<p><strong>($217.59 &#8211; $27.99 = $189.60 remaining for 30 days)</strong></p>
<p>This pretty much finishes the shopping week, though I will post a final &#8220;total spent this week&#8221; Wednesday night, with any additional buys.</p>
<p>So, here is the breakdown. I ended up getting buy one @ $1.79, get one free on the organic carrots, because the deal they had on their other carrots @ buy 2lbs get 2lbs free was out of stock. So I didn&#8217;t walk out of there with 4lbs of carrots for two dollars like I wanted to (what does one do with four pounds of carrots anyway? I would have found out), but I didn&#8217;t walk out of there with only a pound for 2 dollars, which is what could have happened if I hadn&#8217;t asked an associate for help. I never ask for ANYTHING when I go to a store; I guess it really does pay to ask questions. The cauliflower was more expensive than I thought it was going to be at this point in the year, but only by a dollar, and I have enough to spread throughout a couple meals. I want to do a massive cauliflower mac of some sort.</p>
<p>On the receipts, you can see I put stars on the left one to highlight actual food items, since mostly I just restocked my kitchen tools/supplies a bit. On the second receipt, I crossed out the items that were there for coffee purposes, as I stated I would (though it should be noted that I got them on deal, and then applied my one and only coupon!) What is missing from the receipt is the kiwi I bought for fifty cents, which apparently didn&#8217;t get scanned. I am half wondering if I actually brought it home with me (eeep!). The vegan crumbles were the most expensive item I bought, as I thought they would be. I am going to spread their usage into two meals by extending them with TVP. The B loves his tacos! It might not be a bad idea to try to extend anything that costs more than 3 dollars into two meals (4 really, for two people)  if possible, just as a general shopping rule.</p>
<p>My fridge and pantry looks pretty full for the week. A few of the items from this week&#8217;s shopping should last for a while. The milk is vanishing faster than I would like, so I will probably have to buy more mid-week, siiiiiigh, and I have yet to make the yogurt. I have a bit of prep-work ahead of me this weekend to make the work week more enjoyable, and to make sure none of what I bought goes to waste. I have some old potatoes at risk of this very fate that I want to try to save to turn into something edible again&#8212;if possible. They might be too far gone. Money down the drain and lesson learned (to be determined).</p>
<p>Something hopeful I am keeping in mind: seasonal veggies and fruits are pretty sparse right now in my location, which makes them pricey. That should be changing here within the next month or two *crossing fingers*. I should be able to spend the same amount of money and get two to three times as much for it. Since we have cut back on prepackaged food, there is plenty of room in the freezer to store extras until we need them, thereby eliminating waste AND cutting cost.</p>
<p>I&#8217;ll touch base this week and let you know what we do with this haul.</p>

<content:encoded><![CDATA[<p>Ihr habt noch Blätterteig im Kühlschrank übrig und ein paar Tomaten, dann kann man mit diesem simplen Rezept ein leckeres Frühstück zaubern oder aber auch einfaches Fingerfood zum Brunchen oder für das Buffet.</p>
<p>Reicht für ca. 12 Stück:</p>
<p>Eine Portion Fertigen Blätterteig (275g)</p>
<p>2-3 aromatische Tomaten in etwa 0,5 cm dicke Scheiben geschnitten</p>
<p>eine Knoblauchzehe, gepresst</p>
<p>etwas Olivenöl</p>
<p>Basilikum</p>
<p>Sojamilch oder Wasser zum Bestreichen </p>
<p>Salz und Pfeffer</p>

<p>Den Backofen auf 180 Grad vorheizen.</p>
<p>Den Blätterteig ausrollen und in etwa 12 gleichgrosse Quadrate unterteilen. Die Tomaten waschen und in 0,5 cm dicke Scheiben schneiden. Den Knoblauch pressen und mit etwas Olivenöl und dem Basilikum vermischen.</p>
<p>Die Blätterteigstücke mit Sojamilch bestreichen und die Tomatenscheibe in den Teig drücken. Mit dem Knoblauchöl bestreichen und mit Salz und Pfeffer Würzen.</p>
<p>Im Ofen ca. 15-20 Minuten Backen, bis die Ränder gebräunt sind.</p>

If I were shopping at one store, I would have put back a pack of wings or thighs, or perhaps a bag of apples. Instead I put back my baking essentials of honey, vanilla and something else at the 2nd store, in order to stay closer to the budget of $100. It&#8217;s not a hardship to be without stock for cookies or muffins. Choice!</p>

<title><![CDATA[Project Minimalist: Leave the tag on and keep the receipt!]]></title>

<p>For the longest time I had a really unhelpful habit of tearing the tags off of newly purchased clothing.</p>
<p>I always thought, &#8220;I LOVE this. I am seriously never going to want to return it. I can wear it now!&#8221; But as time went on, I realized that there were so many pieces of clothing I would wear once or twice and would (too soon) toss to the back of my closet. Months later I would discover the forgotten pieces, and mourn my neglect.</p>
<p>Recently I have been practicing a different approach to shopping. I leave the tag on and keep the receipt. The best part is, realistically you can get away with wearing your newly purchased pearl a few times around the house to get a better feel for it. You can spend a couple of days deciding whether or not this is something you <em>really</em> want and will use. Maybe you&#8217;ll change your mind the next day when you realize that there just isn&#8217;t enough room in the shoulders for you to breathe comfortably. Or maybe you have something in the back of your closet that is almost identical to the thing you just bought, and you&#8217;d rather just use the one you have.</p>
<p>By leaving the tag on, you empower yourself to change your mind. There are many positives to this approach. Making lots of returns is a great excuse to go on another fun shopping trip. And you get the best of both worlds: you can experience the ecstatic highs of shopping like a fiend <em>and</em> the even-keeled, deep satisfaction of returning unwanted or unneeded items.</p>

<content:encoded><![CDATA[<p>Ask any retail worker, they will all agree: returns are the worst. They drop your ROV (returns on visit) and can make your struggling net sales goal plummet to negative. Typically, returns transactions involve the item[s], a receipt and a card. Occasionally there will be no receipt; in that case, most stores offer store-credit for the current price of the item.</p>
<p>Last winter I stood at the counter when an older lady dressed in a lavish, calf-length black coat walked up and addressed me.<br />
&#8220;I bought an item online and it didn&#8217;t fit so I returned it by mail. Here is my receipt.&#8221;</p>
<p>I scanned the receipt, failing to understand why she was in my store if she&#8217;d returned the item. When I asked she said:<br />
&#8220;I want my money back.&#8221;</p>
<p>The client believed she was owed money from the return. Again, I scanned the online receipt to decipher how she paid. It listed a store card.<br />
&#8220;Ma&#8217;am, it looked like you paid with our store card.&#8221;<br />
&#8220;No, I don&#8217;t have your card.&#8221; She replied, assuredly.</p>
<p>The paper I held clearly stated how the clothes were purchased.<br />
&#8220;Yes, you do?&#8221; I told her hesitantly, not wanting to be rude. &#8220;We can look you up in the system, but I cant give you money&#8230;&#8221;</p>
<p>This notion seemed to baffle her. It seemed to her that all money was company money; therefore, she was entitled. When I began to explain that she wouldn&#8217;t receive money for the return, that her credit would merely be wiped clean, she still didn&#8217;t comprehend.</p>
<p>Finally, in an last attempt to help the customer I called Support to check her credit balance. I handed her the phone, the springy black cord yielded taught over the counter. She listened attentively and I watched as her concerned eyes set deep in her furrowed expression. Support vouched that the return had been proceeded and her credit balance was zero.<br />
&#8220;So you won&#8217;t be giving me money?&#8221; I heard her ask. There was a brief silence then a heavy sigh.<br />
&#8220;Okay.&#8221; She then gave me the phone and left the store.</p>
<p>Lesson to be learnt: returns are a pain on all levels. My tip? Don&#8217;t buy something unless you have time to try it on for fit, and only then if you love it. Returns hinder store&#8217;s daily goals and they waste your gas and time!</p>

<content:encoded><![CDATA[<p>&#8230; what else is there, lol? Absolutely <em>LOVE</em> putting together a simple platter like this. Admittedly, it&#8217;s a basic one compared to my other efforts &#8230; but it was only the two of us, and there was plenty of food &#8230; plus I don&#8217;t need to always impress the <em>hellouttaya</em> &#8230; for a last minute, <em>quickie-throw-together-thingie</em>, it worked out great. That&#8217;s my fave focaccia again, Jarlsberg, extra old Cheddar, salami, another salami, ham &#8230; but what really got me excited was the new speck available at my <strong>Highland Farms</strong>. My receipt in shorthand form referred to it as <a href="http://austriansausages.buyorderonlineshopping.com/?Handl_Bacon_Speck_Tiroler_Schinkenspeck" target="_blank"><strong>H/TYROL SCHINKENSPECK SMKD</strong></a> &#8230; it&#8217;s Austrian, it&#8217;s smoked &#8230; and it&#8217;s <em>FANTASTIC</em> &#8230; 3pics y&#8217;all, enjoy!!</p>

<content:encoded><![CDATA[<p>My birthday is coming up and every year I get a new purse. Nothing crazy. Nothing pricy even. I usually get what works for me at Kmart. Told you it wasn&#8217;t pricy. </p>
<p>Kmart offers the option to email your receipt. I like this idea actually. I glanced at the clerk&#8217;s screen as I was paying and something completely inappropriately funny caught my eye. I wasn&#8217;t 100% sure I was correct so I had to wait a few moments for the email to arrive before I could verify the comedy in what I saw. </p>
<p>Ready?  Ok, look at the second item an tell me I&#8217;m not the only one to find that a hilarious promise from a purse. </p>

<p><strong>Fire</strong> <strong>Love Affair</strong><br />
Fire has always fascinated me. I was young pyromaniac. I remember once hanging out with a friend and we decided to burn photos and papers in my attic. It started to smell like smoke and the smoke was raising up out of  the pail. We started to get worried we would burn the garage down and my friend doused everything in water. I was sad to see the flame go.  I always have candles in my room and I&#8217;ve wrote poems about the flame and it&#8217;s dancing. I believe in the beauty of a small light in the dark. The shadows it causes reminding us there is always unknown in darkness even when there is light.  But also, the dark is not to be forgotten. What purpose would a light serve if there was no dark? What beauty would the bright light have in not surrounded in darkness. But, also, the flame reminds us  to be cautious. To not be blinded and deceived.  So while the flame itself may be enticing and tantalizing, beauty can be found in the shadows on the wall. If you touch the flame you will be burned, but if you slink in the shadows you are comforted from the heat.</p>
<p>So, my love affair with fire, I knew IF I did this challenge that would be the prompt I picked. I can&#8217;t draw and I can only doodle two things.<br />
Stick figures.</p>
<p>And  a flame.</p>
<p><strong>The story behind my drawing.<br />
</strong>Like I said, I can&#8217;t draw. So I was thinking how I can draw without drawing. Then I had a memory from a month or so ago.</p>
<p><em>I was at work one day. During  the slowest part of the slow season of working retail. So, I was milling around the registers with two co-workers. We were working the socks and underwear side of the store that day which makes work that much more&#8230;less. It doesn&#8217;t get messy when it&#8217;s slow, everything is in packages. And customers rarely like assistance. They like to keep their underwear size private.  So, we were milling around chit chatting. </em></p>
<p><em>My boss walks up and is grinning from ear to ear. He says</em><br />
<em>&#8220;Tasha, close out these two registers!&#8221;  pointing to two on opposite sides of each other. Confused because we were hours away from closing time and we don&#8217;t close registers until ALL customers are out of the store( not just our department/floor), I ask why.  He said since it&#8217;s slow we&#8217;re getting training in how to use the portable registers ( basically it&#8217;s an Iphone 5 with a scanner attached to scan the items and a slider to swipe the credit card).  This will be my first time using one so I&#8217;m nervous and excited. </em></p>
<p><em>I close one register. My co-worker closes the other. My boss tells me to go to the cash room with the take and then sign out a libby( it&#8217;s what the device is called). </em></p>
<p><em>So, I grab the envelopes for the resister I closed and i grabbed the one my co-worker closed and I was about to walk away when he stopped me. He asked me if I knew his number. We have associate numbers and it goes on everything. When we close a register we type it in the system, write it on the paperwork and give our number to the cash room assistance who takes the cash draw.   I tell him, of course I don&#8217;t, I was just going to use my number. He told me to hang on he&#8217;ll write it down. </em></p>
<p><em>So, i stand there and watch him go to a register and press the button to dispatch a strip of receipt paper. He looks for a pen for like 2 seconds and I start to look around too, but already know all the pens are gone. We keep a pen at each register, sometimes two because we circle a survey the customer can do and also write our name on the receipt so the customer can leave feedback about us. The pens always disappear. </em></p>
<p><em>So, I start to tell him just tell me the number , I&#8217;ll remember it. When he takes his thumb and scribbles on the receipt paper. Then all nonchalantly he says &#8220;here you go&#8221; and thrusts the paper at me. </em></p>

<p><em>I look at the receipt in his hand and then look at him and said </em></p>
<p><em>&#8220;Wait, what just happened&#8221;</em></p>
<p><em>He laughs. He tells me most types of receipt paper you can use your nail to write on it . It&#8217;s makes a friction scratch and it levels a pencil like marking. </em></p>
<p><em>Mind = blown. </em></p>
<p><em>I grabbed the receipt from him and immediately began scribbling with my nail and it my amazement, it left marks. </em></p>
<p><em>My face was like a kid on Christmas. My co-worker laughed and I walked away smiling all the way upstairs to the cash room.</em></p>
<p>Invisible flame eh?It doesn&#8217;t get much more invisible than drawing a flame with <em>invisible ink</em>. SO here I present you with my flame on a random receipt paper I had lying around. It&#8217;s not my best flame, I haven&#8217;t drawn one in years. And, I clipped my nails yesterday so I had little to work with. But, I&#8217;m quite happy with it.</p>

<p>So folks, I hoped you enjoyed my story of my love affair with fire. Just remember, just because something burns you doesn&#8217;t mean its meant to harm you. Fire can save your life. But, just because it&#8217;s beautiful, doesn&#8217;t mean it&#8217;s safe. Fire can consume quickly, consuming a human in mere seconds. The light does not always equate goodness and the dark does not always equate evil. Fire, my friends, its beautiful, dangerous , enticing and enchanting all in one. But, so are the shadows cast on the wall.</p>

<content:encoded><![CDATA[<p>I was a character in the pilot of a new TV-show about zombies. I was about to start working in a small convenience store which zombies often frequented since we had some sort of agreement with them. We took care of their used weapons and stuff and they, as long as we put the receipt of their purchase in our hair, could not attack us. There was one girl early on who had it in for me, but because of this rule I could stay safe. My best friend, who was a guy, hung out with me in the store a lot of the time (and at one point started kissing me!) and was there when a new zombie character came in. The zombie was kind of funny-looking and I had a feeling he would be a regular on the show, thrown in for comic relief.</p>
<p>There was something about him that I liked. He didn&#8217;t really have an attractive face but there was still something I was drawn to. Next thing I knew, we were in his car making out. The only part of him that was zombie-like was one of his hands, which he hid with a glove. He showed me when I asked him, but it was pretty disgusting so he covered it back up and we went back to making out and talking.</p>
<p>We decided to go out to the countryside for lunch. On the train I admired his physique. I kept saying how beautiful and hot and muscular he was, while kissing him, and he almost couldn&#8217;t contain himself. We had to step away from each other for a while so as to not offend the people around us.</p>
<p>When we got to the nice hotel where we had planned to eat, I had to go out of my way to avoid the dog pee that was on the gravel walkway to the main entrance. It surprised me because it was such a fancy place. Once inside, we were shown the very expensive menu and for some reason all the receptionists were Norwegian. We were debating whether to stay for lunch after all but we wanted to sit out in the sun rather than wait for dinner.</p>

<p>Sjuuukt mätt och endån har jag inte proppat i mig en massa mat. Här kommer en enkel och fettsnål maträtt. Tanken är att du ska inte vara petig och gillar t.ex grönsaker. Allt handlar egentligen om kryddningen. Så som jag förstår det så ska man inte salta för mycket om man tränar. En prio i taget tycker jag. kör på kyckling file och skurna morötter i ett vattenbad av olika kryddor som du kanske skulle föredra. jag körde fisksås, ingefära, chili, peppar och curry</p>

Dont be terrified by some healthy greens, just know how to season. So I putt chicken and carrots in plate of water. Add the spices you desire. <content:encoded><![CDATA[<p>Today was also prep day, which means I&#8217;ve been in the kitchen getting meals and food ready for both dinner and the week to come since I got home from the grocery. While one daughter laid down for a while then enjoyed a bath, the other played Operation and Clue Jr. with her daddy at the kitchen table. It was a lovely day.</p>
<p>Now, for this week&#8217;s menu.</p>

<p>And now for the receipt.</p>
<p>Notice I entertained two grocery markets today&#8230; a sunday&#8230; what was I thinking? However, I wanted to give Wegman&#8217;s a chance. Local friends are typically split between the two largest competitors in the area and I have to say, I&#8217;m sticking with GIANT for the majority of my shopping. I <em>will</em> continue to use Wegman&#8217;s to stock up on grass-fed proteins though. Their variety is to-die-for compared to what GIANT is currently offering and their prices are not insane. I was also a bit blown away by the Gluten Free section, although as I perused, I realized it was just more processed crap that I&#8217;d rather not eat. They had a few lower prices on certain items like Almond Flour, but their Coconut Flour inflation made up for it. Also, their gluten-free, non gmo cereals were priced at or higher than GIANT. Since I knew GIANT had Barbara&#8217;s brand on sale, and their organic apples (#1 on the Dirty Dozen) were dollars cheaper, I made up my mind that I would stop by on my way home&#8230; since it is on my way home.</p>

<p>I went over budget by $10.61 today, the most I&#8217;ve ever gone over. I only have myself to blame, of course, deciding to ask my husband if he wanted lunch meat when I got to GIANT. His response was &#8220;No. Bread, soda and chips.&#8221; DARN!  The soda and chips alone were $8.19 and I bought my daughter a new pack of hair bands for $2.96. Without these items I would have spent $99.46 between 2 stores.</p>
<p>From the meats I purchased, all were <a href="http://www.wegmans.com/blog/2012/01/organic-meat/" target="_blank">Wegman&#8217;s Organic Brand </a>. I also made sure to buy meats that would prepare well for more than one meal. For example, I knew I could use the leftover chicken quarters for a salad addition, we&#8217;d have roast beef for lunch and/or a leftovers dinner as well, OR I could use it in a stew. Always make leftovers!</p>
<p>Prep day went something like this:</p>
<ol>
<li><span style="line-height:13px;">Chicken wings marinated in Frank&#8217;s Hot Sauce, onions, bell peppers, butter, salt and pepper. Baked for dinner at 350 for 45 minutes, turned and brushed twice. </span></li>
<li>Chicken quarters baked at 350 for 70 minutes with butter, salt and pepper. Turned and brushed twice.</li>
<li>4 large meatballs, 8 medium meatballs and a heart-shaped meatloaf made from 2lbs of ground beef and 1lb of ground lamb. Added to the mixture: 2 eggs; 1/4(ish) cup of coconut flour; (in the food processor) carrots, onions, celery, dates;  salt, pepper, thyme and savory seasoning. All sprinkled with garlic salt.</li>
<li>A salad for my work-dinner tomorrow night was prepared while I made dinner salads. I added some of the extra roasted chicken to it after dinner was complete.</li>
<li>Mashed white (for husband) and sweet potatoes.</li>
</ol>

<p>After making a whole lot of dinner to satisfy each of our cravings (not my typical m.o.), we have half a dozen wings, 1 quartered chicken plus part of a quarter, and extra mashed potatoes for daytime meals and/or leftover night. Tomorrow, while I am enjoying my protein packed salad, my family will enjoy a meatloaf. I hope to have some leftover meatloaf with an egg Tuesday morning!</p>
<p>I forgot to boil eggs. They are such an important addition to my work-meals because of the protein and fat content. They fill me up and keep me going while on my feet. So, I&#8217;ll make time in the morning to boil a few.</p>

<title><![CDATA[It Is Better To Receipt, Than To Give (Without One)]]></title>

<p>For tax purposes a &#8220;receipt&#8221; is a document which confirms a payment to a third party. Whether the payment reflected in the receipt will be deductible will depend on the particular circumstances.</p>
<p><b>Income Tax</b></p>
<p>Generally a taxpayer&#8217;s income from a business or property will be the taxpayer&#8217;s &#8220;profit&#8221; for a tax year: Income Tax Act, §9(1). Conversely, taxpayers with employment income may only deduct such amounts as are expressly allowed: §8(1) ITA.</p>
<p>&#8220;Profit&#8221; is not a defined term and the Income Tax Act (&#8220;ITA&#8221;) provides no specific rules for its computation: Canderel Ltd. v. Canada, [1998] 1 S.C.R. 147 per Iacobucci at §34 (referring to Friesen v. Canada, [1995] 3 S.C.R. 103 per Major at §41).</p>
<p>The determination of &#8220;profit&#8221; under s. 9(1) ITA is a question of law. It will be determined in accordance with &#8220;well-accepted principles of business (or accounting) practice&#8221; except where those principles conflict with the specific provisions of the ITA (Canderel, above.)</p>
<p><b> Books And Records</b></p>
<p>Every person who carries on a business shall be required to &#8220;keep records and books of account&#8221; at their place of business or residence &#8220;in such form and containing such information as will enable the taxes payable under this Act&#8230; to be determined&#8221;: §230(1) ITA.</p>
<p><b> Filing Returns</b></p>
<p>Individual taxpayers must file income tax returns, when they owes taxes in a tax year: §150(1) ITA; they have to estimate the amount of the taxes they: §151 ITA; remit those taxes:§156(1) ITA; and it will then be up to the Minister of National Revenue (&#8220;MNR&#8221; but in practice it means Canada Revenue Agency (&#8220;CRA&#8221;)) to assess the tax for the year.</p>
<p>Accordingly the taxpayer files their T1 return, by April 30: §150(1)(d) ITA; and they purport to deduct their business expenses.</p>
<p><b>Best Practices</b></p>
<p>The Guide for Canadian Small Business (RC4070E Rev. 01; chapter 6) suggest that taxpayers&#8217; &#8220;should keep a day-to-day record of [their] receipts and expenses. A book with columns and separate pages for income and expenses is good for this. [They should k]eep this record along with [their] duplicate deposit slips, bank statements, cancelled cheques, and receipts. This will support [their] expenditure claims.&#8221;</p>
<p>Consequently, it is the best practice is for a taxpayer claiming a deduction to have third party receipts fully supporting all of their deductions; but, is it the only practice?</p>
<p><b>An Exception</b></p>
<p>Between 1990 to 1992 Anthony Merchant claimed a number of deductions, some of which were &#8220;without any supporting document-ation&#8221;: Merchant v. The Queen, [1998] 3 CTC 2505 per Bowman, J.T.C.C. §22.</p>
<p>&#8220;It is my view that there is no requirement in law that expenses be supported by receipts or other corroboration if such expenses can be supported by credible viva voce testimony and the amounts can be identified with a reasonable degree of specificity (Weinberger v. M.N.R., 64 DTC 5060)&#8230; Failure to keep books and records carries its own sanction [i.e., §238(1) ITA] but had Parliament intended that sanction to include non-deductibility of expenses it would have been quite capable of saying so&#8221; (Ibid, §23) [Emphasis added].</p>
<p>Generally speaking, the ITA is to be literally applied; e.g., Fayle v. The Queen (2005-01-12) Tax Court of Canada.</p>
<p><b>Deductions</b></p>
<p>It is possible to deduct expenses that are not fully supported by receipts. In practice, taxpayer&#8217;s don&#8217;t file their receipts with their return so if the MNR (i.e., CRA) doesn&#8217;t challenge their deduction, as claimed, through a reassessment they actually have the benefit if the deduction, without the receipt, but &#8216;possible&#8217; does not equate to probable &#8211; or even likely.</p>
<p><b>Reassessment</b></p>
<p>In most cases were the CRA does reassess a taxpayer to disallow their deduction of business expenses, or some of them, it will have reasons for doing so. Whether CRA&#8217;s reasons will be accepted will be binding on the taxpayer will be determined through Objections: §165(1) ITA; and/or the appeal process: Ludco Enterprises Ltd. v. Canada, [2001] 2 S.C.R. 1082; and Singleton v. Canada, [2001] 2 S.C.R. 1046.</p>
<p><b>Lessons Learned</b></p>
<p>In Mr. Merchant&#8217;s case, he was only partially successful, &#8220;[a] number of the other items listed&#8230; lack the degree of specificity as to the purpose of the expenditures&#8221; and to the extent the evidence found the evidence unconvincing, the Court declined to interfere with the assessor&#8217;s decision (Op. Cit., §24).</p>
<p>It is useful to remember that as the taxpayer is objecting, or appealing, they have the onus of establishing that CRA&#8217;s position is wrong, either in law, on the facts or both.</p>
<p>In Mr. Merchant&#8217;s case, although he was successful and ordinarily might have expected an award of costs, Justice Bowman took the extraordinary step of awarding costs against Mr. Merchant, to the losing party &#8211; and he did so on a solicitor and client basis (Ibid. , §61) in part, because:</p>
<p>o of Mr. Merchant&#8217;s distain for the Court (Ibid. , §56);</p>
<p>o his &#8220;reprehensible, scandalous or outrageous conduct&#8221; (Ibid., §58 relying on Young v. Young, [1993] 4 S.C.R. 3 per McLachlin J. at p. 134; and</p>
<p>o he deliberately frustrated the audit and objection process by bringing matters before the court that shouldn&#8217;t have been there. (Ibid. , §59).</p>
<p><b>A Better Way</b></p>
<p>The regrettably part of Justice Bowman&#8217;s decision, is his reference to the need for &#8220;viva voce testimony&#8221; to establish payments, absent receipts. Viva voce (Latin for living voice) statements, are given in Court, under oath, and just being in Court is undesirable for a taxpayer because they could be back running their business.</p>
<p>The moral of the story is that taxpayers who don&#8217;t intend to give money out of their after-tax income to third parties should get (and keep) receipts.</p>
