This is a copy of the newsletter that followed the Ratios one published earlier this year – it is also on the blog.

Following on from last month’s circular where we looked at getting the most from your financials by calculating ratios, we thought it would be useful to provide you with an alternative way of presenting that information.

Like it not, it is the financial information that tells us the truth about the performance of the business. What happens though if looking at the figures leaves you cold and none the wiser – what then?

Well believe it or not, you are not alone. The majority of people when confronted with a page of numbers are often mystified by their true meaning, generally only looking at the bottom line to gauge whether they are making a profit or a loss.

However by writing a report in plain English to sit alongside the accounts, many people begin to understand what is happening, without actually looking at the figures. This can be a true eye opener and suddenly understanding the nuts and bolts of the company’s performance leads to decisions being taken on fact as opposed to gut feeling.

There is so much more that can be gleaned from the financial information than basic profit/loss figures. Ultimately strategic decisions can be taken by looking at specific areas for the benefit of the company.

The report not only looks at what has happened during the last month of trading against a budget and the same period last year, but also on a quarterly and year to date basis. In addition the analysis highlights how consistent review of the ratios can aid and improve decision making.

Paul Smalley, managing director of Paper Mountain Solutions, used to manage insurance companies in Guernsey on behalf of their beneficial owners. Part of the job included writing and presenting to the Board of Directors of these insurance companies amongst other matters the financial performance of the company.

For two days last week and two days this week, we have parent teacher conferences at Cedar Park. Held annually in November, these are a great chance to meet and connect with parents formally, discuss important issues, and steer students in positive directions. I enjoy the conferences. It adds another dimension to my understanding of the students. It gives me key insights into their personal and family life. It helps me get parent support for students who are doing poorly academically or behaviorally.

This year, I had 23 conferences. I take notes on each conference, including issues discussed and action points. I also pray for their student at the end of the conversation. I have a progress report and some sample work for each student, allowing parents to get a “snapshot” of work. I discuss academics but also performance, which for my class, is 10% of their overall grade and includes bringing materials, participation in class, and behavior. I have had a positive and encouraging response from parents as I’ve addressed issues and concerns with them.

In talking with parents, I am realizing more and more how important my class website is to them as a secondary resource. At the middle school level, there is often a lack of clear communication and insight between student and parent. Students, in an effort to build independence, often report that they don’t have homework or that they’ve got everything taken care of, when this is not always the case. My class website can verify what students should have written in their daily planners. It can allow parents to know exactly what is going on in my classroom, so they can keep their student accountable at home. After all, in the case of Cedar Park, parents are investing heavily in their child’s education. I want to partner with them to help their student succeed.

Tomorrow, we will conclude our conference time with an open, informal conference time, held in the commons area and gym. This is something new our school is trying this year. It is designed for parents who would like to check in with teachers informally, without scheduling an official classroom conference. It will be interesting to see how it goes. I have a feeling parents will appreciate it, and teachers will enjoy the reduction in sometimes high numbers of official classroom conferences.

The Citadel Outlets will host a FREE performance by  Justin Bieber on Monday December 14, 2009. The event will take place in front of the 90 feet christmas tree in the center of the shopping center. The Citadel Outlets are located in the City of Commerce in California. Make sure to get there early! Bieber’s performance is scheduled to start at 6 P.M. Hopefully he’s able to perform with that cast he got today! Will YOU be there? We know we will!

Today, the blogosphere was DOMINATED by Adam Lambert (of American Idol fame) and his risque performance at the American Music Awards. This is unnerving and at the same time, thoroughly expected. After all, he is a young pop star, and as evidenced by the long line of such folks before him (I could name names, but that would be a tangent I don’t want to touch), his sexually charged, homo-erotic, over-the-top performance is a constant in the Pop Success Theorem.

I could talk about my dislike of his sexual display (homo- or otherwise, no matter), but my opinion probably doesn’t carry much weight.

I could compare the American culture to Orthodox Christian patristic teachings, but my knowledge of the latter is admittedly fleeting compared to than that of the prior.

I could even compare the differing responses from the American IDOL runner-up’s fans, but it is not the differences therein that I am interested in.

Instead, I am most concerned with how so many people, so many thousands have spent so much time concerning themselves with the singer and his show (and yes, I do understand that now, by this post, I’m one of them).

It is during this time of fasting that my own preoccupations become so clear. I, as a product of my raising, am very American. I like to be entertained. I like my TV, filled with a barrage of images and messages, always changing depending on what I want to see, or what’s on next (when I decide I don’t want to change the channel). I like my sports. I like a tall glass of cold milk with my steak dinner. I like a beer on the front porch. When I fast, I try to avoid all these things because I like them so much, in accordance with Eastern Orthodox practice.

The hunger pangs caused by the break of my routine, physical and spiritual, make some of my reality more clear.

I worry that we, the American youth, unquestioningly buy into the constant artificiality of the engineered and programmed “entertainment” provided us everywhere.

I’m pretty sure that in their attempts to keep us entertained (and themselves in business), so-called “entertainers” must keep things new and exciting. In a cultural maelstrom where there is nothing new under the sun, or on TV, the envelope keeps getting pushed and prime-time TV gets more “edgy.”

It is in this environment that Adam Lambert surfaces as nothing more than another push. I don’t blame him or the choreographer or the AMA’s or the network that carried the show. It is all just a response to a people which places as its premier desire entertainment; with media, with their lives, even so far as with their churches.

We spend so much in this netherworld of the artificial that I am afraid we are actually losing touch with reality.

I think of the caricature of Americans in the Disney-Pixar film Wall-E. How, in the constant search for entertainment, the people become by their reliance on their technology completely and entirely entertained. They never have to leave their floating chairs complete with Big Gulp dispensers.

I just hope that we might at some point be like the one fat space-goer from the film and realize that there is something more and completing to the human condition beyond the contented entertainment from the screens in our faces.

As a member of a generation so bored with our constant entertainment that our entertainment has morphed into shock-and-awe campaigns, I can only hope that we can see beyond our bubble and begin to comprehend that REAL life is more than entertainment provoked complacency.

Do you want to climb the ladder, achieve more, or set yourself apart from others you work with? Here are three ways you can perform at a higher level and set yourself apart:

1. Goal Setting -Start out your week by listing out your goals.  List out everything you need to do to accomplish your week.
2. Plan and Organize -Once you set up your goals, plan out what tasks it will take to achieve them. Detail out as much as possible.
3. Set Priorities -Now that you have your goals and plan, set your priorities. Attack the goals that will get you the most out of your week.  It’s sometimes not about getting it all done.  It’s about getting your high priority goals accomplished.

It does happen. Buyers at auctions deciding, either suddenly or with some premeditation, that they aren’t going to pay for their purchase. The courts are filled with such cases, and there is significant precedent.

First, it does matter if the transaction involves real property or personal property. Each are handled in very different ways due to the Statute of Frauds, which has been adopted by all states in some form or another. The Statute of Frauds dictates that all purchases of real estate must be in writing to be enforceable.

Enforceability is the major issue here. If an agreement can be enforced, then a court can take action to require performance. If an agreement is not enforceable, then a court will typically not require any performance, and will usually dismiss a lawsuit asking for performance.

For example, Bob is the high bidder on a house sold at auction. The auctioneer says, “Sold! for $225,000 to bidder number 27 (who is Bob).” Bob then refuses to sign the purchase contract, and refused to close. Of course, the seller and auctioneer sue Bob and ask a court to require Bob to perform. However, without a signed purchase contract, it is unlikely the court will take such action.

The Statute of Frauds does not apply to personal property sold at auction.

For example, Bob is the high bidder on a 1963 Winchester Model 94 Rifle. The auctioneer says, “Sold! for $275 to bidder number 27 (who is Bob).” Bob then refuses to pay for the gun and goes home. Of course, the seller and auctioneer sue Bob and ask a court to require Bob to perform. The Statute of Frauds does not require personal property auction contracts to be in writing, and with sufficient evidence of Bob registering and participating in the auction, the court would likely rule he must perform — i.e. pay for the gun and assume title.

One common misconception is that all purchases for real estate must be in writing. Actually, they don’t, and many times aren’t in writing. The Statute of Frauds only dictates that they must be in writing to be enforceable, not that they must be in writing, regardless.

Would having the buyer sign something following “Sold!” ever be a bad idea? If it required too much time and/or inconvenience, it may deter buyers, but otherwise, it would certainly not hurt in the event the buyer decided not to perform. Many auction venues selling very high priced items (artwork, horses, equipment … to name a few) do require the buyer to sign a memorandum immediately following the auctioneer’s declaration of “Sold!”

And, what about Promissory Estoppel? This doctrine essentially rewards a party if another party makes a promise to them, and the promisee relies on that promise, and with the promissor now refusing to perform, there is economic harm or detriment. Promissory estoppel essentially requires the promissor to hold up to the promise made.

So, could this be a factor in such cases? In real estate, occasionally, courts have ruled that despite there being no written contract, per the Statute of Frauds, that promissory estoppel requires the buyer to perform nonetheless. While this is not typically the case, it may help some auctioneers when a contract is not signed following the auction.

Lastly, is it worth filing a lawsuit against a buyer who won’t pay? If another buyer can be procured for about the same price (or, for no less than the likely cost of litigation), then maybe it’s best to let the issue rest. However, if no other buyer can be found, and this non-payment is costly, a lawsuit may be prudent.

Something crucial I learnt while my Postgraduate diploma was setting the right expectations for your team members for them to perform well and achieve your objectives.

I completely agree to the part of setting expectations which I have practiced and achieved results. But at the same time there is an additional force you need to get team members to perform as expected. This is ability of a leader to motivate, encourage team members to continuously perform par excellence.

I think the team members who aren’t self motivated or doesn’t value accountability cannot perform even after laying right expectations in front of them. Thus, the game of expectations allows leaders to manage out the undesirable team members. Rest of the team simply needs direction, little encouragement, and appreciation for their efforts.
