Esta vez me ha tocado ya por fin “conocerlo”. Ya me había hablado Laia de él, pero todavía no habíamos tenido el gusto… y es que siendo tan peludo daba un poco de yu-yu, pero al fin he decidido salir al patio y enfrentármele… y resulta que es la mar de simpático!

Sí, se trata de el perro de mis abuelos, Urf. Es un poco salvajote y algo atolondrado, pero es muy cariñoso… tanto que mejor se quedó en su casita, no sea que se me hubiera subido encima y me hubiera lamido de arriba a abajo (para disgusto de mamá y diversión mia!)

Así que creo que seremos amigos, al menos Laia tiene muy buena relación con él!

Y si no, mirad mi reacción!

Den gångna helgen hade tjejerna sitt största uppträdande hittills. Lite osäker på om det var det största ur publikmängd sett, men i alla fall det viktigaste för dem personligen då det var lite av en dröm som gick i uppfyllelse.

De fick nämligen uppträda på Uppsala Reggaefestival och de gjorde det med sin gamla grupp: Zumbas.

Tyvärr blev filmen inte helt toppkvalité, då jag dels stod för nära och dels skrek publiken så enormt mycket att man knappt hör musiken.

Binta och Vendela är dock mycket nöjda med sina insatser under uppvisningen och jag har en känsla av att det inte var det sista vi får se av gruppen Zumbas, där utöver Binta och Vendela, även Aida och Mathilde ingår. Dock var detta gruppens officiella slutuppträdande!

Än en gång lyckades festivalledningen ringa in gräddan av de främsta artisterna inom roots och dancehall. Reggaeälskare har under veckan kunna njuta av högdjur som Ky-Mani Marley, Alpha Blondy och Busy Signal.

Temperaturen var hög – på scenen, i publiken och i luften. Flera av de artister som uppträdde under lördagen, festivalens sista dag, hade flyt med både väder och publik. Nåja, nästan alla i alla fall.

På den stora scenen inleddes eftermiddagen med Governor Andy som med sin käcka folkparksreggae fick scenen och publiken att gunga. Hyfsat mycket folk hade tiden till trots flockats framför scenen för att se en av Sveriges främsta reggaeartister.

Det var många som försvann efter att Guvernören lämnat scenen, och tyvärr visade det sig att de flesta inte brydde sig om att komma tillbaka till området förrän flera timmar senare. När veteranerna Inna de Yard Allstars klev upp på scenen var det pinsamt tomt framför de numera grånande gubbarna Cedric Myton, Linval Thompson, Earl “Chinna” Smith och Kiddus I samt deras två yngre kollegor.

Gubbarna i Inna de Yard Allstars har tillsammans en diger meritlista som spänner över fyra decennier och de är sannolikt vana vid en större och betydligt mer aktiv publik – något som blir uppenbart när bandledaren Earl “Chinna” Smith  i konsertens inledning förtvivlat försöker få igång allsång under klassiska Soul Syndicate-låten Mariwana. “You can be arrested for smoking it, but not for singing about it!“. Det hela slutar med vad som ser ut som en rejält förbannad bandledare som lämnar scenen, för att efter en sekund eller två vända tillbaka och dra igång vad som blir en makalös spelning med både klassiska och mer okända låtval.

Etana är kvällens “Concious Lady”. Hon debuterade 2006 och har sedan dess släppt ett bra debutalbum och en rad starka singlar. Hennes röst kan utan problem konkurrera med souldivor som Beyoncé och Alicia Keys. Det kan däremot inte hennes utstrålning. Etana är en vacker men grå mus när hon kommer ut på scenen, och lyckas inte förmedla styrkan i väl valda låtar som Jah Chariot och I’m Not Afraid. Det hela blir dessutom pajigt i duetten Blessings. Originalet är tillsammans med Alborosie, men här framför hon den med den manliga delen av körduon. Och resultatet är allt annat än imponerande.

Musikerna som backar Etana stannar ett par timmar på scenen. De är nämligen band till efterföljande Lutan Fyah och Busy Signal.

Dessa två deejays river ner stora applåder när de kliver på scenen efter Etana.

Lutan Fyah är på Uppsala Reggae Festival för tredje gången. Och det är lätt att förstå varför festivalledningen vill ha honom tillbaka. Han river rappt och energiskt av hit efter hit, men avslutar tyvärr med att köra två korta versioner av favoriterna Save the Juvenile och Rasta Still de Bout.

Lutan Fyah påminner om en duracellkanin när han springer fram och tillbaka över scenen, men är ändå i en betydligt lägre energidivison än Busy Signal som greppar micken efteråt.

Busy Signal kan närmast liknas vid en duracellkanin på speed. Han hoppar jämfota, knäböjer, springer fram och tillbaka i en fart som för tankarna till Jamaicanska sprintern Usain Bolt. I all denna fart levererar han hittar som Unknown Number, Jail, Badman Place och Hustlin’ på tunga Baddaz Riddim. Han gör även ett annorlunda coverval – Nightshift av The Commodores passar förvånansvärt bra i dancehalltappning.

Få grupper har haft ett sådant stort inflytande på reggaemusiken som legendariska The Heptones. Eller kanske snarare gruppens frontman Leroy Sibbles. Det var han som startade gruppen, det var han som var leadsångare och det är han som är ansvarig för otaliga klassiska låtar och riddims från skivbolaget Studio Ones storhetstid i slutet på 60-talet.

Och det här är hans kväll. Det märks tydligt i sättet han med järnhand styr bandet och sin Heptones-kollega Barry Llewellyn. Men han har kul och trivs trots att arrangörerna petat in bandet på tältscenen medan pojkarna i T.O.K tar huvudscenen i anspråk.

Leroy Sibbles bjuder på en kavalkad av hittar från 60-talet och försätter den lite åldriga publiken i ett glädjerus. Jag hade dock gärna hört några alster från perioden tillsammans med Lee Perry.

Kvällen avslutas med ivorianen Alpha Blondy som är här för andra gången. Även han har varit i reggaebranschen länge och har gett ut en rad starka plattor. Till kvällens spelning har han tagit med sig bandet Solar System, som för att förstärka världsmusikkänslan består av musiker från jorden runt. Tyvärr verkar de ha hittat gitarristen i något glamrockband i Tyskland. Han har nämligen inga som helst problem att riva av ett och annat meningslöst och glammigt gitarrsolo i tid och otid.

Alpha Blondy gör en vad som i vissa delar känns som en rutinspelning. Visst, energin finns där, och låtvalen också. Men jag saknar inlevelse.

Kanske har det med mig att göra. Efter nära nio timmar på ett festivalområde som på kvällen närmast liknar en ungdomsgård, så lockar annat än ringande mobiltelefoner, irriterande visselpipor och ölluktande kläder.

Det är alltså jag som är bloggaren Tonårsmorsa. Jag är Bintas mamma och jag försöker stötta och hjälpa tjejerna i Blackout för att de ska komma igång ordentligt, men framför allt för att de ska ha tid att fokusera på dansen, då det är ganska mycket på gång just nu!

Nu har spellistan för Uppsala Reggaefestival 2009 utökats med ett namn, nämligen Zumbas (ja, de har glömt ett “s” på slutet!)

Zumbas är alltså den grupp som Binta och Vendela har varit med i fram till nu. I samförstånd kommer nu Zumbas att avsluta med ett stort uppträdande på URF, för att sedan splittras.

Tjejerna har lite andra planer på varsitt håll och Binta och Vendela som är två av Zumbas medlemmar har alltså startat dansgruppen Blackout!

Det kan säkert innebära att de någon gång kommer att köra något med Zumbas igen i framtiden, eller i andra danskonstellationer, men officiellt så har Zumbas sitt avslutningsuppträdande under URF 2009!

Tjejerna är taggade som aldrig förr och har beslutat sig för att nu satsa ganska hårt på dansen!

De vill utvecklas och de vill förbättra sin dans. Och ingen kan stoppa dem!!

Meet the new boss

Okay, so I won’t be accused of burying the lead, I’m the newest staff producer/writer at Running Pony Productions. RPP is a well-known production house in the Memphis area.

Here’s how they describe themselves on their website: “Running Pony Productions, a Memphis video production company and digital content producer, was founded in 1994 by two veteran television journalists. In 1999 the company took on a third principal.”

TV viewers might recognize the third principal, Rod Starns, formerly of WMC-TV. We started reporting in Memphis around the same time, and had been in contact after I came back to town to work at FedEx.

Hopefully, you’ll excuse me for dragging this out, but my new co-workers only found out at their morning staff meeting. My first day on the job is tomorrow and hopefully, I’ll be able to add to consistently excellent product they’ve been producing for the last 15 years.

A reader of this blog passed my info on to the writer, Richard J. Alley (a blogger himself at Richard J. Alley and Urf!). We talked about my various coping mechanisms in late April. A couple of weeks ago, veteran CA photo Mike Maple stopped by the house to take a couple of snaps of me in various states of joblessness.

I didn’t mention being interviewed to too many people, not wanting to jinx things. I was hopeful that showing up in the paper would help spark employers’ attention in my availability, but that’s moot now. I let Richard know that was I on the verge of employment; I think that detail is going in as a “happy ending.” Which is cool.

Brains on display

This Sunday, 350 or so people (including me), will be showing off their ability to retain mostly useless knowledge. But we’ll be doing it for money.

We’ll be crammed into the Dan McGuinness Pub on Spottswood, taking part in the Memphis Trivia League Championships.

If you drink (or visit bars) in the Memphis area, you may have noticed that many of them hold trivia contests. Several months ago, former TV journalist and retired city official Carey Hoffman talked me into going to the Blue Monkey in downtown Memphis to play. It got to be a habit and I was invited to be on a team that had made the finals before (the team name is Intelligent Design, although we use different names at some bars – like The Producers at the Blue Monkey).

With various groups of people taking part, the team managed to qualify for the tournament at 3 different places (keeping other teams from qualifying cuts down on competition in the semis and the final).

I’d invite you to Dan McGuinness to cheer on the team, but with so many people playing, the sponsor, Challenge Entertainment, says “only qualified teams and participating players will be admitted.” Check out Challenge’s site for winners on June 8.

Settling into a Rhythm

As the days go on, I hope to settle into a new rhythm of things I’ll blog about. Because of my separation agreement with FedEx, that organization won’t be one of the topics. And since I’m still on good behavior with my new employer, I probably won’t do too much on Running Pony either.  Still, Memphis is a big ‘ol, often silly town, so I’m sure we’ll have something to talk about.

I also don’t know yet whether I’ll go in for a permanent name change or stick with “On the Beach.” Even though I’m not on the beach, as far as my employment status goes, life’s still a beach in a lot of ways.  I’ll figure something out.

I just found this one, I think through Neat-O-Rama (though I could be mistaken. It’s basically all about this world called ‘Urf’, which is mostly similar to earth, with small differences. It’s a cute site, and it made me giggle: [Link]

That’s really all I’ve got to say for now. Sorry that I don’t update as often as I want to; guess I’m too lazy.

Not a ton of news from the Observer this week in terms of MMA/UFC for this week but here is all the scoops fit to print!
UFC/WEC

The B.J. Penn vs. Kenny Florian lightweight title match has now been agreed to and signed by both fighters as the main event on 8/8

for UFC’s debut in Philadelphia at the Wachovia Center. The last word from UFC is that the Philadelphia location is probable, but

not 100%, but either way, that’s the main event for UFC 101. Also on that show looks to be Matt Hamill vs. Brandon Vera, which isn’t

signed, but there are verbal agreements from both sides. By all rights Vera should win that one, but you can never take Vera for

granted.

Station Casinos, the Fertitta’s main company, remains a financial mess due to the Las Vegas economy taking such a huge hit in recent

months. The casino has, since 2/1, failed to pay an interest payment to bondholders and the bonds were ruled this past week to be

worth 32% in an auction.

Alessio Sakara vs. Rousimar Palhares is tentatively set for UFC 99 on 6/13 in Cologne, Germany. The show will be a PPV and it looks

like the five live fights will be Wanderlei Silva vs. Rich Franklin at 195 pounds, Cain Velasquez vs. Heath Herring, Mike Swick vs.

Ben Saunders, Spencer Fisher vs. Caol Uno and Marcus Davis vs. Dan Hardy.

There were no drug test failures at UFC 96 on 3/7 in Columbus, OH.

Cole Province is out of the 4/5 show in Chicago due to a severe ankle injury. He will be replaced by Mike Budnick in a match against

Rafael Dias. The injury took place several weeks back and he was hoping he could fight through it, but decided against it. Also on

that show, Anthony Pettis pulled out with an injury from a fight against Anthony Njokuani, and will be replaced by Bart Palaszewski.

Both are prelim matches.

Danillo Villefort vs. Jesse Lennox, two former WEC fighters from the shut down welterweight division, debut in UFC as a prelim match

on 8/8 in Philadelphia.

K-1/DREAM

A correction from the last issue regarding HDNet. It is available on several cable systems in Canada. HDNet is in danger of being

removed this week by Time Warner Cable. In fact, Andrew Simon of HDNet urged wrestling and MMA fans to call the G.M. of their local

cable operator to let them know they are avid viewers of the station.

The 4/5 Dream show in Nagoya (4/10 TV airing on HDNet) has the first round of the welterweight Grand Prix with Shinya Aoki vs.

Hayato Sakurai, Andre Galvao vs. John Alessio, Yuya Shirai vs. Jason High and Marius Zaromskis vs. Seichi Ikemoto. The rest of the

show has Hideo Tokoro vs. D.J. Taiki (a first round match in the featherweight tournament), plus a pro wrestling battle for the

toughest guy in Nagoya with Minowaman vs. Katsuyori Shibata, plus Andrews Nakahara vs. Shungo Oyama, Murilo Ninja Rua vs. Yoon Dong

Sik and Jeff Monson (in his third straight weekend of fighting, as he beat Roy Nelson via decision on 3/21 on the March Badness PPV,

and on 3/28, beat Sergej Maslovojev in 2:30 with an Anaconda choke in the main event of the Cage Wars show in Belfast) vs. Sergey

Kharitonov.

There is also a 5/26 Dream, show featuring J.Z. Calvan vs. Tatsuya Kawajiri.

A new Japanese star was created on the 3/28 K-1 show, in Keijiro Maeda, who last week wasn’t even in the tournament and was still

carrying a part-time job, g a till , but wound up as the new K-1 world heavyweight champion on the 3/28 show at the Yokohama Arena.

The show was built around trying to reach for a grudge with Alistair Overeem representing MMA and K-1 sending its Grand Prix

champion, Remy Bonjasky, to defend its turf after Overeem knocked out K-1 star Badr Hari on New Year’s Eve. They even shot a big

press conference angle where Overeem came out with a trophy that looked like a mini-Oscar, and said that Bonjasky won the best actor

award for his performance in fake getting knocked out and being unable to continue, thus causing a DQ for stomping, against Hari in

the finals of the Grand Prix in December. Bonjasky shot back that Overeem, now up to 254 pounds and ripped (as the announcers noted

he used to kickbox a few years ago at 202 pounds, and fought at 205 for years in MMA although he was a 230-pounder cutting hard,

which probably explains his proclivity for looking strong the first few minutes and running out of gas), asking him about what drugs

he’s using. Overeem shot back that he’s from Holland, and everyone uses drugs in Holland. A few days later, in another interview, I

guess figuring how that came out, he didn’t deny steroid use, but played the “I’ve never failed a steroid test” card (of course,

neither K-1 nor Dream does steroid testing). The show drew 10,328 fans, so they didn’t sell out, and did an 11.1 rating, which is

considered not so hot. As for the match, Bonjasky looked terrible, but still won a three-round decision. In K-1, they do open

scoring, which means scores are announced at the end of the round. K-1 judges also are encouraged to score anything close 10-10,

with the idea they want fighters to do knock downs or at least dominate a round to win. Overeem probably won the first round close,

and definitely won the second, but both were judged as even rounds. He was winning the third round as well, but with seconds left,

Bonjasky scored a knockdown to take the decision. The immediate reaction based on U.S. scoring is that it was a home promotion

decision with K-1 protecting the insider against the guy from the other sport. But the way they judge, that’s not inconsistent.

Bonjasky then went to give Overeem back his best actor trophy, but Overeem’s corner was pretty pissed about losing and swatted it

away. In the tournament, the 22-year-old Maeda, with a green Mohawk and a starfish on the sides haircut, knocked out tournament

favorite Melvin Manhoef in 2:02 in one semifinal. Maeda was a last minute addition to the tournament when Chalid Die Faust couldn’t

get a Visa on time. Gokhan Saki finished Tyrone Spong with a knockout in overtime after the judges ruled it a draw in regulation.

Spong was also a late addition, a fighter who started as a world class Muay Thai fighter in the 145 pound weight class and is now

fighting heavyweight (220). Once again it was ruled a draw after three rounds because none of the rounds were one-sided enough. They

went into a fourth overtime round, and Maeda was given the round by two of the three judges. He won the round, but didn’t overtly

win it, so it could have been a draw and sent to another round, but that’s how it was judged. It was a shock because Japan has never

had a world heavyweight champion in K-1 history, let alone a 22-year-old relative unknown who is undersized. I don’t see Maeda doing

well long-term in defenses. He fought at about 210 in a 220 pound division, but is a guy who has the frame of a 190-pounder.

Eventually he’s going to have to face Hari (who was stripped of the title for his actions in the Bonjasky match) and Hari seems both

too big, too strong and too quick for him. Maeda (14-1), did beat both Mighty Mo and Musashi last year, but was still working three

days a week at a $10 per hour job to augment his fighting pay. Legend Peter Aerts, in his 124th pro fight, still had enough to

decision Errol Zimmerman, while Semmy Schilt won a decision over Hesdy Gerges by scoring a knockdown early, while Ewerton Teixeira

won a split decision after five rounds, going to a draw in three, and a 10-10 across the board first overtime round. In K-1 rules,

you can do two overtime rounds. Judging in overtime rounds is different than regular rounds, in that you are encouraged to pick a

winner, although all three judges ruled the fourth round even. In the fifth round, judges are strongly encouraged to pick a winner

because it’s the last overtime.

STRIKEFORCE

The 4/11 show will air as a PPV event in Canada.

The Brett Rogers vs. Abongo Humphrey (real name Ron Humphrey) match was made official this past week as the final match of the 4/11

Showtime card. Humphrey is the first fighter off the Iron Ring TV show on BET to make it to a major national live TV event. The

other matches airing live are Frank Shamrock vs. Nick Diaz, Josh Thomson vs. Gilbert Melendez for the lightweight title in a five-

round fight, Scott Smith vs. Benji Radach and Christiane Santos (formerly Cris Cyborg) vs. Hitomi Akano.

They’ve offered Bobby Lashley a multi-fight exclusive contract for what we’ve been told are good figures, with the promise they’ll

bring him along slowly, giving him regular fights with increasingly tough opponents. It’s probably a good move on the Strikeforce

part because their key is to get people to watch shows on Showtime, and Lashley has a good name to where unless he gets blown out,

people will be intrigued enough where he’s a name as part of a hook to watch his fights on television. He can be used in a non-main

event capacity as a special attraction like fighter to be built that has some name identity and builds interest in the show. Plus,

Lashley vs. Kimbo Slice on CBS will do ratings. At this point, Slice has not agreed to come in even though Strikeforce purchased his

contract. Lashley hasn’t signed, but at least word was seriously considering the offer. The 4/25 Lashley vs. Marcus Jones match

talked about last week is out. Lashley’s side thought it was a done deal last week, but Jones’ side said that they were never

contacted in the first place, but now it’s out as Lashley is looking at this new offer and no longer fighting on that card. Lashley

will be at the 4/25 XFC show in Knoxville on HDNet, but only in the role to present the new XFC world featherweight title belt to

the winner of a Bruce Connors vs. Jarrod Card main event.

In response to the comments made by Joe Riggs, Versus.com got a response from Jake Shields, who said, “I think he needs to

concentrate on his fighting skills instead of talking. I would kick the crap out of him. I don’t think he would make it past the

first round. So, he can talk all he wants, but I am not too worried. I think (Robbie) Lawler is a much tougher fighter tan him, and

that is why I am taking it. He says I’m avoiding a fight. That’s funny, I’m fighting a bigger, better striker. So, he can say what

he ants. But I think everyone knows that I am turning him down for a tougher fighter.” “I can understand him being a little upset

because he thought he had a fight, but if he sits there and looks at the situation, he would do the same thing. I would be stupid

not to take the bigger fight. If he can’t sit back and look at it from a business standpoint, then he is not a very intelligent

guy.”

OTHER MMA

A movement to legalize and sanction MMA in Vancouver, consistently one of the top ten markets for UFC in North America as far as per

capita interest (No. 7 in 2008) was basically punted this weekend by the City Council. The City Council said that it is an issue

that the provincial government should take care of, and not something that should be regulated city-by- city, which is actually the

logical answer (it shouldn’t be regulated city-by-city but the idea in 2009 of it being banned in a city where it has so much

interest is crazy). Heather Deal of the commission said the city would try and draw up regulations for the sport in the event the

Province doesn’t act. Councilwoman Suzanne Anton was the only one voting for city regulation, saying the sport should be overseen by

the city’s athletic commission and it would give the city safe and entertaining shows that would help the city economically. The

city’s athletic commission sanctioned MMA until 2007, when the city council did what was at the time called a temporary ban. The

council, when asking the province to act, said they were not closing the door on the idea of doing it themselves. Anton said that

the 2007 ban was based on wanting more information on the subject, but now that they have that information, the city should have

acted. “This simply delays and defers and shows a lack of interest in resolving this issue.” Mayor Gregor Robertson said they need

to put pressure on the province to regulate it. Dr. Rajindar Sandhu of the Vancouver city Athletic Commission said, “I am literally

pissed at this. This council does not want to make a decision. I think if we come back with the information they want, they are just

going to table it again.” The city commission regulates both pro boxing and pro wrestling events, so as far as consistency goes, if

they regulate both through the city and not the state, that is a precedent for doing that with MMA. The major arena in the city, the

GM Place, was behind the city regulating it and said they would like to bring a UFC event to the city.

After New Jersey wouldn’t allow the fight, promoter Monte Cox has moved the scheduled Tim Sylvia vs. Ray Mercer six round boxing

match to 6/13 in Birmingham, AL.

Sengoku 7 took place on 3/20 at the Yoyogi Gym in Tokyo with mostly a featherweight tournament. Good show overall. Easy to watch and

mostly fast- paced matches with the most entertaining ground work of any show in a long time. It was a lot like a good WEC show in

that you have small guys with great action, but no names, no great crowd reactions and only few guys came across as stars. Advancing

to the next round in the 143-pound tournament, were Nick Denis (7-0, Canadian King of the Cage champion), Ronnie Ushiwaka (real name

Ronnie Mann (17–1-1), but uses his mother’s maiden name to appeal to the Japanese audience, Jung Chang Sun (3-0, from South Korea),

Masanori Kanehara (12-5-5), Marlon Sandro (13-0, King of Pancrase featherweight champion), Michihiro Omigawa (15- 7-2, dropping down

from being a small lightweight in UFC), Nam Phan (15-5, born in Viet Nam, now living in Westminster, CA and his losses were mostly

to name lightweights that he was undersized to face), and Hatsu Hioki (17-3-2). Hioki was presented as the top star in the

tournament and came through with an impressive win over Chris Manuel. Sandro was the other favorite and he was pretty dominant. A

guy to look out for is Tetsuya Yamada, who graduated high school three weeks earlier and was 172 pounds at graduation, and dropped

to 143. He faced Ushiwaka and they had a great first round until he got tired late in the second, which he attributed to the big

weight cut. The tournament continues on 5/2 in Tokyo’s Yoyogi Gym with Hioki vs. Ushiwaka, Omigawa vs. Phan, Kanehara vs. Sun and

Sandro vs. Denis as the quarterfinals. There were two non-tournament matches on the show. Jim York of Australia knocked out James

Thompson of the U.K. (Of Kimbo exploding ear fame) via KO in the first round. The funniest thing was the start as Thompson did his

usual charge and York side stepped and Thompson nearly ran through the ropes, like a pro wrestler missing a spear spot. Main event

Pada pertemuan sebelumnya telah dikaji seputar hukum-hukum (dalil-dalil) selain Alquran, Hadis, Ijma’, dan Qiyas, yang ternyata ada beberapa dalil yang menjadi pegangan para ulama dan mujtahid sejak di era sahabat hingga saat ini. Terakhir yang dikaji adalah Al-Maslahah Al-Mursalah, yaitu maslahah (kebaikan-kebaikan) atau menafikan kemudharatan, tetapi tidak ada penjelasan dari Allah dan Rasulullah bahwasanya kemaslahatan tersebut dianjurkan (baik) ataupun ditolak (buruk). Kalau maslahah itu dijelaskan oleh Allah diterima, maka para ulama tidak berbeda pendapat mengenainya. Begitu juga kalau suatu kebaikan itu memang tak pernah dianggap, bahkan jelas-jelas dinyatakan oleh Allah sebagai suatu keburukan, maka para ulama pun tak berbeda pendapat mengenai hal tersebut.

Tetapi pada Mashalih Mursalah, para ulama terbagi menjadi beberapa kubu. Berkaitan dengan Mashalih Murasalah ini, ada satu hal yang menarik pada Mazhab Maliki. Pada Mazhab Maliki, jika ada perempuan muda, cantik, dan mempunyai posisi di masyarakat (baik karena keluarganya memang keluarga terhormat ataupun kedudukan-kedudukan yang lainnya), kalau perempuan ini menikah, kemudian melahirkan anak, maka dia tidak wajib menyusui anaknya. Perempuan dengan kriteria seperti ini boleh tidak menyusui anaknya, anaknya itu boleh disusukan kepada orang lain (kalau sekarang mungkin juga bisa menggunakan susu instant/susu botol). Padahal alasannya itu sepele, yaitu supaya si perempuan tetap cantik, penampilannya tetap menarik, sehingga ia boleh mengorbankan anaknya untuk tidak disusui.

Mengapa bisa demikian? Karena ini untuk maslahah, biar perempuan itu di hadapan suaminya tetap menarik, sehingga suaminya tidak terpesona dengan perempuan lain. Maslahah ini terkesan bertabrakan dengan maslahah yang lain, yaitu maslahah untuk kesehatan anaknya. Padahal para dokter sudah menyatakan, bahwa konsumsi yang paling bagus untuk bayi tersebut adalah ASI. Tak hanya sebatas itu, dalam Alquran juga disebutkan dan menganjurkan agar para ibu menyusui anaknya:

Para ibu hendaklah menyusukan anak-anaknya selama dua tahun penuh, yaitu bagi yang ingin menyempurnakan penyusuan. Dan kewajiban ayah memberi makan dan pakaian kepada para ibu dengan cara yang ma`ruf. Seseorang tidak dibebani melainkan menurut kadar kesanggupannya. Janganlah seorang ibu menderita kesengsaraan karena anaknya dan juga seorang ayah karena anaknya, dan warispun berkewajiban demikian. Apabila keduanya ingin menyapih (sebelum dua tahun) dengan kerelaan keduanya dan permusyawaratan, maka tidak ada dosa atas keduanya. Dan jika kamu ingin anakmu disusukan oleh orang lain, maka tidak ada dosa bagimu apabila kamu memberikan pembayaran menurut yang patut. Bertakwalah kepada Allah dan ketahuilah bahwa Allah Maha Melihat apa yang kamu kerjakan. (Q.S. Al-Baqarah: 233)

Di dalam kajian Ushl Fiqh, ayat di atas merupakan kalimat khabariyah yang bermakna insya-iyah (berita tetapi substansinya adalah perintah), bahwa ibu-ibu itu harus menyusui anak-anaknya. Mengapa kemudian Mazhab Maliki membolehkan para ibu untuk tidak menyusui anaknya, sementara alasannya terlalu sepele untuk mengabaikan kesehatan anak dan untuk meninggalkan perintah Allah. Berkaitan dengan ini, ada dua hal, yaitu:

Pertama, bahwa Al-Mashalih (kebaikan) tidak menyusui itu karena melihat kebaikan, yaitu agar penampilan seorang perempuan tetap menawan. Maslahah ini pada prinsipnya termasuk mukhashshis (yang mengkhususkan) dari ayat tadi. Pada ayat tersebut artinya bahwa semua ibu-ibu harus menyusui anaknya, yang hal ini berlaku umum. Ternyata ini di-takhshis atau dikecualikan dengan maslahah. Sehingga dalam kasus ini, maslahah menurut Mazhab Maliki termasuk penjelas. Dalam hal ini, sama halnya dengan ayat:

Padanya terdapat tanda-tanda yang nyata, (di antaranya) maqam Ibrahim; barangsiapa memasukinya (Baitullah itu) menjadi amanlah dia; mengerjakan haji adalah kewajiban manusia terhadap Allah, yaitu (bagi) orang yang sanggup mengadakan perjalanan ke Baitullah; Barangsiapa mengingkari (kewajiban haji), maka sesungguhnya Allah Maha Kaya (tidak memerlukan sesuatu) dari semesta alam. (Q.S. Ali Imraan: 97)

Ini juga termasuk ayat-ayat yang berbentuk khabariyah tetapi bermakna insya-iyah. “…mengerjakan haji adalah kewajiban manusia terhadap Allah…”. Ayat ini berlaku umum, karena bahasanya itu adalah “an-naas (manusia)”, siapapun manusianya itu. Ternyata ayat ini di-takhshis oleh kondisi. Pertama, tidak semua manusia wajib. Kalau mereka bukan muslim, maka tidak wajib mengerjakan haji.

Seperti juga ayat ini, menurut Mazhab Hanafi, ternyata ayat 233 Surah Al-Baqarah tersebut masih bisa di-takhshis. Hal seperti itu adalah kebiasaan orang Arab sejak zaman sebelum Rasulullah lahir, bahkan Rasulullah sendiri disusui oleh orang lain. Hal ini akan diperjelas dalam al-’adah awil ‘urf (‘urf), yang melalui dalil inilah Mazhab Maliki menentukan bahwa para ibu boleh tidak menyusui anaknya dengan alasan untuk menjaga kecantikan, boleh disusui oleh orang lain (kalau sekarang mungkin juga bisa menggunakan susu instant/susu botol). Tapi sekali lagi, ini menurut Mazhab Maliki, tidak berlaku bagi mayoritas ulama (jumhur ulama). Maslahah yang seperti ini tidak mu’tabarah (tidak diakui).

Saddudz Dzara-i’

Selanjutnya, ada juga dalil-dalil selain Alquran, Hadis, Ijma’, dan Qiyas, yang menurut ulama Ushl Fiqh disebut Saddudz Dzara-i’. Sad artinya memotong atau menolak. Dzara-i’ artinya adalah al-wasilah atau jalan perantara (batu loncatan) yang bisa mengantarkan seseorang melakukan hal-hal yang buruk. Contohnya: menanam anggur, apakah itu boleh atau tidak?

Dzara-i’ itu adalah jalan perantara yang akan mengantarkan kepada perbuatan yang buruk. Jalan ini pada asalnya adalah boleh. Bahkan tidak mustahil adalah sunnah. Tetapi karena jalan tersebut mengantarkan kepada sesuatu yang haram, maka jalan tersebut di-sad (dipotong/ditolak). Contohnya adalah menanam anggur, paling tidak itu adalah boleh, atau bisa jadi dianjurkan, yaitu ketika di tempat itu satu-satunya tanaman yang bisa hidup hanyalah anggur, atau paling tidak hal itu dibolehkan (mubah).

Tetapi, kalau menanam anggur ini memang diprediksi akan mengantarkan pada suatu kondisi dijadikan khamr (minuman keras), maka menanam anggur tersebut dilarang. Apakah dalilnya? Di Alquran, dalil mengenai hal ini memang tidak ada. Malahan di Alquran disebutkan, bahwa salah satu pohon di surga adalah anggur. Di Hadis juga tak disebutkan, di Ijma’ tak ada kesepakatan, di Qiyas juga tak bisa dianalogikan. Tetapi kita tahu, bahwa khamr itu dilarang oleh Alquran, sehingga hal-hal yang bisa mengantarkan kepada khamr tersebut juga dilarang. Dalil mengenai anggur dilarang dan tak boleh ditanam adalah Saddudz Dzara-i’.

Begitu juga dalam hal jual-beli. Jika kita menjual sesuatu yang dibolehkan, tetapi ketika ada yang membelinya untuk maksud yang haram dan terlarang, maka menjual barang itu kepada yang bermaksud terlarang tersebut hukumnya adalah haram. Padahal menjualnya itu mubah. Apakah dalilnya sehingga dilarang? Dalilnya adalah Saddudz Dzara-i’. Hal ini tak ada di dalam Alquran, Hadis, dan dalil-dalil yang lain, kecuali akan ditemukan pada Saddudz Dzara-i’ yang artinya itu adalah melarang atau memutuskan hal-hal yang bisa mengantarkan kepada yang terlarang.

Pada prinsipnya, Saddudz Dzara-i’ ini ada tiga:

Pertama, bahwa Dzara-i’ (perantara) itu memang dipastikan akan mengantarkan pelakunya kepada sesuatu yang haram. Maka dalam hal ini, para ulama tidak berbeda pendapat, sehingga hukumnya memang haram.

Kedua, Dzara-i’ (perantara) itu biasanya mengantar kepada keburukan. Dalam hal ini pun para ulama tidak berbeda pendapat bahwa hal tersebut hukumnya adalah haram. Diperkirakan di atas 50% hal tersebut akan mengantarkan seseorang menjadi pelaku haram.

Ketiga, hal tersebut setengah-setengah akan mengantarkan kepada keburukan dan juga takkan mengantarkan kepada keburukan. Maksudnya, ada kemungkinan hal tersebut akan mengantarkan kepada keburukan, dan ada juga kemungkinan takkan mengantarkan kepada keburukan. Dalam hal ini para ulama berbeda pendapat. Jika suatu referensi menyatakan bahwa para ulama berbeda pendapat (khilafiyah) mengenai Saddudz Dzara-i’, maka maksudnya adalah jenis yang ketiga ini.

Mengenai hal ini, disebutkan dalam Alquran, misalkan kita jelas-jelas diperintahkan hanya menyembah Allah, kita dilarang menyekutukan Allah, ataupun menyembah Allah tapi juga menyembah yang lainnya. Sehingga tuhan-tuhan selain Allah itu harus tidak kita yakini. Tetapi kalau kita mengejek tuhan-tuhan selain Allah yang akibat ejekan itu membuat orang non Islam berbalik mengejek Allah, maka mengejek tuhan mereka itu haram hukumnya. Padahal tidak mempercayai bahkan menolak tuhan selain Allah itu wajib hukumnya.

Sekali lagi, pada yang ketiga itulah sering terjadi perbedaan pendapat di antara para ulama, sedangkan yang pertama dan kedua, para ulama sepakat mengenainya. Tetapi pada banyak buku referensi, bahwa yang pertama dan kedua itu tak pernah dibahas, tetapi yang dibahas itu adalah yang ketiga, yang dalam hal ini tanpa disebutkan mengenai hal tersebut. Sehingga orang yang tidak paham kemudian menganggap bahwa Saddudz Dzara-i’ ini memang tidak layak dijadikan sebagai dalil hukum Islam, karena para ulama berbeda pendapat mengenainya. Padahal, perbedaan para ulama hanyalah pada jenis yang ketiga.

Ada banyak dalil yang dijadikan landasan untuk mengatakan bahwa Saddudz Dzara-i’ yang ketiga tersebut layak juga untuk dijadikan sebagai pegangan, antara lain firman Allah:

Katakanlah kepada wanita yang beriman: “Hendaklah mereka menahan pandangannya, dan memelihara kemaluannya, dan janganlah mereka menampakkan perhiasannya, kecuali yang (biasa) nampak daripadanya. Dan hendaklah mereka menutupkan kain kudung ke dadanya, dan janganlah menampakkan perhiasannya, kecuali kepada suami mereka, atau ayah mereka, atau ayah suami mereka, atau putera-putera mereka, atau putera-putera suami mereka, atau saudara-saudara laki-laki mereka, atau putera-putera saudara laki-laki mereka, atau putera-putera saudara perempuan mereka, atau wanita-wanita Islam, atau budak-budak yang mereka miliki, atau pelayan-pelayan laki-laki yang tidak mempunyai keinginan (terhadap wanita) atau anak-anak yang belum mengerti tentang aurat wanita. Dan janganlah mereka memukulkan kakinya agar diketahui perhiasan yang mereka sembunyikan. Dan bertaubatlah kamu sekalian kepada Allah, hai orang-orang yang beriman supaya kamu beruntung. (Q.S. An-Nuur: 31)

Ayat ini melarang perempuan-perempuan untuk memamerkan perhiasannya. Para ulama memang banyak penafsiran mengenai “ziina (perhiasan)” yang dimaksud. Ada yang mengatakan, bahwa “ziina (perhiasan)” yang dimaksud itu adalah bagian-bagian yang memang tak layak untuk ditampilkan (dipamerkan), termasuk di antaranya adalah aurat. Hal ini berdasarkan sabda Rasulullah, yaitu:

Sesungguhnya dunia seluruhnya adalah benda (perhiasan), dan sebaik-baik benda (perhiasan) adalah wanita (isteri) yang shalehah. (HR. Muslim)

Jadi, pengertian “ziina (perhiasan)” dalam ayat tersebut adalah seperti yang dimaksudkan pada sabda Rasulullah tersebut. Sehingga kesimpulannya, ayat tersebut menjelaskan larangan Allah bagi perempuan-perempuan itu untuk memamerkan auratnya, perhiasannya, termasuk juga dalam hal ini adalah perhiasan yang disematkan (emas, perak, dan semacamnya) dan juga perhiasan yang ada pada perempuan seperti kecantikan dan semacamnya. Semuanya haram diperlihatkan (dipamerkan), kecuali kepada suaminya.

Ayat ini menjelaskan bahwa yang haram tersebut adalah memamerkannya. Yang diharamkan tersebut karena akan mengantarkan pada memamerkan “ziina (perhiasan)” yang dimiliki itu. Ayat inilah salah satunya yang dijadikan pegangan oleh para ulama yang menjadikan Saddudz Dzara-i’ itu bagian dari dalil yang bisa dipegangi.

Termasuk dalil yang juga dipegangi yaitu apa yang dilakukan oleh Khalifah Utsman. Ketika itu terjadi suatu peperangan. Pada peperangan tersebut, banyak ulama yang juga ikut serta. Perangnya itu berhari-hari, bahkan berbulan-bulan. Ketika waktu kosong saat Maghrib, mereka berhenti dulu dari peperangan. Sehingga para ulama dan para sahabat yang ikut berperang ketika itu berkumpul untuk mengisi kekosongan sekaligus istirahat. Para sahabat dalam hal ini istirahatnya adalah membaca Alquran. Mereka ketika itu saling membaca dan menyimak.

Di dalam pasukan Islam ketika itu asalnya dari berbagai tempat: ada yang dari Baghdad, Yaman, Madinah, Mesir, dan daerah lainnya. Mereka membaca bergiliran. Ketika orang Mesir membaca, ternyata mereka membaca yang tidak pernah didengar oleh orang Madinah. Padahal menurut orang Madinah, ayat tersebut tidak seperti itu bunyi dan cara membacanya. Dari daerah lainnya juga membaca dengan cara yang berbeda. Mereka kemudian saling menyalahkan antara bacaan satu dengan yang lainnya. Karena Alquran itu jika ada yang membaca tidak sesuai dengan bacaan Rasulullah, maka itu dihukum kafir. Sehingga mereka ketika itu nyaris bertengkar dan saling menyalahkan antar sesama muslim, bahkan hampir terjadi perang saudara.

Ketika itu, Huzaifah ibn Yaman berinisiatif ke Madinah menyampaikan kepada Khalifah Utsman untuk segera menyikapi hal tersebut, karena kalau tidak maka akan hancurlah Umat Islam ketika itu. (Pada masa hidup Rasulullah, perbedaan cara membaca Alquran ini juga pernah terjadi, yaitu antara Umar ibn Khattab dengan Hakam)

Akhirnya, mereka itu dihadapkan. Ternyata mereka itu betul. Orang dari Baghdad misalkan, mereka itu mengikuti bacaan seperti yang diajarkan oleh Abdullah ibn Mas’ud. Abdullah ibn Mas’ud ini tidak pernah mengarang sendiri bacaannya kecuali mendengar bacaan dari Rasulullah. Yang dari daerah lainnya juga begitu, yaitu sesuai dengan yang diajarkan oleh sahabat Rasulullah yang lain.

Untuk menengahi hal ini, Khalifah Utsman kemudian menarik Alquran yang dikumpulkam pada masa Khalifah Abu Bakar yang telah tersebar pada para sahabat. Kemudian dikumpulkanlah para Qura’ (penghapal Alquran), dan di bawah komando Said bin Tsabit, Alquran ditulis kembali, yang tulisan itu bisa mencakup seluruh bacaan yang ada. Mushaf ini kemudian dikenal dengan nama Mushaf Utsmani.

Dalam hal ini, Rasulullah pernah mengatakan, bahwa Alquran itu diturunkan menjadi tujuh huruf. Maksudnya, bahwa Alquran itu diturunkan dengan tujuh macam bacaan.

Setelah penyusunan Mushaf Utsmani selesai, maka mushaf-mushaf yang lain (selain Mushaf Utsmani) yang telah dikumpulkan dan ditarik peredarannya, kemudian diperintahkan oleh Khalifah Utsman untuk dibakar. Dalam hal ini, apakah ada dalil yang membolehkan membakar Alquran? Ternyata tidak ada dalilnya, tidak juga dianjurkan, bahkan perbuatan tersebut sebenarnya dilarang. Tetapi dalam konteks ini, kalau Alquran tidak dibakar, maka akan mengantarkan pada kondisi terjadinya perbedaan pendapat, bahkan saling mengkafirkan. Sehingga untuk kemaslahatan umat ketika itu, maka dibolehkan untuk membakar Alquran yang dimaksud. Dalam hal ini dalilnya adalah Saddudz Dzara-i’.

Al-Bara’ah Al-Ashliyyah

Berikutnya di antara sekian banyak dalil adalah Al-Bara’ah Al-Ashliyyah. “Al-Bara’ah” artinya adalah bebas dari hukum, sedangkan “Al-Ashliyyah” artinya adalah pada asalnya.

Ketika sebelum terjadinya peristiwa Isra’ Mi’raj, yang pada peristiwa tersebut Rasulullah menerima perintah salat, maka umat Islam tidak mempunyai kewajiban untuk salat. Begitu juga ketika sebelum turunnya ayat yang mewajibkan puasa, maka tak ada kewajiban untuk melakukan puasa.

Selanjutnya, apakah Bara’ah Ashliyyah ini bisa dijadikan sebagai pegangan? Misalkan, tidak ada ayat yang membolehkan atau melarang sesuatu. Sehingga dalam hal ini, hal tersebut tidak wajib dan tidak juga dilarang, tidak haram, tidak sunnah, serta tidak juga mubah.

Pekerjaan manusia sebelum ada ketentuan dari Allah

Dalam hal ini, para ulama berbeda pendapat menjadi tiga: Pertama, ada yang mengatakan bahwa hal yang dimaksud itu mubah, kecuali ada hal-hal yang menjadikan itu wajib ataupun haram. Kedua, kalau tak ada ketentuan, tak ada ayat ataupun Hadis yang turun menjelaskannya, maka pekerjaan tersebut adalah haram. Ketiga, tak berkomentar mengenai hal tersebut (mendiamkan).

Ketiga pendapat ini kemudian dibantah oleh Imam Al-Ghazali. Menurutnya, ketiga-tiga pendapat tersebut tidaklah benar. Karena kalau tak ada syara’ ataupun tak ada ketentuan-ketentuan syari’at dari Allah maupun dari Rasulullah (baik langsung maupun melalui perantara), maka kalau dikatakan mubah ataupun haram, yang itu semuanya adalah hukum, berarti kita telah menentukan hukum di luar ketentuan Allah, dan juga menghukumi dengan bukan hukumnya Allah.

Berbeda halnya dengan kaum Mu’tazilah. Menurut kaum Mu’tazilah, walaupun hukum tak pernah mengatakan, walaupun Allah dan Rasulullah juga tak pernah memberitahukan, tetapi otak kita mampu memilah-milah. Kalau perbuatan itu tidak baik menurut pendapat otak, walaupun tak ada ketentuan dari Allah dan Rasul, maka perbuatan tersebut haram dilakukan. Jika perbuatan itu baik, walaupun tak ada ketentuan dari Allah dan Rasul, maka itu adalah baik dan boleh dilakukan. Konsep Mu’tazilah itu disebut dengan at-tahsin wat-takbih (baik dan buruk). Artinya, menyikapi kondisi berdasarkan otak. Inilah pegangan Mu’tazilah. Tetapi mayoritas ulama tidak seperti itu. Mayoritas ulama berpendapat, bahwa otak selamanya takkan pernah bisa dijadikan sebagai pegangan.

Menurut kaum Mu’tazilah, jika menurut otak itu baik, maka wajib dilakukan. Kalaupun ada ayat Alquran yang memerintahkannya, maka itu tak lebih hanyalah memperkuat pendapat otak. Menurut Imam Al-Ghazali, yang seperti ini tidaklah dapat dibenarkan. Sehingga ketiga perbedaan itu sama sekali tak pernah diperhitungkan oleh Imam Al-Ghazali, sehingga ia mengatakan, bahwa semua itu tidak layak untuk dipegangi. []

Urf… mirando a ver como entraba en el castillo

Bueno, el perro y yo comenzamos a ser amigos.

Hoy hemos estado comiendo en casa de los abuelos en Llagostera y parece que el bicho ese ya no me molesta tanto… al menos hoy me ha hecho reir mucho!

Urf me persigue!

Urf me lame la mano y me da mucha risa!

Uyyy Urf... todavía me das un poco de miedo!
