Quanell X, a Houston community activist, is demanding that an Black police officer who used racial slurs and curse words to describe Black people,  be fired immediately!

( I hadn’t read the story and already agreed with the man!)

Seems last Saturday there was a robbery at the Hush nightclub.   This officer-who’s identity the Houston Police Dept is witholdin’, evidently was one of the officers to respond.

This knuckle-head is on VIDEO TAPE tellin’ a local promoter, “F**k ni**ers,” following a robbery in which a cash register was stolen.

Corey LeDay, was explainin’ $30G’s had been stolen with the cash register!   The “Unamed Officer” just went off:

 “So f**k yo’ money. F**k Prairie View!   Because you know what?   The mutha f**ers shouldn’t have been here to begin with.   Because the same mutha f**in sh*t happened the last time.    Mutha f**kin n***ers don’t know how to act.   That’s the bottom f**ing line.”

So what the h3ll was his problem??  He needs to shift into damage -control mode now.   This is not goin to blow over real soon.  He did issue a bullshyt-a$$ statement, somethin’ about his frustration’s gettin  the best of him, and that “the promoter was only concerned about his lost profits, (Duh-this is $30G’s dude!)and not ‘the welfare and safety of innocent people”.

Thats not gonna be enuff.   If you havin’ breakdowns like this, then maybe you don’t need to be Five-O.  This is the M.O of a mofo who will beat and even kill a citizen, talkin about safety and welfare of…what if that promoter hadda kept talkin?  Hey – you never know…

But that is still no excuse or reason!

Four weeks of break with much less to do compared to the average semester or summer means there is more time to get out and adventure, or meet up in Manhattan and have a school reunion with people you definitely didn’t think you’d miss when finals came around last week.

Investing in Penny Stocks is a dangerous game – is it a universally accepted form of gambling, like choosing a used car dealers – or may I suggest – ULK! and attorney.
Why? There is a machinery existing which makes unthinkable amounts of money promoting stocks – brokers, market makers, promoters, blogs, social networking sites, media – print, phone, television, phone rooms, chat rooms etc. etc. etc. the “information providers” and by now I think you get the idea. Too much information from too many sources promising too many good things.
So how should one invest in penny stocks well I call it the TARR programmer.
Before making a decision to invest in a particular penny stock follow the TARR rules:
(1) Track Record
Does the particular promoter or information disseminator have a track record which is positive?
This is easy to find out – just look at the company’s performance record in its “Picks” over last few months.
(2) Advisors
Before taking a high risk jump off the 10 meter board into the pool of penny stocks – get some professional advise from your accountant, or lawyer, or financial planner. Tell them what you want to buy and ask them to determine in their particular opinion is it worth investing into a particular Penny stock.
(3) Research
Before buying a particular penny stock ask your advisers or “information provider” to give you some information on the particular company’s stock you wish to buy. If there is no information available – DON’T BUY. If there is information – READ IT, then make a decision.
(4) Reputation

Is the reputation of the information provider good or excellent? If it is anything that at all seems inferior don’t buy – the penny stocks are a high risk game.

So TARR – if all indications are right – hire the lawyer, buy the used car or buy the penny stock – But this is 2009 so even if every indicator is positive, circumstances beyond yours or anyone elses, control may hurt your investment.

George Michael will perform two Australian concerts in February, and the first will be in Perth.                                                          

Rumours had been rife that the Too Funky star was headed down under, and today his Australian trip has been confirmed.

Heading to Australia for the first time since 1988, the Wham! star and solo pop vocalist will perform at Member’s Equity Stadium on February 20.  He will then perform in Sydney at Sydney Football Stadium on February 26.

He will perform tracks from the early days, Wham! and his latest material.

Promoter Paul Dainty said it was thrilling to bring Michael back to the country following his Faith tour in the 80s.

“He is a consummate performer and will deliver a stunning show to his fans who have waited 22 years to see him perform in Australia,” Dainty said.

Michael has performed for more than 2 million fans on this 25 Live arena tour so far. More than 350,000 people flocked to his London performances alone.

Michael has sold more than 100 million pop albums, had six American number one singles and won plenty of awards for tunes including Faith, Wake Me Up Before You Go-Go, Careless Whisper, One More Try, Freedom, Don’t Let the Sun Go Down on Me and Too Funky.

The funny thing is at the Examiner website, my topic is Canadian music, which is a large and broad topic, however, I’m not allowed to write about anything else. This of course leaves out many great musicians/indie bands out there. So, I’ll use this blog to put up some cool new “foreign” music that I’m not allowed print at the Examiner.com/Canada.

You know that saying, “when you least expect it, you get it!”, well that saying goes far in explaining how I got introduced to this next band’s music. Normally, it’s myself trolling through the internet, music sites, listening to songs, looking for that group that just shines & sparkles. Oftentimes it’s few and far between. This time the band, found me on Twitter. I usually find my way listening to most of what people send me, but realistically I only time to write about a certain number of acts.

There are many ways to look at indie: just starting out & trying to find their sound; those that are starting to turn heads & have the talent, and are gigging like mad to make it (at this time they are pretty much ready); Indie/underground groups that have been around so long that they are very respected, but shameful they didn’t break through into the mainstream.

I would class the Junior League band in the second category, as they certainly are up and coming, but they bring a throwback roots/americana/country/acoustic sound. The Lissy Rosemount (the singer) stands out from the pack as her soulful voice that is truly unique, & the band has that polished sound that comes with many performances together. Anyway, you can check out their videos for yourselves. I chose: South Carolina Blues and Kiss You In The Morning b/c. they are more their “music videos”, the other clips are more raw performances.

So how did all this come about? Well some years ago I was handed the reins of a private company, we will call it “M5”, with the intention that it eventually go public. After all I was an experienced, educated, self titled genius. Now I have survived jungle treks, sailed the seven seas, even experienced the gourmet taste of stewed “Dog” in Asia – but nothing prepared me for the experience I was to embark on.

First step is to raise a little seed money from my close friends and business associates. Hey John, I hear you are doing a deal, here is some money. Son, is this a good deal? Darling I love you, how about making me some money? So the seed money is collected, a project is started. Lawyers, Market Makers Accountants and a host of others are hired to perform their magic. I am assured by everyone, I retained, it will take 6-8 months, to list.

Two years later, hundreds of thousands of dollars spent, the overhead continues and the bank account is dry. My advisors tell me only 4-5 weeks left and M5 will be listed. So with much reluctance I raise more seed monies. “John this is my line of credit”! “John this my retirement fund”! John this is all I have”!

Three months later still not listed, Murphy’s law the phone rings “you scammed me!”, you “knew it would not go public!”, “you are a liar!”, “my lawyer told me you were a bad person”!!

How does one explain the following to your investors?
Financial crisis!
My partners went bankrupt!
The lawyer retired;

You suddenly hear from those that gave their precious few remaining dollars to you for M5, so it would list. They start calling you, emailing you.  Where’s my money? Where are my shares?  Why isn’t M5 public?  And finally you Scammed Me!!

What do I as a promoter do? They won’t accept any explanation! – John Taylor pays some monies back, retains a new lawyer, raises more seed and continues the quest of a listing.

Or did John Taylor move to China, buy a Junk, a blender, and a case of Tequila?

There is probably no other profession than the music business where California Music Lawyers spend so much of their time advising their clients how to avoid being taken advantage of. Unfortunately, without the music industry, you can’t be seen or heard. You need them as much as they need you. If they could sing or dance without you they would. But they can’t. The trick is to see that they don’t take everything from you without leaving you the ability to receive the compensation you should receive for your talent and abilities.

Music contracts are notoriously long, complicated and almost undecipherable to all but a music lawyer. Thirty page contracts are nothing unusual in this business. And there are so many contracts you will be faced with as a musician. Sign the wrong contract and you can be married to a bad agent, promoter, manager, distribution deal, publishing deal or record company and have your career over before it ever began.

Besides the issues you will face with copyrighting your music and trademarking your band name and logo, if you have one, there are management contracts, recording agreements, publishing contracts, agent contracts, distribution deals, licensing contracts, promotion deals, festival and concert contracts, producer agreements and that doesn’t even get into the complex issues contained in many of these agreements.

A music lawyer must have knowledge of synchronization rights, digital rights, peer to peer file swapping, sampling, mechanical licenses, copyright infringement, publishing, advertising law, immigration, employment law, negotiation, ring tones, and have a good understanding of how music is made from mixing to mastering, from the roles of the producer to the needs of the musicians.

And yet, for the music lawyer, there is little that is as rewarding as being part of the recording process or helping a group or an artist make it to the big time.

My advice to musicians just starting out and being presented with any type of contract is that having their contract reviewed by a music lawyer is essential. You are likely being presented with the most one-sided type of contract in any business or profession. They are written by the attorneys for the company or manager who is handing it to you with absolutely no attempt to be even handed.

Worst of all, at this stage in your career, you have little leverage. No matter how good you think your music is, the music world is littered with great musicians who signed horrible contracts that stifled if not ended their careers. If you have to do an extra gig and save the money to have a contract reviewed, that’s what you need to do. Get yourselves a good music lawyer. Not a divorce lawyer. Not a trial lawyer. An entertainment lawyer who knows the music business and one, preferably, who is interested in music and who is willing to listen to your music.

Bungee jumping without a cord quickly comes to mind as I write this article. I have read the “Spams”, the “Touts”, My Space, Twitter, and the odd paper solicitation. I am familiar with astounding predictions of doubling ones investment in a day – ( 1 cent to 2 cents a share, a 100% gain), or of amazing assay results, and miracle cures. I have seen and read it all. Am I experienced, of course, I lost my retirement funds, hoping some NEW found formula would be a quick fix for HIV.

Lets get back on track here. I am a firm believer in equalization. For every loser there is a winner and vice versa.

We NEVER hear of the Merits of Penny stocks. All we ever read about are scams, prison terms, and/or conspiracies.

Penny stocks are an essential part of the business world. They provide the vehicle for small businesses to grow. Penny Stocks are the result of the entreprenevial skills of promoters. Let’s give penny stocks and promoters a break! A promoter not only must create and run a business but also must create and establish a Penny stocks listing, and run the public side of the company.  Two jobs not one. Gene Barry died Dec. 9 at the age of 90.

He came to prominence first in the 1953 film, “War of the Worlds” and then moved on to household name status when he played in the “Bat Masterson” series in the late 1950s. Less has been written of his singing and dancing talents, but longtime Arkansas observers say Barry once appeared at the Vapors Club in Hot Springs during the heyday of his fame between “Masterson” and “Burke.” Some contend that Barry may have been scheduled in the Vapors once when the notorious club was bombed and had to be rescheduled in a nearby club. (Barry made several appearances in Broadway musicals.)

Ironically, William Barclay “Bat” Masterson, the longtime lawman-gunslinger-gambler-promoter-sports writer on which Barry’s “Masterson” character was based, was reportedly a big fan of Hot Springs in its prime as the nation’s favorite resort and gambling center.
