Tad nu tā. Nedēļa tuvojas beigām, kas nozīmē, ka kaut kas ir jāieraksta arī blogā.

Nu tad par visu pakāpeniski. Nedēļas sākumā turpināju apmeklēt lāzerterapijas plaušām, šoreiz saprotot arī to jēgu un nozīme, manas veselības uzlabošanā. Otrdien vēl pie reizes izlūdzos atļauju aiziet pamētāt uz treniņu. Rokas vienkārši bezspēcīgas pēc šīs gadrīz mēneša nekā nedarīšanas, elpošana arī nekāda. Treniņa sākumā uztaisījām nelielu metienu precizitātes konkursiņu. Šoreiz komandas pirmo vārtsargu sanāca sarūgtināt visas 6 reizes. 100% realizācija pat man bija neliels pārsteigums.

Līdz trešdienas vakaram noskatījos visas sakrājušās filmas un daļu no seriāliem. Īpaši patika TOP GEAR jaunākā sērija. Vēl paspēju uzdurties internetā uz šeit publicētās bildes ar uzticamākajiem FK Rīgas faniem

Ceturtdienas rīts sākās ļoti agri, taču par laimi skolā bija jāiet vien uz pāris stundām, jo tā jau īsajā dienā nenotika arī krievu valoda. Mums īpaši garajā starpbrīdī nolēmām doties uz Čili Picu, taču skolas dežurante paziņoja, ka pēc jaunajiem noteikumiem mūs nedrīkst laist ārā. p.s. es gan neesmu tos parakstījis Nācās doties pie skolotājas un lūgt rakstisku atļauju. Kad saņēmām to, tad mierīgi devāmies pusdienās.

Pēc stundām bijām saorganizējuši tādu kā mini tweetup @forumcinemas.lv . Ar @PienaZupa un @daenne aizgājām uz “Mākoņains, iespējams kotlešu lietus” 3D. Dažviet pat ļoti smieklīga multene, vismaz 1. skatīšanās reizē tā likās. Pēc tam gan nepaspēju uz vilcienu un mājup ceļu nācās atlikt uz 40 minūtēm.

Atgriešanās skolas solā atkal atgrieza tos smieklus par dažādajiem jokiem, kāršu spēli kā arī daudz ko citu vērtīgu, pēc kā tik ļoti biju noilgojies.

Gluži nemanot atgriezies arī SLINKUMS, kurš traucē mācību darbu, un it īpaši grāmatu lasīšanu, kas nākamnedēļ būs jāpārvērš vairākās recenzijās.

Piektdien vēl biju aizgājis iečekot Triobet Florbola Līgas spēli starp FK Rīga un RTU. Bija smieklīgi skatīties, kā FK Rīgas spēlētāji kaitina pretiniekus pirmajā periodā speciāli raidot bumbiņu prom no savas laukuma puses, un sagaidot pretiniekus ar zonas aizsardzību. Šoreiz uzvarēja RTU, nākamā šo komandu savstarpējā spēle 4. decembrī, OSC.

Omnia: i lavoratori e presidiano la sede “lucchettata”

«Con la presente, Le comunichiamo che a decorrere dal 16 novembre 2009, Ella è dispensata dal prestare la propria opera e dal presentarsi presso la sede Omnia Service Center di Ivrea in via Montenavale 1, con corresponsione della normale retribuzione».

E´ questo il testo della “dispensa dalla presenza in azienda” che si sono visti recapitare (come raccomandata) i dipendenti eporediesi di Omnia alla fine della scorsa settimana.

Ma quella che sembrava già una mossa di chiusura alle trattative da parte aziendale, era in effetti solo una parte di una azione ancora più netta: infatti i lavoratori che ieri, nonostante la raccomandata, hanno deciso di recarsi ugualmente nei loro uffici hanno trovato le porte chiuse con dei lucchetti: «In pratica una serrata dell´azienda» è stato il commento di Lino Malerba di Fiom Cgil.

Già sabato scorso Luca Basilicata, uno dei destinatari della “dispensa”, a nome anche dei colleghi aveva girato il testo della missiva aziendale agli organi di stampa, preannunciando: «Da lunedì ci mobiliteremo e ogni giorno organizzeremo in città qualcosa di diverso. Se entro il 15 dicembre non ci sarà una soluzione… preparatevi a grosse sorprese».

E la prima iniziativa è scaturita spontanea di fronte a quelle porte bloccate: i dipendenti Omnia hanno immediatamente dato vita a un presidio proprio di fronte a quei lucchetti.

«Abbiamo immediatamente fatto presente all´azienda che il suo atteggiamento era inaccettabile – ha raccontato Malerba -, anche perché all´interno dei locali erano rimasti gli effetti personali delle persone che vi lavoravano.
Verso le 14 un incaricato aziendale è arrivato da Torino per aprire le porte. E i dipendenti, una volta entrati in quelli che erano i loro uffici, hanno deciso di non uscire più e dare immediatamente il via a un´assemblea permanente.

Sul fronte della vertenza sindacale, intanto, due sono le direttrici d’azione. Da una parte ci sono le iniziative dei lavoratori eporediesi che già oggi, verso le 9.30, si ritroveranno sotto il palazzo della Provincia di Torino in via Maria Vittoria per un presidio in contemporanea all´incontro tra l’assessore alle attività produttive Carlo Chiama e i sindacati.

A questo proposito è utile ricordare come in più occasioni i lavoratori abbiano tenuto a ricordare alla Provincia le proprie responsabilità in questa crisi. Nel messaggio di posta elettronica inviato lo scorso sabato Basilicata scrive: «Ovviamente stiamo ancora aspettando che la Provincia si faccia carico di noi 38 dipendenti, visto che è responsabile di questo danno. Ricordo a tutti il fallimento del Polo della Pubblica Amministrazione. (noi dovevamo fare parte di quel progetto). E come sempre accade in Italia, i danni della Politica li paghiamo sempre e solo noi».

Sul versante nazionale, intanto ieri si è svolto al ministero dello sviluppo economico un nuovo incontro tra sindacati e vertici aziendali. Ma durante questa ennesima riunione non si è ancora arrivati ad avere indicazioni chiare sul futuro dell´azienda. I sindacati lamentano come non sia ancora chiaro se vi sarà una ricapitalizzazione o meno. «Qui abbiamo la vertenza per i licenziamenti alla sede di Ivrea – è stato il commento di Malerba -, ma il vero rischio è che tutta l´azienda alla fine faccia il “botto”!».

L´unica novità emersa è che Omnia Service Center sarebbe nuovamente passata di mano. Dopo la cessione di qualche mese fa, con l´acquisto da parte di dirigenti Omnia, sarebbe ora diventata proprietà di Voicity, una Holding che dovrebbe procedere alla ricapitalizzazione grazie a un socio finanziario, la East Investment. Ma le modalità e le tempistiche non sono ancora chiare.

Proprio in ragione di queste novità nel livello nazionale della crisi i sindacati locali avrebbero chiesto all´azienda la sospensione della mobilità, ma nessuna risposta è per ora giunta.

«Dopo la lettera di dispensa dal lavoro – ci scrive Luca Basilicata -, ecco l’ennesima “porcata” che ha fatto l’Azienda Omnia Service center nei nostri confronti. All’Ingresso della porta principale della sede hanno pensato bene di mettere due luchetti da bicicletta per evitare che noi “poveri dipendenti” andassimo a rubare i computer “da quattro soldi” che occupano le nostre
scrivanie».

«Dopo numerosi solleciti – continua Basilicata -(compresa la telefonata che ha fatto il Sindaco di Ivrea davanti a noi dipendenti) si presenta verso le 12 tale Yvette Rechichi, responsabile del personale di Torino/Ivrea per rimuovere
i lucchetti dall’ingresso principale»

So my launchpad is not here yet. It seems it’s in store worldwide from 2 Nov, except Italy. Maybe Italy it’s not part of the world, or Novation is not from this world. By the way, I’m so excited about this device that I can’t stop my compulsive need to look around for it and its applications. So, here we go with my favourites!

Nonome, the Monome emulator

With all the protocol under the sun, it was just a matter of days. And infact Peter at Create Digital Music informs us that Piclae made ( and it’s currently updating quite often ) a cool Monome emulator for the Launchpad. It seems most apps run smootly ( the major problem seems to be 7up ), and you can choose your favourite colour too! And if you’re guessing it, yes, you can keep your Ableton modes while using it!

OSC Wrapper, programming made easy

This is my favourite one! It’s a simple app by Will Crossland which translates the MIDI communication with the Launchpad into OSC. So, the 12 pages of  the protocol are reduced to 2 simple messages, /press and /led! The program lets you use 8 different “layers” to address 8 applications for each Launchpad. And yes, yes… you keep your out-of-the-box Ableton modes too! The application is made in Max/MSP, but only for the communication’s buses. All the code is placed inside a Javascript file, which everyone can modify to his needs. Cool stuff, cool stuff.

The nice part is that Will decided to use the approach of monome’s protocol due to its logical simplicity:

“The Monome OSC protocol is clearly well thought and well suited to addressing a 2D grid so why reinvent the wheel?”

I can’t agree more. And it would be cool to have a unified protocol for every grid controller! It seems like Monome’s users don’t like the Launchpad too much, but I think that both devices ( and think of Livid Instruments’ Block and Ohm64, too ) are simply different forms of the same concept. Monome’s succesful work is about faith in a concept that big names rejected at first. I personally don’t think a grid of back-lit buttons is any kind of invenction you can patent, and that talking about “stolen ideas” is inappropriate in this context. Concepts belong to people who are using that stuff, the wonderful community behind Monome for example. Now the family is extended, and I’ll be happy to see a common language, and people sharing their work, in the name of a common evolution. Will’s choice seems a good start in this direction!

Custom Max controller and Max4Live porting of  Monome’s apps is ispiring

Surfin’ around YouTube brought me to this Max/MSP application which makes the Launchpad a custom controller! I can’t understand exactly the features, I don’t understand the language, but it seems he made pages of presets’ grids mixed with slider controllers, which makes sense in many ways, like if your using it with your favourite synthesizer or for some kind of experimental generative application!

And you know, Max4Live public beta is started and people are having fun! So check out these Max4Live ports of Polygome and StepFilter by Stretta! It will not be difficult to adapt these to the Launchpad, expecially now that we have our OSC wrapper!

Second in Radius series.

The procedure for modification of California child custody and visitation orders is to file and serve an Order to Show Cause to modify the child custody and/or visitation orders.

In part one of this blog post it was noted that the party seeking a modification of child custody must make a showing of changed circumstances. However, there are exceptions to this rule.

The changed circumstances rule is triggered only after a “final” or  “permanent” custody adjudication. The ordinary best interest standard, without the additional changed circumstances burden of proof, applies when the court makes an initial custody adjudication and when it adjudicates custody following any temporary or interim custody order. Montenegro v. Diaz (2001) 26 Cal.4th 249, 256,  257; Marriage of Burgess (1996) 13 Cal. 4th 25, 29, 37.

So as not to discourage parties from entering into custody stipulations, ambiguities about whether the parties intended a stipulated custody order to be a “final” or “permanent” custody adjudication will be resolved against finality and thus against application of the changed circumstances rule in subsequent proceedings to modify the stipulated order. All indication is that, where the issue is disputed, a stipulated order will be deemed to be temporary or interim in nature unless it clearly states it is a final judgment as to custody or words to that effect.  See Montenegro v. Diaz, supra, 26 Cal. 4th at 259, neither underlying stipulations nor court’s minute order contained “clear, affirmative indication” that parties intended stipulated orders to be final judicial custody determinations;  Marriage of Rose & Richardson (2002) 102 Cal. App. 4th 941, 952, (citing text).

A stipulated dissolution judgment awarded the parties’ joint legal custody, mother “primary physical custody” and father “reasonable visitation.” The judgment also recited, however, that “in the event the parties are unable to resolve their custody and visitation issues, they shall agree upon a therapist or counselor to assist them If after meeting with a therapist or counselor, the parties remain unable to resolve their differences, they shall make an appointment with the Conciliation Court prior to either party filing a request with the Court for a hearing on the issue.” Despite other boilerplate language in the judgment stating it was intended to be a final settlement of the parties’ rights and obligations, there was no “clear, affirmative indication” that they intended the stipulated custody provision to be a final judicial custody determination. Quite the contrary, the stipulated language warranted “the opposite conclusion the parents disagreed and were attempting to resolve the custody and visitation issues.” Marriage of Rose & Richardson, supra, 102 Cal. App 4th at 951, 952.

As to physical custody, the changed circumstances rule applies when the modification request seeks to remove custody from one parent and give it to the other. By contrast, no change of circumstances need be shown as a prerequisite to altering only the coparenting schedule (the amount of time the child spends in each parent’s household) under a joint custody order. Proposed changes in parenting time are “not on a par with a request to change physical custody from sole to joint custody, or vice versa”; the only standard the moving parent must meet in such cases is the child’s best interest. Enrique M. v. Angelina V. (2004) 121 Cal. App. 4th 1371, 1379, 1380;  Marriage of Birnbaum (1989) 211 Cal. App. 3d 1508, 1513.

So long as the joint custody award itself is not being changed, the court has very broad discretion to revise the “coparenting residential arrangement” where the parents are unable to agree and call upon the court to intervene. Marriage of Birnbaum, supra, 211 Cal. App. 3d at 1518.

And the changed circumstances rule does not apply when a parent requests only a modification of the visitation arrangement (whether in a joint custody or sole custody situation). Because such a modification does not change “custody,” the trial court considers a visitation modification solely under the child’s best interests standard.  Marriage of Lucio (2008) 161 Cal. App. 4th 1068, 1077 1080, (citing text) (collecting cases) noncustodial parent who had supervised visitation not required to show changed circumstances in support of request for unmonitored visits and additional visitation time not amounting to “de facto joint custody”.

The procedure for modification of California child custody and visitation orders is to file and serve an Order to Show Cause to modify the child custody and/or visitation orders.  Several statutes and cases outline the standards used and the burden of proof on the moving party.

Child custody and visitation orders generally are modifiable throughout the child’s minority whenever the court finds a modification is “necessary or proper” in the child’s best interests.  See Family Code § 3022.

To put it another way, in child custody/visitation matters (just as with child support,) the family law court has continuing jurisdiction and the matter thus remains pending even after entry of the underlying dissolution (or legal separation or nullity) judgment.  Marriage of Kreiss (2004) 122 Cal.App. 4th 1082, 1085.

Although the statutes governing custody adjudications only require courts to ascertain the child’s best interest, the best interest standard has an added twist once a “final” judicial custody determination is in place: A party seeking to modify a “permanent” custody order can do so only upon a showing of a significant change of circumstances so affecting the child that modification is essential to the child’s welfare. Absent such a showing, any modification would be an abuse of discretion as denying the child the benefits of a stable home environment and thus would not be in his or her best interest. Montenegro v. Diaz (2001) 26 Cal. 4th 249, 256, Marriage of LaMusga (2004) 32 Cal. 4th 1072, 1088.

Indeed, the trial court’s exercise of discretion is far more limited when it effects a change in existing custody orders than when it makes an initial custody decision. Appellate courts are “less reluctant to find an abuse of discretion when custody is changed than when it is originally awarded, and reversals of such orders have not been uncommon.” Marriage of McLoren (1988) 202 Cal.App. 3d 108, 113,  modification giving W joint legal custody (where original order gave H sole legal and physical custody) reversed because W failed to present proof of change of circumstances affecting children’s welfare.)

The “changed circumstances” rule is an adjunct of the statutory “best interests” test for determining child custody. See Family Code §§. 3011, 3040(b). It furthers the paramount goal of preserving the need for continuity and stability in custody arrangements, unless some significant change in circumstances indicates a different arrangement would be in the child’sbest interest. Montenegro v. Diaz, supra, 26 Cal. 4th at 256, Burchard v. Garay (1986) 42 Cal. 3d 531, 535, see Marriage of Brown & Yana (2006) 37 Cal. 4th 947, 956.

Hace algunos años que me ocupo activamente en la proyectación y realización de sensores y dispositivos electrónicos, usados principalmente en muestras y presentaciones multimediales interactivas. La mayor parte de estos dispositivos usan microprocesadores y comunican con las computadoras de control a través de líneas seriales RS232. Los protocolos de comunicación los he desarrollado yo siguiendo las exigencias del momento y privilegiando siempre la sencillez y la facilidad de utilizo.

Debido a la gran variedad de dispositivos que he construido en el tiempo, me encuentro hoy en día con la necesidad de proyectar e implementar un protocolo unificado que sea versátil, flexible y que pueda ser aplicado a los dispositivos ya desarrollados. Una posibilidad muy interesante sería la de usar un protocolo que fuera independiente del medio de transmisión e que permitiera el uso de redes ethernet e internet.

He sentido hablar del protocolo Open Sound Control (OSC), posible sucesor del protocolo MIDI y que posee características ideales para ser usado en sistemas como los descriptos en el párrafo anterior. Por lo tanto he decidido de desarrollar un sistema completo de dispositivos electrónicos con este protocolo describiendo en este blog los pasos que he seguido.

Espero que esta experiencia personal pueda servir a otras personas interesadas en este argumento.

As disputas comerciais entre a China, os EUA e a União Europeia (UE) se intensificaram, e a Organização Mundial do Comércio (OMC) admite que as tentações protecionistas estão piorando.

A China acionou ontem a OMC contra a UE contestando sobretaxas de até 85% impostas na importação de grampos de aço chineses, o que considera um “abuso” e claro protecionismo. A decisão chinesa parece uma retaliação à imposição pela UE de sobretaxa de 39,2% nas importações de outro produto, os tubos de aço chineses, uma medida anunciada na semana passada.

Também os EUA abriram investigação contra o produto, o que pode conduzir a sobretaxa de até 100%. Recentemente, Washington já tinha irritado os chineses com sobretaxa pesada contra as importações, de pneus chineses, alegando que os preços deslealmente baixos ameaçariam a produção doméstica. Pequim reagiu com
uma barreira contra a entrada da carne de frango americana.

A China se tornou o principal alvo de medidas de defesa comercial em meio à recessão global, e não apenas por parte da UE e dos EUA. As demandas de restrições de indústrias em torno do mundo contra produtos chineses aumentaram 23% em 2008 e devem aumentar ainda mais neste ano.

Em debate ontem na OMC, o di-retor-gerál da Organização Internacional do Trabalho (OIT), Juan Samovia, alertou que será necessário “muito tempo” até que o mercado de trabalho volte á crescer.

Por sua vez, o diretor-geral da OMC, Pascal Lamy, admitiu que a alta do desemprego vai causar “reações sociais” e disse que “as tentações protecionistas são mais e mais fortes, na medida em que a situação se torna mais difícil”.

Outra confrontação pode ser deflagrada nesta semana, quando o secretário do Tesouro dos EUA deve declarar se a China manipula ou não sua moeda para ganhar mercados no exterior.

Já na UE, os 27 países do bloco estão divididos sobre a extensão de uma sobretaxa na importação de calçados produzidos na China. A questão é que varias indústrias europeias se instalaram na China para produzir mais barato e se opõem a barreiras que vão elevar o custo para eles e para o consumidor europeu.

Na escalada de tensões comerciais, os EUA denunciaram a UE na OMC por causa de nova restrição na entrada de frango americano. Bruxelas bloqueou o produto pois
ele é lavado com uma substância química proibida no mercado europeu, mas os americanos insistem que o tratamento é seguro e não afeta o consumidor.

Certos analistas acham que o Brasil pode sair ganhando com a briga entre os três grandes. Por exemplo, pode exportar mais pneus para os EUA e mais carne de frango para a China. Na prática, quando os contenciosos aumentam muito, como é o caso agora, é todo o comércio global que sofre um choque de incerteza.

“Esse vai ser o lugar do verão”, disse o DJ Nado Leal, após show de Anna Luisa, que abriu o fim de semana do Projeto em Casa. Na sexta à noite,  com um timbre delicado e entrosamento com a banda  (João Gaspar, violão; Siri e Marcelo Costa,  percussão; Carlos César,  bateria; e Emerson Mardhine, baixo), a jovem cantora e compositora, aos 28 anos, mostrou as influências, que vão de maracatu a baião e  rock. Anna Luisa apresentou Girando, o segundo CD, lançado em 2008 depois de Do Zero de 2006. Entre suas autorias do mais recente disco, está Bailarina do Mar.

“Uma regravação que eu gosto muito e que acabou entrando neste segundo CD para a minha felicidade é Cachaça mecânica, de Roberto e Erasmo Carlos”, disse a cantora antes de entrar no camarim para vestir o figurino. Desfilando um repertório sólido, sem dar margens a referências, Anna Luisa atravessou pouco mais de uma hora deslizando groove e suingue.

“Agradeço a presença de vocês. Agradeço esse espaço lindo para a música”, sentenciou, antes de Baião digital, música de Rodrigo Maranhão numa onda mangue-beat.  “Adoro Anna Luisa, sou muito suspeita para falar dela”, disse Ana Costa, também cantora e compositora, nome atual do samba. Os aplausos do público e as lágrimas de emoção de Anna Luisa cumprimentando amigos depois do show falaram por si. O DJ Nado Leal seguiu a energia da noite de sexta com o melhor da MPB.

No sábado foi a vez dos Doces Cariocas. “Se a gente falar por aí que é Em Casa, as pessoas vão achar que é o nosso sarau”, disse Pierre Aderne,  rindo ao lado da parceira Alexia Bomtempo. A brincadeira foi um trocadilho com o nome do projeto no Zozô. O clima leve da noite começou com Quanto tempo, música que emplacou nas rádios e despertou a crítica para o primeiro CD cujo trabalho trouxe um time de compositores .  Vida de estrela, que teve Edu Krieger na concepção, foi uma das parcerias apresentadas.

Além de autorias inéditas, a dupla fez releituras do que ficou gravado musicalmente na memória de cada um. Swing de Campo Grande, de Acabou Chorare, de 1972, fez parte do show.

Doces Cariocas com violões, violoncello, acordeon e percussão é um ‘baleiro musical’, eles se denominam assim. “Quando a gente lembra de baleiro, a gente lembra de muita bala misturada. A gente carrega na sonoridade uma mistura de vários estilos e gerações diferentes’’,  explicou Alexia. No início do próximo ano, tem lançamento do DVD gravado no Teatro Tom Jobim. Uma das músicas que fazem parte é Tua namorada. Mais uma letra que imprime o bom humor de momentos entre amigos compositores. 

[Marco Tempest] has developed some software called MultiVid that allows synchronized video across multiple iPhone or iPod Touch devices. For this to work, all of the devices must be connected to the same WiFi network. Playback can be controlled from any one of the iPhones/iPod Touches or from the Mac running the controller software. There is of course the option of connecting to larger monitors through a video output cable. The app also supports OSC. We’ve embedded the example video as well as a video detailing the software setup after the break.

The client software is available at the apps store and controller software can be downloaded from [Marco's] website. Both are free which is our favorite price point.

Update 9/6/09: We contacted Marco because this app was MIA from the App Store. He responded promptly to let us know that his app is “still in approval limbo”. He’s going to contact us when it is approved and we’ll be sure to pass on the update to you.

En m’appuyant sur le patch Max/msp créé par J. K. Van Woesik et P. Brouwer créateur d’un Pong à commande vocal, j’ai créé a mon tour le mien. Le patch réalise l’analyse FFT du signal sonore et transmet à Flash via un serveur dédié des paquets OSC contenant l’amplitude et le pitch du signal stereo. L’idée est donc d’utiliser le son du micro pour piloter un jeu 2 joueurs ici incarné par le légendiare Pong. L’idée est innovante et super sympa et mérite d’être approfondie. L’idée de coupler max/msp à des phidgets ouvriraient encore plus de possibilités.

Dans mon cas, je n’utilse pas de signal stéréo mais la direction de la balle active le paddle se trouvant sur sa route.

Dans la première démo, le mouvement et la taille des paddles est commandé respectivement par le pitch et l’amplitude du signal.

Pour la démo, J’utilise ma voix dans un premier temps puis un piano et c’est plutôt sympa.
