<p><strong> The General Election is a matter of months away. Once again, this is an election in which only two parties are competing to form a government – Labour or the Tories.</strong></p>
<p><strong> </strong></p>
<p>A series of opinion polls have pointed strongly to the defeat of the Labour government. The outcome, however, is not a foregone conclusion. A recent poll suggests that the result will be finely balanced, with a hung parliament a real possibility.</p>
<p><span style="color:#800000;"><a href="http://www.therespectparty.net/" target="_blank"><strong>Respect</strong></a></span> is neither neutral nor indifferent to the outcome of this election. We think that a <strong>Tory</strong> victory would be a disaster for working people. Yes, <strong>New Labour</strong> has betrayed the aspirations of its traditional electorate in working class communities, among Black and Asian communities, and among trades unionists. But its strongest support still comes from these communities and the vast majority of the trade union movement will support Labour at the next election. Despite the efforts of the <strong>New Labour</strong> clique that now dominates the <strong>Labour Party</strong>, it is still seen by millions of people as a party that looks after the interests of working people &#8211; albeit a disastrously right wing example of such a party.</p>

<p>A <strong>Tory</strong> victory in the context of a deep economic crisis will herald a deep attack on the welfare state. The Tory obsession with cutting the national debt not only risks a deeper and more prolonged recession, but will inevitably lead to a massive assault on public services and public sector workers. It will represent a much more profound shift to the right in the political agenda. Respect therefore stands with the vast majority of the labour movement in seeking the defeat of the Tory challenge at this election.</p>

<p>Under <strong>Blair</strong>, and now <strong>Brown</strong>, <strong>Labour</strong> have demoralised large parts of its traditional support. Many people have broken from Labour to the left in disgust at Blair’s support for the <strong>Iraq war</strong>, and New Labour’s subservience to the bankers and privatisers. Respect was born out of the movement against the Iraq war, and we have successfully built a real base in limited parts of the country. We believed then, and believe now, that there is an urgent need for a radical left wing party that can help shift the political consensus towards an agenda of peace, anti-racism and social justice.</p>
<p>In <strong>3 parliamentary seats</strong> in Birmingham and East London, Respect is fighting to win. We do not know what the outcome will be, and we are well aware of the difficulties in the way of small parties under a first past the post electoral system. But in these 3 seats we have a genuine chance of victory. We have deep roots and credible candidates. There are only a handful of seats up for grabs in the general election that could conceivably be won by parties to the left of Labour (including the challenge by <strong>Caroline Lucas</strong> for the <strong>Green Party</strong>). The most important contribution that we in Respect can make to the left as a whole in the immediate future is to do everything within our power to win these seats.</p>

<p>We do not believe, however, that a radical alternative can be built by acting in way that allows the <strong>Tories</strong> – or the <strong>BNP</strong> – to be the beneficiaries of discontent with <strong>Labour</strong> or our efforts to build an alternative. In areas where we are highly unlikely to win it is important that we are not seen to be reckless over the consequences of standing in marginal seats where the likely beneficiary would be the Tories. Where we do stand, we want our supporters to know they can express their discontent with the Labour government without handing seats on a plate to the Tories.</p>

<p>We are also in favour of the maximum possible unity against the BNP. <strong>Nick Griffin</strong> has announced he is standing in Barking and Dagenham. His election to the European parliament was an historic breakthrough for British fascism. But it would be nothing in comparison to a BNP MP. Hard choices have to be made. There is absolutely no prospect of a candidate to the left of Labour winning this seat, and any such candidate could only split the anti-BNP vote.</p>

<p>Respect will therefore not consider standing in Barking and Dagenham, and call on other left wing parties to do likewise. We are well aware of the way in which <strong>New Labour</strong> have created the conditions for the BNP to grow, and equally aware that Labour’s candidate, Margaret Hodge, is one of the least palatable New Labour MPs. Nonetheless we call for a vote for the Labour candidate as the only practical way of defeating the BNP.</p>
<p><strong>Respect</strong> believes that the interests of working people are best served by working for the maximum unity against a Tory victory in the <strong>General Election</strong>, while continuing to build left wing alternatives to the Labour Party in the most tactically effective manner.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>The Church of England may not seem like an institution that is very good at listening, but it is ready to listen to young people, and we need to find a voice.</p>
<p>For well over a decade, the Church of England has been struggling with profoundly difficult, but ultimately internal, issues. Finding a new role for women&#8217;s ministry in the church, as well as a vicious debate over homosexuality, <!--more-->has led to a great deal of negative media attention. Consequently, outsiders have come to regard the CofE as an institution with little interest in, or relevance to, the real world.</p>
<p>As someone who spends more time than most hanging around churches, cathedrals and the ecclesiastical equivalent to the water-cooler, I see a very different side to the CofE. In particular, as a young person I see how keen the senior elements of the church are to listen to the youth voice.</p>
<p><a href="http://jetownsend.wordpress.com/files/2009/11/ceyc1web.jpg"><img class="alignleft size-medium wp-image-275" title="CEYC Service at Westminster Abbey" src="http://jetownsend.wordpress.com/files/2009/11/ceyc1web.jpg?w=300" alt="" width="300" height="200" /></a>This weekend I attended a service at Westminster Abbey, to celebrate the 5<sup>th</sup> Birthday of the <a title="Church of England Youth Council" href="http://www.ceyc.org" target="_blank">Church of England Youth Council (CEYC)</a>. Somebody queried why it was that a youth service should be held at, of all places, Westminster Abbey. Surely, my friend asked, somewhere more appropriate could have been found to represent the energy and imagination of the youth in the church?</p>
<p>My friend may have had a point – Westminster Abbey is home (of sorts) to the <em>established</em> church. As the stage for great State occasions, the Abbey has come to represent a very traditional, unchanging and formal part of Christian life in this country. It is a place where protocol and formal uniforms abound – not, perhaps, the right image for a Youth Council.</p>
<p>But having attended the Service, I am convinced that it could not have been held anywhere more appropriate. In dealing with young people, there is always a danger that the church can create a ‘church within a church’. I cringe whenever somebody suggests that young people should be listened to because they are ‘the future of the church’. We are not – we are part of the church today.</p>
<p>The CEYC service at Westminster Abbey was reflective of that. By hosting such a service at the Abbey, the Dean of Westminster was making a statement to the young people there: ‘You are part of this Church of England. You are welcome here, as a valued part of our community.’</p>
<p>Through the Youth Council, diocesan youth synods and many other channels, young people have the potential to make an enormous impact on the Church. The current wind is a fair one for Christian youth. There is an opportunity, while the support for youth involvement lasts, to set out our vision for the church.</p>
<p>The Church is listening. We, the young people of that church, need to make sure we have something to say.</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>It is too much too soon, but the opposition parties at Holyrood should stop treating the Scottish voters with contempt.</p>
<p>A referendum on independence is not what Scotland needs. If Alex Salmond and the SNP want to provide a catalyst for a national conversation, a vote on constitutional powers at this stage of the debate is the wrong way to go about it.</p>
<p>Labour, the Lib Dems and the Tories, however, don’t seem to want any form of debate. According to them, the Scottish people are not capable enough or willing to engage in that time-honoured Scottish tradition of trashing out ideas in progressive discourse.</p>
<p>This website supports a national conversation. A debate – that is a serious, profound and forward-looking review of Scotland’s interests and the powers needed to secure them, is precisely what The Scots Journal has been created for.</p>
<p>However, none of the parties in Holyrood seem able to put playground tactics aside in favour of reaching out to the Scottish voters. In fact, if the headlines over the last week have been anything to go by, insulting the intelligence of the electorate seems to have become a national sport.</p>
<p>In particular, the Scottish media appear to have teamed up with the most intransigent and arrogant wings of the Labour party, to propagandise rather than encourage Scots to engage with their future.</p>
<p>The SNP on the other hand are driving home their agenda based on sensationalism and short-term gain. In reality, for the nationalists as well as the country at large, a vote on independence is ludicrous.</p>
<p>On all sides of the political spectrum, Scotland’s future seems to be given little intellectual credibility. Emotional outbursts, dubious rhetoric and misrepresenting the facts rule day. All the while the tolerance of the Scottish people is being tested by those who claim to have their interests at heart.</p>
<p>The opposition parties are nothing but disparaging about constitutional change. The SNP is shoving it down our throats.</p>
<p>However, the figures, as reported in this morning’s papers, are clear: Scotland is undecided.</p>
<p>Despite what the politicians would like you to think, the people of Scotland appear to be open-minded, even with their natural and healthy scepticism.</p>
<p>An Ipsos Mori poll shows that half of the Scottish people are in favour of a vote on independence in the future, but not immediately. This contradicts the claims of all the political parties.</p>
<p>Contrary to what the opposition, with their bed-buddies in the media, are saying, independence and constitutional change are not irrelevant. However, Scots are not as pliable as the SNP would hope.</p>
<p>What have the politicians got to lose through a genuine public dialogue on these issues? Who is really calling the shots here? The truth is no one actually knows for sure whether Scotland’s future demands more independence. No one can say whether it would be strategically better for us to remain in the UK, or pursue our interests as one of Europe’s smaller, energy rich nations.</p>
<p>There are arguments on both sides. Yet the Scottish people have been denied their right to a fair and thorough debate.</p>

<p>A escuridão deixava a cidade mágica.<br />
Havia um convite irrecusável no ar.</p>
<p>Eu havia realmente me apaixonado pela cidade de Londres.<br />
Andar por aquelas ruas caprichadas, com aquele vento gelando o rosto, compartilhando sonhos e admirações com os demais turistas que passavam boquiabertos pela nossa frente trazia liberdade, enchia o coração de uma felicidade que eu nunca havia sentido.</p>
<p>Eu já estava saudoso antes mesmo de ter minhas pegadas apagadas daquele chão.<br />
Eu já sentia falta de Londres antes mesmo de deixá-la.</p>
<p>Captava sons, cheiros e luzes.<br />
Caminhava por caminhos e passagens secretas que mexeriam com meus sonhos num futuro qualquer.</p>
<p>Ruas e túneis, escadarias e passarelas que mexiam com o meu labirinto e gravavam as mais fantásticas recordações no meu coração.</p>
<p>Não resistíamos ao Big Ben.<br />
Já não era a primeira vez que subíamos as escadas da Westminster Tube Station e dávamos de cara com aquela enorme torre.<br />
Já não era a primeira e muito menos a segunda vez e, ainda assim, sentíamos aquele adorável sentimento de descoberta, que faz a gente procurar o final da torre para encontrar os ponteiros precisos do famoso relógio.</p>

<p>Ficar pela região do rio era uma prova de fogo, ou melhor, de gelo!<br />
Naquela hora da noite, daquele lado de lá, era preciso ter sangue quente, ou melhor, frio, para suportar ou se fingir de sapo.<br />
Enfrentar aquela gélida corrente de ar que por ali existia não era tarefa para muitos cavaleiros.</p>
<p>Parar no meio da Ponte de Westminster e ter um momento de reflexão, do que tudo isso significa, do quanto estamos distantes de casa, do tanto que lutamos por este momento, mesmo sem saber que ele seria tão especial&#8230; É algo que mesmo agora, do lado de fora da foto, sentado em minha velha cadeira, digitando aqui nesse computador, eu não poderia compreender.<br />
É tão completa a experiência em fazer parte de um lugar tão importante e ao mesmo tempo tão gigante que por um momento me perco em pensamentos indescritíveis.</p>
<p>Estava eu ali, olhando para mim mesmo e nem havia me dado conta!<br />
Claro que eu não me enxergava.<br />
Mas óbvio que eu me vejo agora.</p>
<p>Somos tão pequenos e frágeis se comparados ao concreto e aos tijolos que recheiam e envolvem todas essas estruturas, ao mesmo tempo que somos tão capazes de modelá-las a nossa vontade.<br />
Somos gigantes quando estamos fora da foto, olhando por cima algo que ficou no passado.</p>
<p>Nem havia me tocado que o ambiente atrás de mim havia mudado suas luzes para se adequar a minha vibração colorida.</p>

<p>	First, you need to know that insurance companies evaluate cases two ways.  As soon as you begin negotiating with the insurance company yourself, they evaluate your case, unfortunately, in terms of a nuisance value matter.  They’ve settled tens or hundreds of thousands of cases with individuals before for paltry amounts and they will expect they can settle your case for a measly amount as well.  </p>
<p>	Why do they look at you as if you’re chopped meat?  As soon as you tell them you are negotiating your own settlement, they know you’re trying to save money.  To them, that means you may even be desperate.  They also know you won’t be as knowledgeable about their tricks and tactics and like those tens or hundreds of thousands of people before you, they know how they can play you until you either become so frustrated you settle for their bad offer or become panicked that your time is running out.</p>
<p>	The second way they evaluate a case, namely one presented by a lawyer, is an analysis of what the case’s true settlement value is based on the attorney’s skill and experience, how prepared the case is for litigation in the event it doesn’t settle, and the actual value of the injuries and associated pain and suffering, wage loss and other out of pocket expenses.</p>
<p>	To settle your case for the largest amount possible, which may be the policy limits of the insurance policy, depending upon the severity of your injuries, you need to get the insurance adjuster to evaluate your case in the same manner they would as if an attorney were negotiating with them.  While most insurance companies, unfortunately, simply won’t do that, here’s what you need to do to try to obtain the maximum settlement value.</p>
<p>	First, you need to obtain all of your medical records and bills.  You can’t rely on the insurance company to do this.  As soon as you tell the insurance company you want them to do this or agree to having them do it and tell you how much your medical bills come to and what your medical records say, you are giving up control of the situation.  I can’t stress this enough.</p>
<p>	You will need to sign authorization forms to obtain your medical records and bills and pay the cost of obtaining those medical records and bills (the cost of which can range from $15 to hundreds of dollars) from each hospital, ambulance company, doctor, chiropractor, radiologist, emergency room billing service, etc.  Some medical providers require you to use their authorization forms.  Some require you to agree to their using a photocopy service to copy your records at a higher cost.  Some medical providers require one fee for your bills and another fee for your medical records.</p>
<p>	Just obtaining all of your medical records and bills is one of the most time consuming aspects of handling personal injury cases.  And, to make matters worse, you’re still not through with your medical providers.  When your treatment is complete and you have all of your medical records and bills and the first settlement offer is made to you, you’ll need to call each of your medical providers or their billing offices again to learn if you have any balance owing (and you can expect to be on the phone repeatedly and for long periods of time to learn this information) and in many cases you will need to send them another authorization form before they’ll tell you this information.</p>
<p>	You will need to obtain a copy of the police report.  This is a much simpler process.  Some police departments charge between $10 to $40 for a copy, while other departments provide them to you for free.  You can pick it up at the police or CHP office yourself or request one by mail with an authorization form and a check for the proper fee.</p>
<p>	You’ll also need to obtain your wage loss information on a wage loss form from your employer if you suffered any wage losses or had to use up valuable sick time, personal time, or vacation days.</p>
<p>	You should obtain witness statements if there is any issue as to the liability of the other driver for the accident and you should take photos of the scene if there was something wrong with the road conditions or other unusual circumstances.</p>
<p>	You will also need to obtain a number of good photographs of your car damage, copies of the vehicle repair bills and estimates and receipts for any items damaged in your vehicle.  </p>
<p>	Here’s a secret.  In California you are entitled to the cost of a replacement child seat if one was in the accident.  It’s automatic.  Just tell the insurance company the make and model or find out the cost for the make and model child seat and the insurance company will send you a check for a new one, even if the old one wasn’t broken.  Why?  It’s in the California insurance code.  The insurance companies, however, don’t volunteer this information.  Why?  They’re in business to make money, not pay it out.</p>
<p>	Finally, when all your treatment is done, you will need to put together a demand package with a demand letter reviewing the facts of the accident and the negligence of the other driver that made him or her at fault, a summary of your injuries and medical treatment (from your medical records), an itemization of your medical bills, a discussion of your pain and suffering and how the injuries impacted your life, a discussion of your wage loss and how you determined the amount, and finally the amount of your demand and a time limit (40 days &#8211; the time allotted under the insurance code) for the insurance company to respond with their offer.  The demand letter should be a minimum of four pages in length.  Some of ours have been close to twenty pages.  Accompanying the demand letter should be copies of all of your medical records and bills, color copies of the car damage photos, copies of the repair bills and estimates, any wage loss documentation and any other relevant items such as witness statements, etc.</p>
<p>	If all of this is too much work for you to accomplish (and it is a lot when you are just trying to get better, get on with your life, raise a family and still go to work to put food on the table) you may want to hire our law firm to represent you.</p>
<p>	The reason why, in most cases you will receive more, even after an attorney’s fees and costs are taken out, is that insurance companies offer much more to an attorney handling your case than when you are attempting to settle it yourself.  In addition, an experienced and reputable lawyer can also obtain reductions from your health insurance company and from any medical providers with a balance with regards to what amount has to be paid back to them out of any settlement.</p>
<p>	When you rely on the insurance company to pay your medical bills, and then simply pay you a skimpy amount on top, you are giving them the right to determine what bills they think were “reasonable” and to obtain any reductions in the bills to save themselves money.  When an attorney obtains a reduction in your bills or your health insurance company lien, the amount the attorney saves increases the amount of your net settlement.</p>
<p>	Keep in mind that as soon as you start negotiating your claim by yourself, it’s almost impossible for an attorney to persuade the insurance company to evaluate your case in the higher category type of claim.  At our law firm, while we’ll take on a case that may be months old where the injured victim has simply been receiving medical treatment, we won’t take on the case in most cases if the victim has already received a bad offer from the insurance company.  At that stage it’s usually too late for an attorney to make much of a difference.</p>
<p>	Hopefully, this article has provided you with some insights as to how to obtain the maximum settlement from an insurance company for an auto, car, motorcycle, bicycle, pedestrian, truck, dog bite, or wrongful death claim.  There is much more that an experienced attorney does, especially in the negotiation stage to maximize the settlement and this is where an attorney’s experience kicks in.  </p>
<p>	An attorney such as Sebastian Gibson who has been negotiating these cases with many of the same adjusters for decades, knows the tactics and negotiating style of them and their companies and knows how refute the talking points their insurance companies train their adjusters to use in negotiations.  </p>
<p>	What causes many attorneys to be unable to settle their cases and who then find themselves with no alternative but to file a lawsuit in court and face two to five years of litigation before the matter settles or goes to jury, is to get angry (some even scream and yell) with the adjuster, box themselves into a corner and tell the adjuster something along the lines of, “If that’s the best you can do, we’re filing suit.”  The adjuster’s response to this is naturally, “go ahead.”  </p>
<p>	An insurance company doesn’t really care if they have to dump your case onto the case load of their attorneys who are already handling tens of thousands of such cases.  One more case, makes no difference to them at all.  They also know, you may give up or settle for even less when you learn from an attorney how much just the court costs will be.  Just to file a lawsuit in most courts alone incurs a $350.00 or larger filing fee.  Depositions can cost over a thousand dollars if they are lengthy.  And all such court costs come out of your settlement, even if you have a contingency fee attorney handling your case.</p>
<p>	Sadly, many of these same lawyers take this step or let their improperly trained staff members (secretaries and clerks) force the matter to such an impasse and then file suit without properly informing the client of the negotiations that took place and led them to that point.</p>
