it’s true that when you let go, things tend to fall into place easier and everything just kind of work itself out. it’s all very zen but hard to accomplish.

JW moved in over the weekend. except for AK, she has the most stuff out of all my roommates. although she doesn’t have furniture, she has a lot of kitchenware and things for bathroom, etc. i told her to feel free to move my things to make room for her things, since i was in and out of the apartment yesterday. she took my suggestion and definitely made room for her own things. but for some reason, with her, this time around, i am not territorial about my things, my space, etc. i looked around and she’s definitely made a presence the last 12 hours. but i’m totally fine with it.

i think i’ve let go of, or trying to let go of marking, establishing my territory and making myself the “master” tenant. i don’t care if JW wants to make some changes here or add her touch to the place. at the end of the day, it is really as much her space as it is mine. and ultimately, the more she feels comfortable/at home here, the better we’ll get along. plus i know how it feels to not feel like you have a home and you’re just a guest in someone’s space. it’s a sucky feeling. i don’t want her, especially being that she’s my age, to feel that way. and i also want her to feel invested in the apartment to maintain it, keep it clean and take care of it when i’m gone.

it feels good. not like when i had other roommates, where their presence have been jarring and uncomfortable. with JW so far, it’s been fine. of course she’s only been here for one day so who knows if her weird ways will eventually come out in small doses. but hopefully, that’ll not be the case. i really want this one to work.

so with her and her presence and her things, i’m just going to let go. holding onto this apartment and being territorial about it has become exhausting. it’s time i just let go. let go of it all…and in order to make this bi-coastal thing work, i really just need to let go and not be attached to much. that’s the only way i’ll be free.

There’s an old Native American proverb which states “We do not inherit the land from our ancestors, we borrow it from our children.” What this means is that land doesn’t belong to any one person, but rather land exists for all people. The concept of land-ownership among the Native Americans existed solely in a territorial sense. That area belongs to (or rather, is being used by) that group, this land is being used by us, and so on. Indeed, this concept is almost universal to all hunter-gatherer, pastoral, nomadic, and horticulturalist people groups.

This all contrasts very sharply with our modern, Capitalist belief in private property- especially in regards to land. For some odd reason, humans enjoy being able to state “this land is my land, it sure aint your land”. We take pride in our ability to put up fences, barbed wire, and “no trespassing” signs.

Now this is a concept I have difficulty grasping. We somehow imagine that we can divide the world up into little plots of land, separate them by borders, and claim that we own them. How on earth (yes, that’s a pun) can we do this? We don’t own land, the land owns us! To pretend that everything within points ABCD is ours and ours alone is ridiculous. Now if we some created the land, then the concept might have some (and only some) weight to it. The fact of the matter is, however, that the land was here millions of years before some person got it into his head that these twenty square acres belonged to him and no one else. Yet the vast majority of our planet is sliced up into neat parcels of land which most of the time aren’t even being utilized by the so-called “owner”. If he isn’t living on it, then why shouldn’t you be able to enjoy it? Have angels descended from the heavens and proclaimed that by divine mandate, this mountain exists solely for the uses and pleasure of a single man? No. All that happened was one man decided that these twenty-or-so square acres were going to belong to him and that if anyone disagreed, he would fight them.

So how is that right? Carving out a stretch of land by simple superior firepower (which almost always eventually translates into legal justification) for sole purpose of satiating greed (which incidentally, isn’t satiable) – is that ethical? No matter what your politics, you have to come around the belief that this land is as much yours as it is mine. This land was made for you and me!

SINGAPORE, Nov 15, 2009 (AFP) – Japanese Prime Minister Yukio Hatoyama indicated he made little headway in talks Sunday with Russian President Dmitry Medvedev on a decades-old territorial row.

The two nations have yet to sign a peace treaty ending World War II because of the dispute over a chain of Pacific islands seized by Soviet troops in 1945, known as the South Kurils by Russia and the Northern Territories by Japan.

“I told President Medvedev that the Japanese people cannot understand the proposal of returning two islands (out of four), and that we are expecting that (Russia) would offer a proposal beyond that,” Hatoyama told reporters.

The Japanese leader said Medvedev told him it was meaningless to be stuck in Cold War-era thinking.

“This time our discussion ended here,” Hatoyama said. “There was no concrete proposal. He showed only a way of thinking.”

“I believe that this issue has to be resolved at the leaders’ level,” he added. “President Medvedev and I agreed that we could make telephone calls at any time to discuss the issue.”

Medvedev had said at the start of the meeting, held on the sidelines of an Asia-Pacific summit in Singapore, that he hoped to discuss a range of issues including “the most difficult ones that we inherited.”

In October, Japanese Land Minister Seiji Maehara became the first cabinet minister in five years to view the disputed islands when he surveyed them from the sea.

Maehara said afterwards that Japan should keep demanding that Russia return them and called their seizure an “illegal occupation”, provoking an angry response from Moscow.

Hatoyama, who has a history of personal ties with Russia, said Sunday he planned to build “new Japanese-Russian relations”.

His late grandfather, former prime minister Ichiro Hatoyama, visited Moscow in 1956 and signed a joint declaration reopening dialogue after the war. The new prime minister’s son also teaches at Moscow State University.

Ce pré projet de création d’une association loi 1901 (sans but lucratif) me tient particulièrement à coeur. A travers l’existence d’une telle structure devront se développer des échanges de toutes sortes et permettre ainsi de dynamiser notre réseau (qui existe déjà au sein de

http://concoursredacteur.wordpress.com ). Celui-ci est pour l’heure qu’une simple avancée inachevée, qu’une essence existentielle subjective.

Je demeure persuadé que l’APTE est ou peut être un outil de travail  exceptionnel pour toutes celles et tous ceux qui, de près ou de loin, s’intéressent au secteur public.

Déjà se posent de nombreuses questions auxquelles il va nous falloir apporter une réponse :

- quelles seront les dispositions statutaires qui emporteront légalité et légitimité de notre association ?

- doit-on poser des obligations et des droits que tout membre inscrit se devra de respecter ? Ceci sous-entend qu’il puisse y avoir des sanctions pour manquement ou non-respect de ceux-ci… Comment doit-on les définir le cas échéant ? Comment les faire appliquer ? Comment les mettre en oeuvre ? Cet aspect coercitif doit-il tout simplement exister au sein de l’APTE ?

Il me paraît judicieux et opportun d’envisager une collégialité, une collaboration qui serait à même de permettre l’émergence des dispositions statutaires les plus justes, les plus objectives, les plus utiles, afin de pouvoir trouver cet équilibre (presque) parfait qui assurera le développement souhaité et attendu de notre association. Trop et pas assez sont donc à exclure.

La définition des dispositions statutaires suppose aussi que l’on sache parfaitement ce que l’on entend par Association Publique pour le Travail d’Entraide… (?) En d’autres termes, que doit-on y mettre ? Et surtout que doit-on NE PAS Y METTRE ?

Par ailleurs, la page des CORRIGES/COURS sur Intellect territorial version 3 devenant trop lourde, le présent espace servira à compléter celle-ci. Chacun aura pu constater que la GRATUITE ne fait pas défaut à la QUALITE. JAMAIS on en vous aura proposé autant de ressources gratuites pour votre préparation. La création de l’APTE devrait permettre de nous asseoir sur une communauté légale qui puisse faire face aux attaques des sites marchands dans le domaine. Car Intellect Territorial se bonifie avec le temps (je ne dirais pas l’âge). Les ressources augmentent et leur utilité devient de plus en plus évidente.

Les fichiers intégrés à cet espace web peuvent objectivement et sans discussion aucune obtenir la mention “TRES BIEN”.

The National Center for Hydro-meteorological Forecasting said Typhoon Parma has crossed the northern part of Vietnam’s Hoang Sa (Paracel) Islands to lie 700 kilometers away from the country’s north central coast on October 11.

The sea between Quang Tri and Quang Ngai provinces and the southern part of the Gulf of Tonkin would see strong winds and be choppy, it said.

It forecast the typhoon to move west, westnorth towards China’s Hai Nam Islands on October 12 and possibly weaken to become a tropical low pressure 90 kilometers off the coast between Thanh Hoa and Thua Thien – Hue provinces on October 13.

It is then expected to make landfall over the north central region the day after, bringing heavy rainfall to Thanh Hoa, Nghe An, and Ha Tinh provinces.

Success!  I had my first (mini)harvest from the Fall garden.  Spinach and rainbow chard!  I shared some of the spinach with friends, and put the rest in our breakfast frittatas for this week.  I’m not sure what I’m going to do with the rainbow chard, but it’ll probably become a side dish some day this week.  I’m so proud that the garden is producing!

This weekend I thinned the carrot starts.  I put some of them into rows in the Fall garden.  The remaining starts went into containers to share with friends.  So far they seem happy, but I’m a little worried that the recent colder weather will be hard on them.  They have lost the protection they provided each other when they were packed tightly together in rows.

I also planted garlic cloves from Territorial Seed Company this weekend.  It was the missing item in my garden grid.  I fear I may have planted them upside down.  It’ll be awhile before I find out since garlic is slow growing.  I also received garden fabric that I need to install to protect the Fall garden before our first frost.  My hope is for the Fall garden to last throughout the Winter.

It was a busy gardening weekend.  I also finished savings the tomato seeds.  They have completed drying and are now stored safely in coffee filters for next year.  I’m eager to find out if they will sprout, but I will have to be patient until Spring.

This week I need to figure out how to support the garden fabric so that the Fall garden is ready in case we get our first frost.  I’m not sure what I’m going to use for support, but I want it to be made from salvaged items from our house.  Maybe some of the leftover plumbing from the remodel.

GROT Goal: Reusable Ice Blocks

I’ve dipped my feet into growing vegetables!  For my 32nd birthday Phil built me a 3′X3′ box.  I installed it and added plants the day after my birthday.  I’m growing chard, carrots, spinach, onions, broccoli, brussell sprouts, kale and beets.  And garlic in on its way from Territorial Seed.  I was hoping to get it from Swansons Nursery, but they can’t guarantee they will have it in stock again this season.  As of today the garden has taken off with little watering.  I have only had to water it twice.  Rain water has done the rest.  I’m a bit worried about the upcoming cold weather that is inevitable here in the late Fall and all of Winter, so I added some cloth fabric to my Territorial Seed order.  I plan to build some sort of protection around the box.

I need to research how to harvest spinach.  I feel like it’s already getting crowded but I’m not sure if I should thin it from the outside or what.  I also need to thin the carrots.  I’m hoping to give some to Rachel and some to Christy if I can thin the plants without damaging them too much.

My Garden in September

This weekend I purchased bulbs from Swansons Nursery.  I planted tulips, daffodils and crocus for some Spring color.  I concentrated on the right side of the house since that side has more dirt and I see it more often.  I limited the colors to yellow and white.  I think they are going to look beautiful against our blue house.  I also planted an ornamental kale and 2 pansies in a clay pot on the front porch.  It had been empty since last summer, so it was long overdue.

Additionally, I started the fermentation process of tomato seeds.  I gutted out the seeds and goo from three of my tomatoe plants.  One is a Beef Steak and the other two are cherries.  For now they are sitting on our kitchen window sill fermenting away.  They have two more days of this before I rinse them off and start the drying process.

O critério de fixação da competência territorial no processo do trabalho visa a facilitar o acesso do empregado – parte economicamente mais frágil – à Justiça. Tanto que o artigo 651, parágrafo 3o, previu o local do domicílio do empregado como foro competente, nas hipóteses nele listadas. Portanto, é perfeitamente admissível a fixação da competência territorial pelo domicílio do empregador quando isso atende a pedido dos reclamantes.

Assim entendeu a 3a Turma do TRT-MG, ao dar provimento ao recurso da viúva e filhos de um empregado falecido em acidente ocorrido no seu local de trabalho, em Jacobina, na Bahia. O juiz sentenciante havia acolhido a exceção de incompetência, alegada pela reclamada, e determinado a remessa do processo para uma das Varas do Trabalho da cidade onde ocorreu a prestação de serviços. Os reclamantes não concordaram com a decisão, sustentando que moram em Raposos–MG e não têm condições de arcar com as despesas de um processo na Bahia, uma vez que sobrevivem com a minguada pensão por morte deixada pelo falecido.

Analisando a matéria, o desembargador César Pereira da Silva Machado Júnior ponderou que a distância entre Raposos e Jacobina é de aproximadamente 1.400 km, o que dificultaria em muito o acesso dos reclamantes ao Poder Judiciário. Por outro lado, a fixação da competência em Belo Horizonte não traz qualquer prejuízo para a reclamada, pois a empresa tem sede na cidade. “Dessa forma, a facilitação do acesso à justiça, com os meios de defesa a ela inerentes, é objetivo que deve condicionar a interpretação do art. 651 da CLT, que, inclusive, estipulou como foro competente o do domicílio do empregado nas hipóteses do art. 651, § 3º, da CLT” - destacou o relator.

Nesse contexto, a aplicação subsidiária do artigo 94, do CPC, que estabelece o foro do domicílio dos réus como o competente para julgar ações fundada em direito pessoal, não é contrário aos princípios do processo do trabalho, pois amplia o direito de ação dos reclamantes, sem comprometer o direito de defesa da reclamada. Com esses fundamentos, a Turma declarou a competência da 10a Vara do Trabalho de Belo Horizonte para conhecer, instruir e julgar a reclamação proposta.

Na Conferência, a sociedade civil, gestores de comunicação e o poder público dos territórios de desenvolvimento Carnaubais e Entre Rios terão a oportunidade de discutir comunicação no Piauí.

Depois das Conferências realizadas nas cidades de Picos, Esperantina, São Raimundo Nonato, Bom Jesus e Floriano a capital do estado é palco de um momento histórico para a comunicação do país, abrindo espaço para a discussão de temas como a democratização da comunicação, concessão de rádios e TV, legalização das rádios comunitárias, internet e telefonia.

La Presidenta de CHA, Nieves Ibeas, estuvo presente este sábado en la inauguración de la VI Feria de Coleccionismo General y Popular (REPLEGA 2009) que se celebra en Monzón y que está organizada desde la Delegación que dirige Joaquín Palacín (CHA). Nieves Ibeas estuvo acompañada por el Diputado de CHA en la DPH, Pepe Torralba, y por el Secretario Territorial de CHA en el Altoaragón, Eduardo Pueyo.

REPLEGA 2009 ha recogido este año una exposición filatélica inédita en el Estado español sobre el conflicto saharaui. La exposición, comisariada por Chorche Paniello, llevaba por título “El país prohibido: República Árabe Saharaui Democrática”. En ella se recogía la casi totalidad de los sellos emitidos por el Gobierno Saharaui. El gobierno de la RASD (REPÚBLICA ÁRABE SAHARAUI DEMOCRÁTICA), reconocido actualmente por la Organización para la Unidad Africana y por 76 países de mundo (aunque el Estado español no la reconoce), ha editado desde 1990 estos sellos como una forma más de internacionalizar el problema.

Esta cita cultural está organizada por la Asociación Cultural L’Albada y concentró a decenas de diablos de distintos dances y pueblos de todo Aragón y de Tudela en un pasacalles que pone en valor esta tradicional figura y sus características en cada zona.
