Finals are finally over and so is the semester. And I don’t have to go to work for another 2 weeks (i kinda miss that though). but here I am sipping coffee (thanks kaleigh) at 12.17pm and thats coz I just got up…yessss i too do get to sleep past noon

But its that time of the year when the school wants to empty your pockets by sending you emails about paying your registration fees and tuition fees and…. Well i already paid my registration fees and I strongly suggest that everybody pay their registration fees on time before the deadline and more importantly before they start charging another fee as ‘late fees’. Paying your fees on time is just a safer option, and you don’t have to wait to register for classes. For those who wish to pay the fees in installments, they can contact the cashiers office and ask for the available installment plans.

And if you’re thinking that the school is paying me to convince you to pay your registration fees, then that is definitely not the case here. Its just good practice to get these things done ASAP and out of the way so you can focus on classes.

And oh yes.. before I forget…. everybody, go watch AVATAR in 3D its awwwwesome !!

During the holiday season, we often run into relatives that we rarely see, might never have known an

During the holiday season, we often run into relatives that we rarely see, might never have known and recap the year’s changes re: births, deaths… within the family. We make promises to be in touch and oftentimes, we now turn to technology – in the form of ancestry sites, to help us maintain our family ties.

There are many ancestry sites on-line that help us reconnect with our lost, or find, unknown family members. A majority of these sites can disappoint by posting incomplete, mismatched records, dubious source information… The most popular ancestry site, Ancestry rises above these issues by operating on a legitimate, comprehensive, matched data verification system. Annual registration for Ancestry starts at roughly $150 year and of course, there are buy-ons you can add to your account.

Regardless of the perceived security of ancestral online database membership, the question looms as these sites often, inadvertently provide a gateway to gather personal information by identity thieves. While phishing (hacking) is still the preferred method of anonymously obtaining personal data, our savvy thieves realize that they can potentially legally get away with theft by selecting their victims carefully.

The general M.O. of an i.d. theft criminal is to locate a “mark” ,someone who appears isolated from the rest of the family, generally someone old, lonely or infirm. The use of an ancestry site allows the thief to gain familiarity with the victim’s family. Insider information is always good to put an innocent, unsuspecting person at ease.

From there, it is simple for an i.d. thief to run a background check on his target on any number of the data providers now available online. This search can yield hard information; ranging from current address, address histories, mortgages, voter registration, professional licenses, email addresses, phone number, relatives, neighbors…

If a criminal takes the time, he can form a fairly accurate profile of his target before the victim is even aware that anyone is looking into his/her background.

Some helpful hints to keep identity thieves off-base.

If a site demands your SSN, do not provide it.

DOBs are optional. (Most legitimate sites will allow you to simply cross off that you are over 13 y.o.)

In filling out promo ads (and we all do this!), use a middle initial not associated with your name in reality. It’ll allow you to keep track of how your personal information is being distributed.

If you wish to add pictures on the site you wish to join, a) elect for the pictures are to be available only to those you chose to opt in and b) upload a generic pic that does not have your house number or vehicle plate in the photo.

If you’ve taken as many preventative measures as possible and still get “phished” or have your identity stolen, you need to contact your local police immediately as well as your banking institutions, medical, driver’s insurance companies and alert your friends and family so that they will be aware and not inadvertently release additional personal information.

Good luck and as they say in poker, keep your cards close to your vest.

BNI Operatives: Street smart; Web savvy.

As always, stay safe.

Tomorrow is the last day and I am not yet registered. Tsk tsk. I went at 8:30 am at the municipal hall of Binan, the new one, and sad to say, no more slots/numbers left. They will entertain only the first 600 registrants today, and I’m way far far far from that number. The people all queued up at the comelec binan office, each having their own complaints. Because I cannot register today, I just accompanied my lola whose to undergo the same process. She’s already a senior citizen so we went directly to the office without having to fall in that long line of people waiting for their turn. Just like outside, it was also ‘maingay’ and ‘mainit’ sa loob ng office. There were five steps for the reg process.

Get a number, fill out the white form.
Step 1: Present a valid ID. Get a green form.
Step 2: Submit the green form.
Step 3: More forms…
Step 4: Thumbmarking? haha.. and Picture taking!
Step 5: Final form…Get your slip.

There. My lola had to undergo steps 3 to 5 nalang. She’s so lucky. Parang gusto ko nang maging senior citizen…daming privileges hehe. (like the 20% discount sa Mang Inasal…) The man in charge of Step 1(the yellow man) was annoyed with the people, but still doing his job. I thought it would be better if he will shut his mouth. Hai… ang ingay niya kasi, nakakatakot tuloy siyang pagtanungan. Pero may point naman kasi siya. I wonder kung napapaos ba siya…vocal strain chor!

YELLOW MAN: ‘Yan kasi, bakit ngayon lang kayo nagpaparegister?! Lagi naman kaming bukas,,kahit holiday! biyernes santo lang kami nagbakasyon! pati tuloy kami pinahihirapan niyo. PEOPLE ESP THE

WOMEN: Pilipino. buzz. buzz.

YELLOW MAN: nagiingat nga kami sa sindikato!

AKO: hindi po ako sindikato! (pause) please….

We’ve fixed some issues with Unlock Text, the placename text extraction service, thanks to fee

We’ve fixed some issues with Unlock Text, the placename text extraction service, thanks to feedback from members of the OSGeo-UK community.

Parsing of HTML pages is now reinstated and there’s a bit more documentation on the form-based interface; the meaning of the options should be a bit clearer.

The main outstanding caveat is that if you use the ‘XML’ document type option, but the document you send isn’t well-formed XML, you’ll still see the unfriendly “Error executing command-line application”.

Next step is to trap the different error states better so we can offer more meaningful feedback to the user if these errors do occur. However that will take a while longer to resolve, with input from our partners in this part of the project, the wonderful people at the Language Technology Group in the University of Edinburgh’s School of Informatics.

We’ve also streamlined the process of registering an API key to access OS data through Digimap, so it should be a bit clearer where to go to add a new key for a new IP address.

Today I registered for classes that I’ll be starting in January!

I’ll be taking Introduction to Biblical Literature and Themes and History of Christianity. And as an added bonus, I found out that History of Christianity is the equivalent to Introduction to Christianity, which is a program prerequisite.

I’m still working on getting things in order to get as many transfer credits as possible, but it’s proving to be a bit of a hassle. The program I took at SAIT doesn’t exist anymore, and it’s been 7 or 8 years since I went to CBC, which has changed its name 3 times and moved provinces since then. One of the ladies in the registrar’s office sent me the course syllabi for the semester I went there which is awesome as that should count for a full semester here at CMU.

I’m hoping they have the books for the classes available by the end of the week so I can buy them and read them over the Christmas break.

I found out that they don’t have spring/summer classes, so I need to find out if I can take courses at UofM or UofW during those semesters and transfer them over. This would mean getting my degree done faster which is key.

Hypothecation (Simple Mortgage of Movable Properties) The Madras High Court in the case of DAKSHINAM

Hypothecation (Simple Mortgage of Movable Properties)

The Madras High Court in the case of DAKSHINAMURTHY MUDALIAR vs. GENERAL AND CREDIT CORPORATION (INDIA) LTD A.I.R 1960 Madras 328 had made the following observation while discussing enforceability of Hire purchase Agreements in India.

Mortgage of movable properties is not governed either by the T.P. Act or by the Contract Act and there is no other Statutory provision to govern them conrresponding to the Bills of Sale Acts in England-Flory v. Denny.” According to the English law such a mortgage may be effected without writing, and the registration I in no way compulsory: Kalka Prasad v. Chandan Singh, See : Gour – Law of Transfer, Seventh Edition Page 952. Mortgages of movable are created by way of security for repayment of loans. At times they are followed by possession and at others they are not accompanied b any delivery of possession.

Regarded in the nature of hypothecation known to English law, the validity of such mortgages has been recognised in India and sometimes, enforced even against bona fide purchasers without notice. With regard to priority in mortgages of movables, the good will of a business, though not mentioned, passes; the maxim, qui prior est tempore portior est jure applies: See: Darashaw on Transfer of Property Act, 1938 Edn. Pages 471 and 472

In India, there are two cases where the courts have taken quiet a different views based on the facts of the case. In the case before Kerala HC (Sundaram Finance Ltd.Vs.State of Kerala AIR1966SC1178, [1966]2SCR828, [1966]17STC489(SC) ), the hire purchaser of a cinema projector argued that the agreement he signed although purports to be HP is in fact a hypothecation deed. He claimed that he is the owner of the goods and the projector is hypothecated to the bank as security for the debt. The bank claimed repossession on the basis that it is the owner of the projector which was hired to the purchaser. The court looked into various payment clauses of the HP agreement and found that in case of default by the purchaser apart from repossession of the projector the bank had a right to recover the arrears of rent but not the full price of the projector. In other words, for example if the projector price is Rs 100 and the installments are broken into Rs 10 equal installments over a period of 10 months, if the clause says that in case of default of any of payment of installments then the bank could recover whatever is due until the day of repossession and not the balance of the price then it is not in the nature of obligation to purchase. Therefore, the agreement is hire purchase.

The hp agreement need not expressly state if there is an option or an obligation to purchase the goods. For example if the clause says that banker is entitled to recover all of the remaining balance of price of the goods spread in installments even after repossession then it is a case of obligation to purchase. This is because just the like the seller of goods the banker had the right to insist for full price of goods. On the other hand, if the clause says that the banker is entitled to recover whatever is due until the goods are repossessed then it is case of hp. This is because the the price of goods need not be paid by the purchaser once the possession is taken away by the banker. Whatever he paid already by way of rent is for bailment of the goods and not towards price of the goods. It automatically means that once he defaults and possession is taken away from him he no longer is bound to pay the balance installments. He is liable only for the arrears if any of the installments incurred while he was in possession of the goods.

In case of sundaram finance, the SC declared the specific hp agreements to be hypothecation agreements. The transaction contemplated in this case is like this:
The hire purchaser will pay part of the price of vehicle to the dealer who passes the title in the vehicle to the purchaser. The purchaser also registers the vehicle in his name and takes insurance policy in his name. But the balance price against the vehicle will be paid by the banker on following conditions: the purchaser has to write a resell letter acknowledging transfer of the vehicle to the banker. However, he need not register the sale (Indian Motor vehicles Act ) requires registration of sale including sale of second hand motor vehicles. He can continue to hold the possession of the car and have his name as registered owner. The bank will pay the balance amount of price to the dealer and will let the vehicle to the purchaser as per hp agreement. The purchaser pays installments to the banker for the price it paid to the dealer of the vehicle. The purchaser becomes absolute owner of the vehicle on payment of last installment. The purchaser also has to bind himself personally to pay all the installments by executing a promissory note in favour of banker.

Although there is apparent purchase, resale and repurchase of the goods the court looked into intention of the parties. The majority of judges looked into facts like execution of promissory note (which is usually executed only if the banker has lent the money) and also the non registration of the vehicle in the name of the banker even after signing a letter of sale in favour of the banker. Legal effect of transfer of vehicle takes place only on registration. The court ultimately concluded that the purchaser is the real owner of the vehicle and there has been no real transfer of ownership in favour of the banker and the hp agreement signed is actually hypothecation of his own vehicle to secure payment of loan amount sanctioned by the banker by way of payment of balance price to the dealer. In this case, the financier of vehicles escaped General Sales tax because the court declared that they actually sanctioning loans and taking hypothecation of vehicles as security for the loans and not signing hp agreements.

Today morning went to meet up with Singapore Minister for Environment and Water Resource, Dr Yaccob Ibrahim, at his hotel for a short meeting and discussion. Really felt so privileged!

Afterwhich, went to college for British Council briefing to get the urgent update on the distribution of the secondary badges to enter Bella Centre – was able to sign-up for Wednesday afternoon. This will be my 2nd last chance to enter to Bella Centre to get into the real action.

Surprised to see a marching contingent marching pass the square @ Norreport:

Smart-looking soldiers marching by the Square

Took a bus from Norreport Station to go straight to Bella Centre. In the end, even though I have the Primary and Seconday badges, I have to wait for almost 1h to get in!!! Organiser should not have over-accreditated the participants in the first place to avoid all these unhappiness incidents from taking place. Now, hundreds of foreign delegates already paid their air fare etc to come to attend COP15 but was turned down by the security. This shouldn’t be the way of showing hospitality to foreign friends.
