Apabila keadaan berubah menjadi tidak normal, hukum dihadapkan kepada kesulitan.</p>
<p>Hari-hari ini, Indonesia berada dalam keadaan yang tak biasa. Kasus Bibit-Chandra yang rumit dan melibatkan banyak institut hukum menyebabkan penyelesaiannya secara tradisional kurang berhasil. Fakta yang terjadi sulit untuk dimasuk-masukkan begitu saja ke dalam berbagai skema penyelesaian yang sudah disediakan, seperti the criminal justice system dan lain-lain.</p>
<p>Dibutuhkan semacam terobosoan. Maka, wajar apabila Presiden Yudhoyono yang bukan ahli hukum gamang ketika harus membuat putusan dalam situasi tidak biasa sekarang ini. Takut nanti dituduh intervensi dan ini dan itu. Sebuah tim, Tim 8, pun dibentuk untuk mendampingi Presiden menghadapi tantangan itu.</p>
<p><strong>Pintu-pintu darurat hukum<br />
</strong><br />
Sebenarnya sejak awal, pembuat hukum sendiri menyadari, ia membuat hukum berdasarkan asumsi situasi yang normal. Maka, untuk mengantisipasi terjadinya keadaan yang tidak selalu normal, hukum sudah menyediakan pintu-pintu untuk keluar dari keadaan darurat itu.</p>
<p><!--more-->Contoh, diskresi dalam kepolisian. Di sini seorang polisi diberikan hak istimewa untuk tidak menerapkan hukum yang seharusnya dilakukan atas dasar pertimbangan menyelematkan keadaan. Ini banyak terjadi dalam pengaturan lalu lintas. Contoh lain adalah hal untuk menyampingkan proses hukum yang sedang berjalan (deponeering). Hak itu hanya diberikan kepada Jaksa Agung berdasarkan pertimbangan untuk menyelamatkan kepentingan bersama yang lebih besar.</p>
<p><strong>Membuat dan mematahkan</strong></p>
<p>Dari uraian itu, ternyata pekerjaan hukum tidak hanya melakukan rule making (membuat dan menjalankan), tetapi sesekali – dalam keadaan tertentu – juga melakukan rule breaking (terobosan). Contoh tentang “pintu-pintu darurat” itu adalah di mana hukum melakukan terobosan terhadap peraturan, doktrin, dan lain-lain yang dibuatnya sendiri.</p>
<p>Dari aturan itu kita juga belajar, yang namanya hukum tidak selalu membuat suasana yang penuh ketertiban dan keteraturan (order), tetapi juga ketidakaturan (disorder). Di sisini hukum menyadari kekurangannya sehingga menyediakan berbagai mekanisme untuk menyelamatkan eksistensinya. Kalau sudah begini, kita harus mengatakan, yang teratur dan tidak teratur itu sama-sama ada dan berkelindan dalam hukum.</p>
<p>Terkait permasalahan luar biasa yang sedang dihadapi hukum di Indonesia, disarankan untuk tidak ragu-ragu mengambil langkah-langkah progresif. Hukum progresif adalah hukum yang membebaskan kita dari “belenggu kerangkeng hukum.”  Kita memang membutuhkan hukum, tetapi jangan sampai terjadi hukum itu justeru membelenggu kita.</p>
<p><strong>Belajar dari AS</strong></p>
<p>Amerika Serikat memberi contoh yang baik bagi kita tentang bagaimana membebaskan diri dari tradisi berhukum yang dirasakan membelenggu dinamika sosial yang berjalan. Dalam sejarah tercatat, pada suatu kurun waktu tertentu, AS bekerja keras membangun negerinya untuk menjadi negara modern.  Saat itu, berbagai praktik hukum dilakukan huna mendukung AS yang sedang bergerak dinamis. Apa pun dilakukan, bahkan kalau perlu prinsip, doktrin yang berkualitas universal, dipinggirkan. Saat itu Mahkamah Agung AS membuat berbagai putusan monumental utnuk membantu pembangunan AS, bahkan dengan cara-cara rule breaking (baca : menerobos) sekali pun.</p>
<p>Jika di dunia ada doktrin universal Trias Politica yang membuat pembatasan ketat antara legislatif, eksekutif, dan yudikatif, demi kepentingan AS yang sedang membangun, doktrin besar itu dipatahkan. Dicontohkan bagaimana pengadilan membuat berbagai putusan, seolah duduk di kursi eksekutif (government by the judiciary).</p>
<p>Tentu saja, komunitas hukum dunia menjadi amat gusar. Namun, jawaban apa yang dilontarkan Negeri Paman Sam ? AS dengan gagah mengatakan, “ this is American development “  dan “ this is the American concept of law “.</p>
<p><strong>Hukum progresif</strong></p>
<p>Selama ini kita adalah murid-murid yang baik dan patuh terhadap cara berhukum yang umum digunakan bangsa-bangsa di dunia, termasuk asasnya, doktrin-doktrinnya. Tanpa disadari, kita telah membelenggu diri sendiri dengan menganggap bahwa kitatidak dapat keluar dari praksis yang sudah dipersepsikan sebagai berhukum secara universal.</p>
<p>Gagasan progresif diharapkan dapat membantu kita keluar dari kungkungan cara berhukum yang sudah dianggap baku. Di sini, hukum progresif membebaskan kita dari cara berhukum yang selama ini dijalankan.</p>
<p>Sudahlah, semua konflik yang terjadi dalam ranah hukum mulai saat ini harus kita hentikan. Tertalu mahal apabila kepentingan yang lebih besarm yaitu membangun dan menyejahterakan bangsa, harus dibayar dengan pengurasan energi untuk menyelesaikan kemelut hukum yang sedang terjadi.</p>
<p>Mulai sekarang kita dorong sepenuhnya agar Presiden sebagai kepala negara tidak ragu mengambil alih komando penyelesaian kemelut hukum yang sedang terjadi demi kepentingan bangsa yang lebih besar. Penyampingan terhadap doktrin, praksis hukum tradisional, dan lain-lain, kalau itu ada, kita pikirkan nanti.</p>
<p>Mudah-mudahan, di belakang hari nanti, kita berhasil membantu suatu teori hukum Indonesia yang memberikan pertanggungjawaban terhadap apa yang kita lakukan sekarang.<br />

<p>That’s something I read somewhere and it made me feel pretty good in my everyday chaos. Some people want their every day to be in perfect order. They write to-do-lists about everything,  they plan the whole day from morning till night. Control freaks is a word for those people. The opposite must be a chaos freak – a me. My home is a chaos. My every day is a chaos. My whole life is a chaos. But the thing is that I have allways felt good about living in my chaos. Well, it sometimes happens that I start thinking that maybe it would be smart – just a little – to make some sort of order in my chaos. And when – about once a year – I try to find order, then, POOF! something unexpected pops up. And I go back to my world of chaos.</p>
<p>And the point is that you can’t control life. No matter how much order you keep on your desktop, no matter how well organized your drawer is, no matter how well you plan your day and no matter how many to-do-lists you write for your life, life allways ends up surprising you with unexpected events.</p>
<p>And thus! you can choose one of two ways to go.</p>
<p>1. You can choose to keep on trying to get control of everything in your life.</p>
<p>2. You can choose to kiss your chaos – accept it… even learn to love it.</p>
<p>If you choose number 1, you will – sooner or later – end up on valium or even worse. Because, since life is a thing you can’t control, a real control freak will just have to go nuts trying to do so.</p>
<p>If you choose number 2, you will find out – like I did – that your life, everyday of it, is a matter of chaos, a mess,  no order at all,  not even in your drawer. But – on the other hand – you have not a single moment of stress in you every day since you allready know disasters will happen, you expect them to happen, you even say HELLO and WELCOME when chaos arrives.</p>
<p>So I’ll just repeat now:</p>
<p>Kiss your chaos, life is a mess anyways</p>

<content:encoded><![CDATA[<div class='snap_preview'><p align="justify"><font size="3" face="Calibri">As readers of this Blog would know, I have been reading ‘The Reformers and Their Stepchildren,’ by Leonard Verduin. I have now completed this book and maintain that this is a book that should be read by all Reformed believers. It is a brilliant treatment of both the Reformers and those who sought a more ‘radical’ reform, in order to bring the church back to that which was modelled on the New Testament example.</font></p>
<p align="justify"><font size="3" face="Calibri">Verduin deals with many of the disputed areas between the Reformers and the Stepchildren, and in so doing shows how the Reformers chose to go only so far in their work of reformation and indeed how some chose to back peddle in some areas. As much as I respect many of the Reformers (if not all), I have always been saddened by their refusal to fully reform the church/separate from it, and to set up a church based on the New Testament model, which was something the stepchildren also sought. The Reformers treatment of the stepchildren will always be a blight on their legacy also.</font></p>
<p align="justify"><font size="3" face="Calibri">Read this book without being biased either way and allow the truth of the Scriptures to determine the path on which you walk. There is much food for thought in this book and a real challenge for Reformed believers throughout.</font></p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Clearly, strategic planning is no panacea. Strategic planning is simply a set of concepts, procedures, and tools designed to help leaders, managers, and planners think and act strategically. Used in wise and skillful ways by a “coalition of the willing,” strategic planning can help organizations focus on producing effective decisions and actions that further the organization’s mission, meet in mandates, and satisfy key stakeholders. But strategic planning is not a substitute for strategic thinking and acting. Only caring and committed people can do that. And when used thoughtlessly, strategic planning can actually drive out precisely the kind of strategic thought and action it is supposed to promote.</p>
<p>Furthermore, strategic planning is not a substitute for leadership. There is simply no substitute for leadership when it comes to using strategic planning to enhance organizational performance. At least some key decision makers and process champions must be committed to the strategic planning process, or any attempts to use it are bound to fail.</p>
<p>In addition, strategic planning is not synonymous with creating an organizational strategy. Organizational strategies have numerous sources, both planned and unplanned. Strategic planning is likely to result in statement of organizational intentions, but what is realized in practice will be some combination of what is intended and what emerges along the way. Strategic planning can help organizations develop and implement effective strategies, but they should also remain open to unforeseen opportunities. Too much attention to strategic planning and excessive reverence for strategic plans can build organizations to other unplanned and unexpected—yet incredibly useful—sources of information, insight, and action.</p>
<p>The discipline necessary for strategic planning can be of two sorts. The first harkens back to Latin root of the word “discipline,” emphasizing instruction, training, education, and learning. The second embodies later interpretations of the word, emphasizing order, control, and punishment. Emphasis should be placed on education and learning, although there clearly are occasions when imposing order, taking control, and enforcing appropriate sanctions are appropriate. Certainly, key leaders, managers, and planners can best use strategic planning as an educational and learning tool, to help them figure out what is really important and what should be done about it. Sometimes this means following a particular sequence of steps and preparing formal strategic plans, but not necessarily. The ultimate goal of strategic planning should not be a rigid adherence to a particular process or an instance on the production of plans. Instead, strategic planning should promote wise strategic thought and action on behalf of an organization and its key stakeholders. What steps to follow, in what sequence, and whether or not to prepare formal plans are subsidiary concerns.</p>

<p> I have spent a considerable amount of time in the past year watching the decline and fall of the newspaper empire. At times I have had a ‘you get what you pay for’ take on the situation while at others I find it sad that an important industry is in a rapid downward spiral. Now add to the mix the musings / rantings of Rupert Murdoch and his thought that he can revive his industry through his proposed tactics and you are close to a three ring circus with all clowns and no ringmaster.</p>
<p> You see, when I get the most value out of a newspaper it really has nothing to do with the hard news. In fact, I have already heard most of the news that I care about before a newspaper gets my fingers dirty (which I think is one of the cool things about newspapers because there are fewer tactile experiences in the online world). What I devour though in the newspaper is any investigative reporting. Anything that took time to compile and either promotes someone doing good or exposes someone doing bad. That’s one place where the printed ‘news’ works well. There could be others as well.</p>
<p> I would like to propose some possible solutions / options for newspapers to consider.</p>
<p> Let hard news ‘reporting’ be online and embrace it. The Internet is becoming a more real time medium and the printed word will not be able to compete. As a result, I would love to see in a newspaper a 4-6 page section that is just chock full of snip-its about news items. Just the facts. No opinions. Just a strong aggregation of the high points and no one’s opinion attached. Let me decide what to do next after you have gathered it up for me. Stop telling me what to think.Tell me what you think but don’t force me to think it. Now I am not suggesting that you go the Newsweek route and just have all op-eds all the time because quite frankly I hate that format. It’s arrogant and it is designed to divide and conquer. We have enough divisiveness in this world. What if you just had a strong stable of consistent op-ed type players who clearly identify where there allegiance is and then provide that content for their audience as the other side of the ‘news’. If I don’t like one or the other then I either don’t read it or, even better, I read it to be better informed. Present both sides of arguments REGULARLY as part of your format rather than trying to look balanced by occasionally bringing in someone from the other side as a sacrificial lamb for your readers to offer up to their ideological god.Be truly balanced. Stop taking sides for goodness sake. This Washington Post v Washington Times, right v. left crap is just that. Crap. I would LOVE to see a newspaper talk evenly about both sides of the same coin. That would take guts but I think there is a real market for it. I would read that one for sure.Recognize the real audience. The printed word is more for the thinker, the ponderer (I made that word up so sue me) and the person who wants to digest the news. Online is for the ADHD world we live in of ‘read and reject’ and ‘consume and dsipose’. The quick hit. The surface player. Let the online world serve the ‘real-timers’ and you serve the thinkers. Since an investigative technique takes time to put together there won’t be the ‘it’s old news before the ink hits the paper’ issue.Make a difference. As I stated earlier I think that a newspaper that was out there uncovering the good, the bad and the ugly of the world with long-term investigative pieces that dig deep and create change and impact would be awesome. You would have less staff because you were not concentrating on the minutiae of each insignificant story. Leave that to the online quick hit environment. Be a true change agent. I would pay for that and I think advertisers would to.Embrace bloggers and tweeters. Rather than view the real time nature of the web as a threat and somehow ‘beneath your standards’ embrace it for your readers and help them sift through it. What if you put yourself in the position of telling your dedicated readers that “we trust this or that blog” because of the following reasons. That would be cool. Bloggers would then be a much different animal if your could have a frienemy or co-opetition like relationship rather than a completely adversarial one.Let the engines index your content. This one’s easy. Don’t be an idiot.Stop playing political games. You report news not set public opinion. When you choose sides you actually lose credibility. That’s not reporting that is campaigning.
<p> As always there is more and I would love to hear your thoughts. If there is a paper that is doing some or all of these please let me know. Where else could newspapers evolve and take full advantage of the new world media order rather than act like there is a way to preserve their no longer relevant status quo?</p>

The nuts and bolts of the story is this. The goal of the Copenhagen conference is to collectively gather up the nations of the world into one big happy family under the auspices of green house emissions and carbon tax. In other words because we use 25% of the world&#8217;s energy we would be taxed and our wealth would be redistributed to poorer nations. How do you spell communism? It would appear that the New World Oder may be birthed at Copenhagen. While the antics of morons who masquerade as musicians, at the AME awards caught the media&#8217;s attention, and provide a distraction, we are faced with some very disturbing developments that may create a future world that we won&#8217;t recognize. The video link below is well worth watching as Lord Monckton gives a riveting explanation as to what we are about to face. It would appear that we now understand the media hype and the slobbering love affair that accompanied Obama&#8217;s campaign. He is a socialist and wants to redistribute wealth. He is a junior Senator with one term and he&#8217;s awarded the Nobel peace prize for what? I think that his election was a set up &#8211; we&#8217;ve been duped! The Copenhagen treaty could spell the end of America as we know it!</p>

<p>Of  course there are forces that are puling in the other direction. I speak of the recent outing that the science behind global warming is junk science, and that data was manipulated to attain the desired results. So that being said, this makes the entire premise behind Copenhagen fall of its own weight. <p>The bottom line is this, and once again I turn to the supernatural guide-book for the answer. We are told that in the last days there is going to be a one world government. Now when that was written about 2000 years ago it certainly seemed like the ravings of a mad man, to those who don&#8217;t grasp that when the God of the universe declares a thing before it happens you can bet your bottom dollar that it will come to pass, even if it takes a couple of thousand years to do so! We are told that this global government would be one of the signs of the last days. The last days mean this, that there will be a point where history as we know it will end and a theocracy will be set up. The rightful king will return &#8211; think Jesus here &#8211; and men will beat there spears into plowshares? Isn&#8217;t that the phrase that hangs above the U.N.? Unlike the enervated U.N. world peace will actually happen, but before it does we will see the tyranny of a one world government system along with the nefarious mark of the beast and the rise of the antichrist.</p>
<p>Meanwhile, I look forward to spending some time with my wife and kids this Thanksgiving. I&#8217;m grateful for my freedom, the blessings I have and the many friends and acquaintances that impact my life. Happy Thanksgiving to all!</p>

<p>So, one night I place an order with PJ&#8217;s &#8211; of course &#8211; and when they brought the pizza there was a tag on the side with the information: what kind of pizza it was, when the order was called in and who prepared it. Where they list the name, however, I&#8217;m pretty sure they only have space for a few of the letters of the person&#8217;s name, which brings me to the discovery&#8230;.</p>
<p>Who prepared it? Well according to the information on the tag&#8230;<br />
&#8220;Your order was prepared by Christ.&#8221;</p>
<p>My thoughts?<br />

The pressing question is how should our growing understanding of complexity influence the content and organization of curriculum. So many things to say but such a restrictive space to assemble them into.<br />
The halls are quiet here but did run into a former student majoring in social justice. Perhaps I&#8217;ll start with Dewey&#8230;</p>

Makes for a quiet study space when all you can here is distant doors and the sound of the heaters circulating the air. SO one way to measure complexity is by looking at how something, like curriculum is organized/ ordered. A patterned and predictable order with clear hierarchy and rules for relationships has no complexity. Neither does a completely random collection with relationships between the parts that are not predictable and have not apparent pattern. Complexity lies between the two. In cognition complexity is measured by the patterns of firing of neurons in the brain. Highly ordered sensory events are matched by highly ordered patterns of firing.  Spontaneous and random sensory events are evidenced by different patterns reflecting the brains general pattern for dealing with novelty.</p>
<p>In between lies how the brain deals with complexity. Now, if I can just link these ideas to the curriculum imperative.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Members of the “Los Zetas” not only supply drugs to mid-level drug dealers or ‘narcomenudistas’, of Tepito, but also arms for their gunmen. According to <em>La Reforma</em> citing a report from the Intelligence Agency of the Office of Justice of Mexico City, the group known as the Cártel of Tepito is linked to different groups of “Los Zetas” who are established throughout Mexico City in order to control the distribution of marijuana and cocaine. The investigation reveals that weapons such as the “police killers”, a pistol or a sub caliber .40, which had been used various executions in Barrio Bravo and surrounding areas, are lent to gunmen at rates that rise as from $1,500 to $5,000 pesos. The weapons are lent per event, based on the time it takes to perform the task for which they were rented.</p>
<p>Likewise, some of the motorcycles used by the gunmen to carry out the murders are rented, mainly the Yamaha BWS, the model that has most often appeared in preliminary investigations related to executions.</p>
<p>According to intelligence information, the gunmen of Tepito carry out jobs for “Los Zetas”, and to perform just one homicide they charge $30,000 to $300,000 pesos, depending on the “target”. A commander of the Investigative Police claimed they had a very efficient organization based on their access to weapons used by groups of the elite army of police forces. He also made the statement, “The latest deaths we have had were carried out by a caliber .40; we have found in those events more than 15 and up to 20 cartridges, which means that it’s a glock [weapons manufacturer] type of pistol, holding 18 cartridges, including expansives, that enables us to understand that it’s another type of execution more similar to the mafia or the ‘maña’”.</p>
<p>According to the reports given from the Attorney General of Justice in Mexico City, the weapons investigated relate to the gang, “El Muerto”, who are dedicated to drug distribution. Just this past week a suspected drug distributor in the zone, Ricardo Castañeda Cruz, was shot and killed. At the crime scene there were more than 20 bullet shells from a caliber 9 and .40 mm, according to the investigation FCH/CUH-3/T2/1300 / 09.11.</p>
<p>According to <em>La Reforma</em>, the rent of weapons occurs through intermediaries; the boss of any gang is the one who has “contacts”, to one who administers the rent of weapons and who orders and gives the weaponry to his gunmen. This individual may or may not be part of the gang; the gunmen are interchangeable and act as substitutes. Also, there is a level of hierarchy as a future gunman can start as a guardsman at the executions, and after he can drive the motorcycles used in the homicides, until he finally becomes the one to pull the trigger.</p>
