In Part 1, I described how the revision in 2003 of Article 107 of the Civil Code means that immigrants no longer have to divorce under the law of their country of origin if that law is discriminatory.

However, if you and your spouse are English, there may be advantages to filing under Engish law, or even in England. Marilyn Stowe, a UK divorce lawyer, has commented extensively on this subject in her family law blog and was also quoted in a recent article in the Guardian Weekly,“Warring Across Waters.”

According to Stowe and other lawyers mentioned in the article, the spouse with the least assets is treated more favourably under English law because the rules regarding financial disclosure are stricter in England than in other EU countries, making it more difficult for a spouse to hide his assets from his partner. In addition, it seems that alimony is granted under more generous terms in England than in its EU partners.

This is precisely why, in recent years, more English spouses have been filing for divorce abroad. They may even establish residency in countries such as Spain or France with precisely this plan in mind.

It’s important to be aware that under Brussels II the law of the nation where suit is filed first will prevail in a divorce. The Guardian article describes a scenario in which partners race each other to file first in order to have the upper hand. Usually it is the wife who must rush home to England and hire a lawyer if she suspects that her husband wants a divorce. If she does not she may lose out, as did a wife who “only got” £1 million of her husband’s £90M after he moved her to France for a year and divorced her under French law.

For many, the wild fires that swept Greece in 2005 and 2007 are a distant memory -  and thankfully so !   Nevertheless their impact is being felt to the current day as the Greek Government aims to assist the accelerated regrowth of the forest by assigning areas as “Forests in Perpetuity”. Prior to 2003, if married partners were of the same nationality, the law of their country of origin applied in case of divorce. But in 2002 a group of Moroccan women filed a complaint with the Defensor del Pueblo on the grounds that Moroccan law discriminated against women and therefore violated the Spanish Constitution. As a result, Article 107 of the civil code was revised. The Article now reads that the law of the country of origin will be applied except in certain circumstances, one of which is that this law does not recognise separation or divorce and/ or is discriminatory.

The revision to Article 107 is good news for mediation here in Spain. It would be pointless to attempt to mediate between partners where one partner has considerably more legal clout than the other. Mediation is also questionable when one partner is obviously intimated by the other. Thus in cases of domestic violence the mediator often has no choice but to terminate mediation if one partner is so cowed by the other that he or she is unable to express and defend his or her own point of view.

The revision to Article 107 is not without controversy. One of the problems, as pointed out in “Una reforma desconocida y controvertida” (El Pais, 2003) is that a divorce granted to immigrants under Spanish law will not be not recognised outside of Spain. So, for example, the divorce of a Moroccan woman obtained according to Spanish legislation would not be valid if she returned to Morocco. However, given the alternative – having to apply discriminatory laws here in Spain – the revision to Article 107 is certainly a step in the right direction.

Je suis tombé sur Zigonet sur l’article “France : un domaine pour les femmes, conçu par des femmes”.

À Mauguio (c’est en France, dans le Languedoc-Roussillon), un promoteur a construit une résidence (ils appellent ça un domaine) privée spécialement conçue pour les femmes.

Sur le blog Pelenop, on nous explique pourquoi il s’agit d’un projet immobilier sexiste. Mais ce n’est pas ce qui m’a interpelé…

Ce sont les caractéristiques mises en avant :

• un cellier peut remplacer le garage : Et elle la range où la voiture madame ? En plus, les courses, c’est lourd. Ce serait plus pratique d’avoir un garage qui donne directement dans la cuisine… Et même s’il ne pleut pas beaucoup dans le Sud, décharger les courses à l’abri, perso, je préfère.
• portail télécommandé à l’entrée de la résidence pour plus de sécurité : Il ne manque plus que les caméras de surveillance vidéo pour se sentir encore plus chez soi. Moi, en bon voleur, une résidence avec portail télécommandé, ça m’attire… surtout si je sais que la résidence est avant tout habitée par des femmes…
• hauteur sous-plafond de 2,70 m : un régal pour les femmes qui referont la décoration de leur intérieur. C’est tellement reposant de peindre à cette hauteur. Et à chauffer, je vous raconte pas la facture (bon, d’accord, on est dans le Sud ).
• places de parking engazonnées : ce type de parking est une connerie ! D’une part il n’existe pas de pelouse qui supporte ce type d’utilisation. D’autre part les fuites d’huile et autres oublis de votre titine chérie retournent directement à la terre, c’est tellement plus écologique. Le macadam à au moins l’avantage de les retenir et de les rediriger vers le système d’assainissement de la ville, c’est déjà mieux.
• une voûte sarrasine permet de glisser l’ordinateur et de cacher les câbles : ben oui, la femme est une rétrograde ! Ça fait longtemps qu’elle devrait passer au portable, tellement plus pratique et moins lourd, mais elle préfère rester avec son gros ordinateur tout plein de câbles. Pour ceux qui, comme moi, ne savent pas ce qu’est une voûte sarrasine, c’est simplement un espace sous escalier…
• les chambres principales disposent d’une salle de bain privative : voilà une idée qu’elle est bonne ! Je me disais bien que les femmes adoraient faire le ménage. Plusieurs salles de bain à nettoyer, c’est plus sympa qu’une seule…

Je me suis fait la réflexion qu’ils n’avaient pas parlé de la cuisine : c’est pourtant le domaine de prédilection des femmes ! Non ? Ah bon… L’argument béton aurait été de dire que les meubles y sont à portée de main même des femmes les plus petites.

A friend of mine had to give up one of his dreams in order to accomplish another, without seeing that all of his dreams can come true, he simply hasn’t got the will to see them all through.

It makes me feel sad when I hear of it.

Well Wednesday has come and nearly gone.

Snuck another one since I was still a wee peckish.

Lunch was a Green Monster in A Bowl (a mix of Angela and Kath). And a cracker with cheese:

Home and ate the following:

That there white thing is a Birthday bun. It’s a Chinese treat thing. You steam a white bun, and it’s filled with a yummy lotus paste. A wee bit sweet, but not too bad.

I went to a meeting tonight for a Suite Style musical being held in residence! Oh! Exciting. And I had my council meeting. Apparently in a week and a bit I will be going Paintballing…

Now I’m exhausted, and getting ready for some shut eye. Night all!
