<title><![CDATA[Convention on the Rights of the Child &amp; the Reporting Process]]></title>

<content:encoded><![CDATA[<p><strong>Convention on the Rights of the Child</strong></p>
<p>The Convention on the Rights of the Child is an international treaty that sets out a full set of human rights standards for children. Through ratification of the Convention, national governments affirm their commitment to ensure children’s rights in their country and to be accountable for ensuring those rights. Pursuant to article 44, paragraph 1 of the Convention, national governments, or states parties, are required to submit reports on the implementation of the Convention to the Committee on the Rights of the Child, through the Secretary-General of the United Nations. These reports are due:</p>
<p>(a)    Within two years of the entry into force of the Convention for the state party concerned;</p>
<p>(b)   Thereafter every five years.</p>
<p>Malaysia ratified the Convention in 1995 and has submitted one report, in December 2006, since ratification. Malaysian civil society did not submit any supplementary documents at that time. The next report is due by 19 March, 2012.</p>
<p>As described by Save the Children UK in its Child Rights Supporting Strategy paper:</p>
<p>The periodic reporting process to the Committee on the Rights of the Child is the primary international mechanism for monitoring state obligations under the UNCRC and mobilising civil society to press for change. It is not merely a report, submission or attendance at a meeting in Geneva every few years. This mechanism serves as an important basis for action on addressing the imbalance between state obligations on paper and implementation on the ground. The process provides a framework for awareness raising and mobilisation, analysing national policy and practice, national and international linkages and advocacy, capacity building of local NGOs, monitoring state obligations, facilitating child participation and more.</p>
<p> <strong>Components of the State and Supplementary Reports</strong></p>
<p>Reports should provide information on the measures adopted and progress made by the state party to ensure that children have access to the rights described in the Convention. Any difficulties should also be noted, so that reports furnish the Committee with a full picture of the level of implementation of the Convention. The reporting process is seen by the Committee as a valuable opportunity for state parties to review both their legislative measures and their actual implementation, as well as to engage in a dialogue with the Committee about the status of children’s rights in that country.</p>
<p>As stated in the UN’s General Guidelines for Periodic Reports (CRC), state parties should describe eight areas in their reports:</p>
<ol>
<li>General Measures of Implementation</li>
<li>Definition of the Child</li>
<li>General Principles (articles 2,3,6, 12)</li>
<li>Civil Rights and Freedoms</li>
<li>Family Environment and Alternative Care</li>
<li>Basic Health and Welfare</li>
<li>Education, Leisure and Cultural Activities</li>
<li>Special Protection Measures</li>
</ol>
<p>Within each subject area, the report should describe measures undertaken with reference to the Committee’s previous Concluding Observations. Specific attention should be paid to policies, agreements, programs and services to implement the Convention and also mechanisms to monitor implementation efforts. States must provide information on the amount and percentage of the national budget and other resources devoted annually to children. Data should be disaggregated by gender, disability, geographical area, age, and social or ethnic group, sufficient to indicate trends and highlight groups requiring special attention.</p>
<p>Following Malaysia’s submission of an initial report in 2006, the Committee responded with its Concluding Observations in February 2007. This document included specific recommendations about how Malaysia can fulfill its obligations under the Convention. Special mention was made of particularly vulnerable groups, such as children of migrants, refugee and stateless children, children with disabilities and indigenous children.</p>
<p>In conjunction with the states parties’ reports, the Committee also accepts supplementary, or “shadow,” reports from civil society bodies that provide an additional perspective on implementation of the Convention. Article 43 of the Convention mentions that “other competent bodies” can participate in the reporting process by providing additional information. To provide the fullest possible picture to the Committee, the supplementary reports should include an independent analysis of the child rights situation in the country and an analysis of the State Report. Supplementary reports are also a means to include children’s views which may not be heard elsewhere in the process. The form of the report should follow the government’s report in its consideration of the eight subject areas. The supplementary report also should address issues raised in the Concluding Observations.</p>
<p><strong>Report Submission Process</strong><br />
Once the Committee has received the state report, a date is set for a Plenary Session at which the report is considered by the Committee. Supplementary reports are due within six months of the submission of the state report and three months prior to the Pre-Session.</p>
<p>The Pre-Sessional Working Group is a private meeting between the Committee, in-country NGOs and international stakeholder organizations. The Pre-Session occurs approximately four months prior to the Session with the government to discuss the State Report and the alternative reports. At the Pre-Session, the civil society groups present a list of issues that they wish the Committee to raise with the government officials at the Session, and this list is given to the government representatives so they can prepare written responses in advance of the Plenary Session.</p>
<p><strong> </strong>The Plenary Session is the main meeting between the government representatives and the Committee. During this meeting, the Committee asks a series of questions in the same thematic format as the State Report, and the Government will be given the opportunity to respond. NGOs attend as observers only, they may not make presentations.</p>
<p>Following the Sessions, the Committee responds to all of the information presented in the form of a Concluding Observations document. This response includes notes on progress made, concerns and recommendations, as well as a date for submission of the next report. The Concluding Observations also provide a base and starting point for subsequent State and supplementary reports.</p>

<p> <a href="http://rdale.org/modules/cms/pages.phtml?pageid=93645&#38;sessionid=4a2513043330b7c9a8e36aa47104c2c4&#38;sessionid=4a2513043330b7c9a8e36aa47104c2c4">Robbinsdale Public school </a>located in New Hope, MN which has 12,500 students, 150 buses, vans and 120 drivers chose rSchoolToday&#8217;s rTransportation Request. This software aims to provide a smooth runaround for receiving and entering requests without the worry of having multiple data entry.</p>
<p> Kelly Stano, Transportation Secretary for Robbinsdale attests that before using rTransportation, they use to have a log sheet per day, assign to driver in red at least 3 days in advance for scheduling, and fill out a 4 part Trip Ticket form which needs to be sent to different personnel for approval and documentation. Because of this, orders use to take 5 days to approve, no auto assignment; dispatch log had to be put out so drivers could see 2 weeks in advance. These along with all the hustle and bustle of scheduling Athletics, activity clubs, special ed, and special order buses trips for their students.  This has become a struggle to them since they usually schedule 3,000 trips a year. </p>
<p>One of the main benefits of using rTransporation is that Open tickets are not approved unless they are “coded” properly with an account code.</p>
<p>Kelly likes the fact that she can access everything at home; she sometimes gets calls at 6:00AM and can take care of a situation right away by accessing the application from her home computer.</p>
<p>She can also contract buses from within the district or charter companies from outside. And the fact is Mileage for state reporting is easier now!</p>
<p>Kelly easily runs monthly reports for Sandy regarding special ed usage. State reports are now easier to complete.</p>
<p>Full &#38; part time billing is easy to invoice. By just adding the budget code and simply creating the final amount.</p>
<p>Now it&#8217;s easy to get invoices either inside or outside of the school district. It&#8217;s just one click away by emailing the documents to the client or school.</p>
<p> This application also is convenient to their bus drivers since once every 2 weeks they can print dispatch log which the drivers use to sign up.</p>
<p>Request trips are made easy now that only Admin can request trip 1-2 days in advance, or day of trip.</p>
<p>Admin override is great!</p>
