Something game related finally.

So, I’m all okay with game companies. I don’t believe they’re evil corporate jerks who sit in an office made of gold, discussing around a dark table how to best exploit us. They’re businessmen, that’s what they are. So the only real difference is that they have an excuse. But anyway, while suing a game company is okay if the cause is just, it just is too much sometime. Allow me to take a little part out of an article from my favorite online magazine, The Escapist:

Agoraphobic PS3 Owner Sues Sony over PSN Ban

Erik Estavillo is suing Sony over being banned from PlayStation Network, claiming that the company violated his right to free speech and has caused him pain by removing his only form of socialization, as he suffers from agoraphobia.

PlayStation Network is important to Erik Estavillo, so when the San Jose resident was banned for inappropriate behavior in Resistance, he had to do something to get it back: file a lawsuit. Estavillo, then, is suing Sony for repressing his constitutional right to free speech and causing him pain and suffering.

The lawsuit claims that Estavillo was “exercising his First Amendment Right to Freedom of Speech” in the game’s “public forum” (guessing this refers to the official Resistance message board?) when moderators, who the suit alleges are biased, banned him from Resistance and PlayStation Network altogether.

Taking away his right to free speech would be one thing, but in addition to that, the suit claims that the ban “has caused pain and suffering to an already disabled plaintiff.” Estavillo, it seems, suffers from Obsessive-Compulsive Disorder, Panic Disorder, Major Depression and Crohn’s Disease. To ban him from PSN robbed him of one of the few sources of pleasure in his life, as Estavillo is an agoraphobic (he’s afraid of crowds) who “relies on [PSN] to socialize with other people, since it’s the only way the plaintiff can truly socialize,” the suit states.

The suit states that Estavillo has medical documents to prove that he really suffers from all those conditions, and okay, if he’s not lying, that really sucks. But this is just plain ridiculous. Estavillo is asking for $55,000 in punitive damages as well as “pain and suffering damages.”

Okay, it’s cool so far. The guy obviously has issues. But, illness or not, the friendly people at Sony doesn’t like their customers get verbally abused. So something had to be done. Yes, you have issues, but those are the rules. You may not yell at people.

At first, this guy seemed reasonable. But then, this came up:

Agoraphobic PS3 Owner Sues Microsoft, Nintendo

The agoraphobic PS3 owner who sued Sony because he was banned from the PlayStation Network has launched two new lawsuits, this time against Microsoft and Nintendo.

Erik Estavillo sued Sony after being banned from the PlayStation Network earlier this year for “inappropriate behavior” while playing Resistance: Fall of Man, seeking $55,000 in punitive damages and “pain and suffering.” The case was dismissed in October, with Judge Ronald Whyte ruling that PSN couldn’t be held to the same First Amendment standards as a state-owned body and thus hadn’t actually violated his rights. Nonetheless, Estavillo announced later in the month he had appealed the dismissal and also filed a second civil suit against Sony for $180,000 in damages.

Apparently not wanting anyone to feel left out, Estavillo has now filed suits against the other two console manufacturers as well. He’s seeking $75,000 from Microsoft as a result of his console being hit by the Red Ring of Death; he can’t afford to repair or replace the unit because he’s disabled, he said, so he’s seeking compensation for the “undue stress” he’s suffered since the demise of the unit and the “sadness he will have in the meantime of finding one he can afford.”

His lawsuit against Nintendo, meanwhile, centers around the 4.3 update to the Wii firmware, which disabled the Homebrew Channel. Estavillo used the Homebrew Channel to unlock characters in Mario Kart Wii and the only way to unlock them without it is to purchase Super Mario Galaxy, essentially “forcing customers to buy another game to unlock one character in a different game.” Estavillo is seeking $5,000 from Nintendo as well as an injunction against “deleting, blocking or prohibiting the Homebrew Channel and Ocarina applications.”

Estavillo, who said he also suffers from depression, obsessive-compulsive disorder, panic disorder and Crohn’s disease, plans to file similar lawsuits at the state level as well.

Wait, what? Let’s take this piece by piece. First, you sued Microsoft for RROD? They’ve already stated that you can get that, you can’t sue them for something that happens to EVERY console. Besides, you can, you know, fix it or get the Elite version.

Also, he sues Nintendo? For bad firmware update? How about, you know, calling support and waiting until the next update comes? Or are you that obsessed with getting all the Mario Kart characters by the end of the week. Patience, young Padawan.

Also, “plans to file similar lawsuits at the state level as well.” You just shot yourself in the foot, kiddo. You basically revealed that those lawsuits have nothing to do with damages. You’re just an attention whore, and a bad one at that. Or do you think that there is actual money to gain here? But wait, there’s more:

Agoraphobe Sues Activision Over “Hurtful” World of Warcraft

The crazy-ass bastard who sued Sony over a PlayStation Network ban and then launched suits against Microsoft and Nintendo has fired one last litigational salvo: He’s suing Activision Blizzard because World of Warcraft isn’t fun enough.

The story of Erik Estavillo should be familiar to all of us by now: The agoraphobic gamer filed a lawsuit against Sony in July for banning him from the PlayStation Network for “inappropriate behavior” while playing Resistance: Fall of Man and then last week began a pair of sequel lawsuits against Microsoft and Nintendo for the Red Ring of Death and the 4.3 update to the Wii firmware respectively. But that’s not the end of it; today he announced his “final lawsuit,” filed against Activision Blizzard because World of Warcraft isn’t fun enough.

I make that point twice because although it may sound like a joke, it’s not. Estavillo’s complaint essentially breaks down like this: Blizzard charges too much money for World of Warcraft, a problem exacerbated by the fact that the game doesn’t let people move around fast enough until they’ve sunk enough time and money into it to buy a mount or a “teleportation stone.” But mentally ill people who rely on MMOGs as their primary form of entertainment and contact with the outside world have a tendency to die when they’re deprived of them and since Estavillo himself is mentally ill and doesn’t want to end up like all the other dead MMOGers out there, he wants the game “fixed.”

Oh, and he wants a million bucks in punitive damages “for creating a game which hurts gamers rather than being a bridge of entertainment for them to pursue happiness.”

But wait, there’s more! To support his case, Estavillo has subpoenaed both Martin Lee Gore of Depeche Mode and actress Winona Ryder to testify. “[Gore] will be a witness on ‘alienation’ and the ties it has to World of Warcraft, since he himself has been known to be sad, lonely, and alienated as can be seen in the songs he writes,” he explained in an email to The Escapist.

“[Ryder] and I share a common interest in the book Catcher in the Rye, which is all about alienation,” he continued. “She will be a witness that can explain the significance of alienation in Catcher in the Rye (since she bought one of the original printed copies at an auction) and will also testify to how alienation in the book can tie to alienation in real life/video games such as World of Warcraft.”

It’s quite clear at this point that one of two things is happening here: Either Estavillo is a total nutcase – not just agoraphobic, OCD and all the rest, but completely out of his tree – or these lawsuits are a buildup to some sort of unfathomable attention-whoring punchline. It’s a dangerous game; according to Rule 11 of the Federal Rules of Civil Procedure, people who knowingly bring a frivolous lawsuit before the courts can be slapped with some pretty hefty fines.

And yet… Is there a third possibility that we’re overlooking? Could all of this in fact be another stealth ad from the wild and crazy guys at the Dante’s Inferno marketing team? Is it sloth? Will it be greed? Is it possible that this series of insane lawsuits will turn out to be the most insidious advertisement ever? Of course not – although as explanations go, it makes about as much sense as anything else involved in this case. (And if it is, I’m totally buying the game just for the sheer awesomeness of the marketing.)

DAAAAAAHH! *slams head in table* What has this world come to!?

First of all, that’s the reason you’re suing Blizzard? Why not just sue them over Starcraft’s lack of LAN? And while you’re at it, sue Infinity Ward for Modern Warfare 2’s lack of dedicated servers. This has to stop.

If you have such a problem with WoW, why are you playing it? Play something else. I hear that Champions Online and Aion is new. The game isn’t designed for mentally ill attention-whores like you, it’s designed for normal shut-in nerds like other gamers. Why should Blizzard make money that way, it’s called genius game play design. As said, they’re business men, they’re job is to make money. Also, how many of the 11 million players have you seen complain about this? They can’t fix it to fit one out of several million players.

And what!? You’re calling in Martin Gore, the best song-writer in the world? What has he to do with anything? Oh sure, he’s made songs about alienation, but what has that to do with WoW? He hasn’t ever mentioned it. There are other things that can alienate, and many of them far worse than a bad game. Like, I don’t know, having a divorce, having close ones almost die, go through depression. There are far worse things. And you’re calling in Winona Ryder cause she read the same book as you and liked it? Oh my God, there aren’t like millions of people who liked that book! I don’t think the author wrote the book with the intent to be used in a lawsuit against video games. Get a grip! Seriously, do you have some sort of grudge against video games? Then stop playing and do something else if it isn’t good enough. Wouldn’t it just be easier to get your own developer team to make your dream game? Nobody is forcing you to put up with any of the stuff you’re pissed about. You can just as well do something else. Oh wait, no you can’t, cause then you will end up suing that too.

God, now I’m pissed.

Nail biting you got me again! It hurts after you get to where the nail is connected with the rest of the finger, but how else do you grossly and awkwardly halt boredom? I’ve heard of bitter stuff you put on your nails to get you to stop biting them, but that reminds me a little too much of sour apple spray you train a dog with.

I’ve been way too late since whenever I first wrote about my lack of sleep due to not sleeping and then waking up early. Recently, I’ve been trying to put together my ideal soundtrack for what would play during Grizzly Skag Bear.

Here are three songs that would definitely be on the soundtrack:

Say Anything – Woe

Weezer – El Scorcho

A Day To Remember – NJ Legion Iced Tea

Those are some starters. Write you’re own movie if you want to create your own made up soundtrack.

Winona is a ghost town again. Sometimes it’s called “summer”. It’s worse than summer now, though. At least it’s green, warm, and the sun doesn’t go down at 4 in the afternoon. A person just feels limited if they can’t go outside and enjoy the day past 4PM.

This Thanksgiving holiday will be plenty of time to definitely maybe start writing the movie again. It’s priority number 5 behind researching stereotyping in advertising, finishing up my portfolio for advertising, painting some stuff I’m a bit behind on, and creating a webpage for my internet com class.

I’m looking forward to seeing some family members I haven’t seen in a long while. You know, those family members you only see 2-4 times a year. They’re the ones I actually look forward to seeing. I highly doubt the family members I could care less about seeing know how to operate computers.

What’s that? Bloody Mary’s you say? Why yes, I believe I’ll have 3. At twin cities prices though. I just hope we don’t run into that prick of a bartender that looked like a skinnier Jon Gosselin, but was still just as big of a douche bag. If you don’t want a 5% tip or less, then I suggest smiling at the very least, and not looking so deliberately disinterested. And I wonder how those people are hired for jobs before me….? Someone please tell me if my fly is down or if I, for some reason, have a swastika on my cheek next time I go in for an interview, please.

Bram Stoker’s Dracula (1992)
★★★ / ★★★★

Gary Oldman stars as Count Dracula, a man who found his love named Elisabeta (Winona Ryder) died after he arrived from the war. The priests did not want to give Elisabeta a proper burial because she committed suicide. This angered Dracula, denounced God and was cursed to live for eternity lusting for blood. Hundreds of years later, Jonathan Harker (Keanu Reeves) was assigned to help Dracula to buy some property in London unknowing of the vampire’s true intentions. Eventually, Dracula set his sights on Harker’s wife (also played by Ryder) because she looked exactly like his former lover and Dr. Van Helsing (Anthony Hopkins) stepped in to help. I’m not entirely convinced on whether to recommend this picture. While I did find the asthetics magnificent and the execution of the story to be just fine, some crucial elements did not meet my expectations. I thought it sacrificed a lot of the terror for the sake of romance. When I watch a movie about Dracula, I expect to be suspended in suspense instead of watching him yearn over a lover. I thought the best scenes in the film were in the first half. There was something extremely creepy about the whole vibe of the castle when Jonathan visited Dracula in Transylvania. Every shadow and dark corner of the room felt menacing as if something seriously wrong was about to happen. The soundtrack was used sparingly so that the audiences could hear every creak and footstep made in the castle. The second half of the movie felt exactly the opposite. There were overt sexual references, consistent loud noises and the pacing became static. While it still remained elegant, I began to feel more apathetic toward each character when I should have been rooting for them because lives were at stake. Regardless of its flaws, I was still curious on what was going to happen next because Francis Ford Coppola, the director, had interesting techniques when it came to presenting his audiences gothic imagery. Coppola spent too much of his time with the images and asthetics of the picture that he somewhat neglected his characters and where the story was going. I’m not sure how closely this followed Bram Stoker’s original 1897 novel because I haven’t read it. But I must say that it definitely took me back to that time period. So in terms of escapism, I think this movie did a good job. However, when I try to really analyze it piece by piece, I’m not that impressed with it. It’s the strangest feeling.

I like food. I want to make sure I get all my fruits and veggies in a day. But that’s hard on a college budget and schedule. What I do now is have a soy milk smoothie with banana and blueberries in the morning. I think smoothies is one of the best ways to get a wallop of fruits and veggies in one shot.

On my wishlist this week is a real juicer. I want to be able to throw a whole apple or other fruits and veggies. My blender is just not cutting it anymore. Literally.

Fruits and veggies are crucial to being healthy and 2-3 servings a day just isn’t enough. So my advice is buy some frozen fruit, a blender and get creative!

Do you get enough K? Chances are you don’t because college students especially don’t eat enough fruits and veggies. You get potassium from every food group except the the sweets at the tip of the pyramid. But Americans only get about half of our daily values.

Potassium is key to water balance in the body but it’s neat because potassium is shown to lower blood pressure.

Some of your best sources of potassium include:

• bananas

• potatoes

• tomatoes

• most fruit and veggies

• here is an article about sources of K

So grab an extra banana when you’re at the caf and get some K!

It’s possible if you take care of yourself. Managing things like diet, exercise and risky behavior can enhance your quality and QUANTITY of life.

There is a way you can measure this, take the quiz called my RealAge and find out how old your body really is. It takes 10-15 minutes to finish but I feel it does a pretty comprehensive anaysis. After your done taking the quiz it will tell you what your bodies age is, what you’re doing right and what you need to work on. From there it gives you several resources and ideas on how to improve your quality and quantity of life.

After I took the quiz I was surprised to find my RealAge is 14.5!

Los dejo con Primus con el castorzote café de Winona.

Primero el video de estudio

To glique is when you kinda shoot saliva from your tongue. Bet you didn’t know that.

Walked around the lake tonight, it was dark, but a good walk nonetheless.

But yeah, the movie, as with many goals I have tried to set and follow, I get more done if I just don’t do that. It will get done when I decide to finish it.

I try not to let snow ruin my commute to school in the winter via bike. In case you fall into that

I try not to let snow ruin my commute to school in the winter via bike. In case you fall into that category as well, here are some tips and the reason for this weeks wishlist! item.

First of all, once the snow and ice is here, it’s time to put away the road bike, skinny tires and break the cross, mountain or junker bike. I make sure I got some nice knobby tires on and deflate them to about half or 3/4 of what the tire says is the maximum. This will give you a nice cushy ride but also one that really grips into the snow.

Which leads me to ice and my wishlist! item. A set of studded mountain bike tires. I would throw these on in a heartbeat once the snow is packed or their is ice on the roads. Like a car’s tire, you can buy winter tires but they fail once your on ice. But once you buy studded tires (knobby tires with hardened steel cleats) you get little ice picks to prevent slipping as you ride merrily to class during a blizzard. Everyone driving their cars slipping and sliding will be jealous.

Not!

Basically it’s a vitamin. Sure the vitamin is useful and promotes health. But it’s water soluble which means that once you absorb your limit it just leaves your body through urination. Basically you are throwing your money in the toilet. You get essential nutrients through your normal diet and probably don’t have to supplement it with expensive tablets.

Andrew Bird will be coming to St. Marks Cathedral in Minneapolis, MN, Saturday, December 12!

The show will be $29 plus utilities and there is also more expensive tickets for better seats.

Based out of Chicago, Andrew Bird provides some of the best Indie/Folk/Baroque pop music I have heard in my lifetime.

This man is completely individual in his music, and I have never heard anyone else that sounds like him.

He writes all of his own song, sings them, plays many instruments such as; violin, guitar, glockenspiel, and the man can whistle like a champion.

His songs put me into a unique thought process where I get lost in his music. I would recommend this artist to anyone and everyone.

Here’s my favorite song by Mr. Bird-

My time left at Winona is down to about a month left. After four and a half year, I’ll be graduating (most likely) with a degree in advertising and a studio art minor (not recommended). I enjoy creating things like art, and advertising is along the same lines, except it is a written format. Both are creative endeavors depending on how much you put into them. The thing about the advertising part is this semester I’m pretty sure my desire and want to go into that field has disappeared. As the title of this blog states: it’s not the best time for that to be happening.

I’m not quite sure what happened and maybe it is only temporary, but for now, I don’t care to go into it. It could be a moral/ethical dilemma of not wanting to sell certain products to people, but I doubt that. You can buy what you like. If I write something and you gain weight or your health decreases from it, well then you should’ve spent your money on something else.

The point of this GSB entry is throughout the process of writing this movie, I rediscovered, I guess, or altered, what I wanted to do. Maybe it’s taking a less defined step back, but whatever I do I know I want to write. Writing a handful of scripts isn’t a very sound approach to a sustainable career, especially since there are about 60,000 written each year. I do like the creative freedom allowed with writing, so for now, I shall stick with doing that.

As I begin to approach writing Grizzly Skag Bear again, I’ve been paying more attention to how people act in their everyday activities and jobs, etc. I’ve noticed not a whole lot of them smile whether it be the lady you pay off a parking ticket to, Walmart cashiers, Subway workers, and so on. I’ve been paying more attention to this so I can apply what I see to the characters in the movie. It’s like adding quirks and deepening the characters persona. Also, I think it would be awesome to make money off someone that acts like a prick. I’ve always wanted to do that. Do your GD job with a smile. It makes the people your helping or serving think you have less wrong with you than you actually probably do.

The Warrior Women’s basketball team has high expectations after going 2-1 against 3 division 1 opponents in exhibition play. Not only did they beat two division 1 teams, they do so on the road! Beating the University of South Dakota is one thing, but going in to Williams Arena in the twin cities and beating the University of Minnesota is a very impressive feat.

All of this having been said, the NSIC conference is very good one for women’s basketball. This conference is home to the defending division 2 national champion Mankato Mavericks. The Mavericks will be a true test for the Warriors early in the season when they play each other on a neutral location for NSIC hoops fest in Sioux Falls, South Dakota.

Ana Wurtz and Michelle McDonald have been impressive for the Warriors early but really opening eyes have been the freshman for Winona State. Dulas and Barber have been great players off the bench for Winona State in this exhibition season.

Great things are to come for Winona State basketball this year!

Go Warriors!

With Clayton Vette now out until January with an MCL tear, the Warrior Men’s big guys have to

With Clayton Vette now out until January with an MCL tear, the Warrior Men’s big guys have to step up in the paint. Winona State men struggled in the paint last year and the biggest problem was not being able to pull down boards. This is going to be tough to improve on without Vette but it has to be done to compete in maybe the best division 2 conference in the nation.

CJ Erickson will have to step up big with Vette out and I think he is capable of putting up big-time numbers. Erickson has already proved that he is the most versatile player on the team with his quick feet on defense, his long wing-span to block shots, and his determination on offense.

This will also put the focus back on Joel Armstrong, who, as a freshman had a pretty good season. But with high expectations for Vette this year, Armstrong will now have to be a go-to-guy for Winona State in the paint for the first half of the season.

The Warriors tend to rely too much on their 3 point shooting and if they want to win a conference title this year, they will have to shoot the ball better and not live and die by that 3 point shot.

The Warriors play tonight in their last exhibition game against St. Thomas right here in Winona at McCown Gymnasium. Tune in to your official voice for Warrior basketball, 89.5 KQAL at 7 PM for tipoff!

Go Warriors!

The Winona State Warrior football team had a great season. In a very tough NSIC conference the Warriors still managed to make the last week of the season mean something against Duluth because of Winona State’s impressive win in Sioux Falls the week before.

With an incredible nucleus coming back next season, the Warriors should be a contender for a conference title run. The conference will again be very good and Duluth will without question be at the top along with Mankato. But with Dewberry and Simmons coming back, a solid defense, Winona State football should have a great season.

Greg Preston is graduating and he has tough shoes to fill. The front-runner has to be Alex Nelson. When he came into the games in mop-up duty, he did tremendous things. I think Nelson can be a difference maker next year. He may not be as mobile as Preston was, but Nelson surely is an accurate passer.

It was a pleasure covering Winona State football this year. I really enjoyed the opportunity and had fun traveling with the team on the road. The future is bright for Winona State football!

The closest Olive Garden that we have to Winona is in Onalaska, but it is well worth the drive to try out their new special! Olive Garden describes the new dish as “crescent-shaped ravioli filled with four Italian cheeses, tossed with grilled Italian sausage and roma tomatoes in a creamy homemade tomato alfredo sauce, topped with melted mozzarella.” It is delicious! Give it a try
