<title><![CDATA[China executes 2 for child abductions]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>BEIJING – China has executed two men for abducting and selling 15 children, many of whom were taken as babies or toddlers and have not yet been reunited with their parents, state media said Friday.</p>
<p>The official Xinhua News Agency said Hu Minghua, 55, and Su Binde, 27, were executed Thursday morning, according to a statement from the Supreme People&#8217;s Court.</p>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"><img class="alignnone size-medium wp-image-320" title="ChineseChildren" src="http://abpworld.wordpress.com/files/2009/11/chinesechildren.jpg?w=300" alt="" width="351" height="235" /></a></p>
<p>Hu was convicted of kidnapping and selling nine children from April 1999 to Oct. 2005. He was detained in January 2006. Five of the children, all boys now aged from 3 to 6, have been returned to their families, while the parents of the remaining ones have not been found.</p>
<p>Su was convicted of abducting six children between Sept. 2005 to July 2006. Five of the children were rescued by police while a sixth remains missing.</p>
<p>Child trafficking is big problem in China, where traditional preference for male heirs and a restrictive one-child policy has driven a thriving market in baby boys, who fetch a considerably higher price than girls. Girls and women also are abducted and often used as laborers or as brides for unwed sons.</p>
<p>Thousands of children go missing every year though the exact numbers of victims are difficult to obtain. Earlier this year, Chinese police announced they had rescued about 2,000 abducted children as part of a nationwide crackdown on widespread trafficking of women and children.</p>
<p>In October, China&#8217;s Ministry of Public Security set up a Web site — &#8220;Babies Looking for Home&#8221; — to reunite rescued children with their families.</p>
<p>State media have reported hundreds of rescues and arrests since the campaign began in April, and the new site had photos of dozens of children rescued from kidnappers but who had not yet found their families. The ministry set up a national DNA database earlier this year.</p>

<title><![CDATA[How to Win a Hague Convention Child Abduction Case]]></title>

<h5>Here are some tips for attorneys and clients faced with instituting or defending child abduction proceedings under the Hague Convention on the Civil Aspects of International Child Abduction, whether in the United States or internationally.</h5>
<h5>In a nutshell, a Hague Convention application may be made when a child is taken or retained across an international border, away from his or her habitual residence, without the consent of a parent who has rights of custody, if the two countries are parties to the Convention. The child must be promptly returned to the habitual residence unless the return will create a grave risk of harm to the child.</h5>
<p><strong>1. ACT FAST</strong></p>
<h5>An attorney must be ready to file a Hague Convention application and institute or defend a Hague Convention lawsuit on extremely short notice.</h5>
<h5>Prompt action may be critical. The Convention specifically requires that hearings be conducted expeditiously. A Hague case can theoretically be instituted more than a year after the abduction but a defense will then arise that the child has become settled in the new environment and, in practice, the longer a child is in a new place the more likely it is that a court will be reluctant to send the child away.</h5>
<h5>Fast action by the left-behind parent is also necessary to help prevent a claim that the parent has acquiesced in the child’s relocation.</h5>
<h5>Clients must move quickly to obtain the documents needed to file the initial application and then to collect the documents needed for the hearing. They should normally be asked to prepare a detailed family history and to assist the attorney to develop evidence as rapidly as possible.</h5>
<h5>In addition to the Hague application and lawsuit itself, counsel for the left-behind parent should take many other steps.</h5>
<h5>First, counsel should enlist the support of the U.S. State Department’s Office of Children’s Issues. Second, the left-behind parent should institute civil proceedings. If there is no custody order in place from a court in the jurisdiction of the habitual residence, an application should immediately be made for such an order.</h5>
<h5>Third, counsel should consider putting the abducting parent on immediate written and formal notice of the dire consequences, civil, criminal and financial, that the abduction will cause to that parent personally, and, possibly to others conspiring with the parent. It may be appropriate to provide an extremely short time for the abducting parent to cure the problem by returning the child.</h5>
<h5>Fourth, the parent should consider requesting the federal and state prosecutors to institute both federal and state criminal proceedings. The federal crime of international parental kidnapping is a felony with a penalty of up to three years in prison. In addition, many states including New York have provisions that also provide criminal penalties for parental child abduction. It will occasionally be possible to seek extradition based on a federal warrant.</h5>
<p><strong>2. PREPARE THE FACTUAL PRESENTATION INTENSELY</strong></p>
<h5>Hague Convention cases are often extremely fact-intensive. They frequently hinge on the ability of one party to convince the court of matters such as the habitual residence of a child, the extent to which a parent actually exercised custody rights and whether or not a parent consented to or acquiesced in a new residency. For a court to resolve these matters it must analyze the relevant facts.</h5>

<h5>A successful Hague proceeding requires the attorney, working closely with the client, to marshal as much evidence as possible, in as many forms as possible, to support the client’s position.</h5>
<h5>Clients are frequently shocked that matters that to them are obvious and indisputable turn out to be disputed and to require them to produce clear and convincing proof. They may well be insulted that their word alone is insufficient to convince the court that they are truthful and that the other parent is lying.</h5>
<h5>In one case, the parents had moved permanently with their young child from the mother’s native country to the U.S. Two years later, the mother took the child back to her country for a vacation and then refused to return to the States. In supporting her claim that the child was never habitually resident in the States she claimed that the original move to America had been only temporary and that she and the father had agreed that they would return to the mother’s native country after a year or two. The mother had planned the move well in advance and had amassed — and even created — evidence that tended to support her claims. Additionally, she had removed evidence from the parties’ home that would have disproved her claims.</h5>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"></a></p>
<h5>To win the case, we interviewed neighbors, friends, family members, schoolteachers, real estate salespeople, fellow office workers and an array of other people who had had some connection with the family. We checked into any and all areas of the mother’s life for anything that might indicate her intention to stay in the States. We obtained emails, notes, invoices, and other documents. We searched old household bills for evidence of the purchase of items that inferred a degree of permanency. At the hearing, the mother was shocked that her husband had collected so much written evidence to disprove her claims and undercut her credibility. The courts ultimately — and with great reluctance, since they were going against a local national — found in favor of our client.</h5>
<h5>Since Hague cases are tried quickly, there is usually only one chance to present the case and it needs to be done well at the very outset. An attorney must embark on a quick campaign of collecting mounds of relevant evidence to support the client’s positions, and must expect the other parent to lie, cheat, and distort the facts in a desperate attempt to avoid losing the case.</h5>
<h5>Just as a current military strategy is to employ overwhelming force to create shock and awe, so too in a Hague Convention case it is often advisable to use overwhelming amounts of evidence to win the case. Such a campaign in a Hague proceeding may yield a capitulation by the other parent even before the hearing actually commences.</h5>
<h5>Hague Convention hearings sometimes take the form of “he said, she said” disputes in which each side makes verbal accusations against the other. Documentary evidence is usually far better than the mere word of one parent. Thus, if you want to claim that a parent applied for an immigration visa, you must be prepared to do more than simply have the parent tell the court that this was done. You should do whatever you can to get hold of the actual application papers that the parent signed in applying for the visa, which may mean contacting the lawyer who handled the immigration matter originally.</h5>
<h5>While it is helpful if documents are supported by sworn statements, it is not essential. Both the Convention and the International Child Abduction Remedies Act (“ICARA”) provide that authentication of documents is not required in a Convention proceeding.</h5>
<p><strong>3. PREPARE THE LEGAL ARGUMENT INTENSELY</strong></p>
<h5>Hague Convention cases raise unusual international law, foreign law and treaty law questions. They involve the courts in matters of a kind that they are usually not used to handling. In many jurisdictions the court may be entirely unfamiliar with Hague cases. Accordingly it is usually essential for the lawyers to help the court to an unusual extent. Certainly a well-reasoned memorandum of law is essential.</h5>
<h5>The matters in dispute in most Hague cases raise difficult legal issues that must be thoroughly briefed. Thus, the Convention requires the left-behind parent to establish that the child was taken from the “habitual residence” and that the parent had “rights of custody” under the law of that jurisdiction. However, neither of those fundamental terms is defined in the Convention and substantial jurisprudence has grown domestically and internationally setting forth often-contradictory determinations concerning their scope and meaning. Moreover, courts have held that, while they must determine under international law whether the left-behind parent possesses Hague Convention “custody rights,” they must first examine the law of the child’s habitual residence in order to ascertain the extent of the rights that such parent possesses under that law. In this regard, it is often essential to use foreign law experts to establish the existence and scope of such rights.</h5>
<h5>A Hague Convention attorney may ” and should ” cite cases not only from the domestic jurisdiction but also from other jurisdictions if they support the client’s position. It has become more usual to cite cases from other jurisdictions in this area of the law than perhaps in any other. Courts around the world recognize that it is best to coordinate their decisions with those of other courts internationally and, for that very reason, the Hague Conference on Private International Law has established a database of significant Hague cases from courts around the world.</h5>
<p><strong>4. AVOID BEST INTERESTS ANALYSIS </strong></p>
<h5>In representing the left-behind parent in a Hague proceeding, it is necessary to keep the court focused on the narrow issues that the Convention requires an applicant to establish and the narrow defenses that a respondent can assert. Whenever the hearing strays into any areas that might be considered as constituting an analysis of the child’s best interests, the applicant should vehemently object.</h5>
<h5>However, a party opposing a return should do his or her utmost to assert any and all relevant issues under the rubric of one of the defenses specified in the Convention and should be armed with case law to establish that similar claims were permitted in other cases.</h5>
<p><strong>5. BE FLEXIBLE CONCERNING EVIDENCE </strong></p>
<h5>In Hague cases evidence rules are usually relaxed, so evidence should be submitted in any possible format. Live testimony is invariably the best and normally everything should be done to get the left-behind parent into the courtroom. (An exception is if that parent would be a poor witness and his or her presence would create an opportunity for embarrassing cross-examination). If a witness cannot be brought to the courthouse, consider testimony by video conferencing or otherwise by telephone conference. As a last resort, submit affidavits.</h5>
<p><strong>6. USE AN EXPERIENCED ATTORNEY: IF THAT’S NOT YOU, FIND SOMEONE WHO IS</strong></p>
<h5>Hague Convention cases happen too fast, and too much is at stake for the client, for an attorney to learn about this area of law at the last minute. It is extremely important to locate counsel with knowledge and experience in Hague proceedings.</h5>

Some authorities say that if your child is abducted, you should follow procedures outlined by the Hague, but we don’t agree.</p>
<p>Until 1980, there was no international system in place to help parents recover abducted children who had been taken to other nations. The Hague Convention attempted to create one, but it doesn’t work. If you take the time to read the well-intentioned text of the Hague, you’ll see its many flaws.</p>

<p>In our opinion, it’s not worth the large amounts of money, time and trouble to hire an attorney to try using the Hague Convention to get your child back. You aren’t likely to get him or her back — and even worse, the abducting parent could be “legitimized” by the courts in another nation.</p>

<p>Under the Hague Convention, a case must be filed in the country where the abductor has taken the child. The courts of that country tend to render their decisions in favor of their countrymen, as the Hague Convention focuses on residency, not citizenship. There is little concern for the fact that the child is a citizen of the country from which he or she was abducted, or for the possible detrimental effect on the child.</p>
<p><a href="http://www.abpworld.com/kidnapping_eng.html"></a></p>
<p>Even if the child was born in your country, if that child is found to be a “habitual resident” by the courts in another country, the child may be ordered to be returned to that country.</p>
<p>This underscores the need to act quickly.</p>
<p>Few, if any, of the Hague signatory countries are going to send anyone out to physically recover your child for you. Embassy officials will check on the child’s welfare, if it is known where the child is and if the abducting parent lets them.</p>
<p>As soon as abducting parents are aware that that they’ve been located, they’ll usually disappear with the children again.</p>
<p><strong>And about hiring lawyers</strong></p>
<p>You need to be aware that a great amount of money has been spent on lawyers in foreign abduction cases. The unfortunate fact is that they, most often, can’t practice in the foreign courts and are required to hire associate lawyers in the foreign country.</p>
<p>Note: they often have no qualifications or experience working with child abduction cases.</p>

<p><strong>Educate yourself</strong></p>
<p>Many resources are available to help you learn about parental child abduction. If you’re dealing with an abduction, the better informed you are, the better equipped you’ll be to cope.</p>
<p><strong>Recover your child</strong></p>
<p>Time is of the essence. Parentally abducted children are helpless on their own and confused by the irrational and sometimes abusive acts of non-custodial parents who are supposed to have their best interests in mind. <p style="text-align:justify;">This one didn&#8217;t seem to have the flair that is usually associated with James Bond. Maybe it&#8217;s just because of the fact that I&#8217;ve watched too many movies and have a feel for gadgets. Either way this one was a gadget-less mission.</p>
<p style="text-align:justify;">Bond seems to be on the verge of breaking down. He keeps irregular timings, he keeps making mistakes meant for a much lower class of me, and there is an aura of forgetfulness around him.</p>
<p style="text-align:justify;">M is then given advice by a psychologist friend to allow Bond to recover slowly by giving him a mission that will bring him back to his senses. It is then that Bond is sent for a diplomatic visit to Tiger Tanaka in Japan who is a high honcho in the secret service. To retrieve something that England needs, Bond finds himself trapped in the necessity to overcome death itself by trying to kill a world-wide crimnal who harbors an Island of Death.</p>

<p>I feel very lonely and lost without my eating disorder. I want more then anything right now to have it back. It&#8217;s still there, waiting  inside me, but faded and has definitely dwindled&#8230;I don&#8217;t like this at all. I wish I was healthy enough to say, &#8220;GOOD, GETTHEFUCKOUT AND LEAVE ME ALONE&#8221; but I can&#8217;t. I don&#8217;t know what I&#8217;m doing. I want it back. I want it back so bad.</p>
<p>For awhile, I&#8217;ve avoided pro ED sites and things online but I find myself going back once in awhile, more and more. I miss the chat, I miss meal plans, life plans, schedules for myself. I miss goals. I miss scheduling every second of my life, based around food. Why? When I say it I&#8217;m like, &#8220;Why would anyone miss that?&#8221; and I still have no idea. I do though.</p>
<p>I can&#8217;t stand the way I look. 131 pounds. 131 POUNDS. It&#8217;s the most I&#8217;ve weighed in my entire life. I could I let myself get this way? It&#8217;s 20 lbs heavier then I&#8217;d like to be. I can&#8217;t believe I look like this. I can&#8217;t believe I look like THIS. My brother lifted me up the other night and carried me. He said, &#8220;Whoa, you&#8217;re heavy&#8221; when he has ALWAYS, ALWAYS said, &#8220;You weigh like, nothing!&#8221; every other time he&#8217;s lifted me. What a good fucking time to say that. When I&#8217;m doing so &#8220;well&#8221; and then he says that and it throws me off and I KNOW I&#8217;m heavier now then I was before. Why did he say it? WHY did he SAY IT?!!!</p>
<p>I&#8217;m so stressed tonight and sad and I don&#8217;t want to eat again. I miss being hungry. I miss being starving. I miss flat tummy and being dizzy. I want it all back. Again, why? WHY? Why am I so fucked up that I want to digest nothing but tea and diet pills? What&#8217;s wrong with me? There&#8217;s something wrong with me.</p>

<p>Parental child abduction is a federal crime.  It is also a tragedy that jeopardizes children and has substantial long-term consequences for the “left-behind” parent, the child, the family, and society. Children who are abducted by their parents are often suddenly isolated from their extended families, friends, and classmates. They are at risk of serious emotional and psychological problems. Similarly, left-behind parents experience a wide range of emotions including betrayal, loss, anger, and depression. In international cases, they often face unfamiliar legal, cultural, and linguistic barriers that compound these emotions.</p>

<p><strong>International Parental Child Abduction Is Illegal</strong></p>
<p>Under the laws of the United States and many foreign countries, international parental child abduction is crime.  Removing a child from the United States against another parent&#8217;s wishes can be considered a crime in every U.S. state.  In some cases an abducting parent may be charged with a Federal crime under the <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00001204----000-.html">International Parental Kidnapping Crime Act</a> (IPKCA).  This can be the case even when neither parent holds a custody decree prior to the abduction. Nevertheless, a custody decree can be helpful to prevent an international parental child abduction, or to recover your child if he/she is abducted.</p>
<p><strong>The Importance of a Custody Decree</strong></p>
<p>A well-written custody decree is an important line of defense against international parental child abduction. In your custody decree, it may be advisable to include a statement that prohibits your child from traveling abroad without your permission or that of the court. Ask your attorney if you should obtain a decree of sole custody or a decree that prohibits the travel of your child without your permission or that of the court.  If you have or would prefer to have a joint custody decree, you may want to make certain that it prohibits your child from traveling abroad without your permission or that of the court.</p>
<p>If your child is at risk of being taken to a country that partners with the United States under the <a href="http://www.hcch.net/index_en.php?act=conventions.text&#38;cid=24">Hague Convention on the Civil Aspects of International Child Abduction</a> (Hague Abduction Convention), your custody decree should include the terms of the Hague Abduction Convention that apply if                            there is an abduction or wrongful retention (<a href="http://travel.state.gov/family/abduction/hague_issues/hague_issues_1487.html">see country list</a>).</p>
<p>The American Bar Association also suggests requesting the court, if the other parent is not a U.S. citizen or has significant ties to a foreign country, to require that parent to post a bond. This may be useful both as a deterrent to abduction and, if forfeited because of an abduction, as a source of revenue for you in your efforts to locate and recover your child.</p>
<p>REMINDER: Obtain several certified copies of your custody decree from the court that issued it. Give a copy to your child&#8217;s school                            and advise school personnel to whom your child may be released.</p>
<p><strong>Two Parent Signature Law for a Passport</strong></p>
<p>The United States does not have exit controls on its borders for holders of a valid passport.  This makes preventing a passport from being issued to your child without your consent very important.  Generally, if your child has a passport, it can be difficult to prevent the other parent from removing the child to another country without your permission.</p>
<p>U.S. law requires the signature of both parents, or the child&#8217;s legal guardians, prior to issuance of a U.S. passport to children under the age of 16.  To obtain a U.S. passport for a child under the age of 16, both parents (or the child’s legal guardians) must execute the child’s passport application and provide documentary evidence demonstrating that they are the parents or guardians.  If this cannot be done, the person executing the passport application must provide documentary evidence that he or she has sole custody of the child, has the consent of the other parent to the issuance of the passport, or is acting in place of the parents and has the consent of both parents (or of a parent/legal guardian with sole custody over the child to the issuance of the passport).</p>
<p>EXCEPTIONS: The law does provide two exceptions to this requirement: (1) for exigent circumstances, such as those involving the health or welfare of he child, or (2) when the Secretary of State determines that issuance of a passport is warranted by special family circumstances.</p>

<p><strong>Children&#8217;s Passport Issuance Alert Program</strong></p>
<p>You may also ask that your child&#8217;s name be entered into the State Department&#8217;s <a href="http://travel.state.gov/family/abduction/resources/resources_554.html">Children’s Passport Issuance Alert Program</a> (CPIAP).  Entering your child into the Children&#8217;s Passport Issuance Alert Program will enable the Department to notify you or your attorney if an application for a U.S. passport for the child is received anywhere in the United States or at any U.S. embassy or consulate abroad. If you have a court order that either grants you sole custody, joint legal custody, or prohibits your child from traveling without your permission or the permission of the court, the Department may refuse to issue a new or renewal U.S. passport for your child. The Department may not, however, revoke a passport that has already been issued to the child. There is also no way to track the use of a passport once it has been issued, since there are no exit controls for people leaving the U.S. If your child already has a passport, you should take steps to ensure that it is kept from a potential abductor by asking the court or attorneys to hold it.</p>
<p>IMPORTANT TO KEEP IN MIND:</p>
<ol>
<li>The United States does not have exit controls.</li>
<li>The Department of State may not revoke a passport that has been issued to a child, but you can ask a court to hold onto it.</li>
<li>There is no way to track the use of a passport once it has been issued.</li>
<li>Your child might also be a citizen of another country (dual nationality).  Even if he/she does not have a U.S. passport, your                               child may be able to travel on the other country&#8217;s passport.</li>
</ol>
<p><strong>The Privacy Act and Passports</strong></p>
<p>Passport information is protected by the provisions of the Privacy Act (PL 93-579) passed by Congress in 1974. Information regarding a minor’s passport is available to either parent. Information regarding adults may be available to law enforcement officials or pursuant to a court order issued by the court of competent jurisdiction in accordance with (22 CFR 51.27). <p>Youth is very lost today. Most teenagers think that by imitating the most barbaric actions of adults, they will be adults (L&#8217;Élégance du hérisson), and maybe for a moment they will FEEL like them, but no&#8230;being nonsense and getting drunk and high at parties to justify taking an emergency pill in the morning, does NOT make you adult.</p>
<p>If we are not able to rescue our art, if we are not able to rescue our culture, if we are not able to rescue our roots, how can we rescue our youth??</p>
<p>Art needs us, and it shows us that in the most humble ways. It doesn&#8217;t recluit us, it doesn&#8217;t tell us it&#8217;s the most crucial of the fields, but it does take us and lets us see the world from somebody else&#8217;s eyes. </p>

<p>The Hague Convention on the Civil Aspects of International Child Abduction created an international treaty and legal mechanism in order to find children that have been abducted. This is just one treaty or law that has been enacted in order to recover children that have been taken away from their loved ones. However, it is really important to make sure that every state has a means to deal with and track down children that have gone missing. Children get abducted for a number of reasons: •Intent to raise the child as their own<br />
•A parent takes the child from the other parent’s care<br />
•For ransom</p>

<p>Despite the seriousness of child abductions it is not publicized enough. This may in part be because the statistics are not very clear. Data collection by different organizations can differ drastically from the definition of “abducted child” to a motivation explanation. Consequently, comparing the numbers is not very helpful or simple. The need for a transnational database is evident in that it will help ascertain the significance of the missing children problem.<br />
Fortunately, in 2007 the European Commission declared the telephone number “116000” to be the single telephone number in the EU to make pressing calls about 3missing children. By securing a single hotline number, hopefully the “116000” number will help this lack of communication that can occur between the EU countries.<br />
Despite this effort to create a line of communication across European borders there is still not a child alert system that would create a network to look for children who may have been taken into a different country.<br />
The United States has a number of different laws that focus on this topic exclusively by engaging in actively preventing crimes against children as well as, similar methods to handle situations in which children go missing. With the ease of crossing borders in Europe it becomes apparent that it can be difficult to work with countries that follow different procedures to help children and this creates a complicated setting to recover and protect children efficiently and safely.<br />
Missing Children Europe is one organization that is tirelessly working to improve and enact legislation that will improve the mechanisms to help children across the European Union while simultaneously working to improve the quality and communication of existing means of handling missing children cases.</p>

But then I was glad that I had a good sleep although my nights are most of the time full of worries. I hope and pray that in my every prayer,Jah hears me and I believed He is. Sometimes I saw myself in a mirror healthily standing and I had dreaming of of seeing my self fit again, not this thin, I look forward to see myself again back to healthy Fhel.</span></p>
<p><span style="color:#800000;">I hope I had a good advise to a new friend on a phone, at first I don&#8217;t feel good about him but as he always calls and we&#8217;re getting to know each other,he knows most about me and he was telling me his&#8217; though I don&#8217;t know if it&#8217;s true or not. Yesterday in his call, I understand why he calls, he needs someone to talk to, now I know my instinct was right, he has problem with his gf,which he denies to tell me at our first talks. I have been true to everything I am answering to his questions and he knows I have boyfriend,he knows I am recovering,he was nice and I am glad he was able to open his story,the truth. He was crying on the phone and it is a different him, because on our conversations, he was jolly, he makes me laugh hard and he comforts me saying he&#8217;s glad meeting me and he learns from me. I told him last night to pray before he sleep so would sleep tight,worry-free and calm.And to my surprise he don&#8217;t pray! So I am eager to try to change atleast his spiritual life and I hope I can,it&#8217;s not too late.</span></p>
<p><span style="color:#800000;">I had a good sleep and a calmly and sweet-worry morning. I thank God for a new day, I asked Jehovah to touch me again and send me his instruments. And wish granted! I should wait always for his answers and believe that He will heal me. Got a help from a special person in my second life,my boss. He was so kind,understanding,good-heart and he was the best. </span></p>

<content:encoded><![CDATA[<div class='snap_preview'><p>This week, I spent a lot of time trying to recover. I watched hours and hours (and hours) of Big Love on TV, ate many popsicles, and pretty much drank an entire bottle of NyQuil. I felt so much better! And then I had a crazy whirlwind day of travel and excitement, as I attended my dear friend S.’s wedding. And now I don’t feel so great again.</p>
<p>S. is a friend from graduate school, and she was one of my running teammates this summer. We trained for many long and hard hours together. At the half-marathon in September, we held hands as we crossed the starting line. I was so happy to be able to go to her wedding in Baltimore yesterday – she looked like she walked right out of a bridal magazine!</p>
<p>I had a really fun moment getting ready for the wedding; I tried on all the dresses in my closet – including my high school prom dress – and nothing fit me! I didn’t think far enough ahead to have anything tailored, so I had to go shopping for a new dress; literally, everything I owned was falling off my body, and would have needed to be taken in by a few inches. I went shopping with my friend, and former coach J., and had quite a thrill. I bought a dress – size 14! This is a big moment for me, dear readers. Not too long ago, and I will admit this in a public forum, I was a size 22. I’m not at my goal weight yet, but I can’t even begin to describe what a different experience shopping is now. I used to only be able to buy clothes at certain stores that catered to plus sized shoppers. And now I find myself being able to shop in more and more stores for more and more kinds of clothes. A whole new world of fashion is opening up for me, and I love the way I look!</p>
<p>It’s an amazing thing to feel healthier, to love my body, and to be able to see and notice real differences as I work so hard to achieve goals. I’ve tried to do this for many years, and I’m finally following through and making real commitments. I’m really doing this!</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Many left-behind parents are told that the <a href="http://www.hcch.net/index_en.php?act=text.display&#38;tid=10#family">Hague Convention</a> will bring about the return of their abducted children. Some authorities say that if your child is abducted, you should follow procedures outlined by the Hague, but we don&#8217;t agree.</p>
<p>Until 1980, there was no international system in place to help parents recover abducted children who had been taken to other nations. The Hague Convention attempted to create one, but it doesn&#8217;t work. If you take the time to read the well-intentioned text of the Hague, you&#8217;ll see its many flaws.</p>
<p>In our opinion, it&#8217;s not worth the large amounts of money, time and trouble to hire an attorney to try using the Hague Convention to get your child back. You aren&#8217;t likely to get him or her back — and even worse, the abducting parent could be &#8220;legitimized&#8221; by the courts in another nation.</p>
<p>Under the Hague Convention, a case must be filed in the country where the abductor has taken the child. The courts of that country tend to render their decisions in favor of their countrymen, as the Hague Convention focuses on residency, not citizenship. There is little concern for the fact that the child is a citizen of the country from which he or she was abducted, or for the possible detrimental effect on the child.</p>
<p style="text-align:center;"><a href="http://www.abpworld.com/kidnapping_eng.html"><img class="size-medium wp-image-213 aligncenter" title="child-and-dog" src="http://abpworld.wordpress.com/files/2009/11/child-and-dog.jpg?w=300" alt="" width="344" height="228" /></a></p>
<p>Even if the child was born in your country, if that child is found to be a “habitual resident” by the courts in another country, the child may be ordered to be returned to that country.</p>
<p>This underscores the need to act quickly.</p>
<p>Few, if any, of the Hague signatory countries are going to send anyone out to physically recover your child for you. Embassy officials will check on the child&#8217;s welfare, if it is known where the child is and if the abducting parent lets them.</p>
<p>As soon as  abducting parents are aware that that they&#8217;ve been located, they&#8217;ll usually disappear with the children again.</p>
<h3>And about hiring lawyers</h3>
<p>You need to be aware that a great amount of money has been spent on lawyers in foreign abduction cases. The unfortunate fact is that they, most often, can’t practice in the foreign courts and are required to hire associate lawyers in the foreign country.</p>
<p>Note: they often have no qualifications or experience working with child abduction cases.</p>

<p>Many resources are available to help you learn about parental child abduction. If you&#8217;re dealing with an abduction, the better informed you are, the better equipped you&#8217;ll be to cope.</p>

<p>Time is of the essence. Parentally abducted children are helpless on their own and confused by the irrational and sometimes abusive acts of non-custodial parents who are supposed to have their best interests in mind. The Pittsburgh Steelers exposed their offense, and maybe even their defense a little bit in their 2nd half assault on the ground and through the air. <description><![CDATA[Once again, another marvelous day has come to an end. I&#8217;m a bit surprised at what good luck I]]></description>

I&#8217;m a bit surprised at what good luck I&#8217;ve had these last two days. Typically, my mood swings all over the map with ED thoughts ebbing in and out of my head. But not so much lately.</span></p>
<p style="text-align:center;"><span style="color:#000000;">And I must say, I have no complaints.</span></p>
<p style="text-align:center;"><span style="color:#000000;">When I woke up at 9:30 A.M., the house was empty. The house was empty and desolate except for a young man playing &#8216;Ghostbusters&#8217; on his playstation and two cats. One of those cats lay on my head.</span></p>

After throwing a small tantrum due to heart break, I remembered my dear </span><a href="http://www.mybreakfastblog.com/" target="_blank"><span style="color:#000000;"><span style="color:#9350cd;">Maggie&#8217;s</span> </span></a><span style="color:#000000;">vanilla protein oats and decided to hook up her oats with Mitri&#8217;s so that they could make a tasty baby:</span></p>
<p style="text-align:center;"><span style="color:#000000;">1 packet of <span style="color:#2983d5;">oatmeal </span>cooked in <span style="color:#ff0000;">coconut milk</span> &#38; <span style="color:#0000ff;">v</span><span style="color:#0000ff;"><span style="color:#0000ff;">a</span>nilla whey protein powder</span>, 1/4 c. <span style="color:#cf692f;">cottage cheese</span>, <span style="color:#008080;">shredded coconut</span>, and <span style="color:#800080;">crushed almonds</span>.</span></p>

It reminded me of a french vanilla crisp Pria Bar, which I used to LOVE to death and swear on. <p style="text-align:center;"><span style="color:#000000;">Once lunch was over, I discovered a video that my beautiful </span><a href="http://pistachiosandrainbows.blogspot.com/" target="_blank"><span style="color:#9350cd;">Maya</span></a><span style="color:#000000;"> recorded for me on Facebook. It made my entire day! That girl is so sweet and I love her to bits, so I made her a silly little video in response.</span></p>
<p style="text-align:center;"><span style="color:#000000;">When snack time jumped out at me from around the corner, I prepared a petite peanut butter sandwich on cinnamon raison <span style="color:#993366;">Ezekiel Bread</span> with <span style="color:#5b4cc6;">blueberries</span> and a glass of <span style="color:#ff0000;">soy milk</span>.<a rel="attachment wp-att-3132" href="http://spidersfrommars.wordpress.com/2009/11/12/i-have-no-degree-in-preschool-2/pbj-2/"><img class="aligncenter size-full wp-image-3132" title="pbj" src="http://spidersfrommars.wordpress.com/files/2009/11/pbj.png" alt="pbj" width="500" height="369" /></a></span></p>
<p style="text-align:center;"><span style="color:#000000;">Ballet/Nutcracker rehearsal was psychotic. We did class until 7, and I&#8217;d planned on staying for the Waltz of the Snowflakes rehearsal until 8:15. All of a sudden, my stressed out instructor told us Snowflakes was cancelled tonight but that we would be working on Act I Angels instead after the party scene.</span></p>
<p style="text-align:center;"><span style="color:#000000;">&#8230;.</span></p>
<p style="text-align:center;"><span style="color:#000000;">OKAY, so I took a seat and watched children, dolls, and mice parade around the studio as though they were at a party or something (:p). Then, I find out I have to stay until 9 P.M. and literally run to the supermarket across the street to pick up a Clif Builders Bar because clearly, I would not be eating dinner at an appropriate time.</span></p>
<p style="text-align:center;"><span style="color:#000000;">Once I returned to the studio and gobbled up my chocolate Builders Bar, my instructor nonchalantly informed me that I could go home because we would not be rehearsing Angels anymore. Argh. This always seems to happen!</span></p>
<p style="text-align:center;"><span style="color:#000000;">Regardless of how nettlesome the situation was, I am very proud of myself for the flexibility I demonstrated tonight. It just goes to show that ED can&#8217;t control me! And the dinner that I prepared when I got home was fantastic:</span></p>
