<p>Assalaamu Alaykum brothers and sisters,</p>
<p>Have any of you ever been stung by what seem&#8217;s like rather a large bank charge when an unexpected payment takes you into the red?</p>
<p>I know I have, I was charged £25, which is quite infuriating given I&#8217;ve done everything I can to avoid Riba and this is exactly what such charges are &#8211; Riba.</p>
<p>You see Riba is where you charge more or expect something extra for borrowing money to someone.</p>
<p>So if you accidently go a few quid into the red, then obviously you will want to pay that off as soon as possible but on top of that the bank will charge you between £25 and £50 on top.</p>
<p>This isn&#8217;t just like Riba IT IS RIBA! and as such Muslims should openly condemn it as an evil as Allah says in the Quran,</p>
<p><strong>O you who believe! Be afraid of Allah and give up what remains (due to you) from Riba (usury) (from now onward), if you are (really) believers. And if you do not do it, then take a notice of war from Allah and His Messenger but if you repent, you shall have your capital sums. Deal not unjustly (by asking more than your capital sums), and you shall not be dealt with unjustly (by receiving less than your capital sums). </strong><br />
Translation of the Quran, 2:278-280</p>
<p>As well as this it is a Zulm, an oppression because such charges for accidentally going a little bit into the red are all too possible in today&#8217;s society where everything is on direct debit and is invisible and such charges are therefore only going to fall on the poorest people in society.</p>
<p>May Allah (swt) grant us aid and victory in bringing Shariah to Leicester and the rest of the world so such oppression is not allowed again and these merchant bankers are dealt with severely if they will not repent and give up Usury.</p>

<title><![CDATA[La Mourabaha permettra à des dizaines de milliers de marocains d’accéder au logement ]]></title>

<p style="text-align:justify;"><strong><span style="color:#333399;">Les produits bancaires halal reviennent au-devant de la scène bancaire marocaine. Cela fait plus de deux ans qu’ils ont reçu le feu vert de la banque centrale, mais ces produits trop taxés coûtaient plus cher et avaient du mal à trouver preneur. A partir du premier janvier 2010 la TVA sera appliquée uniquement sur la marge de la banque – et non sur la totalité de l’échéance – et au taux de 10% seulement contre 20% auparavant.</span></strong></p>

<p style="text-align:justify;"><span style="color:#333399;">L’un des principaux types de financement autorisé par Bank Al Maghrib, la Mourabaha est un contrat par lequel un établissement de crédit acquiert, à la demande d’un client, un bien meuble ou immeuble qu’il lui revendra avec une marge bénéficiaire. Le règlement par le client donneur d’ordre se fait par des versements sur une période convenue d’avance.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Surtaxé, ce financement immobilier restait trop cher par rapport au crédit classique. Grâce à la loi de Finances 2010, cette formule ne sera plus sanctionnée par la TVA puisqu’elle ne supportera plus la TVA sur l’échéance totale, mais uniquement sur le profit de la banque et au taux de 10% seulement contre 20% auparavant.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Pour Lahcen Daoudi, membre de la commission parlementaire des finances et du développement économique, qui milite depuis vingt ans au sein de l’Association des études et recherches en économie islamique qu’il a fondée, cette mesure est la bienvenue, même si elle a beaucoup tardé : « Beaucoup de familles auraient pu avoir un logement et sortir de la pauvreté grâce à ce produit. Pendant longtemps on a traité ces produits de manière idéologique et non comme des outils de financement comme les autres. » Il estime qu’aujourd’hui des dizaines de milliers de citoyens, qui refusent le taux d’intérêt des banques, vont recourir à ce mode de financement pour se procurer une voiture ou une maison. Pour que les financements islamiques remportent le succès escompté, Lahcen Daoudi invite les banques à ne pas être trop gourmandes au niveau de leur marge bénéficiaire. </span></p>
<p style="text-align:justify;"><span style="color:#333399;">En plus du coût jugé trop élevé, les équipes d’Attijariwafa bank qui travaillaient sur les produits islamiques étaient parvenues à la conviction qu’il y a aussi un problème de distribution : les produits alternatifs ne peuvent pas marcher tant qu’ils seront distribués dans les agences bancaires classiques. D’où l’idée qui commence à germer d’un réseau de points de vente exclusivement dédiés aux produits islamiques.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Avec cette baisse de la TVA, le gouvernement donne un coup de pouce à la Mourabaha, et partant au marché immobilier marocain. Des analystes voient derrière cette baisse de la TVA une volonté de relancer un secteur qui a connu une année 2009 difficile en ouvrant le marché à des citoyens réfractaires aux crédits immobiliers traditionnels.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Une chose est sûre, ces mesures vont promouvoir les produits financiers islamiques et répondre à une demande bien réelle. Pour Belkacem Boutayeb, expert consultant en finances et banques islamiques, outre l’attrait de ces produits lié aux sensibilités culturelles et cultuelles des populations, les banques marocaines – par ailleurs très performantes et se positionnant superbement au Maghreb et sur le continent africain – peuvent parfaitement jouer leur rôle de relais commercial pour ces produits financiers islamiques, si l’Etat marocain décide des formules d’incitation et d’encouragement en faveur de ces nouvelles opportunités de financement.</span></p>

<p style="text-align:justify;"><span style="color:#333399;">La Mourabaha est un contrat de vente au prix de revient majoré d’une marge bénéficiaire connue et convenue entre la banque et le client. (البيع بربح معلوم). La banque achète le bien qu’elle revend au comptant ou à terme à son client moyennant une marge bénéficiaire convenue entre les deux parties.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La Mourabaha est un mode de financement qui sera proposé par Banque Zitouna aussi bien pour les clients particuliers qu’aux entreprises. La mourabaha pourra financer l’immobilier, les véhicules de tourisme, utilitaires et industriels, les besoins d’exploitation (stocks, matières, produits intermédiaires…), ainsi que les équipements professionnels et / ou privés.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Pour que le contrat de Mourabaha soit conforme aux principes de la  Charia : l’objet du contrat doit être licite ; l’achat/revente doivent être réels et non fictifs ; le prix de revient, la marge bénéficiaire de la banque et les délais de paiement doivent être préalablement connus et acceptés par les deux parties.</span></p>
<h5 style="text-align:justify;"><span style="color:#333399;">Ijara</span></h5>
<p style="text-align:justify;"><span style="color:#333399;">Le contrat d’Ijara est un contrat de location, le cas échéant avec une option d’achat du bien à terme. Sous la transaction Ijara, la banque (référée comme Mu’jir) achètera le bien immobilier tel que sollicité par le client (référé comme Must’ir) et donne au client le droit de l’utiliser et d’en bénéficier pour une période de temps prédéterminée et en contre partie le client paye un loyer convenu d’avance (référé comme ujrah).</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Le bien immobilier reste la propriété de la Banque vu que seul l’usufruit, c&#8217;est-à-dire le droit de l’usage, est transféré au locataire. L’ijara est une technique de financement des investissements mobiliers et immobiliers qui constitue un moyen souple et pratique donnant accès à des avantages fiscaux.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Conformité à la Charia : l’objet de la location (l’utilisation du bien loué) doit être connu et accepté par les deux parties ; la location doit porter sur des biens non destructibles du fait de la jouissance ou de l’utilisation ; la durée de location, le délai de paiement, le montant du loyer et la périodicité doivent être déterminés et connus à la conclusion du contrat de leasing.</span></p>
<h5 style="text-align:justify;"><span style="color:#333399;">Moudharaba</span></h5>
<p style="text-align:justify;"><span style="color:#333399;">Dans le contrat de Moudharaba, la banque en tant que financier d’une opération remet les fonds à un moudhareb afin qu’il l’investisse dans un projet spécifique nécessitant un savoir-faire particulier. Les profits sont partagés in-fine selon un ratio préétabli (principe de la société en commandite (article 67 du CSC Tunisien). La banque peut jouer le rôle de Moudhareb en utilisant les fonds des déposants dans divers projets (Moudharaba restrictive /Libre).</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La Moudharaba constitue un investissement direct, semblable au capital risque. La banque se fixe pour objectif d’assurer une rentabilité satisfaisante des capitaux investis, dans le cadre d’un compte d’investissement et rémunération de l’épargne.</span></p>
<p style="text-align:justify;"><span style="color:#333399;"><strong>Réseau et Direction</strong></span></p>
<p style="text-align:justify;"><span style="color:#333399;">Le siège social la banque, situé aux Berges du Lac II à Tunis est en cours de construction, et son ouverture est prévue pour la fin du 1er trimestre 2010. Par ailleurs, un vaste programme d’ouverture d’agences a été engagé et couvrira dans une première phase les principales villes de Tunisie. Prés de dix agences seront ouvertes d&#8217;emblée pour le démarrage de la banque, courant 2010 dont 5 sur le Grand Tunis dans les localités d’Ennasser, La Marsa, Centre Ville et le Kram, ainsi que 2 à Sousse et 2 à Sfax.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Mahfoudh Barouni, nommé Directeur Général est considéré comme le spécialiste de la finance islamique en Tunisie. Economiste de formation, il peut se prévaloir d’une longue et riche carrière, dont 25 ans à la tête de la  BEST Bank. Pour le seconder, Walid Koubaa, n’est pas non plus un inconnu dans le domaine bancaire et dans le secteur de la finance islamique. Ancien de la Citibank à Tunis, il a notamment travaillé sur la création de la Noor Bank et de la Sharjah Islamic Bank.</span></p>

Syaikh Abdul Aziz bin Abdullah bin Baz ditanya : Kami adalah para pegawai Turki yang bekerja di kerajaan Saudi Arabia. Negara kami Turki, sebagaimana yang kita maklumi, adalah negara yang menjadikan sekulerisme sebagai hukum dan undang-undang. Riba demikian memasyrakat di negeri kami dalam aplikasi yang aneh sekali, hingga mencapai 50% dalam satu tahunnya. Kami disini terpaksa mentransfer uang kepada keluarga kami di Turki melalui jasa bank-bank tersebut, yang jelas merupakan sumber dan biangnya riba.</p>
<p>Kami juga terpaksa menyimpan uang kami di bank karena khawatir dicuri, hilang atau bahaya-bahaya lain. Dengan dasar itu, kami mengajukan dua pertanyaan penting bagi kami. Tolong berikan penjelasan dalam persoalan kami ini, semoga Allah memberi kan pahala terbaik bagi anda.</p>

<p>Pertama : Bolehkah kami mengambil bunga dari bank-bank riba tersebut lalu kami sedekahkan kepada fakir miskin atau membangun sarana umum, daripada dibiarkan menjadi milik mereka ?</p>
<p>Kedua : Kalau memang tidak boleh, apakah boleh menyimpan uang di bank-bank tersebut dengan alasan darurat untuk menjaga uang itu agar tidak tercuri atau hilang, tanpa mengambil bunganya ? Harus dimaklumi, bahwa pihak bank akan memanfaatkan uang tersebut selama masih ada didalammnya.</p>
<p>Jawaban<br />
Kalau memang terpaksa mentransfer uang melalui bank riba, tidak ada masalah, insya Allah, berdasarkan firman Allah Ta&#8217;ala.</p>
<p>&#8220;Artinya : Sesungguhnya Allah telah menjelaskan kepada kamu apa yang diharamkanNya atasmu, kecuali apa yang terpaksa kamu memakannya..&#8221; [Al-An'am : 119]</p>
<p>Tidak diragukan lagi, bahwa mentransfer uang melalui bank-bank itu termasuk bentuk kedaruratan umum pada masa sekarang ini, demikian juga menyimpan uang didalamnya tanpa harus mengambil bunganya. Kalau diberi bunga tanpa ada kesepakatan sebelumnya atau tanpa persyaratan, boleh saja diambil untuk dioperasikan di berbagai kebutuhan umum, seperti membantu fakir miskin, menolong orang-orang yang terlilit hutang dan lain sebagainya.</p>
<p>Namun bukan untuk dimiliki dan digunakan sendiri. Keberadaannya bahkan berbahaya bagi kaum muslimin bila ditinggalkan begitu saja, walaupun dari usaha yang tidak diperbolehkan. Maka lebih baik digunakan untuk yang lebih bermanfaat bagi kaum muslimin, daripada dibiarkan menjadi milik orang-orang kafir sehingga justru digunakan untuk hal-hal yang diharamkan oleh Allah.</p>
<p>Namun bila mungkin mentransfer melalui bank-bank Islam atau melalui cara yang diperbolehkan, maka tidak boleh mentransfer melalui bank-bank riba. Demikian juga menyimpan uang, bila masih bisa dilakukan di bank-bank Islam atau di badan-badan usaha Islam, tidak boleh menyimpannya di bank-bank kafir berbasis riba, karena hilangnya unsur darurat. Hanya Allah yang bisa memberikan taufiqNya.</p>

<p>It&#8217;s been a very busy month for living:room as word about the blog has spread across the country and beyond!</p>
<p>Firstly, we were featured in the &#8216;Around the Block&#8217; section of the Irish Times&#8217; Property Supplement, where  our &#8216;good design is good value&#8217; message was emphasised along with our use of social media and the free advice offered on the blog, to <a title="Irish Times - living:room" href="http://www.irishtimes.com/newspaper/property/2009/1008/1224256160519.html" target="_blank">help homeowners make better use of their space</a>.</p>
<p>Living:room then took to the road with the <a title="Denny Home Is" href="http://www.homeis.ie/home/" target="_blank">Denny Home Is campaign</a> &#8211; offering free home design and planning advice in their Pop Up Homes in Galway, Letterkenny &#38; Dublin, all in aid of the Simon Community to help the homeless. Denny are asking what home means to you and contributing €1 for every comment, picture or video received &#8211; here I am at the Galway house, doing my bit:</p>

<p>The living:room blog was also featured in a presentation to the Royal Institute of British Architects in London, as an excellent example of <a title="Su Butcher - RIBA Presentation" href="http://www.justpractising.com/talks/architects-why-take-your-network-online/" target="_blank">how architects can use social media to communicate about their work</a> with clients and the public at large.</p>
<p>The presentation was given by <a title="Su Butcher - Twitter" href="http://twitter.com/SuButcher" target="_blank">Su Butcher</a> &#8211; Practice Manager at Barefoot &#38; Gilles Architects and one of the most prolific architectural voices using social media in the UK. Su was so taken with the living:room story and <a title="Taking Your Network Online - Living:room" href="http://www.justpractising.com/construction-on-twitter/taking-your-network-online-livingroom/" target="_blank">how I came to set up living:room &#38; start blogging, tweeting et al</a>, she even featured it in her blog, <a title="Su Butcher - Just Practising" href="http://www.justpractising.com/" target="_blank">&#8216;Just Practising&#8217;</a>, to inspire other architects to make the leap. How did it all come about? Simply by chatting one day on Twitter&#8230;</p>
<p>And last week, <a title="Silicone Republic " href="http://www.siliconrepublic.com/" target="_blank">Silicone Republic</a> included living:room in a feature on <a title="Silicone Republic - Blogs Digest" href="http://www.siliconrepublic.com/news/article/14383/new-media/blog-digest" target="_blank">blogs offering useful tips for a leaner lifestyle</a> in these recession weary times, with our articles<strong> &#8216;The DIY Energy Efficient Home&#8217;</strong> &#38; <strong>&#8216;It&#8217;s Not About Looks &#8211; Good Design Works&#8217;</strong>, being highlighted.</p>

<title><![CDATA[Finance Islamique : le  Maroc s’attaque enfin à la surtaxation de la Mourabaha]]></title>

<p style="text-align:justify;"><span style="color:#333399;"><strong>Grâce à la loi de Finances 2010, la Mourabaha ne sera plus sanctionnée par la TVA puisqu’elle ne supportera <span style="color:#333399;">plus la  TVA sur l’échéance totale mais uniquement sur le profit de la banque et au taux de 10% seulement contre 20% auparavant.</span></strong></span><strong><span style="color:#333399;"> </span></strong></p>
<p style="text-align:justify;"><span style="color:#333399;"><strong>Pour le Ministre marocain des finances, Salaheddine Mezouar, c&#8217;est simplement une promesse </strong><strong>tenue</strong><strong>. Pour Lahcen Daoudi, membre de la commission parlementaire des finances et du développement économique, qui milite depuis vingt ans au sein de l’Association des études et recherches en économie islamique qu’il a fondée, c’est un grand jour qui marque le véritable essor des produits financiers charia compatibles au Maroc.</strong></span></p>

<p style="text-align:justify;"><span style="color:#333399;">Au Maroc, le budget 2010 poursuit son chemin au sein de la  Chambre des représentants, après son adoption jeudi 12 novembre 2009 par la commission des finances, dans l’attente de son examen en séances plénières. La loi de finances 2010 sera votée à la première chambre le jeudi 19/11/2009, avant d’être soumise à la Chambre des conseillers.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La plus grande nouvelle est relative au produit bancaire Mourabaha qui ne sera plus sanctionnée par la   TVA. Il sera donc mis fin à la surtaxation de la mourabaha qui était considérée comme opération d’achat et de vente comme c’est le cas pour le leasing, avec application de la TVA au taux de 20% sur le remboursement du capital et sur la marge de la banque ou sa rémunération. A partir du premier janvier 2010 il sera appliqué uniquement 10% de TVA sur la marge de la banque sans toucher au principal comme dans le cas de l’emprunt avec intérêts.</span></p>
<h4><span style="color:#333399;">Exemple</span></h4>
<p style="text-align:justify;"><span style="color:#333399;">Mr X achète en 2009 un appartement de 900.000 dh avec mourabaha. Il avance 300.000 dh. Il lui reste à payer 600.000 + la rémunération de la banque qu’on suppose de 60.000 dh. Le tout étalé sur 120 mensualités.</span></p>
<p><span style="color:#333399;">La mensualité en 2009 est de :</span></p>
<p><span style="color:#333399;">((600 000:120)+ TVA ))+ ((60 000:120)+TVA))<br />
= 5000dh +5000×20% + 500 + 500×20%<br />
=5000dh + 1000dh +500dh +100 dh<br />
= 6600dh</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La somme de la TVA est donc de 1100 dh par mois soit 132.000 dh pour les 120 mois</span></p>
<p style="text-align:justify;"><span style="color:#333399;">En 2010 on ne paie plus la TVA sur les 5000 dh et uniquement 10% sur les 500 dh. Donc la mensualité en 2010 ne sera plus que de :</span></p>
<p><span style="color:#333399;">5000dh + 500dh + 500x 10%<br />
=5000dh + 500 + 50<br />
= 5550 dh par mois</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La TVA mensuelle ne sera plus que de 50 dh au lieu de 1100 dh, et sur la totalité 6.000 dh au lieu de 132.000 dh, soit une économie substantielle de 126.000 dh.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Les produits financiers islamiques deviennent donc aussi compétitifs que le financement bancaire traditionnel, n’étant plus assimilés au leasing, mais au financement bancaire normal.</span></p>

<title><![CDATA[Poverty and Islam!]]></title>

<p><strong><img class="alignright" src="http://farm1.static.flickr.com/34/71885208_539c051bff_m.jpg" alt="" width="240" height="174" />Firstly:</strong></p>
<p><strong>Poverty is one of the calamities that Allaah has decreed should happen, either to a specific person or a family or a society</strong>. <strong>Poverty has negative effects on people’s beliefs and conduct</strong>. Many Christian missionaries exploit the poverty and want of some peoples to spread Christianity among their ranks. Similarly, immoral behaviour becomes widespread to a large extent because of poverty, as a means of meeting people’s needs, so theft, murder, zina and sale of haraam things become widespread. Undoubtedly these things have a negative effect on individuals and societies. Allaah tells us that some of the mushrikeen used to kill their children, the apples of their eyes, either because of the poverty in which they were living or for fear of poverty that might befall them. Allaah says of the first case (interpretation of the meaning):</p>
<p><strong><em><span style="color:#0000ff;">“kill not your children because of poverty — We provide sustenance for you and for them”</span></em></strong></p>
<p>[al-An’aam 6:151]</p>
<p><strong>And He says of the second case (interpretation of the meaning):</strong></p>
<p><strong><em><span style="color:#0000ff;">“And kill not your children for fear of poverty. We shall provide for them as well as for you. Surely, the killing of them is a great sin”</span></em></strong></p>
<p>[al-Isra’ 17:31]</p>
<p><strong>In al-Saheehayn there is narrated the story of a woman of the Children of Israel who,</strong> when she needed money and felt under pressure, she could not find anyone but her paternal cousin who wanted to have his way with her in return for giving her money. Then Allaah saved her from that after she reminded him of Allaah and told him to fear Him.</p>
<p><strong>Whatever the case, it is well known that poverty leads to crimes and corruption</strong>. Many nations suffer from it and are looking for solutions to this problem, but to no avail, and there is no solution except in Islam, which brought rulings for all people until the Hour begins.</p>
<p><strong>Secondly:</strong></p>
<p><strong>The means that have been prescribed by Islam to solve the problem of poverty and combat it are as follows:</strong></p>
<p><strong>1 – Teaching people to believe truly that provision comes from Allaah and that He is the Provider (al-Razzaaq), and every calamity that Allaah decrees is for a reason, and that the poor Muslim should be patient in bearing his calamity and strive to relieve himself and his family of poverty.</strong></p>
<p><strong>Allaah says (interpretation of the meaning):</strong></p>
<p><strong><em><span style="color:#0000ff;">“Verily, Allaah is the All‑Provider, Owner of Power, the Most Strong”</span></em></strong></p>
<p>[al-Dhaariyaat 51:58]</p>
<p><strong><em><span style="color:#0000ff;">“And no moving (living) creature is there on earth but its provision is due from Allaah. And He knows its dwelling place and its deposit (in the uterus or grave). All is in a Clear Book (Al‑Lawh Al‑Mahfooz — the Book of Decrees with Allaah)”</span></em></strong></p>
<p>[Hood 11:6]</p>
<p><strong><em><span style="color:#0000ff;">“Who is he that can provide for you if He should withhold His provision? Nay, but they continue to be in pride, and (they) flee (from the truth)”</span></em></strong></p>
<p>[al-Mulk 67:21]</p>
<p><strong><em><span style="color:#0000ff;">“And indeed We have honoured the Children of Adam, and We have carried them on land and sea, and have provided them with At‑Tayyibaat (lawful good things), and have preferred them above many of those whom We have created with a marked preferment”</span></em></strong></p>
<p>[al-Isra’ 17:70]</p>
<p><strong>It is because of these beliefs that a man should bear with patience whatever befalls him of the calamity of poverty, and turn to Allaah alone in seeking provision, and accept the decree of Allaah, and strive to earn a living.</strong></p>
<p><strong>It was narrated that Suhayb al-Roomi (may Allaah be pleased with him) said</strong>: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: <strong><em><span style="color:#339966;"><span style="color:#99cc00;">“How wonderful is the situation of the believer, for all his affairs are good. If something good happens to him, he gives thanks for it and that is good for him; if something bad happens to him, he bears it with patience, and that is good for him.”</span> <span style="color:#000000;">Narrated by Muslim (2999).</span></span></em></strong></p>
<p><strong><em><span style="color:#000000;">We can understand the effect of this belief on the Muslims by looking at what happens to others. In Japan – for example – in 2003 thirty-th</span></em></strong>ree thousand people committed suicide! And one of the main reasons for that was unemployment. In a report on the BBC website on 1/9/2004 they said:</p>
<p><strong>Official statistics show that thirty-three thousand people killed themselves last year in Japan</strong>. Japanese officials say that one of the reasons for this rise in the suicide rate is the economic recession that Japan is facing, which is regarded as the worst in fifty years. This has led to an unprecedented rise in unemployment as well as a rise in cases of depression, especially among middle-aged men. End quote.</p>
<p>Allaah says (interpretation of the meaning):</p>
<p><strong><em><span style="color:#0000ff;">“Truly, your Lord enlarges the provision for whom He wills and straitens (for whom He wills). Verily, He is Ever All‑Knower, All‑Seer of His slaves”</span></em></strong></p>
<p>[al-Isra’ 17:30].</p>
<p><strong>Ibn Katheer (may Allaah have mercy on him) said:</strong></p>
<p><strong>The words of Allaah </strong><span style="color:#ff9900;"><strong><em>“Truly, your Lord enlarges the provision for whom He wills and straitens (for whom He wills)” tell us that He, may He be exalted, is the Provider, the Withholder and the Bestower, Who deals with His creation as He wills. He grants independence of means to whomsoever He wills and makes poor whomsoever He wills, with wisdom in that. Hence He says “Verily, He is Ever All‑Knower, All‑Seer of His slaves” i.e., He knows and sees who deserves to be rich and who deserves to be poor.</em></strong></span></p>
<p><strong>In some cases wealth may be a means of letting people get carried away in sin and poverty may be a punishment. We seek refuge with Allaah from both.</strong></p>
<p>Tafseer Ibn Katheer (5/71).</p>
<p><strong>2 – Seeking refuge with Allaah from poverty.</strong></p>
<p><strong>The Sunnah relates to us what the Prophet (peace and blessings of Allaah be upon him) used to do and what he taught his ummah to do, which is seeking refuge with Allaah from poverty, because of the effect that it has on a person, his family and his society.</strong></p>
<p><strong>It was narrated that Muslim ibn Abi Bakrah said</strong>: My father used to say following every prayer: <strong><em><span style="color:#ffcc00;">Allaahumma inni a’oodhu bika min al-kufri wa’l-faqri wa ‘adhaab il-qabr (O Allaah, I seek refuge with You from disbelief, poverty and the torment of the grave</span></em></strong>), and I used to say them too. My father said: O my son, where did you get this from? I said: From you. <strong>He said: The Messenger of Allaah (peace and blessings of Allaah be upon him) used to say that following every prayer.</strong></p>
<p><strong>Narrated by al-Nasaa’i (1347); classed as saheeh by al-Albaani in Saheeh al-Nasaa’i.</strong></p>
<p><strong>It was narrated from ‘Aa’ishah (may Allaah be pleased with her)</strong> that the Prophet (peace and blessings of Allaah be upon him) used to say in his prayer: <strong><em><span style="color:#ffcc00;">“Allaahumma inni a’oodhi bika min al-ma’tham wa’l-maghram (O Allaah, I seek refuge with You from sin and heavy debt).”</span></em></strong> Someone said to him: <strong>“How often you seek refuge from heavy debt</strong>!” <strong>He said:</strong> <strong><em><span style="color:#00ff00;">“When a man gets into debt, he speak and tells lies, and he makes a promise and breaks it.” Narrated by al-Bukhaari (832) and Muslim (589).</span></em></strong></p>
<p><strong>3 – Encouragement to work and earn a living, and to travel in the land to seek provision.</strong></p>
<p><strong>Allaah says (interpretation of the meaning):</strong></p>
<p><strong><em><span style="color:#0000ff;">“He it is Who has made the earth subservient to you (i.e. easy for you to walk, to live and to do agriculture on it); so walk in the path thereof and eat of His provision. And to Him will be the Resurrection”</span></em></strong></p>
<p>[al-Mulk 67:15]</p>
<p><strong><em><span style="color:#0000ff;">“Then when the (Jumu‘ah) Salaah (prayer) is ended, you may disperse through the land, and seek the Bounty of Allaah (by working), and remember Allaah much, that you may be successful”</span></em></strong></p>
<p>[al-Jumu’ah 63:10]</p>
<p><strong>It was narrated from al-Miqdaam (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said:</strong> “No one ever eats any food better than that which he has earned with his own hands. The Prophet of Allaah Dawood(peace be upon him) ate that which he earned with his own hands.” Narrated by al-Bukhaari (1966).</p>
<p><strong>It was narrated from al-Zubayr ibn al-‘Awwaam (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said:</strong> <strong><em><span style="color:#99cc00;">“If one of you were to take a rope and bring firewood on his back and sell it, thus preserving his dignity, that is better for him than asking of people who may give to him or withhold from him.”</span></em></strong></p>
<p>Narrated by al-Bukhaari (1402).</p>
<p><strong>4 – Making zakaah obligatory on the wealth of the rich</strong></p>
<p><strong>Allaah has granted the poor a share of zakaah, which is to be given to the poor to keep</strong>, and is to be given until he becomes independent of means and is no longer poor.</p>
<p><strong>Allaah says (interpretation of the meaning):</strong></p>
<p><strong><em><span style="color:#0000ff;">“As-Sadaqaat (here it means Zakaah) are only for the Fuqaraa’ (poor), and Al‑Masaakeen (the poor) and those employed to collect (the funds); and to attract the hearts of those who have been inclined (towards Islam); and to free the captives; and for those in debt; and for Allaah’s Cause (i.e. for Mujaahidoon — those fighting in a holy battle), and for the wayfarer (a traveller who is cut off from everything); a duty imposed by Allaah. And Allaah is All-Knower, All-Wise”</span></em></strong></p>
<p>[al-Tawbah 9:60]</p>
<p><strong>“And those in whose wealth there is a recognised right</strong></p>
<p>25<strong><em><span style="color:#0000ff;">. For the beggar who asks, and for the unlucky who has lost his property and wealth (and his means of living has been straitened)”</span></em></strong></p>
<p>[al-Ma’aarij 70:24, 25].</p>
<p><strong>5 – Encouragement to give charity, set up waqfs and sponsor orphans and widows</strong></p>
<p><strong>Allaah says (interpretation of the meaning):</strong></p>
<p><strong><em><span style="color:#0000ff;">“So keep your duty to Allaah and fear Him as much as you can; listen and obey, and spend in charity; that is better for yourselves. And whosoever is saved from his own covetousness, then they are the successful ones”</span></em></strong></p>
<p>[al-Taghaabun 64:16]</p>
<p><strong><em><span style="color:#0000ff;">“and whatsoever you spend of anything (in Allaah’s Cause), He will replace it. And He is the Best of providers”</span></em></strong></p>
<p>[Saba’ 34:39]</p>
<p><strong><em><span style="color:#0000ff;">“And whatever good you send before you for yourselves (i.e. Nawaafil — non‑obligatory acts of worship: prayers, charity, fasting, Hajj and ‘Umrah), you will certainly find it with Allaah, better and greater in reward”</span></em></strong></p>
<p>[al-Muzzammil 73:20]</p>
<p><strong>It was narrated that ‘Adiyy ibn Haatim said: I heard the Prophet (peace and blessings of Allaah be upon him) say</strong>: <strong><em><span style="color:#99cc00;">“Whoever among you can shield himself against the Fire, even with half a date, let him do so.”</span></em></strong> Narrated by al-Bukhaari (1347) and Muslim (1016).</p>
<p><strong>It was narrated that Sahl ibn Sa’d said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said</strong>: <strong><em><span style="color:#99cc00;">“I and the one who sponsors an orphan will be like this in Paradise” – and he gestured with his forefinger and middle finger, holding them slightly apart.</span></em></strong></p>
<p><strong>Narrated by al-Bukhaari (4998).  Muslim (2983) narrated a similar report from the hadeeth of Abu Hurayrah.</strong></p>
<p><strong>It was narrated that Abu Hurayrah said: The Prophet (peace and blessings of Allaah be upon him) said:</strong> <strong><em><span style="color:#99cc00;">“The one who strives to help widows and the poor is like the one who strives in jihad for the sake of Allaah and the one who prays at night and the one who fasts during the day.” Narrated by al-Bukhaari (5038) and Muslim (2982).</span></em></strong></p>
<p><strong>6 – Prohibition on riba (usury), gambling and deceit in selling</strong></p>
<p><strong>Allaah says (interpretation of the meaning):</strong></p>
<p><strong><em><span style="color:#0000ff;">“O you who believe! Fear Allaah and give up what remains (due to you) from Ribaa (from now onward) if you are (really) believers.</span></em></strong></p>
<p><strong><em><span style="color:#0000ff;">279. And if you do not do it, then take a notice of war from Allaah and His Messenger but if you repent, you shall have your capital sums. Deal not unjustly (by asking more than your capital sums), and you shall not be dealt with unjustly (by receiving less than your capital sums)”</span></em></strong></p>
<p>[al-Baqarah 2:278-279]</p>
<p><strong><em><span style="color:#0000ff;">“O you who believe! Intoxicants (all kinds of alcoholic drinks), and gambling, and Al‑Ansaab (stone altars for sacrifices to idols etc) and Al‑Azlaam (arrows for seeking luck or decision) are an abomination of Shaytaan’s (Satan’s) handiwork. So avoid (strictly all) that (abomination) in order that you may be successful”</span></em></strong></p>
<p>[al-Maa'idah 5:90]</p>
<p><strong>It was narrated from Abu Hurayrah that the Messenger of Allaah (peace and blessings of Allaah be upon him) passed by a pile of foodstuff; he put his hand in it and found that it had gotten wet. He said,</strong> <strong><em><span style="color:#99cc00;">“What is this, O seller of the foodstuff?” He said: It got rained on, O Messenger of Allaah. He said: “Why don’t you put it on top of the food so that people can see it? Whoever deceives (people) does not belong to me.”</span></em></strong></p>
<p>Narrated by Muslim (102).</p>
<p><strong>That is because if these things are done and become widespread among people, it means that some are taking people’s wealth unlawfully, and people may lose all their wealth because of them. Hence the texts clearly forbid them.</strong></p>
<p><strong>7 – Encouragement to help the needy and support the weak</strong></p>
<p><strong>It was narrated that al-Nu’maan ibn Basheer said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said:</strong> <strong><em><span style="color:#99cc00;">“The likeness of the believers in their mutual love, mercy and compassion is that of the body; when one part of it is in pain, the rest of the body joins it in restlessness and fever.” Narrated by al-Bukhaari (5665) and Muslim (2586).</span></em></strong></p>
<p><strong>It was narrated from Ibn ‘Abbaas (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said:</strong><strong><em><span style="color:#99cc00;"> “He is not a Muslim who eats his fill when his neighbour goes hungry.” Narrated by al-Bayhaqi in al-Shu’ab (9251) and by others. Classed as hasan by al-Albaani.</span></em></strong></p>
<p><strong>In Muwatta’ al-Imam Maalik (1742) it is narrated from Yahya ibn Sa’eed that ‘Umar ibn al-Khattaab met Jaabir ibn ‘Abd-Allaah who was carrying some meat with him. He said: What is this?</strong></p>
<p><strong>He said:</strong> O Ameer al-Mu’mineen, we desired meat so I bought some meat for a dirham.</p>
<p><strong>‘Umar said</strong>: <strong><em><span style="color:#ff9900;">Would one of you want to fill his belly apart from his neighbour or his cousin? What don’t you pay heed to the verse “You received your good things in the life of the world, and you took your pleasure therein” [al-Ahqaaf 46:20]?</span></em></strong></p>
<p><strong>Finally:</strong></p>
<p><strong>This is a brief look at poverty, which points to some of its bad effects. The Muslim knows that poverty and richness, and whether things are given to one or withheld, are all subject to the decree of Allaah. So he bears hardships with patience when they come, and he thanks Allaah, may He be exalted, for good times when he finds them. But he is required to work and seek to earn a living so as to relieve himself and his family of poverty. But if someone is unable to do that because of health reasons or problems in his land, then Islam relieves him of poverty by means of zakaah and charity that are given by the rich. This is the share of their wealth that the poor are entitled to.</strong></p>

<p style="text-align:justify;"><span style="color:#333399;">Une délégation de l’Institut français de finance islamique dirigée par son président, M. Hervé de Charette, ancien ministre des Affaires et étrangères et, par ailleurs, président de la Chambre de commerce Francoarabe, accompagné du Dr. Saleh Al-Tayar, premier vice-président de l’Institut et Secrétaire général de la  CCFA, et de M. Anouar Hassoun, vice-président de l’Institut, s’est rendue, le 11 novembre 2009, en Arabie Saoudite où elle a rencontré M. Ahmad Mouhamad Ali, président de la Banque islamique de développement (BID).</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Lors de cette rencontre, la délégation française a, notamment, discuté avec le président de la BID des différents moyens à mettre en oeuvre afin de renforcer ce qu’il est désormais convenu d’appeler la « Place parisienne », pour consolider sa position et renforcer son attractivité au vu des nouvelles dispositions prises par les autorités françaises pour adapter sa législation aux besoins de la finance islamique et pour rendre l’industrie financière islamique bienvenue dans la capitale française.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">A la fin de cette rencontre, les deux parties ont finalisé un projet d’accord qui sera paraphé par M. Hervé de Charette, et par M. Ahmad Mouhamad Ali le 9 décembre prochain, lors de la tenue du IIIème Forum français sur la finance islamique, organisé par la Chambre de commerce Franco-arabe en collaboration avec Sécure Finance et Les Echos Evénements.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Durant son voyage de trois jours dans la capitale saoudienne, la délégation française s’est entretenue également avec plusieurs personnalités saoudiennes, des chefs d’entreprises, des financiers et des hommes d’affaires, à qui elle a exposé l’importance de la « Place parisienne » comme pôle majeur de la finance européenne et porte d’entrée dans la zone euro.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">L’Institut français de finance islamique, créé récemment par la  Chambre de commerce Franco-arabe, joue un rôle fondamental dans la promotion des mécanismes de la finance islamique en France. Elle encourage les professionnels et les particuliers à les utiliser dans leurs relations commerciales, en parallèle avec les mécanismes financiers conventionnels. A cet effet, elle organise des séminaires pour expliquer cette nouvelle industrie financière et pour former les dirigeants et les cadres français, afin de les familiariser avec ces nouveaux mécanismes.</span></p>

<title><![CDATA[Islamic Finance: A Central Bank’s Perspective]]></title>

<p><!--more more--></p>
<p style="text-align:justify;"><span style="color:#333399;">As the international financial markets and the global economy recover from the repercussions of the financial disruptions and dislocations that have occurred in the major financial systems, there have been wide ranging proposals to strengthen the foundations for financial stability, and reviews of the existing institutional arrangements in the international financial system.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Despite this more challenging environment, the expansion of Islamic finance as a viable form of financial intermediation has gained momentum demonstrating its viability and resilience. The rapid growth and development of Islamic finance essentially reflects its ability to meet the changing pattern of demand by consumers and businesses, its ability to remain competitive and its ability to withstand a more challenging environment.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">More recently, the international dimension of Islamic finance has gained significance as it transitions from being domestic centric to becoming increasingly more internationalised. There is now increased international participation in Islamic financial markets in the different jurisdictions and more Islamic financial institutions are having presence or strategic interests in several jurisdictions. This trend has resulted in increased cross border financial flows.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">My remarks this morning will focus on three aspects of Islamic finance that is of interest to Central Banks. The first relates to the financial stability of the Islamic financial system and to highlight the sources of stability that is derived from the inherent elements of Islamic finance and the regulatory and supervisory framework that has been developed to deal with emerging risks that are specific to the Islamic financial system. The second relates to the role of the Central Bank in developing the Islamic financial infrastructure, including the international Islamic financial architecture.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">The third aspect concerns the implications of the increased internationalisation of Islamic finance and the potential for greater interdependence thus requiring more effective surveillance and cross border coordination to ensure financial stability across jurisdictions.</span></p>
<p style="text-align:justify;"><strong><span style="color:#333399;">Intrinsic Value Propositions of Islamic Finance</span></strong></p>
<p style="text-align:justify;"><span style="color:#333399;">The strengths in Islamic finance are derived from the principles of Shariah that require financial transactions be accompanied by an underlying productive economic activity thus resulting in a close link between financial and productive flows. This requirement reduces the prospect for over-exposure to risks associated with excessive leverage and imprudent risk taking.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Fundamental to Islamic finance is the profit and risk sharing which explicitly requires the appropriate due diligence and ensures that the profit is commensurate with the risks. The risk associated with the real investment activity is therefore explicitly integrated into the financial transaction. There is thus an explicit emphasis on the economic viability of the underlying assets and on good governance, ethics and transparency. It is these very elements of Islamic finance that provides an in-built mechanism that enhances the prospects for its soundness and stability.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">As Islamic finance evolves to meet the changing requirements of businesses and consumers, innovation is integral to the development of new Islamic financial products and services. It is recognised, however, that unfettered financial innovation can become a major source of instability. In Islamic finance, innovation must be tested against the objectives of the Shariah, where the primary objective is the realisation of benefit to the people. This demands the internalisation of Shariah principles in Islamic financial transactions, both in form and substance. Indeed, Shariah-based innovation brings with it a Shariah-compliant culture in the Islamic financial institutions that serves to ensure that the product development process incorporates ethical value propositions.</span></p>
<p style="text-align:justify;"><strong><span style="color:#333399;">A Central Bank’s Perspective</span></strong></p>
<p style="text-align:justify;"><span style="color:#333399;">From a Central Bank’s perspective, ensuring financial stability of the Islamic financial system is the paramount objective. Integral to the efforts in the development of Islamic finance, is therefore, the strengthening of the regulatory and supervisory framework. The Islamic Financial Services Board (IFSB) which was established in 2002 has been instrumental in developing and issuing global prudential standards and guiding principles for the industry. This has included capital adequacy requirements, to governance and risk management standards. The IFSB has also contributed to the harmonisation in the development of Islamic finance across different jurisdictions.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">While the basic legal, regulatory and supervisory framework that takes into account the distinctive features of Islamic finance are already in place, efforts are now underway to put in place a comprehensive infrastructure to deal with the new challenges confronting the international financial system. Looking beyond the current crisis, an integrated crisis management framework will be part of this infrastructure. It is recognised that a more facilitative and modernised legal framework is also required and that the boundaries of the regulatory framework for Islamic finance would also have to be regularly adapted to keep pace with the evolution and transformation of the financial system. Finally, the supervisory framework for Islamic finance is also being reinforced by a financial safety net framework that comprises the lender of last resort facility and a deposit insurance system. These financial arrangements are now in place in Malaysia.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Also important are the institutional arrangements for resolution of troubled Islamic financial institutions. In Malaysia, we have in place a mandated resolution mechanism to provide for expedient, effective and cost efficient resolution of Islamic financial institutions. Yet to be put in place however, is a mechanism for cooperation between regulators within and across jurisdictions for resolution to contain potential systemic risks beyond the national boundaries. In 2008, the Taskforce on “Islamic Finance and Global Financial Stability” was formed by the Islamic Development Bank (IDB) and the IFSB, together with the industry leaders and international expertise to examine further the building blocks in the Islamic financial infrastructure that need to be put in place to ensure financial stability.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Among the areas covered by the report are for the effective implementation and enforcement of the prudential standards and the supervisory framework, and the recommendation for the establishment of a Financial Stability Forum to address issues of financial stability in the Islamic financial system.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">In Malaysia, the Islamic financial system operates in parallel with the conventional financial system. In such a dual system attention needs to be given to avoid the potential for regulatory arbitrage that may result in distortions that undermines the environment of a level playing field between conventional finance and Islamic finance. The development of the legal and regulatory framework for Islamic financial services industry is therefore grounded on the principle of neutrality in ensuring no worse off treatment when compared to conventional finance in terms of the taxation, laws and regulations.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Equally important in the building of the financial infrastructure is the development of the Islamic financial markets. Malaysia has now developed a comprehensive Islamic financial system that includes the banking and takaful industry, other specialised financial institutions and the Islamic money and capital markets. The supporting financial infrastructure includes a robust regulatory and supervisory framework reinforced by the legal and Shariah framework, the payment and settlement systems, the development of the pool of expertise and talent to support the industry.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">The sukuk market that is, the Islamic bond market is fast emerging as the most significant form of financing that continues to receive strong interest as a means for raising funds and for investment. The global sukuk market has been increasing at an average annual rate of 40 percent, with 90 percent of the issuances by the corporate sector. In Malaysia, the issuance of sukuk has now surpassed the issuance of conventional bonds. Strong demand for sukuks have also come from the high savings economies including from Asia and the Middle East. As a new asset class, it has generated demand from both conventional as well as Islamic financial investors. The sukuk is therefore not only an attractive instrument for investment but it is also a competitive means for raising long term funding needs.</span></p>
<p style="text-align:justify;"><strong><span style="color:#333399;">Strengthening synergies between financial centres</span></strong></p>
<p style="text-align:justify;"><span style="color:#333399;">Two important trends have increased the integration of Islamic finance into the international financial system – the accelerated development of the Islamic financial markets and increased liberalisation. The development in the Islamic financial markets has contributed to the availability of a wide spectrum of Islamic financial instruments that has ranged from instruments to manage liquidity, to structures for financing of mega investments. The higher level of foreign participation in the Islamic financial markets which has resulted in the increase in cross border flows in the international Islamic financial system thereby, enhancing international financial linkages between financial systems. Liberalisation has also brought greater foreign institutional presence in Islamic financial systems resulting in greater diversity of players and strengthening further the international financial linkages.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Malaysia has very much been part of this process. In 2003, the Islamic financial system was liberalised to allow for increased foreign presence. In 2007, the sukuk market was liberalised to allow the raising of funds by eligible corporates from any part of the world in any currency. And this year, the first foreign currency sukuk of USD1.5 billion was successfully issued by our petroleum corporation with a significant over subscription by investors from Europe, Middle East and Asia.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">As the international dimension of Islamic finance gains momentum, it is necessary to facilitate the potential for liquidity management across borders. As part of an international collaborative effort, a Task Force on Liquidity Management was set up by the IFSB and the IDB early this year to develop solutions to enhance the efficiency of Islamic financial institutions in managing liquidity at both the national and international levels.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">A further area of international collaboration is towards promoting value-added investment in human capital building as a long term solution to sustainable growth of the Islamic financial industry. The establishment of talent development and research institutions in Islamic finance are now increasingly wide spread in several jurisdictions with several strategic alliances across borders being entered into. The International Centre for Education in Islamic Finance (INCEIF) in Malaysia was set up by the Central Bank with programmes for practitioners and post-graduate studies to ensure the continuous supply of talent in Islamic finance. The current enrollment in INCEIF are from more than 60 countries attracting students including from the UK, Canada, France and Japan and Korea and the Middle East.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Equally important to innovative development is a deeper understanding of Shariah and knowledge of Islamic finance and for a greater convergence in the theoretical understanding and practical considerations in resolving the contemporary issues faced by Islamic financial industry players. In this regard, a platform has been established for active engagement and intellectual dialogue among global Shariah scholars, practitioners, regulators and academicians. As the global economy becomes a more interconnected and interdependent, the process of greater convergence of financial standards and mutual recognition of products is also facilitating the international integration of Islamic finance across different jurisdictions.</span></p>
<p style="text-align:justify;"><strong><span style="color:#333399;">Concluding remarks</span></strong></p>
<p style="text-align:justify;"><span style="color:#333399;">Let me conclude my remarks. While the inherent strengths of Islamic finance have contributed to its viability and resilience, going forward the foundations for its sustainability as a competitive form of financial intermediation continues to be strengthened. Concerted efforts are underway focusing on the further development of the Islamic financial markets, the financial infrastructure, the investment in research and development to support innovation, and enhancing further the legal, regulatory and supervisory framework.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">An important part of the developments will be to facilitate a more inclusive arrangement that would allow for greater interface and inter-linkages across jurisdictions, in particular from emerging economies. As part of this process, building and strengthening linkages between financial systems will contribute to this process. Indeed, participation with the European financial systems will form an important linkage between the East and the West. In our pursuit and commitment to strengthening the resilience of Islamic financial industry and to enhance these linkages would not only have the potential to contribute towards global financial stability but also to the prospects for global growth.</span></p>

I learned this when marketing web-based project collaboration software at <a title="BIW Technologies" href="http://www.biwtech.com" target="_blank">BIW</a>, and I&#8217;ve heard the same view expressed about social media tools. Fellow blogger <a title="Julian Dobson blog" href="http://livingwithrats.blogspot.com/2009/11/systems-administrators-do-we-really.html" target="_blank">Julian Dobson</a> quotes responses from people working for an environmental quango and a major civil engineering firm:</p>
<blockquote><p>&#8216;I&#8217;m afraid my government laptop is so locked down that I&#8217;m unable to install any software at all.&#8217;</p>
<p>&#8216;I have to let you know that I can&#8217;t/won&#8217;t download the dropbox application onto [our] heavily firewalled and controlled network.&#8217;</p></blockquote>
<p>But I have found it can also be an attitude of mind held by the AEC professionals within firms. Call it inertia, arrogance, a &#8220;<strong>not invented here</strong>&#8221; syndrome, or maybe &#8217;silo&#8217; mentality, but resistance to consulting outside the organisation is certainly prevalent in some businesses. I spoke to an architect from a leading design firm at the RIBA recently, and he was adamant that a large multi-disciplinary consultancy had no need to interact with co-professionals from other firms through social networks &#8211; &#8220;our in-house resources are more than adequate,&#8221; he insisted.</p>
<p>This may be a common view within that firm. <a title="UCL - Soong's page" href="http://www.ucl.ac.uk/msi/people/soong" target="_blank">Soong M Kang</a>, a university researcher at UCL, told me about a frustrating recent meeting with someone from the same company:</p>
<blockquote><p>He brought two more guys to the meeting: one who deals with their web strategy and another who deals with their &#8220;community&#8221; efforts.  In essence, it seemed to me that they have their own internal system and are not willing to think outside of it. Especially the guy from web strategy was extremely hostile to my project, which is understandable if one sees his vested interests.</p></blockquote>
<p>So in some AEC organisations there is almost an insular, anti-collaborative culture that pervades both the IT department and fee-earning professionals.</p>
<p><strong>Social approaches to innovation</strong></p>
<p>In other engineering design sectors, though, there appears to be more willingness to consider social computing solutions. I first <a href="http://pwcom.wordpress.com/2009/07/24/social-product-development-in-aec/">wrote</a> about social product development in this blog in July, and have just been reading an <a title="Desktop Engineering" href="http://www.deskeng.com/articles/aaastn.htm" target="_blank">article by Tom Kevan</a> in <em>Desktop Engineering</em> along similar lines. He argues that new economic realities (<strong>globalisation, increased competition, &#8216;mechatronic&#8217; design approaches, and changing demographics</strong>) are forcing a rethink of how designers can achieve <strong>innovation</strong>.</p>
<blockquote><p>No longer is it the product of one engineer’s genius or the skill of a company’s engineering team. Increasingly, <strong>the ideas of customers, suppliers, and outside experts are being tapped to create broader development networks</strong>. To enable the communication and collaboration needed by these networks, companies and technology providers are adapting social networking paradigms to the product design arena.</p></blockquote>
<p><a href="http://www.innocentive.com/"><img class="alignright size-full wp-image-1102" title="Innocentive" src="http://pwcom.wordpress.com/files/2009/11/innocentive.jpg" alt="Innocentive" width="231" height="57" /></a>Kevan goes on to describe three pioneering technologies, including the crowd-sourced problem-solving <strong><a title="Innocentive.com" href="http://innocentive.com/" target="_blank">InnoCentive.com</a></strong> (similar to <a title="ideabounty.com" href="http://www.ideabounty.com/" target="_blank">ideabounty.com</a> &#8211; <em><a title="pwcom" href="http://pwcom.wordpress.com/2009/10/27/creative-crowdsourcing-a-technique-for-aec-clients/">post</a></em>). Here:</p>
<blockquote><p>“It is the <strong>diversity</strong> of the community that looks at these problems that matters most in ensuring that they get solved,” says InnoCentive’s Ritter, explaining that it is the social aspect of product development that makes it possible to find the one person in the world uniquely qualified to answer the specific question.</p></blockquote>
<p>Having a closed mentality to problem-solving may satisfy the egos of old-school AEC design professionals (and will probably be supported by their IT departments), but I wonder if it could mean their <strong>firms inadvertently fail clients by not extending their search for innovation beyond the organisation&#8217;s firewalls</strong>?</p>
<p><strong>Web 2.0 and construction collaboration</strong></p>

<title><![CDATA[Islamic Gold Economy ]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p><strong><span style="text-decoration:underline;">Introduction to the Islamic Gold Economy</span></strong></p>
<p>While the terms &#8220;Islamic Banking&#8221; and &#8220;Islamic Finance&#8221; have become fairly common, we expect very few people to have previously heard the phrase &#8220;Islamic Gold Economy&#8221;. Therefore, it is important to take some time to explain what we mean by the Islamic Gold Economy, and why is it so important.</p>
<p>Up until now, a whole range of literature has been produced on the subject of Islamic economics, and some of the work done in this domain is of good quality and merit. But a common shortcoming in many proposed solutions is that they try to introduce Islamic economic ideas as an island in a larger economic context whose fundamental underpinnings are inherently un-Islamic. We, in contrast, propose to introduce a solution that addresses the very roots of the problem by through an end to end economic system that addresses the root causes of our economic problems. The cornerstone of our solution for an Islamic economic model is that it does not simply stop at recommending interest-free banking, but rejects the whole system of money-creation prevalent today based on fractional reserve banking. We propose the adoption of a 100% gold-backed currency, and abolition of fractional reserve banking and money creation by the banks. An informal broad overview of our proposed Islamic Economic System is presented below:</p>
<p>1. Money</p>
<p>All money, or legal-tender, should consist wholly of a full-bodied commodity (e.g. coins or bars of metal), and all money substitutes (e.g. paper notes or debit cards) would simply be claims equivalent to an equal amount of a physical reserve of the chosen money commodity.</p>
<p>2. Specie</p>
<p>The choice of the physical commodity, or specie, to act as money would consist of gold and silver, as indicated by both the Sunnah, and conventional historical wisdom and universal consent.</p>
<p>3. Parallel Currencies</p>
<p>Both gold and silver would exist as the basis of two parallel monetary systems, or currencies (e.g. the gold dinar and the silver dirham). The exchange rate between the two would be free floating determined by the market. (Government enforcement of bimetallism using a fixed exchange rate may be allowed in special cases, as this idea does not constitute a basic building block of the Islamic economic system, and is more of a discretionary choice of the societies involved).</p>
<p>4. Unit of Money</p>
<p>Irrespective of the name chosen for the currency (e.g. Rupee or Dinar), each basic unit of money in that currency would be permanently defined as being equivalent to a fixed amount of gold or silver. The token or face value of the currency would be directly dependent on its weight, and no seigniorage would be allowed on part of the issuer. (Governments may devise means of charging for the brassage of coins, but this would not be allowed in the form of raising the token price of the coins produced beyond their physical value)</p>
<p>5. Private Minting</p>
<p>As a natural consequence of the adoption of this form of currency, private minting of money becomes legal by law, where the private issuing authority can use market forces to establish their credibility that their issued coins conform in weight to the standard units of money.</p>
<p>6. Money substitutes</p>
<p>Money substitutes, such as paper and electronic, would be allowed to exist, as long as their role is merely to act as warehouse receipts of the physically stored money. At any one time, only a money substitute, or the real money, can be in circulation, but not both.</p>
<p>7. Banks Deposits</p>
<p>Irrespective of whether they are called Banks, or Baitulmaal, some fundamental reforms in the operation of all financial institutions would be made. All accounts maintained by banks would be operated as specific deposit warrants instead of general deposit warrants. One implication of this would be that the deposits maintained by such banks would not appear as balance on the banks books of account. The deposits would remain the property of the depositor, and not just a liability on the bank to repay its equivalent amount of money to the depositor. In other words, this would imply that banks must operate on full reserve and not fractional reserve.</p>
<p>8. Banking Services</p>
<p>All regular banking services would continue as currently, including safekeeping and transfer of money. The banks may charge a fee for these services, but they would not be allowed to reflect customer’s deposits in their own books of account as the bank’s money. This implies that money available to the bank for loans and financing would either come from the bank’s own resources, or that which depositor’s specifically allow the bank to use for this purpose under a contractual relationship. This is to prevent banks from ‘creating money’, as now the money would either be owned by the depositor, or loaned to the bank, but not both.</p>
<p>9. Loans and Financing</p>
<p>All regular banking services regarding issuance of loans and financing of business operations would continue as currently, except that all such contracts will comply with Islamic principles of Murabaha, Ijara, Mudaraba, Musharika, Salam and Istisna etc. But an important difference in these arrangements would be that the bank would only act as brokers or mediator between the lenders (bank depositors), and recipients of the loans. The recipient of the loan would not have a liability to the bank, but to the actual depositors of accounts in that bank who signs up for participation in this particular loan. Banks may either charge a fee for mediating the loan, or become a shareholder in the project thus being financed.</p>
<p>10. Interest</p>
<p>It would be illegal to charge interest on money, and any contract to pay in excess among of money than what the burrower initially took would be considered legally void.</p>

<p style="text-align:justify;"><span style="color:#333399;">Afin de mieux appréhender ce nouveau marché, d’en déceler les nombreuses opportunités, et de mettre en valeur les avantages de ce type de financement, le cabinet Isla-Invest a organisé un colloque international sur la finance islamique le 10 novembre 2009 à Alger. Ce rendez-vous a permis, selon ses organisateurs, de mieux appréhender le potentiel du marché algérien, les différents métiers de la banque islamique, le potentiel et les opportunités de développement de la finance islamique pour les PME algériennes ainsi que les défis à relever.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Lors d’un point de presse, Zoubeir Ben Terdeyet, directeur associé du cabinet Isla-Invest, a indiqué que plusieurs experts et spécialistes étrangers ont participé à cet évènement. «Des professionnels et des dirigeants de banques étrangères et privées opérant en Algérie ont ainsi exposé leurs travaux, leurs analyses du marché actuel ainsi que les opportunités d’investissement dans ce pays.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Dans le contexte actuel, caractérisé par une crise financière sans précédent, la finance islamique se présente de plus en plus comme une véritable alternative. De par le monde, plusieurs pays non musulmans commencent à adopter ce mode de financement.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">«Ce forum concerne les décideurs de l’industrie financière en Algérie, mais aussi les dirigeants de groupes opérant dans les pays d’Afrique du Nord et de l’Ouest et en Europe», a-t-il ajouté. M. Ben Terdeyet a indiqué que la finance islamique représente aujourd’hui plus de 700 milliards de dollars d’actifs gérés dans le monde et enregistre une croissance annuelle de plus de 15% sur les dix dernières années. C’est dire, aux yeux du conférencier, l’importance et la nécessité d’adopter ce type de financement.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">« Aujourd’hui, 37 institutions financières sont présentes en Afrique pour une population musulmane de 412 millions d’habitants. Selon une étude de Moody’s, le marché estimé en Afrique est de 235 milliards de dollars pour un volume actuel de 18 milliards, un potentiel de croissance important», a-t-il précisé. La finance islamique peut-elle apporter un nouveau souffle au développement du secteur bancaire privé algérien ? La réponse du conférencier est affirmative. Et pour cause, l’Algérie est devenue une terre d’accueil pour les banques islamiques avec la présence d’Al Baraka Bank en Algérie depuis 1991. Al Salam Bank Algeria a démarré en 2008 et a ouvert une deuxième unité en 2009. La Banque Islamique d’Abu Dhabi (ADIB) et Kuwait Finance House (KFH) sont également en lice pour un agrément», a-t-il souligné.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">De son côté, M. Haideur Nacer, directeur des relations publiques au niveau d’Al Baraka Bank,  a indiqué qu’il existe une volonté politique de la part des autorités monétaires algériennes pour le développement de ce mode de financements, et que des pourparlers sont en cours avec l’Association des banques et établissements financiers (ABEF), la Banque d’Algérie et le ministère des Finances afin de les promouvoir. «Il faut faire de la place d’Alger, un hub de la finance islamique en Afrique» a déclaré Mr Haideur. Selon lui, cette idée, loin d’être prétentieuse est possible, étant donné que les compétences existent, et que la demande est de plus en plus importante, «pourvu qu’on y mette les moyens» a-t-il ajouté.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Selon M. Haideur, «les lois bancaire, commerciale et fiscale gagneraient à être revues en vue d’intégrer des dispositions particulières permettant de conférer aux opérations bancaires régies par les règles de la chari’a islamique l’ancrage légal dont elles sont dépourvues à l’heure actuelle», a-t-il dit. Dans ce cadre, M. Hideur préconise de prévoir dans la loi bancaire une troisième catégorie d’établissements autorisés à effectuer des opérations de commerce et d’investissement spécifiques tels que l’achat-vente de biens à crédit, la réalisation d’ouvrages à crédit et le financement participatif de projets ou d’opérations avec ou sans prise de participation dans le capital social. Il propose, aussi, de prévoir dans le code de commerce des dispositions intégrant dans les valeurs mobilières les titres d’investissement représentatifs de droit de propriété sur des actifs réels ou d’une part indivise de projets financés en participation. Pour lui, il est, également, important de consacrer dans une loi de finances le principe d’égalité fiscale vis-à-vis de ces produits, c’est-à-dire ni faveur, ni pénalisation.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Des moyens qui, selon lui, commenceraient par la mise en place de textes spécifiques qui réglementeraient la finance islamique en Algérie<span style="color:#333399;">. </span></span><span style="color:#333399;">M. Lachemi Siagh PDG du bureau de conseil financier Strategica relève à ce titre que même si la loi sur la monnaie et le crédit autorise les opérations d’investissement et de commerce conformes aux préceptes de la loi islamique (charia), elle ne les a pas clairement définies en tant que catégorie spécifique de financement des entreprises.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Au Maghreb, hormis une expérience timide en Tunisie, la finance islamique n’en est qu’à ses débuts. Les autorités marocaines ne semblent pas très intéressées par ce mode de financement, tandis que l’Algérie, devrais en être le pionnier au vu du marché qu’elle représente a expliqué Mr Haider. Une situation qui est due en grande partie selon M. Ben Terdeyet au manque de communication autour du sujet. Selon lui, plus que la volonté politique, un travail d’information et de marketing est primordial pour présenter la finance islamique au public.</span></p>

<title><![CDATA[Cooperative Islam]]></title>

<content:encoded><![CDATA[<div class='snap_preview'><p>I was going to write about the amazing stuff I&#8217;ve seen happening in northeastern Ohio over the last few days. However, the unfortunate events at Ft. Hood have me distracted. The perpetrator was apparently an Arab-American who was at least sympathetic to extremist Islam. So whether or not this came out of religious motivation, I&#8217;m afraid we&#8217;re in for another round of Muslim-bashing.</p>
<p>Whatever Hasan&#8217;s motivations, it is important for us to remember that he is one person, and that violently radical Islam is only a very small piece of the picture. In general, Muslims are a pretty peaceful bunch until provoked. And isn&#8217;t that true of all of us? Remember, remember, the fifth of November is also Guy Fawkes Day, commemorating <a href="http://en.wikipedia.org/wiki/Guy_fawkes" target="_blank">a notorious Catholic terrorist</a>.</p>
<p>In any case, Muslims deserve credit for launching an extremely brave and useful dialogue with Christians two years ago, called &#8220;<a href="http://acommonword.com/index.php?lang=en&#38;page=option1" target="_blank">A Common Word Between Us and You</a>.&#8221; This <a href="http://acommonword.com/" target="_blank">writing is at a web site</a> which should be familiar to all people who wish to see an end to our current religiously-tinted struggle. Please, please, please take some time to check it out, including the following <a href="http://acommonword.com/lib/downloads/fullpageadbold18.pdf" target="_blank">Christian response</a> and this <a href="http://acommonword.com/index.php?page=jewish-responses&#38;item=8" target="_blank">Jewish response</a>. We can&#8217;t afford another round of post-9/11 style fear and hatred, and it is up to peace-loving people to make sure that we don&#8217;t get drowned out this time.</p>
<p>I&#8217;ll be presenting on interfaith cooperative economics twice this weekend, so it seems like a good time to dust off <a href="http://holycoop.files.wordpress.com/2008/12/hcx32.pdf" target="_blank">a paper I wrote last year</a>, which looked at more cooperative expressions of Islam (as well as Christianity and Judaism). Here are some excerpts from a that paper, outlining some of the admirable steps that Muslims have taken toward building a more just and equitable economic order. The links are in the footnotes, but I hope that isn&#8217;t too much of a deterrent to further research.</p>
<p>Keep in mind that this research is a year old, and some projects described as launching may well be launched. It might be time for me to give it a little update&#8230;</p>
<p>&#8212;&#8211;</p>
<p>The Muslim analog to insurance is called <em>takaful</em>, which translates as “guaranteeing each other.” The main difference is that risk is shared in order to avoid the Islamic prohibition on gambling. Many takaful organizations are members of the International Cooperative and Mutual Insurance Federation (ICMIF), whose website has a separate section addressing the special subject of takaful. More than two-dozen ICMIF Takaful members can be found in Africa, the Middle East, South Asia, North America and the Caribbean. In some cases, general insurance cooperatives have begun offering takaful, as is the case with The Co-operators, located in Canada.<a href="#_ftn1">[1]</a></p>
<p>In the interest of building further bridges to Muslims, ICMIF lists more than 100 non-member providers on its takaful directory.<a href="#_ftn2">[2]</a> Some of these provide a glimpse into the theological reasoning behind the model.</p>
<p>Takaful International of Bahrain provides a particularly useful overview of the cooperative nature of takaful. It points out that in order to be halal (lawful) an insurance arrangement must avoid charging or paying interest, gambling or speculation, and unclear conditions for the insured. The ultimate goal is to organize in a “context of co-operation and solidarity for the good of society.”<a href="#_ftn3">[3]</a></p>
<p>Takaful is also applied to foster economic development. Bandeh Aceh, Indonesia, is home to the Mahardika cooperative, which offers “microtakaful” policies for the very poor residents of that province, who are still recovering from the 2004 tsunami. Mahardika has now started offering savings and loan services, and in doing so has grown tenfold by providing financing with an average amount of $500.<a href="#_ftn4">[4]</a></p>
<p>The Islamic rule against <em>riba</em> (usury, or interest) supports cooperative financial arrangements. Recent years have seen an explosion of “shariah-compliant” finance, which has been the cause of significant controversy and those who declare these practices halal are sometimes derided as “rent-a-sheikhs.” A 2007 <em>Wall Street Journal</em> article on Islamic finance described the many ways that hedge funds and other investment vehicles are being repackaged as halal, even though “Islam prohibits all kinds of speculative behavior that is embedded in Wall Street&#8217;s DNA.”<a href="#_ftn5">[5]</a></p>
<p>An analysis of whether the various “shariah-compliant” banking products are halal or haram (unlawful) is beyond the scope of this paper, but suffice to say that there are many organizations which seek to follow shariah by means of cooperative organization. Islamic finance cooperatives may perhaps limit these ethical grey areas by merging borrowers and lenders into the single class of members.</p>
<p>Credit unions are making some inroads into even the most conservative Muslim society. The World Council of Credit Unions has explored the role that credit unions might play in building a financial industry in Afghanistan, where it has already assisted in the creation of two such cooperatives. Their research paper on the subject concluded that credit unions are appropriate to the nation’s culture, but inasmuch as they (and formal banking, in general) are somewhat exotic and brought by outsiders, it will be important and challenging to build a local sense of ownership.<a href="#_ftn6">[6]</a></p>
<p>Islamic cooperation also occurs in pluralistic nations in which Muslims are a minority. For example the Muslim Community Cooperative (Australia), which has grown to nearly 7000 members and A$120 million (€70 million) in mortgages. It describes its core purpose is “To provide goods and services to members in accordance to the Islamic law of life and the principles of co-operation.”<a href="#_ftn7">[7]</a></p>
<p>The Takaaful T&#38;T Friendly Society is located in Trinidad and Tobago, and provides several services to strengthen that small nation’s small Muslim community. These include a funeral benefits program and a <em>hajj </em>(pilgrimage) fund and a cooperative for <em>waqf</em> (a charitable trust of property).<a href="#_ftn8">[8]</a></p>
<p>Several Islamic cooperatives exist or are forming in the United States. Pioneer Muslim Credit Union was founded in 1981 and serves nearly 5000 members in the Houston area.<a href="#_ftn9">[9]</a> Another credit union is being developed in Minneapolis by the African Chamber of Commerce, and already has 1500 prospective members.<a href="#_ftn10">[10]</a></p>
<p>Islam does not seem to have the same affinity for communalism that is sometimes found in the Jewish kibbutz or monastic-inspired Christian communities. Indeed, the Qur’an teaches against withdrawing into monastic life. (57:16)</p>
<p>Even so, there are cooperative living arrangements in some Muslim communities. These may be limited to North America, and might be inspired more by cultural preferences than Islamic values. Nevertheless, they provide a glimpse at what a Muslim approach to cooperative housing might entail&#8230;</p>
<p>Canada has several housing cooperatives, although these do not take the form of resident communities, which tend to bring members together in a single property or cluster of properties. Instead, it is a mutual financing arrangement in which members select a property that suits them, which is then purchased by the cooperative once the member has made a sufficient initial investment. The member continues to buy shares over a number of years until he or she has acquired enough shares to match the value of the home. At that time, the member and the cooperative make an exchange.</p>
<p>Two of these are sister cooperatives. Islamic Cooperative Housing Corportation (ICHC) has purchased more than 500 houses for members, and transferred ownership of nearly 200 of these to its members. This cooperative was legally limited in its size, so a second co-op was formed along similar lines, called Ansar Co-operative Housing Corporation (ACHC). This co-op has already purchased more than 100 homes and transferred at least 14 of these to members.<a href="#_ftn12">[12]</a></p>
<p>Qurtuba Cooperative is located in Quebec, and was started as part of a financial initiative launched in 1991. Its general processes are rather similar to those of ICHC and ACHC. Qurtuba, like the others, has investor memberships, which provide a dividend for those who do not gain the benefit of housing from the cooperative.<a href="#_ftn13">[13]</a></p>
<p>Given the strong Islamic values that support cooperative economics, it may certainly be the case that the examples discussed here are only the tip of the iceberg. The limited statistics available support this supposition.</p>
<p>In any event, Takaful is spreading rapidly worldwide, and is projected to surpass $7 billion in premiums by 2015.<a href="#_ftn14">[14]</a> Islamic banking is reportedly managing approximately $200 billion worldwide<a href="#_ftn15">[15]</a> but it is not clear to what extent this is being done along mutual lines. In any case, Islamic principles have inspired a widespread degree of cooperative organizing, and this is certainly an area for further research and discussion.</p>

<title><![CDATA[Finance Islamique : experts et décideurs français se mobilisent à Bercy - Vidéo de la Conférence.]]></title>

<p style="text-align:justify;"><span style="color:#333399;"><strong>La finance islamique est susceptible de servir les particuliers, les entreprises et les collectivités territoriales en France. Signe supplémentaire de la volonté française d&#8217;ouvrir la place de Paris aux capitaux islamiques, le ministère de l&#8217;Economie a accueilli le 3 novembre 2009 une conférence sur la finance islamique, rassemblant élus, présidents de banques islamiques et PDG d&#8217;entreprises françaises.</strong></span></p>
<p style="text-align:justify;"><span style="color:#333399;">La conférence sur la finance islamique a été organisée au ministère de l’économie pour débattre &#8211; à l&#8217;aune de la Finance Islamique &#8211; de l’avenir de la place de Paris ; de la vision stratégique des politiques, des institutionnels et des patrons ; de l’environnement, des produits et des approches, ainsi que des exemples d’intégration réussie.</span></p>

<p style="text-align:justify;"><span style="color:#333399;">Dès juillet 2008, la ministre de l&#8217;Economie, Christine Lagarde, avait fait part de son souhait d&#8217;adapter l&#8217;environnement juridique français pour que les activités de la finance islamique soient &#8220;aussi bienvenues à Paris qu&#8217;elles le sont à Londres et sur d&#8217;autres places&#8221;. A sa demande, le Trésor public a publié en février 2009 une instruction fiscale, afin d&#8217;éviter aux instruments financiers  Charia compatibles une trop lourde taxation. En 2007 déjà, l&#8217;Autorité des Marchés Financiers avait donné son feu vert à la création de fonds d&#8217;investissement en accord avec la loi islamique.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">L&#8217;arrivée de la finance islamique en France permettra à certains particuliers de disposer d&#8217;instruments d&#8217;investissement compatibles avec leurs opinions religieuses, alors qu&#8217;aujourd&#8217;hui ils s&#8217;abstiennent, investissent à l&#8217;étranger ou utilisent à contrecoeur des outils financiers habituels.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La finance islamique permettra aussi aux entreprises &#8211; grands groupes ou PME &#8211; de lever des fonds islamiques.  De même, qu&#8217;elle représente pour les collectivités territoriales un potentiel de financement alternatif des projets de développement durable, qui constitue l&#8217;un des fondements de l&#8217;éthique de l&#8217;industrie financière islamique, qui privilégie, en toutes circonstances, l&#8217;investissement responsable et de long terme.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La Qatar Islamic Bank a d&#8217;ores et déjà déposé auprès de la Banque de France une demande d&#8217;agrément pour ouvrir une succursale en France, qui devrait être la première d&#8217;une banque islamique universelle dans l&#8217;Hexagone.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">En septembre 2009, le Parlement avait adopté dans le cadre de la loi sur les PME un article modifiant le régime de la «fiducie» (le transfert temporaire de propriété) et devant faciliter l&#8217;émission en France de sukuk. Ce dispositif avait été censuré par le Conseil constitutionnel, au motif que l&#8217;article n&#8217;avait pas de lien avec l&#8217;objet du texte présenté : le Conseil constitutionnel n&#8217;avait rien trouvé à redire sur le fond du dispositif, et le gouvernement va «réintroduire la modification dans un nouveau véhicule législatif plus approprié, qui évitera la censure du Conseil constitutionnel», a assuré Christine Lagarde. Il s&#8217;agirait en fait d&#8217;inscrire cette adaptation de l&#8217;environnement juridique français dans la loi bancaire et financière qui doit être présentée en décembre 2009, soit dans le projet initial, soit par amendement. Des instructions fiscales sont également en préparation pour éviter que les instruments financiers «charia compatibles» soient trop lourdement taxés.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La réception et à l’intégration de la finance islamique en France repose sur la mise en oeuvre d’outils efficaces qui contribueront à faire ou non de Paris une place financière islamique européenne de taille dans les cinq prochaines années. Les pouvoirs publics Français ont compris les enjeux de cette finance émergente. Pour reprendre Anouar Hassoune, Vice Président de Moody&#8217;s : &#8220;La finance islamique est une chance pour la France, de même que la France est une chance pour la finance islamique&#8221;.<br />

<p><img class="alignleft size-thumbnail wp-image-317" title="bank" src="http://wahyu2005.wordpress.com/files/2009/11/bank.jpg?w=150" alt="bank" width="150" height="102" />Pagi tadi selesai sholat Shubuh, sekitar jam 05.30 saya berangkat ke tempat pengajian, Alhamdulillah…, sebuah nikmat dari Allah untuk menafkahi hati dan akal [salah satu kebutuhan akal adalah ILMU yg BENAR atau KEBENARAN].</p>
<p>Nasihat Ustadz pagi ini adalah terkait halal-haramnya aktivitas muamalah keuangan, khususnya terkait Riba dan produk perbankan. Bagaimana agar kita hati-hati sehingga jangan sampai terjerat kepada yang haram.</p>
<p>Jelas ini bukan tema baru…, tapi memang harus selalu diingatkan karena berkaitan erat dengan kebahagiaan hidup di dunia dan akhirat. Di negeri ini salah satu “penyakit” yang melahirkan kemiskinan, ketimpangan sosial, kejahatan finansial adalah masalah ini: <strong>Sistem RIBA</strong></p>
<p><!--more-->Al Qur’an telah mengajarkan kita…dalam Surat <em>An Nisa:</em></p>
<p><em>29. Hai orang-orang yang beriman, janganlah kamu saling memakan harta sesamamu dengan jalan yang batil, kecuali dengan jalan perniagaan yang berlaku dengan suka sama-suka di antara kamu. Dan janganlah kamu membunuh dirimu<strong><sup>[287]</sup></strong>; sesungguhnya Allah adalah Maha Penyayang kepadamu.</em></p>
<p>Saya tak akan membahas masalah fiqh…, para ulama ataupun pakar ekonomi syariah telah membahas panjang lebar dan sudah <em>clear</em> terkait segala permasalahan dan solusinya.</p>
<p>Permasalahan kita adalah… <strong><em>kebutuhan seolah tiada cukupnya dan kondisi finansial seringkali “kepepet”</em></strong>. Atau kita punya ide-ide atau pun keinginan yang untuk merealisasikannya mau tidak mau harus berurusan dengan bank ataupun lembaga pembiayaan [bahkan di pasar-pasar, di kalangan masyarakat banyak “bank” perorangan &#60;baca renternir&#62; yang bisa memberikan pinjaman dengan sangat mudah].</p>
<p>Sebenarnya, hari ini…kita harus berterima kasih kepada mereka yang telah memperjuangkan Bank Syariah ataupun BMT-BMT. Kita dengan sangat mudah bisa menabung, pinjam, transaksi e-banking di Bank Syariah yang ada. Tapi di tataran realita…, di keluarga, tetangga, ataupun tempat kerja masih banyak yang memilih untuk bertransaksi di Bank Konvensional.</p>
<p>Secara subyektif[yang mengganggu kebahagiaan menurut saya], beberapa permasalahan terkait hal ini antara lain:</p>
<ol>
<li>Mereka yang bekerja di sistem ribawi, bagaimana solusi terbaik?</li>
<li>Mereka yang terjerat utang [bunga-berbunga] oleh Bank Ribawi atau rentenir</li>
</ol>
<p>Permasalahan no 1 jelas harus diselesaikan secara sistemik oleh pemerintah, karena sistem keuangan ribawi ini yang dipakai [padahal jelas tidak sesuai dengan Pancasila, terutama sila 1 dan 5]. Tapi berharap kepada pemerintah….mungkin butuh waktu panjang. Yang paling mudah adalah perubahan secara personal…, berganti pekerjaan, hal ini tentunya sangat membutuhkan kekuatan iman dan persiapan yang matang. Tapi demi halalnya uang yang kita gunakan untuk menafkahi anak-istri kita…</p>
<p><em>[saya sendiri seringkali merasa tidak berdaya, padahal ada saudara, sepupu, dan teman yang bekerja di sektor ini…, sampai hari ini saya belum pernah mendakwahi secara lisan agar mereka segera berpindah kerja, saya baru bisa mendo’akan…, sungguh berat amanah mereka yang ada di eksekutif ataupun legislatif negeri ini, kapankah akan ada perubahan signifikan. Seperti di Pekalongan, Bupatinya jelas orang pesantren…sudah adakah keinginan untuk menyelamatkan masyarakat dari sistem ribawi ini?]</em></p>
<p>Tetapi kita harus optimis dan <em>positive thinking</em>…, insya Allah perbankan dan ekonomi Islam semakin berkembang dan diterima masyarakat.</p>
<p>Alhamdulillah, secara pribadi saya telah merasakan kemudahan dan keberkahan dengan bertransaksi sesuai syari’ah.</p>
<p><strong><em>Waktu itu pas saya butuh laptop</em></strong>, tapi uang <em>cash</em> yang ada untuk alokasi beli laptop hanya ada 2 juta…, saya berpikir bagaimana bisa beli laptop baru, saat itu kira-kira budgetnya 7 juta-an.Akhirnya pas ada pameran laptop [Acer] di Botani Square, saya mengajukan kredit ke Adira (non-syari’ah), setelah saya tunggu katanya ada yang mau survey, ternyata tidak ada yang datang…saya menyimpulkan nggak lolos usulan saya.</p>
<p>Trus saya mencoba ke BMT, saya mau minjam 5 juta, tetapi karena tidak ada jaminan yang saya punya otomatis tidak bisa. Akhirnya saya cerita ke Angga dan Dedi, sambil mengeluhkan tentang ekonomi syariah yang dipraktikkan, mau pinjem 5 juta aja ribet. Saya sempat tergoda untuk minjam di BRI, karena kampus saya ada MoU dengan BRI, sangat mudah lah untuk pinjem ke BRI. <em>Tetapi subhanallah nasihatnya Dedi….”<strong>mas, dengan ekonomi syariah insya Allah lebih berkah</strong> [mirip-mirip gitu deh]”,</em> akhirnya….pertolongan Allah datang. Waktu itu ada mas Herdi, mendengar saya butuh laptop, dia menawari untuk transaksi sama dia [maklum bisnisnya emang jualan komputer dan laptop], akhirnya saya beli laptop seharga 5,5 juta dengan dp 2 juta dan akad jual-belinya seharga 6 juta selama 4 bulan ke depan angsurannya.</p>
<p><strong><em>Pengalaman kedua</em></strong>, ketika saya dicarikan Pak Arifin “Rumah”, dan saya harus membelinya seharga 25 juta. Gimana caranya? mencari uang 25 juta secepatnya…, sekali lagi saya tergoda untuk mengajukan pinjaman ke BRI [konvensional], karena cara inilah cara yang instant, seperti para pegawai negeri yang lain; tinggal menjaminkan SK PNS.</p>
<p>Alhamdulillah…, setelah berkonsultasi dengan Ust. Hamdan [Operational Manager Bank Muamalat Bogor] dan Pak Mukti [Operational Manager Bank Muamalat Palangkaraya_sekarang di Papua], saya disarankan untuk mengajukan pembiayaan ke Bank Muamalat di Palangkaraya. Alhamdulillah berhasil, memang pengurusan administrasi di kampus lebih ribet dibandingkan pinjam di BRI, tapi bisa….</p>
<p>Pengalaman ini semakin mengajarkan saya tentang <strong><em>pentingnya niat dan komitmen</em></strong> kita untuk bermuamalah sesuai tuntunan syariah. <strong>TERNYATA MUDAH dan BERKAH</strong></p>

<title><![CDATA[Finance Islamique : experts et décideurs français se mobilisent à Bercy - Vidéo de la Conférence.]]></title>

<p style="text-align:justify;"><span style="color:#333399;"><strong>La finance islamique est susceptible de servir les particuliers, les entreprises et les collectivités territoriales en France. Signe supplémentaire de la volonté française d&#8217;ouvrir la place de Paris aux capitaux islamiques, le ministère de l&#8217;Economie a accueilli le 3 novembre 2009 une conférence sur la finance islamique, rassemblant élus, présidents de banques islamiques et PDG d&#8217;entreprises françaises.</strong></span></p>
<p style="text-align:justify;"><span style="color:#333399;">La conférence sur la finance islamique a été organisée au ministère de l’économie pour débattre &#8211; à l&#8217;aune de la Finance Islamique &#8211; de l’avenir de la place de Paris ; de la vision stratégique des politiques, des institutionnels et des patrons ; de l’environnement, des produits et des approches, ainsi que des exemples d’intégration réussie.</span></p>

<p style="text-align:justify;"><span style="color:#333399;">Dès juillet 2008, la ministre de l&#8217;Economie, Christine Lagarde, avait fait part de son souhait d&#8217;adapter l&#8217;environnement juridique français pour que les activités de la finance islamique soient &#8220;aussi bienvenues à Paris qu&#8217;elles le sont à Londres et sur d&#8217;autres places&#8221;. A sa demande, le Trésor public a publié en février 2009 une instruction fiscale, afin d&#8217;éviter aux instruments financiers  Charia compatibles une trop lourde taxation. En 2007 déjà, l&#8217;Autorité des Marchés Financiers avait donné son feu vert à la création de fonds d&#8217;investissement en accord avec la loi islamique.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">L&#8217;arrivée de la finance islamique en France permettra à certains particuliers de disposer d&#8217;instruments d&#8217;investissement compatibles avec leurs opinions religieuses, alors qu&#8217;aujourd&#8217;hui ils s&#8217;abstiennent, investissent à l&#8217;étranger ou utilisent à contrecoeur des outils financiers habituels.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La finance islamique permettra aussi aux entreprises &#8211; grands groupes ou PME &#8211; de lever des fonds islamiques.  De même, qu&#8217;elle représente pour les collectivités territoriales un potentiel de financement alternatif des projets de développement durable, qui constitue l&#8217;un des fondements de l&#8217;éthique de l&#8217;industrie financière islamique, qui privilégie, en toutes circonstances, l&#8217;investissement responsable et de long terme.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La Qatar Islamic Bank a d&#8217;ores et déjà déposé auprès de la Banque de France une demande d&#8217;agrément pour ouvrir une succursale en France, qui devrait être la première d&#8217;une banque islamique universelle dans l&#8217;Hexagone.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">En septembre 2009, le Parlement avait adopté dans le cadre de la loi sur les PME un article modifiant le régime de la «fiducie» (le transfert temporaire de propriété) et devant faciliter l&#8217;émission en France de sukuk. Ce dispositif avait été censuré par le Conseil constitutionnel, au motif que l&#8217;article n&#8217;avait pas de lien avec l&#8217;objet du texte présenté : le Conseil constitutionnel n&#8217;avait rien trouvé à redire sur le fond du dispositif, et le gouvernement va «réintroduire la modification dans un nouveau véhicule législatif plus approprié, qui évitera la censure du Conseil constitutionnel», a assuré Christine Lagarde. Il s&#8217;agirait en fait d&#8217;inscrire cette adaptation de l&#8217;environnement juridique français dans la loi bancaire et financière qui doit être présentée en décembre 2009, soit dans le projet initial, soit par amendement. Des instructions fiscales sont également en préparation pour éviter que les instruments financiers «charia compatibles» soient trop lourdement taxés.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">La réception et à l’intégration de la finance islamique en France repose sur la mise en oeuvre d’outils efficaces qui contribueront à faire ou non de Paris une place financière islamique européenne de taille dans les cinq prochaines années. Les pouvoirs publics Français ont compris les enjeux de cette finance émergente. Pour reprendre Anouar Hassoune, Vice Président de Moody&#8217;s : &#8220;La finance islamique est une chance pour la France, de même que la France est une chance pour la finance islamique&#8221;.<br />

<p style="text-align:justify;"><span style="color:#333399;">Lors de son intervention à l’occasion de la <a href="http://ribh.wordpress.com/2009/11/04/finance-islamique-bercy-video/">Conférence sur la Finance  Islamique</a> organisée le 3 novembre 2009 à Paris sous l’égide du Ministère français de l’Economie et des Finances, Carlos Ghosn le PDG du groupe Renault-Nissan, a confirmé que son groupe est en quête de produits financiers islamiques afin de diversifier ses financements dont les besoins sont évalués à 20 milliards d&#8217;euros par an, et ceci dans un contexte de tarissement généralisé des sources de capitaux au niveau mondial.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Parmi les domaines dans lesquels le groupe Renault souhaite avoir recours à des instruments financiers islamiques, Carlos Ghosn a mentionné le financement de projets d’implantation de nouvelles unités de production, notamment dans les pays maghrébins. Il a cité d’autre part, au niveau &#8220;corporate&#8221;, le marché des obligations islamiques – les sukuks – pour diversifier la base d’investisseurs et augmenter la participation aux investissements. Par ailleurs, au niveau du réseau de distribution, il a indiqué que Renault envisage de proposer des financements islamiques à ses importateurs ainsi qu’au client final lorsque celui-ci le souhaite : <a href="http://www.rcibanque.com" target="_blank">RCI Banque</a> qui finance la vente des véhicules Renault pourrait notamment offrir des financements basés sur l’Ijara, l’équivalent islamique du leasing.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Pour illustrer sa perception de la finance islamique, le PDG de Renault a établi un parallèle entre l’introduction de la voiture électrique sur le marché automobile et l’introduction de la finance islamique sur une place financière. Carlos Ghosn a souligné qu’à ce titre, le succès des produits financiers islamiques en France est tributaire d’une conception simple et standardisée, d’un effort de communication qui en facilite la compréhension par les clients, et de coûts compétitifs.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Faisant l’éloge de la finance islamique qui a le mérite de se concentrer sur le financement de l’économie réelle, le PDG du groupe Renault a insisté à cet égard sur le rôle essentiel des pouvoirs publics pour assurer le démarrage de la finance islamique en France, estimant qu’une fois les préalables réglementaires parachevés le marché prendrait spontanément en charge le développement des financements charia compatibles en France.</span></p>

<p style="text-align:justify;"><span style="color:#333399;">Parmi les projets du groupe pour lesquels des financements islamiques seraient les bienvenus, le PDG de Renault a notamment cité le projet Renault Tanger-Méditerranée au nord du Maroc dont la construction a été lancée le 31 octobre 2009 et dont la production devrait démarrer début 2012, avec une capacité d’assemblage à terme de 400.000 véhicules par an pour un investissement global qui avoisinera le milliard d’euros.</span></p>
<p style="text-align:justify;"><span style="color:#333399;">Doté d’une usine ultramoderne et installé en zone franche, Renault a pour objectif de faire de ce complexe industriel automobile basé au Maroc, l’un des sites les plus compétitifs et l’une des plaques tournantes du groupe pour la production à petits prix de véhicules économiques exportés partout dans le monde à partir du complexe portuaire de Tanger Med.</span></p>

<p>Čak je i mene postidio. Svaka mu čast!</p>

<p><em>Još jedan radni vikend! Nastavljaju se aktivnosti oko poribljavanja jezera Šićki Brod. Članovi istoimene sekcije zajedno sa matičnim društvom SRD &#8220;Rudar-Kreka&#8221; Tuzla uspješno su poribili ovo jezero. Ovaj put sa ribom ulovljenom na jezeru Modrac koju su dobili poslje održanih kvalifikacaija za svjetsko prvenstvo o kojem je već pisano na ovoj stranici.</em></p>
<p><em>U ovom poribljavanju je prebačeno oko 400 kom. uglavnom deverike kao i par manjih šarana i bucova. Sva riba je preživjela transport.</em></p>
<p><em>Ovom prilikom zahvaljujemo se učesnicima i organizatorima takmičenja koji su dozvolili da se ulovljena riba prenese u jezero &#8220;Kop&#8221; (Šićki Brod).</em></p>
<p><em>Ovom prilikom najuspješnijima čestitamo sa željom da postignu sto bolji plasman na predstojećim takmičenjima. Nadamo se da će jednog dana doći i takmičiti se na jezeru koje su i oni na ovaj način poribljavali&#8230;</em></p>

<h2>Bentuk-bentuk Jual Beli Secara <em>Taqs<span style="text-decoration:underline;">i</span>th</em></h2>
<p style="text-align:justify;"><strong>Satu : </strong>Sistim kontan dan kredit.</p>
<p style="text-align:justify;">Contoh : seorang penjual berkata : “Saya jual mobil ini seharga 100 juta secara kontan dan seharga 150 juta secara kredit”.</p>
<p style="text-align:justify;"><strong>Dua :</strong> Sistim kredit pilihan dengan jangka waktu.</p>
<p style="text-align:justify;">Contoh : seorang penjual berkata : “Saya jual mobil ini secara kredit, kalau satu tahun harganya 150 juta, kalau dua tahun harga 175 juta dan kalau tiga tahun harganya 200 juta”.</p>
<p style="text-align:justify;"><strong> Tiga : </strong>Sistim kontan dan kredit dengan pilihan jangka waktu.</p>
<p style="text-align:justify;">Contoh : seorang penjual berkata : “Saya jual mobil ini 100 juta secara kontan dan kalau secara kredit satu tahunnya seharga 150 juta, kalau dua tahun seharga 175 juta dan kalau tiga tahun seharga 200 juta”.<!--more--></p>
<p style="text-align:justify;">Tiga bentuk ini termasuk dalam kategori jual beli secara <em>taqs<span style="text-decoration:underline;">i</span>th</em> yang dibolehkan dalam syari’at Islam dan tentunya akad transaksi terhitung sah apabila terjadi kesepakatan antara penjual dan pembeli pada salah satu harga dan jangka waktu yang tertera dalam akad sebagaimana yang telah diterangkan. Pada contoh pertama –misalnya- harus ada kesepakatan apakah ia mengambil dengan harga kontan 100 juta atau mengambil secara kredit 150 juta. Demikian pula pada contoh kedua si pembeli harus memilih salah satu dari pilihan yang ada, apakah ia mengambil mobil itu secara kredit selama satu tahun, dua tahun atau tiga tahun dengan ketentuan harganya masing-masing, dan demikian seterusnya.</p>
<p style="text-align:justify;"><strong>Beberapa Hukum Dan Etika Seputar Jual Beli Secara <em>Taqs<span style="text-decoration:underline;">i</span>th</em></strong></p>
<p style="text-align:justify;">*      Tidak diragukan bahwa jual beli secara <em>taqs<span style="text-decoration:underline;">i</span>th</em> adalah <em>mustahab </em>(sunnah,dianjurkan) bila dilakukan dengan maksud memudahkan pembeli sesuai dengan apa yang mencocoki keadaannya. Rasulullah <em>shollall<span style="text-decoration:underline;">a</span>hu ‘alahi wa ‘al<span style="text-decoration:underline;">a</span> <span style="text-decoration:underline;">a</span>lihi wa sallam</em> bersabda :</p>
<h3 style="text-align:justify;">رَحِمَ اللهُ عَبْدًا سَمْحًا إِذَا بَاعَ , سَمْحًا إِذَا اشْتَرَى , سَمْحًا إِذَا اقْتَضَى</h3>
<p style="text-align:justify;">“Allah merahmati seorang hamba yang samhan (pemurah hati,toleran) bila membeli, samhan bila menjual (dan) samhan bila memberi keputusan”.(HR. <strong>AL-Bukh<span style="text-decoration:underline;">a</span>ry</strong>)</p>
<p style="text-align:justify;">*      Transaksi jual beli secara <em>taqs<span style="text-decoration:underline;">i</span>th</em> yang dibolehkan tentunya bukan pada barang <em>rabawy </em>yang memiliki <em>‘illat </em>yang sama. Sebab sebagaimana telah dijelaskan dalam volume yang telah lalu bahwa dua barang <em>rabawy</em> yang sama dalam <em>‘illat</em>nya namun berbeda jenisnya, maka dalam penukaran antara satu jenis dengan yang lainnya disyaratkan harus saling pegang dan pada saat itu juga (kontan). Maka tidak boleh –misalnya- mencicil emas dengan menggunakan mata uang, sebab keduanya adalah barang <em>rabawy </em>dan memiliki <em>‘illat</em> yang sama yaitu <em>muthlaquts tsamaniyah</em> (mempunyai nilai tukar dalam transaksi jual-beli) sehingga harus kontan tidak boleh secara kredit atau berangsur.</p>
<p style="text-align:justify;">*      Terlihat dalam praktek jual beli secara <em>Taqs<span style="text-decoration:underline;">i</span>th</em> adanya pensyaratan dari penjual agar hak kepemilikan diserahkan kepada pembeli saat penyerahan cicilan terakhir. Yaitu pembeli telah mengambil barangnya namun penulisan keterangan surat atau bukti kepemilikan bahwa barang itu adalah miliknya diserahkan saat pelunasan cicilan terakhir. Maksud pensyaratan tersebut adalah agar pembeli komitmen dan serius dalam menyelesaikan tunggakannya dan bila pembeli bangkrut, barang tidak diikutkan dalam perhitungan barang yang bankrupt sehingga merugikan penjual. Pensyaratan yang seperti ini dinilai oleh Syaikh ‘Abdulllah bin ‘Abdurrahman bin Jibrin mungkin untuk dibenarkan namun beliau sendiri tidak memastikan syahnya/benarnya dan beliau khawatir hal tersebut masuk dalam kategori penjualan dengan dua syarat yang terlarang. Disisi lain <em>Majlis Majma’ Al-Fiqh Al-Isl<span style="text-decoration:underline;">a</span>my</em> dalam keputusan no. 51 (2/6) pada point keenam menyebutkan bahwa penjual tidak ada hak untuk menyimpan kepemilikan barang padanya setelah terjadi transaksi.</p>
<p style="text-align:justify;">*      Adapun kalau hak kepemilikan sudah ditetapkan dan tertulis untuk pembeli maka tidak mengapa penjual menyimpannya sebagai jaminan agar pembeli tetap menyelesaikan tunggakannya. Demikian Fatwa Syaikh Syaikh ‘Abdulllah bin ‘Abdurrahman Jibrin dan keputusan <em>Majlis Majma’ Al-Fiqh Al-Isl<span style="text-decoration:underline;">a</span>my</em> dalam keputusan no. 51 (2/6) pada point keenam.</p>
<p style="text-align:justify;">*      Tidak diperbolehkan penjual menetapkan denda materi terhadap pembeli bila terjadi keterlambatan pembayaran setelah jatuh tempo, sama sekali tidak diperbolehkan walaupun penetapan denda terjadi sebelum akad transaksi karena hal tersebut tergolong riba jahiliyah yang telah diuraikan dalam <em>Dh<span style="text-decoration:underline;">o</span>bith</em> keempat dalam Volume 06 yang telah lalu. Adapun denda yang berkaitan dengan badan seperti dipenjara atau semisalnya maka hal tersebut diperbolehkan, tentunya dengan melalui mahkamah syari’at. Demikian kesimpulan Fatwa Syaikh Syaikh ‘Abdulllah bin ‘Abdurrahman Jibrin dan keputusan <em>Majlis Majma’ Al-Fiqh Al-Isl<span style="text-decoration:underline;">a</span>my</em> dalam keputusan no. 51 (2/6) pada point ketiga dan keempat.</p>
<p style="text-align:justify;">*      Tidaklah pantas seorang muslim membeli dengan cara <em>taqs<span style="text-decoration:underline;">i</span>th</em> kecuali kalau punya kemampuan untuk membayar cicilannya dan bersungguh-sungguh untuk hal itu agar ia tidak merugikan orang lain dan tidak pula membebani dirinya dengan sesuatu yang ia tidak mampu.</p>
<p style="text-align:justify;">*      Boleh hukumnya membeli barang secara <em>taqs<span style="text-decoration:underline;">i</span>th</em> walaupun ia mampu membayar secara kontan. Kendati demikian kalau seseorang mampu membayar kontan maka itu lebih baik dan lebih terpuji untuk dirinya.</p>
<p style="text-align:justify;">*      Tidak boleh seorang penjual memanfaatkan banyaknya kebutuhan manusia untuk meninggikan harga sehingga menjadi sangat mahal.</p>
<p style="text-align:justify;">*      Muslim yang paling baik adalah orang yang menerapkan hadits Rasulullah <em>shollall<span style="text-decoration:underline;">a</span>hu ‘alahi wa ‘al<span style="text-decoration:underline;">a</span> <span style="text-decoration:underline;">a</span>lihi wa sallam</em> berikut ini :</p>
<h3 style="text-align:justify;">إِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً</h3>
<p style="text-align:justify;"><em>“Sesungguhnya sebaik-baik manusia adalah yang paling baiknya dalam menunaikan”.</em> (HR. <strong>Muslim </strong>dari Abu R<span style="text-decoration:underline;">a</span>fi’ <em>radhiyall<span style="text-decoration:underline;">a</span>hu ‘anhu </em>dan Riwayat <strong>Al-Bukh<span style="text-decoration:underline;">a</span>ry</strong> dan <strong>Muslim</strong> dari Abu Hurairah <em>radhiyall<span style="text-decoration:underline;">a</span>hu ‘anhu</em>)</p>

<h2 style="text-align:justify;"><strong>Jual Beli Dengan Cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em></strong></h2>
<p style="text-align:justify;">Jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em> adalah seseorang menjual suatu barang dengan harga tertentu secara kredit lalu ia kembali membelinya dari pembeli dengan harga yang lebih sedikit secara kontan.</p>
<p style="text-align:justify;">Hakikatnya ia tidaklah dianggap sebagai jual beli, melainkan hanya sekedar pinjaman riba yang disamarkan dalam bentuk jual beli dan termasuk bentuk <em>h<span style="text-decoration:underline;">i</span>lah</em> (tipu daya) orang-orang yang senang melakukan riba.</p>
<p style="text-align:justify;">Contoh : Ahmad menjual barang kepada Muhammad dengan harga Rp. 1.000.000,- secara kredit selama satu bulan, kemudian Ahmad atau yang mewakilinya kembali datang kepada Muhammad membeli barang tersebut dengan harga Rp. 800.000,- secara kontan.</p>
<p style="text-align:justify;">Kasus ini banyak terjadi di zaman ini, seperti seseorang yang hanya memegang uang sebesar 20 juta sedang ia mempunyai kebutuhan yang sangat mendesak sebesar 200 juta, maka datanglah orang tersebut ke sebuah perusahan mobil yang mempunyai bagian penjualan dan bagian pembelian kemudian menkredit dari bagian penjualan sebuah mobil senilai 220 juta dengan membayar panjar menggunakan uang yang dia pegang sebanyak 20 juta. Setelah mengambil mobilnya ia datang kepada bagian pembelian dan menjual mobil tersebut dengan 200 juta. Inilah yang disebut dengan jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>.</p>
<p style="text-align:justify;">Jadi ukurannya, kapan barang tersebut jatuh kembali kepada pihak penjual maka ia terhitung sebagai jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>.</p>
<p style="text-align:justify;">Demikian pula <em>h<span style="text-decoration:underline;">i</span>lah</em> (tipu daya) segitiga yang disebutkan oleh Syaikhul Islam Ibnu Taimiyah dan Ibnul Qoyyim dengan contoh seorang fakir yang butuh uang lalu ia pun datang seorang seorang pedagang. Oleh si pedagang ia diajak ke toko untuk mengambil barang apa saja yang ia inginkan. Si fakir mengambil sebuah barang dengan harga Rp. 1.000.000,-, yang oleh si pedagang dinilai 1.200.000,-. Karena si fakir sebenarnya hanya butuh uang maka barang tersebut kembali dijual kepada pemilik toko dengan harga yang lebih rendah dari 1.000.000,-.</p>
<p style="text-align:justify;"><strong>Hukumnya</strong></p>
<p style="text-align:justify;">Jual beli secara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em> adalah haram dan tidak diperbolehkan menurut <em>Jumhur ulama </em>(kebanyakan ulama). Hal tersebut diriwayatkan dari ‘<span style="text-decoration:underline;">A</span>isyah, Ibnu ‘Abb<span style="text-decoration:underline;">a</span>s, Anas bin M<span style="text-decoration:underline;">a</span>lik, Ibnu S<span style="text-decoration:underline;">i</span>r<span style="text-decoration:underline;">i</span>n, Asy-Sya’by, An-Nakh’iy dan juga merupakan pendapat Al-Auz<span style="text-decoration:underline;">a</span>’iy, Ats-Tsaury, Abu Han<span style="text-decoration:underline;">i</span>fah, M<span style="text-decoration:underline;">a</span>lik, Ahmad dan Ish<span style="text-decoration:underline;">a</span>q.</p>
<p style="text-align:justify;">Disisi lain Imam Asy-Syafi’iy dan pengikutnya membolehkan jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>.</p>
<p style="text-align:justify;"><strong>Tarj<span style="text-decoration:underline;">i</span>h</strong></p>
<p style="text-align:justify;">Tidak diragukan bahwa yang benar dalam masalah ini adalah haramnya jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>. Adapun Imam Asy-Syafi’iy dan pengikutnya, mereka berdalilkan dengan Hadits Abu Sa&#8217;<span style="text-decoration:underline;">i</span>d dan Abu Hurairah riwayat <strong>Al-Bukh<span style="text-decoration:underline;">a</span>ry </strong>dan <strong>Muslim</strong> :</p>
<p style="text-align:justify;" dir="rtl"><strong>أَنَّ رَسُوْلَ اللهِ صَلَّى اللهُ عَلَيْهِ وَعَلَى آلِهِ وَسَلَّمَ اسْتَعْمَلَ رَجُلًا عَلَى خَيْبَرَ فَجَاءَهُ بِتَمْرٍ جَنِيْبٍ. فَقَالَ رَسُوْلُ اللهِ صَلَّى اللهُ عَلَيْهِ وَعَلَى آلِهِ وَسَلَّمَ : (( أَكُلُّ تَمْرِ خَيْبَرَ هَكَذَا ؟ )) قَالَ : لَا, وَاللهِ يَا رَسُوْلَ اللهِ, إِنَّا لَنَأْخَذُ الصَّاعَ مِنْ هَذَا بِالصَّاعَيْنِ وَالصَّاعَيْنِ بِالثَّلَاثَةِ. فَقَالَ رَسُوْلُ اللهِ صَلَّى اللهُ عَلَيْهِ وَعَلَى آلِهِ وَسَلَّمَ : (( لَا تَفْعَلْ, بِعْ الْجَمْعَ بِالدَّرَاهِمِ ثُمَّ ابْتَعْ بِالدَّرَاهِمِ جَنِيْبًا )).</strong></p>
<p style="text-align:justify;"><em>“Sesungguhnya Rasulullah shollall<span style="text-decoration:underline;">a</span>hu ‘alaihi wa ‘al<span style="text-decoration:underline;">a</span> <span style="text-decoration:underline;">a</span>lihi wa sallam</em> <em>mempekerjakan seorang di Khaibar. Maka datanglah dia kepada beliau membawa korma Jan<span style="text-decoration:underline;">i</span>b (korma dengan mutu sangat baik) maka Rasulullah shollall<span style="text-decoration:underline;">a</span>hu ‘alaihi wa ‘al<span style="text-decoration:underline;">a</span> <span style="text-decoration:underline;">a</span>lihi wa sallam</em> <em>bertanya : &#8220;Apakah semua korma Khaibar seperti ini ? ia menjawab : &#8220;Tidak, demi Allah wahai Rasulullah, kami mengganti satu sh<span style="text-decoration:underline;">o</span>&#8216; dari (korma Jan<span style="text-decoration:underline;">i</span>b) ini dengan dua sh<span style="text-decoration:underline;">o</span>&#8216; (dari korma jenis lain) dan dua sh<span style="text-decoration:underline;">o</span>&#8216;nya dengan tiga sh<span style="text-decoration:underline;">o</span>&#8216;. Maka Rasulullah shollall<span style="text-decoration:underline;">a</span>hu ‘alaihi wa ‘al<span style="text-decoration:underline;">a</span> <span style="text-decoration:underline;">a</span>lihi wa sallam</em> <em>bersabda : Jangan kamu lakukan seperti itu, juallah semua dengan dirham (mata uang perak) lalu dengan dirham itu belilah korma Jan<span style="text-decoration:underline;">i</span>b.”</em></p>
<p style="text-align:justify;">Sisi pendalilannya : Sabda beliau “<em>juallah semua dengan dirham (mata uang perak) lalu dengan dirham itu belilah korma Jan<span style="text-decoration:underline;">i</span>b</em>” berlaku umum sehingga kalau korma jelek itu dibeli oleh pemilik korma Jan<span style="text-decoration:underline;">i</span>b lalu dengan uang dari hasil penjualan korma jelek itu oleh pemiliknya kembali dibelikan korma Jan<span style="text-decoration:underline;">i</span>b, berarti uangnya kembali kepada pemiliknya.</p>
<p style="text-align:justify;">Dan tentunya pendalilan diatas tidaklah kuat karena tipu daya riba nampak dengan sangat jelas pada jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em> tersebut, apalagi telah datang hadits yang sangat tegas tentang haram jual beli secara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em> sehingga harus dijadikan sebagai  dalil khusus yang membatasi keumuman dalil yang disebutkan oleh  Imam Asy-Syafi’iy dan pengikutnya.</p>
<p style="text-align:justify;">Ibnul Qoyyim dalam <strong><em>Tahdzibus Sunan </em></strong>menerangkan dalil-dalil tentang haramnya jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>. Diantara yang beliau sebutkan adalah hadits Ibnu ‘Umar <em>radhiyall<span style="text-decoration:underline;">a</span>hu ‘anhuma</em>, Rasulullah <em>shollall<span style="text-decoration:underline;">a</span>hu ‘alahi wa ‘al<span style="text-decoration:underline;">a</span> <span style="text-decoration:underline;">a</span>lihi wa sallam</em> :</p>
<h3 style="text-align:justify;">إِذَا تَبَايَعْتُمْ بِالْعِيْنَةِ وَأَخَذْتُمْ أَذْنَابَ الْبَقَرِ وَرَضِيْتُمْ بِالزَّرْعِ وَتَرَكْتُمُ الْجِهَادَ سَلَّطَ اللهُ عَلَيْكُمْ ذُلاًّ لاَ يَنْزِعُهُ حَتَّى تَرْجِعُوْا إِلَى دِيْنِكُمْ</h3>
<p style="text-align:justify;"><em>“Apabila kalian telah berjual beli dengan cara Al-‘<span style="text-decoration:underline;">I</span>nah dan kalian telah ridho dengan perkebunan dan kalian telah mengambil ekor-ekor sapi dan kalian meninggalkan jihad, maka Allah akan menimpakan kepada kalian suatu kehinaan yang (Allah) tidak akan mencabutnya sampai kalian kembali kepada agama kalian”.</em> (HR. Abu Daud dan lain-lainnya dan dishohihkan oleh Syaikh Al-Alb<span style="text-decoration:underline;">a</span>ny dalam <strong><em>Ash-Shoh<span style="text-decoration:underline;">i</span>hah</em></strong> No. 11).</p>
<p style="text-align:justify;">Hadits diatas adalah ancaman yang sangat keras dan peringatan yang sangat tegas berupa kehinaan bagi orang yang melakukan pelanggaran yang tersebut dalam hadits yang diantaranya adalah jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>. Bahkan seakan-akan pelakunya sama kedudukannya dengan orang yang keluar dari agama sehingga diakhir hadits dikatakan “<em>maka Allah akan menimpakan kepada kalian suatu kehinaan yang (Allah) tidak akan mencabutnya sampai kalian kembali kepada agama kalian</em>”. Semua ini menunjukkan haramnya jual beli dengan cara <em>Al-‘<span style="text-decoration:underline;">I</span>nah</em>. Demikian keterangan Ash-Shon’<span style="text-decoration:underline;">a</span>ny dan Asy-Syauk<span style="text-decoration:underline;">a</span>ny.</p>
