Unless you`ve been living in another country or under a rock you can`t help but hear or notice the negative impact the wolf population has had on our big game animals in the western states over the last few years. Sportsmen had a victory this year when hunting seasons were opened on the wolves, however they`re still a big problem. Just a few weeks ago a pack of wolves attacked and killed three of Scott Leeper`s best hunting hounds. Scott Leeper is a lion hunting guide in Wyoming. His dogs whom he raised from birth were maliciously slaughtered by this pack of wolves for no reason other than their own blood lust. Click here for the full story.

Toby Bridges at Lobo Watch out of Missoula Montana has this to say on his blog concerning the wolf population. He also sent this letter out to 350 different organizations including the media, shooting & hunting industry and wildlife agencies. The wolf problem is not being handled even with an open season on them. Here`s what Toby`s letter states: click here. Toby has some great info on his blog regarding wolves and updates on this years harvest.

We want your opinions/facts/stories regarding this matter, email them to us at admin@huntersagainstpeta.com. This information will be sent to the Secretary of Interior – Ken Salazar as well as all wildlife agencies in the west where wolves are a serious threat or will be a serious threat in the future.

Whether you carry a gun or have one in your home for self defense, if you are ever involved in a shooting below is some good advice to keep you out of the pokey after the fact. Even if you are completely in the right, your words, whether written or spoken, need to be chosen very carefully. Shooting your mouth off when you are still pumped full of adrenaline is NEVER a good idea. Venting your emotions about the attack or the individual who attacked you to others isn’t a good idea either, as it could put them in a position of having to make statements that might not look so good for you.

Just remember, even though you are in the right, the liberals and self-proclaimed victims are out to get you. They will twist ANYTHING you say to portray you as the bad guy.

Summary: Shut up and lawyer-up.

It Doesn’t Have to Make Sense: It’s Just the Law – Statements

“…Written statement: a VERY BAD idea! ….”
BY K.L. JAMISON

In 1996, an unhappy consumer attacked the City Marshal of Lancaster, Missouri with a hammer.(1) The Marshal defended himself and later vented his adrenaline to the responding Sheriff stating, “I hope the son-of-a-bitch is dead.” This led to the Marshal’s conviction for involuntary manslaughter and a sentence of seven years in prison.(2) The story had a happy ending, but a story four years and tens of thousands of dollars in the making, and not a story the Marshal enjoyed very much. The Marshal might have avoided the worst part of the story had he not confused his right to remain silent with the right of free speech.

In the movie, Under Pressure, a woman tried to explain the stalking and implied threats of a neighbor. After a disorganized and unconvincing recitation of ambiguous events she lamely concludes, “I’m not a very good story teller.” Most people tell stories badly. In the aftermath of self-defense there can be a giddy stream of consciousness statement which has more to do with the effects of adrenaline than reality. The basic legal advice is “DON’T.”

The first question is, “What is a statement?” In a nation which counts exotic dancing as freedom of speech, a statement is also broadly construed. In 1996, the Missouri Supreme Court ruled that a suspect’s refusal to uncross his legs during questioning could be taken as a statement when later charged with murder.(3) In a separate death penalty case, the court found that the defendant had purchased a used car which sported the bumper sticker, “I’m the person your mother warned you about.” At trial the prosecution argued that the fact he did not remove this bumper sticker revealed something about his character. The Missouri Supreme Court ruled that it was perfectly acceptable for the state to kill this man, in part, because of his failure to remove the bumper sticker.(4) One can imagine the effect of bumper stickers bought in jest such as, “Keep Honking, I’m Reloading.” If this case does not also inspire a re-evaluation of one’s T-shirt collection, nothing will.

There is also the problem of nicknames. As of this writing, a rapper who rejoices in the stage name “C-Murder” is on trial for murder. If I were asked to defend a man named “Murder” or any variation thereof, I would charge more. Massad Ayoob testified in favor of a police officer who had killed a felon nicknamed “Snake.” Captain Ayoob slipped the nickname into his testimony which seems to have had an effect on the jury.

Written statement, a VERY BAD idea!

There is a cynical defense attorney saying: “Anything you say will be misquoted and used against you.” In the movie, My Cousin Vinnie, two, unfortunate Yankees are suspected of murder and during questioning are accused of shooting a clerk. One incredulously asked, “I shot the clerk?” This is taken down and read in court as a confession. Theater audiences laughed, defense attorneys smiled and nodded. There have even been cases where comments by other persons have been attributed to the defendant, and used against him; complete silence is the only bulwark against these mistakes.

The first statement is the 911 call. These calls are recorded and if the call sounds bad for the defendant, it will be played over and over again at trial. In one case, a man cocked his double-action revolver and went after a person who was shooting out windows. When he caught up with the threat he extended his revolver and in the process tripped the light single action trigger pull; arguably an accidental discharge. His 911 call records him saying that he thought he had just shot someone. The 911 operator, trained to keep him on the line and keep him talking, asked why he thought he had shot someone. The man replied, “Lady, I think I’m a pretty good shot.” This callous-sounding statement took accident off the table and the man had to live or die with a self-defense case. This all important introduction to law enforcement must be planned in advance.

The first words out of the caller’s mouth should be the location of the incident. If the battery then dies, or the minutes run out, or some other technological catastrophe occurs the authorities will know that something of interest is at that location, and the caller’s cell phone records can prove that he or she made the call. The next statement is the caller’s name. The core of the 911 call consists of three sentences:

“He tried to kill me.”
“I was never so scared in my life.”
“Send an ambulance.”(5)

The first sentence serves to introduce the roles of the parties, the caller is the victim, the other person the attacker. Being in reasonable fear of life or limb is a prerequisite to acting in self-defense. The phrase “I was never so scared…” is to preclude the prosecutor from claiming that the citizen never said he was scared “until he talked to a lawyer.”(6) The phrase “Send an ambulance” says that the caller does not want anyone to die.

When the police arrive, they will want a more elaborate statement; this should consist only of:

1. He attacked me.
2. I will sign a complaint.
3. There is the evidence.
4. I WANT A LAWYER.

Good Advice.

This restates part of the 911 call and points out critical evidence. One cannot expect the “CSI” team to be called out to pick up every fiber and hair. If a real forensic team routinely conducted the investigations shown on television, its budget would last about a week.

The demand for a lawyer is both the best thing one can do, and a damaging statement. Anyone who is questioned by police has the right to a lawyer; this includes victims. The problem is that the police, and potential jurors, take a demand for a lawyer as evidence of something to hide. To compound the problem, the victim’s decision to remain silent and demand for a lawyer can be used again him or her in court. In the criminal system, one does not have rights, until arrested; it doesn’t have to make sense, it’s just the law. It is a left-handed fortune that people who act in self-defense are routinely arrested. It may be called something else such as “detained” or given the “Alice in Wonderland” explanation “You’re being handcuffed for your own protection.” Whenever a person is not allowed to leave, he is placed under arrest regardless of descriptive terms. If one is arrested, generations of TV shows advise us to remain silent.

Western Missouri Shooters Alliance President Sheila Stokes-Begley employs a cell phone and CZ75 compact.

If the circumstances are ambivalent, simply state a fear of being sued, and demand a lawyer to protect against frivolous litigation. Bernard Goetz was acquitted of criminal charges in the shooting of four thugs on the subway, but was sued for $43 million and lost. Police are frequently sued by criminals and the explanation is likely to ring a bell.

Self-defense cases bring out the curious, the media in the forefront. Comments to friends will be confused and used against you, comments to family will be mistaken and used against you. Both family and friends can be subpoenaed and forced to testify against you. Comments to the media will be sensationalized and this is never good. The New York City prosecutor’s office had determined not to charge Bernard Goetz, until he made unwise remarks to the news media. At some point a statement must be made. The impression is that the earlier a statement is made, the more reliable it is. In reality, the earlier a statement is made, the less reliable it is. The effects of stress will confuse the statement and even cause temporary amnesia. Inaccuracies in the initial statement will convince authorities that the survivor is both a liar and a murderer. A lawyer must be immediately engaged to organize the statement.

A lawyer is a professional storyteller. He will not tell the client how to lie, he will tell him how to tell the truth, a more complicated process than most imagine. The statement must contain facts which track the elements of self-defense. In the case of defense of home or defense of other persons, there may be other elements as well. Knowledge of the assailant’s reputation for violence would certainly be relevant. The most important element to include is fear. A police statement is no place for macho posturing. One cannot use violence against another person unless in fear of life or limb. The survivor must go over every detail of why he or she was terrified, weak-kneed, pants-pissing afraid. If one does foul one’s pants, a not uncommon event, make sure that goes into the statement. No matter how ineffective a storyteller the survivor might be, the jury is sure to believe that.

The caption sucked you in didn’t it? “Drive By Shooting”…it’s a sad commentary on society and the state of art when this kind of story get’s attention but that is the way our MTV, FOX, iPod, Twitter, Facebook, etc. media generated minds work now. Back to the ‘Drive By’…

The drive south down 99 from Whistler to Vancouver was brilliant. The sun finally pushed through the five-week canopy of cloud and the curtain opened to five meters of fallen snow in the past 24 days. Meanwhile, I realised almost immediately that I had fallen into the three most regrettable pitfalls of renting a car.

Number one: never get into a rental car without you sunglasses. Granted it is November on the wet coast so a sunny drive on a day forecast for heavy rain wasn’t expected but I own a store that sells three of the coolest brands of sunglasses out there, have shades stashed in back packs, in my glove box (my wife had my truck) and otherwise scatter them in any number of places around my home and office on ledges and window sills where I meant not to forget them…but step into a shiny new Hyundai from Avis…you get the picture. Note to self, when you get home put a pair of sunglasses in every bag.

Number two: no tunes. No hook up for my HTC Mp3 phone (no iPod dock…not that I have an iPod), no Bluetooth, no CD’s (although the player is marked clearly ‘MP3′…even Hyundai gets that we burn them)…just the radio. Mountain FM? God no. I mean, yes it works, but no. Enter XM Radio (XM2 actually…do they need 2?). Leave it to Hyundai to add XM but no jack for auxiliary hook ups…and to add insult to injury they call it a ‘full size’? They must be made in, well, somewhere with very small people. XM and I develop an inevitable love hate relationship within minutes. Every specialty commercial free station you can imagine categorized by music genre, decade, nationality, a million talk stations from comedy to sports to news, even religion (do they still have that?), every station that is except one that is playing a song I want to listen to. Seek, scan, stop, XM Elvis, 60’s Pop, 70’s, 80’s, 90’s…end of a good song, damn! OFF!!

Finally, the third and hardest to swallow of all rental car pitfalls – especially for hardened Whistler locals like myself who drive full size 4×4, 4 door, Chevy Silverado pick-ups with one of the coolest line ups of stickers ever assembled on a vehicle and, by the way, gets better gas mileage than the Hyundai – the rest stop photo op. It doesn’t matter how core I am or what hoody I have on or what time my meeting with Patagonia at Granville Island to see the 2010/11 winter line up is (yes, already) when I sit down in a rental car I know I will drop my camera ready to shoot in the passenger seat beside me and be resigned to stop at the first rest stop with a view and take a few shots like every other tourist and be humiliatingly recognized and at the same time welcomed as one of them. I can’t fight it, or bother to explain to the guys in the big truck – like mine at home – loaded with sleds who are obviously local and only stopped for the call of nature that happens whenever there are more empty cans of Monster than passengers. I give in to the urge and like a bar star who says she only smokes when she drinks, I pull over and suffer the loss of inner discipline that self righteously drives locals everywhere from interrupting their commute by selfishly enjoying magnificent surroundings like ours…dummies!

The tragic irony of the rental car is that, for me anyways, it is the ultimate excuse and licence to not be cool (except of course for the dorks in Hawaii who insist on renting the Mustang convertibles thinking they are cool). So my pride intact, I pull up on the Tantalus view-point, grab my camera from the seat beside me, fold myself out of the Hyundai (still squinting from the drive south into the sun…no shades), dressed in my city clothes – black shirt, black jacket, black Vans – and lose myself in the grandeur of this place I am so blessed to call home. Go ahead, I think to myself, “Screw the cool guy standard…Claim it!” (MSP, In Deep 2009)

The rolling summit due north is a scene straight out of Alaska…’click’…every rock and tree and shadow line a canvas of white beneath the pale blue sky of morning, and down the valley the snow line on the pines is churning in the smokey mist and warmth of the sunlight seen so rarely this time of year…’click, click, click’. I love the pure imagination of it all…even the digital sound of a shutter release embedded on a chip programmed to echo from the little speaker on my camera to add to the nostalgia of my experience every time I snap a shot like I am Ansel Adams in 1930’something 3 months into a cold winter in Yosemite…brilliant. Another car drives up and snapped back to reality I wonder for a moment what time it is, put the lens cap back in place and fold myself back into the Hyundai and stop. I look again through the windshield at the smokey trees…and get back out for a few more…one more for the road. I laugh to myself and think, ‘I love being a tourist’, and head on down the highway listening to Mountain FM.

It’s awakening to find inspiration in my own time…in my own back yard. What have you passed by lately? or daily? Is there some place you know you’ve always wanted to stop but never have the time? (ie. When your on your way to wait 10 minutes in the line at Starbucks or Wal-Mart or London Drugs? – sorry, no line ups there.) It’s right there outside your window, just a step outside the comfort of your shiny metal box, yes, it’s right there. Stop. Just stop.

(Aside: I would love to hear the stories of the people who just sopped after reading this…)

Back to the ‘Drive By’…need to hit Vancouver, Granville Island by noon. Bathroom break in Squamish, resist the ridiculously priced CD’s at Chevron even though they have a copy of ACDC’s Dirty Deeds…where will I ever find that on CD again? Answer; right there, forever…and don’t even think about the shades on the shiny spinny chrome rack thingy on the counter. Three words, ‘Made In China’, and while I’m at it, why not add one word to that oh so familiar phrase stamped across some ridiculously growing double-digit percentage of our economy that might just sway the buying and manufacturing habits of the western world, ‘communist’. If every second item you purchased was labelled, ‘Made in Communist China’, would you think twice? Just a thought. Two Mocha Monsters for $5.00, an old school chocolate puffed wheat square and I am back on the road.

The drive by shooting begins somewhere on the descent to Stanley Park on the Lion’s Gate Bridge. I look in the rear view and see the perfect reflection of the suspension towers behind me, the city scape in front just above the mirror, wrap the neck cord of my camera around my wrist – just in case – open the window and fire off a round of black and white’s (I pre-programmed a B+W high res mode on my digi) at arms length out the window from the driver’s seat. The first shot amazingly catches an oncoming car completely obscuring the city view above the mirror but captures a perfect mirror image of the bridge and the traffic behind. The next two or three catch the view of downtown Vancouver between the cars, through the suspension cabling, above the tree line of Stanley Park. Here we go.

I rattle off a few more down West Georgia; homeless guy in the soft focus silhouette of the moving trees (moving @30km/h past Burrard), big sign on the Vancouver Art Gallery, cool soft cover on the back of a Silverado like mine, the underside of the Granville Street Bridge at False Creek, a painting through a wood framed window where I parked, and think to myself, “Drive By Shooting…Drive By”. Don’t call the MOT (BC Ministry of Transport) for an opinion on this one, don’t even take mine or think what you think I am suggesting (I accept no liability, blah, blah, blah…). Just think of the possibilities. We have all done it (haven’t we?). Eaten a grape at the grocery store, pocketed some cool meaningless trinket, ridden to the store without our helmet, gone into the back country alone…snapped shots from airplane windows, on the bus or train, taken pics of funny road signs, people, other cars, vistas…this is just the natural progression of the art of every day. It gives new meaning to ‘Street To Peak’ (ha, ha…just thought of that now!). What better place to get it started (not that I am starting anything) than Street To Peak.

Imagine you are a tourist today. Yes, at home or sitting where ever you might be reading this. How many photos did you take on your last week or two escape to somewhere else? How many letters and/or post cards did you write? (Better question – how many did you send?) Did you get out your journal or a pile of napkins and write? and fill more pages than you have in the past six months of the every day? Imagine you are a geeky tourist in a rental Hyundai with no iTunes, squinting into the sun, drinking Monster Mocha, eating Fish and Chips from Tony’s (the best on Granville Island) from a box on the passenger seat, searching for a good song on the local radio, snapping photos of the sky on a dark rainy bridge after a day of stopping a view points and rest stops just because life is good and you don’t know for sure when you will ever be here, right here, right now, again. Imagine if that today was every day.

Where to start? Wait a minute…before you dust off your SLR, load it in the car and hit the road, don’t miss the point. (I can see the type A’s and OCD’s packing their sunglasses and CD’s already.) In the immortal words of Ferris Bueller, “Life moves pretty fast. If you don’t stop and look around once in a while you could miss it.”

Shooters line up to "get on the board" and have a crack at the target at the Wilson's Mills Fire Department turkey shoot.

For those of you that ain’t from ’round here, you may not not know what a Turkey Shoot is. In fact, you may have never even heard of one. (In full disclosure, I’ve never been to one myself). Here in rural North Carolina, Turkey Shoots are usually done by the local Fire Department as a fund raiser (often volunteer fire departments that need supplemental income above and beyond the small amount in public funding they receive). During the nights proceeding Thanksgiving, people gather to pay about $3 or $4 for the opportunity to win a turkey. They bring their own shotguns and to make it fair, the fire department provides everyone with the shells. The participants line up to shoot at targets (not, as you may have originally thought, a turkey), usually at least 35 feet away, and the person who gets the closest to the “X” wins a turkey.

Any good ‘ol boys (or girls) out there that have participated in a Turkey Shoot? How about other traditions or fundraisers that organizations held in your community that “outsiders” may think were strange?

A reporter for the local paper wrote an entertaining recap of his first experience at a Turkey Shoot; the first part of his story is below:

I was holding a shotgun for the first time since Boy Scout camp about eight years ago. I didn’t even know how to load the thing.

When I finally fired the shot, briefly deafening my left ear, I found I’d completely missed the paper target. But I considered it a success since I hadn’t hit one of the cars parked nearby.

Not surprisingly, I didn’t come close to winning a ham or a turkey — the object of the annual fundraiser for the Wilson’s Mills Fire Department.

But Clayton resident Allen Pulley did walk away with a ham for his Thanksgiving dinner, and he had a few words of advice for me.

“You’ve got to have a good gun, a good shell and luck,” said Pulley, sporting a camouflage jacket and a faded cap promoting a pheasant hunt. A crack marksman, he travels to shooting contests all over the country, and he’s been to just about every turkey shoot the fire department has ever had.

Pulley said the main reason he comes is to support the local firefighters. “I think I done bought one fire truck already,” he said.

But organizers of the event — which runs several nights a week throughout November — said attendance has been down in recent years.

“Turkey shoot ain’t what it used to be,” said Charles T. Wilson, the last original member of the fire department, which started in the 1970s.

Firefighter Bill Hardison says the community has changed. “Now 75 percent of the people in town don’t know what hunting is,” he said.

JUPITER, Fla. – Three women and a child in bed were shot to death during a family Thanksgiving gathering in South Florida and a male relative was being sought early Friday.

Police said 17 relatives were in the house when the shootings were reported around 10 p.m. Thursday in Jupiter, a small, well-off beach town about 90 miles north of Miami that is best known as a home to celebrities including Michael Jordan and Burt Reynolds.

Jupiter Police Sgt. Scott Pascarella said officers were looking for Paul Michael Merhige, 35, of Miami. Merhige is a cousin of the 6-year-old victim, Makayla Sitton, and has no criminal record, police said.

The others killed were Merhige’s twin sisters, Carla Merhige and Lisa Knight, 33, and an aunt, Raymonde Joseph, 76, according to police.

Authorities said a fifth victim, Merhige’s brother-in-law Patrick Knight, was being treated at a hospital. His condition was not available. Another man, Clifford Gebara, 52, was grazed by a bullet and was treated by paramedics on the scene and released.

Police across South Florida and the U.S. Marshals Service were searching for Merhige. Pascarella said Merhige is believed to be driving a blue 2007 4-door Toyota Camry with Florida license plate W42 7JT.

Pascarella said police received a 911 call from a neighbor shortly after 10 p.m. Police then received a second 911 call from someone within the home.

Pascarella said the shootings took place inside the house. He said that sometime after Thanksgiving dinner, Merhige left the residence and returned shortly afterward with a handgun.

“What led to this incident, we’re not quite sure,” said Pascarella. “It did not appear there was any altercation prior to this shooting.”

Pascarella said there was an “ongoing resentment” in the family, but didn’t know the nature of the problem or whether the victims were specifically targeted.

Police said the home was owned by Jim Sitton, a photojournalist for WPTV-TV and father of the little girl killed. Sitton told WPTV his daughter was in bed when she was shot. He was at the party at the time of the shooting but was not wounded.

Yellow crime scene tape was stretched around Sitton’s salmon-colored house, located in a well-kept subdivision of stucco homes. Several cars were parked in the driveway, and a crime scene van sat in front.

Sitton told local media that his daughter was supposed to perform Friday in a holiday production of “The Nutcracker.”

“God packed a lot of sweetness into that little body,” Sitton said. “She’s just our life. I don’t know how we are ever going to recover.”

The relationship between Sitton and Paul Merhige was unclear, police said.

Phone calls to a number listed for Paul Merhige were not answered. A phone call to Sitton was also not returned.

Neighbors in the Palm Beach County community were shocked.

“Our kids walk the streets by themselves,” said 67-year-old Nicole Kemp, who did not know any of the victims. “I thought it was the safest place to live. I guess it doesn’t matter, if there’s a maniac here.”

It’s unclear where the adult victims lived. Carla Merhige was a real estate agent in Miami, said a co-worker.

“She was a wonderful agent,” said Joanna Sherman, a manager at Coldwell Banker Residential real estate. “She was very active in the community and in charities. She was just a genuine, beautiful individual. She always had a smile for everybody.”

___

Associated Press writers Suzette Laboy and Tamara Lush contributed to this report.

(This version CORRECTS last names of two victims to ‘Knight.’)

Nov, 24th 2009

A researcher at the University of Minnesota has recently become the target of an animal rights activist by the name of Camille Marino.

The post came last week on the website Negotiation Is Over.com criticizing one of the researchers, Dick Bianco. He has been the focus of a recent Minneapolis Star Tribune story regarding a national campaign by researchers designed to increase support for scientific tests using animals.

Of course Camille Marino denies her post was promoting violence against the researcher, here`s her post: “I believe there is a moral obligation to prevent violence against innocent beings, whether they are animals or humans. If violence will prevent that, it would be justified.”

The FBI is now monitoring his home and are investigating whether it`s a real threat to him or not.

Ladies and Gentlemen, darf ich Euch Susi vorstellen:

I’ve been seeing a resurgence of interest in the so-called “Israeli” draw; that is, in carrying one’s defensive pistol with an empty chamber, and cocking it during the drawstroke.

Please do not do this. There is no good reason to carry a pistol with an empty chamber, and many good reasons to carry your pistol loaded. If you’re afraid that your gun will go off in the holster, get a different gun, a different holster, or get educated about how your gun works. If you’re afraid of accidental discharges, get some professional instruction. If you think the Israelis are all cool and badass and you want to carry like the Sayeret Matkal do, get a life.

That is all.
