<description><![CDATA[Soybean futures finished 14-19¼c higher through the August contract, while new-crop futures were 11¾]]></description>
<content:encoded><![CDATA[<p>Soybean futures finished 14-19¼c higher through the August contract, while new-crop futures were 11¾-13c higher. That was near session highs. Soybean futures bounced back from Monday&#8217;s hefty losses with a round of solid corrective gains. The high-range close suggests additional short-covering is possible, but a lack of followthrough could trigger fresh selling as bears have momentum.</p>
<p>May soybeans finished up 16½ at 1411½, 5½ off the high &#38; 22½ up from the low. July soybeans closed up 19¼ at 1375¼. This was 24¾ up from the low &#38; 2½ off the high. May soymeal closed up 8 at 401.3. This was 9.3 up from the low &#38; 2.4 off the high. May soybean oil finished up 0.8 at 48.98, 0.13 off the high &#38; 0.98 up from the low.</p>

<description><![CDATA[Soybean futures sank into the close to finish 18c lower in May &amp; 23-25c lower in other contracts]]></description>
<content:encoded><![CDATA[<p>Soybean futures sank into the close to finish 18c lower in May &#38; 23-25c lower in other contracts. Futures were pressured by disappointing Chinese GDP growth of 7.7% in the last quarter, which didn&#8217;t live up to expectations. This, combined with more bird flu cases being reported in China, raised concern about Chinese feed demand.</p>
<p>May soybeans finished down 18 at 1395, 24¾ off the high &#38; 1¼ up from the low. July soybeans closed down 23¼ at 1356. This was 1½ up from the low &#38; 24¼ off the high. May soymeal closed down 6.9 at 393.3. This was 1.0 up from the low &#38; 8.7 off the high. May soybean oil finished down 1.05 at 48.18, 1.16 off the high &#38; 0.09 up from the low.</p>

<p>IRS</p>
<p>The monetary policy statement came and went and USD/SGD again in an amazingly tight range of 1.2350  &#8211; 1.2427. The 6M SOR held steady between 0.38242 -0.41119.</p>
<p>No moving SGD rates in a quiet week of trading, the only tenors of interest are the 3-5Y which came under selling out of local banks, yet again, against the steepener pay flows on supposed hedge fund activity. Volumes relatively light without much challenge to the mid week selling activity and market died down to a hush in the past 2 days with the gold rout.</p>
<p>Another week and yet another can of worms. Tying in with the MPS, rates should continue in free fall mode except that there are no bids to catch be it for a lack of trading interest or traders. Considering that most of the rates are now at support levels before the next break down to last year&#8217;s historical lows, it should that the USD/SGD and SGD fwds to dictate the next move. Suggest small paids in the short end to hedge event risks, the other tenors are not going anywhere for now.</p>
<p>SGS</p>
<p>Bonds rallied hard the week before on BoJ and said nothing to the MAS MPS.</p>
<p>Slow markets without much activity on the week with small profit taking selling along the way. With yields treading near their historic lows, the only bonds left with some meat would be the 20Y and 30Y, at 2.14% and  2.56% (historic low 1.91% and 2.25%).</p>
<p>A trader likened it to squeezing water out of stone. After the bull flattening over the past 2 weeks with yields down 7 to 26 bp, the market is heading to take a breather for the time being.</p>

<content:encoded><![CDATA[<p>Soybean futures ended 8-11c higher in old-crop contracts, while new-crop contracts were 4-6c higher today. Old-crop futures posted solid corrective gains for the week, while new-crop futures struggled to find buying interest. A continuation of this week&#8217;s bull spreading is likely again next week. While export demand for US soybeans is slowing seasonally, China has remained a buyer of US old-crop supplies, keeping the market supported.</p>
<p>May soybeans finished up 11 at 1413, 6 off the high &#38; 13½ up from the low. July Soybeans closed up 11 at 1379¼. This was 14 up from the low &#38; 4½ off the high. May soymeal closed up 5.2 at 400.2. This was 5.8 up from the low &#38; 3.1 off the high. May soybean oil finished down 0.54 at 49.23, 0.77 off the high &#38; 0.23 up from the low.</p>

<content:encoded><![CDATA[<p>Soybean futures closed 9¼ &#38; ¾c higher in the May &#38; July contracts. The Sept contract ended a nickel lower, while new-crop contacts were mostly 8-10c lower. Tight supplies &#38; decent old-crop export sales of 319,200 ton, including 526,000 ton in purchases by China, supported nearby soybean futures throughout the day. New-crop contracts struggled to gain traction, however, amid a disappointing 2013-14 export sales figure.</p>
<p>May soybeans finished up 9¼ at 1402, 4¼ off the high &#38; 19½ up from the low. July soybeans closed up ¾ at 1368¼. This was 13 up from the low &#38; 7½ off the high. May soymeal closed up 2.1 at 395.0. This was 5.2 up from the low &#38; 4.1 off the high. May soybean oil finished down 0.26 at 49.77, 0.38 off the high &#38; 0.1 up from the low.</p>

<content:encoded><![CDATA[<p>Soybeans futures saw choppy, two-sided trade today &#38; settled in the lower half of its daily trading range with losses of 2¾-5¾c for the day. Soymeal futures posted slight losses while soyoil finished with marginal gains. Soybean futures softened following the release of USDA&#8217;s Supply &#38; Demand Report. The department left its carryover estimate unchanged from March at 125m bu., which was on the friendly side of expectations. But traders put more focus on USDA&#8217;s 2.42m ton increase in its world soybean carryover projection from last month &#8212; most had expected a slight cut to this figure.</p>
<p>May soybeans finished down 2¾ at 1392¾, 17 off the high &#38; 7¼ up from the low. July soybeans closed down 3¾ at 1367½. This was 8¼ up from the low &#38; 14½ off the high. May soymeal closed down 1.9 at 392.9. This was 2.4 up from the low &#38; 8.0 off the high. May soybean oil finished up 0.05 at 50.03, 0.2 off the high &#38; 0.42 up from the low.</p>

<p>Role of judiciary in a country is of significant importance to set an environment for international arbitration. Pakistan is one of the countries which are known for their unfriendliness towards international arbitration. Although international and domestic arbitrations are governed under different law regimes but a friendly domestic arbitration practice serves as good base for international arbitration to grow in that country. Out of several elements constituting to an arbitration friendly environment, eg developed arbitration law regime, developed arbitration institutions and training facilities for law professionals in arbitration etc, the role of judiciary stands paramount.</p>
<p>Pakistan faced a great deal of criticism due to <i>HUBCO v WAPDA<a title="" href="/Folder%201/Articles/International%20Arbitration%20Debate%20of%20Judicial%20Bias%20in%20Pakistan.doc#_ftn1"><b>[1]</b></a></i> and <i>SGS v Pakistan<a title="" href="/Folder%201/Articles/International%20Arbitration%20Debate%20of%20Judicial%20Bias%20in%20Pakistan.doc#_ftn2"><b>[2]</b></a></i> cases in which Pakistani courts played a role against the expectations of international arbitral community and passed anti arbitration injunctions. Pakistan also became the attention of international arbitration community in a case <i>Dallah v Pakistan </i>[2010] 3 WLR 1472<i> </i>in which Pakistan is accused of causing delay in arbitration proceedings due to its unwillingness to arbitrate the matter. The said matter was disposed off by the ICC tribunal in Paris in almost eight years. Although, this matter was also taken up in Pakistani courts but no anti arbitration injunctions were issued in it. In the first two cases Pakistani courts are said to have breached the international arbitration law regime by intervening into the arbitral process by accepting the jurisdiction upon the matters where exclusive jurisdiction should have been allowed to the arbitral tribunals.</p>
<p>Certainly, these cases should have been better addressed by the courts but contrarily what has been ignored so far is to analyse the overall judicial stand of Pakistani courts and judge the element of judicial bias in the light of overall court practice. A quick perusal of court decisions of Pakistan shows that majority decisions uphold the arbitration agreement and refuse the court jurisdiction in favour of arbitration proceedings. In case titled as <i>Metropolitan Steel </i><i>Corporation</i><i> Ltd v Macsteel International UK Ltd </i>PLD 2006 KAR 664<i>,</i>  suit for recovery of money was filed by plaintiff against which defendant raised the objection that there was an arbitration agreement between the parties to refer all the disputes to arbitration and thus requested the court to refer the matter to arbitration. Plaintiff denied the contention and said that there was no agreement between the parties. Court looked into the detail and found that parties had agreed upon arbitration in the correspondence between them. Court stayed the proceedings of the suit in favour of arbitration and gave finding that the arbitration agreement could also be inferred from the correspondence between the parties and directed the parties to resort to terms of sale contract for the settlement of dispute. In another case titled as <i>Islamic Republic of Iran Shipping Lines v Hassan Ali &#38; Co Cotton (Pvt) Limited </i>CLD 2006 KAR 153 Sindh High Court Karachi acting as the executing court of a foreign award gave finding that court while considering the enforcement of foreign awards merely acts as an executing court and while doing so it cannot go behind the award and sit as an appellate court and make appraisal of evidence. In the same line there are number of other precedents which uphold the arbitration agreements and enforce the foreign awards.<a title="" href="/Folder%201/Articles/International%20Arbitration%20Debate%20of%20Judicial%20Bias%20in%20Pakistan.doc#_ftn3">[3]</a></p>
<p>Before giving an analytical view about the judicial bias in Pakistani courts, there is a need to draw a clear distinction between the element of ‘lack of judicial independence’ and ‘judicial bias’:</p>

<p>The purpose of drawing distinction between both the elements is to draw attention to the fact that the effect of lack of judicial independence in the court decisions should not be mixed with the effect of judicial bias.</p>
<p>Supreme Court of Pakistan fought its battle of independence (known as the “lawyers’ movement”) against the establishment in the era of 2007-2009. The HUBCO and SGS cases were decided in between the years 2000-2002. A common element in both the cases was that in these cases, state or the state interest was directly involved. Hence, the element of influence upon the judiciary cannot be overlooked. While, the element of judicial bias can be rebutted in the light of majority judgments referred above and the receptivity of legal system towards ADRs including arbitration. There are enactments in Pakistan eg Co-operative Societies Act, 1925 and Electricity Act 1910 which specifically contain the provisions which allow the parties to resolve their disputes through arbitration. Pakistan Law Commission which works for development of law and justice in Pakistan consists of Chief Justices and senior judges of superior courts along with other law personalities, has approved various draft statutes, such as the Small Claims and Minor Offences Courts Ordinance, which recognize the ADR mechanism. This receptivity of top judicial body towards arbitration system negates the existence of element of bias for arbitration in the mindset of judiciary.</p>
<p>Irrespective of the discussion above HUBCO and SGS cases can also be considered as the exceptions to general practice which can take place even in the reputed arbitration friendly jurisdictions. As <i>Dallah v Pakistan </i>is one of the most recent examples, in which English court refused to enforce the award rendered by the French tribunal and based its refusal upon section 103(2)(b) of English Arbitration Act, 1996 which reflects article V(I)(a) of the New York Convention according to which recognition and enforcement of award may be refused at the request of the party if the arbitration agreement between the parties was not valid under the law to which the parties have subjected it to or failing any indication thereon, under the law of the country where the award was made. In <i>Dallah</i> case there was no express agreement upon the choice of law applicable upon the arbitration agreement, hence the tribunal should have decided the validity of arbitration agreement under the French law. While, the tribunal decided the validity of arbitration agreement under the principles of international law, which was rejected by the English court at enforcement stage. Although, the awards could be enforced at <i>Dallah’s</i> plea before the enforcing court that the principles of international law constitute to the part of French law, as the French law promotes the approach that arbitration agreements are governed under the transnational principles of law. This example brings forth that exceptions to the general practice can also take place in reputed arbitration friendly jurisdictions. Although Pakistan has failed to develop a friendly image in the field of international arbitration but the responsibility of it is not upon the mindset of judiciary but upon other factors.</p>
<p>Supreme Court of Pakistan after being successful in its battle for the sake of rule of law has passed several bold decisions at national level without accepting any pressure or influence of any other body, which is admirable. January 2010 decision of declaring National Reconciliation Ordinance, 2007 <i>void ab intio</i> and <i>non est</i> which was aimed at providing unlawful relief to the political elite of the country is an example. In this sequence, if a matter relating to international arbitration comes to be dealt by the court, the best expectations are that the court would follow its independent approach and the decision passed would be reasoned and free from the effect of either of the elements discussed above.</p>

<content:encoded><![CDATA[<p>Soybean futures extended gains through the day &#38; posted a high-range close. The May-Sept contracts ended 10-17½c higher, with new-crop contracts up 8¾ to 9½c. Ideas prices fell too far too fast triggered a round of short-covering as traders turned their focus to evening positions ahead of tomorrow&#8217;s USDA reports.</p>
<p>May soybeans finished up 17½ at 1395½, 1½ off the high &#38; 20 up from the low. July soybeans closed up 13¼ at 1371¼. This was 17¾ up from the low &#38; 1¼ off the high. May soymeal closed up 1.5 at 394.8. This was 3.4 up from the low &#38; 2.5 off the high. May soybean oil finished up 0.46 at 49.98, 0.07 off the high &#38; 0.61 up from the low.</p>

<content:encoded><![CDATA[<p>Soybean futures settled high-range with gains of 12-16¼c in old-crop contracts, while new-crop beans reversed early losses to close up 4-5c. Soyoil posted moderate gains. Ideas the downside has been overdone considering basis strength &#38; uncertainty about whether USDA&#8217;s Supply &#38; Demand report Wednesday will confirm heavier old-crop supplies than earlier thought encouraged some short-covering.</p>
<p>May soybeans finished down 10¼ at 1361¾, 11¾ off the high &#38; 7¼ up from the low. July soybeans closed -8 at 1343¾. This was 7¼ up from the low &#38; 9¼ off the high. May soymeal closed down 5.3 at 391.8. This was 1.5 up from the low &#38; 5.8 off the high. May soybean oil finished up 0.28 at 48.83, 0.15 off the high &#38; 0.53 up from the low.</p>

<p>IRS</p>
<p>USD/SGD barely budged on the week, compared to the movements in the JPY driving the NEER to 145 bp. This is not a good sign going into the MPS, which effectively rules out the potential of a tightening.</p>
<p>Thus we had the SOR spiking almost 4 bp higher into today&#8217;s fix above 0.4% again, a level not seen since mid March.</p>
<p>Flows on the week has been light with local banks slamming curve flatteners against some payers who were riding off the back of relative value plays vs the USD curve. The 2-10 flattened some 6 bp as a result.<br />
My view now is that for any weakness in the SGD currency and even with a surprise announcement of weakening on Friday (from the 15% fall in JPY ytd), the impact would be short lived. The chances of SOR heading to zero in the future has increased considerably since last week and we note that BoJ&#8217;s program could stretch up to 5 years.</p>
<p>SGS</p>
<p>Bonds outperforming on BoJ, keeping pace with UST, in anticipation of a surge in inflows. Volumes suggest trading book positioning with the short end seeing great interest despite most issues under 09/2016 trading under 0.20%.</p>
<p>The big picture for bonds has become rosier, dampened only by casual ADB warnings of asset bubbles which is a good reason to load up on SGS. Because bubbles have to grow and the issuance calendar will be light for another 6 weeks till end May where we will have more bond supply in a 7Y reopening.</p>

<content:encoded><![CDATA[<p>Soybean futures moved well off their lows into the close to settle 3¼ to 8¼c lower in old-crop contracts, while new crop posted fractional to 2c gains. Soymeal ended mixed while soyoil posted moderate losses for the day. Strength in the US$ index &#38; concerns that the bird flu situation in China could cause consumers to shy away from meat &#38; poultry products, limiting crushing demand &#38; weighed on old-crop beans today.</p>
<p>May soybeans finished down 8¼ at 1372, 11¾ off the high &#38; 11 up from the low. July soybeans closed down 6 at 1351¾. This was 11½ up from the low &#38; 9¼ off the high. May soymeal closed down 0.9 at 397.1. This was 3.7 up from the low &#38; 2.2 off the high. May soybean oil finished down 0.6 at 48.55, 0.7 off the high &#38; 0.3 up from the low.</p>

Futures came slightly off session lows into the close but still posted losses in the lower to mid-teens. Meal &#38; soyoil saw spillover pressure from soybeans &#38; sharp weakness in crude oil futures.</p>
<p>May soybeans finished down 10½ at 1383½, 13¾ off the high &#38; 8 up from the low. July soybeans closed down 16¾ at 1357¾. This was 5½ up from the low &#38; 19 off the high. May soymeal closed down 4.1 at 398.0. This was 2.9 up from the low &#38; 4.6 off the high. May soybean oil finished down 0.44 at 49.15, 0.67 off the high &#38; 0.02 up from the low.</p>

<p>IRS<br />
No real flows or interest in the market which is a sign of the new norm or perhaps consortiums at work. Economic numbers looking weak with the Feb Industrial Production coming out on the low end of the scale which is very telling of the new economic model for Singapore.</p>
<p>Market took the new 9 mth low in the 6M SOR in its stride with the 1Y irs failing to break the 0.36% before rebounding above 0.4% briefly. Activity for the rest of the curve centred on selling in the 5Y and 10Y irs to no challengers as local bank and his friendly parties continue to dominate the market. Thus just calm into the MAS monetary policy statement and 1Q flash GDP numbers next week before we get an inkling of what lies ahead.</p>
<p>Rates now below their 200 day moving averages and moving into filmsy support levels before the historic low abyss-zone of 2012. The strength of the inflows into ASEAN for Q1 has got the region worried for outflows to come and thus, perhaps, pose a new challenge for the central bank&#8217;s decision next week.</p>
<p>Suggest profit taking on shorts into MAS MPS and sitting into the event with a clear head.</p>

<p>Cyprus effect and yet SGS did not see the rally that matched UST or JGBs, probably because of the absence of POMO here.</p>
<p>Yet we saw a decent rally in the long ends, the 15Y SGS which caught the fancy of a local bank for it to be the best performer on the week, its yield falling 10 bp at one point before another local bank came out to take profit. It still remains the highest premium bond on the curve at 116 handle.</p>
<p>The 30Y SGS deserves special mention after its auction at 2.77% end Feb. The bond managed a credible rally to 2.7% while the new 5Y is holding the 0.5% level (auctioned at 0.57% last week).</p>
<p>The market is caught in a disconnect as the US stock market rally year to date pours cold water on the need for a safe haven hedge in SGS.</p>
<p>Probability of slightly higher prices going ahead without much conviction of a sustained rally.</p>

<content:encoded><![CDATA[<p>Soybean futures settled mixed, with old-crop contracts 1½ to 3¼c higher &#38; new-crop contracts mostly 1¾ to 4c lower. Soybean futures were solidly higher through the overnight hours amid corrective short-covering. But buying interest faded around the start of pit trade as soyoil &#38; corn weakened, &#38; the market favored the downside until some corrective buying resurfaced late.</p>
<p>May soybeans finished up 3¼ at 1394, 11¾ off the high &#38; 8 up from the low. July soybeans closed up 2¼ at 1374½. This was 7¾ up from the low &#38; 11½ off the high. May soymeal closed up 3.6 at 402.1. This was 2.9 up from the low &#38; 2.3 off the high. May soybean oil finished down 0.47 at 49.59, 0.69 off the high &#38; 0.14 up from the low.</p>

<content:encoded><![CDATA[<p>Old-crop soybean futures posted losses of 7¾-14c, while Sept finished 1½c down. New-crop futures ended 1¼ to 3¾c up. Soymeal &#38; soyoil futures settled mixed with nearby contracts favoring the downside &#38; deferred months the upside. Old-crop futures were pressured by heavy spillover from corn today, as well as USDA&#8217;s heavier-than-anticipated soybean stocks estimate.</p>
<p>May soybeans finished down 14 at 1390¾, 17½ off the high &#38; 4½ up from the low. July soybeans closed down 13¼ at 1372¼. This was 5½ up from the low &#38; 16 off the high. May soymeal closed down 5.1 at 399.5. This was 3.1 up from the low &#38; 6.8 off the high. May soybean oil finished down 0.05 at 50.06, 0.44 off the high &#38; 0.74 up from the low.</p>

<title><![CDATA[Research Plans!  I have become a believer.]]></title>

<content:encoded><![CDATA[<p>This past month the ProGen class has been working on Research Plans.  I got mine written and along the way I learned a lot about why people write them and their value.</p>
<p>I have not been a fan of research plans.  Recently I posted about them:</p>

<p>&#8230;and I received some great comments from Yvette!  Thank you.  Her comments illustrated how (and why) a research plan for a client is helpful.  In discussions with others in the class, a second scenario was presented.  One of the class members uses a very short (one page or less) research plan every time she is researching problem A and she runs into problem B.  Problem B could totally divert her from working on problem A. Instead, she quickly writes a research plan on problem B and move back to Problem A.  She stated sometimes she ends up with quite a stack of problem statements/research plans but at least she knows where the gaps are.</p>
<p>Pretty cool and probably obvious to many!  I have no clear system for tracking identified problems but ones that cannot be addressed at the moment.  This seems like a reasonable way to do it.</p>
<p>One of the common issues with the research plans of the class is that they ended up writing more of a report and less of a plan.  They incorporated the implementation of the plan as part of the plan.  It seems to me that  &#8220;A Plan&#8221; is strictly that&#8230;.what you will do in the future to address the problem.  Even BCG when it requests the research plan, restricts it to one page (part of the document work segment.) Many of the commenters suggested alternative sources and places to look.  While this was helpful it didn&#8217;t address the effectiveness of the structure of the plan itself.  The lesson for me was to see how quickly I could write a research plan&#8211;the quicker I write them then the more likely I am to write many more.  I need to keep refining the process and worry less about the product.  I also learned that one type of problem, say document retrieval, might not elicit the need for a plan and others might vary in what is needed to include.</p>

<p>What I have done since the last posting:  submitted my assignment (took comments and revised it accordingly and that is what is posted here), participated in the group critique, got out a SGS newsletter (painfully), attended SGS Board meeting, got 2 more clients (!), got a request to present my Civil War Prisons presentation to SGS (end of April) and to present at the fall seminar. I also started researching doing house histories (I will blog about that soon), read <em>Inheritance in America: from Colonial Times to the Present</em> by Shammas (I&#8217;ll blog about that as well), skimmed <em>The Law of Sexual Discrimination</em> by Lindgren, and am in the midst of reading <em>Visiting the Courthouse</em>.  I found that my great grand uncle purchased a parcel of land using the Timber Culture Act, which I had never heard of; that&#8217;s a blog topic for the future as well.  I am starting the layout of the Spring <em>SGS Bulletin</em>, which must be published by the end of the month.  Whew!  It&#8217;s an over achiever month.</p>
