Prabal called the registrar again,  (he has NEVER called when he said he would), and told Prabal, “I am unsure whether more documents are needed or not”.  (Even though we went to his boss, and ASKED him ourselves, what was needed).  He also said he ” needed to look up more laws, too”.  Prabal got off the phone, saying “The registrar has gone mad!”  Then proceeded to tell me in English what went on and then to his family in Bengali. ( Even though they understand English, they don’t speak it back and forth.  The listening and reciprocation part is not good).  We were all upset at this, because this has been going on since the 27th of October.  He has been kicking this around and dragging his feet from the beginning.  I guess he is afraid of the possibility of going to prison.  Time to call other registrars…

Prabal called one woman, who had done the paperwork for his brother and sister-in-laws marriage.  She listened to the whole story and said that she would have gone ahead and submitted the marriage notice, and after the 30-day wait period, she would ask to see the original copy with the stamp.  “That, is doable” Prabal told her, but since she is not in THIS jurisdiction, she cannot do the work.  Prabal then had one more phone number for a registrar, and called him.  Prabal then told this registrar the story, and this registrar actually said the same thing as the earlier female registrar…but, he IS in the jurisdiction.  Now, we are having this man come to the office tonight, and set us up with the paperwork.  YAY!!!  We are just forgetting about this other guy.  It became  a waste of half a month.   Better late than never though.  At least the paperwork will be submitted, and we will have the original (a copy of the original with a stamp on it…really original, eh? ).

Note to previously married people, who marry outside the US citizens…hmmm…I got nothin’! HAHA!  Just have ALL your paperwork OR say you’ve never been married .  BAD me.  I was ready just to say I was “unmarried” because technically, I am .  Prabal wouldn’t go for it…darn goody-goody!

Crossing my fingers and toes and thinking really positive thoughts about this evening.  I will let you know what happened with this one .

Security firm chokes sprawling spam botnet

The efforts of a research firm took down a botnet responsible for 33% of the world’s spam.

The attack was multipronged. First the security firm reported abuses to ISPs regarding certain IP addresses. Secondly, the firm worked with registrars to deactivate registered names. Third, the firm registered backup domains that were not used, and fourth, the botnet was able to generate random domains based on a specific algorithm. The firm understood the algorithm and registered names possibly generated by this algorithm.

The effect was a botnet that had no where to turn. Now the individual bots have been orphaned and the security firm is working with the ISPs to notify the computer owners whose computers were once members of the botnet.

Majority of Web Apps Have Severe Vulnerabilities

A recent report indicates that close to 9 out of 10 web applications could lead to information exposure due to flaws as 87% of the Web applications analyzed had serious vulnerabilities.

60% of Internet-based attacks targeted Web applications. 90% of web vulnerabilities rested with commercial Web applications while 8% rested with browser-run applications.

25% of the attacks were SQL Injection-based with 17% of the attacks being attributed to Cross Site Scripting

No Rush to Adopt Domain Names Written in Chinese in China

While ICANN has opened the gates for IDNs to begin in certain countries, China being one of them, it appears there is no great rush to acquire the Chinese equivalent of the currently used Latin character set.

In many cases Chinese organizations have reduced the number of characters to make it easier for Chinese to type in the URL. For example “Tenchnt” is known as “qq.com” for its users. Another company has used “163.com” as the URL for its brand name as companies often associate numbers with their brands.

In one case where someone has already grabbed the Chinese equivalent to one company’s name, the head of the company would like to purchase the name, but feels having it owned by another party would not create any harm to their existing brand.

While the Chinese character sets will aid Internet usage for the older population, the majority of China’s Internet population is already used to the current method of using the Internet.

Earlier today, Seth Godin blogged about Upside vs. Downside, which I initially thought was irrelevant for Registrars’ offices. Initially. And then I pinched myself and woke up.

The question he raised is “How much time, staffing and money does your organization spend on creating incredible experiences vs. avoiding bad outcomes?”

I just spent a day in Vancouver at a Degree Partnership Symposium, hosted by the BC Council on Admissions and Transfer. At this symposium, three different presenters all said the same things: “Well, after we had this great idea, we took it to the place that kills all good ideas – the Registrar’s Office!”

I don’t know about you, but I’m getting a little sick of hearing that. I’m sorry, but if you are a Registrar who is best known as a killer of good ideas YOU HAVE A PROBLEM!

Don’t mask it with euphemisms like, “I’m just introducing a dose of reality,” or “Someone has to keep standards around here!” A Registrar must be a can-do person, someone who knows the ins-and-outs of the organization and can help good ideas navigate through the complexities and into success.

But too often Registrars protect or we are, as Godin says, “busy ensuring that a bad thing won’t happen.” If we continue down that road for too long, we will quickly become irrelevant – an office to avoid. We will soon be victims of restructuring or redesign.

Why can’t we be known as the place that guides good ideas to fruition? Let’s be known as people who are “aggressively investing in having a remarkable thing happen that will delight or move a customer”. What a joyful place that would be to work!

Algunos  ingresan a academias, otros a la universidad, otros a institutos, algunos a trabajar, otros se casan de inmediato, en fin: salimos del territorio escolar y nos separamos, y probablemente muy pocas veces volvemos a saber los unos de los otros.

El modo de búsqueda es muy sencillo: entras al link http://www.adonde.com/colegios-peru/ del Directorio y tienes dos opciones de rastreo: la primera, buscar en la barra de acceso rápido utilizando la palabra precisa de búsqueda – ya sea exploración por alumno o colegio – o buscar a los alumnos a partir de la ubicación de tu colegio en la lista (Inicio Colegios) que se te ofrece y donde te aparecerá primero los distritos o ciudades para que, tras un clic, brindarte la data de colegios localizables dentro de el espacio geográfico. Tras seleccionar el colegio de tu preferencia se te presentará el listado de alumnos registrado, así como sus sitios Web, si los tuvieran, donde los podrás localizar. Así que si quieres encontrar a un amigo de promoción o a la gente de tu “cole” o quieres que te ubiquen a ti, este directorio es recomendable  al respecto.

Hat man Schadenersatzansprüche gegen ein DENIC-Mitglied, daß eventuell nicht rechtzeitig die Domain reserviert hat, obwohl dies vorab vertraglich vereinbart und bezahlt wurde?

Der Sachverhalt:

Die Webplus24 GmbH hatte für den 23.10.2009 vorab die Zeiten ab 9:00 Uhr im Minutentakt teuer verkauft. Zuvor wurden per Paypal mehrere hundert Euro für einen der fordersten Listenplätze bezahlt. Danach wurde per Vertrag zugesichert die Domain zu einer bestimmten Uhrzeit zu reservieren. Die Chancen wären dadurch hoch die gewüschte Domain zu erhalten.

Die Auktionsliste von Sedo zeigt, daß die Domain für über 25.000 Euro hätte weiterverkauft werden können. Die Bieter hatten sich im Vorfeld verpflichtet den Gebotspreis zu zahlen und Sedo den Ankauf beim Inhaber der Domain zu versuchen. Dadaurch hätte sich ein Gewinn von über 20.000 Euro realisieren lassen!

Der oben gezeigte Change in der Whois-Auszug zeigt, daß die Domain zu einem späteren Zeitpunkt ein Timestamp von einem anderen DENIC-Mitglied für einen Kunden aufweist. Bedeutet das im Umkehrschluß, daß Webplus24 vorher keinen Reservierungsauftrag zur vertraglich vereinbarten Uhrzeit an die DENIC übergeben hat?

Die Konsequenzen:

Als erstes stellt sich die Frage, ob man sein vorab bezahltes Geld zurück bekommen kann. Ich vermute mal, daß dieser Punkt unstrittig ist, wenn eine Vertragspartei vorab bezahlt und der Vertrag durch den Rechnungsversand im Nachgang wirksam wird. Wenn die Registrierung nicht wie vereinbart erfolgt sein sollte, würde auch der Vertragsgegenstand – nämlich zu einer festgelegten Uhrzeit zu registrieren – nicht erfüllt. Hier hat Webplus24 vorbildlich reagiert und mir zugesichert den gezahlten Rechnungsbetrag zurück zu erstatten.

Die viel spannendere Frage ist, ob man nun einen Anspruch auf Schadenersatz hätte? Der Schaden ließe sich mit Sedo sogar auf den Cent beweisen. Der Schaden wäre die Differenz zwischen dem höchsten Sedo-Auktionsgebot und der Gebühr für die Vorabregistrierung.

Gibt es einen Rechtsanwalt der sich bei diesem Thema auskennt?

Update: Letzter Absatz wurde gestrichen, weil das Geld zurück erstattet wird. Rein rechlich würde mich dennoch die Frage nach einem möglichen Schadenersatz interessieren. Vor allem, ob es dem Registrar überhaupt möglich ist seine Vertragserfüllung gegenüber dem Kunden zu beweisen?

Aber es gibt noch mehr rechtliche Frage, z.B. ob Sedo nachträglich das Aktionende verschieben darf. Aber so konnten immerhin 6 Millionen Euro für die freien Kurzdomains erzielt werden.

The Summer 2009 edition of College and University, a journal of the American Association of Collegiate Registrars and Admissions Officers has an interesting article entitled, “Middle Management and Institutional Strategy”. The author, Sam J. Fugazzotto, does a very nice job of summarizing some of the differences between well-known middle-management positions such as those in a manufacturing plant, and middle-management positions in colleges and universities such as the Registrar. His main point is that organizations which succeed do so because they marry operational effectiveness (sometimes known as OE) with a unique strategy, and the Registrar is best situated to assist in managing both.

Typical manufacturing plants have a middle management with a ton of control. This is because senior management tends to focus on strategy, and directs middle management to achieve the strategy by directing, standardizing and measuring the operators’ work.

When I was doing my M.A., I was informed by one of my professors that “middle management is dead.” It appears they have been resurrected.

Enter a Monty Python moment: “And now for something completely different.” Middle management in higher education bears little resemblance to the manufacturing sector. First of all, we deal with faculty members who, along with their multitudinous degrees, seem to have their own ideas and are hard to influence (read “almost impossible to argue with and win”). Fugazzotto puts it strongly when he says deans, provosts and presidents “cannot unilaterally hand down strategy to as powerful a group of operators as college faculty.” No kidding.

But even faculty want strategy as recent non-confidence votes against college presidents by faculty unions  can attest. And the magnitude of change in our world is a call for strategy to institutions that wish to survive this decade. The trick comes in how to measure success of strategy, especially in academe which doesn’t have a strong history of measuring such things. I have personally heard multi-millionaire potential donors say that they will not support all the wonderful things we do in higher education if we can’t run an effective organization.

As you might have guessed, enter the Registrar. In my institution, the Registrar’s Office tracks almost all the information needed to determine success of strategy. In economic terms, we process about $20 million per semester in tuition and room and board fees. In people terms, we track admitted students, course and program enrollment, student success (grades), progress towards degrees, and graduation numbers. We know how many students drop out.  We know where transcripts are being sent to, so we have a pretty good idea of where our students are getting jobs and further education – or we know where they’re applying, at least. We can even tell you how many parking passes we sold this fall, and whether there were enough parking spaces to hold all the cars (btw, when did students start driving vehicles that are much nicer than faculty vehicles???)

Even further than this, Fugazzotto says, “registrars can combine technical and institutional knowledge in order to use technology strategically rather than making data systems an end in themselves.” We are “business process managers who deliver information and resources that support the academic missions of our campuses.”

What he’s saying is we are in a position to quantify most things in the academy. Therefore, we have great strategic value.

I feel much better now that someone has justified my existence!
