Criminal Sale of a Controlled Substance ("CSCS") in the Third Degree

The controlled substances offenses are all classified under Section 220 of the New York State Penal Law. This is where both the possession, possession with an intent to sell, and the sale charges are.

Criminal Sale of a Controlled Substance in the 3rd Degree reads as follows:

A person is guilty of criminal sale of a controlled substance in the third degree when he knowingly and unlawful sells:

a narcotic drug

Definitions:

Narcotic - This is defined in NYS Penal Law 220.00(7) as any controlled substance listed in I(b), I(c), II(b) or II(c) other than methadone, listed in section thirty-three hundred six of the public health law.

Controlled Substance is defined in NYS Penal Law 220.00(5) as any substance listed in schedule I, II, III, IV or V of section thirty-three hundred six of the public health law other than marihuana, but including concentrated cannabis as defined in paragraph (a) of subdivision four of section thirty-three hundred two of such law.

Sale – The word sell here means to sell, exchange, give or dispose of to another. This is defined in NYS Penal law 220.00(1). This will also include when a seller makes offer to sell or an agreement to sell even if the transaction is not completed. The requirement being that the “seller” must have had the conscious intent to make the sale.

Knowingly – A person knowingly sells when that person is aware that he/she is selling a substance which include the controlled substance.

Unlawfully – This is that the individual charged has no legal right to sell it. This is defined under NYS Penal Law 220.00(2) and refers to a violation of Article 22 of the Public Health Law. Under the law there are exceptions where individual are allowed to sell controlled substances.

This statute does not specify the amount of narcotics that need to be sold for one to be charged and subsequently be found guilty of CSCS in the 3rd Degree. Any amount of narcotic will suffice.

CSCS 3rd Degree is class B non-violent felony.

He was a writer. No, not a regular blogger or someone who writes witty status messages. A proper writer. One who goes to book reading sessions and signs his own books, that kind of proper writer. His last book was published 3 years back. He was kicked left, right and center by the critics. The protagonist of his last novel, a police inspector who worked undercover as a porn-star to invade the piracy mafia, died due to prolonged erection, keeping the suspense alive and making way for a sequel.

Critics thought this novel sent out a wrong message by glamorizing pornography and the association of porn artists accused him of defamation, and of course there was a lawsuit too. The sequel got lost somewhere and readers too found that the only interesting thing in the novel was how April, the porn queen, gets free from the mafia and realizes her dream of napkin showrooms.

Somewhere between all this he hit the writer’s block. And he had been at this block ever since. But tonight, before going to bed, he knew things will change tomorrow. He promised himself, he will write again. No particular idea as such, the first thing that he sees tomorrow, will be the theme and will mark the new beginning. He made one last peg, carried it to the oak table by the bed and lied down, resting his head on his interlocked elbows. The drink remained there, waiting all night while he slipped into the world of unpredictable possibilities.

He deliberately kept his eyes closed. He could see the mix of orange and yellow from the sunlight showering his face. He turned to the other side. The color changed to black with a rather darker shade of green. He knew he will write about the first thing he sees. He was careful. He created a visual model of whole room in his mind. He located the oak table, the window, the photograph, stack of magazines and even the slippers. While all this was happening in his mind, an automotive motion made him sit with his legs swinging from his bed and his feet touched the slipper-soft, warm and white. He slipped in and the feeling transformed to that of wet sticky clay wrapped around the bottom of his smaller fingers. He panicked but by that time he had slipped his whole feet and had opened his eyes. Apparently, his dog, Adolf, beat him in waking up as well as first set of daily rejections. He pronounced Shit in all possible intonations and with all possible expressions. But he could not go back. Shit will be his new beginning. Shit will be the medium to express his ideology, ethics and philosophy to explore the intricacies of life. Shit it is, and why not? It has a universal appeal. Writing about shit was not a problem the amount on his feet and empty water tank was.

But he decided to overcome these humanly obstacles. He grabbed a piece of paper and, in the thick smell hanging in the air, he wrote the name of his upcoming romantic saga- EXCRETA.

Whenever someone frets about the erosion of personal freedoms in our modern society, such as in the steady proliferation of surveillance cameras in public places, the stock answer, which is one I read all too often in my e-mail, is:

“If you haven’t done anything wrong, you have nothing to worry about.”

People who say this are fools, not to be too blunt about it. Not only are they willing to trade away my rights, since they haven’t a basic appreciation of theirs, but their understanding of the relationship between government and the governed is one of subservience based on fear, and the idea that their fear is not only natural, but justifiably permanent given the state of the world.

Thus, we should all be fearful, all of the time. We should empower government to do whatever it feels necessary to protect us. The unquestioning nature of this logic not only institutionalizes fear, it makes it a patriotic duty. And the good citizen, the one who has done nothing wrong, will have nothing to worry about.

Oh, yeah?

Out of Britain comes the case recently of 40-year-old Jenny Paton, mother of three and, in the eyes of the state, a security hazard. Her crime? She was suspected of falsifying her address to enrol her daughter in a neighbouring school.

A covert surveillance operation was begun on her in 2008, when — and I am not making this up — an officer from the local education department followed her for three weeks. He noted her movements in a log. The department obtained her telephone records.

Paton had done nothing wrong. And the local council where Paton lives maintained it had nothing wrong, either. Under the Regulation of Investigatory Powers Act of 2000, local governments have the power to use surveillance to investigate such picayune matters as reports of people not cleaning up after their dogs, or whose dogs bark too loudly, of people who don’t recycle or who put out their trash early, of people who operate unlicensed taxicabs. Some 474 local governments and 318 agencies have availed themselves of these powers (including, hilariously, the Charity Commission), and they can, and do, use hidden cameras, examine phone records, track website visits and hire people to go undercover.

According to a New York Times story on Paton’s case, which is being heard by a regulatory tribunal, local governments in Britain not only use these surveillance powers regularly, they “self-authorize” such activities outside the scrutiny of the judicial and law enforcement systems. One government report found that some 10,000 “directed surveillance missions” had been undertaken in a single year.

Britain, once the crucible of parliamentary democracy, is now a surveillance state, and is more insidiously Orwellian than Orwell could have ever imagined. It has an estimated 4.2 million closed-circuit TV cameras — one for every 14 citizens — and new powers allow police there to access telecom records without judicial authority. In 2007, they did so 500,000 times.

What has this all to do with us?

We are putting on an Olympics. The security budget, as best as non-government sources can estimate, is now in the range of a billion dollars. Included in that will not only be the cost of toys such as an armoured personnel carrier, but a rumoured 900 to 1,100 CCTV cameras for surveillance of Olympic venues and city entertainment areas.

There is nothing wrong with this, despite the ludicrous overkill. Security at events like these is a good thing. And the powers that be have assured the public that the CCTV cameras were temporary in nature and would all be removed once the Olympics had finished.

Well, hmmm. Colour me skeptical. Earlier this year, the City of Vancouver announced it would be retaining 10 of those cameras to be deployed on a mobile basis by police as they saw fit, and that they would be monitored out of a permanent control room at the city’s emergency operations centre.

A small matter? Numerically, yes, but cumulatively, no. Small matters add up to big trends. And what big events like the Olympics do is normalize the idea of security as an antidote to our constant state of fear. They are now as much of an Olympic legacy as debt hangover. So we spend a billion dollars to counteract every possible attack, including domestic, foreign or yet to be imagined, and get ever used to the idea that we must let governments do whatever they must — including trampling on our right to privacy — to protect us.

Sociologist David Lyons of Queen’s University has a good line on this. He said surveillance efforts are no longer being based on “insurable risks” — where risk was assessed on historical precedent — but have shifted to “incalculable risks” — those unimaginable acts of terrorism like 9-11 that government maintains can be countered only by increased security and surveillance.

In that sense, to allude to that hoary Bush-ism, the terrorists have won.

We not only fear the terrorists, but our governments, too.

Lila Rose announces new undercover mission to expose Planned Parenthood

From exposing Planned Parenthood’s cover-ups of sexual abuse to accepting donations targeting black babies, she’s uncovered it all. There were videos of Planned Parenthood across the country, in multiple cities in multiple states, using similar tactics and techniques at each clinic.

Now, Lila Rose has unveiled a new project, the Rosa Acuna Project. This is designed to show how Planned Parenthood lies and manipulates women to coerce them into getting abortions. The first video, from Appleton, WI showcases just how far their “counselors” will go to get another sell.

New undercover footage from an Appleton, WI Planned Parenthood abortion clinic shows clinic staff, including the abortion doctor, lying to two young women about fetal development and encouraging the one who is pregnant to obtain an abortion because “women die having babies.”

In the undercover video, when the two women ask a Planned Parenthood counselor if the pregnant woman’s 10-week-old unborn child has a heartbeat, the counselor emphasizes “heart tones,” and answers, “Heart beat is when the fetus is active in the uterus–can survive–which is about seventeen or eighteen weeks.” On the contrary, embryologists agree that the heartbeat begins around 3 weeks. Wisconsin’s informed consent law requires that women receive medically accurate information before undergoing an abortion.

The counselor then says, “A fetus is what’s in the uterus right now. That is not a baby.” Dr. Prohaska, the abortion doctor, insists, “It’s not a baby at this stage or anything like that.” Prohaska also states that having an abortion will be “much safer than having a baby,” warning, “You know, women die having babies.”

[...]“Planned Parenthood is a billion-dollar organization with nearly $350 million of government funding, and stands to gain hundreds of millions more from national health care,” says Rose. “Do we really want to subsidize an organization that gives women in need atrocious misinformation and predatory abortion practices?”

Well, if the abortion providers were smart, they’d take that money from the government and say whatever they needed to say to women to perform as many abortions as possible, and make even more money. And, if the Republicans tried to taxpayer funding of abortions, the abortion providers could just give lots of money to Democrats to get lots of Democrats elected. And those Democrats could vote for government funding of abortion and defeat any amendments to block funding of abortion.

Gateway Pundit reports that Senate Democrats have just blocked an amendment to block funding of abortions with taxpayer money.

Democrats rejected legislation that would have banned federal support for abortions in their nationalized health care bill. That means the democratic health care legislation will result in the biggest expansion of taxpayer-funding of abortions since Roe v. Wade.

Regular readers of Catholic Heart and Mind will remember that I took part in our local 40 Days for Life prayer vigil outside Planned Parenthood in Birmingham. While there I learned that the facility was under investigation and I heard that they had been filmed by Lila Rose as part of an undercover operation, but I’m told they were already in trouble before that. Tonight I found the video about that same Planned Parenthood facility! I’m watching it now. Wow. Seems that, from what I understand from reading their site, and then finding the video on YouTube, that YouTube may have banned it, then restored it but censored it. Amazing that they censored this, considering the kind of things they regularly allow.

Any fan of Cookie Monster on Sesame Street knows that “C” is for cookie.

But at the Obama White House, “A” may be for acorn — as in acorn cookies served at Monday’s annual Christmas party.

The chocolate cookies shaped like an acorn were quite a hit with Rep. Steve King, R-Iowa.

“I didn’t expect to see such stark symbolism,” King said in an e-mail.

President Obama worked with the community organizing group ACORN in the mid-90s. But now ACORN faces a host of allegations related to voter fraud in the 2008 election and has been weakened by an undercover expose that shows employees offering tax advice to a couple posing as a pimp and prostitute.

The irony of the White House dishing out acorn-shaped chocolate cookies seemed a little, well, “nutty” to King. The Iowa Republican is one of the loudest voices calling for Congress to investigate ACORN.

King pocketed several of the acorn cookies at the White House soiree and even stowed a few at home in his freezer. King even delivered a real acorn to House Judiciary Committee John Conyers, D-Mich., in an effort to launch a dialogue about the organization’s legal woes.

“Bill Clinton redefined a two and a three-letter word,” King said, a reference to Clinton’s denial of the Lewinsky scandal . “But from the man who wrote ‘The Audacity of Hope,’ we were served the very redefinition of the word ‘audacity.’”

Can you write about a survey on friendly-fire and omit the survey?

A survey that asked how uniformed NYPD officers treated their undercover brethren made news; this, after an African-American undercover officer had been killed in a friendly-fire incident.

RaceWire.org, ColorLines magazine’s weblog, posted an item about it. But it omitted a link to the survey. When I clicked to the New York City news source, NY1, I found that they had omitted it too.

Before I shared this via Facebook, I refused to do so if I could find the survey; after some minutes of semi-zealous research, I found nothing.

This makes me wonder about what standard news audiences should expect or demand. A sometime mentor, who runs a national radio show, spoke a lesson that stuck in my head: “There is so much bad journalism out there!”

This isn’t a big deal, but…yeah it is.

All news organizations, including NY1 and RaceWire.org, need to abide by consistent rules. Either post the PDF, or a link to the survey, or explain why they do not. If your audience can peruse and scrutinize the survey, they can judge its worth; without it, they have to assume.

Recently, I had a custom order to make a Nancy Drew Duct Tape Sleuth Kit. The buyer wanted it to look similar to the sleuth kit in the Nancy Drew movie. This new bag is different from the original bag I had made. For instance, the straps are made of canvas material, I used Velcro instead of a buckle, and the overall design of the bag is different. I am selling the whole kit with shipping for $60. Here are the pictures of it:

New Lean-To Greenhouse

Protection for seedlings makes all the difference when raising your own plants so Rachel has built a wonderful lean-to greenhouse outside the potting shed/cellar in front of the house that will give protection in both winter and summer.

I think it is great and it has already made my life easier. It did not cost much to make because Rachel used an old aquarium for the glass and timber we had left over from another project for the frame. It is designed to fit standard full size trays and double size trays on the ground with plenty of plant head room as well as slatted shelves to keep air and light circulating.

The green-house is designed and situated in such a way that it will get the most light in winter when the sun is low and the least amount in summer when the sun is high. It is situated next to a large bush on the west side that adds further protection from midday and afternoon sun and is built against the stone wall of the house so that the heat absorbed by the walls during the day will be radiated back at night and keep any frost at bay. The wooden frame is built onto a concrete plinth on a slight slant so that excess water drains off and the roof and sides vent to keep the inside from getting too hot. The roof has a plastic rather than glass lid incase tiles or other debris drop from the roof. All in all it is just perfect for my needs and a safe place to harden off all my seedling plants and propagate the next batch.

Hampir setengah tahun saya ga nulis sama sekali di blog ini, dan bahkan ada saja orang yang membaca blog saya (I thought there was nobody read my post) dan dengan sangat baik hati memberi komentar dan masukan. Saya dapat masukan buat kembali ngeblog dari teman saya, (dan memang saya pun berpikiran begitu). Sudah saatnya saya kembali produktif menulis. Kemarin kemarin saya tidak menulis bukan karena saya tidak mau, tapi keadaan yang membuat saya tidak sempat menulis apapun meskipun di benak saya sebenarynya banyak yang bisa dicurahkan lewat rangkaian kata kata.
Kini saya sudah tidak sesibuk sebelumnya, saya memang benar benar ingin mencurahkan hidup saya untuk kuliah dan aktivitas di kampus saja, tanpa harus bekerja seperti sebelumnya. Kini saya tak lagi seorang tentor bimbel, bukan juga seorang yang harus pulang malam demi mencari uang. Bukannya tak butuh, tapi dari awal memang saya tak membuat uang sebagai alasan utama.
Indahnya hidup seperti ini, pulang kuliah saya bisa dengan mudah pulang ke rumah, mengerjakan tugas dan melakukan pekerjaan rumah lainnnya, maklum tahu sendiri saya memang dari awal kuliah tinggal menumpang di rumah ua saya yang baiknya minta ampun! hehe..
ga enak juga udah hampir tiga tahun tinggal di rumahnya tapi kerap pulang malam dan jarang membantu pekerjaan rumah.
Maka dari itu mulai sekarang mungkin saya akan lebih sering memposting tulisan disini, meskipun saya yakin tidak rutin tapi saya mencoba untuk terus produktif.
