.

A first report of the United Nations said that the death of the indigenous leader was because the military roadblock was not fully identified and the shots were indiscriminate. According to the first investigations of official of the UN among the population in the region, there were not fully identified military roadblocks and the shots were made out of what is contemplated in the rules of the Army, said the UN press release.

The UN expressed also concern that this event is one more of the numberless attacks against the life of activists of the Indigenous National Organization of Colombia, ONIC (by its acronym in Spanish.) UN asked also that this incident should not stop the current dialogue among government and indigenous leaders.

Edwin Legarda was the husband of Aida Quilcue, the representative of the Indigenous State of Cauca Council. She is one of the leaders of the marches that began last October asking justice for the killing of indigenous activists. According to the reports of the indigenous organizations, the killings are made by illegal armed groups when the indigenous claimed the lands that were stolen from them. Indigenous groups are demanding that the government return to them about 2 million hectares (4.9 million acres) of land that they claim was misappropriated, mostly by right-wing militias in the service of large landholders.

Les forces de sécurité abattent des manifestants

Les forces de sécurité colombiennes ont attaqué des manifestants indigènes, tuant plusieurs d’entre eux et en blessant plus d’une centaine.

“Les événements les plus graves ont eu lieu dans les provinces du sud-ouest du Cauca et de Valle del Cauca pour briser les manifestations durant lesquelles l’ESMAD (l’escadron anti-émeute ), l’armée et la police ont utilisé des armes à feu, des gaz lacrymogènes, des tanks, des hélicoptères et même des machettes”, a déclaré l’ONIC, l’organisation indigène de Colombie.

Douze Indiens, dont deux enfants, ont été blessés hier, lors d’une attaque des forces de sécurité.

Les manifestations qui ont lieu dans plusieurs endroits du pays, s’inscrivent dans le cadre d’un mouvement national coordonné par l’ONIC qui affirme que le gouvernement mène une politique “d’extermination” des peuples indigènes de Colombie. Les causes de ces manifestations sont nombreuses : l’abrogation d’une loi territoriale controversée, le refus du gouvernement de voter en faveur de la Déclaration des droits des peuples indigènes des Nations-Unies, l’opposition gouvernementale à la Déclaration des droits des peuples indigènes de l’Organisation des Etats d’Amériques, “le rejet et la dénonciation des politiques [du gouvernement] … et la suppression des garanties constitutionnelles dans le but de favoriser les compagnies transnationales”, “la criminalisation du mouvement indigène”, et ” le génocide et les crimes contre l’humanité”.

Ces six dernière années, l’ONIC a recensé plus de 1200 assassinats d’Indiens colombiens, 55000 déplacés et 400000 spoliés de leurs terres, soit un total de dix-huit communautés indigènes “en danger d’extinction.”

Les indigènes représentent près de 3% de la population colombienne. Leurs droits sont bafoués et ils sont trop souvent victimes du conflit armé impliquant les guérillas d’extrême-gauche, l’armée, les paramilitaires et les narcotrafiquants. L’autonomie toute relative de leurs territoires n’est pas respectée. Ainsi, plus de 1200 indigènes ont été assassinés depuis 2002 et des dizaines de milliers ont été déplacés. Beh, l’incontro è stato molto interessante: in particolare, il portavoce dell’Onic ha tracciato una panoramica molto veloce della condizione indigena, raccontandoci come e quando sia nata la necessità e con essa la spinta a costruire l’Onic (Organizzazione Nazionale Indigena Colombiana), quindi come si sia deciso e si sia creata la rete delle Organizzazioni indigene nonchè il ruolo svolto dai leader nella costituzione.

In particolare ci è sembrato interessante che nel corso dei primi anni di vita di questa rete vi sia stata la proposta del Governo di allora di una sorta di istituzionalizzazione del progetto, con la creazione di un Consiglio Indigeno: dopo alcune riflessioni i leader e le comunità hanno rifiutato la proposta, ritenendo molto più importante, funzionale e necessario come precedente storico, creare una rete indipendente, che restasse saldamente ancorata ai territori e alle comunità che li abitano.

La scelta dell’autogestione ribadita come principio fondamentale, che, solo, garantisce l’indipendenza e la partecipazione.

Confermare poi l’esistenza di una sorta di trait d’union tra tutte le lotte territoriali indigene del mondo, raccontarlo sorridendo, lasciando che, con i tempi della traduzione, l’Onic, il comitato NOExpo, le Mamme Antismog, e le fabbriche occupate argentine (Chilavert) potessero incrociare sguardi e condividere forme di lotta, autogestione ed autorganizzazione, regala ancora una piccola idea di possibile anche a questa città.

Segnaliamo, intanto, il sito dell’associazione ASUD, promotrice ed organizzatrice dell’incontro insieme alla Scighera, nonchè portavoce in Italia dell’Onic stessa e creatrice da qualche tempo del Centro di Documentazione sui conflitti ambientali del Sud del mondo (CDCA).
