<p>It&#8217;s <a href="http://spectator.org/archives/2009/06/30/the-powers-that-be">blindingly</a> <a href="http://spectator.org/archives/2009/10/26/nadlers-acron-ethics">obvious</a> why corrupt <a href="http://www.discoverthenetworks.org/guideDesc.asp?catid=93&#38;type=issue">leftist</a> lawmakers including House Judiciary Committee chairman <a href="http://www.discoverthenetworks.org/individualProfile.asp?indid=1987">John Conyers</a> (D-Mich.) and his subcommittee chairman <a href="http://www.discoverthenetworks.org/individualProfile.asp?indid=1986">Jerrold Nadler</a> (D-N.Y.) won&#8217;t investigate their good friends at <a href="http://www.discoverthenetworks.org/groupProfile.asp?grpid=6968">ACORN</a>, but as evidence continues to mount of ACORN&#8217;s habitual, potentially criminal wrongdoing, why does the mainstream media refuse to investigate a scandal that &#8220;<a href="http://www.bloomberg.com/apps/news?pid=20601039&#38;sid=aZ8U4iOoY83w">could be as historically significant as Watergate</a>&#8220;?</p>
<p>Big Media seems to be taking cues from what NewsReal blogger <a href="http://newsrealblog.com/author/kathyshaidle/">Kathy Shaidle </a>calls the <a href="http://www.discoverthenetworks.org/individualProfile.asp?indid=977">George Soros</a> Steno Pool at <a href="http://www.discoverthenetworks.org/groupProfile.asp?grpid=7150">Media Matters for America</a>. Throughout the continuing revelations about ACORN, Media Matters has steadfastly defended its allies at ACORN. One has to wonder if ACORN is keeping <a href="http://www.discoverthenetworks.org/groupProfile.asp?grpid=7150">Media Matters</a> on retainer and if so how big the regular checks must be.<!--more--></p>
<p>Soon after the first few <a href="http://biggovernment.com/acorn/">hidden-camera videos</a> of James O&#8217;Keefe and Hannah Giles surfaced in September showing the public ACORN&#8217;s barely concealed criminal proclivities, John V. Santore of Media Matters launched a sleaze attack against O&#8217;Keefe, Giles, and their online publisher, Andrew Breitbart.</p>
<p>Because O&#8217;Keefe, Giles, and Breitbart are conservatives there is no way they could be honest reporters of facts, <a href="http://mediamatters.org/blog/200909160028">implied Santore</a>. Giles even attended events at the National Journalism Center, he noted. <em>Heavens</em>! Of course  ideological disqualification never applies to left-of-center media outlets.</p>
<p>Santore also focused on the journalistic ethics involved in the undercover video sting operation, arguing that because the reporters had an animus against ACORN they couldn&#8217;t be trusted. Tell that to the award-winning crusading journalists throughout American history who have helped to bust up (other) crime gangs and expose malfeasance everywhere. Having an opinion or a desire to do the right thing isn&#8217;t a requirement to be a reporter nor does it disqualify a person from being a reporter.</p>

<p>Appropriately, on his TV show Glenn Beck observed</p>
<blockquote><p>The <em><a href="http://www.discoverthenetworks.org/groupprofile.asp?grpid=6207">New York Times</a></em> wonders why they are losing readers. It&#8217;s because reading their paper is like entering a time machine or reading the news in your rearview mirror. They didn&#8217;t even bother to jump on the ACORN story, which came complete with corruption, hookers and pimps.</p></blockquote>
<p>The <a href="http://www.discoverthenetworks.org/groupProfile.asp?grpid=6968">ACORN</a> scandal is a great story yet apart from Fox News and a few other media outlets, the media has been ignoring it. What coverage we&#8217;ve seen &#8211;especially from the Associated Press&#8211; tends to focus not on ACORN&#8217;s corruption, but instead on the political ramifications of what is now happening to the radical advocacy group-cum-organized crime syndicate. Still other news stories focus on the journalistic ethics involved in the <a href="http://biggovernment.com/acorn/">hidden-camera videos</a> of James O&#8217;Keefe and Hannah Giles that helped to show the public ACORN&#8217;s barely concealed criminal proclivities.</p>
<p>Particularly tedious are the whiny, <a href="http://newsrealblog.com/2009/11/03/media-matters-how-eric-boehlert-became-illiterate/">typo-laden</a> essays of Eric Boehlert of Media Matters who declares that whatever the videos are, <a href="http://clips.mediamatters.org/blog/200909290033">they&#8217;re &#8220;not really journalism at all.&#8221;</a></p>
<p>Media critic Jack Shafer of the liberal Slate.com website excoriates the mainstream media for ignoring the ACORN story. Shafer wrote:</p>
<blockquote><p>The liberal advocacy group Media Matters for America complains that the ACORN videos, which aren’t a “major story,” are driving an “incomplete, misleading” media stampede. But Media Matters is wrong. Independent news organizations, including the <em>Washington Post</em>, the <em>New York Post</em>, and the <em>Baltimore Sun</em>, are chasing the ACORN story not because they’ve been bamboozled by the Breitbart exposé but because the dress-up stunt has pointed them toward what could be fertile grounds for wrongdoing.</p></blockquote>
<p>Actually, when Shafer <a href="http://slate.com/id/2229387">wrote the above referenced column on Sept. 23</a> it appeared the media was actually going to do its job and thoroughly investigate ACORN.</p>
<p>Alas, it was not to be.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Written by the two journalists who uncovered the <a title="watergate" href="http://en.wikipedia.org/wiki/Watergate_scandal" target="_blank">Watergate scandal</a>, <em>All the President&#8217;s Men</em> is part detective story, part political thriller and part first-draft of history.  <a title="bob woodward" href="http://en.wikipedia.org/wiki/Bob_Woodward" target="_blank">Bob Woodward</a> and <a title="carl bernstein" href="http://en.wikipedia.org/wiki/Carl_Bernstein" target="_blank">Carl Bernstein</a> ended up on the Watergate story by accident, stayed on it despite personal difference, and ultimately uncovered one of the greatest political scandals the US has ever known, which led to the resignation of President Richard Nixon.</p>
<p>The book was written and published before the full story of Watergate was known, and so it&#8217;s sometimes a bit confusing.  It&#8217;s slow to start with, the significance of events and people are not clear, and the two journalists seem to uncover a lot of information that doesn&#8217;t make sense. There are a lot of names to remember, and many of these characters don&#8217;t appear again.  However, these are all natural consequences of the book being an account of real events, rather than fiction.  Once it becomes clear to the journalists who the major players are, the story begins to make more sense and the pace picks up.</p>
<p>The journalists are like detectives in the way they collect and assemble information, but unlike detectives, they can&#8217;t compel anyone to talk to them, which makes their job harder and the story more frustrating.  Everything they publish has to be verified by at least three sources, and many times it&#8217;s &#8216;obvious&#8217; what is going on but the story can&#8217;t advance until things are verified.  The journalist&#8217;s frustration at times like these is evident.</p>
<p>Because the book ends before the full extent of the Watergate scandal is known, the end is a bit ambiguous and unsatisfying, I suppose because we now know what happened, and because the thread of events now looks clearer than it would have at the time.</p>
<p>What I found most interesting about this book was the background it gives about American politics and political institutions.  To someone from a country that is at best ambiguous and at worst deeply cynical and government and institutions, the reverence that Americans (even investigative journalists) have for the office of President seems strange. For a reader used to the Westminster system, the executive system of government looks opaque and ripe for cronyism.</p>
<p>The other interesting aspect of the book is the window it gives onto the world of investigative journalism and news in the days before computers, mobile phones, and internet.  The journalists meet with sources in person, they use ingenious things like reverse telephone directories to track down people, and records (both the journalists&#8217; and those of their investigative subjects) are all single-copy paper documents that can disappear quite easily.  On the other hand, their sources in government are happy to talk on the phone from their offices &#8211; obviously the days of manual switchboards, untraceable calls, and office doors rather than open plan layouts made it safer.</p>
<p><em>All the President&#8217;s Men</em> is a good read, and highly recommended.  I&#8217;m keen to see the movie and perhaps read Woodward and Bernstein&#8217;s other Watergate book, <em><a title="the final days" href="http://en.wikipedia.org/wiki/The_Final_Days" target="_blank">The Final Days</a>.</em></p>

<p>Pitching his case before more than 600 campus audiences, Friedman concludes that alien aircraft have been around for decades and that governments have tried to keep an airtight lid on them.</p>

<h4>Hacked files of the Climatic Research Unit, Global Warming a deliberate fraud</h4>
<h2>The Death Blow to Climate Science</h2>

<p><a href="http://canadafreepress.com/index.php/article/17102#" target="_blank">Global Warming<img src="http://images.intellitxt.com/ast/adTypes/mag-glass_10x10.gif" alt="" /></a> is often called a hoax. I disagree because a hoax has a humorous intent to puncture pomposity. In science, such as with the Piltdown Man hoax, it was done to expose those with fervent but blind belief. The argument that global warming is due to humans, known as the anthropogenic global warming theory (AGW) is a deliberate fraud. I can now make that statement without fear of contradiction because of a remarkable hacking of files that provided not just a smoking gun, but an entire battery of machine guns.</p>
<p>Someone hacked in to the files of the Climatic Research Unit (CRU) based at the University of East Anglia. A very large file (61 mb) was downloaded and posted to the web. Phil Jones Director of the CRU has acknowledged the files are theirs. They contain papers, documents letters and emails. The latter are the most damaging and contain blunt information about the degree of manipulation of climate science in general and the Intergovernmental Panel on Climate Change in particular.</p>
<h3>Climate science hijacked and corrupted by this small group of scientists</h3>
<p>Dominant names involved are ones I have followed throughout my career including,<strong> Phil Jones, Benjamin Santer, Michael Mann, Kevin Trenberth, Jonathan Overpeck, Ken Briffa and Tom Wigley</strong>. I have watched climate science hijacked and corrupted by this small group of scientists. This small, elite, community was named by Professor Wegman in his report to the National Academy of Science (NAS).</p>
<p>I had the pleasure of meeting the founder of CRU Professor Hubert Lamb, considered the Father of Modern Climatology, on a couple of occasions. He also peer reviewed one of my early publications. I know he would be mortified with what was disclosed in the last couple of days.</p>
<p>Jones claims the files were obtained illegally as if that absolves the content. It doesn’t and it is enough to destroy all their careers. Jones gave a foretaste of his behavior in 2005. Warwick Hughes asked for the data and method he used for his claim of a 0.6°C temperature rise since the end of the nineteenth century. Jones responded, <em>“We have 25 years or so invested in the work. Why should I make the data available to you when your aim is to try and find something wrong with it?”</em> He has stonewalled ever since. The main reason was because it was used as a key argument in the Intergovernmental Panel on Climate Change (IPCC) Reports to convince the world humans caused rapid warming in the 20th century. The emails obtained are a frightening record of arrogance, and deception far beyond his 2005 effort.</p>
<p>Another glimpse into what the files and emails reveal was the report by Professor Deming. He wrote, <em>“ With publication of an article in Science (in 1995) I gained sufficient credibility in the community of scientists working on climate change. They thought I was one of them someone who would pervert science in the service of social and political causes. So one of them let his guard down. A major person working in the area of climate change and global warming sent me an astonishing email that said. “We must get rid of the Medieval Warm Period.”</em> The person in question was Jonathan Overpeck and his even more revealing emails are part of those exposed by the hacker. It is now very clear that Deming’s charge was precise. They have perverted science in the service of social and political causes.</p>
<p>Professor Wegman showed how this “community of scientists” published together and peer reviewed each other’s work. I was always suspicious about why peer review was such a big deal. Now all my suspicions are confirmed. The emails reveal how they controlled the process, including manipulating some of the major journals like <em>Science and Nature</em>. We know the editor of the Journal of Climate, Andrew Weaver, was one of the “community”. They organized lists of reviewers when required making sure they gave the editor only favorable names. They threatened to isolate and marginalize one editor who they believed was recalcitrant.</p>
<h3>Total Control</h3>
<p>These people controlled the global weather data used by the IPCC through the joint Hadley and CRU and produced the HadCRUT data. They controlled the IPCC, especially crucial chapters and especially preparation of the Summary for PolicyMakers (SPM). Stephen Schneider was a prime mover there from the earliest reports to the most influential in 2001. They also had a left wing conduit to the New York Times. The emails between Andy Revkin and the community are very revealing and must place his journalistic integrity in serious jeopardy. Of course the IPCC Reports and especially the SPM Reports are the basis for Kyoto and the Copenhagen Accord, but now we know they are based on completely falsified and manipulated data and science. It is no longer a suspicion. Surely this is the death knell for the CRU, the IPCC, Kyoto and Copenhagen and the Carbon Credits shell game.</p>
<p>CO2 never was a problem and all the machinations and deceptions exposed by these files prove that it was the greatest deception in history, but nobody is laughing. It is a very sad day for science and especially my chosen area of climate science. As I expected now it is all exposed I find there is no pleasure in “I told you so.”</p>

<p style="text-align:justify;"><strong>McKay</strong> johti läntisessä Washingtonissa liittovaltion syyttämistoimia kunnes hänet erotti sama hallinto, joka oli hänet nimittänytkin. McKayn toimisto lähetti kannabiksen salakuljettajia ja kasvattajia vankilaan kärsimään vuosikymmenien pituisia tuomioita. <p>Herbert Miller, who drafted the pardon for Nixon&#8217;s role in the Watergate scandal, died today.</p>
<p>The New York Times has the following <a href="http://www.nytimes.com/2009/11/21/us/21miller-1.html?_r=1&#38;emc=tnt&#38;tntemail0=y">obituary </a>detailing Miller&#8217;s long legal career including his achievements in the 1960&#8217;s (pursuing Hoffa on jury tampering charges) and his work with President Nixon and several other players in the Watergate scandal.</p>
<p><em>Mr. Miller told Nixon that he could not get a fair trial and that the case would be likely to drag on for years. He eventually persuaded Nixon to accept a pardon from President <a title="More articles about Gerald Rudolph Ford Jr.." href="http://topics.nytimes.com/top/reference/timestopics/people/f/gerald_rudolph_jr_ford/index.html?inline=nyt-per">Gerald R. Ford</a>, despite its implication of guilt. To clear the way for his client, he said in 1999 in his first public discussion of the case, he sought assurances from Leon Jaworski, the Watergate special prosecutor, that Jaworski would not oppose a pardon, a potential stumbling block that Nixon feared.</em></p>
<p><em>Mr. Miller, who represented Nixon for more than 20 years, also asserted Nixon’s ownership rights to the White House tapes and documents, a hotly contested issue that took years to resolve. Before the pardon was granted, an initial compromise was reached under which the material went to the <a title="More articles about National Archives and Records Administration" href="http://topics.nytimes.com/top/reference/timestopics/organizations/n/national_archives_and_records_administration/index.html?inline=nyt-org">National Archives</a>, where neither Nixon nor archives officials would be allowed access to it without the other’s permission.</em></p>
<p><em>Finally, Mr. Miller persuaded Nixon to sign a statement admitting that he had been wrong in “not acting more decisively and more forthrightly in dealing with Watergate, particularly when it reached the state of judicial proceedings.” The pardon, granted on Sept. 8, 1974, spared Nixon indictment and trial.</em></p>
<p><em>“He was the ideal attorney for Nixon,” said John J. Cassidy, a founding partner of Mr. Miller’s law firm. “Nixon was so embattled, so hated, that he needed a strong lawyer to stand beside him, and Jack never flinched. He was fearless.”</em></p>

<p><em>After working on the Nixon pardon, Mr. Miller continued to defend his client’s interests tenaciously. He carried on a long legal struggle to block access to Nixon’s presidential tapes and papers, arguing they were private property. In a case that reached the Supreme Court in 1982, he successfully argued that Nixon could not be held civilly liable for acts performed while he was president. Nixon had been sued by a Pentagon employee who claimed he had been fired after testifying about cost overruns.</em></p>

<li>Voters <a href="http://artsbeat.blogs.nytimes.com/2009/11/19/voters-choose-flannery-oconnor-in-national-book-award-poll/" target="_blank">have chosen Flannery O&#8217;Connor&#8217;s <em>Complete Stories</em></a> as the best book to have won the National Book Award over the past sixty years.  It&#8217;s odd that four of the six contenders were short story collections.  I tend to prefer novels to short stories anyway, but that ratio seems off.</li>

Mamosa, my blogging friend over at <a href="http://http://lorduseme.blogspot.com/">Eyes on the Prize</a>, just tagged me to name 10 random things about myself and pass it on to 10 others.  The goal is for us to all get to know each other better.</p>
<p>Seems to me that I&#8217;m a rather transparent, simple person and that anyone who talks with me for a few minutes or reads some of my posts will probably be pretty familiar with me.  But I&#8217;ll try.</p>

1.  Vintage Barbie dolls, 1958-1964 are one of my favorite things.  They bring back very pleasant memories just looking at them.  Mine was a 1962 brunette bubble-cut (I call it the Jackie Kennedy hairstyle) which came with a red mailot bathing suit and black high heels.  Alas, I no longer have mine, but a few years ago I paid way too much for a replacement original at a doll shop in Fort Worth.  Playing with Barbies did not scar me or make me feel inadequate.</p>

2.  The Drama Department was one of two main things that kept me in high school (the other reason I stayed was that my brother had dropped out and my mother never got over it.  I couldn&#8217;t do that to her.)  Norma Davis was a wonderful, kind Christian teacher who really helped me by giving me a chance to blossom when I discovered my love of theater.  Auditions can be really scary things and I chickened out at the door when I was a sophomore.  But in my junior and senior years I got the lead in the class plays and won the Best Actress awards for both years.  Over the years, I&#8217;ve only done a few community theater shows and one at the junior college, but just walking into a live theater gives me a rush.  There&#8217;s nothing like walking around on a stage, either empty or a fully dressed set.  The atmosphere, the smell, the magic.  Ahhh.</p>

3.  Galveston is my favorite place in Texas.  Of course the water is nicer in Corpus Christi and obviously it is touristy and I know that men in Italian suits (you know what I mean) used to do a lot of business there.  But it&#8217;s tropical, affordable, historical (until the 1900 hurricane it was the largest city in Texas), beautiful, reachable (only 6 hours away by car) and fun.  Not for me the luxury resorts in foreign places.  Nothing beats staying at the <a href="http://www.wyndham.com/hotels/GLSHG/main.wnt">Galvez Hotel </a>(built in 1911), eating breakfast in the dining room (with beautifully appointed settings on starched, white table cloths), walking on the beach, feeding the seagulls, going to one of the many museums, eating seafood at Gaido&#8217;s, and mostly just driving along the seawall with the windows down.</p>
<p>4.  With only a couple of exceptions, I have sewn my own curtains during our 36 years of marriage and also made a lot of clothes.  But I have never put in a zipper and have a lot of trouble with sleeves and collars.  Patterns need to be simple for me.  It would be better if I would actually learn to sew better because I&#8217;ve always been hard to fit.  I&#8217;m tall (about 5&#8242;10) and it&#8217;s not easy finding things that fit correctly.</p>
<p>5.  I&#8217;m passionate about not being in social drinking situations.  My father became an alcoholic when I was a young teenager and nothing  good ever comes of drinking too much.  Nothing.  That said, I don&#8217;t think drinking alcohol is wrong or evil, but excess is and I know very few people who stop at one drink.  Alcohol could be a real problem for me because I love the taste of champagne and Tecate beer, but I limit it to one or less and very rarely have any.  For goodness sake, I&#8217;m 55 years old and can&#8217;t quit biting my fingernails &#8211; how good would I be at having to give up something really difficult? </p>
<p>6.  My politics have come full circle, or at least my political affiliations have.  The Watergate hearings were going strong when I registered to vote.  My daddy and his family were yellow dog Democrats, in fact a good way for my dad to get mad and start cussing was for a Republican to be on television.  But watching the hearings, I was absolutely appalled at the way the Democrats were acting &#8211; they were like witches dancing naked in the moonlight.  So, I registered Republican.  A few years later, I re-registered Democrat but always voted for who I thought was the best candidate and have never voted for a pro-abortion candidate.  Unfortunately, Jimmy Carter was my selection in 1976, but I voted for Ronald Reagan both times.  It was Bill Clinton who drove me back into the arms of the Republican party.</p>

7.  Long straight hair and little or no make-up were the styles when I was young and it&#8217;s not been easy to leave that behind.  For years I almost never wore any make-up, and now I only do when going to town, and not always then.  But I no longer have the glow of youth (walking by a mirror or a plate glass window is like a Halloween scare); a little powder and mascara sure help polish me up.  My hairstyling skills are almost as good as my sewing, and I don&#8217;t know what to do with my hair and I&#8217;m way too cheap to get it done often.  Mostly I wear a pony-tail, about every year or 2 getting it cut into a short page boy&#8230; it&#8217;s probably time for my annual trip to Pro-Cuts.</p>
<p>8.  Raised in the Southern Baptist Church,I became charismatic in my teens.  I love the SBC but some things about it irritate me.  The &#8216;moderates&#8217; went way too far, but some of the conservatives have swung back too far (even more conservative than the Bible and that&#8217;s not right).  It feels so familiar and at home when we attend one, but then I start to feel like I need to hide the scriptural things I believe, and that&#8217;s just not right.  So, we don&#8217;t know what to do.  We are between churches right now and I would so love to have a church home where we can worship, share, learn and fellowship.</p>
<p>9.  I used to have a very good memory (my husband does not think this is a good thing).  Maybe it was memorizing those scripts (by the time opening night rolls around, one usually knows not only their lines but everyone else&#8217;s as well).  I can remember what I was wearing when, and sometimes what someone else was wearing and describe the outfits.  Trivial Pursuit is one of my favorite games but I don&#8217;t get to play very often.  I am a wealth of useless information (the Battle of Hastings was 1066; don&#8217;t ask why I remember this or what it has to do with anything).  My memory is  not as sharp as it used to be, and since my mother has Alzheimer&#8217;s, this concerns me a little.</p>
<p>10.  Today&#8217;s my birthday.  I share it with the state of Oklahoma.  Mine in 1954, Oklahoma&#8217;s 1907.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p style="text-align:justify;"><img class="alignleft size-medium wp-image-2230" title="73266539" src="http://lifeschool.wordpress.com/files/2009/11/movie_director.jpg?w=300" alt="73266539" width="300" height="199" />Dalam setiap lakon, baik itu sekedar sandiwara sekolahan atau film ala Hollywood, selalu ada sutradara yang berhak mengatur mulai jalannya cerita hingga penentuan pemain. Demikian pula dalam setiap lakon politik di panggung kenegaraan kita, tak heran bila masyarakat bertanya-tanya, setelah semua aktor menampilkan diri, maka, siapakah sang sutradara? Bila di panggung sandiwara atau teater sang sutradara akan tampil dengan bangga saat diperkenalkan di akhir acara, atau menampilkan diri dalam credit title di akhir film, maka dalam konteks sutradara di panggung politik kenegaraan malah sebaliknya, sang sutradara malah &#8216;ngumpet&#8217;.</p>
<p style="text-align:justify;">Kenapa ngumpet? Karena sebagai &#8216;aktor intelektual&#8217; ia memiliki peran paling besar dan merupakan otak dari segalanya, maka, ia pun kemudian memiliki tanggung jawab paling besar dibandingkan aktor biasa. Apalagi bila kemudian drama nasional yang dipertontonkan merupakan perbuatan yang merugikan pihak lain.</p>
<p style="text-align:justify;">Terkadang, sang sutradara memang tidak tersingkap sampai lakon berakhir. Akan tetapi, itu tak sering. Bahkan, andaikata tak disebutkan gamblang, biasanya ada tindakan yang terindikasi bahwa seseorang adalah sutradaranya. Seperti tulisan saya kemarin di Politikana (untuk link mohon baca kembali tulisan saya kemarin), dalam skandal Watergate misalnya, Richard Nixon memang tidak terbukti sebagai sang sutradara. Ia mundur dari jabatannya sebelum pemeriksaan, yang berarti akan mengungkap segalanya termasuk jati diri sang sutradara. Meski tidak pernah ada pernyataan resmi tentang jati diri sang sutradara kasus Watergate, publik tetap bisa menduga, bisa jadi Nixon-lah  sang sutradara itu sendiri.</p>
<p style="text-align:justify;">Dalam kasus kekisruhan yang menimpa KPK dan Polri, yang semula merupakan kasus Bank Century dan kasus pembunuhan Nasrudin Zulkarnaen yang terpisah, publik hanya bisa meraba, siapa kira-kira sutradaranya. Dalam tulisan di internet, berseliweran berbagai skenario terutama dugaan tentang sang sutradara, namun semua hanya dugaan dan prasangka belaka. Tidak ada bukti yang bisa disampaikan. Hanya saja, seharusnya otak yang waras bisa meraba, kemana sebenarnya arah kasus ini. Karena bila memang sekecil itu skalanya, saya pikir tak mungkin sampai dibentuk Tim 8 segala. Sekarang, tinggal menunggu siapa yang akan dikorbankan dan &#8220;diberi cap&#8221; sebagai sutradara. Padahal, mungkin yang bersangkutan cuma figuran belaka.</p>
<p style="text-align:justify;">Sudah lama sekali banyak kasus yang tergolong &#8216;dark number&#8217;. Jangankan sutradaranya, wong aktor pelakunya saja masih gelap atau &#8216;digelapkan&#8217; kok. Misalnya kasus penculikan aktivis 1997-1998, Kerusuhan 13-14 Mei 1998, Petrus di dekade 1980-an, atau Tragedi Tanjung Priok 1984. Meski ada dugaan dari publik atau pengamat ahli, semua itu cuma dugaan tanpa bukti faktual. Memang, ada aktor yang tercatat sejarah, namun belum tentu aktor utama. Terkadang, seperti halnya dalam Peristiwa Malari 1974, aktor utamanya yaitu Ali Moertopo dan Soemitro tidak mendapatkan hukuman resmi dalam pengadilan, melainkan &#8216;hanya&#8217; hukuman berupa pencopotan jabatan saja. Malah, para pengamat ahli menduga dalam banyak kasus konflik di era Orde Baru, sang sutradara justru yang berhak mencopot jabatan para aktor utama itu tadi. Namun, sekali lagi itu hanya dugaan tanpa bisa terungkap.</p>
<p style="text-align:justify;">Pertanyaan saya: akankah kekisruhan KPK vs Polri ini akan berujung pada dark number? Kalau memang begitu, memang repot. Ujungnya kita tinggal menunggu kiamat dan menanti pengadilan Tuhan saja. Akan tetapi harus diingat, kita tidak bisa &#8216;menonton&#8217; pengadilan Tuhan, karena tiap kita akan diadili sendiri-sendiri. Dan pengadilan Tuhan tidaklah mengadili kasus, melainkan mengadili perbuatan pribadi saja. Sehingga, kita pun tidak akan bisa memastikan hal itu, selain orang itu sendiri dan Tuhan tentunya. Akankah semua ini kita serahkan ke Tuhan saja?</p>

<title><![CDATA[Kebenaran Terkuak, Benarkah?]]></title>

<description><![CDATA[Kemarin, sidang pengadilan dalam perkara Antasari Azhar yang menjadi terdakwa dalam kasus pembunuhan]]></description>
<content:encoded><![CDATA[<div class='snap_preview'><p>Kemarin, sidang pengadilan dalam perkara Antasari Azhar yang menjadi terdakwa dalam kasus pembunuhan terhadap Direktur PT Putra Rajawali Banjaran Nasrudin  Zulkarnaen heboh. Sebabnya, saksi kunci yaitu mantan Kapolres Jakarta Selatan Kombes. Pol. Williardi Wizard memberikan kesaksian di pengadilan bahwa BAP dirinya telah direncanakan dengan sasaran Antasari. (berita antara lain bisa disimak <a href="http://megapolitan.kompas.com/read/xml/2009/11/10/15232262/williardi.akui.dapat.petunjuk.atasan.antasari.terharu">di sini</a>). Tentu saja pengakuan berani itu membuat heboh, karena makin mempertajam dugaan adanya rekayasa kriminalisasi terhadap KPK.</p>
<p>Akan tetapi, meski menguntungkan Antasari Azhar, kesaksian Williardi belum tentu sebuah kebenaran. Ia masih harus diuji lagi. Karena seperti pernah saya tulis, apa yang terjadi saat ini di panggung drama &#8220;Cicak vs Buaya&#8221; barulah sebatas &#8220;perang pernyataan&#8221; belaka. Belum ada bukti yang terungkap karena kasusnya masih belum sampai di persidangan untuk kasus Chandra dan Bibit dan masih dalam proses persidangan awal. Bukti-bukti seperti rekaman audio atau video belum lagi diputar, walau menurut KUHAP kita yang warisan kolonial Belanda itu sebenarnya sistem hukum kita belum mengadopsi alat bukti digital semacam ini. Karena itu, Mahkamah Konstitusi (M.K.) patut dipuji telah &#8216;membuat sejarah&#8217; dengan memperdengarkan rekaman sebagai alat bukti uji materi di persidangannya.</p>
<p>Sebenarnya, klaim kebenaranlah yang telah membuat umat manusia terlibat konflik satu sama lain. Baik itu berlatar nasionalisme, agama, sektarianisme, atau persoalan sepele seperti rebutan lahan parkir antar preman. Masing-masing pihak yang berkonflik merasa dirinya benar. Dan untuk mempertahankan kebenaran itulah mereka rela bertarung satu sama lain. Secara fisik bahkan perang besar kalau perlu.</p>
<p>Klaim kebenaran ini bisa jadi tak akan pernah benar-benar terbukti sampai akhir dunia, saat pengadilan Tuhan digelar. Masalahnya, dalam klaim kebenaran ada perspektif atau sudut pandang, dimana tiap pihak yang berkonflik ingin menang atau dimenangkan. Faktor ego dan harga diri juga dimainkan di sini. Apalagi kalau ada faktor kehormatan yang sebenarnya abstrak itu, kebenaran makin jadi nisbi. Demi sebuah kehormatan, apa pun bisa dipertaruhkan bukan?</p>
<p>Karena itu, walau ada pengakuan dari Williardi soal dugaan adanya rekayasa kriminalisasi KPK dan pimpinannya, belum tentu itu kebenaran. Jangan bilang saya memihak &#8220;buaya&#8221;, karena saya ini cuma &#8220;cicak&#8221;. Saya cuma bilang pada rekan-rekan sesama &#8220;cicak&#8221;, jangan berpesta dulu, karena saya yakin para &#8220;buaya&#8221; sedang mengasah taringnya sekarang. Apalagi pasca kesaksikan Williardi yang menggigit ekor mereka itu!</p>
<p>Karena itu alangkah baiknya bila semua pihak dapat mengambil pelajaran dari kasus Watergate, yang telah difilmkan dengan judul &#8220;All The President&#8217;s Men&#8221;, dimana kepentingan negara diletakkan di atas segalanya. <p>A little scary though. He said that law students never realize just how hard they are going to work. He also said the longest he ever worked was beginning 7 am on a Thursday, and leaving Friday at 6 pm. I won&#8217;t lie, I did 17.24 hours straight at a restaurant once (no kidding) but then again, I was 16 at the time. How does one have a family but spend 30 hours straight at the office? Even that isn&#8217;t so bad, but he also said he used to work all day, seven days a week.</p>

Dean</a> will give a free public lecture titled “Watergate: The Final Chapter” and sign copies of his newly reissued, bestselling book <a href="http://www.amazon.com/Blind-Ambition-White-House-Years/dp/0671224387" target="_blank">Blind Ambition</a>.<!--more--></p>
<p>John W. Dean was a key figure in the <a href="http://www.washingtonpost.com/wp-srv/politics/special/watergate/" target="_blank">Watergate</a> scandal and whose testimony first linked President <a href="http://www.whitehouse.gov/about/presidents/richardnixon" target="_blank">Richard Nixon</a> directly to the burglary. Dean, who served as White House counsel for almost three years and who chose to cooperate with Watergate investigators, was charged with obstruction of justice and spent about four months in prison for his role in the Watergate cover-up. He is the author of several books, including Worse Than Watergate, in which he denounced the administration of President George W. Bush and called for the impeachment of Bush and Vice President Dick Cheney. Dean’s first book on Watergate, Blind Ambition, has just been reissued in a new edition that seeks to debunk what Dean feels are apologist histories of the Watergate scandal. As new White House tapes continue to be made available from the <a href="http://www.nixonlibrary.gov/" target="_blank">Nixon Library</a>, now part of the National Archives and Records Administration, Dean remains at the center of the debate about Nixon’s role in the Watergate break-in and subsequent cover-up.</p>

<p>Secondo la norma attualmente in vigore, <strong>il medico</strong> <strong>deve rendere edotto il paziente di tutte informazioni e le controindicazioni inerenti un trattamento sanitario al quale il paziente stesso venga sottoposto</strong>. La vaccinazione, che ad ogni effetto è  un trattamento sanitario, ha una particolarità: si effettua principalmente su individui sani; e come tutti i trattamenti sanitari, può avere delle controindicazioni.<br />
Su quali siano queste indicazioni e controindicazioni, e del fatto che il medico debba informarne il paziente che si sottopone alla vaccinazione, nessuno sa nulla. E non si parla dei &#8220;sospetti&#8221; &#8211; per modo di dire, e dei quali si parlerà in un prossimo articolo &#8211; sulla tossicità degli adiuvanti e dei conservanti contenuti nel preparato, ma semplicemente delle indicazioni riportate sul &#8220;<span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Bugiardino" target="_blank">bugiardino</a></strong></span>&#8221; (foglietto illustrativo). Tipo quelle che seguono:</p>

Nell’ambito della sorveglianza post-marketing di vaccini trivalenti stagionali in tutte le fasce di età e di vaccini trivalenti stagionali adiuvati con MF59 e con composizione simile a quella di Focetria (antigene di superficie, inattivato, adiuvato con MF59C.1) autorizzati per la somministrazione in soggetti anziani di età superiore ai 65 anni sono stati osservati i seguenti eventi avversi:<br />
<strong><span style="color:#ff0000;">Raro:</span></strong><br />
<strong><span style="color:#ff0000;">Nevralgia, parestesia, convulsioni, trombocitopenia transitoria.</span></strong><br />
<strong><span style="color:#ff0000;">Sono state osservate reazioni allergiche, in casi rari con shock.</span></strong><br />
<strong><span style="color:#ff0000;">Molto raro:</span></strong><br />
<strong><span style="color:#ff0000;">Vasculite con transitorio coinvolgimento renale ed eritema multiforme essudativo.</span></strong><br />
<strong><span style="color:#ff0000;">Disturbi neurologici, come encefalomielite, neurite e sindrome di Guillain Barré.</span></strong><br />
<strong>5.0 Proprietà farmacologiche</strong><br />
Categoria farmacoterapeutica: vaccino influenzale, codice ATC: J07BB02<br />
<strong><span style="color:#ff0000;">Questo medicinale è stato autorizzato in &#8220;Circostanze eccezionali&#8221;.</span></strong></p></blockquote>
<p>In sintesi, sul vaccino che dovrebbe (il condizionale è d&#8217;obbligo) proteggere dall&#8217;influenza suina si apprende che:</p>
<ul>
<li>è stato autorizzato in circostanze eccezionali &#8211; ovvero pandemia dichiarata in atto dall&#8217;OMS (Organizzazione Mondiale della Sanità) -: quindi non deve sottostare a tutti i controlli previsti usualmente per i farmaci ed i vaccini;</li>
<li>non se ne conosce l&#8217;effetto &#8211; non vi sono dati clinici al riguardo &#8211; sulle donne in gravidanza;</li>
<li>non se ne conosce l&#8217;effetto &#8211; non vi sono dati clinici al riguardo &#8211; su bambini e addolescenti;</li>
<li>potrebbe non funzionare (niente immunità dall&#8217;influenza suina)</li>
<li>in casi molto rari potrebbe causare in soggetti al di sopra di 65 anni <span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Encefalomielite" target="_blank">encefalomielite</a></strong></span>, <span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Neurite" target="_blank">neurite</a></strong></span> (detta anche Assone, NdA) e <span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Sindrome_di_Guillain-Barr%C3%A9" target="_blank">sindrome di Guillain-Barré</a></strong></span>.</li>
</ul>

Per quanto riguarda l&#8217;encefalomielite in una sua particolare forma (ADEM &#8211; Encefalomielite acuta disseminata) è noto nell&#8217;<span style="color:#0000ff;"><strong><a href="http://www.medicoebambino.com/?id=CL0406_10.html" target="_blank">ambiente medico</a></strong></span> che <strong>detta malattia &#8220;<em>&#8230;esordisce improvvisamente con un ampio spettro di segni e sintomi neurologici spesso a breve distanza da un episodio infettivo o da una vaccinazione.</em></strong><br />
<strong> Letto bene? A breve distanza da una vaccinazione: chissà se di questo vengono informati i genitori che portano i bambini a vaccinarsi contro l&#8217;inflenza suina.</strong></p>

<p>Se si sceglie di dare credito alla tesi &#8211; peraltro corroborata da quanto <span style="color:#0000ff;"><strong><a href="http://lucamarcon.wordpress.com/2009/10/28/l%e2%80%99influenza-suina-e-una-bufala-peggio-che-l%e2%80%99aviaria-con-l%e2%80%99aggravante-che-ci-e-gia-stata-propinata-nel-1976-e-nessuno-se-lo-ricorda-piu/" target="_blank">già accaduto nel 1976</a></strong></span> &#8211; secondo la quale l&#8217;influenza suina è una <span style="color:#0000ff;"><strong><a href="http://www.report.rai.it/R2_popup_articolofoglia/0,7246,243%255E90230,00.html" target="_blank">bufala tale e quale l&#8217;aviaria</a></strong></span>,  l&#8217;unico movente che rimane in piedi per giustificare il falso allarme pandemia è l&#8217;interesse economico delle <span style="color:#0000ff;"><strong><a href="http://lucamarcon.wordpress.com/2009/10/28/l%e2%80%99influenza-suina-e-una-bufala-peggio-che-l%e2%80%99aviaria-con-l%e2%80%99aggravante-che-ci-e-gia-stata-propinata-nel-1976-e-nessuno-se-lo-ricorda-piu/#comment-7" target="_blank">case farmaceutiche</a></strong></span> produttrici dei vaccini e dei medicinali. In altre parole, sarebbero state le medesime, con una ben orchestrata azione di <span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Lobbying" target="_blank">lobbying</a></strong></span>, a &#8220;creare&#8221; dal nulla la pandemia dell&#8217;influenza suina all&#8217;unico scopo di vendere i loro prodotti: si tratterebbe, insomma, di una pura operazione di <span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Marketing" target="_blank">marketing</a></strong></span> con i prevedibili annessi e connessi.<br />
Il problema è che per dimostrare una tesi, non è sufficiente descriverla: bisogna suffragarla con delle prove. Magari come quelle che seguono.</p>

<p>Il grafico sopra riportato rappresenta l&#8217;andamento del valore di borsa delle azioni della multinazionale svizzera. Se si confronta la variazione dei prezzi dei titoli con la cronologia dei fatti collegati, si scoprono delle analogie davvero interessanti.</p>
<p>Nell&#8217;ottobre del 2008 esce un articolo di Repubblica dal titolo inquietante: &#8220;<span style="color:#0000ff;"><strong><a href="Disoccupazione, nuovo spettro Usa nel 2008 già 750mila licenziamenti" target="_blank">Disoccupazione, nuovo spettro Usa nel 2008 già 750mila licenziamenti</a></strong></span>&#8220;; in particolare, scrive  Vittorio Zucconi, &#8220;<em>Avvisi di pink slips, delle temute «lettere rosa» che annunciano il licenziamento, arrivano dalla Merck farmaceutici, che taglierà il 12% dei dipendenti, 7.400 impiegati. Neppure il consumo delle pillole sostiene più la «macchia produci lavoro». <strong>Negli ultimi cinque anni,</strong> <strong>le grandi case farmaceutiche</strong> <strong>hanno già perduto complessivamente 100 mila posti di lavoro</strong> e la recessione ormai in atto devasta anche i consumi di medicinali non strettamente necessari per patologie acute.</em>&#8220;</p>
<p>A partire dallo stesso periodo, le quotazioni della Novartis sono sottoposte a <span style="color:#0000ff;"><strong><a href="http://farm3.static.flickr.com/2670/4079899677_e4de08324d_o.gif" target="_blank">forti oscillazioni</a></strong></span> fino al gennaio del 2009: iniziato il quale, imboccano una tendenza al ribasso che le porterà dagli iniziali 52 dollari a poco meno di 35, con una perdita del 33%. Il titolo tenta in seguito una timida ripresa, ma non riesce a sfondare il muro dei 38 dollari e  ricomincia a scendere.</p>
<p>Nello stesso periodo &#8211; inizio aprile 2009 &#8211; cominciano a diffondersi sui media americani le prime notizie di una sedicente &#8220;pandemia influenzale&#8221;. Dopo un po&#8217;, arrivano le notizie anche sui giornali nazionali. Il 25 aprile, giorno di festa, quindi a maggior tiratura giornalistica &#8211;  il Corriere titola  &#8220;<span style="color:#0000ff;"><strong><a href="http://archiviostorico.corriere.it/2009/aprile/25/Virus_dai_maiali_all_uomo_co_8_090425043.shtml" target="_blank">Virus dai maiali all&#8217; uomo Messico, decine di morti</a></strong></span>&#8221; e tanto per far capire dove si andrà a parare, vi aggiunge un bel &#8220;<span style="color:#0000ff;"><strong><a href="http://archiviostorico.corriere.it/2009/aprile/25/infezione_che_ricorda_aviaria_puo_co_8_090425052.shtml" target="_blank">«Un&#8217; infezione che ricorda l&#8217; aviaria: può portare a epidemie»</a></strong></span>&#8220;, scordandosi completamente che l&#8217;aviaria si risolse in un bluff. La Repubblica non è da meno. &#8220;<span style="color:#0000ff;"><strong><a href="http://ricerca.repubblica.it/repubblica/archivio/repubblica/2009/04/25/virus-mortale-dal-maiale-paura-in-messico.html" target="_blank">Virus mortale dal maiale, paura in Messico</a></strong></span>&#8220;, con un&#8217;apertura dell&#8217;articolo che è tutto un programma: &#8220;<em>AVEVAMO paura dell&#8217; influenza aviaria. E invece il virus ha scelto il maiale per  lanciare il suo attacco all&#8217; uomo.</em>&#8220;</p>
<p>Povero uomo. E povero maiale.  Si comincia a parlare di possibili acquisti di massa (per svariati miliardi di dollari) di vaccini e medicinali da parte delle strutture sanitarie degli stati occidentali per arginare la &#8220;pandemia&#8221;. E le azioni Novartis cominciano a salire: anzi, si avviano sulla strada del &#8220;trend&#8221; al rialzo.  Ma all&#8217;inizio di giugno, vi è uno stop: corrono voci (&#8220;<span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Rumor" target="_blank">rumors</a></strong></span>&#8220;, nel linguaggio borsistico) sul fatto che i vaccini non siano abbastanza sperimentati e abbiano diverse controindicazioni. Chi aveva acquistato le azioni, vende subito per monetizzare il guadagno: eventuali cause per danni da vaccino potrebbero portare ad un nuovo crollo del valore di borsa delle multinazionali farmaceutiche. Ma nello stesso periodo avviene un fatto del quale si avrà conoscenza diverse settimane dopo. Il segretario del dipartimento alla salute ed ai servizi sociali <strong><span style="color:#0000ff;"><a href="http://www.hhs.gov/secretarysebelius.html" target="_blank">Kathleen Sebelius</a></span> </strong>(amica e pubblica elettrice di Barack Obama, che da Presidente la riconfermerà alla carica)</p>

<p>ha firmato un provvedimento nel quale concede <strong>l&#8217;immunità legale alle case farmaceutiche produttrici dei vaccini. Le quali, da allora in poi, non dovranno più temere alcun danno economico per eventuali cause di risarcimento.</strong> E il titolo imbocca decisamente la strada che lo riporterà, agli inizi di questo mese, ai 52 dollari di valore che aveva nel quarto trimestre del 2008. Il 23 ottobre  Repubblica esordisce con un &#8220;<span style="color:#0000ff;"><strong><a href="http://ricerca.repubblica.it/repubblica/archivio/repubblica/2009/10/23/influenza-fa-bene-big-pharma.html" target="_blank">L&#8217;influenza A fa bene a Big Pharma</a></strong></span>&#8221; e nel seguito dell&#8217;articolo specifica cifre da capogiro: &#8220;<em>La svizzera Novartis ha annunciato ieri che nel solo quarto trimestre le vendite del Focetria, uno dei tre farmaci anti-H1N1 approvati in Europa, aggiungeranno tra i 400 e i 700 milioni di dollari ai suoi ricavi. UNA pioggia d&#8217; oro destinata a gonfiare anche i conti del 2010, visto che la domanda di vaccini pandemici &#8211; come ha ammesso l&#8217; Organizzazione mondiale per la Sanità &#8211; è e rimarrà per un paio d&#8217; anni almeno doppia rispetto alla capacità produttiva dei big della farmaceutica. I governi dei paesi più ricchi, nona caso, hanno messo le mani avanti da tempo, prenotando milioni di dosi (il costo è di circa 7,9 dollari l&#8217; una, lo stesso dell&#8217; anti-influenzale tradizionale) presso le aziende che stanno sviluppando i nuovi prodotti. L&#8217; inglese Glaxo ha venduto a 22 nazioni 440 milioni di confezioni del suo Pandemrix, con un incasso già arrivato a 3,5 miliardi di dollari, annunciando che sono in arrivo altri accordi da centinaia di milioni. Vendite da capogiro sono previste anche per il Celvapan della Baxter, per cui è arrivato il disco verde delle autorità nelle ultime settimane. La francese Sanofi ha in portafoglio ordini per 250 milioni dagli Stati Uniti ancora prima dell&#8217; ok al suo vaccino, cifra simile a quella che si è già messa in cassa l&#8217; australiana Csl. L&#8217; Oms stima che il giro d&#8217; affari complessivo per il vaccino contro l&#8217; H1N1 possa arrivare a quota 20 miliardi di dollari.</em> &#8220;</p>
<p>Roba da non credere: un giro d&#8217;affari di 20 miliardi di dollari per una &#8220;bufala&#8221;. Ma le case farmaceutiche non sono le uniche ad averci guadagnato. Altri &#8220;<span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Rumor" target="_blank">rumors</a></strong></span>&#8221; parlano di società legate a politici americani (e italiani) che avrebbero fatto incetta di azioni dei colossi Big Pharma quando erano ai minimi, sicuri del fatto che sarebbero salite in quanto erano gli stessi politici a garantire che avrebbero provveduto a varare le politiche di vaccinazione e di acquisto di medicinali di massa. A dire il vero, operare sul mercato borsistico essendo in possesso di informazioni privilegiate, è definito &#8220;<span style="color:#0000ff;"><strong><a href="http://it.wikipedia.org/wiki/Insider_trading" target="_blank">insider trading</a></strong></span>&#8220;: ed in America (ma anche in Italia) è un <span style="color:#0000ff;"><strong><a href="http://www.bancaditalia.it/sispaga/sms/normativa/mercati_post_trading/primanaz/L_2005_62.pdf" target="_blank">reato</a></strong></span>. Lasciando che l&#8217;America s&#8217;arrangi e restando a casa nostra, non sarebbe il caso di dare un&#8217;occhiata ai conti bancari (eventuali esteri compresi) del signor Maurizio Sacconi e consorte? Per chi non se lo dovesse ricordare, il primo è il <strong><a href="http://www.ministerosalute.it/ministero/sezMinistro.jsp?label=bio" target="_blank">ministro della salute</a></strong>, la seconda, Enrica Giorgetti, è <span style="color:#0000ff;"><strong><a href="http://www.farmindustria.it/Farmindustria/html/aree.asp?menu2expand=elOne" target="_blank">direttore generale di Farmindustria</a></strong></span>. E pensare che qualcuno lo chiama ancora conflitto di interessi.</p>

<p><strong>Indennizzo a favore dei soggetti danneggiati da complicanze di tipo irreversibile a causa di <span style="text-decoration:underline;">vaccinazioni obbligatorie</span>, trasfusioni e somministrazioni di emoderivati.</strong></p>
<p><strong><!--more-->Art. 1.</strong></p>
<ol>
<li>Chiunque abbia riportato, a causa di vaccinazioni obbligatorie per legge o per ordinanza di una autorità sanitaria italiana, lesioni o infermità, dalle quali sia derivata una menomazione permanente della integrità psico-fisica, ha diritto ad un indennizzo da parte dello Stato, alle condizioni e nei modi stabiliti dalla presente legge.</li>
<li>L’indennizzo di cui al comma 1 spetta anche ai soggetti che risultino contagiati da infezioni da HIV a seguito di somministrazione di sangue e suoi derivati, nonchè agli operatori sanitari che, in occasione e durante il servizio, abbiano riportato danni permanenti alla integrità psico-fisica conseguenti a infezione contratta a seguito di contatto con sangue e suoi derivati provenienti da soggetti affetti da infezione da HIV.</li>
<li>I benefici di cui alla presente legge spettano altresì a coloro che presentino danni irreversibili da epatiti post-trasfusionali.</li>
<li>I benefici di cui alla presente legge spettano alle persone non vaccinate che abbiano riportato, a seguito ed in conseguenza di contatto con persona vaccinata, i danni di cui al comma 1; alle persone che, per motivi di lavoro o per incarico del loro ufficio o per potere accedere ad uno Stato estero, si siano sottoposte a vaccinazioni che, pur non essendo obbligatorie, risultino necessarie; ai soggetti a rischio operanti nelle strutture sanitarie ospedaliere che si siano sottoposti a vaccinazioni anche non obbligatorie.</li>
</ol>
<p><strong>Art. 2.</strong></p>
<ol>
<li>L’indennizzo di cui all’art. 1, comma 1, consiste in un assegno non reversibile determinato nella misura di cui alla tabella B allegata alla legge 29 aprile 1976, n. 177, come modificata dall’art. 8 della legge 2 maggio 1984, n. 111.</li>
<li>L’indennizzo di cui al comma 1, integrato dall’indennità integrativa speciale di cui alla legge 27 maggio 1959, n. 324 e successive modificazioni, ha decorrenza dal primo giorno del mese successivo a quello di presentazione della domanda.</li>
<li>Qualora a causa delle vaccinazioni o delle patologie previste dalla presente legge sia derivata la morte, spetta, in sostituzione dell’indennizzo di cui al comma 1, un assegno una tantum nella misura di lire 50 milioni da erogare ai soggetti a carico, nel seguente ordine: coniuge, figli minori, figli maggiorenni inabili al lavoro, genitori, fratelli minori, fratelli maggiorenni inabili al lavoro.</li>
<li>Qualora la persona sia deceduta in età minore, l’indennizzo spetta ai genitori o a chi esercita la potestà parentale.</li>
</ol>
<p><strong>Art. 3.</strong></p>
<ol>
<li> I soggetti interessati ad ottenere l’indennizzo di cui all’art. 1, comma 1, presentano domanda al Ministro della sanità entro il termine perentorio di tre anni nel caso di vaccinazioni o di dieci anni nei casi di infezioni da HIV. I termini decorrono dal momento in cui, sulla base della documentazione di cui ai commi 2 e 3, l’avente diritto risulti aver avuto conoscenza del danno.</li>
<li>Alla domanda è allegata la documentazione comprovante: la data della vaccinazione, i dati relativi al vaccino, le manifestazioni cliniche conseguenti alla vaccinazione e l’entità delle lesioni o dell’infermità da cui è derivata la menomazione permanente del soggetto.</li>
<li>Per le infezioni da HIV la domanda deve essere corredata da una documentazione comprovante la data di effettuazione della trasfusione o della somministrazione di emoderivati con l’indicazione dei dati relativi all’evento trasfusionale o all’emoderivato, nonchè la data dell’avvenuta infezione da HIV.</li>
<li>Alla domanda di indennizzo ai sensi dell’art. 2, comma 3, è allegata la documentazione comprovante:<br />
la data della vaccinazione, i dati relativi al vaccino, le manifestazioni cliniche conseguenti alla vaccinazione e il decesso. Per le infezioni da HIV alla domanda è allegata la documentazione comprovante la data di effettuazione della trasfusione o della somministrazione di emoderivati con l’indicazione dei dati relativi all’evento trasfusionale o all’emoderivato, nonchè la data dell’avvenuto decesso.</li>
<li>Il medico che effettua la vaccinazione di cui all’art. 1 compila una scheda informativa dalla quale risultino gli eventuali effetti collaterali derivanti dalle vaccinazioni stesse.</li>
<li>Il medico che effettua trasfusioni o somministra emoderivati compila una scheda informativa dei dati relativi alla trasfusione o alla somministrazione.</li>
<li>Per coloro che, alla data di entrata in vigore della presente legge, hanno già subito la menomazione prevista dall’art. 1, il termine di cui al comma 1 del presente articolo decorre dalla data di entrata in vigore della legge stessa.</li>
</ol>
<p><strong>Art. 4.</strong></p>
<ol>
<li>Il giudizio sanitario sul nesso causale tra la vaccinazione, la trasfusione, la somministrazione di emoderivati, il contatto con il sangue e derivati in occasione di attività di servizio e la menomazione dell’integrità psico-fisica o la morte è espresso dalla commissione medico-ospedaliera di cui all’art. 165 del testo unico approvato con decreto del Presidente della Repubblica 29 dicembre 1973, n. 1092.</li>
<li>La commissione medico-ospedaliera redige un verbale degli accertamenti eseguiti e formula il giudizio diagnostico sulle infermità e sulle lesioni riscontrate.</li>
<li>La commissione medico-ospedaliera esprime il proprio parere sul nesso causale tra le infermità o le lesioni e la vaccinazione, la trasfusione  la somministrazione di emoderivati, il contatto con il sangue e derivati in occasione di attività di servizio.</li>
<li>Nel verbale è espresso il giudizio di classificazione delle lesioni e delle infermità secondo la tabella A annessa al testo unico approvato con decreto del Presidente della Repubblica 23 dicembre 1978, n. 915, come sostituita dalla tabella A allegata al decreto del Presidente della Repubblica 30 dicembre 1981, n. 834.</li>
</ol>
<p><strong>Art. 5.</strong></p>
<ol>
<li>Avverso il giudizio della commissione di cui all’art. 4, è ammesso ricorso al Ministro della sanità. Il ricorso è inoltrato entro trenta giorni dalla notifica o dalla piena conoscenza del giudizio stesso.</li>
<li>Entro tre mesi dalla presentazione del ricorso, il Ministro della sanità, sentito l’ufficio medico-legale, decide sul ricorso stesso con atto che è comunicato al ricorrente entro trenta giorni.</li>
<li>E’ facoltà del ricorrente esperire l’azione dinanzi al giudice ordinario competente entro un anno dalla comunicazione della decisione sul ricorso o, in difetto, dalla scadenza del termine previsto per la comunicazione.</li>
</ol>
<p><strong>Art. 6. </strong></p>
<ol>
<li>Nel caso di aggravamento delle infermità o delle lesioni, l’interessato può presentare domanda di revisione al Ministro della sanità entro sei mesi dalla data di conoscenza dell’evento.</li>
<li>Per il giudizio sull’aggravamento si osserva la procedura di cui agli articoli 3 e 4. ticoli 3 e 4.</li>
</ol>
<p><strong>Art. 7.</strong></p>
<ol>
<li>Ai fini della prevenzione delle complicanze causate da vaccinazioni, le unità sanitarie locali predispongono e attuano, entro sei mesi dalla data di entrata in vigore della presente legge, progetti di informazione rivolti<br />
alla popolazione e in particolare ai donatori e ai soggetti riceventi materiali biologici umani, alle persone da vaccinare e alle persone a contatto.</li>
<li>I progetti di cui al comma 1 assicurano una corretta informazione sull’uso dei vaccini, sui possibili rischi e complicanze, sui metodi di prevenzione e sono prioritariamente rivolti ai genitori, alle scuole ed alle comunità in genere.</li>
<li>Le regioni, attraverso le unità sanitarie locali, curano la raccolta dei dati conoscitivi sulle complicanze da vaccino, anche al fine di adeguare a tali dati i progetti di informazione e i metodi di prevenzione.</li>
</ol>
<p><strong>Art. 8.</strong></p>
<ol>
<li>Gli indennizzi previsti dalla presente legge sono corrisposti dal Ministero della sanità.</li>
<li>All’onere derivante dall’applicazione della presente legge, valutato in lire 19 miliardi per l’anno 1992 e in lire 10 miliardi a decorrere dal 1993, si provvede mediante riduzione dello stanziamento iscritto al capitolo 4550 dello stato di previsione del Ministero della sanità per l’anno 1992 e corrispondenti capitoli per gli anni successivi.</li>
<li>Il Ministro del tesoro è autorizzato ad apportare, con propri decreti, le occorrenti variazioni di bilancio.</li>
</ol>

<p>Frost/Nixon es una película dirigida por Ron Howard que nos presenta la importancia de las entrevistas en los descubrimientos de la verdad. De esta forma, el film nos cuenta la historia de la entrevista de David Frost y Richard Nixon, una que marcó historia al encontrarse en la vorágine originada a partir del caso Watergate. He aquí un análisis desde una perspectiva de la comunicación.</p>

<p>Cuando hablamos de una entrevista, lo más importante que debemos nosotros saber es que buscamos saber la verdad de las personas. Necesitamos nosotros saber eso para así poder tener una entrevista que realmente sea significativa, es decir, buscamos conocer cómo es que se llevan a cabo las significaciones en la mente del individuo a entrevistar. Por ello mismo, resulta de vital importancia saber de qué manera se pueden formular las preguntas y realmente motivar al entrevistado a expresar esta significación verdadera y no exclusivamente lo que se debe decir.</p>
<p>En el caso particular de Frost/Nixon nos encontramos con dos adversarios que conocían plenamente a sus rivales, conocían sus hábitos, sus gustos, sus historias, siendo esto mismo la perspectiva que les mantenía jugar el uno con el otro durante la entrevista. Sin una preparación adecuada, lo más probable es que uno de los dos termine por ser devorado. Por lo mismo, cuando analizamos la cinta, nos damos cuenta de dos errores principales por parte de los contendientes. Por un lado, Nixon se confía desde un principio y demerita la labor de un presentador de televisión, al grado de que llega a menospreciar sus habilidades y decide no prepararse mentalmente para todas las posibilidades. Por el otro, tenemos a David Frost, un presentador de televisión, que busca recuperar su credibilidad como posible reportero y no toma realmente en serio el hecho de estar entrevistando a una de las figuras más importantes del siglo XX.</p>

<p>Probablemente, Richard Nixon sea uno de los presidentes estadounidenses más polémicos de todo la historia, al grado de que se han realizado más de 50 diferentes interpretaciones del mismo hombre en diferentes medios de comunicación. Así, nos encontramos con que su presencia es una que definitivamente vino a moldear la perspectiva a través de la cual se mira a las figuras presidenciales. Esto mismo se refleja en la cinta, al grado de que diversos personajes se dan cuenta de la magnitud de lo que significaría una confesión pública de culpa, logrando así desmitificar a la figura presidencial y realmente otorgarle un carácter más humano y más terrenal.</p>
<p>En el terreno de la comunicación es extremadamente importante que tengamos en cuenta que cuando somos periodistas podemos realmente modficiar la precepción del público hacia una determinada persona, ya sea para bien o para mal, por lo que es extremadamente crucial que busquemos conocer lo más posible acerca de la situación en la cual nos encontramos, cubriendo<a href="http://espaciocritico7.wordpress.com/files/2009/11/dick1.jpg"><img class="size-full wp-image-858 alignright" title="dick1" src="http://espaciocritico7.wordpress.com/files/2009/11/dick1.jpg" alt="dick1" width="199" height="299" /></a> absolutamente todos los ángulos, porque si no lo hacemos corremos el riesgo de cambiar el mundo, literalmente. ¿Qué hubiera pasado si David Frost no hubiera hecho la pregunta correcta a Nixon que lograra realmente ver qué fue lo que sucedió en el caso Watergate? Si Frost no hubiera buscado cubrir todos los puntos de investigación, entonces probablemente podríamos decir que absolutamente todo en el mundo sería diferente ahora.</p>
<p>O inclusive, regresando más al pasado, ¿qué habría pasado si los periodistas no hubieran realmente hecho la investigación que dejó ver la verdad del caso Watergate? Sin duda, no lo podemos saber con certeza, pero efectivamente lo más probable es que Nixon hubiera seguido en el poder afectando la historia mundial como la conocemos.</p>
<p>Por lo mismo, resulta de vital importancia que Frost reconozca que Nixon es una figura imponente, una figura que por el mismo emblema presidencial, marca y tiene una presencia que las figuras que conocemos día con día no poseen, pero que en medida de esta diferenciación, también es importante que se produzca una profundización en la entrevista y que se busque ir más allá de las banalidades. Esto se puede ver reflejado en diversos momentos en la película donde el personaje de Nixon realmente lgora evadir la gran mayoría de las preguntas recurriendo a cuestiones banales, que probablemente para un observador poco apto, pasarían inadvertidas. Sin embargo, cuando hablamos con periodistas, es necesario que tengamos en consideración que el mensaje no viene únicamente de lo que se dice, sino de lo que no se dice. ¿Y qué mejor manera de darnos cuenta de esto mismo si nuestro adversario/contraparte en una entrevista comienza a exhibir señales de preocupación? Nixon literalmente sudaba cuando se daba cuenta de que una pregunta realmente le estaba golpeando.</p>
<p>No obstante, no todo es miel sobre hojuelas para esta película y es que si bien es cierto que ha recibido buenas críticas por parte de críticos de cine, también es cierto que los historiadores se han quejado de muchas incongruencias históricas con la representación presentada en el celuloide. De esta forma, un fragmento de la cinta que nos muestra a Nixon vulnerable y quejándose de que siempre ha sido hecho menos por sus compañeros, resulta una cuestión bastante debatible por los eruditos, quienes desde un principio establecen que esa conversación nunca pudo haberse llevado a cabo. Aunque eso sí, hay que tener en cuenta que muchas de estas licencias dramáticas están basadas en progresión de los personajes y de relaciones que pudieron haberse dado de una manera bastante creíble. Por lo tanto esta confesión de Nixon no se ve ni siente extraña en términos humanos, puesto que si uno analiza algunas cuestiones de la vida de Nixon, se dará cuenta de que hay muchos momentos donde sus relaciones se pueden ver reflejados. Un claro ejemplo de esto es el concepto de que Nixon se sentía bastante inferior al compararse físicamente con Kennedy, y por lo mismo dejó que muchas de sus decisiones fueran tomadas por sus asesores de campaña.</p>

<p>Otro punto a considerar es que la entrevista es mostrada de forma más dramática que lo que en realidad fue. Esto lo podemos ver comparando un fragmento de la entrevista real con la entrevista presentada en la ficción. Aunque eso sí, mucha de la tensión se sigue sintiendo y se encuentra presente en la entrevista real.</p>

<title><![CDATA[Congress does right by journalists, a tear-jerker from Joe Poz, and a great "West Wing" moment]]></title>

<description><![CDATA[Sometimes, in the midst of worrying about health care and Afghanistan, immigration and global warmin]]></description>

<p>Sometimes, in the midst of worrying about health care and Afghanistan, immigration and global warming, Congress actually gets around to doing something tangible that affects the here and now.</p>
<p>Last Friday was one of those days. A story in the New York Times said that after years and years of promises, a <a href="http://thecaucus.blogs.nytimes.com/2009/10/30/shield-law-compromise-would-protect-reporters-bloggers/?hp">federal media shield law</a> has been proposed by Congressional Democrats, and it stands a good chance of passing and becoming law.</p>
<p>For those who don&#8217;t know, a shield law would protect reporters from being thrown into jail, or fined heavily, if they refused to reveal confidential sources. This law would&#8217;ve helped Matt Cooper, who was about to be jailed in the Scooter Libby case, and Judith Miller, the NYT reporter who was imprisoned for three months for not revealing the source of a CIA leak.</p>
<p>The law, which will be voted on by the Senate Judiciary Committee on Thursday, is something I feel is vital (obviously, being a journalist, I may be a bit biased here). Some of the most important stories in American history, like Watergate, the Abu Ghraib prison scandal, and Enron&#8217;s crookedness, have come from journalists who used anonymous, confidential sources to reveal information.</p>
<p>No journalist that I&#8217;m aware of <em>wants </em>to use anonymous sources, but sometimes that&#8217;s the only way to get the information. I feel like a law like this is particularly important when you have an administration like we just had, when vengeance and punishment are dished out for &#8220;disloyal&#8221; people who actually dare to speak truth to power.</p>
<p>Throwing reporters in jail doesn&#8217;t accomplish anything. Don&#8217;t give me the &#8220;protecting national security&#8221; angle, either; that comes up in very rare cases.</p>
<p>Allowing journalists to use all means necessary to do their jobs, and protect their sources, has helped expose some of the biggest corruption and scandals in U.S. history. It&#8217;s about time Congress realized this and has taken up the issue.</p>
<p>Now if you&#8217;ll excuse me, I&#8217;d like to go watch &#8220;All The President&#8217;s Men&#8221; for the 78th time.</p>

<p>*** So my man Joe Posnanski has written <a href="http://joeposnanski.com/JoeBlog/2009/11/02/small-kansas-towns/#more-2793">another beautiful blog essay,</a> about a group of people from a small town in Kansas who got together to &#8230; well, I&#8217;ll let you read it. I&#8217;m always amazed at the power of people to do good. It just takes one person (in this case, one person who wants to help people get mammograms) to start the ball rolling, one person who aches to do good.</p>
<p>Poz&#8217;s post takes a little while to get going, but stick with it; you&#8217;ll be smiling by the end.</p>
<p>**So I&#8217;m pretty much over the Jets loss to Miami Sunday, but this stat, printed in Rich Cimini&#8217;s excellent blog in the New York Daily News, just blew me away. The Jets, in their 49-year history as a team, had only allowed 17 kickoff returns for touchdowns.</p>
<p>In only ONE season, 1970, did the Jets allow two kickoff returns for touchdowns. Then, Sunday, in one quarter, they gave up two to the same guy.</p>
<p>I still can&#8217;t believe they kicked to Ted Ginn again after he scored the first one. There&#8217;s belief in your team, and then there&#8217;s just outright stupidity.</p>
<p>**And now, one of my favorite scenes ever from &#8220;The West Wing,&#8221; for my money the best one-hour show ever on TV.</p>
<p>This is the last scene of an episode where Donna Moss (who I just loved so much) tries to get President Bartlet to give a proclamation honoring her favorite teacher, Mrs. Morello, who&#8217;s retiring. I just love this scene so much.</p>
