Bonjour,
Je souhaite vous soumettre le communiqué de presse que notre association (ASFR: association de solidarité avec les familles Rroms et roumaines) a soumis ce jour au journal Le Parisien (essonne) et à l’Agence France Presse (contact téléphonique avec l’afp et rencontre avec le parisien ce jour);
ci-après notre communiqué:
Mardi 25 novembre 2009

Big Brother is camera shy. It has always struck me as curious and amusing that the perpetuators of surveillance are themselves so suspicious of inverse surveillance. I tend to think that this is because inverse surveillance is reflectionism: holding up the mirror and asking the question: “Do you like what you see?” The answer, in most cases, is obviously “No”. There is also an authoritarian aspect: surveillers sometimes seem to object more to the social act of challenging their “authority” through inverse surveillance than to the actual existence of the inverse surveillance. This is demonstrated very clearly in this video clip where two police officers confront the cameraman in his garden. He’s done nothing wrong, yet they go out of their way to turn back, approach him, and create confrontation.

Historically, surveillance has been used by authority to maintain control; the advent of small, cheap digital cameras and phone cams, along with Flickr and YouTube, have made it easier to “watch the watchmen,” and create a bottom–up, distributed network of inverse surveillance. Citizens are now able to keep tabs on the activities of those in power. Corrupt or unethical behavior is more likely to be uncovered, and recordings of particularly egregious abuses spread almost instantly. We have created our own inverse panopticon.

That’s quite apt when you understand the reasoning behind Jeremy Bentham’s plans for the ideal prison he called the Panopticon. As its name indicates, the building was designed to allow its personnel an unobstructed view of the entirety of the structure. But the physical possibility to see everywhere, combined with the practical impossibility of the guards to simultaneously watch everything, required an additional feature: the guards themselves were not visible to the inmates. As a result, the inmates would have to simply assume they were being watched all the time, and act accordingly, whether or not actual surveillance was taking place. The panopticon’s inmates would therefore discipline themselves and so reform.

Last week, Denis O’Connor, Her Majesty’s Chief Inspector of Constabulary, released the long awaited and damning report, Adapting to Protest – Nurturing the British Model of Policing. It proposes some quite radical and far-reaching changes to the way that the police in this country operate. The only people complaining about its recommendations are the police themselves, which straight away tells you it is “a good thing”. As reforms go, it is a step in the right direction, but that’s all it is – a step, not the whole 9 yards. If it hadn’t been for inverse surveillance at Kingsnorth and G20, the report would never have been commissioned.

Keep photographing and filming. We’ll get them to reform eventually. Meantime, enjoy a little bit of inverse surveillance proving yet again that you can spot when a police officer is lying because his lips are moving.

Oh, and constable, remember: If you have nothing to hide, you have nothing to fear.

(source : Le Monde 27/11/09)

I don’t know who the f**k is trying to go out there and ruin the career of engineering manager Jeremy Shum and singer Miley Cyrus (dumb ass kids, probably do that these days, don’t have time to do anything better) but this is once and for all to set the record straight.

Look here:

http://www.youtube.com/watch?v=eq0TH3WMn24

It’s no use even taking this to court, it’s bull-s***. Obviously there is NO sex scandal. NO sex tape.

Just kids screwing around.

And Jeremy Shum and Miley Cyrus’ careers on the line thanks a lot to some kids mucking around.

It’s untrue. A fake. A fraud. A hoax.

Update:

The alleged sexual tape in McDonald’s car park (http://www.youtube.com/watch?v=bcLK8GVmR_c) looks to be fake too

Pregnancy tape is also fake (http://www.youtube.com/watch?v=FyfC1_QGMoU)

This should be reported to the Police.

Please read the Below judgement and see how unsrupulus members of the Family of the First Wife tried to Misuse the Laws to harass the innocent husband, they were almost successful in the evil intensions but for the good judgement and sensitivity of the Supreme court.

Members of the First Wife who were trying to falsely implicate the husband and his family members should be dealt with sternly and given an exemplary punishment so that nobody else dare to misuse the laws to take revenge in Family disputes .

The Text of the Judgement is below .

Pashaura Singh vs State Of Punjab &Amp; Anr on 13 November, 2009

IN THE SUPREME COURT OF INDIA

           CRIMINAL APPELLATE JURISDICTION

           CRIMINAL APPEAL NO.2122 OF 2009

(Arising out of SLP(Crl.) No. 5910/2006)

Pashaura Singh …Appellant Versus

State of Punjab & Anr. …Respondents JUDGEMENT

R.M. Lodha, J.

Leave granted.

2. In this appeal by special leave, the appellant has challenged the order
dated May 24, 2006 passed by the High Court of Punjab and Haryana. By the said
order, the petition filed by the appellant under Section 482 of Code of
Criminal Procedure for quashing F.I.R. No. 9 dated January 21, 2002 registered
at Police Station Sehna under Sections 498-A, 494, 506/34, IPC has been
dismissed.

3. Kamaljeet Kaur is a landed immigrant of Canada. On May 7, 1997, she married
Pashaura Singh Sidhu – appellant – at village Ghall Kalan, District Moga,
Punjab. She left for Canada on May 15, 1997. She sponsored her husband and,
accordingly, Pashaura Singh went to Canada in 1998. They stayed together for
few months and then relations between them became strained. Kamaljeet,
thereafter, started living separately in Ontario. Pashaura Singh applied for
divorce and dissolution of marriage before the Supreme Court of British
Columbia and a divorce judgment was passed in his favour and their marriage
stood dissolved with effect from February 8, 2001. After the dissolution of
marriage, Pashaura Singh came to India and remarried on January 2, 2002.
Pashaura Singh went back to Canada with his newly wedded wife and both of them
have been residing there.

4. On January 21, 2002, Kamaljeet’s brother Balwant Singh lodged a first
information report being F.I.R. No. 9 at Police Station Sehna against Pashaura
Singh, Hakam Singh (father of Pashaura Singh), Randhir Singh (brother of
Pashaura Singh), Charanjit Kaur (wife of Randhir Singh) and Harbans Kaur
(mother of Pashaura Singh) alleging therein that on May 7, 1997 he performed
his sister Kamaljeet Kaur’s marriage with 2

Pashaura Singh; that at the time of marriage, according to his status, he gave
rupees four lacs in cash, gold jewelry, utensils, almirah, fifty-one suits,
five bags etc. but the accused started harassing his sister Kamaljeet Kaur and
threatened to kill her if she did not bring car, electronic items etc. and that
he has now come to know that Pashaura Singh has entered into second marriage
in the first week of January, 2002. A case under Sections 498-A, 494, 506/34,
IPC was registered against the accused persons and it appears that the police
submitted challan against them in the court of Judicial Magistrate First
Class, Barnala.

5. Randhir Singh, Charanjit Kaur (Rajinder Kaur), Hakam Singh and Harbans Kaur
filed a petition under Section 482 of the Code of Criminal Procedure for
quashing the F.I.R. No. 9 and criminal prosecution against them. Vide order
dated April 29, 2004, the High Court allowed the petition and quashed F.I.R.
No. 9 dated January 21, 2002 registered against them and all subsequent
proceedings.

6. Pashaura Singh by a separate petition under Section 482 of the Code prayed
for quashing F.I.R. No. 9/2002 3

and the subsequent criminal proceedings against him but, as noticed above, the
High Court by its order dated May 24, 2006 dismissed his petition. The High
Court in its cryptic order, while dismissing the petition, observed that
Pashaura Singh has married second time on January 2, 2002 while he was already
married with Kamaljeet Kaur and the aforesaid marriage has not been dissolved.

7. Having heard the learned Counsel for the parties and upon careful perusal of
the materials placed before us, in our judgment, the order of High Court cannot
be sustained for more than one reason. In the first place, the High Court
gravely erred in observing that Pashaura Singh married second time on January
2, 2002 while he was already married with Kamaljeet Kaur and the aforesaid
marriage has not been dissolved. The certificate of divorce dated February 26,
2001 issued by the New Westminster Registry, Supreme Court of British Columbia
shows that the marriage of Pashaura Singh and Kamaljeet Kaur stood dissolved on
February 8, 2001. As a matter of fact, this fact is noticed in the order dated
April 29, 2004 whereby the High Court quashed F.I.R. No. 9 and the subsequent
criminal 4

proceedings against the family members of Pashaura Singh. In the affidavit
filed by Gurmail Singh, Deputy Superintendent of Police in response to the
petition filed by the appellant under Section 482 before the High Court, it has
been admitted that during investigation on March 14, 2002 Hakam Singh had
produced photocopy of divorce certificate purporting to have been issued by the
Supreme Court of British Columbia. The observation of the High Court, thus,
that Pashaura Singh married second time, although his marriage has not been
dissolved, is ex-facie contrary to record.

8. Section 494, IPC, inter-alia, requires the following ingredients to be
satisfied, namely, (i) the accused must have contracted first marriage; (ii) he
must have married again; (iii) the first marriage must be subsisting and (iv)
the spouse must be living. Insofar as present case is concerned the appellant’s
marriage with Kamaljeet Kaur was not subsisting on January 2, 2002 when he is
said to have married second time. Pertinently before the High Court, along with
reply, the complainant Balwant Singh annexed copy of an affidavit filed by
Kamaljeet Kaur which states that she was not aware of the divorce 5

proceedings filed by her husband Pashaura Singh. However, from this affidavit,
it is apparent that her husband has obtained a divorce judgment. There is
nothing in the affidavit that divorce judgment has been stayed or set aside. On
the face of the allegations made in the first information report, therefore,
ingredients of the offence under Section 494, IPC are not satisfied.

9. Insofar as offence under Section 498-A is concerned, the High Court in its
earlier order dated April 29, 2004 in the petition filed by the family members,
observed thus: “I have perused the First Information Report registered
against the petitioners.

The only allegation against the petitioner is that they started
harassing Kamaljeet Kaur Gill for not bringing more dowry. No demand of dowry
has been made by the petitioners, nor is there any specific entrustment, as
alleged in the First Information Report of dowry articles to the petitioners.
Parties have divorced each other, as per the order of the Supreme Court of
British Columbia (Annexure P-1). Order is dated February 25, 2001. It is after
this divorce that Pishora Singh got married in India on January 2, 2002.”

10. Moreover, in the affidavit of Kamaljeet Kaur referred to hereinabove, there
is not a word about demand of dowry or harassment on account of dowry by the
appellant. 6

11. We have no hesitation in holding that the first information report lodged
by Balwant Singh is manifestly attended with malafides and actuated with
ulterior motive. The prosecution of the appellant is not at all legitimate,
rather it is frivolous, vexatious, unwarranted and abuse of process. The
appellant has made out a case for quashing the first information report and all
subsequent proceedings pursuant thereto.

12. For the reasons indicated above, appeal is allowed and order dated May 24,
2006 passed by the High court of Punjab and Haryana is set aside. Resultantly,
F.I.R. No. 9 dated January 21, 2002 registered at Police Station Sehna and all
subsequent proceedings pursuant thereto stand quashed and set aside.

13. The pending applications stand disposed of. ……………………J

THE PURPOSE OF THIS BLOG IS TO ELICIT SUPPORT THAT WILL END THE TRAVESTY CALLED “SCHOOLIES

THE PURPOSE OF THIS BLOG IS TO ELICIT SUPPORT THAT WILL END THE TRAVESTY CALLED “SCHOOLIES”. IF YOU ARE A SCHOOLIES SUPPORTER, GO AWAY…. AS FAR AWAY AS POSSIBLE!

I have put the word “SCHOOLIES” in parenthesis because the application of trendy names somehow lends legitimacy to acts of horror and gradually through the media we all slowly become immune and accepting. As an example I would proffer a few recent headlines… “DAD BRUTALLY KILLS CHILDREN”. This was not a ‘Dad’ this was a murderous monster who hacked up three of his own children with a machete. “Dad brutally kills children” just doesn’t deliver the right message, which is three innocent children aged 5 to 11, literally hacked to pieces, dismembered and left to bleed to death in the most nightmarish fashion while their “DAD” chased their two siblings around the house slashing at them. “MAN GLASSED IN BAR”. Let’s tell it like it is. Some drunken moron actually picked up a glass and jammed it into another human being’s face, severing major facial nerves, tearing out an eye, occasioning major facial reconstruction and plastic surgery to leave the victim with a lesser chance of evoking a gag response whenever he or she goes out in public.

Now this may seem off topic and a bit extreme, but there is a point.

While I may use the term one or two more times, lets tell it like it is. “FORTY OR FIFTY THOUSAND SCHOOL LEAVERS ARRIVE ON THE GOLD COAST EVERY YEAR IN NOVEMBER, A GOOD PERCENTAGE OF WHOM (MALE & FEMALE) ARE INTENT ON NOTHING MORE THAN GETTING SERIOUSLY DRUNK, SHAGGING EVERYTHING THAT MOVES AND SMASHING EVERYTHING THAT DOESN’T WHILST SCREAMING LIKE DEMENTED BANSHEES AND TERRORIZING THE LOCALS.

Okay… so as I write this it’s 11am on Saturday 28 November and we, the permanent residents of Surfers Paradise, take a small breather before the next onslaught of “Schoolies” invades our very lives. As I look out my window I see the poor residents that live at ground level scrubbing graffitti, picking broken glass and other trash off their lawns and trying to avoid stepping in any human excrement and vomit that’s been left in their gardens. Those that live in apartments get the small reprieve of being able to open their doors and windows and take a breather from the obscene behavior and foul language that has been the norm for the past week and will most likely start again late this afternoon. They can also watch the constant train of vehicles arriving as parents arrive to take their little angels home, but more about the parents later.

Here I need also address the issue of ’schoolies’ versus ‘toolies’ (another neat little label). You know what… I don’t care to discriminate. There are two issues here. Firstly the official sanctioning of a giant drunken party for the first lot will always attract the second lot. Secondly it is not just this second lot of morons that causes the problems. I accept without reservation that there are thousands of school leavers who come here, party responsibly, have a drink or two, blow off a bit of steam and go home without causing any problems. However I will recount my own experience of living in an inner Surfers apartment building for the past week. On Friday last (20/11) I called the lift at about 4.00pm. It was full of charming ‘boys & girls’, all of them with an alcoholic drink in their hand and all either inebriated (or pretending to be). I took my place in the lift and said nothing. One of these little charmers decided to be brave and obnoxious. On the return trip in the lift I was joined by another group of inebriates bearing alcohol, who announced they were busy visiting every apartment on every floor to announce their arrival and organise parties. The music, shouting and obscenities was in full swing by 7.00pm when the vacant block and the streets nearby began to fill with P plated cars, vans, wagons and utes and the street party got into full swing. Frequent visits by the police (and apparent arrests) failed to dent the revelry and it continued right through till last night. I trust the clean-up going on out there now is not in vain and that the new lot don’t start the whole thing up again tonight.

By Monday night we had given up. It was impossible to sleep in our own home and impossible to leave it without being subjected to a gauntlet of bravado and belligerence. The beach that we maintain with our rates, regularly walk to and swim at, is barricaded off for half a kilometre and the trip to either end of the barricades for a swim is made less than pleasant by the obnoxious drunken cretins that feel obliged to provoke you or worse, befriend you.

We packed up and left for the remainder of the week only to return last night to find the building in turmoil, the building managers totally strung out and the balconies full of drunken teenagers competing with each other to see who can swear the loudest. I have witnessed the state of a few of the apartments here and I’m led to wonder why any unit owner would gamble the couple of dollars extra profit from schoolies against the potential damage to their properties.

We have witnessed drunken teenagers sleeping it off in gutters, on lawns and in gardens, drug deals, arrests, people vomiting, defecating and urinating in public, ambulances coming and going, elderly residents bullied etc. etc. .. and that’s just in our street!

SO NOW LET’S GET DOWN TO THE POINT OF THIS BLOG WITH A FEW SIMPLE QUESTIONS.

1. How can any local, state or federal government or for that manner any civilised western society condone, and even promote, what goes on here?

2. Who profits from this event?

3. Who is schoolies.com and how do they profit from this fiasco?

4. Who pays for the damage to private and public property?

5. Who pays for the extra policing?

6. Who pays for the extra infrastructure services?

7. Is there an increase in public hospital, ambulance and casualty services and if so who pays for that?

If the answer to 4 through 7 is Gold Coast ratepayers then let us ask the Gold Coast City Council for a breakdown on the additional costs and en-mass withhold an equivalent proportion from our rates payments. I rarely agree with the Lord Mayor, but yesterday I saw him interviewed and I agree with everything he said. Okay Ron, we’ll put pressure on your revenue, you put pressure on our abysmal under-performing state government to step in and stop this fiasco.

It is my belief that this fiasco has harmed the Gold Coast irreparably and we as ratepayers should now step up and be counted. If by some miracle it is allowed to continue we need to see some serious debate and some clear justification. We need to know that the ratepayers and taxpayers of the Gold Coast are neither supporting nor footing the bill. We need to have a system where ANYBODY who profits from this are 100% liable for costs and damages. We need a system where no building or apartment should accept school leavers without their parents signing damages guarantees. Maybe this will stop them sending their little darlings into my town to make my life a misery. If parents coming up for school leaving age doubt the validity of my words, then next year, book yourself into an apartment block that accepts schoolies and spend a week in my shoes on the streets of Surfers.

Have a look at page 3 of today’s Gold Coast Bulletin. This is the reality of “Schoolies”!

I would like to take the time to thank and congratulate those ex-students who came here and behaved like human beings. If you have younger siblings I should like you to talk to them and your parents about the true nature of the event.

I AM SEEKING AS MANY COMMENTS AS POSSIBLE WITH A VIEW TO PUTTING AN END TO “SCHOOLIES”.

PLEASE VOICE YOUR OPINION.

You don’t have the time or the resources to evaluate every applicant who strolls in. to guide your w

You don’t have the time or the resources to evaluate every applicant who strolls in. to guide your work, you should develop a profile of your “ideal” candidate. You may never find your ideal, but you will establish a basic framework that outlines the person you are looking for.

Developing an ideal candidate profile is similar to viewing a lineup of suspects after you’ve witnessed a bank robbery. The individual you pick out may not be the actual bank robber, but chances are the real criminal is strongly similar. Often, a lineup helps police establish the silhouette or basic framework of the person being sought. The police is clear even if the details are not. Likewise, your ideal candidate profile will give you a sharper idea of what you are really looking for, so that you can increase your odds of finding him or her.

Use the following outline to develop of profile of your ideal candidate:

Must have, or have done, or be able to do:

Experience: type and years

Industry: type, or specific companies, and years

Skills or talents

Education

Should have, or have done, or be able to do:

Experience: type and years

Industry: type, or specific companies, and years

Education

Would be nice to have, or have done, or be able to do:

Experience: type and years

Industry: type, or specific companies, and years

Skills or talents

Education

Be specific when you draft your outline. If you want someone with strong follow-up skills, say so. If you want an assertive person who can handle high stress, say so. To create a good match between job and candidate, you need to define the person as closely as you define the job.

Keep your company culture in mind, too. If your company is team-oriented and flexible, you want a candidate who is comfortable with teamwork—and not everyone is. If your department is highly structured, you want someone who works well in a structured situation. Describe the qualities that your company values so that you can find compatible candidates.

Just remember that defining the candidate is a lot like shopping for groceries: the more you toss into your shopping cart, the more you’ll pay. The cost of filling a job is influenced by two factors: how long it takes to find the candidate, and the supply of qualified candidates. The greater the number of must have items on your list, the longer it’s going to take to find that person. The greater the experience, skills, or education requirements, the smaller the supply of candidates and the larger the compensation package required to hire the person.

It’s very, very true.

I’ve been lying in bed for about half an hour now, but I can’t sleep, all I’m doing is thinking. (why do we always think when we should be thinking?)

Do you ever feel that life is moving way too quickly? Like, one minute you’re thinking, God, I’ve got years and years ahead of me, so much time to do all the things I want to do and so much time to plan, I don’t need to do that now, I’ve got plenty of time for all that serious stuff.

Then the next minute you stop and look at your life and think, wow, the last 20 years have gone so quickly, in another 20 short years, the 20 shorts years I’ve been alive, I’ll be 40, I’ll be 10 years off half a century.

By the time I’m 40, I will want to be married, have children, definitely have my career in a steady place, I want to have travelled to Australia, Italy, America and Africa, plus all the small, holiday places in-between.

20 years really doesn’t seem long enough to achieve all of that….

I remember being asked when I left school, just over three years ago now,

‘Where do you want to be in five years time Charlotte?’

I answered, I want to be living in London, I want to have travelled and I want to have joined, or be joining the police force.

Like I said, that was three years ago, granted I have two more years left, but I haven’t travelled, and I gave up on the police to do exactly that. Now I have no job, and am killing myself slowly by searching for one. I need a job to save for travelling, and I can’t see this happening any time soon. At least, not in two, small, tiny years…

I’m not complaining, don’t get me wrong, my life could be, and has been a lot worse.

I’m living in London, my favourite place in the world.

I have a brilliant family, few, but amazing friends, I don’t want for anything (except a job, my own income and my future), I’m well looked after, and my family and friends tolerate a lot of things that many families and friends would not.

I just, I want to see the world, you know? And I want time to get my career going and build a family…It just seems, that time is running out, and I’m going to have to do all these things I want pretty damn quickly else, while I’m planning all these things, life is going to run past me, and before I know it, it will all be too late…And you only get one chance at life, there’s no re-wind button or pause button or off and on button. There’s one chance, and if you muck it up, there’s nothing you can do about it.

Listening to the hilarious recounts/speculation surrounding today’s news that Tiger Woods crashed his car into a fire hydrant and tree at 2:30 am this morning, I was reminded of a funny exchange between Abbott and Costello. The one where Bud Abbott is trying to teach Lou Costello how to drive a car. In the skit, Lou (who’s getting more and more frustrated, ala “Who’s on First?”) keeps asking Bud if he should “put it in reverse?” And Bud keeps replying, “Go ahead. GO AHEAD!”

Some of the news announcers I watched discussing the Woods’ incident, seemed to be holding back laughter as they reported on the circumstances (“Tiger Woods crashed his car into a fire hydrant and then a tree at 2:30 am this morning. His wife used a golf club to break a window to help free him from the vehicle. He suffered minor injuries…..”

Imagine the fiction being drafted right about now.

Whether you carry a gun or have one in your home for self defense, if you are ever involved in a shooting below is some good advice to keep you out of the pokey after the fact. Even if you are completely in the right, your words, whether written or spoken, need to be chosen very carefully. Shooting your mouth off when you are still pumped full of adrenaline is NEVER a good idea. Venting your emotions about the attack or the individual who attacked you to others isn’t a good idea either, as it could put them in a position of having to make statements that might not look so good for you.

Just remember, even though you are in the right, the liberals and self-proclaimed victims are out to get you. They will twist ANYTHING you say to portray you as the bad guy.

Summary: Shut up and lawyer-up.

It Doesn’t Have to Make Sense: It’s Just the Law – Statements

“…Written statement: a VERY BAD idea! ….”
BY K.L. JAMISON

In 1996, an unhappy consumer attacked the City Marshal of Lancaster, Missouri with a hammer.(1) The Marshal defended himself and later vented his adrenaline to the responding Sheriff stating, “I hope the son-of-a-bitch is dead.” This led to the Marshal’s conviction for involuntary manslaughter and a sentence of seven years in prison.(2) The story had a happy ending, but a story four years and tens of thousands of dollars in the making, and not a story the Marshal enjoyed very much. The Marshal might have avoided the worst part of the story had he not confused his right to remain silent with the right of free speech.

In the movie, Under Pressure, a woman tried to explain the stalking and implied threats of a neighbor. After a disorganized and unconvincing recitation of ambiguous events she lamely concludes, “I’m not a very good story teller.” Most people tell stories badly. In the aftermath of self-defense there can be a giddy stream of consciousness statement which has more to do with the effects of adrenaline than reality. The basic legal advice is “DON’T.”

The first question is, “What is a statement?” In a nation which counts exotic dancing as freedom of speech, a statement is also broadly construed. In 1996, the Missouri Supreme Court ruled that a suspect’s refusal to uncross his legs during questioning could be taken as a statement when later charged with murder.(3) In a separate death penalty case, the court found that the defendant had purchased a used car which sported the bumper sticker, “I’m the person your mother warned you about.” At trial the prosecution argued that the fact he did not remove this bumper sticker revealed something about his character. The Missouri Supreme Court ruled that it was perfectly acceptable for the state to kill this man, in part, because of his failure to remove the bumper sticker.(4) One can imagine the effect of bumper stickers bought in jest such as, “Keep Honking, I’m Reloading.” If this case does not also inspire a re-evaluation of one’s T-shirt collection, nothing will.

There is also the problem of nicknames. As of this writing, a rapper who rejoices in the stage name “C-Murder” is on trial for murder. If I were asked to defend a man named “Murder” or any variation thereof, I would charge more. Massad Ayoob testified in favor of a police officer who had killed a felon nicknamed “Snake.” Captain Ayoob slipped the nickname into his testimony which seems to have had an effect on the jury.

Written statement, a VERY BAD idea!

There is a cynical defense attorney saying: “Anything you say will be misquoted and used against you.” In the movie, My Cousin Vinnie, two, unfortunate Yankees are suspected of murder and during questioning are accused of shooting a clerk. One incredulously asked, “I shot the clerk?” This is taken down and read in court as a confession. Theater audiences laughed, defense attorneys smiled and nodded. There have even been cases where comments by other persons have been attributed to the defendant, and used against him; complete silence is the only bulwark against these mistakes.

The first statement is the 911 call. These calls are recorded and if the call sounds bad for the defendant, it will be played over and over again at trial. In one case, a man cocked his double-action revolver and went after a person who was shooting out windows. When he caught up with the threat he extended his revolver and in the process tripped the light single action trigger pull; arguably an accidental discharge. His 911 call records him saying that he thought he had just shot someone. The 911 operator, trained to keep him on the line and keep him talking, asked why he thought he had shot someone. The man replied, “Lady, I think I’m a pretty good shot.” This callous-sounding statement took accident off the table and the man had to live or die with a self-defense case. This all important introduction to law enforcement must be planned in advance.

The first words out of the caller’s mouth should be the location of the incident. If the battery then dies, or the minutes run out, or some other technological catastrophe occurs the authorities will know that something of interest is at that location, and the caller’s cell phone records can prove that he or she made the call. The next statement is the caller’s name. The core of the 911 call consists of three sentences:

“He tried to kill me.”
“I was never so scared in my life.”
“Send an ambulance.”(5)

The first sentence serves to introduce the roles of the parties, the caller is the victim, the other person the attacker. Being in reasonable fear of life or limb is a prerequisite to acting in self-defense. The phrase “I was never so scared…” is to preclude the prosecutor from claiming that the citizen never said he was scared “until he talked to a lawyer.”(6) The phrase “Send an ambulance” says that the caller does not want anyone to die.

When the police arrive, they will want a more elaborate statement; this should consist only of:

1. He attacked me.
2. I will sign a complaint.
3. There is the evidence.
4. I WANT A LAWYER.

Good Advice.

This restates part of the 911 call and points out critical evidence. One cannot expect the “CSI” team to be called out to pick up every fiber and hair. If a real forensic team routinely conducted the investigations shown on television, its budget would last about a week.

The demand for a lawyer is both the best thing one can do, and a damaging statement. Anyone who is questioned by police has the right to a lawyer; this includes victims. The problem is that the police, and potential jurors, take a demand for a lawyer as evidence of something to hide. To compound the problem, the victim’s decision to remain silent and demand for a lawyer can be used again him or her in court. In the criminal system, one does not have rights, until arrested; it doesn’t have to make sense, it’s just the law. It is a left-handed fortune that people who act in self-defense are routinely arrested. It may be called something else such as “detained” or given the “Alice in Wonderland” explanation “You’re being handcuffed for your own protection.” Whenever a person is not allowed to leave, he is placed under arrest regardless of descriptive terms. If one is arrested, generations of TV shows advise us to remain silent.

Western Missouri Shooters Alliance President Sheila Stokes-Begley employs a cell phone and CZ75 compact.

If the circumstances are ambivalent, simply state a fear of being sued, and demand a lawyer to protect against frivolous litigation. Bernard Goetz was acquitted of criminal charges in the shooting of four thugs on the subway, but was sued for $43 million and lost. Police are frequently sued by criminals and the explanation is likely to ring a bell.

Self-defense cases bring out the curious, the media in the forefront. Comments to friends will be confused and used against you, comments to family will be mistaken and used against you. Both family and friends can be subpoenaed and forced to testify against you. Comments to the media will be sensationalized and this is never good. The New York City prosecutor’s office had determined not to charge Bernard Goetz, until he made unwise remarks to the news media. At some point a statement must be made. The impression is that the earlier a statement is made, the more reliable it is. In reality, the earlier a statement is made, the less reliable it is. The effects of stress will confuse the statement and even cause temporary amnesia. Inaccuracies in the initial statement will convince authorities that the survivor is both a liar and a murderer. A lawyer must be immediately engaged to organize the statement.

A lawyer is a professional storyteller. He will not tell the client how to lie, he will tell him how to tell the truth, a more complicated process than most imagine. The statement must contain facts which track the elements of self-defense. In the case of defense of home or defense of other persons, there may be other elements as well. Knowledge of the assailant’s reputation for violence would certainly be relevant. The most important element to include is fear. A police statement is no place for macho posturing. One cannot use violence against another person unless in fear of life or limb. The survivor must go over every detail of why he or she was terrified, weak-kneed, pants-pissing afraid. If one does foul one’s pants, a not uncommon event, make sure that goes into the statement. No matter how ineffective a storyteller the survivor might be, the jury is sure to believe that.

A reminder: Sgt. Smellie was recently granted unconditional bail by District Judge Daphne Wickham until his trial, scheduled for Monday 22 March next year at City of Westminster magistrates court. He has pleaded not guilty to a charge of common assault by beating of Nicola Fisher in the City of London on 2 April. Sgt Smellie will remain suspended from the TSG at least until the case is resolved. Incidentally, Ms Fisher was one of two women to complain about Sgt. Smellie’s actions at G20, but prosecutors said there was “insufficient evidence to charge the officer in relation to the second allegation” (ie nobody nearby caught it on video.) After striking her in the face, Sgt. Smellie (who had deliberately concealed his badge number) hit Ms Fisher twice with his baton, across the back of her left thigh and then on her calf.

But don’t hold your breath – even The Economist has had to cough out: “Bad apples of the sort now starring on YouTube are seldom brought to justice: no policeman has ever been convicted of murder or manslaughter for a death following police contact [brutality], though there have been more than 400 such deaths in the past ten years alone. The IPCC is at best overworked and at worst does not deserve the “I” in its name.”

Fiona Murphy, writing in the Grauniad, tells:

In September a mother was called to a south London police station following the arrest of her teenage son on a charge of stealing a bike. The boy had never been in trouble before, and had borrowed the bike from a friend with the friend’s permission; his mother assumed that she was attending to explain the mistake. She arrived in the custody suite to find that her son had a bruised and swollen face and was holding an evidential bag containing the broken fragments of his teeth.

He alleged that a sergeant in the Territorial Support Group (TSG), the Metropolitan police’s specialist riot squad, had struck him with such force that he had been knocked to the ground. The mother had two requests: that the sergeant be arrested; and photographs be taken of her son’s injuries. She left the police station without either being addressed. Two months later the officer, who her son had identified, has not even been interviewed.

This is a typical story of how the police respond to complaints of violence, and tells us all we need to know about how a culture of impunity has developed in the TSG. Figures obtained by the Guardian reveal that, despite receiving more than 5,000 complaints in the past four years, only nine were “substantiated” following investigation.

The TSG complaints “in box” is obviously “file 13” -

Earlier this year the Met paid £60,000 in damages to 34-year-old Babar Ahmad, and made unprecedented admissions that he had been punched, kicked, stamped on and strangled by officers during his arrest at his home in Tooting, south London. It has been particularly shocking to learn from this case that even when several members of the public complain against the same rogue group of TSG officers, no decisive action is taken. Of over 70 separate complaints recorded against the group of officers involved in the assault on Ahmad only one was substantiated, and no further investigation was undertaken.

The Independent Police Complaints Commission (IPCC) and the Met appear to be engaged in a wilful failure to acknowledge the cogency and seriousness of complaint patterns against individual officers and, perhaps more significantly, groups of officers working in concert. Ten months after the Met commissioner’s admissions in relation to Babar Ahmad’s civil litigation, no officer has faced disciplinary or criminal sanction – despite several refusing to give evidence.

I’m not even going to waste my breath telling you about the police state. At the arse-end of 2009, the country is split three ways: those who believe it, those who refuse to believe it despite all the evidence to the contrary, and those who are enforcing it.

Way back in August, I wrote about an incident involving some members of my club’s B ride who were ticketed for not stopping at a red light before making a right turn.

We were stunned to find that the fine for such a violation is $217. That struck most of us as excessive. The question became, what to do about it?

(BTW, I was not one of the ticketed riders. The incident happened while I was away on vacation.)

Two of the riders decided to simply pay the fine and avoid the hassle. A third, Judy, also planned to pay the fine, but because of an illegible date written on the ticket, discovered that she was overdue, and the fine had gone up to $275!

That’s a lot of money, so Judy requested a court date. In a municipal court situation like this, the options are to pay your fine, request a jury trial, or appear before a judge. Judy sat down with a prosecutor and played “Let’s Make a Deal.” She got a reduced fine of $150. (Traffic violations are dropped from your record if you don’t have another one within three months, but biking violations don’t appear on your driving record anyway.)

Pippa had to get a later court date, because she had to travel back home to the UK for a few weeks. When she did appear in court, she had a similar experience as Judy. But Pippa balked at the $150 fine. Can’t you do any better? she asked the prosecutor. It turned out that if she agreed to 10 hours of community service, he would reduce the fine to $111.

“Does the Lady Bird Johnson Wildflower Center qualify for community service?” asked Pippa. The prosecutor flipped through a listing, and confirmed that it does.

“Perfect,” said Pippa. “I volunteer there anyway.” So Pippa wound up paying the least amount, and didn’t add work to what she was already doing.

The moral of the story: If you’re ever ticketed for a biking violation, request a court date. It’ll cost you less in the long run.

Derbyshire police have received a number of reports from residents relating to security companies co

Derbyshire police have received a number of reports from residents relating to security companies contacting them by phone offering home security surveys, alarm systems and crime prevention advice, stating that they will be in your area shortly. If they mention that they are working for Derbyshire police, they are not.

Some companies use high pressure selling techniques once they visit your home. If you require any security advice, please speak to one of the Crime Reduction Officers at Buxton police station by calling 0345 123 33 33.

There are many scam e-mails in circulation informing people that they have been chosen for a cash award or request a cash transfer. These should be ignored and deleted.

Please be aware of bogus calls from telephone salespeople who give the impression that they work for the emergency services, selling advertising space in publications such as magazines, diaries and guides. They rarely give a name, company name or telephone number. If you are approached in this way, our advice is -

Watch out for salespeople who don’t give their full name or company name, or the exact name of the organisation they say you will be helping – for example, “It’s Dave from the fire service or the police crime prevention department”.

Take a name and telephone number and ask for the offer to be made in writing. Never make a commitment or agree to make a payment on the spot without taking time to think about the offer.

If you are in doubt, tell Consumer Direct by ringing 08454 04 05 06 or emailing from their website.
