i have had a dispute with Tiscali that has run for over two years. They claimed that I owed them money for an account that had been closed by them. They didn’t want much – just £9.00. But I wouldn’t pay because I didn’t owe them anything – they paid me when they closed my account (by mistake!)

They wrote on four separate occasions demanding the money. Each time I phoned and wrote and they said they would cancel the debt. Each time they wrote again. Eventually they put the matter in the hands of a debt collecting agency. The nice young man there said that they would look into it and call me back. They didn’t call.

Some months later they wrote again – this time a very threatening letter.

I  wrote back threatening to sue them – and hey presto, they have admitted their mistake.

But here’s the question. It has cost me more than £9.00 to defend this claim for money not owed. Should I simply have paid up in the first place?

The UK Internet Service Providers Association ( ISPA ) and broadband ISP TalkTalk ( The Carphone Warehouse , Tiscali , AOL etc. ) have both come out in strong opposition to some of yesterdays Digital Economy Bill measures, which have been designed to tackle illegal downloading.

The Bill proposes that the Government can introduce new measures to punish people they think are infringing copyright without having to prove their case in court. This so-called secondary legislation appears to side-step any debate, oversight or public scrutiny. Both are particularly concerned that the proposals grant far too much control to the Secretary of State, who will have the power to make specific recommendations on costs and impose an obligation on ISPs to use technical sanctions. The ISPA believes that an independent body would be a fairer way to assess these factors.

ISPA Secretary General, Nicholas Lansman, said:

“ISPA is extremely disappointed by aspects of the proposals to address illicit filesharing. This legislation is being fast-tracked by the Government and will do little to address the underlying problem. Rather than focusing blindly on enforcement, the Government should be asking rightsholders to reform the licensing framework so that legal content can be distributed online to consumers in a way that they are clearly demanding.”

ISPs believe that to reduce illegal filesharing, music and film fans must be encouraged back to legal services through education and by making content available in a form and at a price that people find acceptable. TalkTalk’s own research shows that over 85% of people think there is not enough legal music and film content available on the Internet at a fair price. Dunstone has again reiterated his promise to only release customer details to rights holders following a court order, although ironically yesterdays Bill promised that details would only be released to copyright owners for further action “after obtaining a court order“. TalkTalk added that they would refuse any request to cut-off customer accounts and take legal action to protect their users.

Meanwhile the ISPA has also raised concerns about the allocation of cost. Consistent with the principle of beneficiary pays, ISPA rejects an apportioning of costs and believes that rights holders should shoulder this burden including reimbursement of ISPs’ reasonable costs. Presently the copyright owners will only pay the cost of notification letters. Both TalkTalk and the ISPA also oppose all of the new technical measures, which include the ability to slow a customers connection, block illegal sites and services or even cut-off user accounts, and have called for them to be dropped from the bill. Sadly we fear this is highly unlikely to happen as the government has proven unwilling to listen. It should be noted that ISPs do appear to support the notification / letter warning system.

So, yesterday I returned to Witney.
I set off early in an attempt to miss the Friday traffic – but to no avail!
I take a fast shortcut from Honiton to jump on the M5 at Taunton that saves me around half an hour – but as I approached Bristol, my shortcut and time saving soon evaporated!
With information boards warning of an accident a few miles ahead, I detoured via the M4 and head for the A46 turn off and Cirencester. Driving past Highgrove House, glancing to see if one of the young Prince’s had borrowed a helicopter for the weekend, I cut through the amazing small market town of Tetbury wondering why I’d not travelled this road for so long, or moreover – in my truck! A few miles later the answer appeared in the form of a single width very, VERY low bridge – a noise in my mind going something like “Ahhhhh” in full realization.
It’s been so darn long since I travelled on some of these roads I had all but forgotten them.
Heading north of Cirencester I cut up an old ‘B’ road, a nice route to the A40 and Burford – not that I could enjoy the scenery as it was both dark and raining heavily. Flying through the village of Bibury nearly ended in disaster as I forgot about a bridge over the river Thames (or Coln, I can never remember) with a sharp right hander straight after with a pub opposite – a pub I was almost serving pints in, from the passenger seat!!!

Arriving at my destination I got straight down to issues of family business and also hooked up the new WiFi.

It’s fair to say, personally I’m not impressed with Tiscali, I use the very same equipment at home and had no bother at all hooking it up and connecting – not so with Tiscali. I most certainly noted that I’d never use this lot as my person broadband provider!!
There are some annoying defects in their software too, but they didn’t seem bothered about this at all. Even had to call their tech support who tried to tell me – and keep telling me, that I had put the password in incorrectly!! Which for the 1000th time of doing so – I hadn’t. They reset the password (when they couldn’t do it either and upon doing so all things worked – for 5 mins!
They ended the conversation and perpetually accusing me of rubbish by asking me to rate their help via email – yeah, they might not like what I write, but I’ll oblige for sure!.
After saving everything and restarting the laptop – nothing!!! I could connect via Ethernet, but some how the laptop no longer held any of the WiFi config. Infact what it did, was initially connect, only to then have the connection stopped – I assume by Tiscali or their software. The WiFi card would connect then stop.
So, Tiscali with their overtly patronizing helpdesk and a lot of messing around and money spending I recommended to get a more modern Laptop and use a proper Internet Service Provider.

The return journey was in dense fog and led me to take a diversion to have a look at a house near Nailsworth. Obviously I couldn’t see a damn thing, but at least I know where it is now lol.

Today I looked back at yesterday and was trying to think of a single thing I enjoyed, yet I simply could find anything – some days are just like that I guess.

L’Antitrust torna a sanzionare le società telefoniche. Con tre distinti provvedimenti l’autorità guidata da Antonio Catricalà interviene sulla gestione del servizio Adsl, per carenza di informazioni sulla velocità di connessione e, per quanto riguarda Tele2 e Wind, anche per la mancanza di informazioni sulla tariffa a tempo, che contabilizzava anche il periodo in cui il pc era spento ma il router rimaneva acceso.

Complessivamente le sanzioni sono pari a 260.000 euro (120.000 euro a Tele2, 90.000 euro a Wind, 50.000 euro a Tiscali). Si tratta di casi per i quali l’Antitrust ha ricevuto moltissime segnalazioni dai consumatori.

La questione non è nuova. In un comunicato della SIAE del 4-9-2008  veniva data notizia della sentenza resa dalle sezioni specializzate in materia di proprietà intellettuale e industriale del Tribunale di Roma, con cui la SIAE aveva ottenuto un risarcimento danni considerevole, pari a complessivi 40.000 euro, a carico di Tiscali, per l’illecita riproduzione di opere d’arte (in tutto non inferiori a 335), rientranti sotto la tutela della legge sul diritto d’autore (per un commento si veda, tra i tantissimi apparsi su Internet, quanto già riportato su Punto-Informatico da Luca Annunziata).

Tiscali, infatti, aveva diffuso sulle pagine del proprio sito web, in un’apposita sezione dedicata all’arte, numerose opere di celebri pittori, senza ottenere l’autorizzazione da parte degli autori o degli aventi diritto e senza corrispondere i compensi tramite la SIAE.

Come riferito nel predetto comunicato, oltre al risarcimento dei danni la pronuncia resa dal Tribunale di Roma contempla anche

l’inibizione della riproduzione, con ordine di immediata rimozione delle opere dal sito Internet (…) e la pubblicazione della sentenza sui due principali quotidiani italiani, Corriere e Repubblica.

Quanto alle modalità della violazione, nel comunicato si legge che

Molte opere di oltre 170 pittori famosi, tra cui Balla, Chagall, De Chirico, Francesconi, Giacometti, Guttuso, Klimt, Magritte, Mirò, Morandi, Picasso, Severini, Sironi, Tadini, erano state riprodotte nella sezione “Arte” del sito Internet di Tiscali, con possibilità per gli utenti di ingrandire, stampare o inviare le relative immagini.

Le riproduzioni di opere in formato digitale erano, infatti, conservate nel sito per più giorni ed erano consultabili dopo anni, con possibilità di essere riprodotte in cartoline e utilizzate per giochi interattivi e avevano ad oggetto interi repertori di opere. Niente “diritto di cronaca”, ma riproduzione illecita di opere tutelate, con vero e proprio scopo di lucro, come dimostra l’inserzione di annunci pubblicitari nella pagina web.

Quanto alla linea difensiva di Tiscali, disattesa dal giudice romano, si apprende che

La Società Tiscali aveva eccepito la legittimità della riproduzione di tali opere – in quanto funzionale all’informazione su mostre, musei e tutto ciò che accadeva nel mondo dell’arte – secondo quanto previsto dall’art. 65, 2°comma della legge sul diritto d’autore, che consente la riproduzione o comunicazione al pubblico di opere protette, ai fini dell’esercizio del diritto di cronaca e nei limiti dello scopo informativo su avvenimenti di attualità. Il Tribunale (…) [aveva] riscontrato la mancanza di tali presupposti (e cioè la citazione temporanea ed attuale di un’opera, in relazione a una mostra o a un’esposizione di opere d’arte in corso e la sussistenza del mero scopo informativo) (…)

Sarebbe interessante rileggere la sentenza, per comprendere meglio le modalità per il computo del risarcimento del danno, quantificato sia con riferimento al danno patrimoniale che al danno non patrimoniale.

In questa pagina di commento in Norme e Tributi de Il Sole 24 Ore si apprende che il risarcimento disposto con la predetta sentenza (n. 8481/2008) è stato ripartito in 30.ooo euro per il danno patrimoniale e in 10.000 euro per quello non patrimoniale, il cui riconoscimento in favore della SIAE rappresenterebbe una novità.

Il caso ha fatto molto parlare anche per via delle strade da percorrere per la fruizione dei prodotti culturali su Internet.

A dire il vero, però, non mancano iniziative in cui la diffusione on-line di opere d’arte digializzate, con elevata risoluzione, sia stata realizzata senza alcun intento lucrativo (neanche con spazi pubblicitari a pagamento presenti sul sito o altre trovate commerciali).

Al riguardo, per chi volesse godere della visione accurata di un patrimonio enorme di opere d’arte (767 dipinti, da 116 sculture, 51 oggetti e arredi di significativo pregio storico e artistico), vi segnalo il Progetto ARTGATE della Fondazione Cariplo, raggiungibile ai seguenti link: collezione on-line (con motore di ricerca e possibilità di zoom) e galleria virtuale.

Si tratta, ovviamente, di immagini non “degradate”. Ad esempio quest’opera, ricca di particolari, riprodotta al 5% nella prima visualizzazione, può essere ingrandita fino al 100% e visualizzata anche a schermo intero.

Tale progetto è la dimostrazione di come sia assolutamente possibile realizzare  progetti ICT di diffusione on-line di immagini digitalizzate, gratuitamente fruibili per l’utente, ad una definizione decisamente appagante. La giurisprudenza sopra richiamata non rappresenta certo un ostacolo alla realizzazione di pratiche virtuose come questa.

Tinet, formerly the international IP wholesale carrier arm of Tiscali Group, continues to grow and now, with the backing of its new financial investor, its international growth ambitions know no bounds. In particular, Tinet’s end-to-end, last-mile Ethernet extension service is attracting high levels of interest among local B2B service providers.

With the explosion in the requirement for network-centric applications, the corporate market requires greater broadband performance and reliability than ever before. This includes the ability to connect globally, with quality service levels that support consistent high-speed network connectivity.

While international services will always rely on local third parties to provide the last-mile connectivity, Tinet’s end-to-end service level guarantee, and single interface, adds significant value, ensuring the performance and continuity of critical business applications including VoIP, data synchronisation for disaster recovery, and real-time financial transactions.

International IP transit: the foundation of any global business

IP transit is now a basic building block in any internet-based service solution, yet the weight on its shoulders is substantial. Come vi avevo promesso ecco il post sulla configurazione di Mutt e Fetchmail per ricevere e spedire email. Ipotizziamo che io mi chiami Tullo Ostilio e abbia due indirizzi email, uno su Tiscali (POP3) e uno su GMail (IMAP). Ma vediamo la configurazione di Fetchmail e Mutt (Fetchmail scarica la posta, Mutt la legge).

Un minimo di conoscenza del funzionamento delle email non guasterebbe, comunque sappiamo almeno che il server POP (e IMAP in alcuni casi) viene utilizzato per ricevere la posta, mentre il server SMTP viene usato per inviare la posta. Dobbiamo inostre conoscere il valore da inserire per POP3 e SMTP.

Questi sono i dati:

le password sono adatte per farsi rubare le email.

Qualunque procedura abbiate seguito dobbiamo ora dare i giusti permessi al file .fetchmailrc:

Adesso scarichiamo la posta col comando:

ci sono anche varie opzioni, ad esempio se volete attivare il demone di fetchmail e fargli scaricare la posta ogni ora (3600 secondi) diamo questo comando:
$ fetchmail -d 3600
per far si che la posta venga scaricata ma ne rimanga una copia sul server date il comando:
$ fetchmail -k
Scrivete:
$ man fetchmail
per conoscere le altre opzioni.

Possiamo anche utilizzare cron per automatizzare il tutto.

MUTT – Adesso vediamo come utilizzare Mutt, un programma leggero e potente che usiamo semplicemente dal terminale. Ovviamente meglio leggersi una guida ben fatta, qui espongo solo parzialmente e superficialmente alcuni punti.

Avviando per la prima volta Mutt, questo creera’ la directory Mail nella nostra home. Ora dobbiamo modificare (o creare) il file di configurazione di mutt.

La configurazione di Mutt non e’ semplice, guardate un esempio di file .muttrc bello grande o questa pagina con esempi anche per alias e altro.

Era un umido mercoledì quando entrato nella mia nuova casa, iniziai a configurare La Fonera. Ero fiducioso nelle tecnologie di autoconfigurazione e  impaziente di navigare. Ma la mia fiducia fu ben presto tradita.

Quella dannata spia Power non voleva diventare verde per nessuna ragione fino ad oggi.

La mia Fonera otteneva la configurazione degli indirizzi in DHCP mentre il modem si preoccupava di dare le credeziali al provider e stabilire quindi una connessione.

In realtà il problema stava proprio nell’assegnamento DHCP (che a quanto pare nei modem D-Link ha qualche problema con diversi sistemi) ,  inutili tentativi di utilizzare ip statici di vario genere, con instradamenti particolari e quant altro.

La soluzione tanto semplice quanto efficace era quella di lasciare alla fonera il compito di identificarsi con il Provider. Sembrava semplice come suggeriva tiscali bastava creare una connessione PPPoA e dare le proprie credenziali.

Eccolo il problema, La Fonera non supportava il PPPoA ma solo il PPPoE e quindi non si poteva fare o forse si?

Eccola la mia configurazione funzionante:

- Modem: Bridge mode (VC-Mux)

- Fonera: PPPoE (con vostri username e pass)

e già, mi sto chiedendo ancora adesso la reale differenza tra PPPoE e PPPoA, la prima e acronimo di Point-to-Point Protocol over Ethernet la seconda Point-to-Point Protocol over ATM.

Possibile che l’unica differenza sia il tipo di ingresso (RJ11 vs RJ45) o Tiscali supporta anche il PPPoE, o ancora e il modem che fa qualche sorta di traduzione?

Comunque ora riesco a navigare tramite la Fonera senza problemi, primo o poi approfondiro questi dubbi sui tipi di connessione ADSL.

Si chiama Tiscali WiPhone, e la novità sta nella convergenza inedita tra fisso, mobile, e rete internet: un sistema che installato sul cellulare permette, appoggiandosi ad una rete internet Wi-Fi, di fare chiamate gratuite a tutti i fissi nazionali. Ma consente anche un canale privilegiato verso ogni altro apparecchio WiPhone, con cui scambiare telefonate e sms senza spendere un centesimo.

“L’obiettivo è conquistare nuovi clienti puntando tutto sull’innovazione”: sono queste le parole con cui Renato Soru (foto sulla home), amministratore delegato di Tiscali Italia, ha presentato il nuovo servizio dedicato alla telefonia.

Cos’è WiPhone

Se all’inizio ad intuire la convenienza del mix di voce e web è stato Skype, ecco dunque che Tiscali ne segue la filosofia, seppure su  una strada diversa.

Un esempio per capire meglio: il presupposto è trovarsi in presenza di una rete WiFi (a casa o in ufficio), e invece di usare il telefono fisso, WiPhone entra in gioco con il suo servizio gratuito per tutte le chiamate che non siano verso mobile. Dunque niente spesa dalla cornetta fissa, magari per le interurbane, e ciao-ciao al telefono con il filo (almeno per chi chiama).

Vantaggi ripetibili in altri contesti, sempre in presenza della copertura WiFi. Quindi se si passeggia in un parco, si beve una birra in un internet caffè, o si dorme in albergo: si chiama a casa per le ordinarie comunicazioni di servizio, gratis.

Qualche dubbio da esaminare nel merito

L’amministratore delegato di Tiscali porta dalla sua qualche dato: “Oltre il 50% delle chiamate fatte con il cellulare partono da casa o dall’ufficio e sono destinate a utenze fisse”. Ma – certo – se rientrate tra la platea che usufruisce di un pacchetto flat, per cui pagate una tariffa fissa indipendente dal “consumo” di telefonate, il vantaggio perde qualche colpo (anche perché dai pacchetti sono generalmente esclusi proprio i cellulari).

La copertura WiFi in Italia in luoghi pubblici, poi, non risulta molto diffusa. “Non vogliamo fare concorrenza ai servizi mobili”, ha dichiarato Soru, “Ma di recente McDonald’s ha iniziato ad offrire il servizio, sul modello di Starbucks”. Come a dire: una tendenza in evoluzione.

Come funziona il servizio

Per capire al meglio vantaggi e convenienza del servizio – comunque – è bene capirne funzionamenti e costi.

Prima di tutto per aderire al servizio non serve cambiare operatore mobile, o Sim. Bisogna scaricare un software da installare sul proprio cellulare, e il gioco è fatto.

Da quel momento WiPhone farà tutto da solo. Vi avvertirà quando siete in presenza di una connessione WiFi, e automaticamente, quando digiterete un prefisso verso un fisso (come lo 06 per Roma o lo 02 a Milano), utilizzerà la copertura ad hoc.

E se invece dovete chiamare un cellulare? WiPhone passerà automaticamente alla rete “tradizionale”, con la tariffa prevista dal vostro operatore. Naturalmente è sempre possibile continuare ad usare il WiFi, ma in quel caso il costo è quello previsto da Tiscali.

I costi: eaminiamo i pro e i contro

E qui arriviamo al portafoglio. Quanto costano le chiamate ai cellulari con WiPhone? E il servizio in toto? Se gratuite sono le chiamate verso i fissi nazionali, le chiamate e gli sms verso un altro WiPhone; le telefonate verso altri cellulari Tiscali si pagano invece 8 centesimi al minuto; e verso gli altri operatori 15 centesimi (entrambi senza scatto alla risposta). Per il servizio in sé, invece, WiPhone costa 5 euro di canone mensile.

WiPhone per ora non è per tutti… i cellulari

Ora che sapete come funziona, se vi chiedete come averlo, sappiate che WiPhone non è per tutti. O meglio, per tutti i cellulari. Il vostro “telefonino” deve infatti essere dual band, e al momento il servizio funziona solo con i Nokia (cliccando sul link potete vedere i modelli che supportano il software).

Ma presto, assicura Tiscali, sarà a disposizione anche Samsung con sistema Symbian, iPhone, Blackberry, e Htc.

Per saperne di più, sappiate che Il servizio può essere sottoscritto online questo indirizzo, oppure chiamando il 130, o presso uno dei punti vendita convenzionati Tiscali o presso i negozi Buffetti. Tiscali wiPhone è un servizio nato per la convergenza fisso-mobile permettendo di utilizzare un telefono wi-fi in duplice modalità. Unica necessità è installare uno specifico software.

Fatto questo, ha spiegato l’ AD Renato Soru, basta collegarsi dal proprio cellulare a una rete wi-fi per usare il servizio wiPhone. Inizialmente è disponibile solo su alcuni modelli di cellulari Nokia, nei prossimi giorni sarà allargata a tutto il mondo Symbian e nelle prossime settimane dovrebbe seguire gli altri modelli di alta fascia, come BlackBerry e iPhone.

Ci sono numeri specifici sulla decade dedicata ai numeri VOIP nuova numerazione con il prefisso “55″ in entrata e in uscita. Le telefonate fisse nazionali sono gratuite, così come le chiamate e gli sms verso altri telefoni wiPhone.
