Johnny v. Commonwealth

Facts:

Defendant appealed his bench trial conviction for possession of heroin with intent to distribute. On appeal, defendant contended that the trial court erred by admitting irrelevant evidence of statements he made to police regarding his prior drug use and dealings and that the evidence was insufficient to prove that he intended to distribute heroin. Upon review, the court affirmed the conviction.

Holdings:

The Virginia Court made the following holding:

The commonwealth may prove possession of a controlled substance by showing either actual or constructive possession. To support a conviction based on constructive possession, the commonwealth must point to evidence of acts, statements, or conduct of the accused or other facts or circumstances which tend to show that the defendant was aware of both the presence and character of the substance and that it was subject to his dominion and control. Moreover, the possession need not be exclusive. The defendant may share drugs with one or more. The duration of the possession is immaterial and need not always be actual possession.

Possession with intent to distribute is a crime which requires an act coupled with a specific intent. Because direct proof of intent is often impossible to produce, it may, and frequently must, be shown by circumstantial evidence. When the commonwealth relies on circumstantial evidence, it must exclude every reasonable hypothesis of innocence, but need not disprove every remote possibility of innocence.

Va. Code Ann. § 18.2-248(D) provides for mitigation of punishment where one convicted of possession with intent to distribute is found not to be a dealer in drugs, but one motivated by a desire to accommodate a friend without any intent to profit or to induce or to encourage the use of drugs.

This Month

This month Kat Allison is visiting us to show us loom work and how we can use a loom for beading or weaving.

Also, we need to discuss the opportunity to volunteer for more beading shows. In the past, it has been the same ladies doing the volunteering. Please volunteer!! Let’s hear your thoughts and comments about being able to commit to volunteering to do more bead/craft shows. This helps spread the word about us to the community!

Loom Beading

When weaving on a loom, the beads are locked in between the warp threads by the weft threads. The most common bead weaving technique requires two passes of the weft thread. First, an entire row of beads is strung on the weft thread. Then the beads are pressed in between the warp threads. The needle is passed back through the beads above the warp threads to lock the beads into place. Heddle looms were popular near the beginning of the 20th century. They allowed weaving of beads by raising every other thread and inserting strung beads in the shed, the space between the lowered and raised threads. There are still a few Heddle Bead Looms being manufactured today. The most difficult part of loom work is finishing off the warp threads.

Although loomed pieces are typically rectangular, it is possible to increase and decrease to produce angular or curvy shapes. Fringe can also be added during weaving or before the piece is removed from the loom.

Free Patterns:

Today is World Lupus Day and someone YOU know may be battling with Lupus and NEED YOU. I was 16 when

Today is World Lupus Day and someone YOU know may be battling with Lupus and NEED YOU.

I was 16 when I was diagnosed. I had never heard of lupus. That is until the one day that changed my life forever. On May 26th, 2000, I was diagnosed with systemic lupus eurythematosis or SLE. We commonly refer to it as Lupus. Several weeks prior I went through several doctors and emergency rooms with multiple misdiagnoses. The simplest answers were given, usually a “Oh you have this (insert random illness here) … here’s your medicine. You should be fine in a couple of days.” If only they had been more focused, paid more attention, listened. I came home from school one day in early May to find myself so fatigued that I had to take a nap. Upon waking up, I could not move. Everything from my neck down went limp. The only thing I could do is call out for my Mom. We struggled getting me into the car and rushed to my primary doctor. Several IVs later, I could feel myself losing grip. Everything was blurry, dreary, surreal. I remember a gurney, an ambulance, the dark night sky. The sound of shuffling around me. The slight movement of the gurney I rested in as the ambulance rushed me to Portsmouth Naval. The doors open and I’m in a large room with glass doors and lots of white. My parents at the foot of my bed the doctors are hard at work. They asked if I could take off my shirt, my favorite NC Tarheels shirt. I couldn’t move and barely whispered a hesitant “OK” before they started. They cut the shirt and started hooping up wires and bags and meds, etc. But then something went wrong.

I could feel myself slipping, my eyes got dark, my chest felt like I was drowning and the last words I heard were “Code Blue, Code Blue”. The dark had found me.

The next thing I remember is waking up. My body fealt heavy. My parents were by my bedside, teary-eyed but smiling. They signaled to the doctor to let him know I was up. He smiled. He asked me if I wanted to know what happened to me and I nodded. He told me I had lupus. The symptoms were so severe that my body was shutting down … rapidly. Had I not made it to the hospital when I did I would not be here today sharing this story with you.

I found out later than an emergency dosage of chemotherapy was given to me to shock my immune system back to life. My parents had to sign the consent as I was unsoncsious. I couldn’t believe they had to deal with that decision at a moment’s notice, especially not knowing if it would work. I had a multitude of other things done to me to make the diagnosis as well as specialists that came over from CHKD to help. I spent two weeks in the hospital trying to get better. I had to re-learn how to walk because my limbs gave out. I was able to see the x-ray of my lungs that explained why I felt like I was drowning; my lungs were over 90% full of fluid. The lining of my heart and lungs were both severly inflamed and my kidneys were failing. My immune system was a war zone.

The years that followed would prove difficult. I couldn’t go out with friends because I was too weak. I would have spurts of immobility in my legs that would feel like pins and needles running through them. I didn’t have the circulation boots anymore like I did at the hospital. I cried in frustration. I became lactose intolerant. I couldn’t go out in the sun too long without passing out from the photosensitivity. I was taking prednisone, a corticosteroid, that caused damage to my hip (I have a hole in my right side) and caused me to blow up over 200+ pounds. The weight is something I struggle with to this day. I lost my hair due to the chemotherapy and didn’t know whether my treasured curls would come back. I had moonface from the steroids which caused me to hate the mirror … forever. I was told I probably would never have kids considering the amount of chemotheraphy I had to go through; it continued a year after diagnosis as well.

But here I am 13 years later telling you this story. I have a beautiful son who is 16 months old, happy, and healthy. I’ve been married for 8 years. I have led a happy and productive life thus far. Most importantly, I have Lupus but it DOES NOT have me.

I know there are others out there that share the diagnosis with me. I encourage each and every one of you today to share your story with at least one person who doesn’t know about your battle with lupus. Educate someone. Let it go.

Join me and the 1.5 million Lupies in the U.S. as well as those around the world as we celebrate our victories, remember those we’ve lost, and search for a cure and the promise of a bright future.

Do something nice for them. Let them share their struggle with you. Take time today to tell them you love and support them.

John v. John

Facts:

The husband, suspicious that the wife was having an affair, hired an investigator to conduct surveillance on her. The investigator substantiated the husband’s suspicions of the wife’s continuous extramarital relationship, and the husband sought a divorce. The trial court granted the divorce on the grounds of the wife’s adultery and granted custody of the two children to the father. The wife challenged the order. On appeal, the court affirmed, holding that the evidence supported a finding of adultery and the award of custody.

Holdings:

The Virginia Court made the following holding:

The basic issue in any custody determination is which party will further the best interests of the child. A finding of adultery is relevant to the extent that it may affect the welfare of the children.

Evidence of an adulterous disposition should be established by conduct of the guilty party and the paramour which consists of some public display of intimacy or indifference to propriety that is observed by others.

To prove adultery, the circumstantial evidence must establish (1) a disposition on the part of the defendant and the paramour to commit adultery, and (2) an opportunity to commit the offense.

Tashena and I have been friends since elementary school. She’s always been an extremely talent

Tashena and I have been friends since elementary school. She’s always been an extremely talented photographer. She has a very keen eye and I love her non-traditional approach. She is able to mix the cheesy photo requests we often ask for with personal, candid shots. She’s able to see a photo moment that needs to be captured even before we mention it!

For reasons out of my control, and much to my disappointment, I wasn’t able to take pictures of my son Kain was he was born nor did I get a chance to take maternity shots. It always bothered and upset me that I would not have these treasured pictures to show my little man as he grew up and it was eating away at me. So I got in touch with Tashena to have her take some pictures of Kain with Mommy and Daddy at our favorite spot … the beach.

It was our first time with Kain at the beach as a family and the pictures were amazing! I couldn’t pick favorites and had a hard time choosing which to post on Facebook! While the pictures will never replace the ones I was so eager to take, I now have a very beautiful collection for my son to see just how much he is loved.

I knew then that I wanted her to continue to capture our family moments and didn’t hesitate one bit to recommend her to my Mom and Dad for their 30th Anniversary pictures and the Christmas holiday family pics we take every year. Needless to say, we’re sold!

I was more than happy to help Tashena get her name out there and grow her photography business. Back in November 2012 I set up her website and blog on WordPress to coincide with her comapny Facebook page. The technology was overwhelming for her at first but she quickly grasped the tools she would need to build her brand. I was thankfuk that she always kept an open mind to new ideas and that she took initiative to learn how to use the tools effectively.

Now, 6 months and several photo shoots later, I am so proud to see the progress she has made!

Her galleries are now growing, interested clients are able to ask questions and book shoots online, and she has consistently received praise for her work. Her talent continues to bring her joy and expand her network.

Please take a moment to visit Tashena Shaw Photography and see what she has been up to! She’s added some great photo package options including a great June Photo Marathon event too good to pass up.

I’m excited to see what’s next! Great job Tashena … you rock

So I know I’m not an editing expert by any means but I LOVE sharing something when I learn abo

So I know I’m not an editing expert by any means but I LOVE sharing something when I learn about it! Especially when it’s something I taught myself or learned “accidentally”– although what I’m about to share probably was in my face for a long time and I just didn’t notice it! Whoops

When photographing something white or light colored with detail, sometimes the way you shoot and exposed can take away from it and everything appears smoother and really bright when you mean to focus on the details of the dress or you want to highlight certain aspects of it, including lace, beading, etc. I LOVE shooting wide open and in allowing more light in, my subject is usually very bright and details are lost. I love this look, and I’m not willing to change it! It’s my style, and the more and more I shoot this way, the more I fall in love with my own images. Like when you sit at the computer and say I nailed this! I LOVE this shoot! That’s how I feel when I branch out and shoot wider. LOVE it Just have to be very diligent with slowing down and picking the right focal point out of 64 on the Mark III to put on my intended subject of the image

This styled shoot is going to serve as my before and after and learning example for this! Basically, it’s as simple as it gets– you just pull that highlight ticker all the way down (to the left) and allow those beautiful details to shine! Depending on your image and how you shoot, you may have to then adjust some other settings but this worked very simply for me!

Here are some before and afters!

I used to be very afraid of shadows and not like them at all because I have an obsession with clean, all over natural illuminated subjects but when shooting wide like this, I am loving the subtle shadows and perfectly balanced highlights! It gives it a beautiful, elegant romantic look.

And here’s one other thing! I have seen SO many tutorials and advice about shooting at certain apertures, etc..especially with detail shots. I LOVE all of the different methods and advice people have to give and it’s helped immensely! The one thing struck me as awesome though was when I said okay, I know I “should” shoot this bouquet at a higher aperture to get more of the detail in there..but something told me to just go with MY flow and keep my aperture at 1.2 and the result was BEAUTIFUL and what I LOVE!!!!! It was artistic, romantic and illuminated. I loved that I followed my heart on this bouquet shot it, it was exactly what I wanted. And it was ALMOST SOOC but I did a little split toning to warm it up! Besides that? Nothing else, no other editing.

It’s so ironic that when I shoot more daring and bolder, and at a more difficult aperture– I experience much more SOOC joy! I go through editing and can’t believe how much I just love the images as they are. It definitely helped on this day to have clouds diffusing the sun so I could in direct light that was softened just right!

Hope this helps, love yall! XOXO, Amanda

Ever get that feeling something good is on its way? Yesterday & today I woke up in the best mood possible. I’m just happy. I don’t feel like sitting still. The sun is shining on me, the weather is getting beautiful, I want to run away to the beach & never come back!!! The serenity of plopping your butt on a blanket in the sand, scooting around until you find a good spot & laying there all day with a beautiful breeze blowing your tanning lotion/oil scent straight to your brain where it’ll remain a memory every time you smell it from that day forward. Little things.

Today is going to be beautiful & I have a session with my grandparents this evening to celebrate their 50th wedding anniversary. <3 They drove down to VA Beach yesterday from their home in gorgeous WV to see my Uncle graduate from ODU tomorrow & to have their love documented by my lens. I’m so thankful to be able to give them this gift. I love you both so so much, I can’t wait!!!

Now I need to take CC for a good walk & get my housework done I hope you all get a chance to be outside today & enjoy a slice of this weather heaven!!! Here’s one of my favorite images from our wedding in Nags Head, NC shot by the one & only Amanda Hedgepeth Photography || www.amandahedgepethphotography.com, my grandparents with 50 years under their belts, my parents with 27 years under theirs & us with 7 1/2 years together, married 9 months We’ll get there, look at the long line of love!! <3

Hello, perfect wedding day! Honest to goodness, I spent the better part of the week leading up to th

Hello, perfect wedding day!

Honest to goodness, I spent the better part of the week leading up to this couple’s special day checking the weather report. Here in VA Beach, the weather is a little finicky. If I’m not mistaken, we had a couple weeks early in April that were 80+ degree beach days (and my sun kissed skin was proof of that!), and then immediately after it dropped to like 50 and rainy… for basically 2 weeks. That being said, the weather was not looking promising for the wedding.

But, as always, God threw me for a loop and brought the most abundant sunshine out to shine down that Saturday. And it was beautiful!

Here are some highlights from the day:

Park Wedding Slideshow from Marybeth Hancher on Vimeo.

I know I was hired to document the day, but no one made me feel like I was “just the photographer”… I was welcomed and treated like a guest. On days like this one, it’s easy to forget that I am essentially at work while I’m snapping that shutter over and over for hours on end… I just love people in general, and I get so much enjoyment out of capturing unrepeatable moments such as these, so sometimes it just doesn’t feel like work at all.

Danae & Andrew- I am so grateful that I could be a part of your wedding day, and I wish only the absolute best for you both during your lifetime together! Enjoy this wonderful time as newlyweds!! :)

{I should also note that after this wedding, I’ll be adding some extra things to my contract in the future just in case. I feel everyone should know before they sign the papers that I’m that photographer… The one that you’ll find wiping her eyes during your first dance and saying to your bridesmaids, “They is just too cute together!”}

About Vault:

Vault is a conference on how to do church … for people who don’t like church. There are many books and conferences on how to grow a “successful” church, but unfortunately they’re not focused on how to reach the unconvinced and cynical. Read more about Vault here.

Speaker:

Vince Antonucci

Vince Antonucci became a Christian out of a completely non-Christian background and ever since his passion has been reaching the “lostest of the lost.” He was the founding Pastor of Forefront Church in Virginia Beach, Virginia, a church where 72% of the people who attend were previously unchurched non-Christians. Vince recently moved to Las Vegas where he started a new church, Verve, in the heart of Sin City, just off the Vegas Strip. Vince is the author of I Became a Christian and All I Got Was This Lousy T-Shirt (2008), Guerrilla Lovers (2010), and Renegade (2013).

Notes:

Session 1: The Call to Reach God’s Lost Children

Vince started by telling his story. Interesting that his mom was Jewish and hs dad was a professional poker player. How in the world did those two meet?

God has countless number of lost children wondering around… is anyone going to help these children back to their Father?

Jesus message “Return to me.”

The mission of every pastor and church planter are not good at helping people get back to God.

Does the church truly have an “evangelistic DNA”?

We can’t pass on DNA that we don’t have.

Don’t lose the rhythm of God’s heartbeat for lost people. How do we get ourselves around lost people?

The longer we wait to reach the lost, the harder it is to reach the lost.

Churches are like steak restaurants for PETA activists.

Session 2: Programming Church Services for People Who Don’t Like Church

Principle 1: Uncross your arms – Change people’s posture. Help people unfold their arms!

Principle 2: Wear their Shoes – How does it feel to go to church when you have never gone their before?

Principle 3: Bring a Guest to Dinner – What do you do that’s acceptable to you but hard to swallow to an outsider?

Principle 4: Be on Your Game (Joe DiMaggio) – Every service should be done like it’s someone’s first time.

Principle 5: Check Your Influences – Are you going to other churches to get things or are you accessing what lost people are interested in in order to change what is secular into something that could be sacred.

Principle 6: Use their Culture – What are people engaging in that you can access?

Principle 7: Don’t Use Your Culture – Be careful about the assumptions you make, your assumptions make your crowd.

Principle 8: Authenticity – Who is this person and is he anything like me? We need to let people access the unconditional love of God.

Session 3: Diving into the Chaos

It’s not your job to clean up someone else’s mess. Lead people to experience the love of Jesus and their sins will start to pass away.

Create the right conditions to grow which is an arena for grace.

It’s easier for most Christians to judge people instead of love people.

People who are far from God have been living with the enemy for so long they have forgotten what it’s like to experience the love of God.

There will be some people who accept grace as a reason to sin. It’s worth the risk.

If people think you like them, they will listen to you.

We need to be more comfortable in our communities instead of our churches, involved in people’s lives who need Jesus the most.

Session 4: Radical to Radical

If you want a radical follower, you need to find someone who is radically lost.

Radically lost people become radical followers of Jesus.

We are all about igniting a revolution and not starting another country club.

We must be compassionately connected to those far away from the Lord.

Session 5: Questions and Answers

Courage comes from a genuine love for people and seeking their best.

Courage to talk comes from courage of conviction. Are we offering people a better way of life?

What is the most loving way to say things to people?

Point people to evidence to help change on a level that is beyond yourself.

Session 6: No Splanga, No Glory

You’re willingness to rist is your potential return.

When we stare at our risk we are giving into our fear.

Lives are impacted when we do things for the kingdom of God.

It’s totally worth doing what God wants you to do. Stare at potential return and it will help you overcome fear.

An Excerpt from Henri Nouwen on faith: “The Flying Rodleighs are trapeze artists who perform in the German circus Simoneit-Barum. When the circus came to Freiburg two years ago, my friends Franz and Reny invited me and my father to see the show. I will never forget how enraptured I became when I first saw the Rodleighs move through the air, flying and catching as elegant dancers. The next day, I returned to the circus to see them again and introduced myself to them as one of their great fans. They invited me to attend their practice sessions, gave me free tickets, asked me to dinner, and suggested I travel with them for a week in the near future. I did, and we became good friends.

“One day, I was sitting with Rodleigh, the leader of the troupe, in his caravan, talking about flying. He said, ‘As a flyer, I must have complete trust in my catcher. The public might think that I am the great star of the trapeze, but the real star is Joe, my catcher. He has to be there for me with split-second precision and grab me out of the air as I come to him in the long jump.’ ‘How does it work?’ I asked. ‘The secret,’ Rodleigh said, ‘is that the flyer does nothing and the catcher does everything. When I fly to Joe, I have simply to stretch out my arms and hands and wait for him to catch me and pull me safely over the apron behind the catchbar.’

“ ’You do nothing!’ I said, surprised. ‘Nothing,’ Rodleigh repeated. ‘The worst thing the flyer can do is to try to catch the catcher. I am not supposed to catch Joe. It’s Joe’s task to catch me. If I grabbed Joe’s wrists, I might break them, or he might break mine, and that would be the end for both of us. A flyer must fly, and a catcher must catch, and the flyer must trust, with outstretched arms, that his catcher will be there for him.’

“When Rodleigh said this with so much conviction, the words of Jesus flashed through my mind: ‘Father into your hands I commend my Spirit.’ Dying is trusting in the catcher. To care for the dying is to say, ‘Don’t be afraid. Remember that you are the beloved child of God. He will be there when you make your long jump. Don’t try to grab him; he will grab you. Just stretch out your arms and hands and trust, trust, trust.’ ”

Great day drinking from a fire hydrant.

Chapter 7 bankruptcy eliminates debts, stops debt collectors, and provides people with fresh start for their finances. Chapter 7 is very effective on credit card debt, medical bills, ordinary civil judgments, and other unsecured debts such as loans without collateral. Many debtors filing chapter 7 are able to keep all of their property as well. Debtors do this by using the property allowances provided by Virginia statutory exemptions, which offer protections up to a set value for a home, a car, household goods, and other property. Chapter 7 is usually a very quick process, often being competed in the course of several months.
