<title><![CDATA[British Parliamentarians for public inquiry into Dr. Aafia Siddiqui’s conviction--&gt;APP ]]></title>

LONDON, Feb 10 (APP): Describing the conviction of Pakistani neuroscientist Dr.Aafia Siddiqui as “miscarriage of justice”, British Parliamentarians have called for withdrawal of case against her and repatriation to Pakistan. At a function organised at the House of Lords on Tuesday evening to raise support for the incarcerated Dr. Siddiqui, Lord Nazir Ahmed together with other speakers said her trial in New York was full of flaws and not based on facts.</p>
<p>They sought the intervention of the US leadership and demanded a fair trial based on real facts and not assumptions. Lord Ahmed said he would be writing a letter to the US President Barack Obama carrying signatures of other British MPs  calling for Dr.Siddiqui’s repatriation to Pakistan and withdrawal of case.</p>
<p>The Labour Peer further said he would also raise this question in the Parliament to ascertain how the British Government could help in this regard.</p>
<p>According to Lord Nazir, the conviction of Dr.Siddiqui has been received with great dismay in Pakistan which would further fuel anti-American feeling in the south Asian country.</p>
<p>“If US wants to create a good impression of itself in Pakistan, it should release Dr.Siddiqui and send her back to Pakistan,” he asserted.</p>
<p>He said no credible independent evidence was presented at the New York court and in the words of defence lawyers the decision of the jury was based on fear rather than facts.</p>
<p>Lord Altaf Sheikh, MP Muhammad Sarwar,  Muhammad Saghir, a representative of Caged Prisoners which represent the inmates of Guantanamo Bay, Rabia Zia of  UK Chapter of Pakistan Tehreek-e-Insaf, journalist Yvonne Ridley, who witnessed the trial and  Barrister Abid Hussain also spoke on the occasion.</p>
<p>The thrust of their speeches was to mobilise public opinion against Dr.Siddiqui’s conviction and call on Pakistani authorities to demand her repatriation as well making efforts to find the whereabouts of her two missing children.</p>
<p>Sarwar said Pakistani authorities must hold inquiry at their end to know the circumstances of her disappearance from Karachi in 2003 and her appearance in Kabul five years later.</p>
<p>Ridley said it was now up to the people of Pakistan to organise regular rallies in support of Dr.Siddiqui and send strong message of their resentment to the USA on this trial.</p>
<p>Barrister Abid Hussain urged the British Pakistanis to lobby their respective MPs and sign on-line petition in support of the neuroscientist for exerting maximum pressure on the US Government. </p>

<title><![CDATA[This Ambassador Is A Sore In US-Pakistani Relationship]]></title>

<div><span style="color:#000000;">ISLAMABAD, Pakistan—US Ambassador to Pakistan <strong><a href="http://www.state.gov/r/pa/ei/biog/favicon.ico">Ms. Anne W. Patterson</a></strong> is becoming quite controversial. She has overseen the worst spell in the relationship between Washington and Islamabad in sixty years and many say she is responsible for at least some of it. Ties weren’t this bad even when the United States unfairly sanctioned Pakistan in 1990 over its nuclear program.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">Mr. Thomas Houlahan, a Washington DC-based expert on Pakistani military issues, accused her in 2008 of conducting ‘bunker diplomacy’—that is, conducting United States diplomacy with Pakistan from the barricaded and isolated confines of her office inside a heavily fortified embassy building which in turn is located inside the isolated Diplomatic Enclave in an outer tip of Pakistan’s federal capital.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">Her reports back to Washington are misleading, explained Mr. Houlahan, because she doesn’t really know what Pakistanis are thinking.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">For information, Washington’s diplomats in Pakistan have been relying on two things: a pro-US government whose principals owe their power to a deal brokered and guaranteed by the US, and a list of proverbial ‘good guys’ that Ms. Patterson’s Embassy recruited from the media, including retired diplomats, military officers and academia, who could take America’s case to the Pakistani public opinion.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">This strategy backfired. Big time.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">Failing to see that Pakistanis were asking for respect and not confrontation, she shot alarming reports back to Washington warning of an organized campaign in Pakistani media to assail US reputation.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">Getting their cue from Ms. Patterson’s reporting, US government’s spin masters countered by launching an organized campaign within the US media and worldwide, accusing Pakistan of ‘anti-Americanism’.  The accusation was expanded to include harassment of US diplomats and non-issuance of visas to them. Obviously, Ms. Patterson failed to tell people back in Washington that <strong><a href="http://www.ahmedquraishi.com/latest_col.php?id=113">CIA and other intelligence-related personnel where using diplomatic cover under her guidance to spy</a></strong> on Pakistan.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">She also might have overlooked another small detail: the US ambassador in Pakistan is <strong><a href="http://aq-lounge.blogspot.com/2009/12/did-us-ambassador-in-pakistan-bribe.html">a potential suspect in a case of bribing</a></strong> a senior Interior Ministry official in order to get a cache of banned weapons into Pakistan without the knowledge of the country’s intelligence.</span></div>

<div><span style="color:#000000;">The alarm generated by Ms. Patterson and her team led US Secretary of State Hillary Clinton to rush to Pakistan in order to counter the Pakistani media, with carefully-orchestrated interviews and public appearances where Ms. Patterson did her best to keep Mrs. Clinton away from the ‘bad guys’. She ensured that her boss <strong><a href="http://aq-lounge.blogspot.com/2009/11/want-to-meet-hillary-dont-criticize.html">never met those commentators</a></strong> and media people who could provide the harsh, but legitimate, viewpoint.</span></div>

<div><span style="color:#000000;">This misrepresentation on the part of Ms. Patterson led someone no less than US Secretary of Defense Robert Gates to land in Pakistan making a highly inappropriate statement, where he accused legitimate critics of US policy toward Pakistan of orchestrating an &#8216;an organized propaganda campaign&#8217;.  He probably had no idea that legitimate criticism of policy by Pakistanis claiming they want US not to ignore Pakistani interests did not qualify to be described as ‘an organized propaganda campaign’.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">[There are indications that some Pakistanis in Mr. Zardari’s government, and not just Ms. Patterson, helped create this misperception in Washington. Topping the list of Pakistani suspects is Mr. Husain Haqqani, Pakistan’s envoy in Washington, a key aide to Mr. Zardari and recently the wizard behind Mr. Zardari’s media outreach campaign. Mr. Haqqani has been quite active behind the scenes in mounting a counterattack on the critics of Mr. Zardari and the critics of US in Pakistan. Recently, large numbers of Pakistani legislators have publicly accused Mr. Haqqani of misusing his official position to poison American perceptions of Pakistan’s military and intelligence.]</span></div>
<div><span style="color:#000000;">So, in essence, Ms. Patterson squandered two great opportunities – the visits of Mrs. Clinton and Mr. Gates – to address the concerns of the harshest critics in the Pakistani media. Due to Ms. Patterson’s failure, it fell to the Pakistani military to discuss those concerns with counterparts in the US military and use that channel to convey Pakistan’s legitimate concerns about how the US was ignoring Pakistani strategic interests in the region.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">What Ms. Patterson should have helped resolve in the civilian arena was actually tackled, and somewhat resolved, in the military arena. But the damage is done. United States’ combative ambassador in Islamabad has left a permanent scar in the media record of the two countries, with silly accusations of anti-Americanism and harassment of diplomats.</span></div>

<div><span style="color:#000000;">Last year she fired <strong><a href="http://aq-lounge.blogspot.com/2009/09/mazari-vs-patterson-clarifications-by.html">a secret letter to a newspaper</a></strong> to silence Dr. Shireen Mazari, a defense expert and Columbia graduate, leading to a public spat that gave the impression the <strong><a href="http://aq-lounge.blogspot.com/2009/09/us-counteroffensive-in-pakistan.html">US ambassador was out to force newspapers</a></strong></span> to fire critics of US.</div>

<div><span style="color:#000000;">In 2008, Ms. Patterson accused ‘irresponsible elements’ in the Pakistani media of spreading lies about Dr. Aafia Siddiqui being in US custody in Afghanistan.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">Yesterday, the British journalist who uncovered Dr. Siddiqui’s presence inside US-controlled Bagram base <strong><a href="http://www.americanpendulum.com/2010/02/truth-about-u-s-justice-dr-aafia-siddiqui/">wrote a damning piece</a></strong> showing that Ambassador Patterson basically lied to the Pakistani public in her 2008 letter, which she sent to Pakistani newspapers.</span></div>
<div><span style="color:#000000;"><br />
</span></div>
<div><span style="color:#000000;">This is what Ms. Ridley has to say about Ms. Patterson:</span></div>

<blockquote><p><span style="color:#000000;">“Everyone had something to say, everyone that is except the usually verbose US Ambassador Anne Patterson who has spent the last two years briefing against Dr Aafia and her supporters.</span></p>
<p><span style="color:#000000;">This is the same woman who claimed I was a fantasist when I gave a press conference with Tehreek-e-Insaf leader Imran Khan back in July 2008 revealing the plight of a female prisoner in Bagram called the Grey Lady.</span></p>
<p><span style="color:#000000;">She said I was talking nonsense and stated categorically that the prisoner I referred to as “650” did not exist.</span></p>
<p><span style="color:#000000;">By the end of the month she changed her story and said there had been a female prisoner but that she was most definitely not Dr Aafia Siddiqui.</span></p>
<p><span style="color:#000000;">By that time Aafia had been gunned down at virtually point blank range in an Afghan prison cell jammed full of more than a dozen US soldiers, FBI agents and Afghan police.</span></p>
<p><span style="color:#000000;">Her Excellency briefed the media that the prisoner had wrested an M4 gun from one soldier and fired off two rounds and had to be subdued. The fact these bullets failed to hit a single person in the cell and simply disappeared did not resonate with the diplomat.</span></p>
<p><span style="color:#000000;">In a letter dripping in untruths on August 16 2008 she decried the “erroneous and irresponsible media reports regarding the arrest of MsAafia Siddiqui”. She went on to say: “Unfortunately, there are some who have an interest in simply distorting the facts in an effort to manipulate and inflame public opinion. The truth is never served by sensationalism…”</span></p>
<p><span style="color:#000000;">When Jamaat Islami invited me on a national tour of Pakistan to address people about the continued abuse of Dr Aafia and the truth about her incarceration in Bagram, the US Ambassador continued to issue rebuttals.</span></p>
<p><span style="color:#000000;">She assured us all that Dr Aafia was being treated humanely had been given consular access as set out in international law … hmm. Well I have a challenge for Ms Patterson today. I challenge her to repeat every single word she said back then and swear it is the truth, the whole truth and nothing but the truth.</span></p>
<p><span style="color:#000000;">As Dr Aafia Siddiqui’s trial got underway, the US Ambassador and some of her stooges from the intelligence world laid on a lavish party at the US Embassy in Islamabad for some hand-picked journalists where I’ve no doubt in between the dancing, drinks and music they were carefully briefed about the so-called facts of the case.</span></p>
<p><span style="color:#000000;">Interesting that some of the potentially incriminating pictures taken at the private party managed to find the Ambassador was probably hoping to minimize the impact the trial would have on the streets of Pakistan proving that, for the years she has been holed up and barricaded behind concrete bunkers and barbed wire, she has learned nothing about this great country of Pakistan or its people.</span></p>
<p><span style="color:#000000;">One astute Pakistani columnist wrote about her: “The respected lady seems to have forgotten the words of her own country’s 16th president Abraham Lincoln (1809-1865): “You can fool some of the people all of the time, and all of the people some of the time, but you cannot fool all of the people all of the time”.</span></p>
<p><span style="color:#000000;">Well I, and many others across the world like me, can’t handle any more lies. America’s reputation is lying in the lowest gutters in Pakistan at the moment and it can’t sink any lower.</span></p>
<p><span style="color:#000000;">The trust has gone, there is only a burning hatred and resentment towards a superpower which sends unmanned drones into villages to slaughter innocents.</span></p>
<p><span style="color:#000000;">It is fair to say that America’s goodwill and credibility is all but washed up with most honest, decent citizens of Pakistan.</span></p>
<p><span style="color:#000000;">And I think even Her Excellency Anne Patterson recognizes that fact which is why she is now keeping her mouth shut.</span></p>
<p><span style="color:#000000;">If she has any integrity and any self respect left she should stand before the Pakistan people and ask for their forgiveness for the drone murders, the extra judicial killings, the black operations, the kidnapping, torture and rendition of its citizens, the water-boarding, the bribery, the corruption and, not least of all, the injustice handed out to Dr Aafia Siddiqui and her family.</span></p>
<p><span style="color:#000000;">She should then pick up the phone to the US President and tell him to release Aafia and return Pakistan’s most loved, respected and famous daughter and reunite her with the two children who are still missing.”</span></p></blockquote>
<div><span style="color:#000000;">Far from the way Ms. Patterson portrayal of Pakistanis as a bunch of ‘anti-Americanists’, most Pakistanis believe in the goodness of the American people and that <strong><a href="http://aq-lounge.blogspot.com/2010/02/from-us-citizen-on-dr-aafia-siddiqui.html">this American here</a></strong> [click to see the video and report] represents America much better than Ms. Patterson has unsuccessfully been trying so far in Pakistan, with all due respect.</span></div>

<title><![CDATA[India’s water terrorism against Pakistan]]></title>

However, far from this signalling renewed composite dialogue, India wants to talk only on terrorism.</span></p>
<p><span style="color:#000000;">Pakistan should talk on terrorism with India, but put forth its own agenda on this subject, with <strong>water terrorism</strong> as the first item. After all, how else does one describe Indian efforts to deprive Pakistan of its water life line? Not only is it going ahead with Baglihar, it is also actually stealing water through pumps so that Pakistan becomes a desert, and totally dependent on Indian agricultural products. The worst act of state theft and terrorism by India is its stealing of the Chenab waters. It is now in the process of constructing the 646 ft high Swalkot Dam on the river &#8211; a dam far larger than Mangla and Tarbela. This will ensure that Pakistan gets not a drop of the Chenab water which is Pakistan’s right under the Indus Waters Treaty.</span></p>
<p><span style="color:#000000;">It is shameful that the international community has allowed India to renege on its international treaty commitments with impunity. But the most despicable aspect is that the Pakistan government has maintained a strange acceptance of Indian shenanigans on all issues, especially the water issue. President Zardari had declared grandiosely that he would write a letter to Indian Premier Manmohan Singh on the stealing of the Chenab waters by his country. Of course the letter never went and the Pakistani state has merely watched as India has moved to choke off all river waters to Pakistan. Only now the Foreign Office spokesperson hinted that Pakistan may go to the ICJ if India continues to violate the Indus Waters Treaty. But this is merely fooling the Pakistani people since we know the ICJ cannot do anything in the face of Indian defiance.</span></p>
<p><span style="color:#000000;">It is time to deal with the waters issue on a war footing as our survival as a sovereign nation depends on access to the waters life line from Occupied Kashmir.<strong><span style="color:#ff0000;"> For anyone who thinks Kashmir is merely an emotive issue for Pakistan, think again</span></strong>. It is essential to our survival. Already this government has been conceding ground to India in terms of trade and a strange silence over its growing support to militancy and terrorism in Pakistan through Afghanistan. But the water issue is literally a matter of survival for Pakistan and we have to ensure that Sialkot Dam does not get built.</span></p>
<p><span style="color:#000000;">State terrorism by India has to be highlighted by Pakistan and ended. So, if India is not prepared to resume the composite dialogue but only wants to talk on terrorism, this is Pakistan’s opportunity to begin this dialogue with <strong>India’s water terrorism against Pakistan</strong>. After all, depriving a state of its internationally guaranteed waters life line is terrorising a nation into starvation and death.</span> <em>The Nation</em></p>

But this proved to be another shattered dream of people blinded by their faith and hope, which soon turned into disbelief on the system for many.</p>
<p>It is amazing that in the time of elected government with new army chief and intelligence chiefs no actions were taken against those involved in these illegal and inhuman activities during the former dictator’s rule.</p>

A Statement by the Asian Human Rights Commission</p>
<p>PAKISTAN: Zarina Marri has been missing along with 429 persons since December 2005</p>
<p>The Asian Human Rights Commission has received further details in the case of Ms. Zarina Marri, a 23-year-old schoolteacher from Balochistan province, who has been held incommunicado in an army torture cell at Karachi, the capital of Sindh province and used as a sex slave, please see our statement; <a href="http://www.ahrchk.net/statements/mainfile.php/2009statements/1843/">http://www.ahrchk.net/statements/mainfile.php/2009statements/1843/</a></p>
<p>The officials of the education department of Kahan have disclosed that Ms. Marri was a teacher at a government middle school in Kahan, Kohlu district, she was registered as Zarina Bi Bi and she was trained as a Junior Vocational Teacher. She was among those people who were transferred from Kohlu, Kahan, Sibi, Hernai, Much, Kohlo, Dera Bugti, Sabsilla, Bhambhoor, Loti, Dhaman, Pir Koh, Spin, Tangi, Babar Kach, Tandori and Sangan of the Balochistan province during December 2005 and July 2006 when the military government of the then President/General Musharraf was using aerial bombardments to defuse the nationalist movement of Balochistan against the construction of cantonment areas. On 14 December 2005, paramilitary troops accused the people of the area of firing eight rockets at a paramilitary base on the outskirts of the town of Kohlu, a stronghold of the Marri tribe, while President Pervez Musharraf was visiting it. After the visit of President/General Musharraf, within three days of the rocket firing incident, the paramilitary forces began attacking vast areas including the Kahan. It is reported in the media that the military government used the Pakistan air force for bombarding the area. During the fighting between local nationalist militants and the government forces particularly, due to the aerial bombardments, the local population started migrating to other places including to Punjab and Sindh provinces. <p>After some days around 429 persons left the Kahan, district Kohlu, and migrated towards Dera Ghazi Khan district, Punjab province, Zarina Marri and her parents were also among the caravan. Since then there is no trace of the caravan of 429 persons. After some months people tried to search the missing people and some army officers deputed at the Kohlu district told the people of the area that so many persons were killed in the fighting between the government forces and militants and also in aerial bombardments. But after the revelation from Mr. Munir Mengal, managing director of Baloch language television channel, to Reporters without Frontiers (RSF) that Zarina Baloch was in military torture cell at Karachi and was forced in to sexual slavery, the concern of the people of Kohlu, Kahan, and Dera Bugti has risen about the people of the 429 persons which includes more than 70 women, including many young women, who may be used as sex slaves by the Pakistan military.</p>
<p>The government of Pakistan has still not initiated any serious efforts to investigate the case of Ms. Zarina Marri, despite, of continuous demonstrations in several parts of the country including, Islamabad, capital of country for the recovery of Zarina Marri from the military torture cell at Karachi and halting the business of making young Baloch women work as sex slaves by the Pakistan army. The government’s ignorance of the serious crimes by the military officers during Musharraf’s regime is evidence for the people in the country that the present government still does not have the power to investigate the military misdoings.<br />
The case of Miss Zarina Marri has ignited the narrow nationalist and secessionist feelings of the ethnic Baloch nation which can easily turn into a bloody mutiny against the state if the cases of sex slavery by the military torture cells are not investigated. The Asian Human Rights Commission urges the government to initiate a probe for the recovery of 429 people who are missing since December 2005. The government should also bring the persons who made Marina Marri work as a sex slave before the law regardless of how powerful they are or whether they are military persons.</p>

<p>PAKISTAN: The life of a disappeared student leader is in danger</p>
<p>The life of a student leader who was arrested by state intelligence officials is in danger. It is apprehended that he might have been killed. The government of Balochistan says that he was released on January 22, 2010, but his family members have said that he has not yet returned home. They have inquired after him at all local police stations, asking if he was booked under another case, but have not been able to find him.</p>
<p>Mr. Zakir Majeed, a student leader, was allegedly abducted by state intelligence agents on June 8, 2009 from Mastung, near Quetta. Majeed is the senior vice chairperson of the Baloch Student Organization, Azad. His alleged abductors drove up in two cars without number plates and asked the young man a few questions, saying that they were intelligence agents.They took Majeed away with them in their cars without making any charges. One car was a Toyota Vego, the other a Toyota Surf SSR. <p>The UN Working Group on Enforced or Involuntary Disappearances (WGEID) has taken up Mr. Majeed’s case after the submission of the WGEID form by the AHRC. After an intervention was made by the WGEID, the government announced on January 22, 2010 that Mr. Majeed had been released. The Balochistan High Court also ordered that an FIR (First Investigation Report &#8211; a legal document for police investigation) be filed for Mr. Majeed. Until this point, the police refused to register the young man’s disappearance, and a case of habeas corpus was up for regular hearing before the High Court of Balochistan. On January 27, 2010, a police official at Khuzdar Police Station of Balochistan, asked the younger brother of the victim, Mr. Waheed Majeed, to file the FIR before the Mastung Police Station. He did so, but the FIR was not entertained. After an intervention was made by higher-ranked police officers, the FIR was finally lodged. On February 2, 2010 Mr. Aslam Bizenjo, Provincial Minister for Irrigation telephoned Mr. Waheed to inform him that according to the list provided by the NCMC, his brother had been released. The Provincial Minister then asked him to speak with Mr. Akbar Durrani, the Home Secretary of the Balochistan government for further details. The Home Secretary confirmed that Mr. Zakir Majeed had been released on January 22, according to the NCMC list published on its website.</p>
<p>These conflicting pieces of information about Mr. Zakir Majeed’s disappearance have created a great deal of confusion in the minds of Mr. Majeed’s family and the human rights activists who are working for his release. In many past cases, the bodies of the disappeared have been found abandoned on roadsides after courts have ordered for their release, or family members of the disappeared person in question testified in courts that the arrest was done by intelligence agents.</p>
<p>The Asian Human Rights Commission urges the provincial government of Balochistan and federal government of Pakistan to secure the safe release of Mr. Zakir Majeed immediately. Since government officials have already confirmed Mr. Majeed’s safe release, we call upon these officials to be held accountable for these confirmations of safety, and urge these officials to take direct action to reunite Mr. Majeed with his family.</p>
<p>Enforced disappearances of civilians and the perpetual lack of thorough investigation by state officials has become so common that the sanctity and dignity of each human life is being ruthlessly compromised in the name of personal or professional gain. The AHRC calls upon the government of Pakistan to take a strong stand against corruption at all levels of its justice system and take steps towards rebuilding the rule of law in the country.</p>

<p>About 90 minutes ago, YouTube suddenly got blocked in Karachi &#8211; with the message &#8220;This site is restricted&#8221; popping up instead. PTCL expressed ignorance about the ban, whereas representatives of various ISPs&#8217; helplines said that Pakistan Telecommunication Authority had banned YouTube. At around 9:30 PM PST, YouTube came back, but now one cannot access the video of Zardari saying shut up to a crowd that surfaced recently on the website. Since its a Sunday, PTA representatives are unavailable.</p>
<p>This move comes just when one thinks the Government of Pakistan cannot outdo themselves. What&#8217;s next, a ban on free speech?</p>

KARACHI: Pressure is mounting on the Pakistan Cricket Board (PCB) chairman Ijaz Butt to step down in the wake of national team&#8217;s horrendous performance during Australia tour, as now members of the Upper House of Parliament have formed a committee to look into the reasons behind the debacle.<br />
The committee had called a meeting to discuss issues concerning the national cricket team, however, Butt didn&#8217;t turn up.<br />
National Assembly’s Standing Committee on Sports chairman Jamshed Dasti has been vociferously demanding Butt&#8217;s resignation.<br />
Dasti said President Asif Ali Zardari, who is also PCB&#8217;s patron, would be soon informed about the prevailing mismanagement in the board.<br />
Meanwhile, Sports Minister Aijaz Jakhrani has said that he has discussed all the issues with the President, and a final decision will be taken by him in this regard soon.<br />
&#8220;I have already taken up the matter with the President during my meeting and hopefully something positive would come up in a few days times. It is entirely up to the President to decide on the issue and I cannot give any deadline for changes,&#8221; Jakhrani said.</p>

KARACHI: Muhammad Ali Shah, Sports Minister Sindh, has urged Pakistani President Asif Ali Zardari to award Pride of Performance to two of the Pakistan Boxing Federation’s (PBF) top men.<br />
According to sources, Sindh Sports Minister has recommended that President PBF, Doda Khan Bhutto and Secretary PBF, Akram Khan should be awarded the Pride of Performance accolade for organising an international tournament in style.<br />
PBF had successfully organised the Shaheed Benazir Bhutto International Boxing Tournament in January 2010 in which teams from 23 countries participated with China winning the trophy.</p>

Today&#8217;s headlines as I’m expecting it&#8217;d be: President sympathizes for Dr. Aafia Siddiqui and pledged to pursue the case in US High Courts. PM slams the decision and promised to talk to US Government. Nawaz Sharif denounced the court decision. Altaf Hussain, on his telephonic address, expresses his strong concern against the court decision on Dr. Aafia. Siddiqui. Pakistani people are infuriated on the court&#8217;s decision. United we rant!</p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
I&#8217;ve been following the case of Dr. Aafia Siddiqui quite meticulously since the case was put on hearing in the court on 19th January, 2010. I&#8217;ve been seeing the action and reaction of the Ghairat Brigade since the time the newses of &#8216;Prisoner 650&#8242; was published in Pakistani newspaper and jolted the Ghairat Brigade from its roots. Well, not all were jolted; some a la mode liberals, yes the liberals, didn&#8217;t feel like paying heed to the issue as for them it was just about an individual, which is inconspicuous when it comes to the nation of 170 million people already stuck in other problems &#8212; the big problems more important than Dr. Aafia Siddiqui, as they say. Some were found justifying her abduction by our beloved dear me dear intelligence agencies and army. A horde of them &#8212; who&#8217;re the supporter of enlightened moderation introduced by the zilch-venerated former president General Pervez Musharraf &#8212; are agilely found justifying such villainous foolish action. </p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
When the prosecution started, it was testified that there were no fingerprints of Dr. Aafia on the M4 rifle, as accused by the government of US that she attempted to murder and FBI official while she was captivated in Afghanistan; there were no M-4 bullets, no bullet debris from the M-4 rifle and no bullet holes from the rifle in the room. She was the one who was shot by FBI officer thrice in the abdomen. And due to the urgent medic availability, she survived. She had 3 kids, all were just too young. Only one is recovered. The rest two are still not recovered from the FBI yet after 7 longs years. God knows where they kept her both kids, God knows if they&#8217;re even alive or they&#8217;ve killed them. Isn&#8217;t it cruel? If you belong to a race of man, it&#8217;s my understanding that you&#8217;ll be condemning such acts of atrocities and injustice by the US courts.</p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
Even the lawyer of Dr. Aafia put forward ahead of the judge during the closing arguments that believing on the accusations of government and FBI agent would simply mean that you&#8217;re also denying the simple laws of science.</p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
This constitutes that a poltergeist removed the fingerprints of Dr. Aafia Siddiqui from M4 rifle (which was held by FBI guy as per him), a poltergeist renovated the walls of the room where she was kept, and that poltergeist also removed the debris of the bullet. This is so amazing, no?</p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
This is just not enough. During the hearing, at one occasion Dr. Aafia started to get hyper and wept. Judge Berman removed her from the court room. At another occasion, Judge Berman called a US serviceman to give a testimony. The serviceman started giving the testimony: “Three of my men were killed, along with one Afghan”. The soldier began crying, and judge Berman reached over and handed him a tissue. Where exactly can you smell the discrimination? The trial wasn&#8217;t fair as the events went. Judge had sympathies with the US serviceman, but not with the Pakistani national. Do you still receive the situation of injustice willingly or you have an urge to deny it?</p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
Had she been acquitted today, I&#8217;m ready to wager that all the leaders of ethnic and national political parties of our country would have been congratulating her, simultaneously asserting that their efforts to retrieve Dr. Aafia have become successful. From the other point of view, we all know that how much our political parties have employed efforts to retrieve her. Every major political party has been busy in power ploys &#8212; holding out massive rallies on  youm-e-tasees, lawyers movement, playing Sindh card to protect their government; briefly, ranting with a big-league along with awaam &#8212; ranting unitedly. But none of the political party ever tried to bring its loyalists on road for a demonstration against the illegal detention and prosecution of Dr. Aafia Siddiqui in US courts. She should have been prosecuted in Pakistani court in accordance with the constitution of Pakistan. But who cares. United we rant &#8212; at all the events and instances that favors us to bring us to power. I’m sick of all such opportunist political parties. </p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
Pakistani Government should immediately reject the verdict squarely which is given by US kangaroo courts. Pakistani government should immediately demand Dr. Aafia back from US. She&#8217;s a Pakistani citizen and should be prosecuted in Pakistani courts &#8212; if she&#8217;s guilty. We, Pakistanis, don&#8217;t accept the verdict by US courts; besides, it&#8217;s against our constitution that pledges to provide security to Pakistan citizen.</p>
<p style="line-height:200%;" align="justify"><font face="Times New Roman" size="3"><br />
This is such a disgraceful event for our nation. I&#8217;ve void of words to write more on this unjust. Somehow or other, I&#8217;ve managed to understand that we&#8217;re, at the most, hellishly proud united Pakistanis &#8212; united when we all rant at such events but do nothing fundamentally!</p>

An author who writes extensively on global politics, he is widely regarded as a leading authority on the Middle East and international affairs.</strong></p>

<p>Bishara writes today in Al Jazerra the following story.  He points out the sub-plots, the cold wars going on right now in Iraq, Afghanistan and Pakistan.  The US Military is in the middle of this mess.  Bishara says &#34;If the US withdraws in any meaningful way in the next couple of years with clear victory against the Taliban/al-Qaeda, as President Barack Obama suggested when he supported the surge, the Karzai government would fall in no time.&#34;  An interesting concept:  The US &#34;Wins&#34; and Karazi Government becomes the Taliban government?.  Read this very important story about Saudi Arabia, Iran, India, Pakistan, Afghanistan dance that is going on.  <strong>Action Items To Do Follow This Story</strong>: </p>
<ol>
Despite the US military &#8217;surge&#8217;, Afghanistan is proving more challenging than Iraq.</p>
<p>Unlike the general Iraqi distaste and hostility for al-Qaeda&#8217;s methods and objectives, Osama bin Laden&#8217;s network remains the Taliban&#8217;s most potent strategic partner in its fight against the central government and its US patron.</p>
<p>Al Jazeera has learnt that in the last several months, al-Qaeda has spearheaded certain Taliban offensives and tried to bridge and coordinate between the various Talibans, notably the Afghan and Pakistani groups. It has been mission impossible for the US thus far to sift the Taliban into so-called moderate vs radicals and hardcore vs pragmatists silos. Separating the Taliban from al-Qaeda has also failed.</p>
<p>In the process, the Taliban have reportedly opened new fronts in the northern regions after they consolidated their grip on the southern and eastern regions. They introduce their version of security and justice to these regions, like a parallel government. The US and the international coalition&#8217;s frustration with the Afghan army and its incapacity to counter the insurgency&#8217;s offensive, sooner rather than later, could force the US to rethink any illusions of victory.</p>
<p>If the US withdraws in any meaningful way in the next couple of years with clear victory against the Taliban/al-Qaeda, as President Barack Obama suggested when he supported the surge, the Karzai government would fall in no time. Perception of US failure and Taliban success would have a far-reaching psychological and political impact on opposition and notably Islamist movements in the region with strategic ramifications for US interests and its role in the Greater Middle East.</p>
<p>Strategy trumps all</p>
<p>All of which explains why the London meeting on Afghanistan has turned its eyes to finding alternative strategies to the military escalation and put emphasis on regional solutions. Notably, Washington and London are eager that Pakistan and more directly Saudi Arabia play a more prominent role in reaching political accommodation in the country between the Karzai government and the Taliban.</p>
<p>For Riyadh, Afghanistan is part of its open cold war with Tehran over influence in the Islamic world, whether on behalf of Washington or its own camp in the region.  As in Yemen, Iraq, Palestine or Lebanon, Saudi Arabia is keen to project influence where it has assets and that includes Afghanistan and the Wahabi-influenced Taliban.<br />
Considering Saudi Arabia has taken the US side in Afghanistan, its past support of the Taliban stemming from their religious commonality suggests that Riyadh still has leverage.</p>
<p>Options</p>
<p>Strategically, the US-sponsored Saudi-Pakistani influence seems the best way to contain Iranian/al-Qaeda influence. Tehran considers Afghanistan to be part of its area of influence and would not hesitate to confront the US and its allies there if Washington where to threaten it or isolate it further.</p>
<p>For Pakistan, Afghanistan has emerged as a central front of its cold war with India. Islamabad is bothered by the US-India rapprochement and the way in which Washington&#8217;s strategy in Afghanistan ended up exporting the Taliban/al-Qaeda challenge to its territory in very violent ways. This means Pakistan has two options: Export the Taliban/al-Qaeda challenge back to Afghanistan &#8211; and its intelligence services reportedly have sufficient leverage to do it.  Or, insist on being centre stage to any future arrangements in Afghanistan. It will not tolerate being a spectator.</p>
<p>It is not clear in the final analysis whether the Saudi-Pakistani role under US patronage would aim to reach &#8216;functional&#8217; or &#8216;territorial&#8217; division between the Karzai government and theTaliban. The first entails ambitious reconciliation, even if limited to the so-called moderate Taliban, which aims to bring them into the governing fold. And the second would lead to de facto, pragmatic albeit transitional division of the country into Karzai and Taliban (14?) controlled regions.</p>
<p>Two challenges</p>
<p>Any accommodation with the Taliban &#8211; as partners not deserters &#8211; will revolve around two important issues, al-Qaeda and Taliban Wahabism. With no global ambition, the Taliban&#8217;s main objective is to rule Afghanistan according to its version of the Islamic Sharia. Despite their serious &#8216;moral&#8217; and strategic commitment to al-Qaeda, bin Laden still comes second. For the US and its coalition partners, the main objective is al-Qaeda&#8217;s isolation and defeat. Social norms in Afghanistan, even if they are committed to change them, remain secondary.</p>
<p>Do not be surprised if there are compromises on secondary issues, allowing the Taliban to impose its rule and the US to declare victory against al-Qaeda.<br />
Either way, all of the regional and international powers are dancing to the tunes of the Taliban. Not exactly the victory gig they had envisaged.</ol>

<p>Cambodia – In late December 1970, Congress passes the Supplemental Foreign Assistance Appropriations Act prohibiting the use of funds to finance the introduction of United States ground combat troops into Cambodia or to provide U.S. advisors to or for Cambodian military forces in Cambodia. </p>
<p>Vietnam – In late June 1973, Congress passes the second Supplemental Appropriations Act for FY1973. This legislation contains language cutting off funds for combat activities in Vietnam after August 15, 1973. </p>
<p>Somalia – In November 1993, the Department of Defense Appropriations Act includes a provision that prohibits funding after March 31, 1994 for military operations in Somalia, except for a limited number of military personnel to protect American diplomatic personnel and American citizens, unless further authorized by Congress. </p>

<p>Cambodia – In late December 1970, Congress passes the Supplemental Foreign Assistance Appropriations Act prohibiting the use of funds to finance the introduction of United States ground combat troops into Cambodia or to provide U.S. advisors to or for Cambodian military forces in Cambodia. </p>
<p>Vietnam – In late June 1973, Congress passes the second Supplemental Appropriations Act for FY1973. This legislation contains language cutting off funds for combat activities in Vietnam after August 15, 1973. </p>
<p>Somalia – In November 1993, the Department of Defense Appropriations Act includes a provision that prohibits funding after March 31, 1994 for military operations in Somalia, except for a limited number of military personnel to protect American diplomatic personnel and American citizens, unless further authorized by Congress. </p>

<p style="text-align:left;"><span style="color:#000000;">&#8220;Islamabad has established an extraordinarily welcoming investment environment that financiers will find hard to resist. The government’s Corporate Agriculture Farming (CAF) policy — spelled out on the Board of Investment’s website — effectively legalises foreign land acquisitions. It permits state land to be purchased outright or leased for 50 years, and allows investors to determine the size of their acquisitions (with no upper ceiling). These features apply to a broad range of agriculture from crops, fruits and vegetables to forestry and livestock farming.&#8221;</span></p>
<p><span style="color:#ff0000;">What a brilliant idea! Sell the most fertile parcels of state land to the oil saturated Arabs [the Saudis, the Emiratis and the assorted dung heads of Arabia] pocket your commission and live happily ever after in the Disney world of Dubai and the fleshpots of London&#8217;s Edgeware Road/Park Lane. As to the landless, sweating masses &#8211; turn them into Talibans, a la Swat style and get the Americans to keep them in their place by &#8216;droning&#8217; them.</span></p>

<p style="text-align:left;"><span style="color:#000000;">For those of us who had thought that the scheme of leasing out a million acres of agricultural land to foreign investors had been shelved by the government, the statement of Foreign Minister Shah Mahmood Qureshi last week served as a rude awakening. Shamelessly reaffirming his government’s commitment to go ahead with the sinister plan, he gave odd justifications for going ahead with it. He was in Dubai for a meeting of Frie-nds of Pakistan who are supposed to help us in this time of need. The Arab countries that have expressed interest in this unethical land grab, obviously have a poor sense of friendship. The message they, as well as the other so-called friends, are sending out is that when a friend is in need, exploit the friend and get a good price for his family silver.</span></p>
<p style="text-align:left;"><span style="color:#000000;"><br />
One has yet to see anything worthwhile coming out of this motley group of countries that have created yet another club for the avowed purpose of helping out Pakistan in consideration of the price it has paid for fighting terrorism and to strengthen the now not-so-new democracy. Going by the Foreign Minister’s recent statement, it seems that the club serves the interests of the generous prosperous friends more than those of the one going around the globe with a begging bowl. Knowing the desperation of the beggar friend whose functionaries do not miss an occasion to register their economic helplessness and to plead with servile eyes and tones for some charity, these so-called affluent friends seem to be finding good bargains for whatever is to be grabbed in the state of Pakistan. All in the name of friendship of course.</span></p>
<p><span style="color:#000000;">It is surprising that after the treatment meted out to us by our best friend and ally, we still have a stomach for these so-called friendships, and as if one were not enough, we are willing to follow the tunes of this assortment of pied<br />
pipers. </span></p>
<p style="text-align:left;"><span style="color:#000000;"><br />
The government, instead of relying on such fickle friends, should be focusing on the wealth of resources at its disposal waiting to be managed properly.<br />
After all, that is what it is there for. Or does the democratic government<br />
believe that its sole purpose is to stay afloat in the short term, even if it means auctioning the country’s vital resources in a grand loot sale? Certainly, something better is expected of a democratic government.</span></p>
<p><span style="color:#000000;">In a ridiculous attempt at justifying the scheme, the Foreign Minister has now informed us that the land that the government intends to lease out is not owned by anyone. By that he means that the land is not owned by any private<br />
individual. But does that mean that these precious acres are lawaris? Does he not know that land not owned by any private individual is owned by the state of Pakistan and is therefore collectively owned by the people of Pakistan?<br />
Does he not know that the government is entrusted with looking after this land and not to sell it off to greedy friends mouthing sincerity? Does the government have no obligation to find ways of util-ising the invaluable resource for the betterment of the people it claims to represent?</span></p>
<p><span style="color:#000000;">To further expose his poverty of vision, the Foreign Minister said that the land to be leased out is not under cultivation and therefore we should not object to handing it over to the foreign investors who will pump in the<br />
resources to cultivate it. Is it the best our democratic government has to offer us? If investors from distant lands with no tradition of agriculture can come and cultivate it, it should not be difficult for Pakistanis to do it, what with an agricultural heritage and knowledge going back to pre-historic times. Instead of wasting government funds on retrogressive schemes like the Benazir Income Support Programme that make beggars of able-bodied citizens rather than helping them stand on their feet, couldn’t the government spend them on helping landless farmers cultivate the land that it wants to throw away to foreign investors?</span></p>
<p><span style="color:#000000;">It is very unfortunate indeed that the government would insist on pushing such a hare-brained and patently nefarious scheme down our throats at the insistence of its dubious friends. But then, it is not just one nut in the<br />
machine that the government is mowing down Pakistan and its citizens with. Whether it is for loans taken from the foul international financial institutions or for aid that it hopes to get from its best friend under the Kerry-Lugar Act,<br />
or for crumbs it hopes to collect from the so-called Friends of Pakistan, the government is willing to compromise the well-being of the people in whose name it governs the country.</span></p>
<p><span style="color:#000000;">To be fair, the present government is only partially responsible for this state of affairs. In recent times, all successive governments have followed the same path. Whether it was the ‘Islamic’ dictatorship of Ziaul Haq or the quasi-democratic governments of Benazir Bhutto and Nawaz Sharif that followed, or the moderate-dictatorship of Musharraf or the Q-government that he gave birth to, those at the helm of affairs have shown a similar poverty of<br />
vision when it comes to managing the country’s economy and the abundant resources at their disposal. They come with new mantras and programmes, but beneath the shallow surface, nothing changes on this count. Those in charge of the future of the Paki-stani people have shown a propensity to become willing partners in their exploitation at the hands of investors, states and multilateral financial institutions. Together, this evil partnership has made a rich land poor, turning its gold to dust.</span></p>
<p><span style="color:#000000;">Granted that the present government has inherited much of this legacy from its predecessors, there is still no excuse for continuing with it, especially when the cost has become too high for the people of Pakistan to bear. More<br />
than millions and billions of dollars that the government is breathlessly running after, what is actually required is a political vision that appreciates the true worth of this land and its people.</span></p>

<h2><span style="color:#000000;">Going gaga over grain</span></h2>

Last May, while Pakistan’s military was waging its offensive in Swat, Islamabad officials were simultaneously launching another offensive in the Gulf: a charm offensive to secure investment in Pakistani farmland.</span></p>
<p><span style="color:#000000;">Appearing at ‘farmland road shows’ across the region, the investment ministry representatives depicted Pakistan’s soil as the perfect solution to the Gulf nations’ food insecurity.</span></p>
<p><span style="color:#000000;">Such efforts have paid off for Islamabad (and according to media reports, more shows have been staged in recent days). Pakistan’s farmland is an increasingly popular target for wealthy, food-importing nations who, because of the volatility of world food markets, are taking food security matters into their own hands. These states (and also private investors) aim to buy or lease farmland overseas, grow their own crops and export them back home.</span></p>
<p><span style="color:#000000;">Given their lack of transparency, the details surrounding these investments are sketchy and the facts elusive. In Pakistan, uncertainty reigns over the exact amount of land made available to investors, the quantum of land sold or leased so far, and who is in fact doing the investing.</span></p>
<p><span style="color:#000000;">Still, even without these details, there is strong evidence to suggest that the race for Pakistan’s farmland — if not halted prematurely by farmers’ opposition or investor change-of-hearts — could trigger droves of land deals, acute resource shortages and even political strife.</span></p>
<p><span style="color:#000000;">Islamabad has established an extraordinarily welcoming investment environment that financiers will find hard to resist. <p><span style="color:#000000;">Land investors flock to countries with strong legal protections. Cambodia’s government has reportedly established a national land concession authorising public land to be allocated to foreigners — and the country is now experiencing what the BBC describes as an &#8216;epidemic of land-grabbing&#8217;. Conversely, in India, foreign companies are banned from owning farmland — and considerably fewer investors have come calling.</span></p>
<p><span style="color:#000000;">Pakistan, like Cambodia, provides the legal cover farmland investors look for. However, the CAF goes beyond legal protections. It also offers generous financial incentives such as 100 per cent foreign equity; exemptions on land transfer duties; and customs-duty-free, sales-tax-free agricultural machinery imports.</span></p>
<p><span style="color:#000000;">Legal protection and financial incentives — what more could a foreign land investor in Pakistan want? Security, of course, and Islamabad purports to have this covered as well, through the formation of a 100,000-strong security unit. Pakistan’s government is so serious about concluding land deals that it has offered to deploy a force almost a fifth the size of the army to protect investors’ new holdings.</span></p>
<p><span style="color:#000000;">A rash of foreign land acquisitions in Pakistan would deepen the country’s resource crisis. Pakistan already suffers widespread water shortages, and could be water-scarce by 2020. However, supplies could dry up much sooner if enormous quantities of water are siphoned off to support large-scale, water-intensive agricultural production schemes.</span></p>
<p><span style="color:#000000;">To understand the scale of Pakistan’s water shortages, take a look at Aquastat, the FAO’s water statistics database. Of all the nations most often associated with relinquishing farmland, only one — Kenya — has less water availability per capita than Pakistan’s 1400 cubic metres. In fact, of the nearly 200 countries listed in the database, only 35 have less water than Pakistan — many of them the parched countries of the Gulf that are seeking the water-laden farmland they lack at home.</span></p>
<p><span style="color:#000000;">Indeed, quests for overseas farmland are water hunts as much as they are land hunts. Yet investors are seemingly so seduced by Islamabad’s legal and financial inducements that they disregard the fact that Pakistan’s water supply can barely sustain its own farming, much less that of immense foreign agribusiness projects.</span></p>
<p><span style="color:#000000;">Pakistan’s water and energy shortages could also limit the possible benefits accruing from the deals, including better technology, more employment and higher crop yields. With limited energy to operate upgraded farm machinery, and limited water to irrigate cropland, farming job prospects could suffer and talk of increased yields could become irrelevant.</span></p>
<p><span style="color:#000000;">Land deals could mean not just compromised small-holder livelihoods but also widespread displacement. Not surprisingly, critics argue that big land acquisitions could spark violent responses and mass political unrest. Such predictions may be premature — other than in Madagascar, opposition has been relatively localised — but they are not far-fetched in Pakistan.</span></p>
<p><span style="color:#000000;">Here’s why. According to the World Food Programme, 77 million Pakistanis are already food-insecure, and many of them live in the country’s most volatile areas. Foreign land holdings could cause a flare-up of this food vulnerability powder keg at the worst possible time. During the height of last year’s global food crisis, Pakistan imposed export bans to keep domestic food prices down.</span></p>
<p><span style="color:#000000;">According to a report by the International Institute for Sustainable Development, the UAE — which hopes to grow rice and wheat in Pakistan — then requested blanket exemptions from these bans.</span></p>
<p><span style="color:#000000;">Islamabad eventually relaxed export restrictions on Basmati rice. So a politically explosive scenario — such as the UAE trucking rice out of a drought-stricken or war-ravaged Pakistan and exporting it back to the Gulf while hungry locals look on — is not at all unrealistic. Throw that investment-protecting security force into the mix, and things could get really ugly.</span></p>
<p><span style="color:#000000;">Furthermore, there are long-standing rifts between Pakistan’s rural poor and its wealthy, landholding elite. Scores of huge land acquisitions — particularly if they displace poor labourers — would exacerbate these class-based cleavages.</span></p>
<p><span style="color:#000000;">Ominously, the Taliban’s actions in Swat reveal a new ability to exploit class divisions by pitting landless farmers against their landlords. Militants may well use farmland acquisitions as a pretext for fomenting a fresh class revolt in Punjab, the fertile, populous province coveted by the Taliban and reportedly ground zero for the farms race in Pakistan. Such a thought is enough to make one wonder if those farmland road shows are really worth the effort.</span></p></blockquote>

<title><![CDATA[Aafia turns out to be a credible witness--&gt;DAWN ]]></title>

<p><em>NEW YORK: Pakistani neuroscientist Aafia Siddiqui took the stand on Thursday afternoon to testify in a court where she is facing the charge of trying to kill American servicemen while in custody at Ghazni (Afghanistan).</em></p>
<p>While denying the attempted murder charge, Dr Aafia told the court that she was concerned she was going to be transferred to a ‘secret’ prison by the Americans and was trying to slip out of the room when she was shot.</p>
<p>“I’m telling you what I know,” she said in response to a question by Assistant US Attorney Jenna M. Dabbs.</p>
<p>“I walked towards the curtain. I was shot and I was shot again. I fainted.” Much to the surprise of her defence team, Dr Aafia turned to be a ‘credible witness’.</p>
<p>She was allowed to take the stand after Judge Richard Berman issued her caveats making her aware of the pitfalls and the dangers of such a move. Her defence team was literally scared that she could turn out to be her own worst enemy given her past record of outbursts.</p>
<p>She had been thrown out of the court several times after being admonished by the judge not to speak out of turn.</p>
<p>But on Thursday she surprised them all and remained calm and composed.Dr Aafia again denied picking up an M4 rifle and taking a shot at American soldiers and instead maintained that she was scared and wanted to run away as she heard conversations from behind the curtain during her incarceration at Ghazni.</p>
<p>She said as she peeked out of the curtain she was shot and injured. She also accused the FBI agents who questioned her time and again of threatening to hurt her children in order to scare her.</p>
<p>At one point she became so chatty that she was asked by the judge to just answer the question instead of elaborating them.</p>
<p>She also denied prosectuion’s claim that she was trained in rifle shooting, saying: “I took physical training but not to shoot a rifle.”</p>
<p>She said she was shot two or three times by one person in the room and then shot by someone else. She also said she did not believe any US soldier in the room would be irresponsible enough to leave his weapon lying around.</p>
<p>A group of FBI agents and US soldiers had travelled to Ghazni to interview Dr Aafia after she was allegedly found with materials that included hand-written notes referring to a “mass casualty attack” in the US and listed several landmark locations, including the Empire State Building and the Brooklyn Bridge, prosecutors have said.</p>

<p><em>Musharraf was denied immunity in CJP restoration case</em></p>

<p>ISLAMABAD: The critical issue whether the president enjoys immunity under Article 248 of the Constitution was categorically and specifically decided by the Supreme Court and it was denied to former president Pervez Musharraf in the case of restoration of the then-deposed chief justice Iftikhar Mohammad Chaudhry.</p>
<p>While the short order in the case given on July 20, 2007, by a 13-member bench, headed by Justice Khalilur Rehman Ramday, restored the chief justice, in its detailed judgment of the same case, given just 35 days ago, no room for any ambiguity has been left.</p>
<p>The detailed judgment, which did not receive much legal or media attention, addressed the issue, which Prime Minister Yousuf Raza Gilani has now referred back to the Supreme Court in his speeches in the National Assembly, and gave reasons and past references to deny immunity to a sitting president, even in criminal cases as provided for in Article 248 of the Constitution.</p>
<p>The detailed judgment issued on Dec 24 clearly states: “&#8230;allegations of mala fide had been levelled against the person of the president by no less a person than the chief justice, no exception could be taken to implead the president as a respondent&#8230;”</p>
<p>Responding to objections raised in 2007 by the then-government (of Gen Musharraf), over impleading the then-president, the detailed judgment also refers to several previous judgments on this specific issue of Article 248 and cites examples where such immunities were not accepted.</p>
<p>The Ramday judgment refers to mala fide actions of Gen Musharraf and ruled in Para 107: “As would appear from the averments made in this petition, some of which have even been noticed in the earlier part of this judgment, the mainstay of the case of the petitioner, the chief justice of Pakistan, is that the entire exercise in question had been commenced for collateral purposes and suffered from mala fides which was sought to be established, inter alia, through the chief justice of Pakistan being summoned by the president to the Army House/President’s Camp Office; detention of the chief justice at the said office for about five hours; attempts made to secure the resignation of the chief justice under duress and through coercion; the alleged illegal detention of the wife and the children of the chief justice in their house and the alleged unconstitutional removal of the chief justice from his office and appointment of acting chief justice of Pakistan. Since such serious allegations of mala fide had been levelled against the person of the president by no less a person than the chief justice of Pakistan, no exception could be taken to implead the president as a respondent in this petition, which was in fact imperative in view of the above-mentioned precedent cases.”</p>
<p>Interestingly, this judgment says the president can be impleaded for his actions of illegal detention of the chief justice, his wife and children, etc. All these actions are of criminal nature, which a sitting president ordered, but the Supreme Court did not give him immunity under Article 248(2), which says no criminal proceedings can be initiated or continued against a sitting president. The Constitution does not give immunity to president or any other public office holder in civil matters.</p>
<p>Referring to the objection raised that Gen Pervez Musharraf, the president of Pakistan, had been impleaded in the said petition as one of the respondents, which was seen by the then government as against the provisions of Article 248(1) of the Constitution, the judgment reproduced the said Article, which reads as: “The president, a governor, the prime minister, a federal minister, a minister of state, the chief minister and a provincial minister shall not be answerable to any court for the exercise of powers and performance of functions of their respective offices or for any act done or purported to be done in the exercise of those powers and performance of those functions: Provided that nothing in this clause shall be construed as restricting the right of any person to bring appropriate proceedings against the Federation or a province.”</p>
<p>Many past judgments were also quoted by the Ramday judgment of Dec 24, 2009. It said that such an immunity clause had been examined by the Privy Council in HB Gills case (AIR 1948 Privy Council 148) and the reaction of the Privy Council to such-like protective provisions was as under: “Their Lordships, while admitting the cogency of the argument that in the circumstances prevailing in India a large measure of protection from harassing proceedings may be necessary for public officials cannot accede to the view that the relevant words have the scope that has in some cases been given to them. A public servant can only be said to act or to purport to act in the discharge of his official duty, if his act is such as to lie within the scope of his official duty. Thus, a judge neither acts nor purports to act as a judge in receiving a bribe, though the judgment which he delivers may be such an act: nor does a government medical officer acts or purport to act as a public servant in picking the pocket of a patient whom he is examining, though the examination itself may be such an act. The test may well be whether the public servant, if challenged, can reasonably claim that, what he does, he does in virtue of his office.”</p>
<p>The judgment added: “In our jurisdiction the pleaded Article 248 came up for interpretation in Chaudhry Zahur Elahi’s case (PLD 1975 SC 383). The scope and the operational area of the said provision was so stated by this court: “&#8230;the immunity provisions must, in accordance with the accepted principles of interpretation, be construed strictly and unless persons claiming the immunity come strictly within the terms of the provisions granting the immunity, the immunity cannot be extended. The immunity is in the nature of an exception to the general rule that no one is above the law.”</p>
<p>The matter was further explained in these words: “Hence, since neither the Constitution nor any law can possibly authorise him to commit a criminal act or do anything which is contrary to law, the immunity cannot extend to illegal or un-constitutional acts.”</p>
<p>This court, the judgment said, when confronted again with the protection provisions of Article 248 in Amanullah Khan’s Case (PLD 1990 SC 1092) reiterated that the said provisions were required to be strictly construed and added in para 56 that: “If mala fide of fact was pleaded by a party then it had to decide for itself whether on the material with it, the minister has to be impleaded in spite of the protecting provisions of the Constitution; because if his act does not fall within the purview of the provision so interpreted, then he can be impleaded as a party and all objections to such impleadment dealt with in the proceedings. In the absence of the party, no finding with regard to mala fide of fact (as distinguished from mala fide of law) can be recorded, should be recorded and should have been recorded. Recourse to the principles of natural justice to overcome the prohibition contained in Article 248 of the Constitution is not permissible.”</p>
<p>“It was further declared: “Protection under Article 248 of the Constitution is not available to the designated functionaries if their actions suffer from mala fide of fact where the allegation against the protected functionaries is one of mala fide of fact, they have to be personally impleaded as a party to the proceedings;”</p>
<p>“The views of Nasim Hassan Shah J in the same case are also enlightening for the resolution of the issue in question. His views were: “Now the immunity to a minister extends only to the exercise of powers and performance of functions of his office or for any act done or purported to be done in the exercise of those powers and performance of those functions. A minister can be said to be acting in exercise of the powers and functions of his office, if his acts are such which not only lie within the scope of the powers and functions conferred on him by law but are performed bona fide and for carrying into effect the intention and purposes of the statute under which, he is acting. If on the other hand his acts are performed with mala fide intent or for a colourable purpose, such acts will not be deemed to have been performed in the lawful exercise of the powers and functions vested in him and will not, therefore, be covered by the immunity. Accordingly, where it transpires that a minister has acted illegally and abused his discretion and the illegality committed was not in the bona fide exercise of his powers and functions but on account of mala fides the immunity contained in Article 248(1) would not extend to protect such an act.”</p>
<p>Similar views were expressed by this court in Nawabzada Muhammad Umar Khan’s Case (1992 SCMR 2450) which were as under: “Secondly, where allegations of mala fide of fact are involved or alleged, it is necessary that the parties against whom such mala fide of fact is alleged must be impleaded as a party so that it has occasion to meet the allegation. This is notwithstanding the constitutional protection enjoyed by such functionaries under Article 248 of the Constitution vide Amanullah Khan and others Vs the Federal Government of Pakistan through secretary, Ministry of Finance, Islamabad, and others (PLD 1990 SC 1092).”</p>
<p>While there are such specific rulings and judgments given by the Supreme Court itself, the latest being on December 24, 2009, a new case filed by Khalid Khwaja is again before the Supreme Court to give another judgment on the subject.</p>
<p>The prime minister has promised in Parliament that he would act if the SC clarified the ambiguity, although after reading the Dec 24, 2009, judgment of Justice Ramday, there is no ambiguity left, an expert said, lamenting that perhaps no one in the government had bothered to go through this detailed judgment that has squarely discussed the issue of President’s immunity.<a href="http://www.thenews.com.pk/top_story_detail.asp?Id=26955"></p>

This is a slap in the face to China, as China sees Taiwan as part of China so this sale is a sign of double-talk by the U.S. in stating there&#8217;s a &#8220;One China Policy&#8221;.  China has announced it has suspended mutual military visits with the United States.  Next, China will most likely not support sanctions against Iran as a &#8220;pay-back&#8221;. <p>What would the world think if Russia or China were number one in Arms Sales World-Wide?  What would the U.S. say?  In 2008, the U.S. sold $37.8 BILLION U.S. Dollars in sales, a total of 68.4% of all World-Wide Arms Sales.  Guess who was in Second Place?  Guess how much they sold? China?  Russia?  No, it was Italy.  Yes, Italy was second in a total of 3.7 Billion in sales (10% of the total U.S. sales).  And Russia was #3 with 3.5 Billion in Arms Sales.</p>

<p>How is the United States for World Peace while supplying the World with Arms to kill other human beings?  The U.S. is in a War Ecomomy, the only export of any size is Military Equipment and Deadly Arms. "The United States was the leader not only in arms sales worldwide, but also in sales to nations in the developing world, signing $29.6 billion in weapons agreements with these nations, or 70.1 percent of all such deals."</p>
<p><strong>How to get international troops out of Afghanistan, and replace them with local forces? That was the crunch issue being discussed at a 70 nation conference on the future of the war-torn country.</strong></p>

<p><strong>The release of two cables sent by U.S. Ambassador Karl Eikenberry reveal how our course in Afghanistan is wrong, sending more troops is the wrong thing to do.  Ray McGovern posts the following story covering the two memos and how things work in the CIA and White House relations on when a National Intelligence Estimate (NIE) is needed and how none was done prior to the troop increase announced by President Obama. <p>President Put Politics First on Afghanistan<br />

<p>Nothing highlights President Obama&#8217;s abject surrender to Gen. David Petraeus on the &#8220;way forward&#8221; in Afghanistan than two cables U.S. Ambassador Karl Eikenberry sent to Washington on Nov. 6 and 9, 2009, the texts of which were released Tuesday by the New York Times. </p>
<p>No longer is it possible to suggest that Obama was totally deprived of wise counsel on Afghanistan; Eikenberry got it largely right.  Sadly, the inevitable conclusion is that, although Obama is not as dumb as his predecessor, he is no less willing to sacrifice thousands of lives for political gain.</p>
<p>Ambassador Eikenberry, a retired Army Lt. General who served three years in Afghanistan over the course of two separate tours of duty, was responsible during 2002-2003 for rebuilding Afghan security forces.  He then served 18 months (2005-2007) as commander of all U.S. forces stationed in Afghanistan.</p>
<p>Straight Talk</p>
<p>In the cable he sent to Washington on Nov. 6, he explains why, &#8220;I cannot support [the Defense Department's] recommendation for an immediate Presidential decision to deploy another 40,000 here.&#8221;  His reasons include: </p>
<p>~Afghan President Hamid Karzai is not &#8220;an adequate strategic partner.&#8221;  His government has &#8220;little to no political will or capacity to carry out basic tasks of governance. &#8230; It strains credulity to expect Karzai to change fundamentally this late in his life and in our relationship.&#8221;</p>
<p>~Karzai and many of his advisers &#8220;are only too happy to see us invest further.  They assume we covet their territory for a never ending ‘war on terror&#8217; and for military bases to use against surrounding powers.&#8221; </p>
<p>[Comment: I wonder where Karzai ever got that idea about military bases-perhaps because we are building them?  I'll bet Karzai also assumes continuing U.S. interest in the projected oil/natural gas pipeline from the extraordinarily rich deposits in the Caspian Sea area and Turkmenistan through Afghanistan to the Arabian Sea, bypassing both Russia and the Strait of Hormuz. ]</p>
<p>~&#8221;The proposed troop increase will bring vastly increased costs and an indefinite, large-scale U.S. military role.&#8221;</p>
<p>~&#8221;We overestimate the ability of Afghan security forces to take over&#8230;by 2013. &#8230; and underestimate how long it will take to restore or establish civilian government.&#8221;</p>
<p>~&#8221;More troops won&#8217;t end the insurgency as long as Pakistan sanctuaries remain&#8230;and Pakistan views its strategic interests as best served by a weak neighbor.&#8221;</p>
<p>~&#8221;There is also the deeper concern about dependency. &#8230; Rather than reducing Afghan dependence, sending more troops, therefore, is likely to deepen it, at least in the short term.  That would further delay our goal of shifting the combat burden to the Afghans.&#8221;</p>
<p>More Straight Talk</p>
<p>Eikenberry is even more direct in his cable of Nov. 9, taking strong issue with &#8220;a proposed counterinsurgency strategy that relies on a large, all-or-nothing increase in U.S. troops,&#8221; and warning of the risk that &#8220;we will become more deeply engaged here with no way to extricate ourselves&#8230;&#8221;  Condemning Gen. Stanley McChrystal&#8217;s recommendations with faint praise, Ambassador Eikenberry describes them as &#8220;logical and compelling within his [McChrystal's] narrow mandate to define the needs for a military counterinsurgency campaign within Afghanistan.&#8221; </p>
<p>&#8220;Unaddressed variables,&#8221; says Eikenberry, &#8220;include Pakistan sanctuaries, weak Afghan leadership and governance, NATO civilian-military integration, and our national will to bear the human and fiscal costs over many years.&#8221;  He complains that the troop increase proposal &#8220;sets aside&#8221; these variables, even though &#8220;each has the potential to block us from achieving our strategic goals, regardless of the number of additional troops we may send.&#8221; </p>
<p>The ambassador also notes that it is hardly a safe assumption that Karzai and his new team will ever be &#8220;committed to lead the counterinsurgency mission we are defining for them,&#8221; noting that Karzai &#8220;explicitly rejected&#8221; McChrystal&#8217;s counterinsurgency proposal when first briefed on it in detail.</p>
<p>Eikenberry does not stop there.  Rather, he bluntly warns-in vain, it turned out-against a premature decision regarding a troop increase, arguing &#8220;there is no option but to widen the scope of our analysis and to consider alternatives beyond a strictly military counterinsurgency effort within Afghanistan.&#8221;  He adds:</p>
<p>~&#8221;We have not yet conducted a comprehensive, interdisciplinary analysis of all our strategic options.  Nor have we brought all the real-world variables to bear in testing the proposed counterinsurgency plan.&#8221;</p>
<p>~&#8221;This strategic re-examination could either include or lead to high-level U.S. talks with the Afghans, the Pakistanis, the Saudis and other important regional players-including possibly Iran. &#8230;&#8221;  </p>
<p>Extraordinary.  Here is the U.S. ambassador to Afghanistan bemoaning the fact that, as the President approaches his decision on a large troop increase, there has still been no comprehensive analysis of the wider issues that remain &#8220;unaddressed&#8221; in McChrystal&#8217;s proposal.</p>
<p>NIEs</p>
<p>Taking an objective look at a complex national security problem is precisely the job for which President Harry Truman created the CIA, giving its director the task of drafting what became known as National Intelligence Estimates-a process in which all agencies of the intelligence community can take part. </p>
<p>That no estimate has been prepared on Afghanistan/Pakistan and the &#8220;unaddressed variables&#8221; is an indictment of President Obama and his deference to the military.  The President and other misguided Democrats are hell bent on preventing the bemedaled Petraeus, a likely Republican candidate for president in 2012, from painting them soft on terrorism.  Letting Petraeus run the policy, while avoiding any critical intelligence analysis, is Obama&#8217;s safe-and cowardly-way out. </p>
<p>During my tenure at CIA (from the administration of John Kennedy to that of George H. W. Bush), I cannot think of an occasion on which a President chose to forgo a National Intelligence Estimate before making a key decision on foreign policy.  However, in early 2002, President George W. Bush and Vice President Dick Cheney set a new kind of precedent when they ordered CIA Director George Tenet NOT to prepare an NIE on weapons of mass destruction in Iraq, out of fear that an honest estimate would make it immensely more difficult to attack Iraq.</p>
<p>That did not change until September 2002, when Sen. Bob Graham, then-chair of the Senate Intelligence Committee, warned the White House that, absent an NIE, he would do all he could to prevent a vote on war with Iraq.  That&#8217;s when a totally dishonest NIE was woven out of whole cloth (or, in the words of subsequent Intelligence Committee chair, Sen. Jay Rockefeller, fashioned from &#8220;created&#8221; intelligence) to hype a threat from non-existent Iraqi WMD.</p>
<p>After that debacle, new leadership was given to the NIE process in the person of Tom Fingar who had run the intelligence unit at the State Department.  It was Fingar who insisted on a bottom-up review of intelligence on Iran&#8217;s nuclear plans, which resulted in an NIE that helped prevent Bush and Cheney from attacking Iran-or encouraging Israel to do so.</p>
<p>That NIE, issued in November 2007, assessed &#8220;with high confidence&#8221; that Iran had stopped working on the nuclear weapons part of its nuclear program in late 2003, directly contradicting claims of Bush and Cheney at the time.</p>
<p>Of equal importance, the Joint Chiefs of Staff and other senior military had no appetite to take on Iran (or to acquiesce in Israel&#8217;s doing so) and insisted that the key judgments of that NIE be made public.</p>
<p>This time, on Afghanistan, it&#8217;s different.  Army generals Petraeus and McChrystal apparently persuaded the Chairman of the Joint Chiefs, Admiral Mike Mullen, that they knew what they&#8217;re doing and didn&#8217;t need any intelligence analysts reaching troublesome conclusions. </p>
<p>What&#8217;s the Rush? </p>
<p>From his vantage point in Kabul, Eikenberry seems impervious to Dick Cheney&#8217;s charges that the President is &#8220;dithering.&#8221;  The first two (of three) subheadings in Eikenberry&#8217;s second cable are:  &#8220;We Have Time&#8221; and &#8220;Why We Must Take the Time.&#8221;  He finishes with an appeal to &#8220;widen the scope of our analysis.&#8221;</p>
<p>Eikenberry is all but demanding a National Intelligence Estimate, but stops short so as not to cross the President or rub salt in the wounds that the ambassador&#8217;s cables have opened in Petraeus and McChrystal.</p>
<p>Instead of requesting an NIE, Ambassador Eikenberry suggests that the White House appoint &#8220;a panel of civilian and military experts to examine the Afghanistan-Pakistan strategy and the full range of options.&#8221;  The list of issues he says this panel &#8220;should examine&#8221; reads very much like what the intelligence community calls &#8220;Terms of Reference&#8221; for an NIE.  (As a CIA analyst and manger I contributed to many NIEs and chaired some myself.)</p>
<p>When the White House gave Eikenberry short shrift, he should have resigned, rather than support the misbegotten strategy Obama chose.</p>
<p>Leakophobia</p>
<p>Part of Obama&#8217;s motivation in not ordering the customary NIE was to avoid any chance that its conclusions might leak, according to a source with good access.  Assuming that intelligence community estimators have not regressed to the Bush/Cheney days of cooking estimates to order, such a leak would certainly have made it more difficult for the President to render unflinching support to Petraeus and McChrystal. </p>
<p>Pity Obama.  It is hard to believe he could be so naive to the ways of Washington and so dismissive of the possibility that there could still be some courageous patriots among the senior officials dismayed at his remarkable retreat from the &#8220;transparency&#8221; he promised.</p>
<p>The New York Times reports, &#8220;An American official provided a copy of the cables to The Times after a reporter requested them.&#8221;  Well, good for that patriotic truth-teller.  And good, as well, for the New York Times for publishing the cables.  I am permitting myself to hope that still more truth-tellers will emerge from the woodwork, and even that The Times might begin to play the kind of key role it did 40 years ago, once it finally brought itself to concede that Vietnam was a fool&#8217;s errand.</p>
<p>NODIS</p>
<p>It may be that one needs to have worked at senior levels on the &#8220;inside&#8221; to understand the twinge that I felt after downloading the NODIS cables made available by The Times.  NODIS cables on my desk at home!</p>
<p>As the cover sheet indicates, &#8220;NODIS&#8221; means no dissemination beyond the named &#8220;addressee and, if not expressly precluded, by those officials under his authority whom he considers to have a clear-cut ‘need to know.&#8217;&#8221; (Emphasis added.  It is not entirely clear, but I assume that exceptions can now be made for the current Secretary of State and other senior officials of her gender.)</p>
<p>In my day we had to go to the CIA Director&#8217;s office, sign for, and read NODIS cables right there.  No doubt there are similar controls today.  So, in this case the whistleblower took considerable risk in taking it upon him/herself to make &#8220;transparency&#8221; real, not just Obaman rhetoric.</p>
<p>The irony?  If, as I have been told, the President put the kibosh on preparation of an NIE for fear it would leak, we now have an even more instructive kind of leak.  Thanks to The Times and its courageous source, we now know not only that President Obama elected to forgo an honest NIE, but that he did so in the face of very strong urging from Ambassador Eikenberry to &#8220;widen the scope&#8221; of analysis, and not simply kowtow to the Army brass. </p>
<p>I imagine that in years to come, Eikenberry will proudly show his cables to his grandchildren.  Or maybe he won&#8217;t, out of fear that one of them might ask why he didn&#8217;t have the guts to quit and let the rest of the country know what he really thought of this latest March of Folly.</p>
