As part of the settlement agreement, ThinkSecret agreed that they would stop publishing, but due to existing advertising obligations they continued publishing in a limited fashion until February 14th.

アップルがらみのニュースで、異常なほどメディアの関心を呼んだ出来事がある。

かつてアップル噂系の最高峰だった Think Secret が休刊閉鎖に追い込まれたことだ。一片のプレスリリースだけで、その詳細はよく分らなかった。

一流メディア（AP、Reuters、New York Times、WSJ、BusinessWeek、BBC、Financial Times、Guardian、Baltimore Sun、新華社）から、IT 系メディア（CNET、CNET Japan、ZDNet、InformationWeek、eWeek、Ars Technica、TidBITS、Computerworld、TechCrunch、TechCrunch Japanese）、そしてマック系メディア（MacNN、Macworld、Wired、Cult of Mac、Mac Observer、Engadget、Engadget Japanese、TUAW、MacDailyNews、Mac Rumors）に至るまで、触れなかったメディアを探し出すのが困難なほどだ。

ニューヨークタイムズに至っては都合３本の記事（Brad Stone、Saul Hansell、David Pogue）を載せている。

なかでも次に取り上げる Brad Stone の記事は、これまであまり表に出ることのなかった Nicholas M. Ciarelli の写真、それも正面から撮ったものを冒頭に掲げている。

裁判の終結

アップルはこの木曜日に一連の裁判を終結させた。未発表の製品計画がウェブに漏れるのを防ごうとした結果、高くつき、負けを認めざるを得なくなったものだ。

ウェブサイトの運営者もジャーナリスト？

Mr. Ciarelli filed a countermotion against Apple in March 2005 under a California provision that makes litigants vulnerable to financial damages if they sue over what is determined to be constitutionally protected speech. Mr. Ciarelli’s lawyer, Terry Gross, who represented him pro bono, said the motion could have resulted in a financially damaging and embarrassing ruling against Apple, a risk that he said led to this week’s settlement.

Apple lost the two other suits on appeal after a higher court ruled that the Web site operators were journalists and entitled to First Amendment protections. The court forced Apple to pay $700,000 in legal fees to the sites.

Think Secret が書くと一流メディアまで大きく取り上げるのが常だった。

１２月２５日付けで、セキュリティアップデートの話。

プレスリリースの「Think Secret は今後発行しない」（Think Secret will no longer be published.）というのは何だったのか？

「友好的な」合意に達したけれど、またひと悶着あるのか・・・

Today I join the rank of thousands other blogger in our mourning for ThinkSecret. I heard about it once in a while and I am not a fan of it, I still feel a sense of sadness that it has to close to settle a lawsuit it has with Apple.

I can see it make sense for Nick Ciarelli, its publisher. I do wish him well and is happy for him that he can now put the lawsuit behind. 

Nonetheless, rightly or wrongly, this suit has a feel that a big company uses lawsuit to silent critics. The whole thing degenerated into not about who is morally on the right side, but a tussle of financial power and the poorer party loses.

The Think Secret Blog, a popular Apple rumor blog, has settled its trade secrets case with Apple–the confidential settlement requires Think Secret to shut down, but it does not require Think Secret to reveal its sources inside Apple. InformationWeek.com is reporting the story here.

If you haven’t been following the case, Think Secret posted information from an inside source at Apple. Apple subsequently sued Think Secret, and its owner Nick Ciarelli, for publishing its trade secrets and getting information from individuals who were subject to a confidentiality agreement. Ciarelli contended that the information was legally obtained (via the same type of newsgathering practices as other journalists). Ciarelli has said “I talk to sources of information, investigate tips, follow up on leads, and corroborate details. I believe these practices are reflected in Think Secret’s track record.” Based on this, Ciarelli argued that he was protected by the right to free speech. A journalist cannot be prohibited from publishing lawfully obtained information according to the U.S. Supreme Court.

There are many issues raised by this very curious case: (1) Are bloggers truly journalists; (2) Did Think Secret use the same types of newsgathering practices as other journalists, i.e., is it a journalistic practice to ask people to violate confidentiality agreements and should such a practice be protected; (3) was the information legally obtained if individuals were asked to violate confidentiality agreements; and (4) did Ciarelli disseminate information that he knew, or should have known, was confidential?

This case has generated no small amount of anger by the blogging community because of the potential precedent it sets. While I believe that bloggers should have the same rights as “journalists” if they are reporting on newsworthy items, I do not believe that the first amendment allows anyone to disseminate information which they know, or should know, came from sources which are under confidentiality agreements to keep the information secret. Apple’s beef here was that Ciarelli knowingly encouraged his sources to breach their confidentiality agreements. The salient question of fact is whether he “knowingly” encouraged someone to breach the confidentiality agreements. If he did, then I believe he would be liable under most states Uniform Trade Secrets Acts.

In California, at Civil Code § 3426.1, “misappropriation” is defined as:

(1) Acquisition of a secret of another by a person who knows or has reason to know that the secret was acquired by improper means; or
(2) Disclosure or use of a secret of another without express or implied consent by a person who:(A) Used improper means to acquire knowledge of the secret; or (B) At the time of disclosure or use, knew or had reason to know that his or her knowledge of the secret was: (i) Derived from or through a person who had utilized improper means to acquire it; (ii) Acquired under circumstances giving rise to a duty to maintain its secrecy or limit its use; or (iii) Derived from or through a person who owed a duty to the person seeking relief to maintain its secrecy or limit its use. (emphasis added)

Based on these definitions, I believe that Ciarelli was more than likely liable under the Act by virtue of receiving information he knew was confidential and was acquired by improper means (i.e., encouraging an individual under a confidentiality agreement to violate that agreement). Here’s an opposite view.

This case is also fascinating in that Ciarelli was not required to give up the names of his sources to Apple. What Faustian bargain was struck we may never know, but it is interesting to speculate as Don Reisinger of The Digital Home blog has done here.

Okay, so we all love at least something about Apple. It seems to be one of if not the most successful company at creating customer loyalty that brings big-spending clients back into its stores on a consistent basis. How consistent? So consistent that a good percentage of customers are ready to disregard Apple’s electronics’ flaws or past failures.

Have you tried Apple customer service if you’ve not purchased extra servicing time? Not a good idea. The ubiquity of white headphones is startling, especially when going through the metros of Western cities. We’ve backed away from radio, watching news, and other things – now all you have to do is carry an iPod – a personalized collection of just about anything you may want to hear or watch right in your pocket. Having sold over 90 million of these babies, they’ve made it a standard device to have if you’re into music or just about any other form of cultural entertainment. From blogs to webpages and review sites you can read about how these fry time and again, about battery life expectancy issues, and other tricks they play, yet people just keep buying them. Just to give you some of my personal moan history: my first iPod fried after 2 years, my last iBook’s combo drive passed out and the screen ended up having a red line running across the screen. I know two people who’ve had to send back their batteries and one who’s hard drive died.

The iPhone – do we really want to talk about the iPhone again? With only selected network carriers and incredible prices, people still have more than hots for these. My flatmate is still thinking of somehow buying an iPhone in France (as they seem to have a policy again sim-locking) and then bringing it over to the UK. Some more to read here if you like…

Now, I don’t really mean to go on ranting. I’m writing this off a Mac myself and can’t say I’m not one of the people who spread the word. Despite being a little evil, it’s still probably the best thing out there. We can moan all we want – like we did with Google, but the truth is that there isn’t much to replace it with. Just to give you some more media coverage on Apple’s part in the lawsuit against Think Secret...

Apple Forces Rumors Site To Shut Down

For a few years now, there’s been a legal battle going on between Apple and Think Secret, a very popular Apple rumors site for publishing certain rumors. The lawsuit had many people up in arms, as they pointed out that Think Secret should be protected in the same way a newspaper is protected (and noting that Apple would never sue the WSJ the way it sued Think Secret). It made sense to go after whoever leaked the info to ThinkSecret, but going after the publication was ridiculous. While the case has dragged on, unfortunately, Apple won some of the legal battles. Now, as sent in by Jon, comes the news that Apple and Think Secret have “settled,” but that settlement means that Think Secret needs to cease publishing entirely. The guy behind Think Secret notes that he never gave up the source, and calls this settlement amicable — but it sets a horrible precedent for plenty of sites, and may create quite the chilling effect on reporters and bloggers alike. It’s really a shame that Apple even decided to pursue this vendetta, and the fact that it ends with Think Secret being shut down completely is a travesty.

Depois de alguns anos de processo a Apple venceu e o site Think Secret está fechando as suas portas. Este caso ficou famoso porque foi um adolescente que contou com a ajuda de um grupo de advogados voluntários que tentavam lutar contra uma grande empresa.  O Think Secret descobriu vários segredos através de informações dos próprios funcionários da Apple. Na corte a empresa pediu que o dono do site revelasse suas fontes porque os funcionários não podem por contrato revelar segredos. Nas aulas de jornalismo usamos este exemplo para mostrar que mesmo não jornalistas hoje fazem o papel de jornalistas perante a justiça.

Não entro aqui no mérito do direito ou não da Apple de fazer isso. Mas, no mínimo é uma atitude antipática de uma empresa que sempre se caracterizou por pensar diferente.  Olhem o post final do site.

アップルは、新しい iMac のラインナップを来週披露する準備が整ったようだ。このひと月でマックのアップグレードは３度目となる。予想的中率の高い信頼出来る情報筋によれば、新しい iMac はブラッシュアルミニュームの筐体を採用し、６月１１日の WWDC 当日ないしはその直近に発表する狙いを定めているという。

June 7, 2007 – Apple is poised to deliver its third Mac revision in less than a month next week when the company takes the wraps off its new iMac line. Sources with reliable track records report the new iMac, wrapped in a brushed aluminum enclosure, is currently tracking for release at or around Apple’s Worldwide Developers Conference on June 11.

MacBook Pro と共通の部品

iMac がインテルマックとして 2006 年１月に登場して以来、内部部品の多くはMacBook Pro と共通仕様になっている。ということは、先週アップグレードされた MacBook Pro の改良点を当然 iMac も享受できるということだ。インテルの Santa Rosa アーキテクチャの実装も含まれ、これによって、フロントサイドバス（front-side bus）はこれまでのものより２０％速く、スピードは 2.4 GHz にも達する可能性がある。

Since the inception of Intel-based systems in January 2006, the iMac platform has shared many of its internals with the MacBook Pro, meaning the new iMac will surely benefit from the same improvements the MacBook Pro received earlier this week. This includes the implementation of Intel’s new Santa Rosa architecture, which features a 20 percent faster front-side bus than the outgoing models and processor speeds up to 2.4GHz.

１７インチモデルはなくなる

前にも述べたように、１７インチモデルは新しい iMac のラインナップからは消えて、２０インチと２４インチモデルだけとなる。現在 1499 ドルの２０インチモデルの価格は下がると思われるが、それでもエントリーレベルの１７インチモデル（999 ドル）までは下がらないだろう。

As previously reported, the 17-inch model will not be included in the new iMac line-up, which will feature models with 20-inch and 24-inch displays only. Prices will drop accordingly on the models with larger displays, which current start at $1,499 for the 20-inch, but they are not expected to match the outgoing 17-inch Mac’s $999 entry-level price point.

来週の WWDC では Mac OS X 10.4.10 のアップデートが予定されているが、併せてこの機会に２３インチの Cinema Display を iMac と同じパネルを使う２４インチモデルに入れ替えるかもしれない。

Also expected at WWDC next week is the Mac OS X 10.4.10 update, while Apple may also take advantage of the timing to replace its 23-inch Cinema Display with a 24-inch model that uses the same panel as the iMac.

この件に詳しいソースによると、アップルで一番売れ行きのよいコンシューマデスクテップマシン［iMac］の徹底的オーバーホールは今年後半を目途に進行中だが、月曜日の WWDC にはまだ時期尚早で、現行モデルの売れ行きを損なう恐れもり、発表はないだろうという。

People familiar with the matter say an extensive overhaul to the top-selling Apple consumer desktop machines remains on track for an unveiling later this year, adding that an introduction during company’s Worldwide Developer Conference on Monday would be premature and serve only to disrupt sales of existing models.

その代わりアップルは、今度のデベロッパ会合では、次世代 Mac OS X Leopard の「秘密の」機能改良に的を絞るだろう。それは、昨年の会合で初めてちょっとだけ披露されて以来、事前配布のビルドが出るたびにうわさになってきたものだ。

Instead, Apple is expected to use its annual developer gathering to zero-in on “Top Secret” enhancements to its next-generation Mac OS X Leopard operating system that have been lingering beneath the surface of pre-release builds since the software was first previewed at last year’s conference.

流通状況も変化なし

火曜日に MacBook Pro がアップデートされる直前のサプライチェーンの様子と違って、iMac については流通に特段の変化はなく、入手状況も普通だ。加えて、大量購入のディーラーも、かなり先までちゃんと入荷できる予定だという。

Unlike a supply-chain pattern that manifested in the weeks and days leading up to Tuesday’s MacBook Pro revamp, checks into the availability and channel flow of existing iMac models revealed no disruptions and normal availability. Additionally, high-volume dealers are expecting an uninterrupted stream of iMac shipments for the foreseeable future.

よく読むと、Think Secret と AppleInsider が異なるのは、来週の WWDC で発表されるかどうかという点だけのようだ。

などはいずれも共通だ。

こうなると iMac に大幅なデザイン変更が加えられるというのはどうも本当らしい。

では、WWDC で発表されるのかどうか。

アップルの発表は常に一歩ずつの積み重ねで、決して一度にすべてを出したりはしないこれまでの状況を見ると、AppleInsider の方に分がありそうな気がしないでもない。

少し視点を変えてみよう。

WWDC 最大のテーマ Leopard の披露は、どのデモマシンを使って行われるのだろうか。

ひょっとして前触れなしに発表された８コアの Mac Pro が、Leopard の登場によって遂にその実力を発揮するのか。

それとも、Leopard 時代にふさわしい実力を備えた iMac が新たに登場するのか。

より高級モデルとして位置づけるという点がどうも気になる。

これはもう、月曜日の来るのが待ち遠しい・・・

アップデート：情報筋はアップルが来週［iMac の］発表を行なう計画であると確信しているが、発表日時には変更があったもしれない。もしその場合には、アルミの iMac は翌週に出る可能性が高い。

Update: While sources are confident that the company’s plans have called for an announcement next week, they caution that the release schedule may have changed. If that proves to be the case, the aluminum iMacs would presumably follow in the ensuing weeks.

当初の記事に比べて Think Secret はいささか後退したようだ。いずれにせよ、あと数日すればハッキリする。

Think Secret がまたスクープをものにしている。アップルの株主総会を詳細に報告したのに引き続き、今度は Aperture 開発チームの大幅縮小の話だ。

Aperture は、RAWフォーマットに対応したプロ用画像管理ソフトだが、Think Secret の伝えるところでは、アップル製品としては珍しく箸にも棒にも引っかからないものだったらしい。

Aperture 開発チームのエンジニアの一部は解雇され、あるいは他部門に吸収されたが、このことからプロ用画像管理ソフトであるAperture の将来については疑問視されている。同ソフトは、これまでも激しく批判され、近年になくバグまみれのソフトだったからだ。

The move, which resulted in the departure of several engineers while others were transferred to different projects inside Apple, raises questions about the future of Aperture, Apple’s most heavily criticized and bug-ridden pro software release in recent years.

アップル内部に詳しい筋によれば、こんなことになっても驚かないという。なぜなら、Aperture の開発はアップルでもまれにみる最悪の状態で、めちゃくちゃ（mess）だったからだ。

Sources familiar with Apple’s professional software strategy said they were not surprised by the move, describing Aperture’s development as a “mess” and the worst they had witnessed at Apple.

Aperture の問題は、特定の部分だけではなく、アプリケーションそのものの基本構造に関するものなので簡単には解決できない。

Aperture’s problems stem not from any particular area that can be easily remedied but rather from the application’s entire underlying architecture.

さらに Think Secret は、開発の一部が Shake や Motion に移行されたこととも関係しており、値引きに追い込まれていることなどについても触れたほか、Aperture と競合する Adobe の LightRoom（無料ベータ版）が出現した影響も大きいと述べている。

Aperture の問題はかなり広汎に及んでいるので、バージョン 2.0 を出すためにはコードの主要な部分を完全に書き直さなければならないだろう。

Perhaps the greatest hope for Aperture’s future is that the application’s problems are said to be so extensive that any version 2.0 would require major portions of code to be entirely rewritten.

RAW データを扱えるスゴいソフトとして鳴り物入りで登場した Aperture がそんなことになっていたとはつゆ知らなかった。

確かに Ars Technica のレビューをみると散々だ。

Daring Fireball の John Gruber は、大筋で Think Secret を認めながらも、アップルが Aperture から手を引くことはないだろうと述べている。

Aperture が書き直されなければならないという大筋においては、Think Secret の記事は正しい。しかし、Aperture の将来が疑問だという点ではまったく間違っている。

Think Secret is right that major portions of Aperture need to be rewritten, but they’re wrong that Aperture’s future is in any way “in question”.

アップル内部の話によれば、Steve Jobs が Apertureを大変気に入っているという。アップルが Aperture を開発し続けることに疑問はない。これからも Aperture のバグをとって修正するだろう。問題は、誰が、何時、如何にしてということだ。Adobe が Lightroom をもってアップルの胸元に迫っていることを考えれば、きっと可及的速やかに行われるだろう。

Word within Apple is that Steve Jobs himself is enormously enamored of Aperture. There’s no question what Apple is going to do with Aperture: they’re going to fix it. The questions are just how, who, and when. And with Adobe breathing down their necks with Lightroom, my guess to the last question is “as soon as possible”.

大手誌のビジネスウィークまで、Think Secret の話に乗っている。

Think Secret の記事を引用したあと、これは Adobe がインテルマック版 Photoshop を来年前半にリリースすると発表したことと関連していると述べている。

これらの動きは、Adobe の Bruce Chizen がインテルマック用の Photoshop（マックにとって最も重要なアプリケーションのひとつ）を来年前半には必ずリリースすると確認したあとに起きている。［だから、そのことと関係がある。］

But the move comes about a week after Adobe CEO Bruce Chizen confirmed that the company will indeed develop its Photoshop application – one of the most important apps on the Mac – for Intel based Macs by the first half of next year.

Think Secret

マックの噂系サイトはたくさんあるが、予測の正確さで群を抜いているのが Think Secret だろう。

的中率にたまりかねたアップルが訴訟を起こしたとき、実は現役のハーバード大生のサイトだと分かって皆唖然としたものだ。現役の大学生が、業界の裏事情に通じているなんて想像も出来なかったからだ。

いろんな噂が横行していても、Think Secret が書くと内容確定となるほど信憑性が高い。なにせ大手紙も一目置くほどだから。

AppleInsider

その Think Secret に一矢報いたのが AppleInsider だ。

先のビデオ iPod を最初から予測したのが AppleInsider だった。そうではないといっていた Think Secret も発表前日には態度を変えざるを得なかった。

AppleInsider の活躍ぶりには目覚ましいものがある。来年一月の MWSF（Macworld San Francisco）で発表されるインテルマックついても着々と報じている。マックファンにとって目を離すことができないサイトだ。

この AppleInsider の記事を日本語に翻訳しているサイトがある。silvervine 氏の 774 だ。とてもキチンとした訳で、並々ならぬ力量と拝察する。しかも、翻訳がアップされるスピードがとても早い。日本のファンにとっては必見のサイトだろう。

内容とタイミング

ところで、ビデオ iPod では結果的に AppleInsider に軍配が上がったが、Think Secret の読みが全然間違っていた訳ではない。後日 Power Mac や PowerBook が実現したからだ。

それぞれの内容は相当な確度でそれぞれに正しかったのだと思う。ただタイミングまでは読み切れなかったということではないか。

内容を縦糸に、タイミングを横糸に読み解くとき、噂系サイトの情報が生きてくるのだろう。

MacRumors

噂系サイトは Think Secret と AppleInsider だけではない。

MacRumors も古手のサイトだ。噂のデパート的で取りこぼしがない。出所不明の（あるいはソースを明らかにできない）噂を扱った「Page 2」もあっておもしろい。噂にも確実な噂とそうでないものがあるという訳だ。

MacRumors には「Buyer’s Guide」というページもあって、発表されてからどのくらい経ったか、ぼつぼつ新しい機種が出そうなので買い控えた方がいいのではないか、といった情報を教えてくれるので便利だ。

Rumor-Watch

記事のタイトルだけを一覧にした便利なサイトもある。Rumor-Watch だ。時間はないけれど全体の感じを掴みたいひとには便利だ。英語が不得意でも、なんとなく感じが掴めるところがありがたい。

このほかにも、macosXrumors、Spymac、MOSR、O’Grady’s POWERPAGE、Mac Night Owl など枚挙にいとまがない。

いつもならせいぜいひと月前に流れはじめる噂が、今年は二か月も前から漏れはじめている。インテルマックへの期待がそれだけ大きいということだろう。
