Capita sempre più frequentemente alla nostra attenzione di visitare giovani a cui gli ortopedici ed alcuni fisiatri hanno diagnosticato una discopatia, specie a livello lombosacrale con conseguenti episodi di sciatica, rigidità della colonna e lombalgie (schiena dolente) e, senza domandarsi il perché di queste particolari ernie al disco in età così giovanile, dopo averli sottoposti ad esami RXgrafici di TAC e di Risonanza magnetica nucleare, decidano di operarli. Ebbene, in pazienti di questo tipo giovanile, se operati di ernia al disco, entro qualche anno si assisterà senza meno alla comparsa di una ulteriore ernia al disco al di sopra di quella già operata: è questo è chiamato l’effetto domino, in cui l’ernia al disco è solo il risultato di una colonna giovanile con difetto posturale e magari con scoliosi iniziale passata inosservata, dovuta nel 90% ad un arto inferiore più corto dell’altro, che porta ad uno squilibrio del bacino: se pensate che la colonna nel suo insieme è composta da una serie di vertebre impilate una sopra all’altra, che sopportano tutto il carico del corpo, con tra una vertebra e l’altra degli ammortizzatori, che sono i dischi intervertebrali, e che per funzionare deve essere perfettamente a piombo, se la base di appoggio della colonna, cioè il bacino, è sbilanciato da un arto più corto, vi rendete conto che con l’andare del tempo uno o più di questi dischi tenderà ad uscire dalla sua posizione naturale, andando a comprimere i nervi che escono dal suo spazio intervertebrale, comprimendoli e provocando dolore inizialmente non costante ma che con l’andare del tempo aumenterà sempre di più.

Fatto questo, si preparerà una talloniera di misura esatta da portare costantemente sotto al calcagno e si farà rientrare l’ernia discale iniziale con un ciclo di massaggi metodo Furter, associati a mesoterapia con i prodotti della SAT-TERAPIA, inoculati sotto pelle con siringhe speciali indolori. Ed i risultati di guarigione sono del 99%. Ed inoltre si bloccherà in questo modo la possibilità dell’effetto domino a carico dei dischi superiori.

O Termo de Ajustamento de Conduta (TAC) também conhecido como Compromisso de Ajustamento de Conduta, tem sua origem nos termos do artigo 5º, § 6º da Lei nº 8.078, de 11 de setembro de 1990, acrescentada à Lei nº 7.347, de 24 de julho de 1985, onde “disciplina a ação civil pública de responsabilidade por danos causados ao meio-ambiente, ao consumidor, a bens e direitos de valor artístico, estético, histórico, turístico e paisagístico.”

Diz a Lei supracitada:
“Art. 5º: Têm legitimidade para propor a ação principal e a ação cautelar:
(…)
§ 6° Os órgãos públicos legitimados poderão tomar dos interessados compromisso de ajustamento de sua conduta às exigências legais, mediante cominações, que terá eficácia de título executivo extrajudicial.”

Desta forma, este dispositivo tem proporcionado a resolução negociada de contendas no âmbito extrajudicial (em alguns casos, o TAC pode tornar-se um título executivo judicial), ou seja, nos autos de inquérito civil ou procedimento preparatório, os quais visam investigar possível lesão ou perigo de lesão aos interesses da coletividade.

O TAC pode ter caráter preventivo, sustatório (fazer cessar) ou punitivo (indenizações). As áreas do Direito que tradicionalmente mais fazem uso deste recurso são as relacionadas ao meio ambiente, ao consumidor e à ordem urbanística (ex.: som alto demais).

O descumprimento do TAC pode ocasionar em multa, que deve ser imposta em um valor tal que vise somente convencer o compromissário de que vale mais a pena cumprir a obrigação do que pagar a multa.
Se o compromissário considerar o valor alto demais, este poderá acionar a Justiça, e caso o Juiz de Direito julgue procedente o excesso, poderá reduzir o valor da cominação (multa).
No sentido oposto, o valor cominatório também não pode ser proporcionalmente pequeno, sob risco de  torná-lo ineficaz.

Para ilustrar este assunto, citaremos três exemplos distintos em que o uso do TAC foi utilizado pelo Ministério Público, a fim de fazer valer a aplicação da Lei, por meio de saída negociada em audiência entre as partes.
Tais exemplos referem-se às mais recentes ações da 14ª Promotoria de Justiça, que possui atribuição para a área do Meio Ambiente.

1º caso: ocupação irregular de Área de Preservação Permanente

Procedimento Preparatório n°. 010/2005: TAC celebrado entre o Ministério Público Estadual, H.J.S. e Fundação do Meio Ambiente (FATMA), em 05 de junho de 2009, a fim de regularizar a situação ambiental da implantação de um loteamento residencial em imóvel localizado na  Rua Bernardo Rech, s/nº, bairro Jarivatuba, nesta cidade, de propriedade do compromissário (o Sr. H.J.S.) O compromissário se comprometeu a ingressar no prazo de 30 (trinta) dias com devida ação judicial de reintegração de posse para que as edificações e outras ocupações existentes sobre a APP (Área de Preservação Permanente) e a área institucional doada ao Município sejam retiradas; comprometeu-se ainda, a realizar plano de recomposição florestal da área do curso d´água e da área verde, bem como o cercamento de identificação da área de preservação permanente e da área verde. Por derradeiro, assumiu a obrigação de não mais se utilizar da área de preservação permanente, nem permitir a ocupação da área institucional e área verde doadas ao Município de Joinville. A FATMA ficou encarregada de fiscalizar o cumprimento das obrigações assumidas pelo compromissário.

Resumo – O Sr. H.J.S. comprometeu-se:

• A ajuizar a reintegração de posse ao Município;
• A realizar plano de recomposição florestal da área citada, bem como o cercamento de identificação da mesma;
• A assumir a obrigação de não mais se utilizar da área de preservação permanente, nem permitir sua ocupação.

2º caso: isolamento acústico inexistente e sistema de prevenção de incêndio idem

Ação Civil Pública nº 038.05.024238-2: TAC celebrado entre o Ministério Público Estadual e o estabelecimento “S.F.de J.”, em audiência  realizada em 15 de setembro de 2009. O estabelecimento compromissário (o estabelecimento “S.F.de J.”) assumiu a obrigação de implementar, dentro de 30 dias, medidas tendentes a melhorar o isolamento acústico do estabelecimento, de modo a atender os níveis de decibéis estabelecidos na última Resolução CONDEMA 05/2007, e de apresentar, ao final dos trabalhos, relatório atestando a eficiência do sistema e sua adequação aos níveis estabelecimentos na referida Resolução. De outro lado, em razão do risco a que expôs seus frequentadores durante os mais de 62 anos de funcionamento sem possuir o sistema de prevenção de incêndio, e da perturbação que gerou aos moradores do entorno devido à falta de isolamento acústico, o compromissário comprometeu-se a efetuar o pagamento do valor de 20 salários mínimos vigentes em quinze vezes fixas de igual valor, em favor do Fundo para Reconstituição de Bens Lesados do Estado de Santa Catarina, a título de reparação dos danos extrapatrimoniais coletivos provocados.

Resumo – O estabelecimento “S.F.de J.” comprometeu-se:

• A melhorar o isolamento acústico e apresentar relatório atestando a eficiência do sistema;
• A pagar o valor de 20 salários mínimos pela falta de um sistema anti-incêndio e pelos transtornos aos vizinhos nesses 62 anos.

3º caso: restauração de imóvel com valor cultural e histórico apontado pela Fundação Cultural de Joinville

Ação Civil Pública nº 038.05.062945-7: TAC celebrado entre o Ministério Público Estadual, R.V.Z. e J. C.T.F. (compromissários nº 2), Município de Joinville, Fundação Cultural de Joinville e C.C.E.I. Ltda (compromissária nº 5). Ficou ajustado no acordo o comprometimento da compromissária número 5 de obstar a degradação do imóvel da Rua Procópio Gomes, nº X, promovendo a supervisão do Município e da Fundação Cultural de Joinville, obras emergenciais de reparo do prédio, que deverão ser iniciadas imediatamente após a liberação do alvará pela Seinfra, sob pena de multa diária de R$ 2.000,00, e concluídas no prazo de 60 dias, também sob pena de multa diária de R$ 2.000,00. O compromissário número 2, por sua vez, comprometeu-se a não efetuar qualquer óbice nas reformas, sob pena de multa no valor de R$ 2.000,00. Além disso, os compromissários números 2 e 5 comprometeram-se a facultar o ingresso da Fundação Cultural de Joinville a qualquer tempo no edifício para realização de estudos de recuperação e acompanhamento da obra. Já a Fundação Cultural de Joinville e o Município de Joinville comprometeram-se a  acompanhar o cumprimento da obrigação prevista nas cláusulas anteriores e apresentar relatório da situação ao final do prazo estabelecido. A compromissária número 5 comprometeu-se a solicitar à Fundação Cultural de Joinville,  no prazo de 30 dias após a conclusão das obras emergenciais, a aprovação do projeto final de ocupação e restauração final do imóvel, sob pena de multa de R$ 2.000,00. Posteriormente, o Município de Joinville e a Fundação Cultural de Joinville comprometeram-se a apresentar um laudo atualizado descrevendo as diretrizes a serem seguidas no projeto de restauração da casa. Por derradeiro,  a compromissária número 5 assumiu a obrigação de restaurar o imóvel da Rua Procópio Gomes, concluindo as obras no prazo de três anos, após  aprovado o projeto junto à Fundação Cultural de Joinville e obtidas todas as autorizações e licenças pertinentes às obras, sob pena de multa diária no valor de R$ 2.000,00.

Resumo – Os referidos compromissários comprometeram-se:

• A conter a degradação do imóvel da Rua Procópio Gomes, nº X;
• A não criar empecilho para a realização das reformas;
• A permitir a entrada da Fundação Cultural de Joinville no edifício para acompanhamento da obra;
• A solicitar à Fundação Cultural de Joinville, após a conclusão das obras, a aprovação do projeto final de restauração do imóvel;
• A concluir as obras de restauração no prazo de três anos, após aprovação do projeto junto à Fundação Cultural de Joinville.

Estes poucos exemplos sobre atividades diversas são uma amostra do quão abrangente pode ser o emprego do TAC e o quanto o cumprimento desses acordos pode trazer benefícios para as partes.
O compromissário evita todos os inconvenientes dos trâmites da instauração de um Processo formal, e a sociedade obtém uma resposta rápida às suas reivindicações.

Greeting:

The great Orthodox theologian John Meyendorff has been quoted as remarking that genuine Christian unity would require humility on the part of many, and charity on the part of all. I suggest that to those two paramount Christian virtues we must add the more workaday quality of patience. It took 450 years to raise all the questions posed by the possibility of real and corporate unity between Roman Catholics and Anglicans. We will not have all the answers in 450 minutes.

Yet with the publication of Pope Benedict XVI’s Apostolic Constitution, Anglicanorum coetibus we do now have the possibility of addressing those issues directly and in cooperation with each other. As most everyone knows by now, the Bishops of the Traditional Anglican Communion, meeting in October of 2007 in Portsmouth, England, addressed a petition to the Holy See seeking to explore what would need to be done to achieve full, visible unity while maintaining the best characteristics of our beloved Anglican heritage. The Apostolic Constitution is meant to provide an approach to just that question. It is an extremely generous and pastoral document. Indeed, it explicitly address the desirability of preserving our Anglica “…spiritual and liturgical patrimony …” intact and undamaged after the ravages of such as Jenkings, Spong, Robinson and Schori.

An initial set of Complementary Norms has been issued by the Confraternity for the Doctrine of the Faith, which we be discussed in detail by representatives of that body and of the TAC College of Bishops within the near future. We are now asking members of the ACA (and other TAC provinces) to study the Norms and then pose such question as may occur. (Some already have, such as: Question: Will we be able to continue to have married priests indefinitely? Answer: Yes. Question: Will those of us who were formerly Roman Catholics be excluded from the Anglican Ordinariates? Answer No. Question: Will we loose control over our Church finances and property? Answer: No) There will be more. These can be sent to your own Bishop, and he will see that they get to the appropriate TAC representatives. Your concerns, as well as your thoughts and prayers, are an essential element and a vital part of this process.

Bishop Langberg has remarked that library shelves around the world are packed with books and papers on the topic of ‘ecumenism.’ Up to now it’s all been theory; but with respect to the world’s largest Communion of Christians, there has been no “test case” or anything like it, trying to work out “how it will work” on the ground. That opportunity has now been presented to us. In view of our Lord’s prayer (John 17) that all his followers might be one, the fact places upon us, and upon our Roman Catholic counterparts, a very great responsibility along with the opportunity. The real-world answer to that practical question will be worked out in real life and in real time as we move forward.

This will require genuine good faith on all sides. That we come in good faith can be seen from the “Portsmouth Letter.” That our Roman Catholic counterparts come likewise can be seen from Pope Benedict’s unprecedented offer of a parallel structure for Anglican Catholics, a “House of our own” (as it were) within the “compound of Catholicity.” Ecclesiastical life within the colony will evolve over time as adjustments are made. We trust each other enough to begin our ecclesiastical journey together in the ACA with an original canonical structure based on what we had know in the past. We have adjusted that structure more than once as circumstances has show the wisdom of doing so. Christians of good will can and must continue that process together in unity as Jesus commanded us to do. He promised us the guidance of the Holy Spirit, and his promise remains true.

Cape Town – President Jacob Zuma’s speech on Aids in Parliament this week marked the demise of state-supported denialism, the Treatment Action Campaign (TAC) said on Friday.

His address had been “one of the most important speeches in the history of Aids in South Africa”, the organisation said in a statement.

“With this speech state-supported Aids denialism has been banished.” it said.

“TAC welcomes the ushering in of this new era, almost exactly ten years since former president Thabo Mbeki made a speech that began the era of state-supported denial.”

Both speeches had been made in the National Council of Provinces.

Renewed Commitment

Zuma’s speech had provided hope that he would show renewed commitment to meet the targets of the national strategic Aids plan.

TAC said it was unsure if the R900m allocated to the department of health for AIDS in this week’s Medium Term Budget Policy Statement was enough.

However it was more than what was previously given to the department and closer to the actual amount requested.

A further R240m would be provided by the United States President’s Emergency Fund for Aids Relief, so the shortfall would be relatively small.

But with the renewed political leadership demonstrated by Zuma and the leadership of the Minister of Health Aaron Motsoaledi, the strategic plan targets were achievable.

Zuma told MPs on Thursday that despite the comprehensive strategy to tackle HIV and Aids, acknowledged internationally, and the largest antiretroviral programme in the world, “we are not yet winning this battle”.

“If we are to stop the progress of this disease through our society, we will need to pursue extraordinary measures.” he said.

O Tribunal Regional do Trabalho (TRT) da 15ª Região reformou decisão de primeira instância, proferida pela 4ª Vara do Trabalho de Bauru, e determinou a condenação da empresa Baterias Ajax, além dos sócios da empresa, Nasser Ibrahim Farache e Treplan Construtora, ao pagamento de R$ 200 mil a título de dano ambiental coletivo, por ter exposto trabalhadores à contaminação por chumbo.

Em 2006, o procurador José Fernando Ruiz Maturana, do Ministério Público do Trabalho (MPT) em Bauru, expôs em ação civil pública (ACP) as reiteradas irregularidades cometidas pela empresa no que diz respeito ao meio ambiente de trabalho dos empregados da planta fabril conhecida por “setor metalúrgico ou de fundição”.

O procurador apresentou Recurso Ordinário, que foi julgado parcialmente procedente pelo TRT em 2008, no acórdão proferido pela relatora Rita de Cássia Penkal Bernardino de Souza, o qual estabeleceu a condenação no valor de R$ 200 mil, a ser revertida para o FAT (Fundo de Amparo ao Trabalhador), que fica mantida até o julgamento da última fase recursal.

Ainda, segundo o acórdão, “desde 1997 a fiscalização do Ministério do Trabalho tem encontrado irregularidades no controle da contaminação do chumbo e no cumprimento de medidas de proteção à prevenção de riscos no ambiente do trabalho”.

HISTÓRICO – Nos últimos anos, uma série de irregularidades envolvendo a empresa, grande parte decorrentes do descumprimento de normas de saúde e segurança do trabalho, culminaram com danos à saúde dos trabalhadores – como casos de saturnismo – superexpostos ao chumbo no ambiente de trabalho, acima dos limites permitidos pela NR 15, em fiscalização realizada em 2000, tornando assim o caso de graves proporções, tendo repercussão nacional e internacional.

Após continuar apresentando irregularidades, mesmo com a firmação de um termo de ajustamento de conduta (TAC), em 2001, a empresa foi penalizada com a interdição temporária do setor metalúrgico, em procedimento oriundo da CETESB. Nova diligência foi realizada em março de 2002, na qual uma série de irregularidades foi novamente constatada, como falta de sinalização de segurança, irregularidades nas edificações, entre outras.

Após firmar novo TAC, ainda em 2002, foi noticiado que o “setor metalúrgico” não poderia voltar a operar no local. Então foi constatado que o termo não seria cumprido. Sendo assim, para não ocorrer a impunidade das omissões e irregularidades que causavam a degradação do ambiente de trabalho, coube ao MPT ajuizar a ACP.

In the 60’s and 70’s, the beginning of the Radical Dissident Catholic Era, many priests were laicized and got married. In fact, many of them married former nuns. While I have only personally been acquainted (that I know of) with one laicized priest, he wasn’t someone who should’ve been ordained. He had the same sort of wardrobe malfunction that Ted Kennedy had. I believe it was intended as a way out. In his case it was successful.

Now that the personal ordinariate for Anglicans has been announced, The Washington Post thinks that celibacy for Roman Catholic Priests is on its way out. What impressed me about the article is that they do point out that Eastern Catholics ordain married men but that priests aren’t married; most people assume that priests may marry after ordination. Eastern Catholic Churches in the US typically ordain only celibate men. Eastern Catholic Bishops are always celibate as are Orthodox Bishops.

I disagree with the Washington Post; Anglicans have made many changes since the church of England was formed, including allowing priests to be married before or after ordination. Eastern Catholics, formerly Orthodox, were brought into Communion with Rome while retaining their traditions, traditions that had existed at the time of the Great Schism, including the Ordination of married men. The difference here is that a married priesthood in the Latin Rite Catholic Church did not exist at the time the Anglicans left and while married men in the Eastern Catholic Churches and the Orthodox Church may be Ordained, priests may not marry after ordination. While it’s certainly possible that the Church would decide to allow married men to be Ordained within the Anglican Personal Ordinariate, I would be very surprised if she would allow priests to get married or allow a married Priesthood in the Latin Rite.

That this Assembly, representing the Traditional Anglican Communion in Great Britain, offers its joyful thanks to Pope Benedict XVI for his forthcoming Apostolic Constitution allowing the corporate reunion of Anglicans with the Holy See, and requests the Primate and College of Bishops of the Traditional Anglican Communion to take the steps necessary to implement this Constitution.

That this Assembly is of the respectful opinion that Bishop Robert Mercer CR might be considered for the position of Ordinary in Great Britain.

I know Bishop Mercer personally and believe that he makes a wonderful candidate for this position.

The news was so overwhelming, I paused work for several hours to drink it in. On Oct. 20, Cardinal William Joseph Levada, prefect of the Vatican’s Congregation for the Doctrine of the Faith and speaking on behalf of Pope Benedict XVI, announced creation of a new “Apostolic Constitution-” a canonical structure establishing “Personal Ordinariates” allowing former Anglicans to enter full communion with the Catholic Church, while preserving distinctive elements of Anglican spiritual and liturgical patrimony. Pastoral oversight will be provided through Personal Ordinariates, whose Ordinaries will usually be appointed from among former Anglican clergy.

Some backstory; this writer is an Anglican Catholic by persuasion, formerly evangelical protestant, now a member of the Traditional Anglican Communion (TAC), a jurisdiction formed to continue historic Anglican expression of the Catholic faith, numbering more than 400,000 members worldwide, most of whom left the established Anglican communion led by the Archbishop of Canterbury in protest over female ordination to the priesthood and episcopacy, novel liturgical innovations, and departure from common biblical teaching on human sexuality – particularly on abortion, ordination of openly homosexual clergy, and blessing of homosexual partnerships. There are a number of other, smaller continuing Anglican groups that are expected to respond positively to the Pope’s invitation.

Restored communion with Rome has been an objective for many (although certainly not all) TAC-ers. In October, 2007, 38 TAC bishops convened in England to compose a formal proposal for reunion to be hand-delivered to the CDC, concurrently signing a copy of the Catechism of the Catholic Church to signify full acceptance of Catholic doctrine.

Although downplayed by the Vatican, it’s assumed the new Apostolic Constitution is the CDC’s response to TAC overtures. After decades of apparently fruitless “ecumenical dialogue” with Canterbury Anglicans, the Pope evidently decided to move pro-actively, offering refuge to Anglicans adherent to the tenets of classical, biblical Christianity.

Describing the development as “a moment of grace, perhaps even a moment of history,” TAC Primate Archbishop John Hepworth said he was “profoundly moved” by the Pope’s decision and will immediately seek approval of TAC members worldwide to join…

It’s not quite a done deal. While the 2007 TAC proposal to the CDC affirmed common Catholic faith as defined by the Catechism and accepted the primacy of the See of Peter as Christ’s will for the Church, the forthcoming Apostolic Constitution will stipulate that historical and ecumenical reasons (notably hoped-for restored communion with the Eastern Orthodox) preclude ordination of married men as bishops. Seminarians in the Ordinariate, whose clergy will be integrated into the Catholic Church, will be prepared alongside other Catholics. Presumably, TAC priests and bishops will have to be preordained, married bishops facing demotion. Some TAC-ers are opposed.
