By Denise Tessier

Earlier this month, an UpFront column in the Albuquerque Journal got me so teed off I ended up spreading the gist of it in conversations with friends and family. I wanted to make sure they were aware, too, of what I perceived as an injustice and new level of ludicrousness on the part of the federal government.

What got me going was the Oct. 4 piece (subscription required) about Embudo Valley Organics not selling local organic turkeys this year. If you read the story all the way through – and it’s a crisp, but blood-boiling read – you’re left thinking they were shut down by the feds for not having enough razor wire to prevent Osama bin Laden and anthrax-wielding terrorists from poisoning our food supply.

If you read it again more carefully (which I did, because it all sounded so unjust) the story did clarify about half-way through that the feds “overlooked the lack of anti-bin Laden wire” stressed so strongly in the first part of the article. However, it said, “they dinged the place” on three other problems, all of which seemed equally ludicrous and onerous for a small family farm.

I believed the farm was forced into suspending its turkey operation — and had no reason to think otherwise — because the story appeared well researched, and because I respect the writer, Leslie Linthicum.

Then I got my weekly newsletter from Los Poblanos Organics farmer Monte Skaarsgard, whom I truly hold in high regard.

And he wrote that the UpFront column “is simply not true.”

“We have been friends with the Embudo dudes for seven years now,” Skaarsgard wrote. “We get our feed for our turkeys and chickens from them.”

Skaarsgard went on to say that Embudo is “an amazing business” whose owner, David Rigsby, experienced the “tragic loss” of his wife in the off season.

From the newsletter:

And their assistant farm manager quit right when the season was about to get going.

Feeling overwhelmed, they took the year off to regroup and rebuild their strength. But the federal government did not run them out.

I confirmed what Skaarsgard had written when I talked by phone to a manager at Embudo Valley Organics, who did not want to be quoted because he said he was feeling a little unhappy with the media at the moment (citing the UpFront column). He did say closure of the turkey operation was an “internal decision completely” and that the feds did not shut it down. In fact, I was told the farm plans to sell turkeys next year.

Certainly, Linthicum didn’t make this stuff up.

There were rumors of a federal shutdown months before the column ran, and the farm apparently has had a lot of phone calls as a result. Four months before the column, in fact, a New Mexico chicken farmer not affiliated with Embudo Valley Organics testified at a hearing that Embudo’s turkey operation was already a casualty of federal regulation and had been shut down. The comments were made at a “Listening Session” sponsored by U.S. Department of Agriculture officials in Albuquerque on June 16. (This pdf can be downloaded by doing a search listing “embudo, listening session, turkey”; then read pages 68 and 69.)

Many stories and columns result from hearsay and rumors; the writer’s job is to check them out. The resulting UpFront column packs in a lot of information and research. It quotes Embudo’s owner, David Rigsby, about what the feds allegedly wanted, and the farm’s manager, John McMullin, is quoted as saying said the feds “put a lot of hurdles up that could put a small farm out of business.” (My emphasis added.) The story gives a history of how inspections used to be done by the New Mexico Livestock Board, but were handed over in 2007 to the feds, who are new at the job.

And deep into the story, almost at the end, Linthicum wrote:

The farm is trying to work with the FSIS (Food Safety and Inspection Service), meet the federal standards and get back into the gobbler business next year.

Nowhere does she say the feds shut the farm down. She says the “farm opted out of raising turkeys this year while it sorts this all out.” Yet, it’s a natural conclusion to think federal regulation is why there will be no turkeys this year - and there’s no mention of anything else going on at the farm that might have contributed to the decision to suspend operations.

Looks like the headline writer got that impression, too; the jump headline was: “Turkey Farm Runs Afoul of Feds.” (The front-page headline was “Talking Turkey With Feds May Cause Migraine.”)

Skaarsgard, who like the Embudo farmers, has to work with federal inspectors in order to stay in business, called the column “op ed compost”. He added that it, “surprisingly, . . . ended up on the front page:”

The one page of the paper that you would hope and expect would deliver news and not someone’s poorly researched opinion. . .

Skaarsgard’s comment about being surprised to see opinion on the front page illustrates a point ABQJournalWatch has made about how readers perceive UpFront, a self-described “daily front-page opinion column.”

Skaarsgaard’s comments conclude with this:

Here is the thing that fries me the most: I hate scare tactics. I do not like when the government uses them. I hate it when businesses use them. And I hate it when the press uses them.

Look, we need regulation in the food industry. Period. We have had people die from tainted spinach, so the federal government is trying to ensure our safety. Will they make it all perfect right off the bat? Of course not.

But I have seen way too much fear-mongering this year in regards to food. . . .

Journalists sometimes describe their craft as “threading the needle” – meaning they are being careful about the wording of every sentence in a multi-faceted story like this one and skillfully string those sentences together. Each sentence can be accurate. And when they are, the result is a column or story that achieves a kind of truth. Oftentimes, that is the best one can do with a given subject. And yet, sometimes the result falls short of the whole truth.

Calling it opinion doesn’t change that.

The first and most exciting news is that the new single ‘Shadow On The Wall’ is getting a lot of love from all the right places. I keep hearing it on the radio and screaming out loud with excitement. A big shout out to Phil Marriott from Gaydar Radio. I’ve been listening to his show every night and he’s been awesome playing out all the different remixes! Good news as well on the club chart – if #24 wasn’t great enough last week, I just found out it’s shot up to #9. I’m speechless and so happy.

Most of this week is being taken up with plans for the video shoot. I’ve been picking out clothes and had a rehearsal today and tomorrow we do the actual shoot. It’s all very glam so I’m excited for you to see it. Last week I took a very quick trip home to see my family and my pets and also dropped into Estonian radio stations to see what they thought of the single. They loved it too. Yay!

Lots of news has been popping up in the papers and online too. Yesterday’s Daily Express included the Booker’s Tip which was so heartwarming. I gotta feeling, that this year’s gonna be a good year!!!

Stay tuned to my twitter and facebook tomorrow and I’ll keep you all up to date from the video shoot.

Lots of Love

(Mario Lettieri e Paolo Raimondi)

Regulation Z of The Truth in Lending Act (TILA) has undergone important changes that you need to know about when talking to your clients. These changes take effect for all new applications taken on July 30, 2009 and after, apply to ALL types of mortgage loans in ALL 50 states plus the District of Columbia, and could impact the overall timeline of the mortgage loan origination process.

Here are the four key parts of the new regulation you need to know:

Initial Disclosures. Under the new rules, initial disclosures must be provided to the borrower for all loan types within three (3) business days of when an application is taken or received. Initial disclosures include: the Good Faith Estimate (GFE), Truth in Lending Statement and state-specific disclosures.

Collection of Up-front Fees. The new regulations prohibit lenders from collecting many up-front fees prior to when the borrower receives the initial disclosures.

Re-disclosures. If there are changes to a borrower’s loan program, loan terms, and/or Annual Percentage Rate (APR), the initial disclosure package must be re-disclosed to the borrower, and it must be received by the borrower at least three (3) business days prior to closing.

Timing of Loan Closings. Prospect cannot schedule the loan closing until at least seven (7) business days after the initial disclosures are mailed to the borrower. If re-disclosures are needed because of changes to the loan program, terms or APR, the loan closing cannot be scheduled until at least six (6) business days after the re-disclosures are mailed to the borrower.

I arrived early as usual and had all of my equipment inside and set up by 12:45pm. Katie and Pat planned on having their ceremony on the dance floor at the UpFront with the reception immediately following. Bridal party members were dressed and milling about as they were to have rehearsal at 1pm with pictures with their photographer, Cameron Fure before the reception. Katie’s mom kindly asked me if I would help them in directing the ceremony and I assisted with rehearsal. The ceremony went off without a hitch thanks to their friend and officiate Mark and Katie and Patrick walked back down the aisle to 525,600 minutes from the Rent Soundtrack. Cocktail hour was fun and then we introduced the bridal party into the room followed by Katie and Pat’s cake cutting ceremony.

Katie and Pat's gorgeous Gopher's cake

.
That’s right, Air New Zealand’s latest ad campaign features the airline’s staff and crew wearing only body paint, shoes, and the occasional hat. What’s the message behind this – that they have nothing to hide; in other words, they give you everything…upfront.

So beyond the fun spirit of nudity and double entendre what else makes this ad interesting? It was shot in 1 day at 10 to 15% the cost of a regular ad. They way they did this was by using actual employees of the airline to act as talent. Even the CEO stripped for the cause, he’s one of the baggage handlers.

In addition to the ad, the flight safety video, Bare Essentials, is created in the same way. The videos already have over 2 Million views on YouTube – and that’s the naked truth.

The CW will be the last broadcast network to release their fall schedules, but it looks like some changes are in store for their network.

According to several reports, it looks like the network is planning on moving their hit series Smallville to Friday nights at 8 pm ET.

This move is to make room for a new series called Vampire Diaries. The network wants to pair it with their other sci-fi series Supernatural.

In other CW news, it is believed that the network will debut their re-launch of Melrose Place alongside 90210 on Tuesday nights. Melrose will star Ashlee Simpson-Wentz.

Here is what The CW’s schedule could look like after tomorrow:

Series Renovadas:
Gary Unmarried, Las aventuras de Christine, Caso abierto, CSI, CSI: NY, CSI: Miami, Mentes Criminales, El mentalista, Numb3rs, Cómo conocí a vuestra madre, Rules of engagment, Dos hombres y medio, The Big Bang Theory y Entre Fantasmas.

Series Canceladas:
The Ex List, Worst week, The Unit, Sin rastro, La hora 11.

Series Nuevas:

A las tres ya comentadas aquí, ‘The good wife’, ‘Three rivers’ y ‘NCIS: Los Angeles’, se les une ‘Accidentally on Purpose’ una comedia para la temporada de otoño. En la midseason llegarán ‘Miami Trauma’, ‘The Bridge’, ‘Undercover Boss’ y ‘Arranged Marriage’.

La parrilla de otoño quedará así:

Para ampliar, pulsa aquí. Azul drama, amarillo comedia y rojo reality.

Mucho drama y poca comedia y realities.

Series Renovadas:
30 Rock, Ley y orden, Ley y orden: Unidad de Víctimas Especiales, Friday Night Lights, Heroes, Chuck, The Office, Parks & Recreation y Southland.

Ninguna sorpresa.

Series Canceladas:
Me llamo Earl, Medium, Kath & Kim, Kings, Knight Rider, Mujeres de Manhattan, My Own Worst Enemy, Life, Crusoe y Urgencias.

Me parece inexplicable.

Además, mucho tiempo dedicado a ‘The Biggest Loser’ y otros realities.

Series renovadas:
Mujeres desesperadas, Perdidos, Anatomía de Grey, Better Off Ted, Cinco hermanos, Castle, Sin cita previa, Scrubs y Ugly Betty.

Series canceladas:
Samantha ¿Qué?, The Unusuals, El mundo según Jim, Cupid, Dirty Sexy Money, Eli Stone, In The Motherhood, Boston Legal, Life On Mars, Criando malvas.

Series Renovadas:

Series Canceladas:
Do Not Disturb, Terminator: The Sarah Connor Chronicles, El rey de la colina, Prison Break y Sit Down Shut Up.

Todas estaban acabadísimas. Quizás la única que podría haberse salvado era ‘Sit down, shut up’, pero finalmente cayó.

Series Nuevas:

Además, vuelven los realities/talent shows ‘American Idol’ y ‘So you think you can dance’, que pasa de emitirse en verano a temporada alta.

ABC
‘The Unusuals’.
‘Better off Ted’.
- ‘Hank’. Una comedia multi-cámara protagonizada por Kelsey Grammer.
- ‘The Middle’.

- ‘The Forgotten’.
- ‘The Deep End’. Otro drama legal.

NBC
‘Chuck’.
- ‘Day one’.

CBS
‘Caso abierto (Cold case)’.
- Spin-off de ‘Navy: Investigación Criminal’.

FOX

Well today is the day, a year in the making…at least for some of us. Today is the start of the 2009

Well today is the day, a year in the making…at least for some of us. Today is the start of the 2009 Upfronts the amazing four days in mid-May where the five network channels (ABC, NBC, CBS, FOX, & The CW) announce their fall schedules to advertisers. Today is the day where unless previously announced we find out if our favorite shows return for another year or if they are circling the drain and we never get to find out whether or not Brooke lived or died when Nicole Julian ran her over at the end of the second season of “Popular”. Let me just start out by apologizing RIGHT NOW for that outburst, I still harbor sour feelings towards Jordan Levin and The WB for that cancellation.

Anyway, I digress…below is the schedule of this weeks Upfront presentations
Monday, May 18, 2009 – FOX
Tuesday, May 19, 2009 – ABC & NBC
Wednesday, May 20, 2009 – CBS
Thursday, May 21, 2009 – The CW

So I pretty much wanted to introduce myself, I’m Sean. I’m a 21 year old college student studying film in Boston, MA. I pretty much love this stuff…I hate to say it but the Upfront week is the highlight of my year. I really want to work in network television some day. Maybe do some movies…but television is really my forte. So I’m going to wrap this up simply because I feel refreshing The Futon Critic & Zap2it homepage isn’t doing me any good but making me all anxious and crazy! Plus I’m sitting here waiting for one of my classes to start. I’ll be back later on with my recap of the FOX schedule and a itty bitty preview of what the ABC & NBC schedules are looking like!

Peace,
-Sean
