The evil is out, apparently. Scherzinger has allegedly gone an done it. The rumor has it that the split is imminent and everyone is waiting for the official announcement of Pussycat Dolls splitting or breaking up or kicking a bunch of people out. Nicole just can’t handle the fact that some of the dolls are better and more talented than her. Now, none of the other Dolls speak to her. Team Melody!

Shareholders voted 99 per cent to approve the split of Calgary-based EnCana into two new companies W

Shareholders voted 99 per cent to approve the split of Calgary-based EnCana into two new companies Wednesday.

One, focused on natural gas exploration and production, will retain the EnCana name. The other, Cenovus, will become an integrated heavy oil producer.

Cenovus’ oilsands extraction facility in northern Alberta. Cenovus will become one of Canada’s largest heavy oil and oilsands producers. (Cenovus)

Not since 2001, when Canadian Pacific Enterprises spun off its five divisions, has a large Canadian company spun itself off into new companies.

The theory is that mixing two commodity operations in one company muddles the markets’ perception of their values, whereas splitting them will improve their share prices as investors are attracted to each as a pure play on the price of either oil or gas.

EnCana originally announced the split in the spring of 2008 but put the plan on hold because of the global financial crisis. Then, its shares were trading in the $100 range. On Tuesday, they closed below $56 on the Toronto Stock Exchange.

EnCana will become the second-largest natural gas producer in North America, with stakes in shale basins in northeast British Columbia, Louisiana and Texas. Cenovus will become one of Canada’s largest heavy oil and oilsands producers.

The largest ever hoard of Anglo Saxon treasure has been valued. The gold, which was found on 5th July this year in Staffordshire, was discovered by Terry Herbert while he was out practicing metal detecting on farmland belonging to Fred Johnson. It has now been valued at £3.28 million by the independant Treasure Valuation Committee. The money will be split equally between the two men. The treasure consists of more than 1,500 individual pieces. The collection includes pommel caps and hilt plates. All in all there is 5kg of gold. The significance of the find is being compared to being, at least equal to, the Sutton Hoo discovery of 1939. Highlights of the collection can currently be seen at the British Museum in London. Thanks for reading.

By Shira Ovide & Gregory Zuckerman (WSJ) Chieftain Capital Management Inc., an iconoclastic inve

By Shira Ovide & Gregory Zuckerman (WSJ)

Chieftain Capital Management Inc., an iconoclastic investment firm with a strong two-decade track record, is splitting up following personality conflicts among its leaders, according to people familiar with the matter.

Co-founder Glenn Greenberg, who came into the headlines nearly two years ago for his campaign against management at cable company Comcast Corp., plans to stay at the firm, according to a letter that he, co-founder John Shapiro and two partners sent to investors. Mr. Greenberg’s firm will be renamed Brave Warrior Advisors, according to a person familiar with the matter.

Mr. Shapiro and Chieftain partners Tom Stern and Joshua Slocum plan to launch a new investment firm that will retain the name Chieftain Capital Management, effective Jan. 1, according to the letter. Chieftain manages about $3 billion in assets. Messrs. Shapiro and Stern are cousins.

“Although Chieftain’s partners remain committed to the firm’s investment philosophy, differences on internal firm matters have led us to decide to separate,” said the letter, sent to investors earlier this month.

Mr. Greenberg, son of legendary baseball player Hank Greenberg and a former competitive squash player, founded Chieftain with Mr. Shapiro in 1984.

A person familiar with what Mr. Greenberg has told investors said Mr. Greenberg and Mr. Stern had personality conflicts, and Mr. Shapiro decided to leave with Mr. Stern. Another person said the personality conflicts were between Mr. Greenberg and the three other officials who are starting the new firm.

Through spokesmen, Messrs. Greenberg, Shapiro, Stern and Slocum declined to comment.

At one point, the firm considered retaining an executive-conflict-resolution specialist, according to people familiar with the matter, though it is unclear if it retained one.

The firm has generated annual gains averaging about 18% before fees focusing on “value” investing, or buying inexpensive, sometimes out-of-favor shares in which the firm has deep conviction. Chieftain’s returns are roughly in line with the market so far this year, according to people familiar with the matter. The firm counts among its clients Yale University’s endowment.

While many other investment managers spend much of their time courting new and existing clients, Mr. Greenberg told Wharton School students several years ago that his firm was built on keeping his communications with clients limited, ignoring ideas from Wall Street analysts and avoiding the marketing of his firm.

The firm disdained Wall Street’s mantra of diversification. Chieftain’s largest stock holdings as of Sept. 30 included Lockheed Martin Corp., U.S. Bancorp, and Comcast, three stocks that represented more than 40% of Chieftain’s stock holdings, according to FactSet Research Systems. By contrast, some funds often keep their top positions at less than 5% of their holdings.

Going against the firm’s typically quiet style, Mr. Greenberg in early 2008 launched a public campaign against Comcast management. He sought in part the ouster of Chief Executive Brian Roberts over complaints about the cable company’s strategy and uses of capital.

Comcast at the time said the company’s operating record, growth and stock returns were strong.

After Mr. Greenberg’s campaign went public, Comcast changed some compensation policies and started a dividend, and the Chieftain campaign died down. Mr. Roberts remains Comcast’s chairman and CEO.

More recently, Mr. Greenberg had been noncommittal about Comcast’s negotiations to buy a controlling stake in General Electric Co.’s NBC Universal. He told the Journal last month that Comcast has moved in the “right direction” since his campaign last year, but he said he would reserve judgment on the possible NBC Universal deal.

After the firm’s planned breakup, Bryan R. Lawrence, the founder of Oakcliff Capital, will work with Mr. Greenberg, as will Mary Mulholland, Chieftain’s vice president of administration, the Chieftain officials said in the letter to investors.

The letter said clients will be asked to select which of the new firms will manage their investment assets.

Paul Fribourg, chairman and chief executive of agribusiness-and-investment firm Continental Grain Co., a longtime investor with Chieftain, said the firm was a collection of “smart, strong-willed, opinionated” people but “I don’t think there’s any hidden mystery or blowup.” Mr. Fribourg, who added that he had no direct knowledge of why the firm was splitting up, said he hadn’t yet decided what he’d do with his Chieftain investments.

But the nation’s sweetheart Cheryl Cole and husband Ashley have been putting on a united front to play down reports of marriage trouble.

The couple, who wed three years ago, looked happier than ever as they attended the birthday party of Cheryl’s bandmates Sarah Harding and Kimberly Walsh on Saturday.

Hot on the heels of her X Factor appearance, Cheryl looked stunning in a neon pink scultped dress as she and her footballer beau arrived hand-in-hand.

It’s the second time in a week 26-year-old Cheryl has quashed reports of marital problems.

On Friday she posted a picture of herself with her ring in front of her face and the line “3 words. Diamonds Are Forever” on Twitter.

Long time, no post. Sorry about that.

It’s official, the split in the Tri-Partite Alliance is inevitably going to occur. We all knew it would; but recent developments have cemented the end of the ANC’s hold on power. The recent media brawl between ANCYL President Julius Malema and SACP Deputy Secretary-General Jeremy Cronin over Malema’s non-policy-based calls for nationalisation of South Africa’s mines, has resulted in an all-out battle between the two Alliance partners.

Jeremy Cronin and the SACP call for the ‘socialisation’ of the mines, compared to the ANCYL’s calls for the nationalisation of our mines. In other words, the ‘socialisation’ of mines would put their control directly in the hands of the people – and not government. Which century do these people live in? Lenin and Stalin are long dead, as are their ideals; and even the Chinese are embracing forms of capitalism. Communism is dead. Deal with it.

Communism aside, nationalisation is a stupid idea. And this leftist stupidity may be the very cause of the split in ruling party. Let’s hope.

Gwede Mantashe, ANC Secretary-General, has called the Alliance partners more irritating than the opposition. Furthermore, as usual our National Source of Amusement Malema ended up making semi-racial remarks about Cronin (because he is white); this led to the Young Communist League calling Malema a racist… And here we are: at the crossroads of change. If the left can muster up enough courage to break free from the grips of a not-so-leftist-anymore ANC, we would have an opposition-run government in a heartbeat.

It’s been a while, but good things come to those who wait. Hailing from opposite ends of Australia, Perth’s Tangled Thoughts of Leaving and Sydney’s sleepmakeswaves are proud to present you with a shiny new split LP. It’s a record from two bands that are very different yet one that finds an equilibrium between the seemingly disparate tendencies of the two groups. Although both bands find common ground in their latent electronic influences, sleepmakeswaves marry these ideas to their characteristic brand of energetic and uplifting instrumental rock while Tangled Thoughts of Leaving pursue a relentlessly improvisatory, innovative path. The results are more foreboding yet no less spectacular, and are all the more reason to watch for their debut full lengths, slated for 2010.

Tracklisting :

1. Sleepmakeswaves – Keep Your Splendid Silent Sun
2. Sleepmakeswaves – We Sing The Body Electric
3. Sleepmakeswaves – This Is How We Remember (Secret Robot)
4. Tangled Thoughts of Leaving – A Vexing Predicament
5. Tangled Thoughts of Leaving – The World Is A Deaf Machine

THE X FACTOR judge CHERYL COLE has taken to the internet to silence rumours her marriage is in trouble – by posting a picture of herself wearing her wedding ring online.
The singer wed soccer star Ashley Cole in a lavish ceremony in 2006, but last year (08) their relationship was rocked by allegations the sportsman had a fling on an alcohol-fuelled night out with his teammates.

They have since put on a united front, but rumours of a split were fuelled recently when the couple was spotted arguing at a charity event. The singer was subsequently seen appearing on the British talent show without her wedding ring.

But the star has moved to dismiss speculation about the union with a telling post on her Twitter.com blog page – she has posted a picture of herself holding her left hand up to the camera, complete with her sparkling diamond band.

The post reads, “3 Words. Diamonds Are Forever.”

The best auto accident lawyer in California in all probability does not have any of these character

The best auto accident lawyer in California in all probability does not have any of these character profiles or tendencies. Consequently, these are clearly not your ten best reasons to hire an auto accident lawyer or what you should be looking for in a good auto accident attorney. They’re reasons to fire an auto accident attorney. Here are our best ten.

1. He doesn’t own a car.

2. He doesn’t know how to drive.

3. He doesn’t look like he’s old enough to shave.

4. He works at a fast food outlet during the day.

5. The bar association has never heard of him.

6. He used to sell cars.

7. Your neighbor, the one you can’t stand, recommended him.

8. When you call him, someone in India who normally handles computer questions, answers the phone.

9. When you mention his name to other attorneys they break out in laughter.

10. He keeps moving his office to different states.

If you’ve been the victim of a car, motorcycle, truck, pedestrian, bicycle, or auto accident, lost a loved one in a wrongful death or been the victim of a dog bite or animal attack, you can visit our website at http://www.SebastianGibsonLaw.com for more information and call us at any of the numbers easily found on our website.

At the law firm of Sebastian Gibson, we don’t seek to take cases from other attorneys. If you’re having difficulties with your current auto accident attorney, the first thing you should do is request a meeting and let him or her know your concerns. Ask to see your file. You may find out that he or she is actually doing a good job. Or you may not.

On the other hand, if your attorney refuses to meet with you much less return your phone calls, and if you’ve lost all trust in your auto accident lawyer, you may have no alternative but to change attorneys.

If you’re already in litigation, don’t fire your attorney until you’ve lined up a replacement lawyer. You may have difficulty finding a lawyer who will take your case once it’s in litigation. Many attorneys won’t take cases that have already been filed in court. Our firm feels the same way. The reason for this reluctance is that no attorney wants a case that has been mishandled, especially if it has been mishandled in the litigation phase.

If your claim hasn’t yet gone into litigation and its become clear to you that you can no longer continue with your current lawyer, you may want to consider this fact. If your attorney quits, he or she isn’t entitled to any portion of the attorney fees from your settlement. Consequently, it will be easier for you to find another lawyer if that lawyer doesn’t have to eventually split his or her fee with your former attorney.

On the other hand, if you fire your current attorney, any new lawyers you contact will weigh whether or not your case has sufficient value to make it worthwhile for them to become involved if they have to eventually split their fee with your former attorney.

What this means is that it will be beneficial to your ability to find a new lawyer if you can convince your current attorney to quit. An attorney formally quits by sending you a letter that he is declining to represent you any further. If you are in litigation, an attorney can withdraw only by filing a substitution of attorney replacing himself or herself with you or with your new attorney.

Having made a mistake with the first attorney you hired, you now need to know how to avoid making the same mistake twice. You can’t afford to hire a second bad attorney for your case. But what makes a good attorney from a bad one?

Contrary to popular belief, it’s not his or her skills in the courtroom. It’s his or her personal communication skills. A good attorney returns every client’s phone calls as soon as he or she is able to. A bad attorney ignores his clients’ calls when he or she thinks they don’t need to talk to him or her. An attorney with good communication skills, both in how he talks and listens to you, and how he or she can write, will likely be just as good in court as he or she is in his office and on the phone.

A good attorney is meticulous and organized. A good attorney can still have an office that’s messy, but your file had better be well organized or it will be very unlikely he or she can prepare a thorough and complete evaluation of your case with copies of all the medical bills and records, wage loss documentation, car damage photos and estimates, witness statements (if necessary), the police report and police photos (if any) and a well-written demand letter from four to twenty pages in length, the length of which depends mostly upon the volume of medical records and the severity of your injuries. A bad attorney almost certainly won’t be conscientious or sufficiently organized to prepare anything close to a good demand package for the insurance company and as a result, the settlement offer the insurance company makes on your case will reflect this.

A good auto accident attorney will be experienced in negotiating auto accident settlements. He or she will also be good at negotiating the medical liens and any amounts that have to be paid out of your settlement for your medical treatment. A bad attorney will recommend that you take the first or second offer an insurance adjuster makes on your case and will also think that you have to pay your medical liens and any medical bill balances dollar for dollar, when in reality, they can often be reduced substantially.

A bad attorney screams and yells at insurance adjusters, putting themselves on the adjuster’s mental list of attorneys they least want to talk to. A good attorney is respectful, even when disagreeing with an insurance adjuster’s evaluation of a case, and persuasive in presenting your claim because he knows all of the details having written a thorough demand letter to get the best settlement possible.

A bad attorney leaves all of the above to his or her staff of secretaries, clerks and paralegals while he or she does other things. A good attorney does virtually all of the legal work himself, leaving just some of the typing to his secretaries and just the research to his law clerks or paralegals (and many good attorneys won’t even delegate the research) while preparing the demand package letter and talking with the insurance adjusters himself or herself.

Most of all, a good attorney is personable. He or she has a sense of humor and is able to make you feel comfortable and even smile. You can relate to him or her just as he or she can relate to you. He neither brags nor needs to. He or she has a quiet confidence and a winning personality. Most of all, you feel like he or she could be someone you’d want to call your friend.

At the law offices of Sebastian Gibson we return every client’s phone call as soon as it comes in, or if we are in court, as soon as we return to the office. There are no secretaries writing demand letters, returning the calls made by clients wanting to speak to the attorney and no staff member talks to an insurance company adjuster in place of Sebastian Gibson.

Attorney Sebastian Gibson has obtained millions of dollars in settlements and multiple million dollar settlements and has over thirty years of experience.

We invite you to visit our website at http://www.SebastianGibsonLaw.com and call us if you’ve been seriously injured in a personal injury auto, pedestrian, bicycle, car, truck or motorcycle accident or if you’ve lost a loved one in a wrongful death or if you or a family member has been bitten or attacked by a dog or other animal and need to retain an attorney.

We believe that you hired an attorney for your auto accident case for that attorney’s expertise, not for him or her to shove the work off onto inexperienced and untrained in the law staff members.

Most of all, we like our clients and we hope they truly like us. We hope that you will feel the same way about your attorney.

Consequently, these are quite clearly not your ten best reasons to hire a wrongful death lawyer or what you should be looking for in a good wrongful death attorney. They’re reasons to fire a wrongful death attorney. Here are our best ten.

1. He goes to a dozen funerals every week to pick up new clients.

8. He always dresses up like Dracula for Halloween.

The best truck accident lawyer in California in all probability does not have any of these character profiles or tendencies. Consequently, these are clearly not your ten best reasons to hire a truck accident lawyer or what you should be looking for in a good truck accident attorney. They’re reasons to fire a truck accident attorney. Here are our best ten.

1. When he signed you up in the hospital, you though you saw him slip the nurse a fifty for giving you his phone number to call.

2. He normally just handles loan modifications.

3. Some of his former clients have a website that says he’s a jerk.

4. You see him hitchhiking on his way to work.

5. Everyone at the truck stops calls him “Slick Willy.”

6. Your ex-wife, the one that hates your guts, suggested you hire him.

7. He looks like he sleeps in his clothes and only has the one set of clothing.

8. There’s always some white powder residue on his desktop.

9. He never fully explained why his contingency fee is 90%.

10. You still don’t understand how he justified his last trip to Vegas as being a “cost” he was entitled to deduct from your settlement.

A bad attorney almost certainly won’t be conscientious or sufficiently organized to prepare anything close to a good demand package for the insurance company and as a result, the settlement offer the insurance company makes on your case will reflect this.

A good truck accident attorney will be experienced in negotiating truck accident settlements.

We believe that you hired an attorney for your truck accident case for that attorney’s expertise, not for him or her to shove the work off onto inexperienced and untrained in the law staff members.

Most of all, we like our clients and we hope they truly like us. We hope that you will feel the same way about your attorney.
