<content:encoded><![CDATA[<div class='snap_preview'><p><span style="color:#dc143c;">Whether you carry a gun or have one in your home for self defense, if you are ever involved in a shooting below is some good advice to keep you out of the pokey after the fact.  Even if you are completely in the right, your words, whether written or spoken, need to be chosen very carefully.  Shooting your mouth off when you are still pumped full of adrenaline is <em><strong>NEVER </strong></em>a good idea.  Venting your emotions about the attack or the individual who attacked you to others isn&#8217;t a good idea either, as it could put them in a position of having to make statements that might not look so good for you.</span></p>
<p><span style="color:#dc143c;">Just remember, even though you are in the right, the liberals and self-proclaimed victims are out to get you.  They will twist <em><strong>ANYTHING </strong></em>you say to portray you as the bad guy.</span></p>
<p><span style="color:#dc143c;">Summary:  Shut up and lawyer-up.</span></p>

<h2>It Doesn&#8217;t Have to Make Sense: It&#8217;s Just the Law &#8211; Statements</h2>
<p><span style="font-style:italic;">&#8220;&#8230;Written statement: a VERY BAD idea! &#8230;.&#8221;</span><br />

<p>In 1996, an unhappy consumer attacked the City Marshal of Lancaster, Missouri with a hammer.(1) The Marshal defended himself and later vented his adrenaline to the responding Sheriff stating, &#8220;I hope the son-of-a-bitch is dead.&#8221; This led to the Marshal&#8217;s conviction for involuntary manslaughter and a sentence of seven years in prison.(2) The story had a happy ending, but a story four years and tens of thousands of dollars in the making, and not a story the Marshal enjoyed very much. The Marshal might have avoided the worst part of the story had he not confused his right to remain silent with the right of free speech.</p>
<p>In the movie, Under Pressure, a woman tried to explain the stalking and implied threats of a neighbor. After a disorganized and unconvincing recitation of ambiguous events she lamely concludes, &#8220;I&#8217;m not a very good story teller.&#8221; Most people tell stories badly. In the aftermath of self-defense there can be a giddy stream of consciousness statement which has more to do with the effects of adrenaline than reality. The basic legal advice is &#8220;DON&#8217;T.&#8221;</p>
<p>The first question is, &#8220;What is a statement?&#8221; In a nation which counts exotic dancing as freedom of speech, a statement is also broadly construed. In 1996, the Missouri Supreme Court ruled that a suspect&#8217;s refusal to uncross his legs during questioning could be taken as a statement when later charged with murder.(3) In a separate death penalty case, the court found that the defendant had purchased a used car which sported the bumper sticker, &#8220;I&#8217;m the person your mother warned you about.&#8221; At trial the prosecution argued that the fact he did not remove this bumper sticker revealed something about his character. The Missouri Supreme Court ruled that it was perfectly acceptable for the state to kill this man, in part, because of his failure to remove the bumper sticker.(4) One can imagine the effect of bumper stickers bought in jest such as, &#8220;Keep Honking, I&#8217;m Reloading.&#8221; If this case does not also inspire a re-evaluation of one&#8217;s T-shirt collection, nothing will.</p>
<p>There is also the problem of nicknames. As of this writing, a rapper who rejoices in the stage name &#8220;C-Murder&#8221; is on trial for murder. If I were asked to defend a man named &#8220;Murder&#8221; or any variation thereof, I would charge more. Massad Ayoob testified in favor of a police officer who had killed a felon nicknamed &#8220;Snake.&#8221; Captain Ayoob slipped the nickname into his testimony which seems to have had an effect on the jury.</p>

<p>There is a cynical defense attorney saying: &#8220;<span style="text-decoration:underline;"><strong>Anything you say will be misquoted and used against you</strong></span>.&#8221; In the movie, My Cousin Vinnie, two, unfortunate Yankees are suspected of murder and during questioning are accused of shooting a clerk. One incredulously asked, &#8220;I shot the clerk?&#8221; This is taken down and read in court as a confession. Theater audiences laughed, defense attorneys smiled and nodded. There have even been cases where comments by other persons have been attributed to the defendant, and used against him; complete silence is the only bulwark against these mistakes.</p>
<p>The first statement is the 911 call. These calls are recorded and if the call sounds bad for the defendant, it will be played over and over again at trial. In one case, a man cocked his double-action revolver and went after a person who was shooting out windows. When he caught up with the threat he extended his revolver and in the process tripped the light single action trigger pull; arguably an accidental discharge. His 911 call records him saying that he thought he had just shot someone. The 911 operator, trained to keep him on the line and keep him talking, asked why he thought he had shot someone. The man replied, &#8220;Lady, I think I&#8217;m a pretty good shot.&#8221; This callous-sounding statement took accident off the table and the man had to live or die with a self-defense case. This all important introduction to law enforcement must be planned in advance.</p>
<p>The first words out of the caller&#8217;s mouth should be the location of the incident. If the battery then dies, or the minutes run out, or some other technological catastrophe occurs the authorities will know that something of interest is at that location, and the caller&#8217;s cell phone records can prove that he or she made the call. The next statement is the caller&#8217;s name. The core of the 911 call consists of three sentences:</p>
<p>&#8220;He tried to kill me.&#8221;<br />
&#8220;I was never so scared in my life.&#8221;<br />
&#8220;Send an ambulance.&#8221;(5)</p>
<p>The first sentence serves to introduce the roles of the parties, the caller is the victim, the other person the attacker. Being in reasonable fear of life or limb is a prerequisite to acting in self-defense. The phrase &#8220;I was never so scared&#8230;&#8221; is to preclude the prosecutor from claiming that the citizen never said he was scared &#8220;until he talked to a lawyer.&#8221;(6) The phrase &#8220;Send an ambulance&#8221; says that the caller does not want anyone to die.</p>
<p>When the police arrive, they will want a more elaborate statement; this should consist only of:</p>
<p>1. He attacked me.<br />
2. I will sign a complaint.<br />
3. There is the evidence.<br />
4. I WANT A LAWYER.</p>

<p>This restates part of the 911 call and points out critical evidence. One cannot expect the &#8220;CSI&#8221; team to be called out to pick up every fiber and hair. If a real forensic team routinely conducted the investigations shown on television, its budget would last about a week.</p>
<p>The demand for a lawyer is both the best thing one can do, and a damaging statement. Anyone who is questioned by police has the right to a lawyer; this includes victims. The problem is that the police, and potential jurors, take a demand for a lawyer as evidence of something to hide. To compound the problem, the victim&#8217;s decision to remain silent and demand for a lawyer can be used again him or her in court. In the criminal system, one does not have rights, until arrested; it doesn&#8217;t have to make sense, it&#8217;s just the law. It is a left-handed fortune that people who act in self-defense are routinely arrested. It may be called something else such as &#8220;detained&#8221; or given the &#8220;Alice in Wonderland&#8221; explanation &#8220;You&#8217;re being handcuffed for your own protection.&#8221; Whenever a person is not allowed to leave, he is placed under arrest regardless of descriptive terms. If one is arrested, generations of TV shows advise us to remain silent.</p>
<p style="text-align:center;"><a href="http://texan2driver.wordpress.com/files/2009/11/self-defense-cz75.jpg"><img class="aligncenter size-medium wp-image-2824" title="Self Defense CZ75" src="http://texan2driver.wordpress.com/files/2009/11/self-defense-cz75.jpg?w=320" alt="" width="320" height="216" /></a><span style="font-size:90%;font-style:italic;">Western Missouri Shooters Alliance President Sheila Stokes-Begley employs a cell phone and CZ75 compact.</span></p>
<p>If the circumstances are ambivalent, simply state a fear of being sued, and demand a lawyer to protect against frivolous litigation. Bernard Goetz was acquitted of criminal charges in the shooting of four thugs on the subway, but was sued for $43 million and lost. Police are frequently sued by criminals and the explanation is likely to ring a bell.</p>
<p>Self-defense cases bring out the curious, the media in the forefront. Comments to friends will be confused and used against you, comments to family will be mistaken and used against you. Both family and friends can be subpoenaed and forced to testify against you. Comments to the media will be sensationalized and this is never good. The New York City prosecutor&#8217;s office had determined not to charge Bernard Goetz, until he made unwise remarks to the news media. At some point a statement must be made. The impression is that the earlier a statement is made, the more reliable it is. In reality, the earlier a statement is made, the less reliable it is. The effects of stress will confuse the statement and even cause temporary amnesia. Inaccuracies in the initial statement will convince authorities that the survivor is both a liar and a murderer. A lawyer must be immediately engaged to organize the statement.</p>
<p>A lawyer is a professional storyteller. He will not tell the client how to lie, he will tell him how to tell the truth, a more complicated process than most imagine. The statement must contain facts which track the elements of self-defense. In the case of defense of home or defense of other persons, there may be other elements as well. Knowledge of the assailant&#8217;s reputation for violence would certainly be relevant. The most important element to include is fear. A police statement is no place for macho posturing. One cannot use violence against another person unless in fear of life or limb. The survivor must go over every detail of why he or she was terrified, weak-kneed, pants-pissing afraid. If one does foul one&#8217;s pants, a not uncommon event, make sure that goes into the statement. No matter how ineffective a storyteller the survivor might be, the jury is sure to believe that.</p>

<p>ALTISSIMO. Nell&#8217;ultimo mese i Cc sono intervenuti 3 volte. La vittima: «Bisogna denunciare». Botte alla donna appena operata a una gamba. È già tornato libero</p>
<p><!--more-->Altissimo. Calci e pugni in testa con violenze anche psicologiche, fino ad arrivare a minacciare di morte la convivente. Una squallida vicenda che si sarebbe consumata tra le mura domestiche, quella scoperta dai carabinieri e che, stando ai riscontri investigativi, pare si sia ripetuta soprattutto in queste ultime settimane. La cittadina slava P.D. di 58 anni residente ad Altissimo sarebbe stata vittima delle insistenze di un muratore di 63 anni di Chiampo, già noto alle autorità, con cui viveva da 3 anni. Una violenza scatenata dai fumi dell&#8217;alcol, secondo quanto emerso dalla testimonianza della donna e dai riscontri dei carabinieri coordinati dal tenente Giacomo Gandolfi. Vittorino Fracasso è stato arrestato per maltrattamenti, lesioni, minacce e atti persecutori che vengono riassunti nel cosiddetto &#8220;stalking&#8221;. Ieri l&#8217;uomo, difeso dall&#8217;avv. Luca Arzenton, è stato interrogato dal gip Furlani che ha convalidato l&#8217;arresto e l&#8217;ha rimesso in libertà con l&#8217;obbligo di non frequentare le zone dove vive e lavora la presunta vittima. La procura aveva sollecitato gli arresti domiciliari, ma il giudice ha accolto le osservazioni della difesa. Secondo la donna, che si è rivolta ai militari del maresciallo Gianpiero Del Mese di Crespadoro, Fracasso non avrebbe esitato a colpirla anche ad una gamba su una ferita dopo un&#8217;operazione. Ormai esasperata e stanca di maltrattamenti ha denunciato il compagno, bloccato dai militari in tempo per evitare un principio di soffocamento della donna.  Per contro, l&#8217;uomo ha riferito che all&#8217;origine della sua frustrazione c&#8217;era il comportamento della donna che dopo essersi fatta mettere a posto l&#8217;appartamento («ho speso parecchi soldi» ha detto) l&#8217;ha lasciato per un altro. L&#8217;epilogo si è verificato ad Altissimo, davanti all&#8217;abitazione in cui si era recata per prendere le sue cose, dopo aver abbandonato il convivente per le angherie.  Nell&#8217;occasione, l&#8217;uomo per bloccarla le avrebbe messo una mano sul viso, pare impedendole di respirare. L&#8217;arrivo dei militari ha scongiurato il peggio. Solo dall&#8217;inizio del mese gli episodi segnalati ai Cc erano stati addirittura tre con richiesta di intervento a pattuglie di Arzignano, Chiampo e Crespadoro.  Ieri la donna ha lanciato un appello: «Credevo di morire, ma ho vinto gli effetti delle pressioni psicologiche riuscendo a chiedere aiuto ai militari dell&#8217;Arma. Ora mi rivolgo a tutte le donne, che hanno vissuto o che stanno vivendo situazioni analoghe a quella in cui mi sono trovata. Si deve avere il coraggio di denunciare quanto subito poiché atteggiamenti di omertà alimentano ulteriori episodi di violenza».(Ha collaborato Luigi Centomo)   Giancarlo Brunori</p>

People that you might know because 14 of your friends know them, people who don&#8217;t have enough friends so I can help them find some? Since when did Facebook think I should be some sort of internet matchmaker. Haven&#8217;t they heard, Eharmony is doing a &#8220;fine job&#8221; of that without my suggestions.<br />
What really gets to me is when they actually have the audacity to suggest to me that I reconnect with my husband. I hope they aren&#8217;t watching me on the webcam that we have here on the computer desk in my bedroom. Perhaps we aren&#8217;t getting it on quite enough. They would know THEY are watching. </p>

<p><strong><em>Famiglia uguale violenza?</em></strong><br />
L&#8217;85-90% dei casi di violenza alle donne si verifica in famiglia.</p>
<p><strong><em>Come agite?</em></strong><br />
Diamo ascolto e protezione alle donne, che spesso hanno paura di non essere credute, temono il giudizio degli altri. Da noi prendono coscienza di ciò che vivono. Non è facile: avevano fiducia nei loro aggressori, spesso hanno avuto figli da loro. I centri antiviolenza offrono consulenze legali, collaborano con le realtà sociosanitarie e le forze dell&#8217;ordine.</p>
<p><strong><em>E sono preparati?</em></strong><br />
Serve più formazione e informazione in un&#8217;ottica di intervento integrato e multidisciplinare di aiuto che coinvolga forze dell&#8217;ordine, servizi sociali, ospedali, medici di base, insomma tutti i soggetti.</p>
<p><strong><em>La legge è adeguata?</em></strong><br />
Manca una legislazione nazionale per i centri antiviolenza e la situazione è a macchia di leopardo: alcuni ottengono finanziamenti dagli enti locali più sensibili; altri stentano a sopravvivere. Da parte del governo non c&#8217;è un piano organico. Per questo è necessaria una sinergia fra tutti i soggetti coinvolti per fornire risposte adeguate alle donne che chiedono aiuto.</p>
<p><strong><em>Cosa bisogna migliorare?</em></strong><br />
Stiamo chiedendo al governo un piano d&#8217;azione nazionale affinché tutte le cittadine abbiano ovunque le stesse possibilità. Manca inoltre una legge sullo stalking, che riconosca come reato le persecuzioni subite dalle donne da parte di partner ed ex.</p>
<p><strong><em>Ci sono casi di successo?</em></strong><br />
Spesso l&#8217;esito è positivo. Molte donne che si rivolgono ai Centri trovano lavoro e indipendenza economica grazie ad un percorso personale di consapevolezza che restituisce loro autostima. Alcune donne riescono anche a tornare a casa.</p>
<p><strong>Parole amare</strong><br />
La violenza tra le mura di casa si esprime sotto varie forme, che spesso si compenetrano. Ecco un breve glossario per capire di più.</p>
<p><strong><em>Violenza domestica</em></strong><br />
Uno dei coniugi esercita un controllo autoritario sull&#8217;altro partner, che sfocia in violenza verbale (con ricatti e imposizioni), ma anche fisica o sessuale. Possono esserne coinvolti anche i figli.</p>
<p><strong><em>Violenza psicologica</em></strong><br />
Anche se apparentemente è meno evidente della violenza fisica o sessuale, consiste in una serie di gravi denigrazioni, umiliazioni, minacce e strategie di isolamento, che limitano molto la vita della vittima. Spesso incapace di rendersi conto di subire tanto.</p>
<p><strong><em>Violenza economica</em></strong><br />
Sono tutti gli atteggiamenti che limitano l&#8217;indipendenza economica (di solito della donna). Piegando la dignità della persona, le si sottrae lo stipendio, la si costringe a contrarre debiti, le si impone di lasciare il lavoro. Il controllo economico è poco riconosciuto, anche perché ancora oggi è considerato normale che sia l&#8217;uomo a &#8220;mandare avanti la famiglia&#8221;.</p>
<p><strong><em>Stalking</em></strong><br />
Il termine inglese (&#8220;perseguitare&#8221;) indica una serie di atteggiamenti ripetuti verso un&#8217;altra persona, spesso di sesso opposto, che generano stati di ansia e paura e possono comprometterne la quotidianità. La persecuzione avviene di solito mediante intrusioni nella vita privata: telefonate, lettere, email, inseguimenti, appostamenti, che possono riguardare anche persone legate affettivamente alla vittima. Lo stalker può essere un estraneo, ma più spesso è un conoscente, un collega o un ex partner.</p>

My phone died so I wasn&#8217;t able to check my celeb crap all day.  Killed me <img src='http://s.wordpress.com/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' />  But, I was pretty sure that Mr. Pattinson was already gone so it was tolerable.  AND, not being able to be reached by the Cling-Ons that I gave birth to was a major bonus.  Anyway, ended up back at the Not Soho and used my new $12 sketchy-bought-from-street-vendor charger.  Checked out radaronline (one of the 72 places I go for up-to-the-minute gossip) and I find out <strong>RPATTZ</strong> is STILL IN NYC.  Holy crap!  Time for scheming! LOL</p>
<p>We decide on Thai food (lower east side &#8211; called Sea I think??)&#8230;Not happy w/my outfit sadly. Grey mini dress (cute &#8211; <strong>Michael Stars</strong> bought thru <strong>RueLaLa</strong> &#8212; Bargain baby!) with tights and black shooties (shoe/booties)&#8230;it just wasn&#8217;t quite right&#8230;you know those times when you have things that are fine individually but just won&#8217;t work all together?&#8230;and since i was so frugal while shopping I had no other options&#8230;grumble&#8230;hair marginal&#8230;face flushed from saunas&#8230;eyes bloodshot from last night&#8217;s alcohol consumption and lack of sleep. I threw back THREE champagne cocktails (called Strawberry Mojos b/c of the yummy strawberry puree in them!) while dissecting my entree. Over dindin we discussed our potential destinations&#8230;I read that <strong>RPattz</strong> was possibly staying at the <strong>Bowery Hotel</strong>. They have a fun &#8216;lounge&#8217; there so we decided to check it out after dinner.  Tried to come up with a code word in case we spotted him.  OHMYGODITSROBERTPATTINSON was really just not going to work, kwim?  Ash and Robin were coming up with terrible code words like &#8216;Sparkle&#8217; and &#8216;Vampire&#8217;&#8230;jesus, may as well just say OHMYGODITSROBERTPATTINSON, kwim?</p>
<p>So, <a href="http://www.theboweryhotel.com/"><strong>the Bowery Hotel</strong></a>&#8230;so cool.  Very cozy, shabby-chic&#8230;but British and hunt country too&#8230;make any sense? We walked right in&#8230;which, from what I have since read, is unusual b/c there are parts of it that are &#8216;hotel guests only&#8217;. Settle in for cocktails in the back bar area. Had my first of THREE champagnes. Only $22/glass, not bad right?! haha  Welcome to Manhattan, bitches!!  Sat in a comfy couch w/the girls and chilled. A Seth Green-looking guy came over to chat us up.  So cute and funny. He was drinking an absinthe cocktail and a coke and carried a Glen-something bottle of scotch. Set for the night, right? He seemed to like Ash and bonded w/her with the acting thing.  But, we dismissed him quickly&#8230;not there for the Seth Greens of the world, kwim? After about an hour, we realized my man wasn&#8217;t there.  Moved on to the next spot.</p>
<p><a href="http://www.bbarandgrill.com/"><strong>The B Bar</strong></a>&#8230;right across the street.  Hung out and had a yummy sangria.  Amazingly I was still able to stand up at this point. Moved onto a latte tho&#8230;Ash &#38; Robin ordered triple espressos&#8230;with butter?  Seriously, the coffee came w/butter. Bartender thought it was white chocolate but she was very very wrong! lol  Quick comment on the bathroom there (after god-knows-how-many-drinks I was in there a number of times!)&#8230;it had an <em>Attendant</em>. I HATE that. I am fully capable of getting my own soap&#8230;and turning the water on&#8230;and getting a paper towel.  And, I don&#8217;t want to have to tip someone in the bathroom.  Do not want to linger in there..fumbling w/dollar bills, etc. It&#8217;s just uncomfortable.  And, you also don&#8217;t want to be the bitch who doesn&#8217;t tip&#8230;it&#8217;s just bad all around.</p>
<p>So, at this point, Robin and I decide we really liked the Bowery Hotel bar and want to go back. Ash thought it was pretentious. (for the record, it sort of was, but I liked it!) My lovely niece thinks going to a drag queen bar would be better. WTF??? Don&#8217;t get me wrong, I love drag queens. I have been to the Drag Queen races in DC. Sometimes, with a bad eyebrow dye job, I even LOOK like a drag queen. I am down with them. We manage to veto her (2 against 1 but she is a fiesty domineering bitch sometimes! lol and so so not kidding)&#8230;</p>
<p>Cue me semi-stumbling in the street and laughing and talking loudly about Rob.  Like, what would I do if I saw him? What would I say? Would I say anything? What if he really looks like a 23 year old baby?  Like, what if I see him and POOF my panties fly off?  What if I trip and fall and my tongue accidentally goes done his throat?   Don&#8217;t recall much more&#8230;other than me yelling the word VAGINA and cackling.  Repeatedly.</p>

<p>A whole lot of artists are unwillingly learning more than they ever wanted to know about the legal process.</p>
<p>Last year it was a tiny case of one individual buying lampwork beads made by glass artists and then this buyer claimed the beads were either made by her or for her in Italy. The glass artists objected to their work being claimed as made by someone else. That was last year. [This detail can be found in the legal papers filed by the victims with the court in Texas.]</p>
<p>This year many of these same artists who objected to their work being claimed by someone else are now being called &#8220;FRAUDS&#8221; and &#8220;Tax Evaders&#8221; in a blog published on the Internet by the individual who is nick named Wacky.</p>
<p>Remember that this sort of slander could happen to anyone, which is why this case is important. Wacky has hired a lawyer. The lawyer is now collecting &#8220;evidence&#8221; and appears to be trolling the internet.</p>
<p>One of the words that lawyers and crime drama shows love to throw around is &#8212; motive.</p>
<p><strong>MOTIVE</strong></p>
<p>What is the motive for someone to continue adding names to this online fraud investigation list? Who would feel the need to dig up obscure individuals, some who have not sold anything online, or who no longer have websites, or who have changed their names or the names of their business? Why spend so much time and effort to call local taxing districts or jurisdictions to personally report artists as tax evaders etc.? Where are these calls coming from and can they be traced? Many individuals on this list had no idea who Wacky is, nor knew any of her history with the glass working art community.</p>
<p>Wacky will get her day in court and she has every right to hire lawyers to represent her. It is too bad that she didn&#8217;t understand the concept of legal proceedings before publishing names of artists on her blog and labeling each one individually as a Tax Evader.</p>
<p>Her blog has published a verdict &#8212; calling people tax evaders &#8212; when not a single person on this list has been indicted, tried NOR been found guilty of tax evasion. Newspapers and legitimate news reporters use the word &#8212; alleged murderer, alleged drunk driver, alleged robber until the individual is convicted or acquitted.</p>

Chances are that you even have an account yourself, seeing as about <strong>21,900,000</strong> people have one today. Just like many social media site such as facebook or hyves, Twitter sounds quite harmless. People can join your account by what is called ‘following’ you, and you can of course follow others. This allows users to send and read other people’s posts, called tweets, about what they are up to. And there’s nothing wrong with occasionally checking what your friends or idols are doing, right?</p>
<p>Well hears the thing, it is not all as nice as it sounds. In fact, according to the Technological Professional Development unit from the University of Alberta, Twitter has privacy issues and is just another medium for voyeurism. I can understand that you are not very concerned about this, because you can decide for yourself whom you wish to follow and who is allowed to follow you. But the fighting fact is that people can be ‘stalked’ on Twitter, without the users knowing they are being followed.</p>
<p>I give you the site <a href="http://tweetstalk.com/">http://tweetstalk.com/</a>, the simple way to stalk Twitter users without having to actually follow them as you would normally have to do. After signing in, the site will provide you an RSS feed, so you can stalk people using your RSS aggregator.</p>

Terminata la relazione, l&#8217;uomo, Daniele Miccioli, un pensionato ravennate di 59 anni, non si era dato per vinto e aveva continuato a cercare l&#8217;amante.</p>
<p><!--more-->Ma le attenzioni non corrisposte si sono rivelate talmente insistenti che la donna, esasperata dalle chiamate e spaventata dalle frequenti visite nei pressi della sua abitazione, ha deciso di allertare le forze dell&#8217;ordine. Le indagini del Norm di Ravenna hanno verificato la situazione, portando così all&#8217;arresto da parte dei carabinieri per il reato di &#8220;atti persecutori&#8221;, in esecuzione dell&#8217;ordinanza di custodia cautelare in carcere emessa dal gip di Ravenna.</p>

I Carabinieri nei mesi scorsi in piu&#8217; occasioni erano intervenuti presso l&#8217;abitazione dell&#8217;ex moglie del pregiudicato per sedare violente liti tra gli ex coniugi, appurando che B.I. in alcune circostanze aveva anche picchiato l&#8217;ex moglie procurandole lievi lesioni.</p>

<description><![CDATA[Last night I had a dream about my ex BF (do we still call them &#8216;boyfriends&#8217; at 50+?). As]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Last night I had a dream about my ex BF (do we still call them &#8216;boyfriends&#8217; at 50+?).  As all my dreams go, I&#8217;m always precariously perched upon an ungodly tall skyscraper with glass floors, and then the scramble to find my way out.  It usually involves an entanglement of staircases, ladders and elevators, all leading to yet another dead end or obstacle to overcome. I guess it doesn&#8217;t take a psychologist to make any assumptions as to what all of that means.</p>
<p>Last evening it involved Japanese people, lean manufacturing processes, cloud computing and a lot of bowing.  I am sure it was because I spent a lot of time on <a href="http://www.metafilter.com/">Metafilter</a> and catching up on <a href="http://abc.go.com/shows/flash-forward">FlashForward</a> .  </p>
<p>So, I met a bunch of factory workers in Japan who put me to work welding, after I finished I bowed away with the object I welded, given as a &#8216;gift&#8217; from one of the thousands of smiley, pasty faced employees.  I then proceeded to go up some stairs, a couple of escalators, climbed a precariously placed ladder and found my way out to Nashville.</p>
<p>In the city, I discovered my ex BF and BFF talking with a beautiful female friend of ours, presumably on a date.  I accused him of two-timing me and I told him I&#8217;d never be back.  But as I always do, I came back to stalk him, and sure enough there he was farking her in the corner of the restaurant behind some boxes.  God, I could even <em>smell</em> the sex in the dream. How bizarre.  Has anyone actually smelled stuff in their dreams?</p>
<p>I looked at him and told him that I wished the two of them the very best, gave him a hug and walked away.</p>
<p>So, after a three month estrangement, I called him after awakening from this dream.  I asked him to be my friend again, and he cried. So whatever this is, it <em>just is</em> and nothing more.  </p>
<p>We&#8217;ll see.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Il Decreto Legge n. 11 del 23 febbraio 2009 (poi convertito in legge il 23 aprile 2009, l. n. 38) ha introdotto un “nuovo” reato in Italia: lo stalking. “Stalking è un termine inglese (letteralmente: perseguitare) che indica una serie di atteggiamenti tenuti da un individuo che affligge un&#8217;altra persona, perseguitandola ed ingenerando stati di ansia e paura, che possono arrivare a comprometterne il normale svolgimento della quotidianità. La persecuzione avviene solitamente mediante reiterati tentativi di comunicazione verbale e scritta, appostamenti ed intrusioni nella vita privata” (fonte: Wikipedia). Il termine utilizzato è decisamente appropriato: lo stalker è un predatore, che si apposta e pianifica inseguimenti, azioni minatorie, diffamazioni, violenze. È colui che aspetta per ore sotto casa, che segue furtivamente, che telefona ad ogni ora, che controlla, che insulta. E che fa paura.</p>
<p>Le modifiche che questo decreto legge apporta al codice penale sono molto importanti. In primo luogo perché conferiscono la giusta importanza a comportamenti apparentemente non gravi quali telefonate, pedinamenti, ecc… ma che sono, in realtà, veri e propri atti persecutori e che, in moltissimi casi, sono l’anticamera di comportamenti violenti, abusi e omicidi: “Salvo che il fatto costituisca più grave reato, è punito con la reclusione da sei mesi a quattro anni chiunque, con condotte reiterate, minaccia o molesta taluno in modo da cagionare un perdurante e grave stato di ansia o di paura ovvero da ingenerare un fondato timore per l&#8217;incolumità propria o di un prossimo congiunto o di persona al medesimo legata da relazione affettiva ovvero da costringere lo stesso ad alterare le proprie abitudini di vita. La pena è aumentata se il fatto è commesso dal coniuge legalmente separato o divorziato o da persona che sia stata legata da relazione affettiva alla persona offesa” (fonte: Ministero dell’Interno).</p>
<p>Un secondo elemento positivo, è l’introduzione dell’Ammonimento: “(…) la persona offesa può esporre i fatti all&#8217;autorità di pubblica sicurezza avanzando richiesta al questore di ammonimento nei confronti dell&#8217;autore della condotta. La richiesta è trasmessa senza ritardo al questore. Il questore, assunte se necessario informazioni dagli organi investigativi e sentite le persone informate dei fatti, ove ritenga fondata l&#8217;istanza, ammonisce oralmente il soggetto nei cui confronti è stato richiesto il provvedimento, invitandolo a tenere una condotta conforme alla legge e redigendo processo verbale. (…). Il questore valuta l&#8217;eventuale adozione di provvedimenti in materia di armi e munizioni. (…)” (fonte: Ministero dell’Interno).</p>
<p>Un grande passo avanti è stato indubbiamente fatto, anche se ancora non riesco a credere che tutto ciò sia stato possibile solo nel duemilanove (!!!!), dopo migliaia di casi finiti in tragedia, ed ettolitri di lacrime versate dalle vittime e dalle loro famiglie. <a href="http://ricostituente.wordpress.com/files/2009/11/munch_l27urlo.jpg"><img class="alignleft size-medium wp-image-942" title="munch_l%27urlo" src="http://ricostituente.wordpress.com/files/2009/11/munch_l27urlo.jpg?w=236" alt="Munch" width="236" height="300" /></a>Questa legge riconosce, finalmente, la gravità delle persecuzioni a cui milioni di donne (e pochissimi uomini) sono soggette quotidianamente. Le forti implicazioni psicologiche nelle vittime degli stolker si protraggono anche per tutta la vita.</p>
<p>Ma ci sono ancora molte questioni da risolvere. L’attuazione della nuova legge è ancora largamente insufficiente per arginare questo drammatico problema sociale e ne sono dimostrazione tutti i casi in cui persone denunciate di stalking riescono comunque a ledere la loro vittima (ultimo episodio raccontato dai giornali solo qualche giorno fa a Pescara) o, una volta scontata la pena, ricominciano la loro attività oppressiva.</p>
<p>Secondo i dati della polizia di stato, da aprile 2009 ad oggi sono state arrestate 520 persone e ne sono state denunciate 2.950. Come mai solo un quinto (circa) delle denunce hanno portato all’arresto?</p>
<p>La risposta che mi sono data è molto semplice: è difficilissimo accedere a strumenti, far avviare le indagini, ottenere davvero una tutela finché non accade qualcosa di grave (a meno che la vittima non sia una persona famosa, o ricca o un politico &#8211; perdonate la vena polemica …). È più facile sentirsi elargire consigli banali (“se teme di essere seguita giri più volte attorno ad una rotonda” … “si prenda lo spray al peperoncino” … “tolga il numero dall’elenco telefonico”) che ottenere la vera e propria apertura di un caso.</p>
<p>La speranza è che questa nuova legge tenga sempre alta l’attenzione e la discussione su questo crimine e che, prima o poi, ogni vittima possa ottenere giustizia prima di essere raggiunta dal leone.</p>

I mean, I always knew that you could search for almost anything, but finding my own name, address, and the names of my household names kind of validated that fear. Anyone could search for it, and show up at your house. </p>
<p>The other day, my boss and I were talking at the front desk, and a guy showed up. He is a piano technician and he tunes pianos at the place she used to work at. He said he was tuning a piano in the area and happen to find the name of the school and her name on the internet while he was searching for directions. It seemed alright at first, but then my boss thought it was weird that he showed up. First of all, the school is facing away from any major streets &#8211; people often get lost here, and our place isn&#8217;t, admittedly, easy to find. Second, there aren&#8217;t any pianos in this very complex (and he wasn&#8217;t at KYR Music, which was the NEXT complex over), except for ours, so he must have been at someone&#8217;s house tuning their piano, which would have been well away from this shopping complex. And third, the name of the school and her name isn&#8217;t even linked together on the internet. In fact, she never even listed the school&#8217;s name with her name on the internet yet. So, conclusion? Her old work probably sent him here to check up on us. I know, we&#8217;re women and we tend to over-analyze, but there have been strange things happening to her and she didn&#8217;t leave her old school on good terms. In fact, where was this whole lawsuit going on, because they were claiming she took their students. If she had lobbied for her students to follow her here, yes, there would be a reason to sue (It was all in the contract). But since the students followed on their own accord, there&#8217;s nothing to worry about.</p>
<p>But, from all that, is how I found my own name and information on the internet. Kind of scary isn&#8217;t it? I think so. </p>

<p> Unfortunately, you never know, because MySpace does not allow you to see who viewed your page. That was until a little side appeared some time ago under the name Profilesnoop.com. </p>
<p> Profilesnoop.com &#39;s motto is: &#34;Snoop on them while they snoop on you.&#34; How manyof us have not secretly viewed the pages of our exes, enemies, old high-school crushes, employees, etc.? We all do it. </p>
<p> Profilesnoop.com provided you with a code to input into your MySpace profile. This code would be that all attendees signed viewed your site, literally snapping a photo of them if you capture on your profilesnoop.com account, we had collected all this information carefully and ready for you to view. </p>
<p> I was on the lucky people who really, before it usedShut down by Myspace. For about a week, I had this wonderful little tool on my profile. It was just a piece of code in the &#34;Who I&#39;d like to&#34; section, are not visible to everyone, but even entered. </p>
<p> It captures all of the photos displayed on my profile, along with the date, time and IP address. I would be automatically re-directed to mypsace profile of a person by clicking on the photo. Some were my friends, others were a big surprise. I found out that I was always regular viewing of theLast Guy I dated on-again/off-again and his girlfriend. Who knows? </p>
<p> Of course, it was too good to last. Only five days after I had registered with the site, the forums talk about the sums of code from their profiles, including all text and photos in their &#34;Who I like to meet to&#34; number. Apparently, the code in violation of the privacy policy, myspace. </p>
<p> The next day it was gone from my profile as well. I was sad to see it go. But it brings me to thisQuestion: Is it correct to Myspace, I know from the block in a position to know who visited my profile? </p>
<p> I&#39;m sure it will not take long to succeed profilesnoop.com a way to back up and running or all the other plagiarism can occur-run websites. And if they do, I&#39;ll be there &#8230; willing to sign up. </p>
<p> Of course, if we manage to see a way to find exactly who does our MySpace profiles, so that others know that we&#39;re theirs. Would this damper our MySpace experiencemakes us think twice before &#34;cyber-stalking&#34; someone? Maybe. But then again, maybe not. </p>

<p>I carabinieri della stazione di Palestrina hanno arrestato G.F., un romeno di 38 anni, con l&#8217;accusa di atti persecutori, violenza privata e lesioni commessi nei confronti della sua compagna convivente 34enne romena. L&#8217;uomo, da circa un anno usando anche violenza, la costringeva ad assumere comportamenti a lui congeniali.</p>
<p><!--more-->Dopo l&#8217;ennesima lite, la donna, esausta delle continue vessazioni, nonostante le minacce di morte, ha trovato il coraggio di portarsi prima presso il pronto soccorso dell&#8217;ospedale di Palestrina dove i sanitari le hanno riscontrato varie contusioni al collo, giudicate guaribili in 7 giorni e poi presso i carabinieri, raccontando i fatti. <p>AVELLINO (18 novembre) &#8211; Continuava ad assillare una donna con continue telefonate, pedinamenti a piedi e in auto, fino ad arrivare a vere e proprie aggressioni verbali e fisiche in strada.</p>
<p><!--more-->Con l&#8217;accusa di stalking, un uomo di 42 anni, originario di Ariano Irpino, nell&#8217;Avellinese, è stato arrestato dai carabinieri della compagnia del paese irpino. L&#8217;uomo era già stato diffidato in passato per le molestie nei confronti di un&#8217;altra donna, una casalinga di 34 anni del posto.</p>
<p>La sua nuova vittima, che ha una figlia minorenne, ha dovuto per mesi a modificare le proprie abitudini ed era costretta a uscire sempre accompagnata da amiche o familiari. I militari hanno raccolto numerosi elementi di colpevolezza.</p>
