<title><![CDATA[Gov McDonnell Responds to House Panel Rejection of Automatic Restoration of Rights Legislation]]></title>

<p><strong>UPDATE: </strong>It&#8217;s a first in Virginia, the full Senate voted in support of automatic restoration of rights for non-violent conviction felons but it did not pass in the House. The House Privileges and Elections Committee voted to table the bill with no likely passage for this General Assembly session.</p>
<p>The 71st Governor of the Commonwealth of Virginia, Bob McDonnell announced during the 2013 State of the Commonwealth Address that he supports automatic restoration of rights for non violent felons.</p>
<p>Governor McDonnell said during his speech at the State Capitol  that his administration has now restored the civil rights of more Virginians than any other Administration in state history. To date, he has restored rights to 4,423 individuals.</p>
<p>Governor McDonnell, in his speech, will support legislation which would allow for automatic restoration of rights for non-violent felons once they have served their sentence and paid fines/restitution.</p>
<p><b> </b>Governor Bob McDonnell issued the following statement on Monday after a House of Delegates subcommittee failed to act on legislation to provide for the automatic restoration of rights for non-violent felons. The inaction effectively ends the bill&#8217;s prospects for passage this session.</p>
<p>“Today, our efforts to provide for the automatic restoration of rights for non-violent felons who have paid their fines and their debts to society came to an end for this General Assembly session when a House of Delegates subcommittee failed to act on the proposal. It is disappointing that the General Assembly was not able to enact this common sense reform to restore the fundamental rights to vote and serve on juries to these citizens who have atoned for their earlier mistakes. </p>

<content:encoded><![CDATA[<p>The House of Delegates Privileges and Elections Sub-Committee killed the restoration of rights measure today. Governor Bob McDonnell supports automatic restoration of rights for non violent convicted felons but House republicans do not.</p>
<p>Governor Bob McDonnell said during State of the Commonwealth Address, just under a week ago,</p>
<p><i>“While we have significantly improved and fast-tracked the restoration of civil rights process, it’s still an executive process. As a nation that believes in redemption and second chances, we must  provide a clear path for willing individuals to be productive members of society once they have served their sentences and paid their fines and restitution. It is time for Virginia to join most of the other states and make the restoration of civil rights an automatic process for non-violent offenders. This session, Delegates Greg Habeeb and Peter Farrell have introduced bills to address this issue, and I urge you to support legislation for the automatic restoration of rights for non-violent felons.”</i></p>
<p>Multiple bills were introduced and all voted down. State Attorney General Ken Cuccinelli and Secretary of the Commonwealth Janet Kelly, both testified in favor of the constitutional amendment.</p>
<p>Delegate Charniele Herring, D-Arlington, and Chair of the Democratic Party of Virginia said &#8221; keeping voting rights from people who have served their time and paid their debt to society is wrong, even Governor Bob McDonnell says we should pass this legislation.&#8221;</p>
<p><strong>Here is how  members of the Privileges and Elections committee voted</strong>:</p>
<p>The subcommittee voted on a motion to recommend that HJ 535 be “passed by indefinitely” – meaning postponed for this session. That motion passed, 6-1.</p>
<p>All five Republicans on the subcommittee voted for the motion. They are Delegates Jackson Miller of Manassas, David Ramadan of Dulles, Timothy Hugo Centreville, Israel O’Quinn of Bristol, and Mark Cole of Fredericksburg. Democratic Delegate Johnny Joannou of Portsmouth also supported the motion.</p>
<p>Voting against the motion to kill the resolution was Delegate Algie T. Howell, a Democrat from Norfolk.</p>
<p>The automatic restoration of rights measure will go to the Senate soon. The bill is named the &#8220;Yvonne Miller Voter Restoration Act&#8221;.</p>

<p>The 71st Governor of the Commonwealth of Virginia, Bob McDonnell announced during the 2013 State of the Commonwealth Address that he supports automatic restoration of rights for non violent felons.</p>
<p>Governor McDonnell said during his speech on Wednesday night at the State Capitol  that his administration has now restored the civil rights of more Virginians than any other Administration in state history. To date, he has restored rights to 4,423 individuals.</p>
<p>Governor McDonnell, in his speech, will support legislation which would allow for automatic restoration of rights for non-violent felons once they have served their sentence and paid fines/restitution.<br />
 </p>
<p><strong>Here are the comments on this from the Governor’s address</strong>:<br />

<i>“</i><i>Second, we’ve dramatically improved our prisoner re-entry system. We want more good citizens, not more returning prisoners. <p>Delegate Herring works to Help Restore Voting Rights</p>
<p>Richmond, VA- In conjunction with several community groups and  Members of the House of Delegates, Delegate Charniele Herring (VA-46),  sponsor of HJ 543- a constitutional amendment to restore voting rights  for non-violent ex-felons, will be hosting her third clinic to train  volunteers and assist ex-felons in filling out the paperwork required to  request the restoration of their civil rights from Governor McDonnell.</p>
<p>Delegate Herring says, “The restoration of civil rights—the right to  vote is an ever-timely issue. The basic right to vote is a fundamental  part of what allows people to be engaged in their community. Virginia is  only one of two states that have this suppressive policy of permanently  taking away a fundamental right unless there is intervention case by  case at the highest levels of government.”</p>
<p>In Virginia, the Governor restores voting rights. On Monday, January  24 from 10am to 11:30am in conference room 7-west of the General  Assembly Building Delegates, volunteers and ex-felons will gather to  work on applications to the governor asking to restore their civil  rights as well as learning to assist others through the process that  Governor McDonnell has implemented for the duration of his term as  Governor.</p>
<p>Herring says, “When a person has served their time, paid fines, and  paid restitution they are supposed to be welcomed back into society. We  have a judicial system that punishes and rehabilitates— when a person  has completed their court sanctioned penalties, he or she deserves their  rights without having to hope for a stroke of the Governor’s pen.”</p>
<p>“HJ 543 was drafted with the intention of taking a step toward  automatic voter restoration, to help Virginia take a step forward. The  reality is that my bill is only a small step, if passed it will allow  for a larger discussion in the General Assembly about a restoration  process for non-violent offenders. Our backwards way not only costs the  state resources but it is inconsistent with the value of redemption,”  says Herring, “While Governor McDonnell has improved the process for the  restoration of voting rights in Virginia, the reality is a subjective  bureaucratic process, and that process is contrary to our notion of  American citizenship. Moving toward an automatic process will save not  only money, but human dignity as well.”</p>
