<p>The CAN-SPAM Act of 2003 authorizes a US$11,000 penalty per violation for spamming each individual recipient. Therefore, many commercial email marketers within the United States utilize a service or special software to ensure compliance with the Act. A variety of older systems exist that do not ensure compliance with the Act. To comply with the Act&#8217;s regulation of commercial email, services typically require users to authenticate their return address and include a <strong>valid physical address</strong>, provide a <strong>one-click unsubscribe feature</strong>, and <strong>prohibit importing lists of purchased  addresses</strong> that may not have given valid permission.</p>
<p>In addition to satisfying legal requirements, email service providers began to help customers establish and manage their own email marketing campaigns. The service providers supply email templates and general best practices, as well as methods for handling subscriptions and cancellations automatically. They also provide statistics pertaining to the number of messages received and opened, and whether the recipients clicked on any links within the messages.</p>
<p>The  CAN-SPAM Act was recently updated with some new regulations that went into  effect on July 7, 2008.</p>
<p>For the non-USA company, is a good practice to following practice to ensure the effectiveness and healthy development of direct email marketing;</p>
<ol>
<li>Include  a valid physical address in your email.</li>
<li>Do not include any false header information. Make sure the &#8220;From&#8221; and &#8220;To&#8221; routing information include the domain name from which the email message originates.</li>
<li>Do not use misleading subject lines.</li>
<li>Include an opt-out method for email  recipients, provide  one-click unsubscribe feature.</li>
<li>You must be able to process the opt-outs for 30 days after sending the email. You must honor the opt-out within 10 days of receiving the request. You cannot sell or transfer the email addresses of those who opt out.</li>
<li>Avoid  purchase of email list that may not have given valid permission. Build your  email list (database) with Opt-in methods (<strong>Opt-in  Database</strong>).</li>
</ol>

She recently found me at my Copeland address, after years of hounding me exclusively on Yahoo. I hear from her every day. She changes her name, but her saucy pitch is always the same: I am an abject failure in certain departments, but she can help me, baby.</p>

<p>She – or he, or it – is one of the senders of billions of spam emails worldwide everyday (as many as 100 billion a day according to <a href="http://www.spamunit.com/spam-statistics/" target="_blank">this source</a>), many peddling online pharmacy products. She can solve everything from impotency to hair loss to depression. Man, she really knows me.</p>
<p>Online pharmacies popped up in Canada and overseas in the mid 90’s to service underinsured American customers, many of them seniors, who couldn’t afford prescription drugs in the States. Then it exploded.</p>
<p>Spam filters catch some, but the online marketers employ constantly evolving evasive practices, using everything from literary quotations in the subject line (Oh my offence is rank) to random nonsense (Sloppiest U. Epiglottis) to spam poetry, or spoetry (Look our your window, make a child happy).</p>
<p>Legitimate advertisers – the ones targeting their opt-in databases, of which Copeland has many – are constantly scrambling to skirt the spam filters.</p>
<p>Unbelievable stat: According to Microsoft security, 97% of all emails sent over the Internet are spam.</p>
<p>Canada<a rel="attachment wp-att-1761" href="http://copelandcommunications.wordpress.com/2009/12/05/spam-bam-thank-you-maam/ottawa01-thumb-2/"><img class="alignleft size-thumbnail wp-image-1761" title="ottawa01-thumb" src="http://copelandcommunications.wordpress.com/files/2009/12/ottawa01-thumb1.jpg?w=128" alt="" width="128" height="92" /></a>’s Electronic Commerce Protection Act (ECPA) was enacted this year to ostensibly prevent Nancy and her spamming cohorts from peppering our inboxes with provocative invitations to break the law.</p>

<p>Most businesses rely on spam filters to determine the legitimacy of incoming email. Yet filtering technology remains far from perfect, and a good deal of junk email still winds up in users&#8217; in boxes. This fact makes it important to be able to visually spot the differences between real email and the digital rubbish spammers generate. Being able to quickly tell the difference between real email and spam will help you save time, unclog your inbox and pay closer attention to the messages that you really want to read.</p>
<p><strong>Finding the Differences </strong></p>
<p>When it comes to spotting spam, here&#8217;s what to look for:</p>
<p><strong>Step One:</strong> Your first action when examining an email should be to check its subject line. Spammers try their best to make their emails look legitimate, yet an email&#8217;s heading often betrays its true motive. Come-ons for things like herbal medicines and home-equity loans are usually quite easy to spot, since they often have hyperbolic headings like &#8220;Incredible Bargain,&#8221; &#8220;Special Report,&#8221; or &#8220;Limited Offer.&#8221; Phishing messages can usually be identified by headings such as &#8220;Immediate Action Required&#8221; or &#8220;Verify Your Account.&#8221; All of these emails can be erased with no regret.</p>
<p>Cryptic subject lines, such as &#8220;Frank told me to write you&#8221; or &#8220;Important business question,&#8221; are more difficult to interpret and will require you to investigate the message more fully. Any messages without a heading should also be checked out more thoroughly, since it may be either spam or a genuinely important letter that was sent in haste.</p>
<p><strong>Step Two:</strong> An email&#8217;s &#8220;from&#8221; line can provide significant clues about a message&#8217;s worthiness. You already know the names of people you regularly correspond with, so it&#8217;s easy to spot messages from these individuals. On the other hand, emails with a from line that contains only a company name are almost always spam or phishing lures. To research any message&#8217;s legitimacy, check out the email&#8217;s return path to verify that it leads back to the person or organization that it purports to come from.</p>
<p>The trickiest emails to decipher are the ones sent by total strangers, who may be spammers or individuals posing a genuine business question or offer. The only method of determining the legitimacy of these messages is to investigate still further.</p>
<p><strong>Step Three:</strong> The dates can sometimes provide a clue to an email&#8217;s value, and take less than a second to check. If a message with a far past or future date suddenly arrives, it&#8217;s more than likely from a spammer seeking attention.</p>
<p><strong>Step Four:</strong> If you&#8217;re still not sure about a particular message&#8217;s authenticity, examine its content. If an email addresses you as a &#8220;friend,&#8221; &#8220;valued customer,&#8221; or &#8220;colleague,&#8221; you can be sure that its sender doesn&#8217;t know your name.</p>
<p>Poor grammar, bad spelling and awkward, non-native use of English are other signs that should arouse your attention. Also look for Web links that lead to suspicious sites (such as a message from someone supposedly at Acme Co. that contains a link leading to a non-Acme Co. site). Con artists also often use URLs that resemble the name of a well-known company but are slightly altered by adding, omitting or transposing letters.</p>
<p><strong>Step Five: </strong>Never open an attachment unless you  know who sent it, or at least understand why it was sent to you.</p>
<p><strong>The Bottom Line:</strong> Knowing how to tell the difference between real email and spam will help you save time and potentially spare you from financial, professional and emotional loss.</p>
