<p>I&#8217;m not half as cool as the people who want to be in the spot light.  I am cool for different reasons.  I know a lot of people&#8230; like a lot people do.  Like all the hipster kids, they know me as my real name&#8211; most people  who know me-know me.   Like who names them selves this for real.   I do like being in pictures and being something&#8230; but I&#8217;m also, a very private open person.  I&#8217;ll tell you what I&#8217;ve been doing but won&#8217;t tell you with who really   Or if I do its okayed by the person etc.  IE code names/porn names/ or initials.</p>

<p>Now, I suspect these may not be so reliable simply because, in most of these surveys, they just ASK the men how big their dicks are. I mean, come on! You think that is going to give you any honest answers? And anyway, it’s impossible to know how to measure it properly. A good deal of the dick is under the surface of the skin, and if you pull it out a bit before applying the tape-measure, you can normally squeeze out another inch or two.</p>
<p>Penis measuring is a science in itself, as you can see by searching on Google for “<em>How to measure your penis</em>”. (<strong>Warning</strong>: do NOT go to Google and search for “<em>How to measure your penis</em>” unless you want to stumble into a deeply unsettling, neon-light-blinking part of the Internet.)</p>

<p>With the exception of &#8220;Penis Size and Age&#8221; and &#8220;On Circumcision, the analyses discussed below pertain to adult subjects, 18 years of age and older.</p>
<p>The inclusion of minimal, and particularly maximal penile dimensions have caused many of you to question the validity of my data. Blatantly fraudulent responses (from 17 year old lawyers or those claiming &#8220;American Zulu warrior&#8221; ancestry, for example) are excluded from entry into the database as are penis lengths in excess of 360mm (14.2&#8243;). As an additional safeguard, the bottom 1% (for those 18 years and older) and top 2% (for all age groups) of each of the five penile measurements studied have also been excluded from the analysis. I realize that this is a rather conservative approach, but the fact that my results are very close to that reported by Kinsey et al. and the almost symmetric distribution of erect penis lengths, leads me to suspect that any residual and unavoidable contamination has been kept to a minimum.</p>

<h1>MEASURING UP</h1>
<p>To determine more precisely how you compare with the 2,545 adult subjects who participated in this survey, I have divided the data into percentiles of 10 percentile increments. If, for example, your erect penis measures 155 mm, the table below indicates that this size falls between the 40th and 50th percentile. In other words, at least 40% of the men fell below this value and at least 50% were above. In the upcoming expanded version of this edition, the chart below has been replaced by three graphs which provide an even greater degree of precision.</p>

<h1>PENIS SIZE AND RACE</h1>

<p>Since the release of the fifth edition, the number of Black and Hispanic participants has not substantially increased. Because of the continued low sample sizes therefore, the results reported below concerning the aforementioned groups must be considered tentative, pending a larger number of responses.</p>
<p>Surprisingly, it would appear from Figure 5, that contrary to popular myth, Black males have shorter erect lengths than their Caucasian counterparts. However, due to the small sample size and large variation in lengths, this &#8220;difference&#8221; is not statistically significant. The average flaccid length among Blacks however was 93.8mm (3.7&#8243;) compared to 87.7mm (3.4&#8243;) for Caucasians, which may be responsible for the impression that Black men have greater erect dimensions. Again, I emphasize that these observations must remain tentative.</p>
<p>There was a significant difference in length between Caucasians and both Hispanic and East Asians (those of Chinese, Japanese, Korean or Vietnamese descent). Whereas with Hispanics, such a difference was limited to erect length only, with East Asians all five measurements were statistically lower in comparison to Caucasians. Although part of this difference may be due to the shorter stature of East Asians (see &#8220;On Correlations&#8221; below), height matched comparisons with Caucasian subjects nevertheless failed to alter this finding.</p>

<p>The figure to the left summarizes the results of question 44, in which men were asked to rate members of their own ethnic group with respect to size. Of particular interest was the response of East Asian subjects. Among East Asians residing in the East, 31% felt that they were generally of modest size, compared to 56% of those living in the West. This is probably due to the fact that Western countries tend to be more racially diverse, allowing for greater interaction and hence comparison with men of different ethnic backgrounds. It is also interesting to note that the vast majority of Black subjects stated that they tended to be well endowed; an opinion which was not borne out by the results of this study.</p>
<h1>PENIS SIZE AND AGE</h1>
<p>I was initially surprised by the number of responses from teenagers and, although my survey wasn&#8217;t specifically designed to detect changes in penis size during puberty, the data collected so far has revealed some rather interesting findings.</p>
<p>As of this edition, and as illustrated in Figure 7, average erect penis length increased until the age of 16, a finding that marks a departure from the five previous editions of this page, which reported that such a developmental milestone occurred at age 17. With respect to adolescent lengths, it is interesting to note that the results presented here are almost identical to that of another online survey, the results of which are located at <a href="http://www.dnai.com/~ibex/jackmisc/jacklib/jacksurvey3.html">http://www.dnai.com/~ibex/jackmisc/jacklib/jacksurvey3.html</a>. The apparent variation in average size between the ages of 16 to 49 was due to random sampling error and was not statistically significant..</p>
<p>The situation with regard to erect penis length beyond the age of 50 remains somewhat nebulous. According to the graph below, there was essentially no difference in size with respect to younger age groups. However, I have detected a progressive, yet slight decline in length among older men in this group. Unfortunately, due to the modest sample size of such individuals, it was not possible to determine whether this was a statistical anomaly or an anatomical consequence of the aging process.</p>

<h1>ON ERECTIONS</h1>
<p>The data indicates that during an erection, the average increase in penis size was 197.9%. However, for men whose flaccid penis measured 80 mm (3.1&#8243;) or less, the increase was 263.2%, compared to 165.3% for those greater than this length (<em>p</em>&#60;0.0001). This principle is demonstrated in Figure 8, which reveals a strong negative correlation between flaccid length and the percent increase during an erection.</p>

<p>It is also interesting to note that there was less variation in erect penis lengths relative to flaccid lengths. This convergence in penis size is illustrated by comparing the coefficient of variation (CV), a unitless measure of variability obtained by dividing the standard deviation by the mean and expressing the result as a percentage. The CV for flaccid lengths was 31.4 whereas in the erect state it decreased to 19.5.</p>
<p>When erect the position of greatest girth was as follows; head 36%, uniform 32%, base 25% and some other location 7%.</p>
<p>Forty eight per cent stated that their penis was straight when erect, 28% reported a deviation to the left or right and 24% claimed to have a bend (presumably in the shaft).</p>
<h1>ON CIRCUMCISION</h1>
<p>Unlike a previously published study in the medical literature, I did not detect a significant difference in erect length (or the other four measurements) between circumcised and uncircumcised individuals.</p>
<p>Overall, 70% of the subjects were circumcised, 27% were uncircumcised and 3% did not specify their circumcision status. Of the 633 men responding outside of the U.S.A. and Canada who specified their status, 64% were uncircumcised. Not unexpectedly, this compares to 40% of Canadians and only 15% of Americans.</p>
<p>The proportion of those claiming to be content, neutral or discontent concerning their circumcision status was almost equal between the two groups (approximately 66%, 21% and 13% respectively). Among those who were content however, there was a striking difference with regard to sexual orientation. Seventy-two per cent of circumcised straight males expressed contentment with their circumcision status while only 58% of circumcised gay or bisexuals felt the same way (<em>p</em>&#60;0.001).</p>
<h1>ON CORRELATIONS</h1>

<p>With the rather impressive number of responses I have amassed since the inception of this survey, I have detected that, on average, there exists a strong relationship between erect penis length and height, as illustrated in Figure 9. For the purposes of demonstrating possible correlations between length and various hand and foot measurements, it became necessary to control for this phenomena by performing a partial correlation between length and the various measurements in question. The results of such an analysis are presented below.</p>
<p>With the exception of shoe size, there exists a significant but weak correlation for each of the body parts studied. (Please note that questions regarding nose length and width are recent additions to the survey, and at the time of this writing I had insufficient data to perform a reliable statistical analysis.)</p>

<p>Figure 10 reveals the significant relationship between erect length and circumference.</p>
<h1>SOME PENILE TRIVIA</h1>
<p>As in previous editions of this communication, body builders tended to be more endowed than &#8220;couch potatoes&#8221; (170.5mm or 6.7&#8243; vs. 160.7mm or 6.3&#8243; p&#60;0.001).</p>
<p>In addition, the difference in flaccid length between those who are reluctant to potentially expose their penis to public scrutiny and those who are not remained strong (81.0mm or 3.2&#8243; vs. 89.6mm or 3.5&#8243; respectively <em>p</em>&#60;0.001). A larger difference however, existed with respect to erect lengths (166.8mm or 6.6&#8243; vs. 153.3mm or 6.1&#8243; respectively <em>p</em>&#60;0.001). A similar relationship was seen with regard to potential exposure to male family members.<br />

<p>As illustrated in figure 11, well endowed men had more sexual partners per year than their average or modestly endowed counterparts. The data reveals that these men were more self-confident which may, in part, explain this finding.</p>
<p>As illustrated in figure 12, a striking difference existed in the response pattern between gay/bisexual men and straight men when these individuals viewed a well endowed male (ref. survey question 47). Gay and bisexual men tended more to express arousal (36%) or awe (28%), while straight men were more likely to be indifferent (29%) or envious (21%). Among both groups, those who were indifferent had significantly larger erect penises than those who felt either intimidation or inadequacy (<em>p</em>&#60;0.001).</p>

<p>Blame or give accolades to <strong>Jane Burgermeister</strong>, who on April 8th, 2009 filed criminal charges in Austria against Baxter and Avir Green Hills Biotechnology for producing and distributing contaminated bird flu vaccine material this winter, alleging that this was a deliberate act to cause a pandemic, and also to profit from that pandemic.  Read more from her site at <a href="http://www.theflucase.com/">http://www.theflucase.com/</a>  There is no case reference numbers that we can find.</p>
<p>The first H1N1 case in the U.S. began in May, 2009 . Mrs. Trunnell, a 33 year old Special Education teacher, was eight months pregnant when she became ill with the virus in April. She was placed on a ventilator before passing away in early May. <p>May 2009, <strong>Jerry Blevins</strong>,esq sued the Elmore County Board of Education and the Alabama State Board of Education in order to keep their 2 children out of the school to avoid catching the flu, and have school assignments done at home. <a href="http://www.homeedmag.com/newscomm/3323/swine-flu-addition-to-the-reasons-to-homeschool-list/">http://www.homeedmag.com/newscomm/3323/swine-flu-addition-to-the-reasons-to-homeschool-list/</a>  Suggesting homeschooling instead, the judge dismissed the case. <p>A preliminary injunction to stop mandatory vaccinations has apparently been issued in the United States District Court of New Jersey.  When/If  the judge signs the Preliminary Injunction, it will stop the federal government from forcing anyone in any state to take flu vaccine against their will. It will also prevent a state or local government from forcibly vaccinating anyone, and forbid any person who is not vaccinated from being denied any services or constitutional rights. Vawter&#8217;s filings included a Complaint, and several pages of evidentiary Exhibits. <a href="http://lawandorderroybean.blogspot.com/2009/09/injunction-to-stop-mandatory-flu.html">http://lawandorderroybean.blogspot.com/2009/09/injunction-to-stop-mandatory-flu.html</a>   I have yet to see the signed injunction.</p>
<p>It would be fair to remind that:</p>
<blockquote><p>&#8220;Forced vaccination would violate the Fourth Amendment of the Constitution by allowing the government to enter homes and force people to be vaccinated, or to forcibly remove people to another location for vaccination. <p>Today, October 9, 2009.  As we have now bombed the moon, Natural News has dropped the bomb of another Swine Flu related lawsuit.  To be filed later today in Washington D.C., it charges that the FDA violated the law in its hasty approval of four swine flu vaccines by failing to scientifically determine neither the safety nor efficacy of the vaccines.  The suit seeks to not only nullify the FDA&#8217;s unlawful &#8220;approval&#8221; of the four H1N1 influenza vaccines, but to also ask the court to issue an injunction that would halt any mandatory vaccination requirements. The suit on behalf of plaintiff <strong>Gary Null</strong>, the New York health broadcaster and author, as well as health professionals in New York State who are being told to take the shot or get fired. Und nun bin ich über eine ganze riesengroße Tafel gestolpert, gleich beim Ausgang vom Quartier21, auf dem so ungefähr alles verboten wird.</p>
<p>Beim Verbotsschild mit Männchen und Weibchen beginnt allerdings das Rätselraten bei mir: Ist das Händchenhalten verboten? Oder dürfen hier nur gleichgeschlechtliche Paare miteinander reden oder gehen? Oder heißt das einfach, dass man mehr als Badehose und Bikini bekleidungstechnisch auf dem Körper haben sollte? Oder sind ganz einfach sowieso alle Menschen verboten im MQ? Ich bin ratlos&#8230;<br />

Actually, I thought I had bought it already. My girls and I were talking about it today and decided to listen to it in the car this morning, but when I searched for it, it wasn&#8217;t there! So, first thing I did when I got home: I bought it on iTunes.</p>
<p>The funny part is we were discussing what in the world this song could be about. My girls are pretty darn smart and very mature, but as awesome as I am, I still try to shelter them just a bit (for now; they&#8217;re only 9 &#38; 11). So, I said, &#8220;It&#8217;s probably a nickname for a girlfriend or something.&#8221; My youngest shouts out, &#8220;My wiener!&#8221; and laughs. And my oldest, (bless her heart *snarky*) says, &#8220;Who would ever write a song about their wiener?!&#8221;</p>

<content:encoded><![CDATA[<div class='snap_preview'><p>Apologies to my dedicated readers for my prolonged absence&#8211;a cross-country move really puts a dent in one&#8217;s productivity. Now that I&#8217;ve pretty much settled into my new home in the quaint town of Somerville, MA, it&#8217;s time to get my blog on.</p>
<p>One momentous occasion that occurred during my epic trek from Northern California to New England was my stopover at Chicago O&#8217;Hare. or, ORD as known to those whose tastes inspire &#8220;Stuff White People Like&#8221; blog posts. Usually, I loathe any amount of time I&#8217;m forced to spend at that airport (damn you, American Airlines!) but this time, I was overcome with glee as soon as I stepped off the plane. The reason for my giddiness? The chance to sink my teeth into a a Chicago-style hotdog. It had been three years since I&#8217;ve had a proper one, so the first order of business was to grab one of these beauties:</p>

<p>&#8230;find a nice, quiet corner in the airport, and chow down.</p>
<p>Ok, so it wasn&#8217;t exactly Jimmy&#8217;s Red Hots&#8211;I got it at a cheesy bar just outside my gate&#8211;but after three years of &#8220;close but no cigar&#8221; dogs, I was ready to eat anything that came remotely close to authentic. And this, my friends, came pretty darn close.</p>
<p>For those who aren&#8217;t quite familiar with what Chicago-style means, let me break it down for you:</p>
<p>1) All-beef hot dog. Vienna Beef makes the best.<br />
2) Poppy seed bun. This is a very rare find outside Illinois, trust me, I&#8217;ve tried.<br />
3) Yellow mustard. None of that gourmet stone-ground French stuff.<br />
4) Chopped onions. Yeah, make sure you have a couple of strong breath mints and possibly Gas-X on hand for this one.<br />
5) Atomic green relish. Shades of olive green won&#8217;t cut it.<br />
6) Pickle spear. The more big and honkin,&#8217; the better.<br />
7) Sport peppers. These are little chiles shaped like Bugles.<br />

9) And, last but not least, a couple of dashes of celery salt.</p>
<p>It sounds like an &#8220;everything but the kitchen sink&#8221; approach, but notice that nowhere did I list ketchup. Ketchup belongs on fries, hash browns, meatloaf and all over little kids&#8217; faces and fingers, not hot dogs, and especially NOT a Chicago-style dog. You put ketchup on that thing and I guarantee you&#8217;ll get some dirty looks. You might as well be throwing the hot dog in the trash if you commit the ultimate sin in wiener circles. Trust me, you won&#8217;t even miss the ketchup with the perfect Chicago dog. That&#8217;s what the tomatoes are for.</p>
<p>Here&#8217;s a fun piece of trivia: The Chicago-style hot dog was invented during the Great Depression, when vendors in the area started touting the &#8220;Depression Sandwich&#8221; as an economical meal tucked inside a bun for 5 cents. Also another juicy tidbit: This kind of hot dog is also known as one that&#8217;s been &#8220;dragged through the garden.&#8221; Cute, no?</p>
<p>I&#8217;ve written a couple of stories about hot dogs for a client, and my source at the National Hot Dog and Sausage Council (yes, there is such a thing) says that poppy seed buns are so hard to find that when the council tried shooting a Chicago-style dog at their headquarters in Washington, DC, they had to buy a regular hot dog bun and glue poppy seeds to it. Yup. It&#8217;s like the unicorn of the hot dog bun world.</p>

<p>With their thin coat it is not suprising that Dachshunds feel the cold! Dachshund Luke is already shivering and he is in Spain. <title><![CDATA[Feedback]]></title>

<p><strong> </strong>In the same way that the scientific community can regulate itself, the regulating feature of community tradition can be seen in its integration as a feedback system.  Norbert Wiener described feedback systems in his work on cybernetics as a way of systematizing error correction.<a href="#_ftn1">[1]</a> In analyzing community dynamics, feedback system theory can help to understand how change occurs within the community.  How is new input integrated with the existing community traditions?  If tradition is understood dynamically as postulated above, then it must find a system for structuring emergence.</p>
<p>A negative feedback system regulates by comparing the difference between the ideal and the actual.  A thermostat is a common example of a negative feedback system.  The thermostat contains data for the ideal temperature of the room.  The thermostat then compares the ideal temperature to the actual temperature of the room and either enacts the air conditioning/heat or turns the device off according to the difference between the actual and the ideal.<a href="#_ftn2">[2]</a> The negative feedback system becomes an instance of standards and performance.  Control is maintained by always comparing the performance to a relatively stable standard.<a href="#_ftn3">[3]</a></p>
<p>A positive feedback system relies on the amplification of input data.<a href="#_ftn4">[4]</a> A fire is an example of a positive feedback system.  As the temperature of the fire rises, the fuel is consumed faster; the faster the fuel is consumed, the higher the temperature of the fire and the cycle continues.  Positive feedback systems work as vicious cycles. The amplification reinforces the data until it reaches a tipping point and the system collapses<a href="#_ftn5">[5]</a> &#8211; the fire burns all its fuel.  The positive feedback system is unstable and difficult to control.</p>
<p>The augmented community uses both negative and positive feedback systems in its regulation of community.  Through standards and community ideals, the Well compares its current actions as a community to the understood model of the past as a negative feedback system.  When the Well extends itself into the global community, though, the positive feedback system enhances the acceptance of divergent ideas into the community.  The challenge for The Well as an augmented community is to balance those two forms of regulation in order to maintain the stability of tradition while allowing it to emerge as a dynamic tradition.</p>
<p><strong>Renewing the Past to Decide the Future</strong></p>
<p>In May of 2009, the leadership at The Well took a step back in order to assess the current situation of the community in hopes of reestablishing the direction of the church.  The first step in this process was to review the past of the church.  In place of the sermon that Sunday, one of the long-time members took the opportunity to relay the twelve-year history of the congregation from a small offshoot of a closing church to the current existence of the group as The Well.<a href="#_ftn6">[6]</a> Following a review of the community’s past, the congregation took time to discuss what they called, “Next Steps for the Well.”<a href="#_ftn7">[7]</a> An outline of these steps, which directly related to the “four foundational values” of The Well, was posted on the group’s website as a way to review and provoke response to the direction of the community.<a href="#_ftn8">[8]</a> The process of reviewing the “Next Steps” for The Well was one of negotiating the ideal of the church.  By reviewing the past, the community was able to utilize the things that they had learned and to rejuvenate the reasons and value associated with the continuing community.</p>
<p>The practice of tradition leads to a common ideal amongst the local community.  Tradition as the center in the local community acts as a negative feedback system; the actual practice is always measured according to the ideal practice of the community.<a href="#_ftn9">[9]</a> This means that all activity within the community is in a constant struggle towards the ideal.  In membership it was seen that well-formed sets have idealized definitions either by laying boundaries or as a center that members move toward.  The ideal becomes a measurement of acceptance both of members and of ideas.  The Well uses its “foundational values” as a measurement of what the community should be doing.  By reviewing the current actions of the community against those standards they are able to judge in which direction to be moving. “The virtue of models is that they enable practitioners to reflect upon their work by making underlying assumptions, and potential contradictions, explicit.”<a href="#_ftn10">[10]</a> Tradition oriented communities hold ideals or models that help to outline the community boundaries and maintain appropriate practice.</p>
<p><strong> </strong>However, reviewing the past and relating the current state of the community does more than just make a comparison between the actual and the ideal practices.  As The Well reviews its values it also attempts to reimagine them.</p>
<p>For the last year or so we have sensed that God has brought us (organizationally speaking) to a peaceful clearing on the trail. This clearing has been a place of much needed stability and rest. We’ve been able to catch our breath, roast a few marshmallows on the fire, and throw the frisbee around a bit. As nice as it is, we do not desire to stay in the clearing for too long. It’s time to continue on our journey.<a href="#_ftn11">[11]</a></p>
<p>As the traditional ideals of the community become idolized, the community reaches a stagnant state.  If a community reaches the state in which it appears to have met the idealized state then it will abstain from any differentiation.<a href="#_ftn12">[12]</a> In other words, when the temperature of the room has reached the thermostat setting then the heating/cooling device is turned off.  The observation made by the members of The Well that they had reached a stagnant state provided incentive not to remain in that place, but to fight the inertial standstill and to reimagine the ideal for new contexts and input.</p>
<p>As a community in a context, The Well cannot remain as an autonomous system.  Like the thermostat in the room, once the standard is met it never remains met.  Why?  Because rooms exist in a larger building which is surrounded by the outside world.  Eventually, temperature changes outside will affect the temperature of the room – regardless of whether you open a window or not.  The Well exists in a context, therefore outside influence always invokes new variable into the equation.  Some communities choose to ignore those inputs, but The Well as an augmented community accepts its context openly.</p>
<p>Tradition in The Well as an augmented community is about emergent tradition, and this understanding of tradition as something that must be renewed gives the community a clearer understanding of the value of change.  “For the fact is that there is no inherent value in change for its own sake, and while nothing in the universe remains forever unchanged, the degree of <em>desirable change</em> for any living system changes.”<a href="#_ftn13">[13]</a> The “foundational values” of The Well provide a system of judgment that lets them know when to rest in the clearing and when to start moving again.  This is the importance of the localization aspect of the augmented community; limitations based on an ideal provide insight into when change is superfluous and when change becomes a value worth its price.</p>

I have no time to divulge the intricacies of these interactions, but&#8230;among the highlights are: several intimate interactions with the Czech police force; an after-hours shirtless Hungarian drum circle; a small dog sharing a plate of goulash with Santa Claus in a down home Prahian pub; indulging in the wonders of a skillfully designed children&#8217;s playground, complete with hamster wheel and zipline, among the streets of Budapest; and hording complementary booze and snacks from some of eastern Europe&#8217;s finest business hotels.</p>

<p>Der Wiener Landtag hat beschlossen:</p>
<p>Geltungsbereich<br />
§ 1. Die Anbahnung und die Ausübung der Prostitution im Gebiet der Stadt Wien unterliegen unbeschadet strafgesetzlicher und gesundheitspolizeilicher Regelungen des Bundes den Bestimmungen dieses Gesetzes.<br />
Begriffsbestimmungen<br />
§ 2. (1) Prostitution im Sinne dieses Gesetzes ist die Duldung sexueller Handlungen am eigenen Körper oder die Vornahme sexueller Handlungen, soweit Gewerbsmäßigkeit vorliegt.<br />
(2) Anbahnung der Prostitution liegt vor, wenn jemand durch sein Verhalten in der Öffentlichkeit erkennen läßt, Prostitution ausüben zu wollen.<br />
(3) Gewerbsmäßigkeit liegt vor, wenn die Anbahnung, Duldung oder Handlung in der Absicht erfolgt, sich durch ihre wiederkehrende Begehung eine fortlaufende, wenn auch nicht regelmäßige Einnahme zu verschaffen.<br />
(4) Aufdringlich ist die Anbahnung der Prostitution dann, wenn unbeteiligte Dritte durch deutliche, die Ge-schlechtssphäre betonende, Handlungen oder Körperhaltungen belästigt werden könnten.<br />
Verbotsbestimmungen<br />
§ 3. Die Prostitution darf nicht angebahnt oder ausgeübt werden von<br />
1. minderjährigen Personen;<br />
2. Personen, gegen deren Prostitutionsausübung pflegschaftsbehördliche Bedenken bestehen;<br />
3. Personen, die die gesundheitspolizeilichen Voraussetzungen des Geschlechtskrankheitengesetzes, StGBl. Nr. 152/1945, in der Fassung BGBl. I Nr. 98/2001, in Verbindung mit der Verordnung des Bundesministers für Gesundheit und Umweltschutz über die gesundheitliche Überwachung von Per-sonen, die der Prostitution nachgehen, BGBl. Nr. 314/1974, in der Fassung BGBl. Nr. 591/1993, für die Zulässigkeit der Ausübung der Prostitution nicht erfüllen.<br />
Beschränkung der Anbahnung der Prostitution<br />
§ 4. (1) Die Anbahnung darf nicht in aufdringlicher Weise erfolgen.<br />
(2) Die Anbahnung der Prostitution ist in Bahnhöfen, Stationsgebäuden und Haltestellenbereichen öffentli-cher Verkehrsmittel verboten. Weiters ist die Anbahnung der Prostitution an folgenden Örtlichkeiten (Schutzob-jekten) und zusätzlich auch in einem Schutzbereich von 150 m Entfernung von diesen Örtlichkeiten verboten:<br />
1. Gebäude und Gebäudeteile, die religiösen Zwecken gewidmet sind;<br />
2. Kindertagesheime;<br />
3. Schulen und Schülerheime;<br />
4. Jugendheime und Jugendzentren;<br />
5. Kinder- und Jugendspielplätze;<br />
6. Heil- und Pflegeanstalten;<br />
7. Friedhöfe.<br />
Der Schutzbereich stellt dabei einen Umkreis mit einem Radius von 150 m Luftlinie dar, dessen Mittelpunkt der nächstliegende Ein- oder Ausgang des Schutzobjektes ist. Von diesem Schutzbereich ausgenommen ist der Fall, dass sich zwischen Schutzobjekt und dem Ort der Anbahnung der Prostitution eine Abgrenzung befindet, die innerhalb des Schutzbereiches keine Verbindungswege und keine Sichtverbindung zum Schutzobjekt aufweist, wie insbesondere eine Bahntrasse oder eine Einfriedungsmauer.<br />
(3) Soweit es im Interesse der Öffentlichkeit oder unbeteiligter Personen notwendig ist, kann die Behörde zusätzlich zeitliche oder örtliche Beschränkungen für alle Arten der Anbahnung verfügen. Dabei ist darauf Be-dacht zu nehmen, daß die Wahrnehmbarkeit der Anbahnung durch die Öffentlichkeit, insbesondere auch durch Kinder und Jugendliche, unter Berücksichtigung der örtlichen Verhältnisse ein zumutbares Ausmaß nicht über-steigt.<br />
(4) Zur Abwehr oder Beseitigung störender Mißstände können die gemäß Abs. 3 getroffenen Anordnungen geändert und ergänzt werden.<br />
Beschränkung der Prostitution<br />
§ 5. (1) Die Ausübung der Prostitution in Wohnungen ist verboten. Dieses Verbot gilt auch für andere Räume eines Gebäudes, wenn sie keinen unmittelbaren und gesonderten Zugang von einer öffentlichen Ver-kehrsfläche aus aufweisen oder wenn das Gebäude innerhalb des im § 4 Abs. 2 umschriebenen Bereiches liegt.<br />
(2) Das Verbot bezieht sich nicht auf die Unterkunft (Wohnung) derjenigen Person, welche die Dienstleis-tung einer die Prostitution ausübenden Person in Anspruch nimmt (Hausbesuch).<br />
(3) Vom Verbot nach Abs. 1 sind Gebäude ausgenommen, deren Wohnungen ausschließlich von Personen benützt oder bewohnt werden, welche die Prostitution ausüben, sofern die Gebäude einen unmittelbaren und gesonderten Zugang von der öffentlichen Verkehrsfläche aus aufweisen und sich außerhalb des im § 4 Abs. 2 umschriebenen Bereiches befinden.<br />
(4) Die Behörde hat die Ausübung der Prostitution in Gebäuden bzw. Gebäudeteilen zu untersagen, wenn dies zum Schutz der Nachbarschaft vor unzumutbarer Belästigung oder aus anderen öffentlichen Rücksichten, insbesondere auch bezüglich des Jugendschutzes, erforderlich ist. Das gleiche gilt, wenn die äußere Kennzeich-nung eines Gebäudes (Gebäudeteiles) in aufdringlicher Weise erfolgt und trotz behördlicher Aufforderung nicht auf ein für die örtlichen Verhältnisse zumutbares Ausmaß abgeändert wird. Die Behörde hat dem Eigentümer (Miteigentümer), dem Verfügungsberechtigten und dem Verwalter eines Gebäudes oder Gebäudeteiles den rechtskräftigen Untersagungsbescheid unverzüglich nachweislich zur Kenntnis zu bringen.<br />
(5) Die zur Ausübung der Prostitution verwendeten Gebäude bzw. Gebäudeteile müssen die unbedingt er-forderlichen sanitären Einrichtungen und solche Sicherheitsvorkehrungen aufweisen, die einer Gefährdung des Lebens oder der Gesundheit von Menschen sowie dem Entstehen eines Brandes vorbeugen. Weiters müssen diese Gebäude(teile) so ausgestaltet sein, daß Anrainer (Haus- und Wohnungseigentümer sowie Mieter) keinen unzumutbaren Belästigungen in optischer oder akustischer Hinsicht ausgesetzt sind. Die näheren Vorschriften über die erforderlichen sanitären Einrichtungen und Sicherheitsvorkehrungen, insbesondere über die Bezeich-nung der notwendigen Verbindungswege (Fluchtwege), der Notbeleuchtung und der Brandschutzeinrichtungen sowie zum Schutz der Anrainer gegen unzumutbare Belästigung werden von der Behörde durch Verordnung erlassen. Die Behörde kann nötigenfalls den Eigentümer (Miteigentümer) zur Schaffung solcher sanitärer Ein-richtungen, Sicherheitsvorkehrungen und Anrainerschutzeinrichtungen unter Gewährung einer angemessenen Frist verhalten; solche behördlichen Aufträge können auch Verfügungsberechtigten oder nach Maßgabe des § 8a Abs. 3 Verwaltern eines Gebäudes oder Gebäudeteiles unter der Voraussetzung erteilt werden, dass diesen Per-sonen die Erfüllung der Aufträge rechtlich möglich ist. Wird dem Auftrag nicht fristgerecht entsprochen, ist die weitere Verwendung des Gebäudes bzw. Gebäudeteiles zur Ausübung der Prostitution verboten; diese Rechts-folge tritt auch dann ein, wenn den mit der Vollziehung dieser Vorschriften betrauten Behördenvertretern der Zutritt in solche Gebäude(teile) nicht ermöglicht wird, und bleibt bis zur Zutrittsgewährung aufrecht.<br />
(6) Der Eigentümer (Miteigentümer), der Verfügungsberechtigte oder der Verwalter eines Gebäudes oder Gebäudeteiles im Umfang seiner Verantwortlichkeit gemäß § 8a Abs. 3 hat für die Einstellung der Prostitutions-ausübung zu sorgen, wenn den Bestimmungen des § 4 Abs. 1 oder 2, des § 5 Abs. 1 oder 3 zuwidergehandelt wird, wenn eine Untersagung gemäß § 5 Abs. 4 erfolgte oder die im § 5 Abs. 5 letzter Satz angeführte Rechts-folge eingetreten ist. Diese Verpflichtung beginnt mit dem Zeitpunkt, ab dem der Verantwortliche von der ge-setzwidrigen Anbahnung oder Ausübung der Prostitution wusste oder bei gehöriger Aufmerksamkeit wissen hätte müssen.</p>
<p>Meldepflicht<br />
§ 6. (1) Personen, die die Prostitution ausüben wollen, haben dies persönlich bei der Behörde (§ 9 Abs. 3) zu melden. Die Meldung hat Vor- und Familiennamen, alle früheren Familiennamen, Geburtsdatum, Staatsbür-gerschaft, Wohnadresse und eine allfällige Anschrift im Sinne des § 5 Abs. 1 zweiter Satz und Abs. 3 zu enthal-ten.<br />
(2) Personen, die die Prostitution ausüben, haben unbeschadet der Verpflichtungen nach dem Meldegesetz 1991, BGBl. Nr. 9/1992, in der Fassung BGBl I Nr. 101/2003, der Behörde alle Änderungen im Sinne des Abs. 1 binnen einer Woche anzuzeigen.<br />
(3) Die von der Behörde entgegengenommenen Meldungen und Anzeigen sind dem Magistrat der Stadt Wien &#8211; Gesundheitsamt bekanntzugeben.<br />
Unterbrechung und Beendigung der Prostitution<br />
§ 7. (1) Personen, welche die Meldung gemäß § 6 Abs. 1 erstattet haben, steht es frei, die Ausübung der Prostitution zu unterbrechen oder zu beenden. Die Unterbrechung oder die Beendigung der Ausübung der Pros-titution ist der Behörde zu melden.<br />
(2) Die Meldung der Unterbrechung muß einen bestimmten Zeitraum bezeichnen.<br />
(3) § 6 Abs. 3 findet Anwendung.<br />
(4) Die Aufzeichnungen gemäß den §§ 6 und 7 sind sechs Monate nach Einlangen einer Meldung über die Beendigung der Ausübung der Prostitution zu vernichten. Der Ablauf dieser Frist wird durch Einleitung eines Verwaltungsstrafverfahrens wegen Verdachtes einer Übertretung gemäß § 8 Abs. 1 Z 3 bis zu dessen rechtskräf-tigem Abschluß gehemmt. Im Falle einer Einstellung dieses Verfahrens wird die Hemmung, im Falle einer Be-strafung wird die Meldung gegenstandslos.<br />
Betretungsrecht<br />
§ 8. (1) Liegt der begründete Verdacht vor, dass entgegen den Beschränkungen nach § 3, § 4 oder § 5 oder entgegen den Verpflichtungen nach § 6 die Prostitution angebahnt oder ausgeübt wird, so ist der Behörde und den Organen des öffentlichen Sicherheitsdienstes jederzeit der Zutritt auf Grundstücke, zu Gebäuden, Contai-nern, Fahrzeugen und allen ihren Teilen, in denen die rechtswidrige Anbahnung oder Ausübung der Prostitution mit Grund vermutet wird, zu gewähren.<br />
(2) Die dort angetroffenen Personen haben auf Verlangen ihre Identität nachzuweisen und die erforderli-chen Auskünfte zu erteilen, wenn anzunehmen ist, dass diese Personen sachdienliche Hinweise über das Vorlie-gen strafbarer Handlungen nach diesem Gesetz geben können. Die Auskunftspflicht hat sich ausschließlich auf solche Sachverhalte zu beziehen, die strafbare Handlungen im Sinne dieses Gesetzes sein könnten. § 35 Abs. 2 und 3 Sicherheitspolizeigesetz, BGBl. Nr. 566/1991, in der Fassung BGBl. I Nr. 104/2002, ist sinngemäß anzu-wenden. Weiters ist § 49 des Allgemeinen Verwaltungsverfahrensgesetzes 1991, BGBl. Nr. 51/1991, in der Fassung BGBl. I Nr. 117/2002, mit der Maßgabe anwendbar, dass eine Verweigerung der Auskunft aus dem Grunde des Gereichens zur Schande nicht zulässig ist.<br />
(3) Die Behörde und die Organe des öffentlichen Sicherheitsdienstes sind weiters befugt, vorgefundene Beweismittel sicherzustellen und in Verwahrung zu nehmen. Die sichergestellten Sachen sind dem Eigentümer oder rechtmäßigen Besitzer unverzüglich auszufolgen, sobald der Sicherstellungszweck entfällt. Können sicher-gestellte Sachen innerhalb eines Zeitraumes von 6 Monaten ab Entfall des Sicherstellungszweckes nicht ausge-folgt werden, weil der Behörde kein Eigentümer oder rechtmäßiger Besitzer bekannt wurde, so gelten diese Sachen als verfallen und sind zu verwerten oder, falls dies nicht möglich oder zulässig ist, zu vernichten. Ein allenfalls erzielter Erlös ist dem Eigentümer auf dessen Verlangen binnen 3 Jahren nach Eintritt des Verfalls auszufolgen.<br />
(4) Die Zutrittsbefugnis gemäß Abs. 1 kann mit angemessener unmittelbarer Zwangsgewalt durchgesetzt werden. Die Behörde und Organe des öffentlichen Sicherheitsdienstes dürfen physische Gewalt gegen Sachen anwenden, wenn es unerlässlich ist und diese Maßnahme vorher angedroht und angekündigt wurde. Dabei haben sie alles daran zu setzen, dass es zu keiner Gefährdung von Menschen kommt. Von einer Androhung und An-kündigung der Ausübung unmittelbarer Zwangsgewalt kann in Fällen der Notwehr oder der Beendigung gefähr-licher Angriffe (§ 33 des Sicherheitspolizeigesetzes, BGBl. Nr. 566/1991, in der Fassung BGBl. I Nr. 104/2002) soweit abgesehen werden, als dies für die Verteidigung des angegriffenen Rechtsgutes unerlässlich erscheint.<br />
(5) Die Amtshandlungen gemäß Abs. 1 bis 4 sind von der Behörde und den Organen des öffentlichen Si-cherheitsdienstes unter Vermeidung unnötigen Aufsehens sowie mit möglichster Schonung des Rufes, der Rech-te und schutzwürdigen Interessen der Betroffenen vorzunehmen. Auf Verlangen ist den Betroffenen binnen 24 Stunden eine Bescheinigung über die Vornahme der Amtshandlung mit Angabe der Gründe dafür auszustel-len.<br />
Strafbestimmungen<br />
§ 8a. (1) Wer die Prostitution anbahnt oder ausübt<br />
1. entgegen den Verbotsbestimmungen des § 3,<br />
2. ohne dass eine Meldung gemäß § 6 Abs. 1 vorliegt,<br />
3. während eine Unterbrechung gemeldet ist oder nachdem die Beendigung gemeldet wurde (§ 7 Abs. 1),<br />
4. für oder in Wohnungen oder Räumlichkeiten, in denen die Ausübung der Prostitution gemäß § 5 Abs. 1, 4 oder 5 verboten ist,<br />
begeht eine Verwaltungsübertretung und ist mit einer Geldstrafe bis 1 000 Euro, bei Uneinbringlichkeit mit Ersatzfreiheitsstrafe bis zu acht Tagen, im Wiederholungsfall mit einer Geldstrafe bis 2 000 Euro, bei Unein-bringlichkeit mit Ersatzfreiheitsstrafe bis zu zwölf Tagen zu bestrafen.<br />
(2) Wer es als Eigentümer (Miteigentümer) oder Verfügungsberechtigter eines Gebäudes oder Gebäudetei-les unterlässt<br />
1. für die Einstellung der Prostitutionsausübung gemäß § 5 Abs. 6 zu sorgen, wenn dort den Bestim-mungen des § 4 Abs. 1 oder 2 oder des § 5 Abs. 1 oder 3 zuwidergehandelt wird;<br />
2. nach einer Untersagung im Sinne des § 5 Abs. 4 oder nach Eintritt der im § 5 Abs. 5 letzter Satz ent-haltenen Rechtsfolge für die Einstellung der Prostitutionsausübung zu sorgen;<br />
3. die gemäß § 5 Abs. 5 ergangenen rechtskräftigen behördlichen Aufträge zu erfüllen;<br />
begeht eine Verwaltungsübertretung und ist mit einer Geldstrafe bis 3 500 Euro, bei Uneinbringlichkeit mit Ersatzfreiheitsstrafe bis zu drei Wochen, im Wiederholungsfall mit einer Geldstrafe von 350 Euro bis 7 000 Euro, bei Uneinbringlichkeit mit Ersatzfreiheitsstrafe bis zu fünf Wochen, zu bestrafen.<br />
(3) Wer die Verwaltung eines Gebäudes ausübt, ist anstelle des Eigentümers (Miteigentümers) für Verwal-tungsübertretungen nach Abs. 2 verantwortlich, wenn die Tat (Unterlassung) ohne Veranlassung und Vorwissen des Eigentümers (Miteigentümers) begangen wurde. Der Eigentümer (Miteigentümer) ist neben dem Verwalter verantwortlich, wenn er es bei dessen Auswahl oder Beaufsichtigung an der nötigen Sorgfalt fehlen ließ.<br />
(4) Wer<br />
1. dem § 4 Abs. 1 oder 2 oder den nach § 4 Abs. 3 oder 4 durch Verordnung oder Bescheid vorgeschrie-benen Beschränkungen zuwiderhandelt oder<br />
2. die nach § 6 Abs. 2 vorgeschriebene Anzeigen nicht fristgerecht erstattet oder<br />
3. Organen der Behörde oder Organen des öffentlichen Sicherheitsdienstes entgegen § 8 Abs. 1 den Zu-tritt zu Grundstücken, Gebäuden, Containern und Fahrzeugen und allen ihren Teilen nicht gewährt oder entgegen § 8 Abs. 2 auf Verlangen seine Identität nicht nachweist die erforderlichen Auskünfte nicht erteilt,<br />
begeht eine Verwaltungsübertretung und ist mit einer Geldstrafe bis zu 700 Euro, bei Uneinbringlichkeit mit Ersatzfreiheitsstrafe bis zu einer Woche, zu bestrafen.<br />
(5) Keine Verwaltungsübertretung nach Abs. 1, Abs. 2 und Abs. 4 liegt vor, wenn die jeweilige Tathand-lung (Unterlassung) zugleich den Tatbestand einer in die Zuständigkeit der Gerichte fallenden strafbaren Hand-lung bildet.<br />
(6) Bei der Verwaltungsübertretung nach Abs. 1 ist als mildernder Umstand zu berücksichtigen, dass sich die beschuldigte Person amtsärztlichen Untersuchungen auf das Freisein von Geschlechtskrankheiten und von sexuell übertragbaren Krankheiten laufend unterzogen hat und im Falle der Feststellung von Erkrankungen auch ärztliche Behandlungen durchführen ließ.<br />
(7) Geldstrafen fließen der Gemeinde Wien als zusätzliche Mittel für Beratungs- und Betreuungseinrich-tungen betreffend Personen zu, welche die Prostitution ausüben bzw. ausgeübt haben.<br />
Sprachliche Gleichbehandlung<br />
§ 8b. Soweit in diesem Gesetz personenbezogene Bezeichnungen nur in männlicher Form angeführt sind, beziehen sich diese auf Frauen und Männer in gleicher Weise. Bei Anwendung auf bestimmte Personen ist die jeweils geschlechtsspezifische Form zu verwenden.</p>
<p>Schluß- und Übergangsbestimmungen<br />
§ 9. (1) Dieses Gesetz tritt mit Beginn des siebenten auf die Kundmachung folgenden Monats in Kraft.<br />
(2) Mit dem Inkrafttreten dieses Gesetzes tritt das Gesetz vom 28. Feber 1975, mit dem der Bundespolizei-direktion Wien die Durchführung von Verwaltungsstrafverfahren wegen Übertretung ortspolizeilicher Verord-nungen auf dem Gebiete der Sittlichkeitspolizei übertragen wird, LGBl. für Wien Nr. 19/1975, außer Kraft.<br />
(3) Behörde im Sinne dieses Gesetzes ist der Magistrat. Die Gemeinde hat ihre in diesem Gesetz geregelten Aufgaben, mit Ausnahme der Durchführung des Verwaltungsstrafverfahrens, im eigenen Wirkungsbereich zu besorgen. Für die Dauer der Geltung der Verordnung der Wiener Landesregierung vom 16. April 1968, LGBl. für Wien Nr. 27, mit der die Besorgung der Angelegenheiten der örtlichen Sicherheitspolizei und der Sittlich-keitspolizei auf die Bundespolizeidirektion Wien übertragen wird, ist diese die erstinstanzlich zuständige Behör-de mit Ausnahme der Vollziehung der Bestimmungen des § 5 Abs. 5. Die Vollziehung der Strafbestimmungen obliegt in erster Instanz der Bundespolizeidirektion Wien.<br />
(4) Vor Erlassung von Verordnungen gemäß § 4 Abs. 3 und Untersagungen gemäß § 5 Abs. 4 ist die zu-ständige Bezirksvertretung anzuhören.<br />
(5) Auf Grund der Verordnung des Magistrats der Stadt Wien über die sittlichkeitspolizeiliche Regelung der Prostitution vom 13. Feber 1975, Amtsblatt der Stadt Wien vom 15. Mai 1975, Heft 20, mit Bescheid vorge-schriebene Beschränkungen gelten als Beschränkungen im Sinne des § 4 Abs. 3 bis zu einer Änderung weiter.</p>

<h2>Does your Dachshund know when a toy is missing?</h2>
<p>Dachshund Luke does &#8211; he checks all his toys at least once a day to make sure they are accounted for. He also loves to play &#8216;find it&#8217; &#8211; toy hide n seek. Well today, there has been an unplanned &#8216;find it&#8217; &#8211; the missing ball that he will not find, but keeps looking for.</p>
<p>It all started when Dachshund Luke bounced a ball out the back door, down the steps and onto the balcony. He has been taught not to go down these steep concrete steps (we carry his out) but enjoys bouncing the ball down there and us throwing it back to him.</p>
<p>I am not good at throwing so never should have attempted to throw the ball from our balcony up 3 steps into our doorway. The doorway the Dachshund Luke was standing in anticipaticion, waiting for his ball.</p>
<p>I threw it without thinking and the ball caught the corner of the door, bounced in front of Dachshund Luke&#8217;s nose and then dived over the balcony. Plummeting 2 stories, bouncing off our car and coming to rest in the barranco &#8211; a weed filled shallow river that runs around the village and only flows when it rains hard.</p>
<p>Dachshund Luke thought we were playing &#8216;find it&#8217; and began searching for the ball. He searched for nearly an hour then started to bark at us &#8211; he wanted his ball back!</p>
<p>We did look in the barranco but the long weeds, and the goat tied up next to it prevented a result. We knew we somehow had to distract Dachshund Luke so that he would stop the hunting and then barking cycle.</p>
<p>No other ball would do. A long walk didn&#8217;t do it.</p>
<p>Then I remembered the giant shirt ball video at <a href="http://kalyxcornucopia.blogspot.com/">http://kalyxcornucopia.blogspot.com/</a> home of a Dachshund called Baxter. I wondered if we too wrapped a ball up in a couple of towels then stuffed it all into a t-shirt (knotted together) would this distract him?</p>
<p>I worked &#8211; he loved the &#8216;giant shirt ball&#8217;, shook it, and dug at it for 40 minutes. Then laid down exhausted and is currently sleeping with Kitty Kat.</p>
