Sentence of full incarceration reversed and restitution order vacated in vandalism case

The Tennessee Court of Criminal Appeals recently reversed a fully incarcerative sentence and vacated a restitution order in a vandalism case.

Regarding the sentence, Tennessee Code Annotated section 40-35-122 does not authorize a trial court to sentence a defendant convicted of felony vandalism under $1,000 to full incarceration unless he has a prior felony conviction or has violated the terms and conditions of an alternative sentence.  236 more words
