The Internet is full of thieves, from Pirates to Plagiarists.  For example, in this episode of the Simpsons, Homer steals copyrighted material from all over the internet.  [Interestingly, this video probably infringes on copyrights held by Fox].

So, how can you, as a contributor to the online marketplace of ideas, protect what you’ve written from this type of thievery?

The law provides that all original tangible works are inherently copyrighted.  You don’t even need to include the © symbol anymore.  Also, the Creative Commons provides an easy way to license your content.  That’s the good news. 

You own your original content.  Fair and square.  If someone is pilfering from your work for their own uses, you have some recourse. 

First, you can contact them directly.  This is intimidating, and might not yield results without a formal demand letter.    You can be as informal as you like in this step, leaving a comment on their blog, for example.  In any case, you should be polite, explain that they have used your content without your permission, and ask them to remove it.  If the user doesn’t respond, take more action. 

Second, you can contact the website owner, registrar or hosting service.  You can find information on the owner of a website by doing a whois search.  Hosting services like GoDaddy and Google, even YouTube, have adopted policies on copyright infringement.  These policies essentially allow for easier enforcement of the Digital Millennium Copyright Act, legislation which basically expanded copyright law to accommodate for new technologies.

This type of contact [example] should be at least somewhat formal, signed, and include exactly what the policy requests.  If done correctly, these letters do yield results [the site the example complained of, presumably has been removed by Google].  Google will also remove search results that use your content to compete for prominence in results, but that process is more complicated.

You should know, however, that making this kind of complaint with some companies, like Google, will land your complaint on ChillingEffects.org, a site which “aims to support lawful online activity against the chill of unwarranted legal threats.”  They’ll take your personal information off, but the substance of the complaint will remain.  So be sure, before you send a complaint, that you own the copyright, and there use is unlawful.  There are several ways an infringer can be absolved, through a claim of fair use, but I will not address those in this post.

Unfortunately, while the law provides many safeguards, and many major companies will help you along the way, if you truly believe your content has been stolen, you may need a lawyer to handle the complexities for you. 

If you send all the requests you can muster, and the material remains posted, and you can handle the expenses, you might consider proceeding with legal action.  Lawyers are expensive, so you should be sure that you have exhausted all other options, and consider that the cost of allowing the plagiarism might be lower than the cost of enforcing the copyright.  You should also take any steps you can required for litigation, such as registration with the Copyright Office, before contracting a lawyer to do them for you at a much higher rate.

So, I went to check up on my video from my 1st vlog on YouTube (I’d posted it on three different sites), and to my surprise it was “removed due to terms of use violation”.

What, YouTube? What did I do wrong?

So, I rush to the login page, type in my username and password, and here we go:

This account has been permanently disabled.

What? *Refresh* WHAT?!

I have no idea why this has happened.

I’ve e-mailed YouTube and they responded with a seemingly sincere human-toned robot:

Thanks for your email. Your “JawaadAhmadKhan” account has been found to
have violated our Community Guidelines. Your account has now been
terminated. Please be aware that you are prohibited from accessing,
possessing or creating any other YouTube accounts.

Then, as I read, in my head I screamed “But WHY!!!!???? WHAT DID I DO!!”

I continued reading:

We are unable to provide specific detail regarding your account suspension
or your video’s removal. For more information on our what we consider
inappropriate content or conduct while using YouTube, please visit…

I responded genuinely asking what was wrong with my video that it caused my account to be suspended. I’ve had trouble with YouTube before (two of my videos were flagged for copyright, but I communicated, deleted and/or fixed both), but this one is just horrible.

(And it happened the day after I decided to regularly produce content, especially for my YouTube channel!).

Well, I digress. Allah’s testing my commitment to this new project. Alhamdulillah.

Honestly, I began growing weary of YouTube, (the amount of un-beneficial and stupid videos is rapidly growing), and I’m liking Vimeo and Blip.tv better for video hosting (they’re more geared toward serious filmmakers and show producers).

Bogus copyright claims analysed

London-UK, Sunday 20 December 2009: Almost all video web sites, including Google YouTube, and almost all legitimate copyright owners benefit from free promotions, whenever copyright is cited, to increase their web site traffic. Copyright fair use (reviews, comment, rate, vote, news report) also drive site visitors.

However, dealing with fake, bogus, dubious and fraudulent Google YouTube copyright claimants has become a full time job for several people, costing serious time and money only to discover the covert claimants breach privacy. Bogus claimants have no plausible legal case to verify their copyright ownership. They fail to prove their claims with irrefutable evidence beyond any reasonable doubt, adding insult to “you remain guilty until proven innocent” injury.

Some claimants are tied to snoopy intelligence agencies. Some are tied to covert credit ratings agencies. Some claimants are merely jealous. Most of them are phishing for personal information, breaching privacy without disclosing their own traceable and verifiable details. All video websites, including Google YouTube and covert copyright claimants, also breach statutory rights, freedom of expression, and stifle free market competition. They aid, protect and defend the criminals around the world. Their bans sacrifice human rights for their corporate financial interests, knowingly participating in fraudulent criminal scams and thus becoming an active party to any legal action that may ensue. They risk getting sued for punitive damages. When, if ever, identified, the criminal fraudsters and parasites will be named, shamed and SUED, big time.

Takedown spammers or fake claimants file copyright on hundreds of videos based on the title, keywords and description of videos that they google, yahoo or bing. All video web sites actively help and enable fake or politically motivated copyright claimants, Internet stalkers, child-abusers and cyber-criminals to abuse their subscribers or users, including females, under-age and vulnerable old. The unsuspecting subscribers and users are forced to waste considerable and needless time and money to defend the fraudulent claims; make the sites lift blanket bans; restore and reactivate suspended accounts. The wasted time and money only adds injury to “you remain guilty until proven innocent”.

All video web sites, subscribers and users must remember that filing a fraudulent copyright claim is a crime, but laws don’t deter criminals. All video web sites must be required to report fraudulent copyright infringement notices so their subscribers or users remain protected from disclosing their personal information to the criminals.

Unfortunately, the 1998 Digital Millennium Copyright Act (DMCA) allows a content owner to issue a subpoena for the identity of an alleged infringer without first filing an actual lawsuit. Back in 2007, a 15 year old from Perth, Australia, sent a signed form to YouTube pretending to be from the Australian Broadcasting Co. The form ordered the takedown of hundreds of ABC video clips. Google YouTube terminated hundreds of subscribers without investigating the bogus copyright claim. Such repeated failures remain unacceptable. Even today many people order Google YouTube to takedown videos without any consequences for the fraudulent copyright claimants, their active accessories, financial beneficiaries or partners in the crimes.

Clearly, there a need to amend the flawed copyright (DMCA USA, and Digital Economy Bill, UK) laws in order to criminalise fake or fraudulent copyright claimants for the deception and the damages they cause; make all video web sites reassess their terms of service and policies that impose blanket bans, help claimants breach privacy, strangle freedom of speech and stifle free market competition, and enable video web site subscribers or users to sue false claimants for tangible, meaningful and punitive damages. The criminals must be prosecuted, named, shamed, jailed and fined. It is time for “criminal penalties for ‘copyfraud’ and non payment of artists, and writers. Lets also throw in open accounting standards for copyright holders,” according to Hephaestus on techdirt.

Why there are no severe legal consequences for Google YouTube and the unknown third parties or claimants for filing a fraudulent DMCA notice?

S P Syed, http://www.youtube.com/spsyed, for example, is set to seek punitive compensation for (defamation, libel, tort) damaging his reputation repeatedly to deter the fraudsters and the criminals. Spsyed invested more than £200,000 (US $330,000) in diligent research portfolio for more than 400 video clips on Google YouTube. His research takes many weeks or even months to put together. His researched clips made him popular, ranking in top-100 on 17 July 2009 Google charts before Google imposed a blanket ban on the undisputed 400 clips for five months to Monday 14 December 2009.

Google YouTube also violated his right to free speech, enshrined in the US’ First Amendment. The move would cost Google YouTube and the bogus claimants tens of millions of dollars in the courts, including the US Federal District Courts and libel rulings in British courts. That would cause intense investor unease on top stock markets around the world.

Google YouTube blanket bans are really about shutting up critics who have exposed serious human rights violations and abuses against minorities in countries like India. No American court would have entertained such overt censorships and blatant blanket bans.

Google YouTube’s audio-visual copyright “content ID” fingerprint enables fraudulent copycat criminals to obtain uncontested copyright ownership over someone else’s video clips and advertising revenue they generate as the ad revenues are split between the claimants and Google YouTube. It seems the fingerprint “asset” software has turned into a liability for Google for the financial benefit of the parties and partners. That is a large revenue stream for the bogus claimants as well as Google YouTube.

The bogus copyright claimants remain untraceable and unknown. They don’t exist! So, one can’t prosecute and sue them for their crimes, fraud or even perjury. The criminals are defended and protected by Google YouTube, and they demand removal of the material that they deem damaging to India’s fake “democratic, secular” public relations image at home and abroad. Google fails to investigate the bogus claims and complies with the disguised gag orders, citing the US DMCA laws.

Moreover, all video web sites, including Google give the accuser the benefit of the doubt without having to provide a shred of irrefutable evidence that the accuser legally holds the copyright. All video web sites’ “terms of service” and DMCA puts way too much power in the hands of the criminals around the world. Google and the accuser force the accused to provide personal information to the accuser, while the accused find out nothing about the accuser other than untraceable “business” name without postal address, telephone/fax numbers, website and email address. What have they got to hide?

Bogus copyright criminals also abuse DMCA notice as “phishing” technique on adults, under-age, females and pensioners. In addition to getting personal details, the criminals file three or more false claims without any irrefutable evidence, and immediately get Google to impose blanket ban, have any account suspended or terminated. The claimants do not have to prove legal copyright ownership. How, why is that even legitimate, and fair?

Moreover, the criminals are also using this as a means to spread viruses, panic people into opening attachments they should never open from anyone they don’t know and trust.

The unilateral Google YouTube blanket bans have become an absolute scandal. The most sinister thing of all is that – by definition – people don’t know what it is they aren’t being allowed to know by the global brands, and the protected criminals.

There is an obvious automated step that Google YouTube must be forced legally to take to stop these bogus claims immediately. All persons/companies wishing to file copyright infringement claims should be required to register, and have their addresses and copyrights, trademarks and patents verified. Google Ads has a system whereby a PIN number is sent to the registrant’s address for verification. This would certainly make individuals and companies, including all video websites, think twice before filing false claims, because they become vulnerable to legal actions and to serve any DMCA counter-notifications and other legal papers. Until then it remains too easy for criminals to get Google YouTube, Yahoo, and Bing content taken down.

The fullest examination is vital of those raising copyright and ad money fraudulently. It is time to examine the flow of money towards extremist (such as Indian or Hindu organisations) and terrorism who preach the ideology of hate against Indian minorities, such as Christians, Sikhs, Buddhists and Muslims.

Spsyed, for example, gave more than adequate time to Google YouTube to help them avoid the issue going before to the judges but Google ignored his repeated pleas to route out the bogus copyright claimants. Google YouTube failed to stop the cyber criminals who try or get a free ride on the back of someone else’s intellectual property, copyrights, trademarks and patents.

There are global financial and political interests and connections that are obviously of great interest to investigative journalists and others who demand accurate and rigorous investigation and reporting. That is in public interest.

There are costly and time consuming legal procedures to help deter unknown, unidentified, untraceable, fraudulent, fake and dubious copyright claimants. The claimants also use the web sites to impose blanket ban, strangle free speech, and stifle free market competition.

Google YouTube and its subscribers or users should contact the author when they are ready to probe the fraudulent, bogus, fake copyright criminals, and nullify or quash their dubious claims.

I am engaged in a contradiction.

I want to converse about poetry, either my work or someone else’s. But no one I know wants to have the same conversation.

I could take my conversation elsewhere and discuss it with people I do not know. But this has a major obstacle: time. I need to spend time away from the people I already know in order to have this conversation. To me, this action too closely resembles abandonment, and to remain consistent with my principles I do not want to consider this as an option.

So the convenience of the blogosphere prevailed, and earlier in 2009 I attempted to start conversations online with complete strangers.  I occasionally reviewed the content under WordPress.com’s poetry tag and commented on any I liked.

Perhaps I have just confessed to spamming or sending unsolicited communications. But commenting on a poem I sincerely enjoy, and that is enabled to receive such communication is (hopefully) distinct from spam.

This practice has been successful to a certain extent. I have communicated and received some communication in return. But the topics of correspondence has been limited. I reflected on why I was disappointed and came to the conclusion that I had envisioned the dialog would be more vigorous.

Such discussions throughout history have cultivated great artists of all sorts who used a variety of mediums. My own work was greatly improved after I took a college course in writing poetry that essentially taught poets how to accept and deliver criticism.

Improving my work from new discussions is only one motivation for seeking them.  Another goal of mine, which will probably perceived as less pure, is to sell copies of my work.  I believe the two are complimentary goals, and not contradictory or competitive.

Selling is an action that is a natural extension from dialog. A sale, like a dialog, is an exchange. Dialog exchanges idea for idea, while a sale exchanges a resource for a resource (the two resources typically involved are a products and a quantity of currency).

In this pursuit I equipped myself with the necessary resources to extend a sale from a dialog.  In other words, I have the ability to produce a modest publication of my work and the legal standing with the appropriate taxing authorities to do sell it.

But I am in no hurry to sell, for a variety of reasons.

(Digression: One of the reasons is that I am hosting the blog on WordPress.com. WordPress.com’s terms of service appear to discourage writers from believing that their work can be a profitable venture. My disagreement with this will inevitably be resolved when I migrate the blog from WordPress.com, but that will not be for another year, possibly longer.)

So I am contemplating an experiment: If I offer my product for free will the offer generate more discussion?

I am going to reflect on this question, and take in to account any comments this post may receive.

7. Keterangan singkat para terdakwa & hubungannya dg Letkol Bobby Meidianto & kesalahan mereka [sebenarnya termuat di facebook.com/mask.rider1 bila belum terhapus setelah mereka hack]. Kami tuliskan beberapa dulu :

• Presiden H. SBY: Adalah termasuk keluarga besar Aroeng Binang I , sama seperti Letkol Bobby Meidianto. Kenal di tahun 2000, di Makam Aroeng Binang  di Kebumen. Saat itu memberikan kartu nama palsu dg tulisan Departemen Pertanahan. Namun nomor telepon {Hape} asli. Letkol Bobby sudah berulangkali memberikan info melalui e-mail addressnya langsung juga sms ke Nomor Hapenya. Persaudaraan & kekerabatannya di putus th. 2008 lalu setelah Letkol Bobby kecewa soal Meutya Hafid. Diketahui menyerang Letkol Bobby berulangkali dg ilmu gaib, & juga tidur menginap di rumah Meutya Hafid adi bulan Januari 2008 lalu itu saat Letkol Bobby di usir dari Rumah Meutya Hafid. Termasuk orang yg tercantum dlm foto ADEGAN SEX MEUTYA HAFID. Letkol Bobby Memutus Hubungan kekerabatan After Februari 2008.
• Hj. Any Yudhoyono: Ini adalah profile seorang wanita Lonte, begitu banyak juga info mengenai ia jadi perempuan murahan demi karir suaminya.  Di tengarai ialah yg juga mengetahui & menerima sebagian faxs & e-mail dari Kopral Indonesia & Letkol. Bobby Meidianto.
• Aulia Pohan : Tahu2 begitu mengetahui Letkol Bobby Mau melamar Meutya Hafid, lantas memberikan ancaman agar Letkol Bobby mundur dg tuduhan akan membuat MAKAR. Apa urusannya ?
• Surya Paloh: Ia juga demikian di bulan Januari 2008 itu, malah mengatakan akan mengkaryakan Meutya Hafid untuk hal2 negatif demi karir politiknya & malah Januari 2009 mentertawakan Letkol Bobby setelah Letkol Bobby batal meledakkan Nuklir Serpong, padahal ia belum tahu saat itu bukan Nuklir Serpong yg di ledakkan namun Depo Pertamina di Jakpus & Bekasi. Ia gunakan juga paranormal untuk melakukan kontak batin kpd Letkol Bobby.  Tahun 1996 termasuk dlm arsip BIN sebagai orang yg seharusnya DIBUNUH oleh DEN HARIN sehubungan dg GPK ACEH.  Dan di ketahui memiliki hubungan Selingkuh dg beberapa istri Pejabat DPR MPR RI & Kementrian th. 1994-1998 & 2000-2006.

Wiranto : Sama sepeti SBY soal hubungan kekerabatan dg Letkol Bobby, dan sebenarnya Letkol Boby bermaksud mengundangnya pula ke Pernikahan  Letkol Bobby  dg Meutya Hafid, namun koq rupanya akan ia “makan sendiri” Meutya Hafid yg lalu sudah menikah Siri dg Letkol Bobby dengan alasan untuk Putranya.
• Hj. Uga Wiranto: Wanita lonte yg sudah terkenal di kalangan TNI sebagai lonte yg suka menyodorkan dirinya kpd atasan2 Wiranto demi karir suaminya. Ia inginkan Letkol Bobby mundur & batal jadi suami Meutya Hafid & akan ia calonkan Meuya Hafid dg Putranya, namun ga tahu kalau Suaminya Lonte laki yg sarap juga doyan makan pagar ayu & mau juga makan istri saudaranya.
• H.Agus Harimurti: Belagak sakti pakai ilmu kontak batin pas lagi jimak dg Annisah Pohan, mengambil Sukma Letkol Bobby. Yg lagi main sex dia apa Letkol Bobby Meidianto? & Anaknya itu AHIMSA , anak nya dia apa anaknya Letkol Bobby? Juga menteror dg kirim foto2 dia lagi main sex dg Annisah Pohan. Pernah dimaki-maki Letkol Bobby di Pasar Kembang Solo th.2005-2006 karena kurang ajar kpd Letkol Bobby.
• Agus Isrok Mikroj: Sang Kapten Inf. Pen gedar Narkoba anak Subagyo HS, yg pernah atau memang masih jadi pacar Meutya Hafid.  Baru di ketahui Letkol Bobby, Januari 2008 sebelum Letkol Bobby Ke Jakarta.
• Edhie Baskoro: Juga pamer ilmu gaib / kontak batin berulangkali & punya banyak dukun yg ia suruh mengganggu Letkol Bobby, belum lagi nyuruhin orang2 untuk menteror Letkol Bobby.
• H. Budianto: Adalah Kameramen Metro TV yg juga ikut di sandera di Irak 2005 lalu. Memukul Letkol Bobby dg ilmu gaib Desember 2007 sebelum Letkol Bobby ke Jakarta Januari 2008. Air SUSU di balas dg air Tuba.
• Budi Putra: Presidential Staff & juga Blogger. Tidak di kenal oleh Letkol Bobby. Tapi juga lancarkan teror serupa dg ilmu kebatinan & fitnahin Letkol Bobby di hadapan orang lain.
• Wimar Witoelar: Pimpinan ANTV, juga manatan jubir GusDur, & mungkin sekarang masih jadi jubir untuk SBY. Bersama Situmorang Berulangkali menghacking situs2 milik Letkol Bobby & Kopral Indonesia, & mendustai Meutya Hafid soal Letkol Bobby. Di sinyalir kuat dialah yg mensortir sebagian surat2 dari Kopral Indonesia & Letkol Bobby kpd Presiden RI GusDur & SBY di saat lalu.
• Subagyo HS: Mantan KSAD, Koruptor yg KEBAL HUKUM sekarang mendukung Hanura, tidak di kenal Letkol Bobby, namun juga menteror dg berbagai cara. Beberapa orang yg bentrok secara fisik vs Letkol Bobby di SOLO, adalah kawan2 anaknya & suruhannya.
• Hendro Priyono: Mantan Kepala BIN, Anjingnya Megawati & Taufik Kiemas, mata keranjang, Dikenal etkol. Bobby Meidianto, hingga ketika Letkol Bobby ingat soal Hendro Priyono, ia tanda tanya apakah Avian Tumengkol ada hubungan keluarga dg Hendro Priyono. Sekarang mendukung Hanura. Taktik & strateginya tak bisa di remehkan terbukti kesuksesannya menggulingkan Presiden Soeharto, dg melawankan Rakyat & mengorbankan ribuan WNI.
• Hj. Megawati: Wanita Lonthe inilah yg di sanjung2 & di sembah2 oleh antek2nya di PDI Perjuangan. Kelihatannya Pendiam namun ambisinya lebih besar daripada Gunung.  Hasil kesuksesannya jadi Ratu di PDI Perjuangan & sebagai Hajjah BESERTA MANTAN ANTEK2NYA TERMASUK SBY adalah: BERHASIL MENDIDIK SEBAGIAN MASYARAKAT INDONESIA MENJADI ORANG2 YANG SIRIK HATI, PENDENGKI, & PERUSAK, SERTA MENDEWAKAN HAL2 YG MERUSAK AKHLAK & MORAL BANGSA [JUDI, MABOK2AN, NARKOBA, PELACURAN, HOMOSEK, KRIMINAL], SERTA menteror Letkol Bobby.

• Jendral Pramono, Ipar SBY: Kurang jelas apakah Letkol Bobby dapatkan juga foto2nya sedang adegan ranjang dg Meutya Hafid, namun yang jelas ia baku hantam vs Letkol Bobby dg ilmunya, karena mengeluarkan kesaktian Pusakanya bersama SBY, hingga membuat Solo dihantam Badai beberpa hari sebelum Bendungan Situgintung Jebol dihantam Letkol Bobby Meidianto.
• Jendral KPH. ROESDIHARJO, Jendral Da’I Bachtiar, & JENDRAL SUTANTO:  Ketiga Mantan Kapolri ini sudah berulangkali dapat surat2nya letkol Bobby melalui e-mail & faxs : kapolri@polri.go.id, & e-mail KBRI Malaysia, sejak tahun 2000, namun koq malah menyembunyikan fakta tentang letkol Bobby. Apalagi Jendral Soetanto yang juga masuk dalam foto2 yang beradegan sex dg Meutya Hafid. Kecurangannya pun juga diketahui sejak bulan Mei 2008 lalu itu mengenai Meutya Hafid , bahwa ia menghubungi Meutya Hafid di bulan Januari itu namun tidak menghubungi Letkol Bobby Meidianto.
• Guruh & Guntur Soekarno: Dulu antara tahun 1996-2000 kira2, Saat itu Panji putranya Letkol Bobby Masih Sekolah di SD 15 Mangkubumen Solo. Saat itu oleh permohonan Letkol Bobby kepada Yayasan GNOTA, Panji & kawan2nya yang kurang mampu dpt bantuan social. Tak dinyana istri Guruh Soekarno lalu ikutan membantu, namun tanpa di ketahui Letkol Boby. Buruknya Letkol Bobby di buruk2in banyak orang tanpa tahu sebabnya. Setelah diselidiki ternyata hal tsb diatas. Akhirnya Bu Guruh tsb yang kediamannya dekat Resto Diamond Solo di datangi Letkol Bobby yang ingin tahu koq ia di perlakukan begitu. Namun tanpa dinyana, malah yang menemui Letkol Bobby yang datang sebagai Sopir Becak dg membawa becaknya, saat itu adalah Kanjeng Sri Sultan HB X, hingga Letkol Bobby batal marah2, dan juga Letkol Bobby di beri uang oleh Kanjeng Sri Sultan HB X uang sebesar Rp. 20.000,-. Saat itu dianggap Letkol Bobby sduah selesai, namun ibunya Pani sampai sekarang selalu memusuhi dirinya dan hal ini diyakini punya hubungan erat selain oleh ulah keluarga OZY HASAN  [bila ia itu OZY HASAN TUMENGKOL] yang juga punya anak kawan sekolahnya Panji Ardhanarespati, putranya Letkol Bobby itu.
• Avian Tumengkol [ Rozy Hasan Tumengkol  Sudah banyak di tulis di website ini. Ia dan teman2nya ketahuan setelah menteror Letkol Bobby sejak bulan Mei 2008.

Today I received an email from Flickr to advise several of my photostreams have been rated “moderate”, rather than “safe”. The immediate consequence of this change is that these streams no longer appear on my website – unless you are already signed into Flickr and have verified your age. Please forgive the disruption; normal service will be resumed as soon as possible.

Actor Ron Livingston is suing an anonymous defendant in California courts for libel.  Livingston alleges that the culprit repeatedly edited the actor’s Wikipedia entry and made it appear as though he was in a homosexual relationship.  Livingston also alleges the defendant created false Facebook profile pages for the “lovers” in order to post their relationship status.

This suit might hinge on a common privacy concern: what is the likelihood Facebook and Wikipedia will give up the identity of the user who created the ruse?  Lawsuits that try to uncover the true identity of anonymous bloggers are common, and most are unsuccessful. 

In this case, however, it could go either way.  The Wikimedia privacy policy provides:

“Occasionally, however, the Foundation may receive a subpoena or other compulsory request from a law-enforcement agency or a court or equivalent government body that requests the disclosure of information about a registered user, and may be compelled by law to comply with the request.”

Facbook’s policy is similar, requiring a “good faith belief” that disclosure is required.  [The Facebook policy has some other issues, though]. 

Facebook has fought subpoenas like this in the past, and likely will continue to do so.  But therein lies the real issue, even though the law might not require disclosure of the posters identity, at the end of the day, then, it’s up to the site whether or not to disclose the information (Facebook’s “good faith belief” is a fairly easy standard for them to meet). 

In a similar suit, Google recently outted a blogger who called a model a “skank.”   The Google privacy policy similarly provides that they can reveal information if:

“We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request”

Now the blogger might be suing Google, though she probably has little chance of winning, given the terms of the privacy policy.  That said, if Facebook or Wikimedia decided to disclose the poster in this case, he too would have little recourse against them.  Agreeing to a privacy policy has consequences.

In short, if Livingston can show defamation, he still has a major privacy hurdle to jump in order to win: convincing Wikimedia and Facebook it would be easier to disclose the blogger than fight the subpoena, an argument that has been unsuccessful with these companies in the past.

The bottom line for bloggers: don’t post false and defamatory statements about people.  Though the law might protect you, you can’t be sure Google, WordPress, Facebook or Twitter will do the same.

On a related note, The Citizen Media Law Project has a great post on whether calling someone gay is even libel.  If this is not libel, then there’s a good chance the case won’t make it to the privacy issues.

This is the first substantive post for #law tag.  It seemed appropriate to give a simple rundown of the agreement I had to consent to in order to start this blog.

The WordPress Terms of Service are simple.  [For a comparison, check out the Blogger Terms of Service which incorporate several other agreements and are written in much worse legalese].  Below, I will take you through the provisions, one by one:

The Gist: In this section, Automattic, Inc. (the company which runs WordPress.com) lays out what it thinks are the basics of the terms.  The section acts like an informal preamble and likely has little legal effect.  In case of a dispute over the other terms, it might be used to figure out the intent of the parties.  This excerpt, for example, makes it sound like the user retains all the copyrights to his content, though that issue isn’t addressed in the more formal provisions:

“Our service is designed to give you as much control and ownership over what goes on your blog as possible and encourage you to express yourself freely.”

The Terms of Service:  The first paragraph basically says that the terms apply to all of the services WordPress provides.  It also incorporates “all other operating rules, policies,… procedures” they may add later and their Privacy Policy.  The second paragraph requires users be at least 13 years old.

Your WordPress.com Account and Site. This section says that if someone gets your password or otherwise hacks your account, it is your responsibility.  It prohibits you from representing yourself as someone else, and allows WordPress to change anything that may cause them liability.  It also says Automattic is not liable for any of your actions.

Responsibility of Contributors. You are responsible for your content and any harm it may cause.  This means you have not stolen the content [from the copyright, patent, trademark holder, or your employer], you aren’t violating any other agreements by posting the content, and you’re not uploading viruses, spam, porn, libel, hate or fighting words.

This section is significant:

“You grant Automattic a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your blog. If you delete Content, Automattic will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.”

The section above basically says that WordPress can repurpose your content in any way, so long as it does so to promote your blog.  Even though you are giving up some usage rights, here will probably benefit you because WordPress probably has more reach than your network [at least thats true for me]. 

The section above also makes clear that anything you delete, might never be deleted.  This could have important implications if you ever post something libelous or infringing on a copyright, then later try to take it down.  Once it is on the internet, it might be there forever [i.e. in the Google Cache].

Fees and Payment. This is some basic information on the pay services you can sign up for and the way they will be billed.  Since I signed up for the free services only, I glossed over these parts.

Responsibility of Website Visitors/Content Posted on Other Websites.  These sections are interesting.  They addresses the reader, rather than the person signing up for the blog.  The reader of a WordPress blog never clicks to agree to these terms, so it’s hard to know their legal effect.  These sections basically say that Automattic hasn’t looked at all the WordPress content and linked content and readers should be cautious and report misuse of WordPress products.  Automattic also disclaims responsibility for content.

Copyright Infringement and DMCA Policy. Having already told its bloggers that they cannot, under the terms of use, infringe on ownership rights, this section tells readers to report bloggers if they suspect infringment.  It also gives WordPress the power to remove content, and suspend accounts.  [DON'T STEAL!]

Intellectual Property. Blogger’s have no right to Automattic property, including trademarks and graphics.  I hope I am not infringing by using the WordPress name over and over here.

Changes.  WordPress can change the agreement at any time.  The user has to check for updates.

Termination. WordPress can cut your access at any time, for any reason.  You can get out of the agreement by cancelling your account.  If you have pay services, they can only terminate for a material breach thats uncorrected after 30 days.

Disclaimer of Warranties. There are no warranties.  But there is a joke.  ”If you’re actually reading this, here’s a treat.”  I don’t know what, if any legal effect a joke inside a contract has.

Limitation of Liability. WordPress won’t pay for special or incidental damages, the cost of substitute products or services, the loss or corruption of data, any amounts over what the blogger paid to WordPress.   This might vary by jurisdiction.

General Representation and Warranty. You agree to follow the privacy policy, the Terms of Use, and all laws and you will not infringe on the intellectual property rights of any third party [AGAIN, don't steal].

Indemnification. “against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.”  Pretty all-encompassing.

Miscellaneous. The agreement can only be ammended if you get a rep from Automattic to sign the revision, which seems unlikely.  There is a choice of laws provision, so if you do sue them, or they sue you, the court will apply California law.  And a choice of venue, so suits must take place in San Fransisco (unless the suit isn’t for money), but that is after a required arbitration.  You can transfer your rights under the contract as long as the person you transfer to accepts the agreement.  Automattic can transfer without any conditions.

Whew!  All done.  There are a lot of potential issues here, but I will leave those for another day.  Here, the purpose was just to explain the terms, not to analyze them.  Interestingly the WordPress terms are apparently enforced by an automated program which can lead to some headaches.

[Just a note, I use WordPress and Automattic interchangeably, though I probably shouldn't have.  Automattic is the company with whom the blogger is entering into an agreement]

An old friend died last week.  The circumstances of his death are still not clear: he was in good health, lived alone, and was getting ready to celebrate his 35th birthday that same week.  We hadn’t really hung out in a few years, having gone our separate ways in life, but we’d see each other on Facebook, trade a chat every now and then, and keep generally informed of each others’ life milestones.  When my father told me the terrible news I was shocked; wanting to get a sense of what was happening in his life prior to his death I went to his Facebook page.

His November updates all seemed positive.  My friend had been a survivor of childhood cancer and possessed a courage that I always admired him for.  On November 10th he posted the status update: “22 years ago this Nov. was my last chemo-therapy treatment.  I have been Cancer free since then; Life is good ♥.”  Prior to that, in response to someone asking him how things were going he said, “Life is good – Had a great day so far and it’s not over yet- ♥ this life.”  The final update he posted, just 6-days before his birthday on November 14th, went as follows: “Going to be having a Tattoo party soon at my home.  My two friends are going to come here and Ink people if you want to get something let me know asap and we will work something out.  These are the people that have worked on me so to see their work look at my photos “.  That was the last Facebook update he ever made.  Police found him in his apartment on November 21st.  The unofficial report, through the grapevine of concerned friends, said that he had been dead for at least four to five days before being found, they did not know the cause of death, and an investigation would be conducted.

Looking at his Facebook page now is a surreal experience.  On his birthday he was already dead.  No one knew that fact until the next day.  Earlier in the week, on his Wall, there was a string of posts wishing him happy birthday, (I remember getting similar birthday posts from “friends” on Facebook, some of whom I hadn’t seen or spoke to in years, wishing me well – part of Facebook etiquette, I guess).  After about 20 or so birthday wishes, the RIP messages began, many more than the birthday wishes.

People posted quick messages like, “RIP brother, you will be missed,” multimedia messages with links to YouTube videos of Pearl Jam’s “Black” or other appropriate songs he would have liked, and some more personal notes, (I have yet to post my note).  What strikes me about this aspect of the tragedy is how we as people are finding new ways to grieve, digitally.  The Facebook Wall has become the virtual wake, if you will, where those of us not local enough or not close enough to be there in person can express our sadness and love to the departed.

When a user dies on Facebook, that persons profile can become “memorialized” by notifying Facebook about the user’s death.  Here is what Facebook says about a memorialized profile:

These mechanisms are in place to preserve the integrity of the person’s profile and provide the emotional outlet for friends and family.  Someone must have worked with Facebook to clean up my friend’s account b/c many of the birthday messages are now gone.  I’m kind of glad.  It was unsettling to see that string of messages knowing they were posted after the fact.  I’m also glad that I can now go leave my parting words for my friend in the hope that perhaps they’ll bring a little comfort, comfort to those looking at his profile, family, friends, whoever.  Also, I hope this blog post serves as a source of information about handling a death on Facebook and a tribute to my friend.  His legacy of courage and love of life will always live on through those who knew him.

The Lori Drew case, which I blogged about a few weeks ago should be over very soon.  According to Professor Orin Kerr, the Justice Department will file a motion to dismiss in the case either tomorrow or the following day.

Professor Kerr represented Drew, taking her case pro bono.  In the words of a Volokh Conspiracy commenter, “If I ever need an example of a case taken to establish an important principle on behalf of a client who is scum of the earth, this case will fit the bill.”  I agree.  This woman is disgusting, but the government’s charges against her are even worse.  I am reminded of one of my favorite Supreme Court cases, National Socialist Party of America v. Village of Skokie, where reportedly Jewish ACLU attorneys reportedly defended the neo-Nazi group’s right to assemble and march, even in a predominantly Jewish community.

Congratulations to Professor Kerr, who is an expert in criminal law, criminal procedure, and computer crime.

Congratulations to Kerr for this much-needed victory for every Internet user.  The fact that a Professor of Law from Washington, D.C. was able to not only brief a case, but actually argue it in court in California simply for the good of the public is an absolutely outstanding life accomplishment.

I had been maintaining a rather quiet existence when all of a sudden, on Thursday, people were pinging me asking what I did this time to violate the WordPress.com Terms of Service. This very neatly escaped my notice as I was away assaulting the tastebuds of my roommates with some concoction that resulted from a cooker, some vegetables and some rice. To top it, Windows had installed updates and thus autorestarted my system. I never got to see those pings.

And then there was this offliner from my mother asking me to buck up and not just lose it and go offline, I can always create a new blog, can’t I?

I tried accessing my blog. And was informed that This blog has been archived or suspended for a violation of our Terms of Service.

And not only that. My WordPress.com account had been suspended. So all my blogs had been ‘archived or suspended for a violation of Terms of Service”.

I tried to remember what exactly I might have done that might result in something like this. Surely I had not done anything like last time. I tried going through the Terms of Service. Apparently I was responsible for my account not being compromised. Suddenly I had grand delusions of my eighty-four-character specially-chosen password being cracked by a spammer and this page being used as a spam location.

Tuna gave me this link, and I reported that this blog, my photoblog, my jokes blog and my cs blog were wrongly believed to violate the Terms of Service, and I asked for an explanation.

A couple of hours later, I got a reply from WordPress saying

Hi,

Sorry for the mixup.  I’ve restored your blogs.

All my blogs were back, save this one. Oh Hell!! I went back to the form. Some more time later, I got another reply saying

Hi,
My apologies – the system should not have done that.

I have removed the warning and I am sorry for the concern it caused.

And then just as I was thinking of posting this entire story, my WordPress account was suspended Yet Again. Back to the forms.

i’m super bored… and i’m sick of my books. i decided that i need to bring back music into my life. a hobby is a healthy way to give my head a break from countless memorization, of all those stupid repedative things that i’m going to be doing the rest of my life.

if you follow my incoherent writing in the slightest, i applaud you. it has been some time since i have journaled in any way shape or form. so hopefully as i continue at this, my ability to form coherent thoughts on the fly will return. christ i really havn’t done this online journaling nonsense since i was 14 or some age close to that.

anyway, this page will be dedicated to my unhealthy obsession with music. i developed this form of OCD when i was a wee tot, but it really started to skyrocket during the days of napster. And let’s just say it’s gotten a tid bit worse. I’ve been told multiple times by friends and family to change the subject from music to something else. No one cares. blah blah. So yeah, things have evolved since my days as a child. but i have way to much to just keep to myself. i’d like to share with you now.

now don’t get me wrong, i’m not attempting to just hand out music illegaly. thats wrong. i will be making mix tapes. something that was such an enjoyable task when i was a kid.

as a lil’un, i would lock myself in my room and talk into a fucking microphone on my boombox. I had my 70min cassette tape in dock, and my variety of cds. I would play some song and act as if i was on the radio and record it. god thats embarassing. i cant believe my mom didn’t make me go play football or something. blitz was cool though.

then theres the other obsession that i started to develop as a child. most of you probably share the same. as you are on the internet. i’m addicted to computing

ithe first cd burner i begged my mom for. wow. the fact that i could make a cd and put all the songs i wanted to hear when my mom drove me to school…as a child, that was probably the coolest shit in the world.
stupid sounding. fuck yea it is. but i miss it. i miss the simplicity of making a mix tape for a friend. fortunately enough for you, i will not be adding my commentary in between tracks with these ones as i did when i was a kid. i’m going to just enjoy having complete control of the dial… persay. if you ever so choose, you may download them, free of charge, right here. i will be supplying you with one track mp3s with multiple songs, throughout sporatic postings on this journal. these mix tapes will contain the music that i have been listening to as of late.

now when i say “as of late”, i do not necessarily mean it is new. most of it probably will be, now that i think about it, but there are always the classics that hold a dear place in my heart. my focus is to attempt to drift away at my early days of mixing, with my attempt to mimic popular mashup djs, and just give you some shoegaze-y type mixes of whats stuck in my head. this blogs intention is to simply supply you with music, mimicking a cassette form, where your only knowledge of what you are going to hear involves reading the post on the blog, and fastforwarding to certain points.

but please don’t fast forward too much. i put the songs together in a particular way, with ever so much time and effort. the reason being this involves my longing for you to hear whats going on in my head. the same process my head works as i walk to class, waiting to impatiently switch the song on my ipod.

The BBB has issued a statement warning consumers to stay away from the teeth whitening scams on the internet.   I first wrote about this http://scams-xposed.blogspot.com/2009/09/whiten-your-teeth-for-free.html.   These sites use deceptive claims to get you into a monthly payment plan and nothing is free or even cheap.

I think they did read my blog.   What,  no backlinks for me…damn.   Oh well.

This scam is repeated over and over again. From late night infomercials to google ads. The latest version I have gotten is in the form of a spam email.

https://www.wealthgrants.com/ claims to be able to get anyone a grant to do anything. To find out how to do this you must become a member of the web site. A careful look at the terms and conditions reveal that the web site subscription costs $73 per month automatically charged to your favorite credit card.

You should never need to pay for grant information. The federal government makes all grant information available for free. See grants.gov for a starting point.

By the way I searched up and down for a grant to pay my Credit Card bill and came up empty.  I guess that makes sense since the Feds can’t pay their own debt off.  Perhaps they should charge for grant information.

I have been removed from adsense due to activity they say is suspicious.   I may have clicked on one of the links they put on this site.   What a crime.   Oh well.   More details after the jump.
Adsense was just getting rolling for me too.   So this is where I get to play the role of “Dad”.  Do as I say not as I do.  It seems I did not read the Adsense terms of service closely enough and unknowingly violated some term of service.   Therefore, I am on the outside looking in.   No warnings, no second chances,  no helpful guidance, just locked out of my adsense account.

Quite honestly, it was time to reduce the number of ads shown here anyway.   Adsense kept showing links for sites I think are scams and really had no business being here.

Some of you may have noticed other ad network ads showing up here and then being removed.   I have been testing several alternatives.   Some are just too damn annoying so I have removed them.

Hey there, hi there, ho there, my lovelies.

This entry is going to be about music.

I love music. I listen to anything and everything, and my library has thousands of songs. Music to me is like air, like oxygen. All I need is music.

However, what bothers me are the people who rip videos off of a band’s fansite, violating said site’s Terms of Use policy, and post it on YouTube or Hulu.

This stupid motherfucker violated her contract as a Victim, a fan of The Killers. Now, other Victims, like myself, are angry with her for doing this, and it’s only a matter of time before she loses her membership and is forever banned. For those who don’t know, Victims pay thirty dollars a year to be a part of the official fan club, and are entitled to perks, such as the above-stated video. When we sign up, we sign a contract stating that we will not take the videos, audio, or other things shared with us and hand it out to sites like YouTube and audio-sharing websites.

By posting the video, she has violated her contract as a Victim, and angered many of us in The Victims community. It shows that she has no discretion, and obviously didn’t read or ignored her Terms of Use and contract. So here is what I believe should be done: I suggest that all Victims should flag the video for copyright infringement, and petition for her subsequent removal from The Victims. By flagging the video, you will call it to the attention of YouTube, and get it taken down or muted. She broke the rules of The Victims, and she should suffer the consequences.

It is the same for other fanbases. Case in point: Vampire Weekend (the band, not my book) recently put out a single called Horchata. Already, there are illegal downloads on audio cafes.

Never mind that the single is free for download on the band’s website.

The stupidity of mankind is enough to make one’s head hurt.

My point is that people really should pay attention to the Terms of Use and post with discretion. Otherwise, you could end up like the poor fool who posted Zombie Hands without permission and you’ll get banned from the fanclub and subsequent shunning from the rest of the community. Yeah, who wins out there, huh?
