If you live in an area that has temperatures below 30 degrees, keep your heat/thermostat set at least in the 50&#8217;s and never turn your heat off. Guess what happens to pipes that carry water to your apartment if you don&#8217;t keep them heated&#8230;..like a elementary school experiment, when water freezes it expands, when heated it contracts and that process often times is too much on the pipes that house it. That creates cracks in the pipes that demand constant pressure to get you precious water instantly. Pressure + water + crack means big mess that can be avoided very easily. Most insurance providers consider turning your heat off in the winter time an act of negligence and will pursue the person responsible for trying to cut corners in the winter. Keep your place heated. Don&#8217;t turn your heat off in the day while you are gone and then turn it on when you arrive home, this recipe always leads to big problems.<br />
Make sure you always set your thermostat to &#8220;AUTO&#8221; rather than &#8220;ON&#8221;. The &#8220;AUTO&#8221; setting will regulate the temperature in your dwelling and turn off once the desired temperature is obtained. The &#8220;ON&#8221; setting tells the furnace/air-conditioning to run all the time regardless of the actual temperature in the dwelling. The AUTO setting will save you money and prolong the life of your furnace or Air Conditioner in the summer time.</p>

<p>Now, to the shit!</p>
<p>I woke up this morning to the sound of a blaring alarm. In fact, my entire complex woke up to that alarm. We thought it was a fire alarm. It wasn&#8217;t, it was a fire-supression alarm. You see, the crackhead (literal, unknown to everyone in the building until the firefighters broke into the apartment and found 1 card table, 1 chair, 1 mattress, and about 1000 cigarette lighters and crack pipes) that lives uses the place above me (he doesn&#8217;t live there, just visits to smoke crack) didn&#8217;t have any heat on. Due to the lack of heat, one of the sprinkler-heads froze and burst, showering thousands of gallons of water down on my place. It took them an hour to shut off the water.</p>
<p>My place is ruined. The whole place is going to have to be gutted and redone.</p>

<p>BTW, you might want to wrap your electronics in plastic, water apparently has a magnetic attraction to electronics, because it managed to find all of mine. Yep, everything, 6 external hard drives, 5.1 speakers, 5 computers, 3 mice, 2 monitors, 2 portable dvd players, sound system, dvr, dvd player, wireless router, Nintendo Wii, and my 42 inch plasma TV.</p>
<p>Do I have renters insurance? Yes. Will it cover it all? I don&#8217;t know yet. Will I have to move out? While the repairs are going on, yes. Do I want to live there now? After it&#8217;s redone and brand new, yes! Does this suck giant donkey balls? Uh&#8230; that&#8217;s affirmative!</p>
<p>So, I have to apologize for not giving more information on the date. I know it deserves it, and I have more to tell, but for right now, this will have to do. Will I update you about it later? Probably not about this date, since I&#8217;m sans computer (I&#8217;m writing this from my dad&#8217;s new 27 inch iMac) for the foreseeable future, but anything new you will hear about.</p>
<p>Now, if only Sabina and Chrissey would live dramatic lives like mine (well, not just like mine, leave out the water bit) , maybe you all would actually have something to read!</p>

<h3>Renters Have Many Options when it Comes to Decorating Their Home</h3>
<p>Are those white walls making you sad? Do you ever find yourself too embarrassed to invite friends over to your house?</p>
<p>Whether you’re decorating a new apartment or just looking to change the look of your current home, you might be hesitant to make too many changes if you rent the space as opposed to owning. But the reality is that while you won&#8217;t likely be able to make any grand structural changes to the space (no adding skylights, no knocking out walls), many landlords are open to tenants making cosmetic changes.</p>
<p>Now don&#8217;t get your hopes up, expecting to make any major architectural changes to your rental; as a rule, most landlords prefer that the space remain whole to ensure that they can still utilize the property (rent it out) once you move out. And as a renter, it would be unadvisable to make expensive upgrades to a place in which you have no investment or ownership stake. But still, there are many things that you can to upgrade your rental from a generic shell to a sophisticated and customized living space. And the best news- landlords are often amenable to the changes as long as you agree to return the place to its original state before you move out. Try one or several of the following options for upgrading your home.</p>
<p><strong>Paint:</strong> The easiest way to change the appearance of a room may be to paint the walls. Whether it&#8217;s a velvety chocolate brown, cool steel gray or a deep shade of blue, applying color to the walls provides a richness and depth that plain walls could never have. And landlords will often allow you to paint as long as you keep it neat and in most cases, agree to return the walls to their original color before you leave.</p>
<p><strong>Wall Art:</strong> After you paint, adding wall art will help to further warm the space and inject elements of your personality. If paint sets the mood of the room, the art provides the soul. Wall art comes in so many styles and forms- paintings or prints, photography. You could use a collection of picture frames mounted on the wall to create visual interest. Or display wall sculpture and ethnic masks to add a worldly flavor to the room. The options and sources are nearly endless, so don’t rush and pick just anything- look around and shop around to see what feels like the best fit for your space. Next to painting the walls, mounting art on the wall are a fabulous way to change the look and feel of a room.</p>
<p><strong>Accessories:</strong> As the saying goes, it’s all about details, details! Sometimes it only takes a few small touches to breathe new life into a tired space. Looking for a quick way to refresh your kitchen? Try swapping out the handles on the cabinets and drawers. They&#8217;re fairly cheap, easy to install and you can always change them back when you move out. Or how about adding a stained glass effect to your windows using colored adhesive window coverings? It&#8217;s easy, inexpensive and the only tools that you need are a spatula and a bottle of window cleaner.</p>
<p><strong>Plants:</strong> Is there anyone who doesn&#8217;t love fresh cut flowers on the dining room table? Plants are great because they provide an organic and lively touch to the space, as well as a splash of color and. And thanks to the process of photosynthesis (think back to your high school biology class), plants draw fresh air into the room. From ferns to cacti, palms to peonies, there are so many different varieties of plants to choose from, so make sure that you opt for plants that you can easily care for.</p>
<p>So don’t be discouraged by those blank walls, and don’t make excuses to keep your friends from coming over. Whether you choose to paint, plant, or accessorize (or all three), you can be sure that with a good plan, a little inspiration and a little work, you can transform your rental space from your bland “box” residence  to a beautiful and stylish new <em>home.</em></p>

<p>The cap rate is about 5.5%, below average due to the difficulty they are having in finding a wealthy renter. Imagine living with these views. Incredible.</p>

<title><![CDATA[Where to Park My Ice Cream Truck]]></title>

My eldest son (4  years old) and I (old enough to have a four year old) went to deliver some notices and check in on things a tone property this morning. One of my tenants drives an ice cream truck and leaves it parked in the parking area behind the building where it inconveniently blocks other tenants access in and out (partly the reason I was there). Like any four year old my little guy said &#8220;hey I want some ice cream from that ice cream truck&#8221; and I told him that he probably isn&#8217;t home and that we can get ice cream from the local gas station, trying to avoid an exchange of goods &#38; services with my tenant which is always a bad idea. My son&#8217;s persistence in the over-priced brain freeze inevitable super pop led me to a claim that I couldn&#8217;t since he was a &#8220;tenant of mine and I don&#8217;t like to buy things from tenants&#8221; based on the fact that most tenants would love to sell you something with a little &#8220;landlord love&#8221; included whatever that might be. A good rule.<br />
My son&#8217;s response was &#8220;but Dad, he is not one of my tenants&#8221; and I was stumped with a big smile on my face. Luckily for both of us the tenant was not home.<br />
The moral of the story, since I had to have one for my son, &#8220;make sure you have a strict parking policy with no room for misinterpretation&#8230;.and of course don&#8217;t buy ice cream from tenants&#8221;</p>

By changing your filter once a month you will significantly cut down the energy it takes to push warm air through a dirty filter. That in turn will cost less in your monthly energy bills.<br />
If you don&#8217;t have central heat and have a window heating unit, clean your filter at least once a week to help prevent the same expense. Filters cost $1.00 to $5.00 on average and will save you much more in energy cost over the winter months.<br />
You can also buy plastic to cover your windows and doors that will prevent cool air from intruding your living spaces. The directions are easy to follow and the kits can be purchased at any hardware store. You can also roll up an old towel and place it at the base of your entry doors to further prevent cool air from entering. Replace weather stripping (or install) as needed to finish off the efforts to stay warm and reduce your potentially hefty utility bills.<br />
With central air/heat units, don&#8217;t set your thermostat to &#8220;on&#8221;, keep it on &#8220;auto&#8221; so that it doesn&#8217;t run all the time, just when you need it. It is a good idea to keep your temperature in the 60-70 degree range. If you want 80 degree weather move to the desert, otherwise you will pay a premium to bring the temperature to you living spaces</p>

The first fact to point to before the main content of this post is that mice only exist where they are provided for. Mice can venture anywhere looking for food, warm shelter and water, but they only stay and breed where those elements are readily accessible. Think of them as unwelcome guests that constantly eat your food and don&#8217;t clean up after themselves.<br />
That being stated, many tenants will find a major problem with the fact that they appear and leave evidence of their scavenging. The first thing that you (the tenant) have to do is take a good look at your apartment/home by asking these questions:<br />
1.	Is your trash placed outside of your home/apartment at all times?<br />
2.	Do you vacuum regularly?<br />
3.	Do you clean up after every meal or snack so there is no possibility of leaving food behind (even very small crumbs)?<br />
4.	Do you store all your food in air-tight containers?<br />
5.	Do you clean up after your pets after every meal or snack (if applicable)?<br />
If you have answered yes to all of these questions, make sure you can verify the following:<br />
There are no open containers of any kind (trash cans, open bottles, soda cans, food containers, etc.) present within your apartment.<br />
If you can positively assess that you are keeping your living spaces up to these standards then a couple of things can be assumed.<br />
If you cut off an animals food supply, they will not stay around. If you violate any of the rules alluded to in the form of questions above then you are susceptible to a mouse invasion. Don&#8217;t blame the landlord for maintaining an &#8220;uninhabitable&#8221; dwelling unit when you are often the one to blame for forgetting to follow through with these principles of cleanliness.<br />
If you are still convinced that you are the epitome of health and sanitation then take a flash light to all the dark areas of your apartment. Look for water leaks, small drops to ponding water since you know the little guys will need a drink once and awhile. Again, you have to take the offensive when getting rid of the problem, not with landlord but the mice. If you find leaks, old trash, wet basements, etc you can then inform your landlord that these problems exist and you can work together to eliminate these issues.<br />
You can also set traps with bait to get rid of the problem. Mice have an interesting problem; their teeth are always growing so they have the constant need to chew to literally file their teeth down. The one thing they can&#8217;t chew through is metal or in the form of steel wool. You can stuff a liberal amount of steel wool into any open hole within the building that might allow their access in. Once all the points of ingress and egress are blocked you are left with stir crazy rodents. Mice without food (once you have taken it away) are left to chew holes in walls, electrical wiring, and shoes, whatever. So you need to make sure once you have them trapped you finish the job by trapping them or poisoning them.<br />
I have found that the old fashioned traps yield the best results and they are inexpensive. I have read things like people leaving buckets of skunky beer out with a diving board type of entry for the mice so that when they take the plunge they can&#8217;t get out and you can fill in the blanks from there. I have not tried that and I don&#8217;t imagine it can be as successful as a cheese bait trap, but it’s a war and by all means use what works to stay on top of it.<br />

Locate your furnace, take the old filter out and find the applicable size on the side of the filter. If you can&#8217;t find a filter in your furnace look for the largest louvered piece of metal in your place  (located on a ceiling, floor or wall), open it and you should find one there. Go to your local hardware store and buy a dozen filters for approximately .75 a piece. This will be the best investment you can make to keep your utility bills down. It will keep your air cleaner &#38; make it easier for your furnace blower to force air through the filters.</p>
<p>90% of the calls I get about inadequate heat or cool air are a result of dirty filters. It will reduce the efficiency of the HVAC components and often result in luke warm heat or air conditioning. A dirty filter can cause the forced air system (including window units**) to work extra hard and often create a fire hazard.<br />
**The same concept applies for window units; they typically have a small reusable filter that can be cleaned by hand with water.<br />

Some messes are greater than others and although life circumstances can understandably make it difficult to pay bills and honor these contracts, the overwhelming majority of these delinquent tenants decide that running away from a problem is easier than doing what is right &#38; working with the landlord to work it out.<br />
No notice, past due rent, trash everywhere and damage to the property equals one obvious outcome when the tenants start the flight away from their responsibilities&#8230;..legal action. It is not my preference to pursue legal action since it takes extra time, legal fees and paperwork that I try to avoid. The reality is that I&#8217;m not the one making the choice for legal action, the tenant made that decision when they started their poor choice to run and leave an expensive trail of damages in their wake.<br />
I have heard a few different &#38; unconfirmed statistics concerning court appearances that usually claim 90% or more of the delinquent tenants don&#8217;t show up for their chance to dispute the charges. Once the judgment is entered you then have the difficult task of finding the tenant to enforce that judgment through garnishment or negotiations. There are those tenants that actually have assets and worth pursuing (i.e. you will actually get paid) and those that don&#8217;t and won&#8217;t have a dime to their name to take.<br />
Sometimes the offenses are so great that sheer principle alone requires legal action even if the tenant will not have the ability to pay. It is for the greater good of warning future landlords and creditors.<br />
The laws are clear about landlord and tenant rights and we have a legal system that allows both sides to defend their positions. When 90% of the defendants don&#8217;t show up it makes it easy to win judgments. If you happen to have a tenant show up and request a trial you are in the minority.<br />
We have had the good fortune of not pursuing too many tenants since our inception. I have only had to show up to court once to defend our position and at the trial the delinquent tenant showed up 30 seconds too late and lost the trial by default.<br />
Find a good real estate attorney that charges a flat fee rather than hourly for these types of cases. It will make all the difference. Don&#8217;t take risks when signing leases, show up at the tenant&#8217;s door when they get behind on rent and only pursue legal action if you have a case you will win.<br />
You want to keep your winning percentage at 100%. If you lose you have not followed the rules correctly somewhere in the process.<br />

A tiny bunny ventured into our backyard and our little kids closed in on it wondering if it actually yielded Peeps or Jelly Beans as commonly misconceived by our young audiences. As they corralled the cowering lil&#8217; bunny I had the image of Monty Python&#8217;s Holy Grail <a href="http://landlorded.wordpress.com/files/2009/11/holygrailbunny.jpg"><img src="http://landlorded.wordpress.com/files/2009/11/holygrailbunny.jpg" alt="" title="holygrailbunny" width="143" height="79" class="alignright size-full wp-image-10" /></a> &#8220;that&#8217;s no  ordinary bunny&#8221; scene and laughed at the possibility. For a moment my boys gently pet the wild animal and experienced &#8220;the wild&#8221; as can only be experienced in city limits with the exception of traveling petting zoos and smelly pet stores. From that point in the week I have dealt with a few wild animal issues that led to the inclination to write about it in this venue since I can easily draw the relevance to this site.<br />

<p>Honey bees in an apartment wall can be a very bad thing. I must have the greatest tenant ever, he was cordial and understanding about the weird happenstance and put up with the little noisy producers of sweetness but quite scary in groups protected class of insects. As they became trapped inside the apartment they died off in hundreds in the window that would not provide them a path to freedom. The moral of the story here, if you limit their access in and out, the thousands who are trapped in stay trapped so be careful which direction you send them. Oh, and make sure you call a bee-keeper not an exterminator for honey bees.<br />
The smallest of animals always create the most damage.</p>
<p>On more than one occasion small dogs and even cats have ruined all the flooring in a few of the rentals I lord over.  It is hard to imagine how something so small can cause thousands of dollars worth of damage. I have the receipts to prove it. I am yet to meet a pet owner that openly admits that their pet is not house-broken and urinates like a pirate anywhere and everywhere. We often convince ourselves that domesticating something intended to be free and wild can yield positive results indoors.  Moral: check up on tenant&#8217;s pets as frequently as possible. The longer you wait the more expensive the repairs become. Tenant&#8217;s, when you find yourself thinking &#8220;it&#8217;s just a [enter pet type]&#8230;.it will live&#8221; that is when you should give the pet away to a caring family immediately. Please.<br />
Raccoons don&#8217;t belong in your air ducts.</p>
<p>If you have open holes in your home/property cover them with paper first. If a couple of days go by without the paper being dislodged or torn away, you can surmise that there are no animals in your dwelling and you can safely cover the opening. Guess what happens when you trap an animal inside with nowhere to go? We found a raccoon with its&#8217; arm stretched out of a wall vent like a prisoner reaching for keys. You can imagine that a trapped animal will go crazy after being stuck in walls less than 6&#8243; wide. Lesson learned: call a animal removal specialist first, they should give you helpful hints and suggestions before they make it there and charge you. Even if they have to remove the animal it is not to expensive and well worth paying for compared to the alternatives. A good visual inspection of the property monthly will help prevent all sorts of pestilence from your walls and air conditioning.<br />
 Big dogs bark very loudly.</p>

Big dogs in backyards make perfect sense, big dogs in 1 bedroom apartments simply do not. I will let you know in on a little secret, leave the TV on instead. Most people looking to steal rob and pillage will keep on walking if they think someone is home. Sure big dogs will do the trick, but the moral of this entire entry is don&#8217;t keep animals in spaces they don&#8217;t belong. Pets will literally go crazy if they are kept in environments not suitable for their kind. Crazy big dog equals a very dangerous situation.</p>

An early start from Bangkok setting off on our countryside drive. En route, we will stop at a local fruit market in Nakhon Nayok province and try bullock cart riding through rice fields.</p>
<p>During our walk along the trails at Khao Yai National Park, we will have a local lunch at the Hiew Suwat waterfall, with elephant riding in the jungle crossing the Lam Taklong creek. A pleasant 2 hour scenic drive takes us back to Bangkok arriving at about 5 o’clock. <title><![CDATA[A Picture is Worth a Thousand Dollars]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>You’ve heard the old phrase “A picture is worth a thousand words,” but in landlord terms, that picture often translates to cold hard cash.   For many landlords, a one month vacancy can cost hundreds or even thousands of dollars.  Including pictures in your apartment listings will dramatically increase the number of renters interested in your apartment.  You&#8217;ll also only receive calls from tenants who are truly interested in your apartment&#8217;s unique set of features, rather from all the rest who only want to see more detail than the listing provided.  The more renters you manage to interest in your apartment, the sooner the rent checks will start rolling in.</p>
<p><strong>Try these tips to get some extra nice apartment photos:</strong></p>
<p><strong>Plan for Natural Light</strong></p>
<p>Put some thought into when the apartment will get the most sunlight.  The more sunlight available to you when you photograph the space, the less you&#8217;ll rely on your flash.  A camera flash can often make your photos look either washed out or give them a yellowish hue common of artificial lighting.  Natural light will make your apartment look light, airy, and well, natural.</p>

<p><strong>Try Exciting Angles</strong></p>
<p>When you&#8217;re looking through the view-finder on your camera, experiment with standing high on a chair, or squatting low to the floor, to achieve a view of the room with more of its features included in the shot.  Alternatively, if you&#8217;ve got the budget, invest in a wide-angle lens.  A wide-angle lens will help bring all the details of a room into one shot, and will result in beautiful, professional-looking photos that are sure to wow apartment seekers.</p>

<p><strong>Highlight unique details!</strong><br />
Is there something about your apartment that makes it stand out from the rest?  Nice landscaping, a fireplace, a spiral staircase, stainless steel appliances, or any number of other features can really bring life to your advertisement when included in the photos.  Don&#8217;t limit your photos to just the bedroom, bathroom, and kitchen.  If there&#8217;s a big closet, snap a photo to add more visual interest to your advertisement.  Just remember not to go overboard!  You want to make sure that there&#8217;s a good variety of images, but you don&#8217;t need more than 2 or 3 photos of each room at a maximum.</p>

<p><strong>Highlight Fixtures and Fireplaces with Night Photography</strong><br />
Light fixtures and fireplaces can look especially stunning at night.  If your unit happens to have either beautiful light fixtures, or a fireplace, you can highlight these features by turning them on and taking their photo at night.  You can even try capturing the glow of your fixtures from the street, looking in, to create the sense that the apartment is a cozy place to come inside to on one of Rochester&#8217;s many cold nights.</p>

<p><strong>In Rochester, NY and the surrounding Metro area, there are several places that allow photos with apartment listing:</strong></p>

<li><a title="newdigs.com" href="http://www.newdigs.com" target="_self">Newdigs.com</a> &#8211; When it comes to adding lots of photos, Newdigs is your best option.  Newdigs allows for unlimited photographs with all of their listings.  Newdigs is free for any apartment of less than 25 units.  (For buildings with 25 units or more, Newdigs is free until the end of the year.  In 2010 they will begin charging $95 per month.)  Okay, we&#8217;ll admit we&#8217;re a little biased here, but we dare you to tell us differently once you try it for yourself.</li>
<li><a title="rochester craigslist" href="http://rochester.craigslist.org" target="_blank">Craigslist.org</a> &#8211; Craigslist is extremely popular because it is free, but landlords have to be selective about which photos you post, as only 4 are permitted per advertisement.  The free 30 day advertisement also offers a very large amount of text, sufficient for any apartment advertisement.</li>
<li><a title="RentRochester.com" href="http://www.rentrochester.com" target="_blank">RentRochester.com</a> &#8211; Like <a title="newdigs" href="http://www.newdigs.com" target="_blank">newdigs</a>, Rent Rochester is a locally based company.  They allow for several photos with their $35 per month, per unit advertisements.</li>
<li><a title="Rent.com" href="http://www.rent.com" target="_blank">Rent.com</a>- Rent.com&#8217;s solution for the small landlord allows for one photo per one month advertisement.  Actually, we should say it requires one photo, as it will not allow a landlord to continue with their advertisement until they add their one photo.  The pricing model is also a little different.  Landlords pay $15 per lead every time an apartment seeker contacts them regarding your advertised apartment, you pay $15, regardless of whether they rent.</li>
<li><a title="apartments.com" href="http://www.apartments.com" target="_blank">Apartments.com</a> &#8211; Basic advertisements, $100, do not allow for a photo, but adding $5 in order to upgrade to an &#8220;Enhanced&#8221;  listing is well worth it in order to include up to 20 photographs.</li>

<title><![CDATA[Tenant Rights and Responsibilities in Rochester, NY]]></title>

<description><![CDATA[Whether you&#8217;re looking for your first apartment, or you&#8217;ve been renting for years, odds ]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Whether you&#8217;re looking for your first apartment, or you&#8217;ve been renting for years, odds are you&#8217;re not aware of your rights and responsibilities as a renter.  Fortunately, our friends at the <a title="The housing Council of Monroe County" href="http://www.thehousingcouncil.org" target="_blank">The Housing Council of Monroe County</a> have compiled a document that renters can <a title="Tenants Rights and Responsibilities" href="http://www.thehousingcouncil.org/page/pdf/13_13_Tenants_Rights.pdf" target="_blank">read online</a>, or pick up at their offices at 75 College Ave, Suite 412.</p>
<p>Across Monroe County, roughly one third of all households are rental.  When you look at the city proper, 60% of Rochester&#8217;s 100,000 households are rentals.  For all those renters, the &#8216;<a title="Tenants Rights and Responsibilities" href="http://www.thehousingcouncil.org/page/pdf/13_13_Tenants_Rights.pdf" target="_blank">Tenant Rights &#38; Responsibilities</a>&#8216; guide is a must have resource for making sure that you&#8217;re getting the most out of your renting experience.  In fact, there is even a hot-line you can call with your renting questions at 585-546-3700.</p>
<p>Here&#8217;s a few tips and resources from the guide:</p>
<ul>
<li>For month-to-month contracts, under New York State Real Property Law 232-b, proper notice to terminate a lease is a one-month notice, corresponding to the rent due date.  No reason for terminating the agreement needs to be given by landlord or tenant.</li>
<li>All rental agreements, written or verbal, are binding once entered by a tenant and landlord.  There is no grace period to withdraw.  If you agree to rent an apartment and change your mind, the landlord can hold you liable for their losses, which can include losing your security deposit.</li>
<li>If severe code violations exist such as serious heating, plumbing or electrical problems, severe fire or health hazards or lack of basic services in the dwelling, a tenant can terminate their rental agreement even if there is a written lease.</li>
<li>Landlords can rent an apartment without appliances (stove and refrigerator) provided that they make it clear to the tenants applying for the apartment that they will have to furnish their own.  If landlords supply appliances, they have a duty to keep them in good working order.</li>
<li>Most landlord-tenant disputes over deposits arise over the issue of damages versus normal wear and tear.  A landlord can deduct from the deposit actual cost of damages including labor costs.  If a tenant leaves an apartment unclean the cost of cleaning can be deducted.</li>
<li>Landlords have a limited right of access to a tenant’s apartment.  The only exception to this is an emergency, during which, a landlord may enter randomly without notice.  In all other situations a landlord must work out a mutually agreeable time to enter, and provide at least a 24-hour heads up.</li>
<li>Any self-help eviction by a landlord without a court order is illegal.  Changing the locks, removing a tenant’s possessions, shutting off the utilities to force a tenant out etc. are criminal acts under New York State Real Property Law 235.</li>
<li>A landlord has no legal obligation to supply a tenant with off-street parking, storage space, use of a garage, use of yard and common areas, snow removal, garbage cans or garbage pickup.  If you live in a dwelling with two or fewer units a landlord can require you to perform basic outside maintenance such as cutting the grass.</li>
</ul>
<p>Familiarizing yourself with your rights and responsibilities will make you a better tenant and save you a lot of aggravation and expense as a renter.  Since the majority of apartments in the Rochester, NY metro are owned by private individuals, renters should share this guide with their landlords to make sure they&#8217;re aware too.  Being a landlord is often a part  time job for the property owner, and it can be difficult for them to be on top of all the rights and rules.</p>

<p>In order to effectively market a rental community, you must differentiate it from the competition. This much, we can all agree on. Your community may be positively unique, but what about the ways in which you deliver this<img class="alignright size-medium wp-image-1085" title="Video" src="http://buildium.wordpress.com/files/2009/10/video.jpg?w=200" alt="Video" width="200" height="300" /> message?</p>
<p><strong>Content + Delivery = Message</strong><br />
Most of what the prospective renter encounters during their hunt is content-focused. But content is only half the equation. For your marketing to stand out, it needs to be delivered creatively. After repeated exposure to similar styles of delivery, content starts to matter less and less. It&#8217;s human nature, and this effect is amplified by our diminished modern attention spans and the sheer volume of information we now see daily.</p>
<p><strong>Special Delivery</strong><br />
Everyone claims that their community is unique, that their amenities can&#8217;t be beat, that they simply <em>do things differently</em>. Prove it! If your message is <em>&#8220;we&#8217;re different&#8221;</em>, its delivery should reflect as much. The following are two ideas to get you thinking about the &#8220;special delivery&#8221;.</p>
<p><strong>MotionNotes Video Messages</strong> <em>- Personalized follow up</em><br />
An incredible idea that I learned about through a weekly industry twitter dialogue called <a title="#aptchat" href="http://www.facebook.com/AptChat" target="_blank">#aptchat</a> (highly recommended). The smart folks at <a title="Nessel Development" href="http://www.nesselinc.com/" target="_blank">Nessel Development</a> mentioned that they used this platform to set their follow up emails apart, and the <a title="example" href="http://viewer.motionnotes.com/viewer.html?message=004AAAAAAAAAAAAAAAAAAAAAAAAA9SQH" target="_blank">example</a> they provided wowed me.</p>
<p>I spoke to Angelo Directo, VP Design for Whiteboard Labs, the minds behind <a title="MotionNotes" href="http://www.motionnotes.com/" target="_blank">MotionNotes</a>. He explained to me that the product was originally developed for Dallas-based developer <a title="Hanover Property Company" href="http://www.hanoverproperty.com/">Hanover Property Company</a> as a way to enliven their post-tour outreach efforts. Since then, a number of other development and management outfits have followed suit. I imagined receiving a personalized Thank You email from a leasing agent who had just showed me around, with video reiterating the features in which I had specifically expressed interest. It&#8217;s exactly the type of high touch someone like myself appreciates, proving that not all digital communications have to be sterile or canned.</p>
<p>MotionNotes requires a considerable $1,500 set-up fee for corporate accounts, after which it&#8217;s $20 per month. This allows for multiple sub accounts (ideal for different leasing agents), a shared contact list, and the custom branding of a white label solution.</p>
<p><strong>Beyond Gift Cards</strong><br />
Another participant of <a title="#aptchat" href="http://www.facebook.com/AptChat">#aptchat</a> was taking vendor discounts and privileges to a whole new level. Why brand the vendors when you can brand your communities? With a single card, prospects who have toured will have access to a host of local discounts and special offers. Every time they take out that card, they will remember your community and arouse the interest of those around them. You&#8217;ll maintain a constant presence in a memorable way, the kind of exposure others dream of.</p>
<p><strong>Don&#8217;t be afraid to ask.<br />

<p>Above is the audio from our spot on Chicago Public Radio earlier this year. It&#8217;s pretty drama filled.</p>
<p>I have been working on Healthy Homes issues since 2007. First it was a lead poisoning prevention partnership. And now I have transitioned to this innovative and ambitious new program on the West Side of Chicago.</p>
<p>I believe in a holistic approach to health care.</p>
<p>I&#8217;ll never forget a training I attended in the winter of early this year. We learned all about asthma and it was very informative. But for whatever reason, at the end of the training, a representative from a well-known drug company [it will remain unnamed in this post] was invited to speak. He showed us a video of some quack Dr. with an M.D. from quack university (I googled the U later, and it definitely was not in the top 500 medical schools). This doctor was employed by the company and published various studies on why asthma rates just cannot seem to stop rising. He always concluded that they just aren&#8217;t taking enough drugs.</p>
<p>Well, if you know me, you know that whenever I am in a situation where I can envision myself telling the story to friends later, I never want to end the story explaining why I chose not to bite the hand that feeds me. This isn&#8217;t arrogance. It&#8217;s good story telling!</p>
<p>So of course, I decided to ask the representative, &#8220;We all know medication is necessary for people who already have asthma. But what is [company] doing to prevent this disease, especially in children?&#8221; The representative could have easily said, &#8220;Well we&#8217;re working with groups like yours to mitigate the underlying causes of asthma exacerbation, like poor housing conditions, yada yada&#8230;&#8221; But he didn&#8217;t. Instead, he told me that &#8220;[company] was working very hard on a vaccine for asthma.&#8221; And yes, I did have follow up questions. My boss was not happy with me for putting this guy on the spot.</p>
<p>Now I know its a drug company. What do I expect?</p>
<p>But lets go back to where I started: I believe in a holistic approach to health care.</p>
<p>Researchers still do not know what causes asthma, a LIFELONG, chronic lung disease. Many say they&#8217;ve grown out of asthma &#8211; nope. They just have not had an attack in a long long time.</p>
<p>The reasons I believe in a holistic approach are many. The reason this asthma partnership is so great is because it gives families the tools to tackle all the little problems that exacerbate their child&#8217;s already uncontrolled asthma. Yes, free drugs from the drug company are great.</p>

<p>And so I argue &#8211; the answer to chronic diseases like asthma [or obesity, or cancer, etc] are NOT vaccines. It is to make our environment a salubrious one. Of course there are natural triggers of asthma &#8211; cold air, exercise, pollen &#8211; and then, aren&#8217;t we glad we have the drug companies?</p>

Typically, homes will increase in value over time. This is known as appreciation. As time goes on appreciation is like money in the bank to homeowners. As a renter you don&#8217;t have the benefit of appreciation in the home you live in. </p>
<p>Tax Benefits:<br />
There are different tax beneifts for homeowners. The most important benefit is the interest you pay for your mortgage, it is usually tax deductible. This benefit can save you a lot of money in your federal income taxes. </p>

<p><strong>1. Calculate your profitability.</strong><br />
Although determining the likely profitability of an investment property may seem like a given, you might be surprised how many investors find themselves in a losing situation simply because they fail to do the math. Before buying an investment property at any price point, be sure you carefully determine how much rental income you are likely to generate on an annual basis. Weigh this against not only your mortgage and property taxes, but also all of the other costs that are likely to occur over the course of a year, such as advertising vacancies and doing general repairs and maintenance.</p>
<p>When calculating these costs, be conservative when estimating income and err towards over-estimating your outgoing expenses. You want to make sure you have enough wiggle room in your profit margins to afford your investment property payments no matter what unforeseen events may unfold in a given year.</p>

Which means that while you obviously have to make a pragmatic investment decision, you also have to think like a renter. Take a long hard look at exactly what sort of properties seem to be the most desirable in your area. Evaluate things like number of bedrooms, location, square footage, and other amenities. Knowing what renters want ahead of time helps guarantee that you won’t struggle to fill vacancies or be forced to settle for less desirable tenants later down the line.</p>
<p><strong>3. </strong><strong>Think long-term.</strong><br />
Will this property still be good a few years down the line? Remember, when it comes to investments, you’re not only investing in your financial well-being—you’re also investing in your future. Which is why it’s so important to take a good, hard look at long-term trends in areas you are considering. Look at city and county records to see how the neighborhood you’re looking at buying into is trending. Have properties been increasing or decreasing in value over the past five or ten years? How about crime rates? Has the demographic remained stable over the past decade or has it evolved (for instance, are residents generally shifting from families to young, single occupants)?</p>
<p>While no one can predict the future, much can be learned from the past. Make sure that you know exactly what direction the neighborhood you’re thinking about buying is headed.</p>
<p>Checking these few items off your Property Investment Checklist can make all the difference between a good investment and a bad one.</p>
